At a regular meeting of the Town Board of the Town of Ithaca , Tompkins County , New York held at the Town Hall , 126 East Seneca Street , Ithaca , New York there were present : PRESENT : John G . Whitcomb , Supervisor ; Karl Niklas , Councilman ; David Klein , Councilman ; Carolyn Grigorov , Councilwoman ; Ellen Z . Harrison , Councilwoman ; Catherine Valentino , Councilwoman ; Edward Conley , Councilman , ALSO PRESENT.1 John Barney , Attorney for the Town ; Joan Lent Noteboom , Town Clerk ; Daniel Walker , Town Engineer ; Fred Noteboom , Highway/ Parks Superintendent ; Andrew Frost , Building/ Zoning Officer ; Sally Alario , Assistant Budget Officer ; Jonathan Kanter , Town Planner ; Dooley Keifer , T . Board of Representatives ; Carol Hale , WHCU ; Bruce Simmons , State Insurance Fund ; Jackie White Call To Order, The Supervisor called the meeting to order at 5 : 30 p . m . , and led the assemblage in the Pledge of Allegiance . Agenda Item No . 4 - Reports of Town Officials - a . Town Supervisor - See attached . These are informational items . Our final audit report was one of the cleanest ever . Civil Service items will be addressed later and policy issues will be reported in more detail at a later date . I am urging the Town Board to move forward on the new town hall issue . b . Town Engineer - See attached . The highlight is the Forest Home bridge will not be built until next year . The status of the design documents and drawings is approximately 90 % and were delivered to the County more than a week ago . The Forest Home work group met and reviewed the drawings . There were a few minor details addressed regarding the railings for historic preservation reasons . John Lampman has sent the drawings to the State for review and it is hoped the state will sign off , however logistics being what they are , getting a design and full set of contract documents ready before August or September would be difficult to do , The plan is to have all approvals by September and put it out to bid at that time and contract the work out in October for construction in 1996 . Winter construction can be expensive and would also cause a significant amount of traffic congestion in that area during the school year . Councilman Conley - What affect would this have on any funding ? Mr . Walker - Our understanding is if we commit to a contract this year the funding would be secure based on discussions with NYSDOT . I am confident the funding will be held . We do not have a final tima cost este as yet as the design , as of the meeting a week ago , TBM 6 / 12 / 95 had not been determined and there is a questions as to whether the abutments can be saved . The new design shows new abutments which could possibly be more expensive than the original concept and we are awaiting the final engineer ' s estimate of cost . Councilman Conley - Has the University and neighborhood been informed of t: his ? Mr . Walker - The work group and other Forest Home organizations as well as Cornell are aware the work will not begin until next year . Councilwoman Harrison - Is an earth fill permit required under the zoning ordinance and is it for excavation or fill ? Mr . Frost - Section 70 of the original Zoning Ordinance was intended to deal with mining . Councilwoman Harrison - The process is then the Planning Board reviews the request and then the Zoning Board of Appeals makes their decision to approve or deny the request , right ? Mr . Walker - If it is less than 2500 yards of material , the ZBA would be the granting authority for the permit . If it is over 2500 yards , it requires review by the Planning Board first , then referred to the ZBA . If it is under 250 yards it becomes an administrative permit . Councilwoman Harrison - Have we talked about the location of the East Hill water tank ? Mr . Walker - This was discussed in the capital project plan some time ago . We are looking at a possible sight on the Baker Institute property . Councilwoman Grigorov - Can you tell me where the Five Mile Drive fill will be placed ? Mr . Walker - Directly across from the cemetery on Five Mile Drive . The property is owned by the Immaculate Conception Church ' s Cemetery Association . C . Highway/ Parks Superintendent - See attached . Councilwoman Harrison - I was delighted to receive your note regarding meetings with residents in various areas of the town . In future reports could you list the names ? Mr . Noteboom - Councilman Klein and myself met with Duane Wilcox on Simsbury Drive recently regarding the paving on the road . Mr . t Wilcox was to talk with the neighborhood association about oil and 2 TBM 6 / 12 / 95 stone methods . There seems to be some contention in the neighborhood with using this method due to the stones , etc . . We made some changes last year on the size of the stone used and the method of laying it . This seemed more aesthetic and appealing and I am trying to sell this method in the neighborhoods . It is less expensive than paving . This year , in our resurfacing plan , I have attempted to contact the neighborhoods and have talked to some of the resident : to ascertain their willingness to try this method . Cost wise , we could resurface 3 to 4 miles of road with the oil and stone method as opposed to 1 mile using black top . Councilwoman Harrison - Could we make a note to include this in our next newsletter ? Mrs . Noteboom - Ok . Councilman Klein - Fred also met with Carol Anderson Winthrop Place regarding the drainage issue . Councilwoman Harrison - Did you manage to reach an understanding ? Mr . Noteboom - I believe she understands however I do not think we have " cured " the situation . There are a few things we will try first and given it is located in the Village , some things have to be done differently . Mr . Walker - We will be working with the Village of Cayuga Heights , the school , etc . . . I received a call from one of the teachers at the school who would like to put multi - use in the detention structure there and have a permanent pond so the students could use it for educational purposes . There are a number of issues including the capacity of the structure and the liability issues which must be addressed before we proceed . I have asked to have one of the authorities of the school write a letter to the Town Supervisor requesting an analysis of the possibilities which have been discussed . d . Town Planner - See attached . The public information meeting for the Six Mile Creek Conservation District is scheduled for Monday , June 19 , 1995 at 7 : 30 p . m , at the South Hill Elementary School cafeteria . We have heard from 2 or 3 residents so at this point we are not sure how many will attend the meeting . Councilwoman Harrison - In the Parks , Recreation and Open Space update it mentioned the possibility of the Conservation Board conducting field visits . It would be nice to invite the Town Board to these visits . e . Building Inspector / Zoning Officer - See attached . 3 TBM 6 / 12 / 95 f . Town Clerk / Receiver of Taxes - See attached . g . Assistant Budget Officer - See attached . h . Attorney for the Town - The Town Board had authorized us , some time ago , to try and negotiate an arrangement where the appeal would be dismissed on the bed and breakfast issue . We have attempted to negotiate with little result after having made the request . They filed the appeal with the courts in an attempt to get a stay against enforcement of the lower court ' s order . We resisted the stay and Judge Rumsey agreed on Friday and ruled from the bench the stay would be lifted effective June 12 , 1995 , Agenda Item No . 