Call to Order : The Supervisor called the meeting to order at 5 : 30 p . m . , and led the assemblage in the Pledge of Allegiance . Supervisor Whitcomb - Agenda item # 13 has been deleted as the Town Attorney will be corresponding with the State Civil Service Commission regarding these issues . He will then report back to the Board . Agenda Item No . 3 - Reports of Town Officials : a . Town Supervisor - I had the privilege of participating with the welcoming committee for the Empire State Games last week . I would like to give particular thanks to Mike Ocello , Sally Alario and Joan Noteboom who worked very hard on a photo album for one of the featured speakers of the games , Bonnie Blair . Negotiations continue with Bolton Point and the Joint Sewer Commission extending and revising various agreements . Discussions with James Schug , Town of Dryden , regarding the park fees associated with Peregrine Hollow are on going . Mr . Schug has requested documentation on operating costs for Eastern Heights Park . Councilwoman Harrison - Will the documentation be only for operation or will it include some capital costs ? Supervisor Whitcomb - Strictly maintenance operations at this point . We have not factored future capital investments or escalation of costs over time . Councilman Klein - The initial numbers we looked at were not that much per household and we were contemplating an initial contribution which could be used for capital improvements . Supervisor Whitcomb - I am concerned the small amount we calculated per household could turn into an administrative nightmare over time . What might make more sense is to have the developer make a " one time " investment in the park which would cover that sort of thing . Councilwoman Harrison - Or a one time investment that does not necessarily go to that particular park . Why couldn ' t we put the monies in the " Fees In Lieu Of " account and use accordingly . Councilwoman Valentino - We could run in to problems with residents in Eastern Heights if some of the money is not going to benefit their park . They will be the ones most affected . Supervisor Whitcomb - We need to appoint an Acting Deputy Town Supervisor for the period of August 19th through August 24 , 1995 as both Councilwoman Valentino and myself will be out of town . Agenda Item No 3 ( a ) - Appointment of Acting Deputy Town Supervisor : Resolution No , 136 : Motion made by Supervisor Whitcomb , seconded by Councilwoman Grigorov approving the appointment of Councilman David Klein as Acting Deputy Town Supervisor during the period of August 19 through August 24 , 1995 with all powers and duties granted under Town Law including authorization to execute the Town payroll and any applicable financial obligations . A vote on the resolution resulted as follows : Supervisor Whitcomb , aye ; Councilwoman Valentino , aye ; Councilman Klein , aye ; Councilwoman Grigorov , aye ; Councilwoman Harrison , aye . Carried unanimously . b . Director of Engineering - See attached . c . Town Highway Superintendent - See attached . Councilwoman Valentino - There is a deer repellent mentioned in Your report . Is this something which could be dangerous to others ? Mr . Noteboom - No . d . Director of Planning - See attached . The Ithacare EIS has been presented to the Planning Board for a public hearing and there has been a great number of public comments received . There is the TB MTG . 8 / 7 / 95 possibility it could come back to the Town Board for some modification or other action related to the special land use district . We are looking at late September for the final EIS to be addressed by the Planning Board . If anything had to come to the Town Board it would not be until after that time . Attorney Barney - There is a question as to whether it would be appropriate for this board to be named now as an involved agency as part of the process . Originally the board was not as it was a site plan review of the Planning Board . In the EIS there is a suggestion the building be located differently than what was provided for by this board in a special land use district . Therefore if it becomes the recommendation of the Planning Board it will be coming back to this board for further evaluation . This would mean environmental considerations among others by this board . we are thinking one of the most appropriate routes to go would be to include this board as a involved agency so it would not require a new and separate EIS . We might want to address this at the end of the meeting to see how you as a board would like to proceed . Mr . Kanter - The Six Mile Creek Conservation District has undergone some additional revisions and is at a point where it will be presented to the Codes and Ordinance Committee for some technical review . It will then go to the Planning Board for recommendation and then to the Town Board . There is a meeting later this week to address the Cornell SLUR . We are in the final stages of the revisions . It is hoped to be presented to the Planning Board in September and to the Town Board in October . e . Director of Building and Zoning - See attached . Councilwoman Grigorov - I thought Andy Frost ' s letter to the Ithaca Journal was very good . Supervisor Whitcomb - Andy felt very strongly the Towns side of the story should be heard as well . f . Town Clerk - See attached . We received notification today from the State Education Department the final expenditure report for the records management grant was approved . The final payment will be made in August in the amount of $ 1 , 787 . 00 . Councilman Klein - I had not heard about the virus which infected the computer systems . Has this been corrected ? 3 TB MTG . 8 / 7 / 95 Mrs . Noteboom - It has been taken care of . Each computer has had an anti - virus program installed . We have no idea how we became infected with the viruses . Supervisor Whitcomb - Possibly shared disks . We share disks with several persons . Mrs . Noteboom - It was a " monkey " virus which could have been devastating had it not been discovered . We could have lost everything on the hard drive . I do not think it was a willful sabotage and would hope it wasn ' t . There is no way to tell . g . Assistant Budget Officer - See attached . Agenda Item No . 4 - Report of Town Committees * Councilwoman Harrison - No report . Councilwoman Grigorov , Planning Committee - No report . Councilman Klein , Public Works Committee - The minutes will be distributed by the end of the week . The majority of the meeting was a presentation by Planning staff on the open space plan they Y are presently working on . The plan itself will work its way through the Planning Committee , Planning Board , Conservation Board and so on . Councilwoman Valentino , Personnel Committee - Most of what I have been working on will be discussed later in the meeting . Agenda Item. No . 5 - Report of Tompkins County Board of Representatives : Dooley Kiefer , T . C . Board Representatives - I hope to be involved and to answer questions regarding adding the solid waste fee on the taxes and the SPCA issues which will be addressed later in the meeting . Tim Joseph asked me to mention the resolution the County received from the Town of Ithaca considering bridge maintenance . It seemed intemperate and the County was startled to receive it . I spoke with Barbara Blanchard , Chair of the County Transportation Services Committee , Commissioner Mobbs and with T . C . Board of Representatives Chair , Stuart Stein regarding this issue . What seems to be the case is the County is not planning to do anything in particular and very concerned we have gotten seriously behind in maintenance of the infrastructure , roads and bridges . It is not clear how we can catch up and in the attempts at outreach , Beverly 4 TB MTG , 8 / 7 / 95 Livesay with Town Supervisors would like to talk about the best way we can jointly make sure the infrastructure is " up to snuff " . There is nothing secretly in the works which seems to be eluded to and we do take issue with the opinion we have no legal ground for undoing a resolution . The resolution 50 years ago in which the County took over maintenance of bridges over 25 feet can be " undone " by a simple resolution . We do not plan to do this however . Acrenda Item No . 6 - Review of Correspondence a . Paul and Claire Carroccia , Benefit Assessments : Director of Engineering , Dan Walker is recommending not to reduce the benefit assessment on Mr . & Mrs . Carroccia ' s property . Mr . Walker - You have a copy of my assessment evaluation sheet which I prepared in response to the Carroccia ' s request . The calculation came up 05 points higher however I am not recommending an increase at this point . The problem is he has 14 acres and our assessment is based on frontage of 250 feet or 2 . 5 units and remaining frontage of 782 feet , which is assessed based on 1 unit per acre . In the R - 30 zone and with one house , now would take up the 250 feet of frontage based on the shape of the parcel . 782 feet would allow them at least four lots on the parcel at 150 feet and if they subdivided the remaining 11 acres , they could get a maximum of :14 to 15 lots from the parcel . When the benefit assessment formula was first set up they took in to account the potential for development and this is the formula used to assess every parcel in the Town . Supervisor Whitcomb - So this is treated no differently than any other similar parcel in the Town with large acreage and frontage . Councilwoman Harrison - Where is this property and what is it on the anticipated land use map ? Mr . Walker - Right now the parcel is at the intersection of Route 327 and Route 13 . Councilwoman Harrison - Is it within the area that is designated as conservation open space ? Mr . Walker - It is in the red zone which is suburban residential , directly across the street from the park . Councilwoman Harrison - Given the proximity to the park etcetera , is this an area we think would benefit the Town if there were conservation restrictions ? We have said the one time we would 5 TB MTG . 8 / 7 / 95 consider changing a benefit assessment would be if there were some sort of easement that would restrict future development . I do not want this to be a way not to pay an assessment however given the proximity of the park I am wondering if this might be a place where we might want to encourage something like this . Is this something we might ask the Town Planner to take a look at ? Mr . Walker - . In this particular case Mr . & Mrs . Carroccia had the property on the market and also considered a possible subdivision themselves . It has been for sale for the past two years at least and they have had difficulty getting their price for it . Councilman Klein - The assessment is at $ 218 , 000 with 14 acres and 1000 feet of frontage which seems very high . Mr . Walker - The lots are averaging about 200 feet in width . Councilwoman Grigorov - He should have his property appraised and then file a grievance with the assessment office . This is really high . Supervisor Whitcomb - The Town Planner might want to take a look at this to see if it would be feasible . Mr . Walker - I will respond to Mr . Carroccia stating the assessment of the units is correct for the land use and the configuration of the lots . I would be happy to inform him that the only time the Town Board would consider a benefit assessment reduction would be if the land is preserved for open space and limiting development . Councilwoman. Harrison - You might also mention this is only the water and sewer assessment and questioning the total tax bill would have to be addressed with the County Assessment Office . b . John Lampman , Tompkins County Engineering , Forest Home Bridge Project : Councilman Klein - This letter seems to get a little closer to the truth as to what really happened . They admitted the County did not do anything for four months and then got caught in the cycle with the new administration . Mr . Walker - Prior to the letter , we still had not received the cost estimates on the bridge . We just received it last week . Councilman Klein - Did we in fact receive the 95W design submission in May ? Mr . Walker - I considered the design drawings we saw in May extremely incomplete and therefore would not call it 95 °s . We have 6 TB MTG . 