At a regular meeting of the Town Board of the Town of Ithaca , Tompkins County,
New York held at the Town Hall , 126 East Seneca Street , Ithaca , New York there were
present :

Call To Order: The Supervisor called the meeting to order at 10 : 08 a . m . , and led the
assemblage in the Pledge of Allegiance .
Agenda Item No . 3 - Reports of Town Officials :
a . Supervisor Whitcomb - You all have a copy of the Supervisor's Annual Report . The
report outlines what I felt were the accomplishments of the past year in Administration
and Finance , Planning , Zoning and Engineering , Highway and Parks , and
Intermunicipal cooperation including projects that are in various stages if completion .
I 'd be happy to answer any questions you might have about those , either now or later.
Mrs . Noteboom - Tax bills are being sent to property owners today.
A special thanks to Deputy Betty Poole and Deputy Mary Saxton and all those who
helped get them ready and sent .
Agenda Item No . 18 - Small Cities Community Development Block Grant :
Mr. Kanter - The County on behalf of communities in Tompkins County applies for
federal grants through Housing and Urban Development for the Small Cities
Community Development Block Grant Program . This proposed program , the county
has an economic development program for monies to provide low interest loans to
businesses in Tompkins County to create jobs for low income individuals .
The prepared resolution would authorize Tompkins County on behalf of the Town of
Ithaca to apply for 1996 funds to be put into a revolving loan fund to provide low
interest loans to businesses that would qualify under those guidelines .
Mr. Hanson - I really appreciate the fact that you were willing to listen about the
proposal because it means jobs for Tompkins County. My staff and I will write the grant
on behalf of the town . The county will administer the program and handle the books
and all necessary documentation . The Attorney for the Town prepared the resolution ,
and the County Attorney has reviewed and approved it .
The grant will provide low interest loans to businesses that will provide jobs . The jobs
have to pay at least $ 18 , 000 a year so they are decent jobs . The first priority goes to
low and moderate income people that reside in the town . Typically, there is an
oversight committee made up of the local jurisdiction to review the application and help
the county in administering the money, We will look to both Catherine Valentino and
Jonathan Kanter to participate on the oversight committee . The grant is rather flexible .
The oversight committee meets with the business or industry and negotiates the rate of
interest for the loan . It' s usually fairly low , such as around 4% . The loan is paid back
over a negotiated flexible time span , around five years but certainly not longer than ten ,
which would be an extended period . This allows the company to put the money
together with its other financial assets to develop new products .
In this case , we are talking with one of the corporations within the Town of Ithaca .
They are very much interested in developing a new product . With this project and loan
program they could add eighteen jobs the first year.
All the County is asking of the town is to participate in the oversight of the
administration of this loan .
Councilwoman Harrison - This is 100 % funded by HUD .
Mr. Hanson - Yes , HUD will pick up all the risk , that is the appeal of this type of project .
The banks are not willing to underwrite programs . In this case , the corporation

informed me that they would have to pay ten percent for aline of credit and that will just
devastate product development . That' s just one of the .big problems .
Councilwoman Grigorov - The application says that production jobs will pay
approximately $ 18 , 000 a year that fills the requirement that they be lower income
employment . Is there an upper limit on the money for jobs ?
Mr. Hanson - There' s some flexibility involved , but it is a HUD grant and what they want
them to do is to have low income individuals get the jobs . This particular company is
interested in bringing in technical people . It will allow them some expansion in the
upper level jobs as well .
Mr. Kanter - Is the HUD guideline 60% of median ?
Mr. Hanson - I can 't remember exactly but there is some flexibility with these economic
development grants . It' s pretty fair to say that you ' re dealing with a baseline of around
$ 18 , 000 or better.
Councilman Klein - Since the money is being paid back to the county, does the county
already have a fund for the project?
Mr. Hanson - Yes , it' s a revolving loan project and the oversight committee would have
a say in where that money goes and job development . The interesting thing about
these grants is that the company has to state the facts on job creation and job
retention . The new people employed have to sign statements so monitoring can occur
showing how many jobs are actually created through these loans .
Councilwoman Grigorov - Is there a time limit of how long the business has to stay in
the county after they use the program ?
Mr. Hanson - Since it is a loan program the paper work will follow them . In this case I
know that they don 't want to leave . They have to pay off the loan , they can 't walk away
from it.
Councilwoman Grigorov Not the loan , but the benefit to the county and town would be .
Mr. Hanson - That's right .
Councilman Klein - Did this company approach your Department or were you out
seeking companies ?
Mr . Hanson - The County made an announcement on the Small Cities Community
Development Block Grant program and worked with TCAD and other lenders in the

community and seek out companies that are looking for risk capital . It worked both
ways they did contact us but we were actively looking for them as well .
Councilman Klein - I ' m glad to see the town participating in this , we have often talked
about our weak industrial sector.
Resolution No . 265 - Authorization Small Cities Community Development Block Grant:
Motion made by Councilwoman Harrison , seconded by Councilwoman Grigorov
authorizing Tompkins County to apply for Small Cities CDGB funds on behalf of the
Town of Ithaca to the HUD office in Buffalo , New York, for program funds for the
County's Economic Development Program as part of the 1996 funding round , and
authorizing the Supervisor to sign any necessary documents to implement this
application . This approval is made with the understanding that the Town of Ithaca shall
not be required to enter into any indemnification agreements with Tompkins County or
any other federal , state , or local governmental entity.