5 - Report of Town Committees • Councilman Niiklas - The Codes and Ordinance Committee met and discussed thte fees in lieu of parkland issue . The committee concluded the most equitable solution would be if property had sold within the last two years the fee would be calculated based of 100 on the assessed value of the property or the purchase price , whichever is less . If the property had been sold longer than two years ago , the fee would be calculated on the based on 10 % of the current assessed value . This recommendation will be presented to the Town Planning Board for consideration . Councilwoman Harrison - There was to be some adjustment regarding partial improvements . The parcels all have public access , not fully developed . Councilman Niklas - We did consider that . The issue was referred to the COC for consideration and recommendation . Councilwoman Harrison - I would ask that we review the minutes . I remember an involved discussion regarding this issue . Councilman Klein - After the discussion , I was of the understanding the actual sale price is the value of the land or in absence of a recent sale , the assessed value . The County reassess land every three years . It seemed this would be the best basis of calculation . Taking 10 % of the land would be 10 % of the value . Supervisor Whitcomb - The assessed value includes any improvements made to the property . Councilwoman Harrison - If you buy raw land there is no improvement value included in the assessment . Supervisor Whitcomb - Yes there is . If water and sewer are available to the property , they are included in the value of the 4 TBM 6 / 12 / 95 property . Councilwoman Harrison - If you buy a piece of land and it does not have water and sewer , then you run the water and sewer and put in a road , the value at the time you purchased the property does not include the improvements . Councilman Niklas - The Town Board referred this back to COC for its recommendation . The bottom line is it will come back to this board with the advice of COC as to how to proceed . At that point , changes may be made . The COC ' s opinion , which the Town Board solicited , is what I just stated . Councilwoman Harrison - Did you have the benefit of reviewing the minutes ? Councilman Niklas - There were three members of the Town Board in attendance at. the COC meeting . The three of us recollected the discussion you refer to . Councilman Niklas - Town staff also finished making recommendations regarding perspective rezoning of properties for which the zoning had been changed in terms of certain site plans approved by the Town Planning Board . There were also some undeveloped lots town staff looked at and will make a recommendation for rezoning . Those recommendations will be sent to the Town Planning Board with back up information . Ultimately , these recommendations will be presented to the Town Board by COC for their review and comments . Councilman Klein - The Public Works Committee discussed the pedestrian walkways and crosswalks . Mr . Noteboom had contacted the State as well as researching the law . Basically crosswalks may be placed any where deemed appropriate however the state does not advise placing more crosswalks than needed . The committee reviewed the proposed trail behind Pine Tree Road . Discussions will proceed regarding the needed easements . The Forest Home bridge issue was addressed with some concerns regarding the County ' s involvement . Annual maintenance on the various water tanks was raised and a recommendation of concrete tanks as opposed to steel was discussed . Mr . Walker - Concrete tanks can be buried as opposed to above ground . Councilwoman Harrison - I would like to know at some point where the various crosswalks are located within the Town . I had discussions with Mayor Nichols and David Boyd concerning publicizing pedestrian rights at crosswalks . One of the prospects 5 TBM 6 / 12 / 95 was dedicating 1 week to pedestrian rights to raise awareness . Councilman Ni. klas - An additional approach would be to solicit Ithaca College and Cornell for their assistance . Information regarding New York State laws on crosswalks could be supplied in admission packages . Councilwoman Valentino - Grocery store crosswalks are also a grave concern to many . Councilman Grigorov - See attached . After some discussion it was suggested the issue of the mailbox placement be taken back to committee to explore some other alternatives which might be available . Mr . Kanter - I met with Cornell GEIS representatives and discussed the issue of parking standards . There will be some final conceptual issues to bring back to the committee in the next week or two , prior to being brought back to this board . Agenda Item No . 7 - Persons To Be Heard : No one present wished to speak . Agenda Item No 6 - Tompkins County Board of Representatives : T . C . Board Representative Dooley Kiefer - I would be happy to discuss the Forest Home issue in detail at another time with you . However , it started when the County ' s staff engineer in charge , Liz Cameron , went: on leave and did not come back . The County , in trying to make use of existing employees without hiring additional , realized there was a qualified engineer in the solid waste division who could fill the position temporarily . This did not happen until approximately three months later . The Engineer was told the County was more concerned about the Biggs air quality problems than anything else at that time . This is my understanding of the situation . Councilman Niklas - Is there any one person responsible for this delay ? Ms . Kiefer - I do not believe there is any one person to point the finger at . :Liz Cameron had assurance from the State Office of Historic Preservation , given the Forest Home Community and the Town Board ' s backing of this particular historic design , that it would be a weeks turn around time in their office . The engineering firm the County retained had no one free to work on the drawings when the project went back to the consultants . At that point they hired a sub - consultant . This consultant was not experienced in historic preservation :projects and ultimately we regressed on the project . 6 TBM 6 / 12 / 95 He tried to redo the project . The questions is who supervises the sub - consultant ? The consultant . Who supervises the consultant ? We thought they knew what we wanted . So it is very difficult to point a finger . The problem now is there has been a change in Albany and Historic Preservation is not doing the one week turn around and will need their full 90 days to review . The bottom line is as was reported . There is every likelihood the designs will be completed and go out to bid . The bid will be awarded and State DOT has given assurances the money is there this year and will be encumbered this year . We believe this and this is the best we can do . Supervisor Whitcomb - Our concern is to make sure the funding is protected . Ms . Keifer - The Town representatives on the County Board know this and feel very strongly about this . I am not on the appropriate committee so it takes me time to find out what is going on . The other item I thought you would be interested in was the solid waste annual fee . A meeting will be held sometime in June to give a demonstration to clerks and supervisors of the special software package being developed to make this transition painless . The date has not been set as we are waiting to hear from the firm developing the software to be sure they will have it ready to demonstrate . Supervisor Whitcomb - This would probably be a good indication of whether or not they will have it ready to use in a timely basis as well . Ms . Kiefer - This firm seems promising to me compared to the firm we have had . I would like to distribute these pamphlets from Tompkins County Environmental Management Council regarding burn barrels and open burning . More are available from EMC if needed . The EMC did a good job in formulating an education flier for the public . Councilwoman 'Valentino - I recently used the new recycling facility on Commercial Ave . and I must say the staff was very polite and the facility was very impressive . Agenda Item No . 24 and No . 