8 / 7 / 95 seen more complete drawings and a cost estimate . The faxed copy we received last: week were not legible and I have asked them to break down the components . Councilwoman Harrison - How quick will the turn around time be between receiving the final plans and the work group approves them? Mr . Walker - There is no work group meeting set up at present . Councilwoman Harrison - Won ' t that affect the rest of the time frame ? Mr . Walker - I have not seen the final plans and specs yet . We are not sure of the cost allocations . Out of the $ 50 , 000 set aside budget for this year it looks like our cost could conceivably double . I do not have the final numbers on this . The way the schedule is now we will not be expending funds this year and we will need a solid budget figure from the County by August or September before our final budget . Councilwoman Harrison - In terms of dates , am I correct we need a contract fully executed before January 1 , 1996 so as not to lose grant money ? Mr . Walker - That appears to be the case since they have December 26 , 1995 as the execution date for the contract . Councilwoman Harrison - If things are slipping already are we going to make it ? We certainly do not want to lose the grant money . Mr . Walker - The time frame to get a contract executed before the first of the year is still workable as long as no one drops the ball and it :keeps going ahead . This board already authorized the Town Supervisor to sign a maintenance agreement with the County back in April or May 1995 . We have been ready to sign the agreement however we have not received all of the documentation needed . Supervisor Whitcomb - The maintenance agreement is not the hold up . It is the short turn around time from the final plans on August 8 to the final bid documents on August 18 , 1995 . Where the plan has fallen apart in the past is where the County has come to the work group expecting to get instant approval and they have not had the plans together in order to get them approved . Ms . Kiefer - What is it you would like me to do at this point ? 7 TB MTG . 8 / 7 / 95 Supervisor Whitcomb - You could express our concerns to the County Board and particularly to Barbara Blanchard and other persons involved with the project and Dan will work with the engineering department and John Lampman . Mr . Walker - The final plans are being done by the County ' s consultants and the biggest thing the County Board can do is to make sure the consultants are not paid until we receive the plans and specifications . If there has been payment our leverage is gone . AGENDA ITEM NO . 7 - PERSONS TO BE HEARD : No one wished to speak . Agenda Item No . 10 - Consent Items : Ms . Alario - We received a voucher late today from Judith Bernal , Court Clerk , for space rental in the amount of $ 400 for the months of June and July 1995 . I would like to include this for approval with the warrant presented . Councilman Klein - Page 8 , paragraph 7 of the July 10 , 1995 Town Board Minutes , should read : " Mutually it was agreed that the concrete gutter . . . . " adding " agreed that " and page 14 , Resolution No . 135 : should read : " Motion made by Councilman Niklas , seconded by Councilman Klein authorizing Hoffman , O ' Brien . . . . " and deleting " directing the Town Supervisor " Resolution Nc:) , 140 : Motion made by Councilwoman Grigorov , seconded by Councilwoman Valentino approving and or adopting the Consent Agenda Items resolution numbers 140 ( a ) - ( j ) , ( 1 ) as presented . Resolution No . 140 ( 1 ) : Appointing Joan E . Lawrence to the position of part - time typist to the Conservation Board retroactive to February 9 , 1995 , Agenda Item No . 8 - Presentation : Tompkins County SPCA : Pamela Stonebraker , Director of SPCA - We have three things we would like to address this evening ; a proposal for the 1996 Dog Control contract with the SPCA , discussion on cat control contributions in Tompkins County and a discussion on the SPCA offering enumeration services to municipalities . 9 TB MTG . 8 / 7 / 95 The SPCA would like to request for the year 1996 a contract increase of 3 °s over the 1995 amount , a $ 492 increase . This increase would assist us in covering our increasing costs due to inflation . If you look at the dog control statistics for the Town of Ithaca dogs impounded were the same however more tickets were issued . There were more dogs returned to their owners . Comparing January to July 1994 to 1995 , no noticeable change is seen . We do not anticipate any change in the services which include impounding of stray dogs , talking to owners , issuing tickets both for violations of the dog control law as well as failure to license dogs . Last year was our first full year of doing dog control for the entire County . We have managed to maintain our statistics and our focus now is to lower the euthanasia rate . Attorney Barney - What is the total dollar amount of the contract with the increase you are proposing this evening . Ms . Stonebra.ker - The contract for 1996 would be $ 16 , 910 as opposed to the 1995 contract of $ 16 , 418 , Councilwoman Harrison - Do dog licensing fees come back to the Town eventually ? Ms . Noteboom. - We collect $ 6 . 00 for every license the Town of Ithaca issuer . The SPCA helps administrate dog control in the Town by issuing tickets and monitoring who does and does not license their dog . They provide a very good service to the Town . Councilwoman Harrison - How much do we bring in through dog license annually ? Mrs . Noteboom - $ 8 . 50 for spayed or neutered dog and $ 13 . 50 for unspayed or unneutered . Supervisor Whitcomb - Last year we had budgeted $ 5850 . 00 . Karen Smith , Board of Directors - At present I believe you have 1 , 021 dogs licensed in the Town , which represents approximately $ 6100 in licensing fees received at $ 6 . 00 per dog . Then approximately $ 700 in impoundment fees which are returned to the Town from the SPCA . This service is one which is required of every City or Town by New York State Law . According to New York State Law the dollars received from dog licensing ma-tor only be used for three things ; dog control , spaying and neutering , and humane education . As I previously stated the Town is expending approximately $ 16 , 000 per year and recognizing approximately $ 6800 in revenues . 10 TB MTG . 8 / 7 / 95 W? A dog enumeration is a dog census , which is finding the dogs and finding out who owns them . If we were to pay attention to American Veterinary Medical Association , statistics for the number of dogs per household , that would indicate there would be about 3200 dogs in this Town and only 1 , 021 are licensed . Pam and I did this based on having been in this business for a while and we arrived at a more realistic figure of almost 2600 for the Town of Ithaca . This indicates to . us the Town is losing approximately $ 7 , 900 in local fees for unlicensed dogs at $ 6 . 00 per dog . Our proposal is the result of a request from the Town and we have put together the proposal of what it would cost for the SPCA to go out and conduct an enumeration . Every clerk will tell you that doing an enumeration is a " pain in the neck " . We devised a procedure a few years ago for the City of Ithaca upon their request however to do various circumstances we were unable to test it . Most people hire 1 or 2 people , going from house to house all year long and ultimately the enumeration is never completed . The reason for this is " burn out " . We propose flooding the area with 15 people and completing it in two weeks , supplying them with good maps and information . I believe this program will work and we are proposing that for $ 5 , 600 the SPCA will enumerate the entire Town of Ithaca . The tasks we are looking at are identification of the owners , collecting the addresses of dogs harbored in the Town , taking the lists and inputting the information in to the computer , cross referencing the information with the Town ' s information of licensed dogs , follow - up letters to owners who are in violation and delivery of tickets in the event of non - compliance . If we were to achieve 850 of the 2600 unlicensed dogs , the anticipated result would be an increased revenue of $ 13 , 260 on the $ 16 , 000 dog control contract plus the same impoundment fees . There will be some fines as well . Enumerations need not be done annually . Normally an enumeration is done every 18 to 36 months depending on what is seen in the licensing . If your licensing numbers are staying up and it looks like 850 to 950 of the dogs which are projected in the Town , the count should be quite accurate . The next time an enumeration is done the cost should be lower as not as much work would need to be done i . e . data base input , etc . . . and as a result I would project a decrease in cost of about $ 1 , 1000 I am recommending something to all of the Towns , Currently , on top of the state fee , the Town of Ithaca is only receiving $ 6 . 00 per dog . The Town is eligible to charge $ 10 . 00 per dog according to State law . The licensing fee may be raised at any time and based on the amount of money the Town is losing on dog control , this 11 TB MTG . 8 / 7 / 95 might not be a bad idea . If the Town were to charge the maximum amount of $ 1. 0 . 00 , the Town would have a revenue stream of about $ 23 , 600 . 00 against an expense of around $ 16 , 000 . 00 , which would enable the Town to reserve the excess funds for the next enumeration and for the SPCA contracts . Councilwoman Valentino - Would the $ 5 , 600 be an additional fee on top of the contract ? Ms . Smith - 'Yes . Mrs . Noteboom - Our 1995 Priority Work Plan included the dog enumeration by the end of the year . When we budgeted for this , the Supervisor and I considered having the SPCA train the people we would send out . We had discussed hiring a team of 6 or 7 workers to get it done within this time frame and we had discussed this with the SPCA for the past couple of years . This is much better and will take quite a load off our office . Finding the people has always been a nightmare . Councilwoman Valentino - Is it also true that dogs have to have their rabies shots in order to be licensed ? Ms . Smith - That is correct . Councilwoman Valentino - So that is another control which is very important to the Town . Ms . Smith - Of the stray dogs we are getting at the SPCA a very high number are not vaccinated . This could be either the owner cannot provide proof of vaccination or in fact they are not . Unless proof is provided for the vaccination we will vaccinate the dog and licE�nse the dog before the dog can be taken from the shelter . Councilwoman Harrison - Once the SPCA has done the enumeration , would the letter to the owners would come from the SPCA or from the Town ? Mrs . Noteboom - They would come from the Town Clerk as we are technically the licensing agent . A very nice letter would be sent . Councilman Klein - So what this is saying is that we invest $ 5 , 600 . 00 in the enumeration and we have a good chance of increasing our revenues by $ 7 , 900 . 00 per year . Other than the initial cost ? it should more than pay for itself . Supervisor Whitcomb - Suppose we decided we wanted to proceed with 12 TB MTG . 8 / 7 / 95 this . I assume we would then enter in to some sort of contract with the SPCA . Mrs . Noteboom - I would like to have it done sometime late September early October if possible so that we get the students when they return . Many of them license their dogs here while they are in school rather than back in their home town . This way we can get a realistic count of the dogs , Ms . Smith - One of the things we want to do is . tell the owner why they want to license their dog . If we find a dog and the license is in Poughkeepsie the chances of getting the dog to its rightful owner is slim . The other thing I thought we should do is hand out rabies information to everyone , We should give them something back for the information they are giving us and do something which is good for all of us . While we are enumerating , we will probably count cats as well . Mrs . Noteboom - We have approximately $ 1 , 700 . 00 in the budget for the enumeration . We have not encumbered funds over the last several years in which an enumeration had not been done or completed . Cat control means we accept stray and feral cats as they have the potential of carrying rabies and simply annoy people . Today cats are the number one domestic animal vector of rabies to humans . The World Health Organization , The CDC , and the NYS Department of Health all say the number one thing you can do is get the cats off the street , vaccinate them and track the vaccinations . Cat licensing discussions has been a major factor in increasing the adoption rate 2006 on cats . This is not the number of cats , it is based on the number per 100 which come to the SPCA so we are moving the cats to homes . This is not to say we are not still getting a large number in and the f act we are not having to kill them however 13 TB MTG . 8 / 7 / 95 they still cost us money . The cost for picking up cats in the County costs $ 36 , 000 . 00 per year . The County is currently contributing approximately $ 21 , 000 . 