At a Special lvfeeting of the Town Board of the Town of Ithaca, Tompkins County, New York held at the Town Hall, 126 East Seneca Street, Ithaca New York there were present: PRESENT: John G. Whitcomb, Supervisor; Ed Conley, Councilman; Ellen Z. Harrison, Councilwoman; Carolyn Grigorov, Councilwoman; David Klein, Councilman, Karl Niklas, Councilman. EXCUSED: Catherine Valentino, Councilwoman; Andrew Frost, Director of Building/Zaning. ALSO, PRESENT: Joan Lent Noteboom, Town Clerk/Director of Administrative Services; John Barney, Attorney for the Town; Daniel Walker, Director of Engineering; Jonathan Kanter, Director of Planning; Gary M. Call to Order: The Supervisor called the meeting to order at 5 :30p.m. , and led the assemblage in the Pledge of Allegiance. Agenda Item No. 3 - Public Hearing to Consider a Local Law Autho ' ping Conduct of Bingo Games by Authorized Or within the Town of Ith aca: The Supervisor opened the public hearing at 5 :30 p.m. The Town Clerk had proof of posting and publication. Gary Teeter - Veterans Volunteer Fireman's Association state his organization brought this to the attention of the Board and that due consideration of the issue would be greatly appreciated. Mr. Teeter thanked the Town Board on behalf of his organization. As no one else wished to speak, the Supervisor closed the public hearing at 5 :32p.m. Agenda Item No. 4 - Consider SEOR Related to a Local Law Authorizing, Conduct of Bingo Games by Authorized Organizations within the Town of Ithaca Resolution No. 151 : Motion made by Councilwoman Harrison, Seconded b y Councilman Niklas approving the SEQR. A vote of the resolution resulted as follows : Supervisor Whitcomb, aye; Councilman Niklas, aye, Councilman Klein, aye; Councilwoman Grigorov, aye; Councilwoman Harrison, aye; Councilman Conley, aye. Carried unanimously. STBM 8/28/95 Agenda Item No. 5 -• Consider Enactment of a Local Law Authorizing Conduct of Bingo Games by Authorized OrLanizations Within the Town of Ithaca: Resolution No. 152 : Motion made by Councilman Conley. Seconded by Councilman Niklas enacting the Local Law. A vote on the resolution resulted as follows: ROLL CALL VOTE: Supervisor Whitcomb, aye; Councilman Niklas, aye; Councilman Klein, aye; Councilwoman Grigorov, aye; Councilwoman Harrison, aye; Councilman Conley, aye. Carried unanimously. Agenda Item No. 9 • Additional Business : Authorization for Payment - Caddtech Productivity IncfMe State Insurance Fund. Mrs. Noteboom: The bill from the State Insurance Fund for the Worker' s Compensation premium was missed on the last abstract. The bill was thought to be a quarterly statement, but it is a monthly bill after an initial down payment. The billings for July and August need to be paid before the September Town Board meeting. Councilman Klein = There are two items, one is from July to July for $ 14, 430. 00, and the other is for a monthly payment of $4810. 00? Mrs. Noteboom = Tlie first amount for $ 14, 430. 00 was not put on the July abstract and is the down payment. The entire premium is approximately $50, 000. 00, paid by the $ 14, 430. 00 down payment and monthly payments of $4810. 00, there are no premiums due in May and June. The total is about the same as last year. Resolution No. 155 : Motion made by Councilman Niklas, seconded by Councilwoman Harrison approving the payment of the bills as presented and authorizing the dispersement of funds. A vote on the resolution resulted as follows : Supervisor Whitcomb, aye; Councilman Niklas, aye; Councilman Klein, aye; Councilwoman Grigorov, aye; Councilwoman Harrison, aye; Councilman Conley, aye. Carried unanimously. Mr. Kanter - The Ithacare Environmental Impact Statement has gone through review process at the Planning Board level. The Planning Board looked at several alternate building locations on site during the Environmental review process. Each Town Board Member has been provided copies of the Environmental Impact Statement. The Planning Board adopted a resolution that refers the Environmental Impact Statement to the Town Board for any comments. This will be an 2 STBM 8/28/95 official part of the Environmental Impact Statement record, and is in anticipation of the possibility that Ithacare may come back to the Town Board for authorization to change the original building footprint and/or configuration. If the footprint is substantially different from what was approved by the Town Board during the special land use district approval process, it would then again have to be authorized by the Town Board. Town Board review is a formality, but review is also an opportunity for the Town Board to make official comments into the environmental review process. Councilman Niklas - Has the Planning Department discussed with Ithacare how or if they intend to change the layout or the size of the placement of the building? Mr. Kanter - One footprint is officially a part of the Draft Environmental Impact Statement. Discussions have since taken place regarding a modification of one alternative shown in the Impact Statement which proposed moving the building from the current site down slope about fifty feet, or approximately the width of the front part of the building, thus further lowering the roof line. The alternative is described in the Environmental Impact Statement as B3 . This alternative involves a slight counter clockwise rotation of the building in its current location with the downsizing of the lower eastern wing to improve the view from the overlook looking toward the lake. Councilman Niklas - 'The