25 - Election To Self - Insure Workers ' Compensation Claims : Supervisor Whitcomb - You may or may not be aware the town was considering changing worker ' s compensation insurance from the State Insurance Fund to the Workers ' Compensation Alliances . This is a self insured group through the New York State Association of Towns . We recently sent a notice to the NYS Insurance Fund announcing our TBM 6 / 12 / 95 intent to leave the fund at the end of June . Mr , Bruce Simmons , New York State Insurance Fund - I am a field service representative with the State Insurance Fund and deal in customer relations and safety . I also represent the State Fund as opposed to Lovell Safety Management Group , who is your group manager for safety issues . You are currently enrolled in the State Insurance Fund , Safety Group # 496 , which is managed by Lovell Safety Management Group . The point I wish to make regarding the State Insurance Fund is it is fully insured . As your Supervisor stated , it is not a self insured group . When you pay your premium to the State Insurance Fund you are 100a covered ; no limit on Worker ' s Compensation and Part B employer ' s liability . Commonly the State self insured alliances do not cover part B , employers ' liability . Part B is third party law suits . This is when a person injures themselves while operating a piece of equipment and their case is handled through Workers ' Compensation . They also then sue the manufacturer of the piece of equipment for some reason . The manufacturer then enjoins the Town and claims the Town did not train the person properly or for whatever reason . How important is this ? Last year it was 10a of the State Insurance Funds ' reserves allocated toward third party lawsuits . The self insured alliance you not only have to compare the price for workman ' s compensation but also the cost of coverage in this particular segment that is now covered under Part 1 - B of your employer ' s liability insurance . The State Insurance Fund is a non - profit organization run by the State with State employees . The safety groups are more concentrated . You could be in a group with 50 towns and about $ 5 million worth of premium . The premiums are collected , the stop loss is purchased from the State Fund , the claims are paid and what is left over is distributed back to the members as dividends . The stop loss purchased from the State Fund is 22 % then the fund gives a 1 . 9 % credit on administration . This means State Fund does not charge the Town anything for administration but in fact gives a credit of 1 . 90 . If the self insured alliance group suffers any losses beyond the premium , the members are then assessed . The safety group first accesses the group then the fund . The membership is not approached and it ' s sole recourse is the premium paid for the insurance policy . Worker ' s Compensation claims continue until the death of the individual as well as permanent partial disability claims . A death claim will pay the beneficiary of a spouse until death or upon re - marriage . The safety group offers stability of premium payments and each year the premium is paid with no additional unforeseen costs for that 8 TBM 6 / 12 / 95 year . With the self insured alliances , if the claims increase they may return to the members and request additional monies even if you are no longer a member . You are jointly and severally liable so even if in 20 years from now they come back and say we need more money , regardless if you are still a member or not , if the particular claim was when you were a member , you are still obligated . Supervisor Whitcomb - That is one of the most important points made . Even if you leave the self insured group you are still liable for the claims processed when you were a member . This could go on for some time . Councilwoman Harrison - What if you get expelled from the group ? Is the group still responsible for any claims , given the termination clause in the document ? Mr . Simmons - You would still be liable . Worker ' s Compensation claims is State Funds ' business and this is what we do . We employ claims administrators , investigators , hearing representatives , rehabilitation nurses , fraud investigators and a large legal department . We started the Worker ' s Compensation business in the United States in the early 1900 ' s . If anyone knows about handling claims , State Fund does . Our safety management also reviews claims for the purposes of the group . A group goes on a seven year payout history ; accumulates the claims of your safety group . They have your reserves set up and they do accounting annually to determine the liability and at the end of the seven years terminates the liability of the safety group . Lovell reviews your claims with State Fund to insure claims are handled in the best interest of the group so they can pay the highest dividend . Relative to Worker ' s Compensation claims , the same worker ' s compensation judge decides your liability to the claimant , regardless of the carrier . State Fund has a field service representative for safety services . They provide safety surveys , demonstrations , posters , and provide video tapes regarding safety issues . The services are available and we encourage our groups to use them . Lovell also provides safety services , conduct inspections , provides materials , holds seminars etc . . . �I When you are in the safety group , you receive a 20 % advance discount , the group has a five year average of 31 % dividend , and you pay a 10 1s service charge to Lovell for being in the group which means a net :reduction of 37 . 5 % off the standard premium . As of past friday , a 35 $ dividend was declared for the Town ' s last policy . �- 9 TBM 6 / 12 / 95 Discussion followed . Councilwoman Harrison - What caused the Town to do this reevaluation ? Councilwoman Valentino - When I was at the Association of Towns meeting in New York and reviewing information provided by the Association , I thought what harm could there be in obtaining a quote and to investigate further just to see where the Town stands . Supervisor Whitcomb - Pat Punger had recommended the Town go with the Worker ' s Compensation Alliance purely on basis of the premium , although she did not feel strongly one way or the other . Councilwoman :Harrison - We are trying to buy insurance which needs to give us assurance regarding coverage . Based on the little I have seen , I do not feel assured about what the alliance seems to offer . The premium difference is very minor . Supervisor Whitcomb - I agree . I have been persuaded by Mr . Simmons we should stay where we are . Councilwoman Valentino - I would concur at this point although I find it interesting as I have worked on State Insurance Funds with another employer and have seen the rates steadily increasing . Now all of a sudden we seem to be in a better position since the creation of the alliance . The Supervisor requested Agenda Item No . 10 be addressed at this time so he may open the public hearing . Agenda Item No . 10 - Public Hearing To Consider a " LOCAL LAW PROVIDING FOR THE NUMBERING OF HOUSES IN THE TOWN OF ITHACA " : The Supervisor opened the public hearing at 6 : 30 p . m . , the Town Clerk had proof of posting and publication . The Supervisor postponed the public hearing until agenda item # 24 and # 25 has been completed . Agenda Item No . 24 and No . 25 - Resumed Mr . Simmons - The competition is good . One of the things that goes along that is the rates go up . Suddenly everyone becomes more safety conscious . Now we are being asked how can we lower our claims ? Councilman Ni. klas - It should be clear we should continue to periodically :reevaluate out insurance coverage and carrier . 