Agenda Item No . 3 - Reports of Town Officials , Cont' d :
Mr. Kanter - The Ithacare final environmental impact statement was accepted by the
Planning Board at the December 9th meeting . It has been distributed to all involved
and interested agencies . Although there' s no formal comment period we are giving an
opportunity for the public to comment until January 8th and then the statement of
findings has to be adopted by the Planning Board , hopefully by the January 23 ,
meeting . I know that several of the Town Board did make comments on the draft
Environmental effect statement , you may want to take a look through the FEIS and see
whether those have been adequately addressed . There is still an opportunity to send
additional comments to the Planning Board ,
The Planning Board ' s task now is to complete the SEQR process , produce their
statement of findings , and move on with site plan approval . There is the possibility that
some action could be coming back to the Town Board if the special land use district
has to be modified for any reason . Several of the alternatives that the Planning Board
has been looking at in the Environmental Impact Statement probably would require that
re- evaluation by the Town Board .
Attorney Barney and I have been working on further revisions to the Six Mile Creek
Conservation District subsequent to the joint Codes and Ordinances , Planning
Committee meeting . We had hoped it would be ready for the January board meeting
for discussion , but that doesn 't look possible .

There is good news regarding the ISTEA grant application submitted for the East Ithaca
Recreation Way extensions . The State Department of Transportation has indicated the
proposal is eligible under the ISTEA guidelines , therefore we will be submitting the full
final application by January 16 , 1996 ,
Agenda Item No 5 - PERSONS TO BE HEARD :
No persons came forward to be heard .
Agenda Item No 4 - Reports of Town Committees :
Councilwoman Harrison - The committee work on the Cornell SLUD is completed . The
transportation committee has it' s first meeting the 8th of January.
Councilman Klein - Public Works Committee minutes were sent in the Town Board
packets . Gail Kroll , Highway Secretary is doing an excellent job preparing them .
Councilwoman Valentino - I talked to the new person that' s in charge of Time Warner
about the complaints on the new converters . It was a lengthy conversation where he
explained quite a few of the regulations that Time Warner must adhere to . I intend to
talk to Hugh Kent of Attorney Barney Is office to follow up on the information that I got , I
will then send a letter to Time Warner . Basically , as far as cable is concerned , the
Town is pretty much stuck with what we 've got .
Councilman Klein - What did the information we received in the packet regarding cable
mean ? What is it we are doing , renewing our Time Warner franchise , are we operating
under the old one ?
Councilwoman Valentino - Every few months Time Warner has to apply to the state to
get an extension to operate because we haven 't renewed our franchise with them .
We ' re still operating under the franchise from 1993 and the law states that as long as
we keep getting these extensions and renewals , that they are mandated to follow the
old franchise . Hugh Kent and I have been communicating since the franchise ran out .
I reported to the Town Board from time to time that we haven 't found that it would be in
the Town 's best interest to renew that franchise during this period because every few
months we get new regulations from the FCC . Since the state cable commission is
pretty much defunct , and because there' s been so many changes on a weekly and
monthly basis we haven ' t felt that it would be in our best interest to lock ourselves into
anything until this sorts itself out .
Councilwoman Grigorov - Can we provide the information received in our packets to
citizens ?

Councilwoman Valentino - Yes , it is a matter of public record .
Correspondence :
Supervisor Whitcomb - I have a letter here from Chuck Moynehan Regional Director,
New York State Department of Transportation to Fred Noteboom to acknowledge the
receipt of our inquiry about a school speed zone at the location of East Shore Drive
and Boynton Middle School . A formal investigation will be conducted and upon
completion the town will be notified of the results .
Agenda Item No . 6 - Presentation Blue Cross Blue Shield :
Councilwoman Valentino - We asked that a presentation not be made at this time . If
you remember the conversation about the retirees and there not being a proper policy
regarding them , and that the other policy we have is sort of a dinosaur. We started
having conversations with the Blue Cross/Blue Shield people about taking the retirees
out of the basic plan . When doing so it ended up that -the rate went up so high for our
basic coverage that it ended up costing us more than if we had left the retirees on the
plan . This is totally ridiculous because it's saving Blue Cross Blue Shield a lot of
money for these people to be on Medicare . I instructed Mr. DiSanto to call Blue Cross
and Blue Shield tell them that their proposal was totally unacceptable with those
increased rates , that they must have made a mistake and to re-check their numbers . In
the meantime I 've instructed Sherm to start shopping for other insurance carriers .
Mr. DiSanto - Just before this meeting we received a twenty seven page facsimile from
Blue Cross Blue Shield , but there was not enough time to review it .
Councilwoman Valentino - We have some other ideas pending .
Agenda Item No . 7 - Consent Items :
Mrs . Noteboom - I would like to delete the approval of the Town Board minutes of 12/ 11
they are not finished because of the additional work related to the tax bills .