Town Board would have to approve this as modification of the SLUR? Would these modifications have to go through the Town Planning Board? Attorney Barney - Yes, and the Planning Board is going through it right now. The problem providing the most concern, is the way SEQR is set up. Theoretically, and applicant should not be made to unduly endure a lengthy repeated process for essentially the same matters. However, when the Town Planning Board undertook the SEQR review, they thought the only thing they would be reviewing was a specific sight plan. It was felt the Town Board' s involvement had ended when the SLUD was adopted. Now, in the course of the review of the sight plan they may come up with a different sight plan, one which will be significantly different from which the Town Board approved. Under the terms of the SLUR, the Town Board again looks at it, triggering another SEQR review. The effort is to try and consolidate the SEQR reviews into one SEQR process, and that is why the Town Board was given the draft Environmental Impact Statement as it is now. The Town Board should make comments and if possible show agreement that the Town Planning Board will be the agency. Then if it does come back to this Board a large portion of the SEQR process will have been completed at that point. The Town Board should make their own independent findings to make sure the SEQR information will have been compiled in a way each is comfortable with. Councilwoman Harrison - The draft impact statement doesn' t dramatically change the location of the building it rotates it, and further discussions about moving the location are not reflected in the draft impact statement. 3 STBM 8/28/95 Attorney Barney - The alternatives are in the draft. One is in the plan, B3, Draft DIS. There is another alternative that is not in the draft DIS presently being evaluated which was . subsequently suggested by Eva HolIman. Ithacare is not sure whether they will include it, because they do not feel they can build fifty feet further away. There would be a problem with the sewer, and may put the building below the; sewer line. Councilwoman Giigorov - The scope indicated they were to avoid steep slopes. Mrs. Hoflnian said she didn't feel that the Planning Board interpreted "avoid" steep slopes as meaning absolutely none. It may not be fair, to expect Ithacare to design a building now on steep slopes. Attorney Barney - That' s the issue that Ithacare is reviewing, just exactly how much evaluation should they do of an ilternative that they believe is just simply economically not feasible to do. Mr. Kanter - The scoping outline didn't say avoid steep slopes. It listed along with other possible mitigating measures the avoidance of steep slopes. It did not make the avoidance of steep slopes a directive. Supervisor Whitcomb - It was a large misconception from the beginning that the Board wanted avoidance of the steel) slopes and the wetland at all cost. Mr. Kanter - The wetland avoidance was more formerly stated by the Planning and Town Boards in the beginning with a specific resolution adopted with the SLUR. It has always been understood that steep slopes are a major concern of the Town, and anyway to avoid them would be desirable. Councilman Niklas - Since moving the building further down the hill is being explored, if that scenario was to be first choice, would it require modification of the Draft Environmental Impact Statement? Attorney Barney - Either alternative requires modification of the SLUR. The second proposal would require additional information. Agenda Item No . 6 - :Public Hearing to Consider the Enactment of a Local Law Amending Local Law No. 3/ 1995, Re&ement Incentive Program. The Supervisor opened the public hearing at 5 :45 p. m. The Town Clerk had proof of posting and publication. No persons came forward wishing to be heard during the public hearing. The Supervisor closed the public hearing at 5 . 45 p.m. Agenda Item No. 9 - .Additional Business, Ithacare - Cont ' d: Councilman Niklas - It may not have been wise to have the proposed SLUD so specific to a sight plan. 4 STBM 8/28/95 Attorney Barney - There is concern about the view, the height of the building, and the bulk of the building. A preliminary drawing was provided and the SLUD proposed building as those preliminary drawing<ep showed. Presently new drawings are changing the configuration of one wing. The building is being rotated. Ithacare will clearly be in violation of the SLUR if they build a building in any way other than in conjunction with those. Councilman Klein = If the Town Board comments get transmitted to the Planning Board and they accept one of the alternatives because it is a better solution to mitigate some of the concerns that brought about the Environmental Impact Statement, and they approve a new sight plan and new building configuration. Then they would ask us to modify the local law. Councilman Niklas - It would be more efficient for the Planning Board to get an unofficial reading from the Town Board. Attorney Barney - If the Town Board is satisfied that there is an adequate discussion of the alternatives, the Town Board may choose, or may be asked to consider modifying the SLUD by proving an informed judgment as to the Environmental Impact of these alternatives. Councilman Niklas - What would be the official means of communicating our comments to the Town Planning Board. Should the comments be in writing?. Mr. Kanter - Written. comments are preferable, but oral comments are also welcome. It would be preferable