10 TBM 6 / 12 / 95 Councilman Klein - The Worker ' s Compensation rates are established by the State and are the same regardless of carrier . The difference is the dividends which are received back . Basically if the group performs well you might get something back which ultimately lowers costs . Supervisor Whitcomb - As no action is required we must now forward a letter to the State Insurance Fund indicating our wish to continue our coverage with them . We would like to check on the Southern Cayuga Lake Intermunicipal Water Commissions status on this as well . Agenda Item No . 10 - Public Hearing To Consider a " LOCAL LAW PROVIDING FOR. THE NUMBERING OF HOUSES IN THE TOWN OF ITHACA " • The Supervisor reopened the public hearing at 7 : 44 p . m . Dooley Kiefer - I am all in favor of the proposal but would like to make a comment on the SEQR form . Almost everything is not applicable however I think the part stating what areas this applies to and N/A is entered is not correct . The Supervisor closed the public hearing at 7 : 45 p . m . Agenda Item No , 11 - SEOR , " LOCAL LAW PROVIDING FOR THE NUMBERING OF HOUSES IN THE TOWN OF ITHACA " : Supervisor Whitcomb - Perhaps Ms . Kiefer could point out on the SEQR form where her concern is regarding the SEQR . Ms . Kiefer - Under # 6 , " Amount of land affected " is answered N/A . Jon Kanter - I prepared the SEQR . Supervisor Whitcomb - Ms . Kiefer suggested you either put in entire Town or acreage of the entire Town . Mr , Kanter - So done . Attorney Barney - There were changes in the reorganization of the first four lines . There was some apparent confusion in filling out the old form where it asked for place of employment . People were not sure if we were asking for their employment with the Town or their actual place of employment assuming they were not employees of the Town . We changed the form to pick up last name and where it asked for address , some people indicated office address and some indicated residence address . The last line is affiliation with the Town of Ithaca . In the outside interests , the example in brackets , was added . This was a result of a number of people not understanding that if they were employed by not for profit organizations , such as Cornell or Ithaca College , they should disclose that on the form . Councilman Niklas - When I filled out the form , I indicated my employer as Cornell University it seemed implicit and explicit that I am affiliated with that institution . Councilwoman Harrison - It is good you put the example in parenthesis as I still would not have understood . I do not consider my employment an " outside interest " . Carried unanimously . Agenda Item No_ . 18 - Consider Tompkins County Solid Waste Fee Being Added to the 'Tax Bill : Mrs . Noteboom - A letter was sent to me from Michael Lane explaining what the County was trying to do with the new program and a meeting which is to be held in June . When I went to the County Budget & Finance Office last week to turn over the taxes , I had a discussion with David Squiers and Lisa Stephens regarding this meeting . It was explained the County would not consider purchasing the software if they were not considering having the solid waste fee included on the taxes . We discussed again the legal issue and I reiterated to them it was my understanding this board had not yet felt comfortable as to whether or not it is legal for the fee to be added to the tax roll for collection by the Town Clerks . They, requested that at this meeting we not address the legal issue . They stated it is a policy issue which must be decided by the County Board of Representatives and individual Town Boards . They asked us to look at the program for its merits on efficiency in being able to calculate the fee . We spoke briefly regarding time frame as far as the availability of the program . Lisa Stephens is leaving the County in August . She has been our liaison and extremely helpful . I impressed upon them the importance that if this is resolved , it would be necessary for us to receive= the program and have the training as close as possible to the completion of the budget . They also mentioned it was their understanding the County Board of Representatives feels the legal issue has been resolved with the Town Board and Supervisors . Councilwoman Harrison - Does the Town Supervisor feel it has been resolved ? Supervisor Whitcomb - Our attorney says one thing , the County attorney says another . I do not think it has been resolved with any County Board or Supervisor in this Town . The County is moving 16 TBM 6 / 12 / 95 ahead on their assumption it is legal . If we want to challenge this at some point we could . Councilwoman Harrison - Would it be worthwhile to have the two attorneys discuss the issue or has this already taken place . Attorney Barney - Yes it has . I indicated to him my doubts about the legality of adding a fee to the tax bill , citing him chapter and verse based upon Real Property Tax Law . He stated , several months ago , it probably would need special legislation unless all of the towns agreed . We can agree to waive the law . I was looking at it from the standpoint if the Town does not want to do it , is the Town in the right or in the wrong ? I was satisfied we were in the right as :Legally they can not impose this upon the Town in the absence of some legislation from the State Legislature authorizing it . That was the last conversation I had with him . It was my understanding from the County Attorney he would look in to the matter further . Councilman Niklas - You said if the Town of Ithaca does not choose to participate in this it is within our legal rights to do that . Supervisor Whitcomb - We do not want to incur any legal liability for this . We could legally agree to proceed with it . Councilman Niklas - Suppose all of the municipalities involved say yes , we will participate . Suppose a group of citizens decide to sue the County and the municipality they reside in , claiming that putting the solid waste fee on the tax bill was illegal . Are we then , as a municipality liable to the legal fees of that lawsuit ? How realistic is it that someone would take that action ? Attorney Barney - We would not be liable for their attorneys fees . If I came in the door and said you have put a fee on my tax bill and you have now made my tax bill illegal , I am not going to pay anything . Where are we at ? Since we return all of our taxes to the County and the County pays us , I ' m not sure the Town is going to be out very much if I choose to take that position as a Town resident . The County will be responsible to collect that bill unless every tax payer decides to take that position . I do not think there is a tremendous financial disclosure to the Town but getting back to what I said before , are we compelled , could we say no and are we justified by saying no and the answer is I believe we are . Councilwoman Harrison - There were a significant number of other issues that would not be addressed by the computer program . Ms . Noteboom -- That is why the County wants us to look objectively at the program . They feel with the program they are proposing , it will address many of those issues . 