00 per year , leaving a deficit of about $ 15 , 000 . 00 . We can not keep going on like this . We need help . What we are proposing is the Towns and the City pick up proportionately the remainder of the cost of $ 15 , 100 . 00 . The cost to the Town would be $ 1 , 959 . 00 . Stray and feral cats with unknown vaccination histories are potential sources of rabies for human beings . About 750 of the people who call us to pick up cats cited fear of rabies to themselves , pets or livestock . We only house these cats for 5 days as that is all New York State Law requires . At that point we can dispose of the cats . What we choose to do is put them over on to the budget which is supported by donations . When you send us an SPCA donation you are supporting extra days at the shelter for these cats , you are paying for an ad in the Ithaca Journal and more . We are just asking you to help keep the SP<'.A as the place people can bring stray cats where they will be taken care of in accordance with New York State Agriculture and Markets Law . Supervisor Whitcomb - Have you approached other municipalities about this . Ms . Smith - We will be . The Town of Ithaca is the first one . We will be asking everyone . Several towns have indicated they would like to participate . Certainly I would be very thrilled if the Town of Ithaca was the first . If we do not have the SPCA we are forcing people to abandon animals or to kill them outside of the law . Supervisor Whitcomb - Are you asking for this money in fiscal 1995 or 1996 ? Ms . Smith - I am asking for 1995 and 1996 . Supervisor Whitcomb - I might be able to help you with 1996 but I am not sure about 1995 . Ms . Smith - 1995 year to date we have taken in 325 , 12 % from the Town of Ithaca , I took the average of 1994 and 1995 in order to calculate the average expense for each town . Councilman Klein - They seem to be somewhat unequally distributed . I am inclined to say we should support this . I think we should be including this in our budget processes . Attorney Barney - The question is whether the Town wants to pick up a share of the deficit the SPCA has by a contract . It should not be by contribution , it should be by contract . I have an additional funding request for 1995 and would also like to present my proposed budget for 1. 996 . If you look at the 1995 budget the Youth Works Program which we contract the Learning Web for is the only program the Town of Ithaca has where there is dedicated youth programs working with. a target population particularly those from age 11 on up . This has been very effective in the schools with many children coming from the Town of Ithaca , the Village of Cayuga Heights and the Village of Lansing with apprenticeship and mentoring programs . There were some costs which were not anticipated when the Learning Web wrote the proposal to us initially and they are enumerated for you this evening . In our original proposal for 1995 , the Town tax portion of Learning Web was $ 10 , 615 . 00 . By the time we added the figures we were at $ 22 , 044 . 00 which was the amount the Town arrived at for the Joint Youth Commission . There is an additional amount of funds over $ 4 , 000 . 00 which we are eligible to receive this fiscal year in matching funds from the County . Councilwoman Harrison - How many kids from the Town of Ithaca are involved in these programs ? Ms . Beermann - In the Summer Municipal Jobs Programs and the Youth Conservation Corps we have approximately 28 Town of Ithaca kids and in the Youth Works program over 50 . Councilwoman Valentino - I am very familiar with the Learning Web Program . It is a proven program that works and makes a difference for a lot of children so I would not have any problem supporting the expenses for 1995 and the matching funds from the County in our next budget . We get our money back one way or another from these programs . Mrs . Noteboom - If I understand , you want an additional $ 1 , 389 . 00 in 1995 and then your 1996 request would be a total of $ 26 , 590 . 00 . Supervisor Whitcomb - So what is our total 1995 line item budget ? Ms . Beerman - The total is $ 22 , 044 . 00 , and I am requesting an additional $ 1 , 389 . 00 more for a total of $ 23 , 433 funded in 1995 . Councilwoman Harrison - And what is the $ 3 , 156 . 00 ? Ms . Beermann - We still have $ 3 , 156 . 00 in Town funds we would be eligible for only if we match them . Supervisor Whitcomb - If memory serves me we thought we had this wrapped up with the last request . Mr . Frantz - The funding before was to finish up the original project . What we are really requesting here is funding for an additional phase going beyond the original project which was to try and determine, whether or not the Coreorgonel Town site was on these properties . We are requesting funding to pursue further excavations on the sites and to provide Town staff with guidance when we are at the point of designing a park on the site . Sherene Baugher - This is our final year at Inlet Valley . The goal is we would be able to provide the Town Planning Department with exact locations of anything of archeological importance and suggestions on how to develop active recreation , if preservation is needed , and ,still not impact the buried remains . At the end of last summer we found a long wall , more than 100 feet long , at the end of our digging season last year and we would like to return to the site to explore it further . The artifacts date to the 1830 ' s . We also found American Indian pottery and a layer of burned materials we think we can connect to an American Indian house . Mr . Kanter - It would be a very good investment on the Town ' s part as it is work which would need to be done as an environmental assessment to develop the park . The 1995 part we are proposing is a budget amendment , Councilwoman Harrison - Is it possible that anything that gets uncovered would be available for people to look at and learn from? Sherene Baugh.er - George and I spoke with the people at the DeWitt Historical Society , The American Indian program is also interested in anything we find which they could potentially display so more people within the Town and County could see what we are doing . Every year wa have talked with Chief Bonamie of the Cayugas in terms of making it known what the Cayuga heritage is . We are concerned that when we actually stop working on the project the artifacts don ' t just sit in file . Last year on our project we had people from the Oneida Indian Nation present to see how we were working on 1E� arning about their heritage . We have students from the American Indian Program working with us as well . There has been a real effort to get the Indian community involved with this and also had a day open for people to volunteer to help . 17 TB MTG . 8 / 7 / 95 Councilman Klein - How much of the wall has been uncovered ? Town of Ithaca : Gary Teeter , President of Ithaca Veteran Volunteer Fireman ' s Association - Recently we purchased property at 638 Elmira Road , in the Town of Ithaca , which was previously the Machinist Hall . Our organization has filed a letter with the Town Clerk in hopes to obtain a license to conduct bingo games at this location . We understand the Town Board must pass a local Law permitting bingo within its boundaries as there is currently no law pertaining to bingo or games of chance . We are one of two Veteran Volunteer Fireman ' s Associations in the State of New York . We were founded in 1919 to preserve , maintain , and keep artifacts of fire origin pertaining to our local fire service and to provide an organization where veteran volunteers may 18 TB MTG . 8 / 7 / 95 congregate and socialize . A veteran volunteer firefighter is an individual with at least 5 years of service to the Ithaca Fire Department as a volunteer . Our association has many artifacts and memorabilia in our possession which we must keep and maintain at a great expense . One of our possessions is a painting by Henry Walton depicting a local fire currently on display at the DeWitt Historical Society with an appraised value of this painting alone in excess of $ 250 , 000 . 00 . We have other paintings , antique equipment and memorabilia in our building which we must preserve and maintain „ This includes a steamer which may be seen presently at the Central Fire Station on Green Street . We hoped that by purchasing the building we may open the doors to the public and display the artifacts and memorabilia in an accessible museum setting . We have also been a Benevolent Association , sponsoring Little League! Babe Ruth baseball teams , Boy Scouts and Girl Scouts , by approving funding by sending needy scouts to summer camp . In the past we have also purchased equipment for the Ithaca Fire Department to help save lives in our community . Without fund raising we may not be able to continue these services as we have in the past . Now that we are located in the Town of Ithaca we hope we can serve the residents of the Town in much the same way . It is our hope the Town Board will consider our request for licensing bingo in the Town so the Veteran Volunteer Fireman ' s Association may continue as it has in the past . Councilwoman Grigorov - How many members do you have ? Mr . Teeter - In our organization at present we have about 260 members . Councilwoman Harrison - Would approving this be specific to this organization :' Mr . Barney - No . Councilwoman Harrison - Then it would be that we in the Town of Ithaca will allow organizations which meet certain charitable tests to conduct games of chance . Councilman Klein - We have to create a local law and then license each organization that applies for it . Councilwoman Grigorov - What is the situation in the rest of the County ? Councilwoman Valentino - They certainly have it in the City . Councilman Klein - No one in the Town of Ithaca conducts bingo ? 19 TB MTG . 8 / 7 / 95 Mrs . Noteboom - There has never been a local law enacted by the Town Board allowing it . Mr . Barney - One could not say whether or not anyone conducts bingo games . The question is whether they do it legally . Mr . Teeter - The reason we came to the Town is we want to do it legally . Councilwoman Harrison - Is there anything against this as far as anyone here on this Board is concerned? Mr . Barney - It is a mandatory referendum , not permissive . If you adopt the local law it has to be put on the ballot in the General Election and voted on by the electors of the Town . Mrs . Noteboom - There are administrative duties that will be entailed in the Town Clerks Office once it has been enacted . Supervisor Whitcomb - But they cant charge fees for permits . Mrs . Noteboom - Yes we can . Supervisor Whitcomb - So we have time enough between now and the election to (let this on the ballot ? Mrs . Noteboomn - It will be tight . Mr . Barney - If you hold a public hearing at your next meeting and adopt the local law I think you could do it . I believe it needs to be presented to the Board of Elections at least 60 days prior to the General Election . Councilwoman Valentino - Are we in agreement at this point to try to set a Special Town Board meeting if necessary ? Mrs . Noteboom - We need 10 days to advertise for a public hearing and for a special meeting . We would have to hold a public hearing to enact a local law and we need to advertise that 10 days prior to the special meeting . Councilwoman Harrison - Do you license the organization once or do you have to every time they want to hold a game ? Mrs . Noteboom - No they need to fill out an application , give all the criteria and they will inform us when they will have the games . That is the only time and date they can hold the games . If they do have a time they need to cancel for an emergency there is certain 20 TB MTG . 8 / 7 / 95 criteria which need to met ; notify me the game has been cancelled . Basically this is gambling so there are quite a few restrictions the State mandates . If they tell me their secretary , treasurer or president will be conducting the games for that night those are the only ones who may oversee the running of the games . They do this once every 4 or 5 weeks or what ever . It depends on the license and what the-%r want to play . We charge a fee to cover the costs of the administration . Mr . Teeter - What we are looking at is the possibility of getting a regular bingo night . Mrs . Noteboom - It is very regulated . Certain things have to be done . Councilman Klein - You are only asking for the bingo license not for games of chance ? Mrs . Noteboom - You could include that in the local law if you wanted to . Games of chance would also be like raffles . If someone is selling a quilt to earn money technically right now in the Town of Ithaca it is illegal for anyone to sell or buy raffle tickets . The Supervisor postponed continued discussion of this item until later in the meeting to allow the Attorney to the Town to research a legal issue regarding time frames for mandatory referendums . Agenda Item 10 ( k ) - Additional Expenditures - Judd Falls Road Reconstructic?n Supervisor Whitcomb - You will recall the discussion on the Forest Home change orders last month and the Board authorized spending up to $ 5 , 000 . 