Agenda Item No . 14 - R duction of Number Members Planning Board :
Mr. Barney: The law changed a couple of years ago stating if you had a Town Planning
Board you could have either 5 or 7 members plus one additional agricultural member.
When they changed the Zoning and Planning Laws back in 1993 , they changed it to
say that you could have 5 or 7 members including one or more than one agricultural
member.
The resolution presented is correcting the number of our Planning Board membership
by reducing it down . We presently have 7 members plus an agricultural member. The
resolution will reduce the membership to 7 including an agricultural member. I think by
law we probably ought to do it .
Councilwoman Harrison - How many potential agricultural members are there in the
Town of Ithaca?
Mr. Kanter - Maybe five .
Councilwoman Grigorov- There used to be seven .
Councilwoman Harrison - Does it make sense to tie ourselves in law to having gone of
those five people serve on the Planning Board ? What happens , if Ainslee retires and
we don 't find a substitute ?
This resolution says at least one member shall be an agriculture member. f
Mr. Barney - I is a decision for the Town Board ,
Councilwoman Harrison - It' s reducing the number, but this still would require us to
have an agricultural member. I 'm not philosophically opposed , I obviously think
maintaining agricultural viability is great but is tying us to that logical ? Is it advisable
for us to leave that in or shall we say that we will do our best as a policy matter to
recruit somebody representing that interest?
Councilwoman Grigorov - I think if that time came there wasn 't someone available we
could change the law again at that time .
Mr. Barney - It' s just a resolution , you can do whatever you like , although the point is
well taken . There' s nothing to prevent you from continuing to appoint 7 agricultural
members . Regardless of what you state in the resolution , this does basically compel
looking for an agricultural member if Mr. Ainslee retires or leaves the Board . It would
require at that point adopting a new resolution .
Councilman Klein - If instance we did not have a candidate that seat would be vacant ,
because this requires us to have an agricultural member . It would actually be vacant

until we revised the law.
Mr. Barney - I included this requirement because I know that the Town 's philosophy has
been to encourage agriculture , but in my opinion I would take it out because as you
govern that appointment you can do it by trying to appoint an agricultural member.
Councilwoman Grigorov - So we could just leave it out of this resolution ?
Mr. Kanter - I would simply mimic what the state law says and just say " may" instead
of shall" . Then you have the reference but you are being consi
" stent with the state law.
Councilman Klein - What about the term of office , currently the agriculture member has
the five year term and the other members have the seven year term ? Should we do
away with the five year term ?
Mr. Barney - : We probably should have a statement that all members have a seven
year term .
Councilman Klein - Would that effect Jim Ainslee now?
Mr. Barney - No , any future appointments shall be for a period of seven years .
Supervisor Whitcomb - So there should be another resolve that all future seats of
appointments shall be for a seven year term .
Resolution No . 14 :
Motion made by Councilwoman Grigorov, seconded by Councilwoman Harrison that the
size of the Planning Board be reduced from eight members to seven members ,
effective January 1 , 1996 . At least one member of such Board may be an individual
who derives ten thousand dollars or more annual gross income from agricultural
pursuits , as defined in Section 271 of the Town Law and Section 301 of the Agriculture
and Markets Law. Each seat shall be for a seven year term with the terms staggered
so that one term expires each year.

Agenda Item No 15 - Planning Board Zoning Board of Appeals Appointments •
Councilman Klein - Candace Cornell and I represented the Boards on the Interviewing
Committee . Ms . Cornell and I fully support the reappointment of Fred T. Wilcox, III . to
the Planning Board .

Resolution No . 260 :
Motion made by Councilman Klein , seconded by Councilwoman Grigorov appointing
Fred T. Wilcox, III . to serve on the Town of Ithaca Planning Board for a term of office
commencing January 1 , 1996 through December 31 , 2002 ,
Supervisor Whitcomb , aye ; Councilwoman Valentino , aye ; Councilman Klein , aye ;
Councilwoman Grigorov, aye ; Councilwoman Harrison , aye ; Councilman Conley, aye .
Carried unanimously.
Councilman Klein - The Interviewing Committee was unable to meet with Mr. Ellsworth ,
however I have worked with him on the Codes and Committee and would
certainly support his reappointment.
Resolution No . 262 :
Motion made by Councilman Klein , seconded by Councilwoman Valentino appointing
Harry E . Ellsworth to serve on the Town of Ithaca Zoning Board- of Appeals for a term
commencing January 1 , 1996 through December 31 , 20000
Supervisor Whitcomb , aye ; Councilwoman Valentino , aye ; Councilman Klein , aye ;
Councilwoman Grigorov, aye ; Councilwoman Harrison , aye ; Councilman Conley, aye .
Carried unanimously .
Mrs . Noteboom - There is still one vacant seat on the Zoning Board of Appeals and we
have not received any notification of interest in this seat.
Councilwoman Grigorov - There should probably be a revision made to the resolution
setting up the Interviewing Committee because they shall bring back two names for
consideration to the Town Board .
Mr. Barney - If Mr . .Ainslee has a five year term on the Planning Board and we have
reduced the number to seven , we need to make sure there are not two terms expiring in
the same year.
Agenda Item No 16 = Appointment Planning Board Chair:
Supervisor Whitcomb - The Planning Board is recommending the appointment of
Candace Cornell as the Planning Board Chair for 1996 .
Resolution No . 262 :
Motion made by Councilwoman Valentino , seconded by Councilman Klein that the
Town Board hereby appoints Candace Cornell to serve as Chair of the Planning Board

for a term of office commencing January 1 , 1996 through December 31 , 1996 ,

Councilwoman Grigorov, aye ; Councilwoman Harrison , aye ; Councilman Conley, aye .