17 TBM 6 / 12 / 95 Councilwoman Harrison - I was recollecting there were potentially a lot of other issues to do with partial payments and how to handle those , which clearly a computer program does not address . Is there anything in terms of discussions with the County , regarding how to manage that ? I know you were worried in terms of staffing issues . Mrs . Noteboom - As far as I can tell this is the first step . I would like to go there with an open mind to see what the computer program does to see how many of those concerns it addresses . I felt quite comfortable when speaking with David Squiers last week that he was very interested in discussing , negotiating and cooperating to try to answer as many of the issues as possible . I am willing to go with an open mind . Councilman Niklas - We should reopen the discussion after the Town Clerk has a chance to see the demonstration of the program . There are a couple of issues which need to be addressed even then . Mrs . Noteboom - The attorney has given his opinion and I defer to that . I myself , will not feel comfortable , under my oath of office , collecting the fee unless I am fairly well assured it is legal for me to do so . I defer to him and I think he is correct . I only hope this board will back the stance I take if it becomes necessary . Councilwoman Harrison - What is the significance of that ? The County is moving forward , their lawyer says he thinks it ' s legal , our Town Attorney , on his reading , says probably not . Mrs . Noteboom - What I am saying is given my oath of office , I am not totally convinced it is legal for me to collect the fee on the property tax bill which I believe the Town Attorney is saying without State legislation . It is not possible at this moment even if all the municipalities agreed to do so I may have to take the stance that I will not collect it as it is against my oath of office , individually , as a person . I do not think this Town Board would ever ask me to do anything out of line with my oath Of office . Councilwoman Harrison - Is the State Legislature going to be out of session at that time ? There would be no opportunity for special legislation . Councilman Niklas - Does the Town Attorney feel any further research is needed in this matter ? Attorney Barney - I am puzzled , quite frankly , letter from Michael Lane where he says they have done researgchtand it is legal . There is no question the fee is legal . It is the ' mechanics of collecting it and whether it can be collected by a 18 =milli Iowa TBM 6 / 12 / 95 simple addition to the tax bill . That is what I am troubled with . Real Property Tax Law basically says thou shall not put on the tax bill anything other than real estate tax . This is clearly not a real estate tax . Councilman Niklas - Ms . Kiefer , has the County Board of Representatives heard any debate or discussion regarding the legality of the pending solid waste fee being added to the tax bills ? You are hearing a one sided debate tonight and have they been made aware ? Ms . Kiefer - The issue came before the County Board in the Solid Waste Committee ' s report and in the County Attorney ' s report . There really has not been a discussion as no one questioned it . The relevant committee is in receipt of substantial correspondence from the Town of Ithaca on the subject which includes the Town Attorney ' s opinion regarding the illegality . Before my tenure on the county Board , this was an area I was interested in as I was in on the solid waste design . I am convinced , in principle , there is not a problem . I understand Mr . Barney giving you the most cautious advice and think an equally strong argument can be made on the other side . I feel we are on firm ground . Councilman Niklas - So you are satisfied no further discussion is desirable . Ms . Kiefer - No . I think discussion is always desirable . I think it is at the :Level of the Town Board and the County Board for that discussion to take place . Councilwoman Harrison - Has something been committed to writing by the County Attorney ? Attorney Barney - I have heard the County Attorney feels that way however I do not recall anything in writing . When I talked to Mr . Wood I do not believe he had anything in writing at that time either . Councilman Niklas - In everyone ' s best interest , the County Board of Representatives should sponsor a debate between the lawyers . At least the members of the County Board could be educated as to both sides of the opinion . Mrs . Noteboom - I have sent everything I received from the Association of Towns , Opinions of the State Comptroller and the State Attorney ' s Office . 19 TBM 6 / 12 / 95 Supervisor Whitcomb - Unfortunately it will not be resolved by the opinions of Mr . Wood or Mr . Barney . The opinion will ultimately come from the State or a judge . Councilman Klein - Is it something one would request from the Attorney General ' s office ? Attorney Barney - We would request one from the State Comptroller or the Attorney General , either one . I think what might be appropriate is for me to get in touch with Mr . Wood and find out what he has learned . The law flows a little with what you want to have happen . If the Town is willing to go along with it , I am not sure it is a problem . I think if we have a situation where Joan feels it is inappropriate , and unless she is satisfied it is perfectly legal , then we have a problem . Councilman Niklas - My suggestion earlier was we table this issue until more information is provided to us . Councilman Klein - Is it inappropriate to ask Mr . Barney to seek an opinion from the State Comptroller ' s Office or the Attorney General ' s Office ? If he says it is legal for us to collect it , in his opinion , then Joan would feel more at ease . Mrs . Noteboom - We have two opinions I requested in February which Mr . Barney has copies of . One is from the Attorney for the Association of Towns and the other is an opinion from the State Comptroller ' s Office . Councilman Klein - That was not a recent opinion and not very specific . Supervisor Whitcomb - Let ' s authorize Attorney Barney to request a more current opinion from the State Comptroller ' s Office , Mrs . Noteboom - I do want to say David Squiers and Lisa Stephens have been most helpful and cooperative . Agenda Item No . 21 - Consider Coddincrton Road Community Center Funding Recruest : Supervisor Whitcomb - In the past we have funded the summer program for a four week period at an approximate cost of $ 2 ' 500 . 00 . This year they are requesting a six week program due to cutbacks in City programs . The enrollment is held open for the Town of Ithaca until May 31 , 1995 and then opens to the general public . Councilwoman Harrison - So basically we end up subsidizing children from other gowns . Supervisor Whitcomb - To some extent . I have advised Attorney Barney to revise the agreement with the Community Center to not only include the quarterly payments but also for the summer program . Councilwoman Valentino - The way the county wide program works is we have children going back and forth . We have quite a few children from the Town of Ithaca who participate in programs in Caroline and Danby . There are alot of Town of Ithaca children who _ attend those schools who go to the programs there . We feel that on 21 TBM 6 / 12 / 95 a county wide basis it tends to balance itself out . Essentially , Dryden and Caroline are paying for Ithaca children there . Agenda Item No 23 - Consider Three Part Custody Agreement with the Southern Cayuga Lake Intermunicipal Water Commission : Supervisor Whitcomb - This concerns a three party custody agreement between the SCLIWC , Tompkins County Trust Co . , and First Chicago Bank and Trust . This is a standard custodial agreement . It was requested at the Bolton Point Commission meeting by one of the Commissioners that it be reviewed by the Attorney for the Town or the Attorney for Bolton Point , for its applicability to the Town of Ithaca . Attorney Barney - By law , the bank must pledge collateral to cover the value of the entities ' deposits . I have looked at the agreement and barring the few typographical errors , substantively , it appears to be in order . They are working out of their homes as there is no space in town hall . Councilwoman Harrison - What is the arrangement ? Attorney Barney - They will be paid a stipend in addition to their salaries . Similarly , paying $ 50 . 00 per month for a phone makes no sense to me whatsoever . Mrs . Noteboom - When Mrs . Bernal turned this in she told me she would be more than willing to have any board member tour her home so they could see how much was actually being used . Supervisor Whitcomb - The phone calls should be reimbursed on the actual usage .. Councilwoman Harrison - Most of those calls are local in which case there is no charge for that . I assume she is going to make the argument there is no phone downstairs but even that is not $ 50 . 