00 . Mr . Walker - One of the items we missed originally was the fact there used to be a sidewalk abutting the old stone curb which has been removed . Replacing the sidewalk , as discussed at the Public Works Committee Meeting , would cost $ 1600 . 00 to $ 1700 . 00 . You have an up to date bid tabulation and account breakdown for the project . The first section is the original contract sub - total of $ 183 , 000 . 00 for the item:; the Town had to do . Adding the change in the curbing material along with doing the sidewalk replacement is another $ 6559 . 60 . That is within the contract quantities and less than 25W of the total contract . I have already been authorized to spend an additional $ 5 , 000 . 00 to make sure we cover the cost to put the sidewalk back in a usable condition and we are now asking for an additional $ 2 , 000 . 00 . 21 TB MTG . 8 / 7 / 95 There is optional work which is Cornell ' s responsibility . Their component cost for this project is $ 62 , 911 . 50 which includes a change order which had been agreed to . They are adding granite curb , handicapped ramps and an additional sidewalk which with their work brings the total project cost to $ 253 , 594 . 00 . We are within our Highway Improvement budget with this additional $ 2 , 000 . 00 over and above the $ 5 , 000 . 00 already approved . Councilman Klein - Even with the extras to date we are still $ 30 , 000 . 00 under the budget . Mr . Walker - That is assuming we expend totally the 453 account and excluding any other work that may have been planned . Carried unanimously . Agenda Item No . 17 - Discussion related to Chase Lane Extension , Park Emergent:y Access : Mr . Kanter - Since the last Town Board meeting we met with Mr . and Mrs . Sawyer , Tessa Flores and Ira Goldstein . We have put together a very conceptual map showing what we are discussing . There are three items of possibility . One is extending Chase Lane in the range of 500 feet , adding a Town Park at what would become the end of Chase Lane , adding a better turn around at the end of Chase lane and then adding an emergency access road which would provide a connection over to Ridgecrest Road to eliminate the problem of having a loncr dead end road . Those items were discussed with the residents involved and both Mr . & Mrs . Sawyer and Tessa Flores properties would be involved with this as it would not be possible without some kind of involvement of their properties . I had a discussion with Tessa Flores and Ira Goldstein about their thoughts involving their property . They had some specific ideas they wanted me to relay to the Town Board . They were however interested in the idea , in general . They would like to see the emergency access be strictly an emergency access and not provide any through access for lots that would develop in that area . They 22 TB MTG . 8 / 7 / 95 also would want some sort of a gate access control for vehicles . With regard to the park land , they were interested in seeing some kind of a buffer into the park property from their private lands . We had origirLally showed the park at the end of Chase Lane and what they are suggesting is possibly moving one of the private lots down to the far end and thereby having the park in between two private lots . They were concerned with the possibility of noise and other disturbances from the park . If the park were to be developed they would like to see some kind of further separation by fencing or screening to protect their private lands . They are concerned with the overall density of development which might result in this area so they were interested in seeing some kind of restriction with the number of private lots that could be served off the Chase Lane Extension . They are talking about limiting any future lots which could be developed to some given number if that access to Chase Lane . They did not want to see any further access to the interior of the Sawyers ' property that would be served through Chase Lane Extension , basically lots which would be served directly . In fact they were more specific as they would like to see the number of building lots on the Sawyers property limited to 3 new building lots . They own a large parcel of approximately 33 acres at the bottom of they road below the Chase Lane extension and the electric line corridor . This parcel has access to Ridgecrest Road through a 70 foot wide strip and they would like to get two large lots of approximately 8 acres each which could have access off of Ridgecrest Road and would want to limit one house on each of the lots . On they remainder of approximately 18 acres , they would make a conservation easement in order to restrict the ultimate development potential on the property and then would like the Town to give them some sort of water and sewer assessment relief based on this configuration . Finally , they are interested in having the Town or a private entity or some combination provide sewer and water extensions to serve what would become their two lots on the Chase Lane Extension . They consider that: to be in exchange for them making the land available to provide the extension and the Town park . I told them that would be something the Town Board would have to decide if that were appropriate to do . We would have to take a look at what kind of costs would be involved in extending water and sewer lines . There is certainly the possibility of having a contribution . They sounded very interested however have some very specific ideas and how that would occur . I talked with Mrs . Sawyer after my discussion wa_ th Ms . Flores and Mr . Goldstein to bring them up to date on our meeting . 23 TB MTG . 8 / 7 / 95 Supervisor Whitcomb - So you are looking to the Board for some kind of direction as to where to go from here ? Mr . Kanter - Yes . We are a step further than we were last time . We have heard from all involved . Supervisor Whitcomb - It appears all of the parties are willing to continue the discussions , What I need to know is what is the proposed cost: to the Town for extending the road and utilities . Mr . Kanter - There are three parts . One is the extension of Chase Lane , the Town Park and the emergency access drive . Councilwoman Grigorov - So our basic problem is we need an emergency access . Mr . Kanter - Yes . To do any of the three items involves land owned by the Sawyez.ws , Ms . Flores and Mr . Goldstein . Supervisor Whitcomb - So everyone gets and gives up something but we need to know the cost of our portion . Councilman Klein - Who is providing the park land ? Mr . Kanter - Ms . Flores . Councilwoman Harrison - The extension of water and sewer is from where to where ? Mr . Kanter - It would be off Chase Lane . We would need to look at how that would work . The sewer line is in back of the lots . Mr . Walker - Right now the sewer ends at the northwesterly corner of lot # 51 . If they were to put a building lot at the end of the parcel you are talking approximately 300 to 400 feet . Water ends at the end of lot # 51 also and that too would be 300 to 400 feet . For 400 feet of sewer we are looking at around $ 20 , 000 . 00 and for 400 feet of water we are looking at around $ 16 - 20 , 000 . 00 for a total of approximately $ 40 - 60 , 000 . 00 . The road we have and based on the poor condition of the existing road in Chase Lane and the fact the soil is a little less stable we are probably talking at least $ 100 . 00 per foot to build that road or about $ 50 , 000 . 00 . Then another 1? 50 . 00 per foot to build the emergency access which is 600 feet , so a total of about $ 300 , 000 . 00 . Councilwoman Harrison - And this is because Phase II never happened for what ever reason ? 24 TB MTG . 8 / 7 / 95 Mr . Walker - Yes . Supervisor Whitcomb - In normal circumstances when a developer comes in with a proposal for water and sewer on property the developer pays for the extension of those facilities . Now here the Town is also getting something in return but are we getting $ 300 , 000 . 00 worth . Councilwoman Harrison - What we are getting is the emergency access road and the park which we didn ' t get in the Phase I because we anticipated t: he Phase II which did not happen . Councilwoman Valentino - The things shown in yellow on the map are not developed ? How long is the road that comes down to where the first yellow area is ? Mr . Walker - They are proposed building lots and the road is approximately 500 feet . Mr . Noteboom - We had worked up the numbers for the road and the development of the park . The road and the park was around $ 150 , 000 . 00 without the water and sewer . This would be making Chase Lane a road , making the emergency access road and the park . Councilwoman Harrison - What is the acreage of the park ? Mr . Kanter - We show it as approximately 1 acre . Supervisor Whitcomb - Is Ms . Flores willing to put a conservation easement on the rest of the parcel ? Mr . Kanter - They talked only about the 33 acre piece . They did not talk about the larger parcel to the west . Councilwoman Harrison - What kind of land is the land with respect to the conservation easement ? Mr . Kanter - It is largely wetlands . Councilwoman Harrison - Is it disturbed wetland or . . . . . ? Mr . Kanter - Some of it is high quality wetland and some of it is disturbed . It is largely a high grade natural wetland . Councilman Klein - To the east side of Chase Lane , is every lot occupied ? 25 TB MTG . 8 / 7 / 95 Mr . Walker - They are all built on . Mr . Sawyer - I keep hearing about the wetland . My land is as dry as a bone . Mr . Kanter - We are not saying the wetland is on your property although I have not looked specifically for that . The wetlands we are talking about are off the Flores property . Councilwoman Harrison - Are you amenable to these three or four lots along the road and not developing the back portion? Mr . , Sawyer - I don ' t understand why it needs to be a dead end street . Mr . Kanter - In the original proposal if Phase II had been developed , there would have been a through road but the wetlands are largely in the area where the road would have gone . The emergency access road would be a permanent emergency access road only . It would be a minimal road not intended for full access . It would be accessed by emergency and maintenance vehicles only . Mr . Frantz - The Chase Lane Phase II did anticipate the possibility of a street across the Sawyer property from Chase Lane to Ridgecrest Road . That was discussed . Councilman Klein - If they did not own the property how did they provide for it ? Mr . Frantz - The idea was the road would go across Chase Lane and actually it was at the request of the Chase Farm people as they wanted to have any development from the Sawyer property towards that road . Mr . Kanter - That must have been very early in the process as it did not show on the preliminary subdivision . Mr . Frantz - I think you are right . It was something which was not caught in the preliminary stage but they brought it in for final . At that point the issue was raised . It was never formally decided upon however . Councilwoman Harrison - Are you saying the emergency access road would be on the Sawyer property or Flores property ? Mr . Kanter - The Sawyer property . 26 TB MTG . 8 / 7 / 95 Councilwoman Harrison - What do the Sawyers get for this ? Mr . Kanter - The ability to put three or four lots in which they can not do now . At this point there is no access to the property . Councilwoman Harrison - From a park point of view it does not make sense to spend this kind of money . The only thing that makes sense is the emergency access . Supervisor Whitcomb - So what is it worth ? Councilwoman Harrison - How would this provide turn around? Mr . Noteboom - Right now the road just ends . Mr . Walker - There is a 50 foot temporary easement on a persons front yard until we get the road finished . They would like to pave it . Mr . Kanter - We would develop a T type turn around . Councilwoman Harrison - If one wanted to solve the turn around problem without extending the road and the rest presumably one could do that: . Mr . Walker - Not with the land we have there now . If we bought a half an acre from the Flores ' we could turn vehicles around then . Supervisor Whitcomb - That would not solve the emergency access road issue . Mr . Kanter - We would not have to develop the park now . That could factored in to another year . Councilman Klein - Are the Sawyers interested* at all in a road going through the middle of their parcel ? Then the side road would not need to be done . Then you could develop more lots off the parcel . Councilwoman Harrison - What this means is that at some time in the future you could build a road through your property which would provide access and therefore the potential to develop lots throughout that property . Mrs . Sawyer - That would prevent the Town needing to spend the money for the emergency access road ? The Town needs an emergency access . If we were to put in the road you are talking about then you would not need to put in the emergency access road ? 