Agenda Item No 16 - Appointment Zoning Board of Appeals Chair:
Mr. Barney - There is a recommendation from the Zoning Board of Appeals that David
Stotz be appointed Chair of the Zoning Board of Appeals for 1996 .
Councilwoman Harrison - How many member so the Zoning Board of Appeals are
there?
Supervisor Whitcomb - Five .
Councilwoman Grigorov - You are short one member, and one member is new.
Mr. Barney - The current veterans are Edward King who refused to be considered as
Chair. He would be the logical choice . Harry Ellsworth and David Stotz are the other
long term members . The consensus of the Zoning Board was that when Edward King
refused the position , Mr. Stotz was the best choice .
Resolution No . 2630,

Mr. Barney - The agreement with the SCLIWC actually compels the Town Supervisor to
serve because the Supervisor also serves as Treasurer of the SCLIWC as Fiscal
Officer of the Town of Ithaca .

Councilwoman Valentino - There is one appointment which is not included . The City
Youth Bureau Board because with the change over to the Recreation Partnership each
municipality has its own system for its internal operations . It does not make sense for
us to have someone seated on the City Youth Bureau anymore , even though the City
did request it .
Mrs . Noteboom - There are still vacancies on the Zoning Board of Appeals , the Ethics
Board and several committees . The Supervisor will be making other appointments after
January 1 , 1996 .
1 will be again advertising for people to apply to serve on these boards and committees
next week.
Agenda Item No . 19 - Planimetric Digital File Agreement :
Mr. Walker - We have been working with the City , the County , and NYSEG on the
planimetric digital map because of certain copy right requirements and issues dealing
with information . NYSEG has retained ownership of the mapping because they have
contributed the most funding for it . The Town of Ithaca , the City, the County and now
the Town of Dryden have paid money into the project and in return for that have a
license to use the digital data for their own purposes . Each entity cannot sell the
product , and there is really no need to do so .
The original license agreement is expiring at the end of the year , this is an extension of
that agreement. One of the issues being worked on is finding funding0for maintenance .
This agreement does not obligate and specific costs to the Town , but there is a
responsibility to share in 1997 and 1998 . NYSEG has been selling licenses to other
municipalities and the County is working with others to sell the product and put that
money in reserve for the maintenance and update costs in the future . The more
municipalities that buy into the program , the less it will cost to the existing partners for
the future maintenance .

The Town does not have a breakdown of all the costs yet. It will include a new update
of the maps in 1997 and 1998 .
Councilwoman Valentino - I was concerned when reviewing this because it shows a
percentage of the cost the Town will have . How was this percentage arrived at, it was
quite high . Cornell University' s was extremely low.
Mr. Walker - The formula was complex because there are different levels of mapping .
It is not just a straight mile computation . There was the area of mapping and the level
of detail . The City has a much smaller area , but they have the most detail .
Cornell was paying for their main campus area within the Town . They have properties
over the whole county, but the primary area of concern was the campus . Most of
Cornell' s area is within NYSEG ' s service area , and NYSEG picked up a much larger
share of those portions of the mapping because they needed that level of detail beyond
what they were already purchasing . In the Town and the rest of the County there were
large areas NYSEG was not mapping as part of the groups needs .
Councilwoman Valentino - Isn 't it dangerous for the Town to agree to a percentage of
some unknown formula in the future? We have no idea what this will cost.
Mr . Walker - We do have estimates that the cost will be in the $ 100 , 000 range . The
anticipated cost portion to the Town will be around $ 10 , 000 to $ 15 , 000 . The original
investment was $ 15 , 000 for the original map in 1992 .
Councilwoman Valentino - Doesn 't this lock the Town into paying whatever the cost
might be ?
Mr. Walker - No , because the Town Board has to approve what ever they would pay.
The project would have to be approved by this Board .
Councilwoman Valentino - The percentage that we are committed to at this point seems
correct?
Mr. Walker - Right , this is a fair percentage based upon the value of the product the
Town is getting , and the alternative methods of obtaining that product . The Planning
Department uses the data extensively , the County Planning Department uses the
information to develop their parcel maps .
Councilwoman Valentino - It seems that we are giving them a great deal of authority.
Councilman Klein - Paragraph 9 , protects us . If we do not agree to the update the
Town does not participate .