00 per month . Councilman Niklas - When we were interviewing the Town Justices they were saying they need to make frequent calls to Albany to find out previous conviction records as well as other reasons . Supervisor Whitcomb - What you are approving is , in principal , compensation on a quarterly basis through the Town payroll system in an amount to be calculated based on the IRS business deduction and reimbursement for long distance phone calls . Agenda Item No 30 - Consider Creation of Civil Service Positions : Councilwoman Valentino - I would like to address the items I requested be deferred earlier , Agenda Items 16 ( i ) , 16 ( j ) , 16 ( k ) . Starting with 16 ( i ) , the appointment for the Engineering Technician is no problem on the appointment . The one problem I do have is the very last sentence where is says " a six month probationary 25 TBM 6 / 12 / 95 period applies after which a performance review will be done " Now that we have come in to compliance with Civil Service the probationary period begins after the certification . Essentially while they are provisional employees , it is the same as being probationary . The probationary period can not start until after certification and has to be for a period of not less than eight weeks nor more than twenty - six weeks . That puts us in conflict with that sentence being in the appointment . Councilwoman Harrison - Do you have a suggestion how it should read ? Attorney Barney - A twenty - six week probationary period applies commencing upon certification by Civil Service . Supervisor Whitcomb - The same holds true for all three of the resolutions ? Councilwoman Valentino - No . Mr . Walker - That person has to be provisional until a Civil Service exam is taken . If a civil service exam is not given within six months and this person has been performing adequately for that six month period can we shorten the review period after the exam? Councilwoman. Valentino - We can shorten it but it cannot be less than eight weeks . Attorney Barney - You would want to bring it back to the board at that point and say it has been the twenty - six weeks then present to the board with the request to shorten the probationary to eight weeks . Councilwoman Harrison - In terms of the probationary period , we have made it: so anything good that happens to an employee applies to them . Councilwoman Valentino - They can get all their raises and evaluations during that period of being provisional just the same as if they were permanent . The only thing is they are basically " at will " employees until the exam . Mr . Walker - And it is dependent on the County and State as to when the exams are scheduled . Councilwoman Valentino - This was an error . We will not need agenda item 16 ( k ) either as it will be covered in Agenda item No . 30 . Item 16 ( j ) and 16 ( k ) are covered in other resolutions . Councilman Niklas - I have a question regarding agenda item # 30 and # 31 combined . In agenda item # 30 you have Town Planner and Town Engineer however in agenda item # 31 you have department heads or director of certain departments . I believe they are supposed to be the same people . If you read the resolutions they are not necessarily the same positions . Attorney Barney - All of the positions , Town Engineer , Town Planner and so forth are basically provisions in the competitive class under Civil Service . There are people in those positions now and of course we have many positions which are supposed to be competitive class and that is indeed what we are doing in the first resolution . We are taking all of these positions which people are presently occupying and placing them in the appropriate location . That is dictated by the Tompkins County Civil Service . The positions of` Director of Planning , Director of Engineering , and Director of Building and so forth will be " Unclassified " positions . This means -they are employees " at will " rather than having the Civil Service protection . That type of situation is available to persons who are department heads having the authority to run a full department . We create the position first to get us into compliance with the Civil Service rules by the titles that are generally accepted at the County level . We will now have to petition the State of New York or have Tompkins County Civil Service , on our behalf , petition the State of New York Civil Service Commission to make certain. these three directors positions are indeed going to be accepted as unclassified . In the mean time the Town , if it is the Board s will , appoint people to those positions provisionally where they will serve until such time as the State rules on the petition , 27 TBM 6 / 12 / 95 which may be a year or two down the road . Councilman Niklas - But there is no petition in here going to the State for those . Councilwoman Valentino - The County will petition the State on our behalf as we are working through the County Civil Service , Attorney Barney - We have in each resolution a provisional statement that we as a Board are authorizing the Town Supervisor , etc . , , to take whatever steps necessary to obtain appropriate Civil Service certification for the positions . Councilman N:iklas - I noticed that some of these positions have the phraseology " at the pleasure of the Town Board " but I notice the Town Engineer ' s position is not . Attorney Barney - That is because under Town Law the Town Engineer is appointed for a two year term effective January 1st following each biennial Town election as is the Town Clerk and Town Highway Superintendent . Those three positions , even though the Town Engineer , being moved to Director of Engineering , still carries with it all of the duties and responsibilities of Town Engineer plus . Therefore I did not feel we wanted to say it would be at the pleasure as it would conflict with Town Law . Councilwoman Harrison - Which are the ones that are two year appointments ? Attorney Barney - Town Clerk , Town Highway Superintendent , and Town Engineer . Councilwoman Harrison - Do each of these say that ? I don ' t think so . Attorney Barney - In agenda item # 31 it basically says that . By Town Law , two years . We put the Town Clerk and the Highway Superintendent in as they were already appointed by this board in January 1995 . Councilwomar.LHarrison - Aren ' t these descriptions something that is going to stand if it is required under law . If it is not just an action that we had taken previously and it is embodied in " Town Law " . . . . Attorney Barney - What I am saying is I do not think you have the power today to appoint someone to those positions . Those positions were filled by the Town Board in January . Councilwoman Harrison - This job description is something that has 28 TBM 6 / 12 / 95 nothing to do with individuals . This is a job description we are creating and will sit in a file and be important when people consider the job . I am saying that if that two year term appointment when the Town Board gets elected is the law , then I would think that should be in these job descriptions . Mrs . Noteboom - For the Town Clerk and the Highway Superintendent it is on the job description . Councilwoman Harrison - In the Town Clerk ? Mrs . Noteboom - " The Town Clerk shall also have such powers and perform such additional duties in the two year term . " Councilwoman Harrison - Then for the Town Engineer it is not in the job description but it should be . Attorney Barney - The Town Engineer is a little bit strange because in one part of the law it says he serves at the pleasure of the Town Board but in another place of the law , which specifically talks about 'Town Engineers , it says it is a two year term . Councilwoman Harrison - If we became dissatisfied with the performance of any of these people who had been appointed to a two year term does the