27 TB MTG , 8 / 7 / 95 Councilwoman Harrison - That is correct . Mrs . Sawyer - Why should we take on that burden ? Councilwoman Valentino - Then you could develop all of those lots from your property . Councilman Klein - Maybe it is just an easier way to share it . You would gain considerable benefit having a development more so than you would gain out of this . Mr . Kanter - Also it did not sound like Mr . Goldstein or Ms . Flores would be interested in allowing that on their portion of the property . Councilman Klein - For the little strip possible there is a public need for that: . We could acquire that under eminent domain if need be . Mr . Kanter - What we are trying to look at is to work out something which would be satisfactory to everyone . Supervisor Whitcomb - Could you also put a hypothetical road up the middle and show how many lots the Sawyers might be able to develop . Kanter came I had been talking with Mr . Walker . This has been two years . And now again more time and more time . Supervisor Whitcomb - Let ' s review just briefly what happened here . A developer went out of business and more or less left everyone holding the bag . We do not have an obligation to extend this road . What we are trying to do is to bring the parties together for the benefit of all involved , that is to you , the Town and Ms . Flores . There is a limit however as to what the Town ' s benefit might be from that . To spend $ 150 , 000 . 00 or $ 250 , 000 . 00 on this project which has questionable benefit to Town residents I think requires some study . Mrs . Sawyer - Didn ' t the Town gain a lot of tax money when all the properties were sold ? Tessa Flores is going to develop too . Supervisor Whitcomb - With six lots ? Mrs . Sawyer - She has how many acres ? Councilman Klein - She is not developing . Mrs . Sawyer - She is going to develop yes . She raised questions about what kind of housing could be put up . They have to match the housing which is in Chase Lane now . Yes , she is going to develop . Supervisor Whitcomb - But she can do that now . She owns the property now and she could extend the road . Mr . Kanter - She is saying just the opposite . She is willing to limit it to no more than three on the large parcel and two on the other and virtually no development on the other with the conservation easement . Mrs . Sawyer - We had a phone call from her when she first purchased the land and she asked my husband what we were going to do with the 8 acres and he stated very clearly we wanted to sell it . She asked if we would like to donate it because the acreage she had bought was all going to be wildlife preserve . My husband said to her if she bought all of that acreage she could buy eight more acres . From talking with other people she is going to develop . Supervisor Whitcomb - That would be part of the arrangement if it came to pass . We would have some kind of conservation easement on the remainder of the land which would limit development . What is to prevent you from selling the eight acres right now to a 29 Y TB MTG . 8 / 7 / 95 developer who could then come in at his expense and put the road and utilities in ? What stops you from doing that ? Mr . Sawyer - First you have to get a developer in here . Councilwoman Grigorov - You want us to put the road in . Mr . Sawyer - They used to say it was prime property up there . The land is worth nothing but we are paying about $ 4 , 200 . 00 per year in taxes . That does not make a lot of sense . We are both working people and I hold two jobs . There is something wrong something definitely wrong . How could two working people afford to put a road in ? We can ' t . We have two acres which go with the house but the eight acres is absolutely no good to us other than to just pay taxes . Councilman Klein - Is it on the market now ? Mrs . Sawyer - No it has never been . We talked to McClure Contractors and he was very honest with us and said he had some economic difficulties otherwise he would be very interested . We have talked to two realtors and the minute they come and see the situation with no sewer there from Chase Lane they say your land is worth nothing . Councilman Klein - But the Town could acquire a strip of land for the public purpose . We could through eminent domain acquire a strip of land in order for a developer to cut through the road . The Town sees the public need to extend Chase Lane , Mr . Barney - Yes . We have to be careful in constructing it in that we are doing it for a public benefit and a genuine public purpose . Councilman Klein - We need to do that . Supervisor Whitcomb - But that does not minimize our expense . Councilman Klein - It would increase the possibility of a developer coming in as he can then connect to Chase Lane . We will still try to digest the numbers . Mrs . Sawyer - So when ? Supervisor Whitcomb - Probably the September meeting . 30 TB MTG . 8 / 7 / 95 Aaenda Item No 11 - Consider Tompkins County Solid Waste Fee being added to the Tax Bill : Mrs . Noteboom - I have prepared some numbers for you today . I thought they might be helpful to the Board in making their determination this evening . First let me! say based on the meeting the Town Supervisor and I attended wit :i representatives from the County as well as other Town Supervisors I feel comfortable that the Attorney for the Town and the County Attorney would be able to draft an agreement which would take care of the legal issue of my office collecting the fee for the County . I believe there would be some mechanisms which would have to be cone through , enacting a local law however I do feel comfortable it could be done if this Board so wished it to be . The memorandum given to you in your packet from Beverly Livesay explaining the costs and benefits to the Town if we were to take this on basically says the benefit to the Town of Ithaca for collecting this fee would be $ 4 , 296 . 00 , I was not clear at the meeting on how they arrived at the figure . I think it was agreed at the meeting they were not quite sure . The total amount of the solid waste fee is levied , which would be on the Town tax bills would be a benefit to the Town as we would be able to invest the funds that we would not have normally had . It is either that or it is the money we would collect for interest and penalties if people did not pay -the bill on time . That would be one of the revenues . The second would be since we currently have computers in the Town of Ithaca , which could be used for the collection of the fee the County , under the contract , has said they would give us a one time payment of $ 2 , 280 . 00 . For us to be able to collect this fee would require software training for at least the receiver . I would request that myself and both of my deputies receive the training . That is why I have projected in this the cost of training two people at TC3 would be $ 400 . 00 . While those three people are out of the office someone has to cover our offices . This would mean normal duties would not be done but at least someone would be there . This would cost us $ 71 . 25 from Manpower Services . The County is also saying they would like two other training sessions , one at the County facility and then in our own facility . In January and February we would need a temporary person for at least eight weeks to assist in collecting the taxes . It will be necessary for us to do some extra administrative calculations for the solid waste fee along with the normal collection process . We also would need to purchase a new printer to handle the software as our printers will not accommodate the software at this time . I am not positive I have included that 31 TB MTG . 8 / 7 / 95 cost . I also added in a 1511 cost for employee benefits of the 3 people who will be out of the office for training and the time lost . This does not include time lost for employees due to computer glitches and such . Tompkins County has projected we will earn $ 6 , 576 . 00 , the $ 2 , 280 . 00 one time payment and our pro - rated annual benefit of $ 4 , 296 . 00 . 1 I do not think . this would happen . In either scenario of what they are figuring , the Town of Ithaca has met its warrant at the end of January since I have been here . Yes , we may meet our warrant a week earlier but the amount of money we would be investing would not be that much for a week or two given the interest rates . If it is , the interest. and penalties projected by the County it is based on no one paying the bill on time , the interest and penalties will be accrued . Supervisor Whitcomb - They took the numbers on page 4 . The County calculated that through this scenario they would lose $ 18 , 125 . 00 in investment income . They would also lose $ 10 , 006 . 00 in interest and penalties totalling $ 28 , 131 . 00 which is what the grand total is . They then took that and proportioned it by the share of the towns . The Town itself , Town government , would not accrue $ 4 , 296 . 00 but the savings to the Town as a whole to Town government and Town residents would equal $ 4 , 296 . 00 as the County is losing it and therefore someone has to gain it . Councilwoman. Harrison - Not if no one is getting interest . The County is getting investment income in March , April . I don ' t really understand this but would we have this money sitting around to invest for January , February , March and April ? Mrs Noteboom - We would make some because the sooner we meet our warrant and the funds can be turned over to the Supervisor , the Budget Officer would invest it . There are only two or three Towns who meet their warrant by January 31st . There are three other Towns who do not meet their warrant by the time they turn it over to the County in June . Their projections of how much I do not agree with . It will cost us money to administrate this . Even if we use the numbers they have here we would only receive a revenue for the year of $ 1 , 808 . 22 . Next year when we collect it we will still have the administrative costs and they will not be paying us the $ 21280 . 000 So the Town Board has to decide whether or not collecting this fee is administratively feasible and something they choose and want to do for the residents in the Town . My projections are it will cost the taxpayers more money , it will be a headache administratively but I can see benefits also . I can see you have the taxpayers coming to one place to pay two things which would make it easier for them . At this point in time it is your 32 TB MTG . 8 / 7 / 95 decision . What ever you want me to do I will implement it and I will take care of it . Ms . Kiefer , T . C . Board of Representatives - The dollar figures on the handout are actual 1995 experience figures for the County . The solid waste :Lost penalties and interest is money the Town has never seen because the County has been collecting the solid waste fee . That seems like a very firm number we experience each year when people come in and pay late . The lost investment income is certainly correct as it is what we earned this year in investing money and whether or not the Towns would make as much as the County made is something much less firm as you pointed out . It is my understanding and I was told although a good Town like Ithaca which meets its warrant quickly has to turn over everything to the County by February 15th so you would only have money for the six weeks and most of it for the last two weeks as most pay at the end of January . There is some provision for you not to pay a certain number of things until May . Mr . Barney - If the County is saying to us we will hold on to all of the tax money until May 15th the economics here begin to make a little more :sense . The County expects their money after the end of January . If that is the procedure i do not know where they are realizing these figures . I don ' t know if the figures for February , March and April are the gross amounts for those months . As I understand it: the Town will have substantially all of the Town of Ithaca ' s shave by February , They will still make some so their loss won ' t be the $ 18 , 000 . 