Mr. Barney - It states , ° subject to the parties agreement to such maintenance" . Clearly
the Town has to agree that there should be the maintenance and that the cost is
something you can accept. Then if the Board does not like the intended percentages
they can be negotiated .
Councilwoman Valentino - I just want to be very clear on the terms .
Councilman Klein - It makes me nervous to agree to a percentage when there is no
dollar amount.
Mr. Walker - The Town Board still has to approve the actual project when it is started.
Resolution No 266 •
Motion made by Councilman Conley, seconded by Councilwoman Harrison authorizing
and directing the Town Supervisor to enter into an agreement with the County of
Tompkins , City of Ithaca , Cornell University, and the New York State Electric and Gas
for the control and use and distribution of the Planimetric Digital File with the
amendments to the agreement as recommended and approved by the Attorney for the
Town . The said term of the agreement shall commence upon execution by all parties at
least through December 31 , 1997 ,

Agenda Item No 20 - Sfatua.RepQrt Slaterville Road Sanitary Sewer
Mr. Walker - We are still waiting for a commitment other than verbal from the Town of
Dryden and the developer on the recreation contribution for the park land in Eastern
Heights . The Town has not accepted the sewer.
Mr. Barney - The Town of Dryden has approved it and wants us to sign that portion of
the agreement which relates to the meter pit.
Mr. Walker - There is a cost estimate and design for a basketball court in the park that
verbally the developer ( Mr. Varn ) has agreed to . The financial security portion of that is
the problem .
Mr. Barney - Weren 't we supposed to send Dryden the cost estimates and design for
that , including a statement that we are not comfortable with only the developer' s verbal
promise .

Supervisor Whitcomb - It will be necessary next year for the Board to stay abreast of
the developments of this situation .
Agenda Item No 21 - Drug and Alcohol Testing Policy and Procedures :
Supervisor Whitcomb - The Town is required to adopt a testing policy before January 1 ,
1996 , Mr. Noteboom and Mr . Hugh Kent of the Attorney' s office have reviewed this .
Mr. Barney - The proposal is to adopt the one prepared by Mr. Kent which is fairly
comprehensive and related to the regulations . Mr. Noteboom thinks that there may be
some changes he would like to make. Those can be made after this policy is in place .
Mr. Noteboom - This is a comprehensive policy as written by Mr. Kent , but there are
certain questions in it that might affect the Town which we may which to set policy on
along with this . Such as , if one certain things happens we want to see some of the
consequences outlined more clearly . That way we know everyone will be treated the
same under the same circumstances .
Supervisor Whitcomb - Mr. Noteboom , do you object to adopting this policy as written
by Mr . Kent .
Mr. Noteboom - I do not object .
Supervisor Whitcomb - I recommend that the Public Works Committee or the Personnel
Committee address the questions and concerns Mr. Noteboom is referring to as soon
as possible .
Councilman Klein - The Public Works Committee has discussed these concerns to
some extent , but they have not been incorporated into this policy .
Mr. Noteboom - I still would like to deal with Mr . Kent so that we don 't have a legal
problem .
Councilman Klein - Since this has to do mostly with the Highway Department , it is
appropriate for the Public Works Committee to address these issues .

Agenda Item Additional No 2 - Benefit Assessment Refunds :
Mr. Walker - When the tax bills came it was found there were still a number of errors on
them which we have been trying to correct for several years . This year was even more
interesting because some individuals were doubled charged the benefit assessment as
well as the pennies .

The changes were sent to the County, and five of the changes we made last year were
inadvertently put into the right category of the pennies charge, but neglected to
withdraw the benefit assessment . The one to the County, on Orchard, and the one to
Mrs . Mead did not get changed properly. The benefit overcharges have been
calculated and letters are being prepared to be sent with the tax bills so the refunds
can be made immediately upon the taxpayer having paid the bills in full . The refund
check will be issued immediately.
Mrs . Noteboom - Betty Poole deserves the credit for finding these errors , she is always
very thorough and consequently found the mistakes .
Mr. Walker - Part of the problem has been that the process has been compressed to
occur towards the end of the year, this is not a good practice. Next year we will change
our operations to follow the County' s taxable status date to immediately review the
parcels .
Supervisor Whitcomb - I am pleased there will be a procedure in place to catch these
errors . In the past , taxpayers have had to wait for their refunds- because we cannot
alter the tax bill once it is printed . They will be given ' an immediate refund when they
pay their bill .
Mrs . Noteboom - The taxpayers will receive the letter of explanation separate from the
tax bill because we had to send the bill today by first class mail according to Real
Property Tax Law . The letters will also be sent today with a copy of the bill explaining
what happened .
Councilman Klein - What about those bills which are paid by escrow , are any of them
with a bank?
Mrs . Noteboom - We just found out about this problem yesterday.
Mr. Walker - I do not believe any are paid through an escrow agency.
Mr. Walker - We are responsible for three of these which slipped through out system ,
but many of them were not changed by the County Assessment Office as we requested .
It was also found in reviewing benefit assessments some of the tax parcels which were
changed by sub- divisions by our Planning Board were incorrectly redrawn on the maps .
They added parcels in one case that was not supposed to be created , and they forgot
to create three parcels where they really were .
We have met with the county officials involved , and we have asked them to send proof
copies of all the maps . We will be working much more closely with them .