Town Board have the right to terminate that two year term? Attorney Barney - Only through a special proceeding . During that two year teen it is a two year term and basically it would be misconduct . That is the basis for termination . Councilwoman Harrison - And whose law is this ? Attorney Barney - State of New York Town Law . Councilwoman Harrison - The other question was some of these descriptions mentioned hiring and firing responsibilities and some did not . Do we really mean that or doesn ' t the Town Board end up putting people in these positions ? Councilwoman. Valentino - When we talked about doing a reorganization we talked about having department heads take more responsibility . If we want them to be exempt and be at will that authority is part of what is mandated and part of the authority we have to turn. over to them . Councilwoman. Thanks to Cathy for service above and beyond the call ! Finance The final audit report is presented for your approval tonight. It is one of the cleanest audits ever. Sally Alario deserves our gratitude. With the appointment of a new Town Justice , it is recommended that a routine audit be done of the former Justice ' s books so that a " clean slate" can be established. I have authorized our accounting firm to perform this audit. In addition I recommend that a routine annual internal audit be performed on the Justices' records . Intermunicipal Lake Water cooling plan is progressing . It appears that there may indeed be an opportunity for cooperation with Cornell in terms of infrastructure improvement and improved public lake access through the project. SJS agreement revision is continuing despite differences of opinion regarding definition of service areas , planning areas , reserve capacity and intermunicipal approvals . Stay tuned on this as the three municipalities continue the debate. Bolton Point agreement should be revised or amended as we approach the final bond payment in 1996 . Issues include ownership of reserve capacity , extension of water to non- member municipalities and future capital improvements . As the largest user and financial contributor ( more than 50%) , the Town has a large stake in the outcome. Movement toward a New Town Hall has bogged down again . Consideration of the he appraisals of our high priory sites represents a decision point. We need to focus here folks and move forward again . I have had several interesting discussions , including one with Cornell about an East Hill Site and with a Mayoral hopeful about the City Hall Annex . FINAL Town Engineer ' s Report for 6/ 12 / 95 Town Board Meeting DEVELOPMENT REVIEW The Engineering Staff has been reviewing compliance on the following projects that have received Planning Board approval and are under construction . Saponi Meadows Subdivision , Seven Mile Drive The first phase water and sewer mains have been installed and receipt of test results and as -built drawings is pending . NYSEG has completed installation of underground gas and electric service . The developer is preparing the road base . Sanctuary Woods Subdivision , Sapsucker Woods Road Record drawings and engineering certification by the developers engineer of the water and sewer improvements are pending . NYSEG and NYNEX have completed installation of utilities in the road ROW , and the contractor plans to have the subgrade prepared for inspection the week of June 12 , EARTH FILL _PERMITS An earth fill permit for a site on Five Mile Drive with the potential source of fill being the Rte . 96 Project has been submitted to the Town . The volume of proposed fill involves review by the Planning Board prior to a special approval consideration by the Zoning Board of Appeals . Cornell University has submitted an . earth fill permit application for the restoration of the old landfill adjacent to the Library Annex in the Orchards area . This site is above the recreation way and Cascadilla Creek and may include some work in wetland areas along with related stormwater management improvements . The proposal also includes improvements to a detentior.L area adjacent to the Life Safety Building on Palm Road , and a new detention area to the east of the campus stores building . The volume of proposed fill involves review by the Planning Board prior to a special approval consideration by the Zoning Board of Appeals . I Town Engineers Report 6 / 12 / 95 2 WATER PROJECTS The Troy Road and Coddington Road water extension project is substantially complete . Final restoration is nearing completion . Three Town water storage tanks were inspected during May . The inspections included draining the tank , entering the tank to inspect the internal coating system , operation of all valves and controls , inspection of the cathodic protection system and inspection of the exterior coating . The inspection reports will be the basis for scheduled maintenance on the tanks . The Ridgecrest tank was inspected during the week of May 1 , and was in good condition except for the interior coating which was in very poor condition . The sapsucker Woods tank was inspected the week of May 8 , and was in generally good condition except for the interior coating and the general tank site which is very overgrown and needs to be cleaned up to prevent damage to the tank and fence . The Danby Road tank was inspected the week of May 22 , and was in good condition except for portions of the exterior coating which needs repair , and some site drainage deficiencies . Survey work required for the evaluation of a proposed new water tank on the East Hill will be completed this Spring and early Summer with the assistance of Cornell student interns . The survey information will be utilized in developing a water system model using the Cybernet computer program . A model for the South Hill water system is currently being developed and will be used to assist in system optimization and reviewing the impacts of several development projects along Danby Road . The Town. Engineering staff is working with Bolton Point staff to implement the master metering program for connections to the water transmission main . The SCLIWC agreement includes a provision that all connection points on the transmission main to the member municipalities will be metered for the purposes of monitoring water consumption . The Town has the responsibility to construct the meter site and SCLIWC will provide and maintain the meter . The Town Engineering staff is preparing the plans and contract documents for all of the master metering locations within the Bolton Point system , and will assist the Bolton Point staff in construction administration . Town Engineers Report 6 / 12 / 95 3 s SEWER The West Haven Road and Mecklenberg Road sewer extension is substantially complete . The flow monitoring station has been installed and is operational . The Contractor has been working on final site restoration and work is nearing completion . The Town Engineer is continuing to work with the City DPW on a plan for improving the sewage transmission capacity that is jointly used . One component of an improved sewer system is being incorporated in the NYSDOT project for improvements on the Meadow Street and Fulton Street . The city has installed sewer improvements on the Inlet Island , which will tie into the work to be done during the DOT contract . The Northeast sewer system , which is served by the Village of Cayuga Heights WWTP , is the subject of a significant maintenance inventory program. The workplan includes clearing rights - of - way , cleaning sewers and inspection with a television camera that is being purchased by the SJS . The inspection will result in a workplan for reducing infiltration problem on the Town system to help relieve the wet weather hydraulic load on the Cayuga Heights treatment plant . r PEREGRINE HOLLOW SEWER DISTRICT The town of Dryden request to purchase IAWWTP capacity for the extension of service to the Snyder Hill Sewer