00 . Ms . Kiefer - I said the $ 18 , 000 . 00 is an accurate figure for the County this year and much less accurate to project for the Towns . Mr . Barney - It makes a difference also in that people are paying the solid waste fee independent from their taxes . They can get a little lazy about it as it is a $ 60 . 00 fee , not a lien on their property as a. real estate tax and as a result they probably let it go . If it is included as part of the tax bill I think you will find a far greater rate of compliance . If the fee is put on the tax bill I think the $ 10 , 000 . 00 figure would be much lower . Councilwoman Harrison - That is a fairly small amount of money compared to the $ 18 , 000 . 00 . The County will still be able to collect half of February plus March and April on the Town of Ithaca share . Ms . Kiefer - You are talking about the tax warrants not the solid waste annual fee . 33 TB MTG . 8 / 7 / 95 Councilwoman Harrison - If this fee does not get paid with the taxes the administrative costs could be higher than we thought . The assumption is to make it easier for people to pay it all at once . It makes reasonable sense to assume people will pay it along with their taxes . If people are paying this along with their taxes , the experience with the Town of Ithaca shows us we will be turning the funds over to you by the middle of February . This way the County will still be able to collect the investment income . It will not be lost at least from the Town of Ithaca from half of February and all of March and April . The Town will not be making the investment income from these funds . Mr . Barney - The law specifically states each Town must satisfy its portion of the warrant first before any funds are turned over to the County . Case law over the years shows if the Towns do not satisfy their warrant by the time the unpaid taxes are turned over , the County must pay the Towns . Mrs . Noteboomm - That happens with two Towns in this County . Mr . Barney - It does not just happen with the Town of Ithaca . We have met our warrant by January 31st , Ms . Kiefer - What struck me was the handout . As I understand it , you are saying you would need to hire someone for eight weeks for the months of January and February . It was our impression that you hire someone anyway toward the end of the month when the volume is high . Mrs . Noteboom - Since I have been with the Town of Ithaca we have not . What I have done is borrowed personnel from other departments . Ms . Kiefer - There is a rush during the end if January and that is the period when you are most likely to need additional help . Your estimate of hiring someone for a full eight weeks due to this seems startling to me when I saw it . Mrs . Noteboom - The reason I used eight weeks is because of a memo I went back to and reviewed from my Deputy who did a much more intense scenario of the problems we could encounter and used her numbers as well as thinking of my crunch . I realize this may be a little bit of an over estimate . I agree to that however I do think we would need to hire additional help at least five to six weeks . we will have to have them for at least five to six weeks . Mr . Barney - The County is quite a bit different . In terms of manually , as it is not all computer , you still have to take this in 34 TB MTG . 8 / 7 / 95 to account . Right now the Town deals with one book . With this there would be three books and a reconciliation needs to be accomplished . Mrs . Noteboom - The books are not the problem . The problem is with our escrow payments which come in near the end of January in large numbers . I also allowed an extra week on this estimate as we would have a new software program . With only three days training we are not going to be able to just concentrate on learning the software program and practice with it . We would have 4 , 000 bills to get out the last week: in December , ready to receive payments plus trying to learn a software program . My estimate of having this person would also be in the first couple of weeks in January so my deputies have the time to :Learn the new program . Ms . Kiefer - I have notice you have been very concerned about this program all along and probably the most thoughtful clerk in raising questions . I am not surprised this is a very conservative estimate though it is a maximum of what it could possibly cost . Supervisor Whitcomb - Similar to Beverly Is maximum estimate on the revenue side .. Ms . Kiefer - Both Beverly ' s and Joanie ' s figures could be cut down to become more realistic . Mrs . Noteboom - I did not even lower the amount of time I am planning for a temporary person . Next year without the $ 2 , 280 . 00 for a computer , even if I took out the money for a temporary person , we MELybe would break even . Ms . Alario - If you are training your two clerks the last couple of weeks in December water bills will be due and you would need extra help with that process as well . Ms . Kiefer - What ever the dollar figures are here they may or may not be a wash. . We think this proposal has value beyond just this and it is not: clear whether every one has thought of it in these terms . What excited me about this proposal was not so much just making it easier for the residents to pay in one place but it was the idea that finally all at once all of the municipalities could share the same level of equipment and the same software program for handling the tax collection . It would give the additional possibility of further connecting with the municipalities in the County . The County is going to go a head with switching tax collection software and going with the company which will keep us updated in a way Williamson has not , whether the Towns do this or not . The idea of this extra benefit seems worth something and not 35 TB MTG . 8 / 7 / 95 just the dollar value . Mrs . Noteboom - We already share all of the same software and computer program and have done so for the last five years . Ms . Kiefer - It is not a very up to date software . Mrs . Noteboom - That is the opinion of other clerks . I have never had a problem with Williamson and we are very pleased with the package . There are a couple of towns which would like a more efficient program as they also collect school taxes . I understand their problems and I sympathize with them . ' Ms . Kiefer - The copy of Beverly ' s handout was written over with tons of questions . Did you want any of them answered ? Supervisor Whitcomb - Many of those questions were answered at our meeting . Mrs . Noteboom - I would just like to point out there were a couple specific things agreed upon at the meeting . All of the Town Supervisors would bring back the questions to their boards at the earliest convenience in August in order for the County to have an answer by August to accommodate proper bidding procedures for the computers . The other was if one Town decided not to collect the fee the Country would not do it as it would take all of the towns to cooperate . It needs to be 1000 . Ms . Kiefer - There would be no bidding . We would purchase them from State Contract . Mrs . Noteboom - I also brought up the issue of the contract with Mr . Lane at the meeting . He agreed he thought it could be done quite easily .. Ms . Kiefer - You do not have the contract ? Ms . Noteboom - No Ms . Kiefer - There were three changes made to the contract . One was in response to your personal concern about any liabilities should this collection by the towns be challenged . That hold harmless clause was written in the contract . The second change was to make it clear the agreement could be changed in writing by mutual agreement between parties . Mr . Barney - Is there a time limit on it ? 36 i TB MTG . 8 / 7 / 95 Councilwoman Harrison - Presumably the problem was agreeing to do this forever ., Ms . Kiefer - There was no time limit on it but that is the kind of thing which could be changed by agreement with the parties . Mr . Barney - That is a little different than saying any town can say we do not: . want to do this anymore . Ms . Kiefer - There was no time limit change put in that was not specifically agreed to at the meeting with the Supervisors . Supervisor Whitcomb - We have the cart before the horse here . We do not need to talk about a contract if we are not going to participate . If we are going to participate then certainly we need to talk about a contract . There are a lot of good reasons for proceeding and Ms . Kiefer had outlined some of them ; one stop paying for the taxpayer , computer upgrade , new tax collection software , and, inter - municipal cooperation between the Town and the County . These are all benefits however there is a cost to it . I think there is a monetary cost and if the Town wants to say we are going to go a head for all of these reasons we need to recognize there is a cost to Joan and her department and we will need to bear the cost of that . It is not a break even or a money making proposition but rather a money losing proposition for the Town . Councilman Klein - The other argument is by the year 2002 you are certainly not going to be using the same software or hardware . Ms . Kiefer - I should tell you a little more . The maintenance contract for the hardware is through State Contract . The first year they would come to the Town and the last two years the Town would need to take it to them for repair . We are trying to buy it locally to avoid problems . The Systems East software company is good about keeping up to date regarding changes in the law . This software should not need any changes unless the State changes the requirements in which case it would need to be updated . Although it is fashionable to say computers and software are obsolete , if they are doing the job we need them to do then it would not be true . Each Town would be licensed individually by Systems East so there would be no question . Mr . Barney - Has this purveyor of software been used by the County in other areas ? Ms . Kiefer - No , We have sought out someone better than Williamson and this is what we have come up with . I was not in attendance when the company made their presentation to the clerks . It is not 37 TB MTG . 8 / 7 / 95 complete at this time as well . Mrs . Noteboom - That is one thing that bothers me as well . They have not even finished writing the software and yet they expect it to be ready a:nd have us trained on it in time . I would like to ask why the Country will be billing the non - profit agencies themselves ? Ms . Kiefer - There is no reason for the Town to get in to what looks like a bill to tax exempt properties . Mrs . Noteboom - But most of the Towns already have tax exempt properties which are sent bills for water and sewer benefit assessments , fire protection services etc . . . Ms . Kiefer - We assumed it was easier not to put that on the Town because you don ' t send them a property tax bill , that is why . Mrs . Noteboom - Many of them do . That might be your cost which could be savE!d to the County . It was my understanding the reason you were going to bill those entities was because you would not be able to collect the fee if it was sent through the tax bill as they would considE! r it a tax . Ms . Kiefer - They do not pay tax bills . Mrs . Noteboom - The solid waste fee is not a special district so the only way the exempt properties would pay it would be through a bill other than the tax bill . Councilwoman Harrison - What are the benefits to having all of the Towns using the same computer program for taxes , what is the significance of that ? Mrs . Noteboom - We already do . It is a uniform system which helps in the collection of the taxes . It helps all of us . Mr . Barney - We could stay with Williamson if we wanted however it would not be feasible to do as it would not work for the County . Suppose the County moves on with the Systems East program and we decide to stay with Williamson ? They originate the warrant which comes to us . Mr . Walker - The only problem is I believe the County has to eliminate the Williamson software so they won ' t be generating the roll on the computer . Mrs . Noteboom - Williamson does not generate the roll now . The County does it through their main frame computer . Williamson 38 TB MTG . 