Councilwoman Valentino - This is one of the priorities of next year, including looking
into some of the other things in the tax rolls which may be incorrect.
Resolution No . 270 :

authorizing the Fiscal officer to prepare refund checks to the property owners identified
for the amounts indicated . The Director of Engineering is directed to prepare the
refund applications for the owners and submit them to the Receiver of Taxes by
January 2 , 1996 . The Receiver of Taxes is authorized and directed to obtain the
signature of the property owner on the refund application , and present the refund check
to the owner, immediately upon receiving payment of the tax bill in full . The Director of
Engineering is directed to take the actions necessary to insure the accuracy of the
benefit assessments on the Town and County Tax Warrant in subsequent years .

from one half of any future sick time that the employee accrues until the extended time
is recovered (i . e . if the employee ' s extended sick leave amounts to six days , such
amount shall be deducted at the rate of one- half of a day for each day the employee
accrues in the future so that from the next twelve days accrued by the employee , six
days will be recovered by the Town and six days will be available for future sick leave
for the employee , or , in other words , the employee shall accrue only one- half the
normal time from future sick days until the extended time has been fully repaid ) . That
the decision to extend sick leave in this particular instance shall in no way be regarded
as a precedent for similar consideration for this or any other employee in the future .

SUPERVISOR ' S ANNUAL REPORT
December 29 , 1995
1995 has been another good year for the Town of Ithaca . Major efforts have been expended in
areas of more efficient personnel and financial administration , planning and zoning improvements,
public works and highway projects , and increased intermunicipal cooperation .
ADMINISTRATION AND FINANCE
The hard work and creative ideas of staff have resulted in increased efficiency in the accounting ,
personnel , and Town Clerk's offices .
Development and approval of the 1995 budget could not have been achieved without the assistance
of all Town department heads and staff. The Town Board has continued to hold the property tax
rate increases at or below the rate of inflation. This year the Townwide tax rate will increase only
33 % over 1994. Of particular note in budget preparation were Joan Noteboom and Sherm
Disanto , who worked diligently to provide accurate amounts for personal services and benefits for
both employees and retirees , Sally Alario , who cranked out iteration after iteration of the budget as
we worked toward the final goal , and Dan Walker who provided a systematic way of predicting
future water and sewer revenues . Andy Frost, Jon Kanter and Fred Noteboom also contributed by
providing their usual accurate , timely and conservative budget projections.
Working closely with Deputy Supervisor Cathy Valentino. Joan and Sherm also deserve high
praise for their work in achieving full Civil Service compliance for the Town . In addition, the
personnel department continues to monitor and revise Blue Cross/ Blue Shield medical insurance to
achieve excellent coverage at the most efficient rates .
After a four year search and the review of dozens of sites . the Town has selected a downtown
location for the new Town Hall . By the time construction is completed in late 1996, the Town will
have set aside $ 1 ,500 ,000 of the $2 . 000,000 cost in a reserve fund .
PLANNING AND ZONING and ENGINEERING
Planning , operating smoothly under the direction of Jon Kanter, can boast a number of
accomplishments and new initiatives . Andy Frost and the zoning department continues to receive
praise from customers as being strict but very fair, conscientious , and helpful . Dan Walker and the
engineering team has designed and assisted in the construction of a number of municipal projects.
This entire technical group continues to provide excellent service to the Town in the review and '
planning, of all development projects .
For years , the Town has had the right to require that 10% of the land in a new subdivision be set .
aside for park land or open space . Town of Ithaca subdivision regulations include a provision for
money in lieu of park land , but no guidelines for how these fees should be determined . In 1995
the Town Board adopted a fee schedule for assessing payments in lieu of where there is a
demonstrated need .
Town committees have also worked diligently to develop recommendations for adoption of a
conservation zone along Six Mile Creek . In addition , several parcels that were zoned multi -
residence years ago as a result of a specific needs at the time . are being reconsidered and may
eventually be rezoned as residential .
After five years of consideration , the Cornell special land use district for Precinct 7 was adopted by
the Town Board in December . Thanks to all involved . particularly , Ellen Harrison , John Barney ,
and Jon Kanter for their hard work , patience and perseverance .
After being delayed for over a year by a lawsuit , an adverse court decision , and the resulting EIS ,
it appears that Ithacare is once again close to final approval and construction . It is hoped that this

thorough review by the Planning department and Planning Board will adequately address the
concerns that led to the lawsuit and EIS .
After approval by the Town , construction of the Ecovillage project is well underway . Construction
of the Kendal retirement community continues on the former Savaae Farm in Cayuga Heights, as
the first residents move in . The first residential Hospicare facility has opened its doors on South
Hill ,
HIGHWAY AND PARKS
After Years of design and community debate, the Judd Falls Road reconstruction project is
complete ! The Forest Home Bridge reconstruction is planned for 1996. Fred Noteboom
continues to manage the highway department efficiently and effectively and the crew deserves high
marks for competence and dedication. Our parks system also continues to grow and prosper.
Rich Schoch and his team have received many compliments from residents for the fine appearance
of our parks. In concert with the Metropolitan Planning Organization (MPO) a number of new-