District is under consideration by the SJS . Construction of sewer improvements by the developer has not begun . HIGHWAY AND PARKS The Judd Falls Road reconstruction project has been started with the installation of storm drainage . Work on repairing the Plantations Road pipe arch crossing is the next item on the list . NYSEG has done some tree trimming in preparation for relocating the electric line at the intersection of Judd Falls Road and Forest Home Road . Concerns about the extent of tree trimming have resulted in a review of the power line alignment by NYSEG . The Forest Home bridge project is behind schedule . Construction drawings were reviewed by the work group on June 1 , 1995 and a few comments regarding the design were made and will be transmitted to the consultant by the County . It appears that a contract for construction may be let in October , and the County is confirming construction costs and funding obligations for this schedule . Town Engineers Report 6 / 12 / 95 4 FACILITIES The Town Engineer has continued to work with the Town Clerk , the Highway Superintendent and the Parks Manager on a facilities improvement plan , which includes the Town Hall facilities and the Highway and Parks department needs . The Engineering staff has been working with the Parks Department and Building Department to develop a plan for the parks shop and storage facility on Seven Mile Drive . Construction of the renovations to the existing building will be completed by Town staff this Summer . Staff has met with applicant to discuss Final Site Plan submittal requirements . Consideration of Final Site Plan Approval is tentatively scheduled for July 18th meeting, pending submittal of complete application. Ithacare Senior Laving Center, Danby Road The Draft Environmental Impact Statement (DEIS) was submitted to the Planning Board on May 31 , 1995. The June 6th Planning Board agenda includes p:reliminary discussion of the DEIS for completion and adequacy for public review and comment, with full consideration scheduled for a public hearing at the June 20th meeting. CURRENT PLAI'�TNING DEPARTMENT PROTECTS Planning Department staff is working on the following projects : Environmental Atlas : Staff has completed preliminary wetlands mapping. A survey for potential GIS users to help determine Town' s needs for GIS was prepared and will be distributed in the near future. The department hopes to hire a summer intern to continue map work on the Atlas, among other work items. Conservation District: Public meeting with area residents is scheduled for June 19th to discuss proposed Conservation District. Fees in Lieu of Parkland : Based on discussion at the May 8th Town Board meeting, the Codes and Ordinances Committee will look at alternate means of determining fee 2 amounts, and wLil report back to the Town Board . Analysis of MR, Commercial , Industrial and Special Land Use Districts : At the request of the Town Board, the Codes and Ordinances Committee continues an analysis of the above-referenced zoning districts on parcels where no development has occurred. Specific parcels are in the process of being identified with relevant information on ownership, acreage, development potential, surrounding zoning, etc. The purpose of the analysis is to identify whether rezonings of any of those properties would be appropriate. The COC will continue consideration of this matter at their 6 / 7 meeting. Ithaca-Tompkins Coun Transportation Council (ITCTC): Subsequent to the discussion of park-and-ride lots at the 5 / 8 Town Board meeting, the ITCTC Policy Committee adopted a resolution endorsing the concepts of establishing additional park-and-ride facilities and supplemental peak period transit service, as mitigation measures to relieve congestion during the Rt. 96 / Octopus construction project. (A copy of that resolution is attached for the Town Board' s information.) Parks , Recreation and Open Space Plan Update : Staff has completed draft Recommendations chapter. Final chapter on financial considerations and proposed capital improvement plan is underway. Meetings are underway with Conservation Board to discuss draft chapters, supplemented by field visits to observe areas being considered in Plan update . Cornell GEIS / SLl:JD: Final revisions to SLUD and Findings Statement have been made, pending refinement of SLUD parking standards. Revised SLUD is tentatively scheduled to go to Planning Board for recommendation to Town Board at the July 18th Planning Board meeting, after which a Town Board public hearing would be scheduled. Eastern Heights F'ark: Town Board visited Eastern Heights Park on 5 /4 at a special meeting to consider future uses of the park, possible dedication of General Purpose Land as parkland, possible Frandsen cul-de-sac (Brian Drive), possible presence of wetlands, proximity of Peregrine Hollow subdivision and subsequent use of park by Town of Dryden :residents, and other park-related issues . There was no evidence of significant wetlands in the cul-de-sac area. Town Board members present agreed to consider reserving; an area on the General Purpose land for a hammerhead turnaround with a right-of-way for a future road extension to the south, and to dedicate the remainder of the General Purpose land as parkland. A public hearing on this is being considered for the 7/ 10 Town Board meeting. Defining Buildable Land : Planning Committee is discussing the question of how to define "buildable land " in proposed subdivisions in order to determine number of permitted lots / dwelling units and to provide better guidelines for lot/ building layout on a site. It was necessary to purchase a new 486 computer with additional me=mory in order that the Word Perfect 6 . 0 for Windows could be utilized as planned . Suzanne Etherington , Certified Archivist will again with us towards the end of June . It is hoped the conversion of the records from the Word Perfect 5 . 1 to the Word Perfect 6 . 0 will be accomplished at that time . All grant funding requirements under SARA will be met by requisitioning and encumbering the funds for the temporary help , and the last few days of service by the Certified Archivist . Unfortunately , the indexing itself will not be completed by the deadline , but will be done throughout the remainder of the year . The New York State Local Governments Records Association invited me to speak at their annual conference in Rochester on June 5 , to explain our progress and problems with the indexing grant . It was a wonderful opportunity and learning experience for me , and I was very happy to have been honored by my colleagues in this manner . The Town looked into this 2 or 3 years ago , and I was, asked to inquire again . Attached is the explanation from Postmaster Gatch . He is very interested in being responsive to consumer questions , so please let me know if there is anything I should bring up with the committee . Of course it isn ' t always possible to do anything about the problem , but at least he explains . Ca of n 6 / 2 / 95 UNUEDSTATES POSTALSOWKE May 18 , 1995 Carolyn : Attached , is a map with the carriers route and line of travel highlighted . The arrows show the direction of travel delivering mail . Delivery starts; in the city and proceeds up Danby Road to W King . He then proceeds to Stone Quarry Road and delivers all the way down to Spencer Rd . As you can see from the map he does not return via the Danby Road . In order to deliver the mail coming back on Danby Road , we would first have to reverse the delivery pattern by starting on Stone Quart' Road . All residents on Stone Quarry would have to move their boxes across the road . Delivery of mail going up Stone Quarry in the winter would be nearly impossible . Another drawback to this delivery pattern is that the businesses now would be on the end of the route and would be delivered late in the day . Whenever possible we try to deliver a business first.