to receive individual comments ahead of the September 11 meeting to review individual modes of thinking, and hopefully compile those as a whole Town Board in the form of a resolution or statement to the Planning Board Councilman Niklas - Is there any indication at the present time as to which proposal the Planning Board favors, rotating the building or placing it further down the hill? Mr. Kanter - There is still a great deal of debate, and no consensus. Councilman Niklas - Have the people at Ithacare expressed their preference? Mr. Kanter = The officials at Ithacare have indicated they would prefer to build the B3 alternative that is in the Environmental Impact Statement. Supervisor Whitcomb - No action is required by the Town Board this evening. Councilman Klein - There should be an appropriate amount of time allotted to discuss this issue at the September 11 , Town Board meeting. 5 I STBM 8/28/95 Supervisor Whitcomb - The September meeting will have a very full agenda, the Town Board may comment individually before that meeting on the Ithacare issue. The Town Board may have some difficulty developing it uniform statement unless it is something simple such as we are willing to accept the recommendations of the Planning Board, and we are willing to modify the SLUR to accommodate the needs of the Town and applicant. Councilman Niklas - Eco Village and a road was a concern and we would send it to the Town Planning Board and be resolved in the best wary possible however to me it was not resolved at all. . It came back to the Town Board and we approved it however I did vote against it. I was not happy with the process nor with my vote. Councilwoman Harrison - What is the public process now for the Planning Board and the Town Board? Attorney Barney - There will be another public hearing at the Planning Board Meeting on the sight plan approval. Councilwoman Harrison - Has there been a hearing ? Mr. Kanter - A hearing is not required on the final EIS . Councilman Niklas - Is a hearing required when this comes before the Town Board? Attorney Barney - Yes. Councilman Klein - Ulhen would that be? Mr. Kanter - Probabbr in November. We 're looking at early October meeting of the Planning Board for the completion of the Environmental Impact Statement, Councilman Niklas - Is Jonathan the person to contact for comments? If he were to have the information before the September 11 meeting, a resolution reflecting the consensus could be drafted. Mr. Kanter - If anyone has any questions give me a call or come in. We have the visual analysis photographs for your review. Mrs. Noteboom - If you could have your comments to me the Wednesday before the board meeting, I could include them in the packets . Agenda Item No. 6 - Resumed - Public Hearing on a Local Law Electing a Ta geted Retirement Incentive Program as .Authorized by Chapter 12 Laws of 1995 of the State of New York For 6 STBM 8/28/95 Eligible Employees o ' the Town of Ithaca: The Supervisor reopened the public hearing at 5 : 52 p. m. As no one present wished to speak, the Supervisor closed the public hearing at 5 :52 p.m. Resolution No. 153 : Motion made by Councilman Niklas, seconded by Councilwoman Harrison making a negative 43 determination of environmental significance in accordance with the New York State Environmental Quality Review Act for the above referenced action as proposed and therefore neither a Full Environmental Assessment Form nor an Environmental Impact Statement will be required. A vote on the resolution resulted as follows : Supervisor Whitcomb, aye; Councilman Niklas, aye; Councilman Klein, aye; Councilwoman Grigorov, aye; Councilwoman Harrison, aye; Councilman Conley, aye. Carried unanimously. Supervisor Whitcomb - The reason we are addressing this issue again is the State has given the entities an opportunity to extended the targeted incentive program. At present there are three people who could take advantage of this. Resolution No. 154 : Motion made by Councilman Niklas, seconded by Councilman Conley enacting Local Law No. 9/1995 , Local Law Electing a Targeted Retirement Incentive Program As Authorized by Chapter 12, Laws of 1995 of the State of New York for eligible employees of the Town of Ithaca . Mrs. Noteboom - There is a formula the state has provided for determining whether we will have the fifty per cent savings. I doubt the persons eligible will accept it as it would not offer them enough money to retire. A roll call vote on the resolution resulted as follows : Supervisor Whitcomb, aye; Councilman Niklas, aye; Councilman Klein, aye; Councilwoman Grigorov, aye; Councilwoman Harrison, aye; Councilman Conley, aye . Carried unanimously. Agenda Item No. _ 10 - EXECUTIVE SESSION : Motion made by Councilman Niklas, seconded by Councilwoman Harrison to move in to Executive Session regarding property acquisition. Carried unanimously. The Board began Executive Session at 5 : 55 p.m. 7 STBM 8/28/95 Motion made by Councilman Niklas, seconded by Councilman Conley to resume regular session. Carried unanimously. The Board resumed regular session at 6 :32 p.m. As a result of the Executive Session, a motion was made by Councilman Niklas, seconded by Councilwoman Gngorov regarding property acquisition (Confidential file shall be kept in Town Hall Archival Records Storage Center by the Town Clerk). A vote on the resolution resulted as follows : Supervisor Whitcomb, aye; Councilman Niklas, aye; Councilman Klein, aye; Councilwoman Grigorov, aye; Councilwoman Harrison, aye; Councilman Conley, aye.