rails and pedestrian and bikeway linkages are being considered. The Town's parks and open
space plan is also being revised and updated in accordance with the Town's comprehensive plan.
INTERMUNICIPAL COOPERATION
The City , the County and the Town have pledged in concept to work more closely together, in
terms of land use planning and public works. The details of this arrangement will be discussed in
1996 .
Substantial progress was made toward revising the sewer contract by clarifying and updating the
language and attempting to resolve a long-standing disagreement with the City over approval of
new service .
The Town continues to participate in the Southern Cayuga Lake Intermunicipal Water
Commission . Two other municipalities have expressed an interest in joining .
Youth services for Town residents are being provided via a new pilot partnership arrangement
developed in cooperation with the City , the County , and neighboring towns and villages .
The 1994- 1999 Transportation Improvement Plan was approved by the Metropolitan Planning
Organization ( MPO) , a partnership of local , state and federal entities . Projects totaling over $77
million for highway improvement , bridge replacement . public transit, and alternate modes of
transportation are planned throughout Tompkins Counrv .
What remains to be done ?
There are a number of ongoing projects in various stages of incompletion.
• The joint sewer agreement is being revised . A sub-committee of Carol Reeves , Tom Richard,
and Jim Schug have been working on this for .3 years . In 1995 they forwarded a draft to the
partners for consideration . This draft has been stalled in the Mayor' s office for months . The
Citv wishes to consider a number of other agreements simultaneously . The agreement for cost
sharing the capital cost of construction or reconstruction of jointly used sewer lines and a
possible future agreement for the sale of water by Bolton Point to the City are two issues that
have been mentioned . This is a complex discussion and much remains to be done .
• The Southern Cayuga Lake Intermunicipal Water Commission joint agreement is also under
discussion . There are a number of major issues to be considered . . . Should Bolton Point sell
water to non -partner municipalities? Should new partners be allowed to buy in ? If so , how
should the costs and rates be calculated " Should Bolton Point remain a commission and

partnership tinder the control of the municipalities or should it become a " water authority " with
a separate board of directors and powers of its own ' As the owner of the majority of this
plant's capacity , the Town of Ithaca has a huge stake in the outcome of this debate .
• Through its participation in the MPO's transportation improvement program , the Town has
received funding approval for a number of projects . One of the most crucial is the Northeast
Connector Corridor Study to determine the possible need for additional capacity improvements,
congestion management, or transportation system/transportation demand management
improvements in the area east of Cornell University . Tills study will include the generation of
congestion/mobility alternatives intended to improve current traffic conditions, including
potential mitigation strategies for residential and other " sensitive areas " within the corridor.
Because of state and federal budget problems, NYSDOT has been reluctant to obligate the
funding to begin the study . At the urging of the municipalities at the December MPO policy
committee meeting, Chuck Moynihan , Director, NYSDOT Region 3 , proposed a " task force"
to define the specific goals and objectives of the stud. . A staff report is expected at the January
1996 meeting . It is imperative that funding for this study not be rescinded by the State . The
Town must continue to be vigilant .
• The Town needs to establish a presence on the Worldwide Web. Neighboring municipalities
have "web pages" that provide a variety of information to the browser. Meeting notices,
zoning regulations , proposed ordinances , and lists of Town officials are only a sample of the
range of information services that could be provided to residents with this too.
• The Town needs a new Town Hall . The Town Board chose a site and adopted an overall
capital budget in December. I voted against this plan not because I disagree with the need, or
the downtown location . I was , however, extremely troubled by the downsizing of the
structure simply to meet arbitrary budget constraints without a thorough evaluation of the
implications on the Town's program . If the Board proceeds with the adopted plan, a
meticulous review and complete re-evaluation of the essential functions of Town of Ithaca
government and its attendant needs for space must be an immediate top priority.
• As I mentioned in my budget message last October. the Town's assessed valuation increased
less than 1 % in 1995) . Sow growth in the tax base is anticipated for the next several years .
The cost of providing services to residents increases by at least the rate of inflation. In some
cases , deferred maintenance of our infrastructure back in the 1970' s and 80 ' s will result in
costs that far exceed the rate of inflation . The Town wilt face some difficult decisions as the
choice between services and taxes becomes more and more difficult. Continuing to improve
efficiencies will be critical . Additions to infrastructure . roads and streets , water and sewer
extensions, new parks and trails , etc . , must be carefulk scrutinized to determine not only the
capital project cost , but also the continuing costs of repair and maintenance . Continued
cooperation and even consolidations of some sen- ices with neighboring municipalities must be
considered . While it has been pointed out that the Town is among the more affluent
communities in upstate New York, there is a limit . While working professionals may be able
to absorb increasing taxes and fees , it will be increasingly difficult for young families , the
elderly , and others on low or fixed incomes to manage . The Town must continue to provide
essential services , but "essential " will need to be re -defined .
I deeply appreciate the expertise and cooperation of all Town staff, boards and committees in
making 199 very productive year. I am very pleased with the staff' s commitment to serving our
constituents in a courteous and professional manner. As 1 look back over my seven years in Town
government , I am extremely pleased with the progress the Town has made in providing services
to the public in a most efficient manner. I am proud to ha % e been a part of it.