8 / 7 / 95 converts that: to their software program . We would still have to contract with the County in that instance if we kept Williamson to create our roll . Supervisor Whitcomb - So then our cost would go up anyway if the County elects to change its software and we do not . Ms . Kiefer - The foreclosure period has changed under State law and we have to change our software and Williamson did not even know about the change . That was one of the problems and they had not been serving us well . Supervisor Whitcomb - I wish we were having this discussion in April instead of August as there are so many unresolved issues . I worry along with Joan in that tax collection time will be here and there will still be unresolved issues . Councilman Klein - Can we defer this issue until next year ? Ms . Kiefer - You can be the one to kill it if you want . Councilwoman Harrison - There is some concern of finding ourselves in a crunch so if one said conceptually we are with you let ' s work on it for the following year , why is that killing it ? Ms . Kiefer - It is not clear to me that solid waste would still be excited about donating $ 60 , 000 . 00 from it ' s budget . Councilman Klein - But they are making all of that extra money . Councilwoman Harrison - That is the County ' s problem . Ms . Kiefer - Of course it is the County ' s problem . I can ' t guarantee anything though . Supervisor Whitcomb - Conceptually and in the abstract I think it is a good idea and something we should continue to discuss however this hurry up and rush it through is going to come back to bite us . Councilwoman Harrison - Could this appear as if the solid waste fee is being :Levied by the Town ? Supervisor Whitcomb - Sure . They think all of the taxes are levied by the Town . Mrs . Noteboom - The way the bill will look is the top portion will have all of the Town , County and special assessments and there will be a total . Then there will be a line drawn and it will indicate 39 TB MTG . 8 / 7 / 95 Tompkins County Solid Waste Fee with the amount . Then there would be a second total at the bottom . I can see someone paying just the top portion or the lower portion which would create so many problems administratively . Supervisor Whitcomb - Most of those come in at the end of January when there i .s not enough time to return them for the correct amount thus resulting in a penalty . In a sense you are going to make it easier for some however there will be others who will mail their payment , pay the wrong amount and it will be sent back to them with a penalty due . Then you will find there will be people who come in to argue about the solid waste fee to our clerks who know nothing about the fee and who bear no responsibility for it at all but has to listen to the complaint so you would get rid of some of the complaints or.Lly to get others . Over the long haul I still think it makes sense for the Town and the County to move forward on the same software . Mr . Frantz - We have discovered the hardest part of this project is editing the signs down . I am trying to develop color themes for the signs however we came down to four . All of the signs have white lettering including the Town of Ithaca logo . These are sprayed on paints . Alan got the price estimates and 24 of the historical markers installed would cost approximately $ 12 , 750 . 00 . Mrs . Noteboom. - If you think about the projected longevity of the signs you would be talking $ 10 . 60 per sign per year for 60 years . Mr . Frantz - I have been looking at a lot of them and virtually all of the ones I have looked were erected before 1935 . The developer is preparing the road base . Sanctuary Woods Subdivision , Sapsucker Woods Road Record drawings and engineering certification by the developers engineer of the water and sewer improvements are pending . The contractor is in the process of construction of the road . EARTH FILL PEFMITS- An earth fill permit for a site on Five Mile Drive with the potential. source of fill being the Rte . 96 Project has been submitted, to the Town . The volume of proposed fill involves review by the Planning Board prior to a special approval consideration by the Zoning. Board of Appeals . Cornell University is preparing additional information for the earth fill permit application for the restoration of the old land fill adjacent to the Library Annex in the Orchards area , and installation of stormwater management structures in precinct 7 . WATER PROJECTS A cybernet hydraulic model for the South Hill water system is currently being developed by student interns , and will be used to assist in system optimization and reviewing the impacts of several development projects along D.anby Road . The Town Engineering staff is continuing to work with the Bolton Point staff to implement the master metering program for connections to the water transmission main . The SCLIWC agreement includes a provision that all connection points on the. transmission main to the member municipalities will be metered for the purposes of monitoring water consumption . The Town Engineers Report 8 / 7 / 95 3 HIGHWAY AND PARKS The Judd Falls Road reconstruction project is proceeding with the installation of storm drainage and pavement underdrains completed . Work on repairing the Plantations Road pipe arch structure is complete and placement of the fill over the arch will be completed after re - installation of the water main . this week . Placement of the crushed stone road base is nearly complete and curb placement is scheduled for August 3 . NYSEG is holding on the relocation of the utility pole at the Forest Home Drive intersection pending their internal review of the project . The Forest Home bridge project has a revised schedule provided to the '.Gown Engineer by a copy of a July 27 letter from John Lampman to Beverly Livesay . The schedule indicates the schedule for approvals by the various agencies involved , and anticipates execution of a contract by the end of December 1995 . The Town Engineer has not received an engineers estimate of construction costs for - the final project , including the distribution of costs between the County and the Town . FACILITIES The Town Engineer has continued to work with the Town Clerk , the Highway Superintendent and the Parks Manager on a facilities improvement plan , which includes the Town Hall facilities and the Highway and Parks department needs . Worksheets were sent to budget managers this past week . Some requests and figures have come in from outside agencies . Throughout the budget process I will be doing studies on all funds for cash flow , year end fund balances , unusual trends etc . Information needed for the first draft of the five year capital plan is still pending . I hope to be able to have a draft plan started in the next couple of weeks . I continue to work with Dave Rose from Computel the utility auditing company . Dave has proposed some changes to help reduce our NYSEG bills . He is currently working with NYNEX on our telemetering bills . He has found us a credit with NYNEX of approximately{ $ 4 , 000 . 00 and will continue to investigate . Several hours were spent this month tagging items for the County auction . We still have a bit more work to do , but I ' m sure we ' ll have everything done in time . The computers in the accounting department have . been linked by cable to enable the accounting package to be used on either computer . This helps alleviate some of the over crowding in that office . I am also looking into prices on external tape drives . This will allow the Town Hall and Highway Departments to implement a backup program outlined by Mike Ocello . Respectfully submitted Sally E . Alario Agenda Item 4c HIGHWAY SUPERINTENDENT ' S MONTHLY BOARD REPORT , JULY 1995 TOWN OF ITHACA TOWN BOARD , AUGUST 7 , 1995 Tompkins County The Town received a copy of the letter that John Lampman , County Engineer in charge of the bridge project , wrote to Beverly Livesay regarding the Forest Home Bridge . That letter outlines the schedule and where it is at this point in time . This schedule has the maintenance agreement between the County and Town being executed by the Town on August 23 , 1995 , and approved by the County September 5 , 19950 Tompkins County has solicited information from every county in the State about bridges . It appears that the County would like to alter the maintenance agreements on bridges that the Towns have with Tompkins County . We have already sent a resolution to Tompkins County stating that we are not interested in altering the agreement . We need to pay attention to this situation to see what develops . If the agreement is altered too much , it could be a very costly item for the Town . Personnel The Highway / Parks Department is always under a great deal of pressure during our summer work season . There is our normal maintenance that needs to be accomplished for all our rights - of - way ( roads , trails , parks , water and sewer lines , etc . ) We also have problems or :requests arise for special situations that need to be addressed . These requests are generally very valid requests that need our attention , but they siphon off much needed work hours that we don ' t always have available . This makes it necessary for us to continually :reprioritized our work load to adopt all the changes that come along . Another area of concern is our construction projects . Our staff is capable of handling theses projects , and they do an excellent job . The problem is having enough staff and work hours to accomplish it all . The Public Works Committee has discussed this on occasion and there are a few apparent solutions . Each one has its draw backs . One solution would be to add more permanent staff . The main draw back in this area is the need to carry this staff year around . To have enough people to do our summer work we would have too many to do our winter- work . Another solution would be to contract out more of our construction work . When the Town does this , we need more money in our budget line items to pay for it . Also , we may need addition Highway Superintendent ' s Monthly Board Report Page 2 administrative personnel to oversee projects . When Town forces do a construction project , the cost does not escalate when changes are needed . Changes made during a contract always add to the costs ( administrative and material ) . The third solution would be to hire more summer help . Good summer help is not always easy to find . This is the method we are going to continue to utilize for the immediate future . We have taken advantage of the Youth Conservation Corp . ( YCC ) , and this year we are utilizing Tompkins County Job Training that gives us a few youth to work with . The draw backs of this is the youth are limited in what they can do and we have to provide supervision . It doesn ' t always appear to be cost effective . We also utilize the Tompkins County Probation Department. ' s Community Service Program whenever we can . Probation supervises these people . ghk Agenda Item 4c Working Supervisor ' s Monthly Report , July 1995 Town of Ithaca Town Board , August 7 , 1995 Again this month , the bulk of the Highway/ Parks Crews time was spent on preparing the roads for surface treating . Ditching and miscellaneous other tasks took 742 hours of time . Eight of those hours were over time . Hot Patching took 575 . 75 hours of time . In July , we used 506 . 74 tons of fine top . This is used for patching the roads . The Crews spent 104 hours on Sewer Maintenance . This includes cleaning catch basins , etc . The rest of the crews time was spent on machinery maintenance , for 216 hours , and mowing and trimming trees , for 152 hours . August Projects 1 . Surface treating roads . This is scheduled for the week of August 14 , 1995 , 2 . Hot patching . 3 . Brush and tree removal . 4 . Mowing rights - of - ways 5 . Repair manholes . 6 . Repair catch basins . 7 . Agenda Item 4c Parks and Open Space Manager ' s Report , Julv 1995 Town of Ithaca Town Board Meeting , August 7 , 1995 ( Note : July report includes June 29 and 30 , 1995 ) 19 Mowing and regular grounds maintenance at all park and trail sites required 98 hours , despite the hot , dry weather during July . 2 . Preparation was begun for resurfacing the East Ithaca Recreation Way from Game Farm Road to Maple Avenue ( a total of 1 . 17 miles ) . Brush was cut back , some trees removed , ditches restored , and base gravel was graded , leveled and rolled . The oil and stone will be applied the week of August 14 , 1995 . Immediately after that , we will be adding loose gravel on the unpaved portion of the trail to built it back up to grade for those who choose to use that side of the trail . Parks worked 89 hours on this preparation work . 3 . Plantings were begun at Christopher Circle Water Tank . However ; dry weather forces us to wait until late summer or early fall to complete the rest of the plantings . We have had to irrigate the grass and wildflower seedings all month and have had to spray deer repellant on our plantings to prevent browse damage . Parks sent 48 hours on the project during July . 