AUTHORIZATION FOR TOMPKINS COUNTY TO APPLY
FOR A 1996 SMALL CITIES COMMUNITY DEVELOPMENT BLOCK GRANT
ON BEHALF OF THE TOWN OF ITHACA
Resolution No . 265
WHEREAS , the U . S . Department of Housing and Urban Development ( HUD) will be
accepting applications for Small Cities Community Development Block Grant (CDBG )
funds in 1996 , and
WHEREAS , the Town of Ithaca is an eligible and interested applicant for funds
under this program , and
WHEREAS , Tompkins County has the ability to and has offered to apply on behalf
of the Town of Ithaca for funds under the rules of the Small Cities CDBG program , and
WHEREAS , Tompkins County intends to apply for funds under the Small Cities
CDBG program for an Economic Development Program to establish a revolving fund to
provide low- interest loan assistance to qualifying companies doing business in
Tompkins County, and
WHEREAS , Tompkins County has indicated that the County would have full
administrative responsibility and liability for administration of any funds received from
and any programs implemented through the Small Cities CDBG program , now therefore
be it
RESOLVED , that the Town of Ithaca Town Board authorizes Tompkins County to
apply for Small Cities CDBG funds on behalf of the Town of Ithaca to the HUD office in
Buffalo , New York, for program funds for the County's Economic Development Program
as part of the 1996 funding round , and authorizes the Supervisor of the Town of Ithaca
to sign any necessary documents to implement this application , and be it further
RESOLVED , that this approval is made with the understanding that the Town of
Ithaca shall not be required to enter into any indemnification agreements with Tompkins
County or any other federal , state , or local governmental entity.

RE: Regular Appointment , Human Resource Specialist
Sherwin DiSanto, Human Resource Specialist has completed many complicated and
extensive projects in an efficient and thorough manner since his employment with the
town . Sherm has a positive and upbeat attitude which is a great benefit in dealing with
all he serves . Town employees feel comfortable working with Sherm , and many have
commented on his friendly personality.
Sherm has been instrumental in tracking and receiving the information needed by
the Personnel Committee with regards to health insurance , security and safety
measures , salaries , grievance procedures , payroll , etc. He has also taken the initiative
to educate himself on pertinent issues when needed . His research and informational
quest regarding Civil Service greatly contributed to our establishing compliance, and
the employees understanding the system .
He is always willing to "pitch in " when needed , and works overtime when necessary
to insure completion of tasks in a timely manner. I highly recommend that Sherwin
DiSanto be made a regular full time employee as Human Resource Specialist
retroactive to December 26 , 1995 , as he has completed his six month probationary
period in an exemplary manner.

Benefit Assessment Refunds

WHEREAS , a review of the 1996 Town and County Tax Warrant has revealed the
incorrect benefit assessment charges were added to the attached tax parcels for the
water, sewer, and Winners Circle Lighting District; and
WHEREAS , the Director of Engineering has determined it will be necessary for a
refund to be paid to the owners of the said tax parcels for the incorrect charges; and
WHEREAS , before a refund can be issued a refund application must be completed
and the tax bill must be paid in full , and
WHEREAS , the Town Board does not wish to further inconvenience the said
property owners by requiring them to unduly wait for their refund ; now therefore be it
RESOLVED , the Town Board of the Town of Ithaca does hereby authorize and
direct the Fiscal Officer to prepare refund checks to the said property owners for the
amounts indicated ; and be it further
RESOLVED , the Director of Engineering is hereby authorized and directed to
prepare the refund applications for the said property owners and submit them to the
Receiver of Taxes by January 2 , 1996 ; and be it further
RESOLVED , the Receiver of Taxes is hereby authorized and directed to obtain the
signature of the property owner on the refund application , and present the refund check
to the property owner immediately upon receiving payment of the tax bill in full ; and be
it further
RESOLVED , the Director of Engineering is hereby authorized and directed to take
the actions necessary to insure the accuracy of the benefit assessments on the Town
and County Tax Warrant in subsequent years .

Authorization of Extension of Sick Leave Benefits
Resolution No , 272
WHEREAS , a Town Employee was stricken unexpectedly with a disease that
required missing a substantial period of work time ; and
WHEREAS , such individual is the parent of one small child and has no source of
income other than the employees' s salary as a Town of Ithaca employee; and
WHEREAS , by reason of such disease such employee has exhausted the sick time
available to the employee under current Town of Ithaca benefit plans ; and
WHEREAS , such employee has been a long-time , loyal , and effective employee of
the Town ; and
WHEREAS , such employee is expected to return to full-time employment with the
Town in the near future ; now therefore be it
RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes the
extension of sick leave benefits up to fifteen additional days to the employee whose
condition was discussed in executive session , such extended time to be subtracted
from one half of any future sick time that the employee accrues until the extended time
is recovered , ( i . e . if the employee 's extended sick leave amounts to six days , such
amount shall be deducted at the rate of one- half of a day for each day the employee
accrues in the future so that from the next twelve days accrued by the employee, six
days will be recovered by the Town and six days will be available for future sick leave
for the employee , or , in other words , the employee shall accrue only one- half the
normal time from future sick days until the extended time has been fully repaid) ; and it
is further
RESOLVED , that the decision to extend sick leave in this particular instance shall in
no way be regarded as a precedent for similar consideration for this or any other
employee in the future .