4 . Two sumrner youth workers began assisting parks in mid - July , working a total of 25 hours per week . They are helping with staining park furniture and shrub trimming . Staining is about half finished . A total of 54 hours was spent in July . Shrub and trail trimming work required 195 hours thus far . 5 . Routine maintenance tasks took 199 hours in July . August Parks Projects 1 . Complete staining and shrub trimming . 2 . Mow water tanks , pump stations , and Dewitt Pond . ghk Agenda Item #3d Plannint; Director' s Report for August 7, 1995 Town Board Meeting DEVELOPMENT REVIEW Planning staff has, been working on the following projects under Planning Board review jurisdiction: First Residents Group at EcoVillage, Mecklenburg Road Final Site Plan Approval was granted at July 18th meeting. Ithacare Senior Living Center, Danby Road A public hearing for public comments on the DEIS was held on July 18, 1995. Comments are being assembled by staff so that responses for the FEIS can be prepared. Significant staff time will be spent on the FEIS and Findings Statement over the next couple of months . Alternative building configurations are being investigated as possible mitigating measures, which may require going back to the Town Board for modification of the Special Land Use District (SLUD) and / or modification of the preliminary site plan. Wheeler/ Boronkay Subdivision, Evergreen Lane Preliminary and Final Subdivision Approval was granted at the July 18, 1995 meeting, subject to modification of restrictive covenants by the Town Board regarding future subdivision of lots in the Poyer Subdivision. This subdivision simply involves the transfer of a portion of one lot to that of the adjacent landowner to increase their yard area . The restrictive covenants that were adopted regarding the Poyer Subdivision were meant to prevent additional building lot;, and were not intended to restrict this kind of land transfer. A request to modify these restrictive covenants will be on the Town Board' s August 7th agenda . Saint Catherine of Siena Church Subdivision, Saint Catherine Circle Preliminary and Final Subdivision Approval was granted at the August 1 , 1995 meeting for the subdivision of the 10 acre Saint Catherine of Siena Church property to create a separate building lot for the construction of a priest' s residence . will be presented to the Planning Board for their recommendations probably in September. Parks , Recreation and Open Space Plan Update : Recommendations, cost estimates and 5 Year Capital Plan were discussed with the Public Works Committee at the July 27th meeting. Staff is hoping to assemble completed draft Plan within the next month or two so that review by the appropriate boards and committees can be completed. Cornell GEIS / SLjJD : Committee and Cornell representatives conducted a field visit to look at building heights and setbacks on campus, and, as a result, have suggested some revisions in the SLUR . A final (hopefully) Committee meeting has been tentatively scheduled for Thursday, August 10th at 2:30 p .m, to go over remaining issues . The revised SLUD would then have to go back to the Planning Board for a recommendation before consideration by the Town Board, Defining Buildable Land : Planning Committee is discussing the question of how to define "buildable land" in proposed subdivisions in order to determine number of permitted lots / dwelling units and to provide better guidelines for lot/building layout on a site. Planning staff prepared a draft amendment to the Subdivision Regulations that was discussed at the June 29th and July 17th Planning Committee meetings . The next probable step is to send this proposal to Codes and Ordinances for review. Ithaca-Tompkins County Transportation Council (ITCTC) : Town Planner was appointed by ITC:TC Planning Committee to the Steering Committee that is overseeing the County Trail / Corridor Study, and attended the kickoff public meeting that was held on July 27th. The purpose of the study will be to collect information and provide planning / design analysis to facilitate the identification, prioritization, and preservation of crucial transportation corridors, focusing on trails, and to provide a countywide perspective to what localities in Tompkins County are doing with their trail systems (as a supplement to what the Greenway Coalition is doing) . In addition, staff has attended ongoing meetings of the Route 96 Mitigation Coordination Subcommittee. Recent meetings have focused on operational and public information aspects of the construction project. County Waterfront Planning Study: Staff attended a meeting with representatives from Tompkins County, City of Ithaca and NYS Council on the Arts regarding a grant application. that was jointly submitted by the County, City and Town. The study would look at waterfront planning issues and opportunities in the City and Town areas of the Cayuga Lake waterfront, including possibilities for increased / enhanced public access . The Council on the Arts representative indicated that chances were very good that some funds would be available for this study. This is the study which for which the Town Board has authorized use of up to $5,000 from the 'Planning Study" account (B8020 . 406 ) . Board Membe FROM: George Fran � ,Q DATE: July 28 , 199 RE : Request for additional funding for Inlet Valley Archaeological Survey, Professor Sherene Baugher has submitted a request for additional funding to allow her to follow up on the findings of the recently completed Inlet Valley Archaeological Survey. Her request is outlined in the attached letter. She would like specifically to return to the site to conduct further excavations at the site of a fieldstone wall which was uncovered in Fall 1994, and to do a series of shovel test pits on the hill that covers the southern portion of the Bostwick Road park site . The Planning Department recommends that the Town Board authorize the additional funding. The archaeological work Professor Baugher proposes to undertake on behalf of the Town is work which would be required as part of any environmental review process under SEQRA, :prior to Town Board approval of any park development projects on either site . By continuing to tap her expertise and resources , the Town is .accruing significant savings over the cost of having the work done by a private contract archaeologist. I have reviewed our files on Survey to determine how much the Town has contributed to the project to date. Altogether the Town of Ithaca share of the project' s costs since August 1993 has been $ 3 ,520 in cash and approximately $3 ,700 in Planning and Highway staff time and highway equipment rime. Kanter: This letter is a follour up to conversations that I have had with George Frantz regarding our final year of excavation on the Town of Ithaca park properties in Inlet Valley . Mr . Frantz suggested that I send this letter as a formal request for financial support for an archaeological assistant. As was done for the past two years , Cornell will continue to pay for the majority of the expenses of the Inlet Valley excavation (equipment, vans , insurance for the students , and my salary) . I hope that the Town of Ithaca will also continue to support the project in its final year . I would greatly appreciate it if the Town of Ithaca would again hire Kathleen Quinn , as a temporary Town employee to work on the project. I will need her for 260 hours at $ 10 per hour for a total cost of $2 , 600 . 00 . She will work for 100 hours ($ 1 , 000) between September 1 , 1995 and December 31 , 1995 . Between January 1 , 1996 and June 30 , 1996 , she will work for 160 hours ($ 1 , 600) . Ms . Quinn has worked with me on all phases of the Inlet Valley project. She is extremely knowledgeable and her assistance will enable me to complete the final report on the Town park sites in a timely manner (June 30 , 1996) . Our report will meet all federal and state environmental review guidelines . Our report will also provide the Planning Department with data and suggestions for preserving the archaeological material while still being able to design the Town park sites for active recreation. During the past two years , it worked out to be more cost efficient for the Town to hire Ms . Quinn directly as a temporary town employee . If the funds were given to Cornell , then there would be an administrative fee charged , meaning less money would be available for the assistant archaeologist . In the past the Town was able to hire GIs . Quinn by using funds set aside for student assistants/temporary employees . In Fall 1995 , we will be excavating the Town site formerly owned by Mr . Tomlinson ; we did not have access to this parcel prior to the Town ' s ownership . In addition, we will finish the excavation of the park site on the former Eddyhill Inc . property . In Fall 1994, at the very end of our digging season , we uncovered a 100 foot long section of a fieldstone wall . This fail we would like to uncover the rest of the structure and determine; its function . The artifacts associated with the wall date from 1830- 1870 . In that same field we found the. floor of a structure that may be made by American Indians ; we also found Native American pottery . It is possible that the pottery and the structure are both associated with the Tutelo settlement of Coreorgonel . I thank you for your continuing interest and support of this joint endeavor . The Planning Department is requesting authorization from the Town Board to apply for a grant from the Preservation League of New York State and New York State Council on the Arts for the purpose of funding. part of the cost of an archaeological survey in Inlet Valley . The objective of the survey is to confirm whether or not the Iroquoian townsite of Correorcronel is located in the area of Inlet Valley bounded by NYS Rte. 13 , Seven Mile V Drive, Bostwick Road, and Five Nlile Drive . (map attached) The survey will be a joint effort between the Planning Department and Professor Sherene Baugher, Visiting Professor in-. the Department of Ciry and Regional Planning and Department of Archaeology at Cornell University . It will be completed during the Fall semester at Cornell, as part of a field course in archaeology. Professor Baugher is an archaeologist, and will oversee the archaeological survey portion of the project. Under her direction graduate teaching assistants and students enrolled in the course will conduct a field survey of the site . Planning Department staff will provide basemaps , aerial photographs , and other data for the site , provide some onsite guidance, act as liaison with property owners, and administer the grant. If necessary , up to three days of Engineering Department staff time will be available for site surveying and mapping work. In addition to Professor Baugher' s expertise and student workers, Cornell University will supply the tools and. equipment needed for the excavation work through a Faculty In Service Grant to Professor Baugher. The Planning Department will be requesting up to S3 , 000 through the Preservation League/Council on the Arts grant program . This money will be used to partially fund an additional teaching; assistant position in the Department of Archaeology for the Fall semester. This additional teaching assistant will augment the one to two assistantship positions that normally support Professor Baugher' s course , and will ensure adequate supervision in the field. The remainder of the position , or $2, 000 , will be paid out of the Planning Department budget for student interns . Evidence however indicates that it may be the crest of the low ridge located approximately 500 feet west of Five-Mile Drive . The proposed archaeological survey is intended confirm whether or not the evidence is correct. The installation by the Town of public water and sewer service in Inlet Valley has greatly increased the potential for large scale development in the area. Town staff is aware of preliminary plans for the development of the 80-acre parcel along the east side of Seven- Mile Drive, and of the intentions of the Tomlinson family to develop their land on the south side of Bostwick Road opposite the Ithaca City School District bus garage . Under SEQRA and any number of other state and federal laws, the issue of the location of the Correorgonel townsite, and the preservation of any historic and cultural artifacts discovered, will have to be addressed by the Town of Ithaca and developers during the development review process. However timely identification of the townsite location, prior to the receipt of development applications, will allow the Town to work with developers to plan for it, design around it, and preserve it without undue expense and controversy .
