TOWN BOARD MEETING
The Regular Meeting of the Town Board of the Town of Cortlandville was held at the
Municipal Garage, 3587 Terrace Road, Cortland, New York with Supervisor Williams presiding.
Members present: Supervisor, Thomas A. Williams
Councilman, Jay E. Cobb
Councilman, Jeffrey D. Guido
Councilman, Theodore V. Testa
Councilman, Douglas E. Withey

Others present were: Town Attorney, John DelVecchio; Highway Sup’t. Larry Drach;
Deputy Town Clerk, Abigail Albro; Town Residents: Robert Martin; Stephen Flatt; and Susan
Fitts.
Supervisor Williams called the meeting to order.
Councilman Withey made a motion, seconded by Councilman Cobb, to receive and file the
Cortlandville Zoning Board of Appeals Minutes of March 29, 2021 and the Cortlandville Planning
Board Minutes of March 30, 2021. All voting aye, the motion was carried.
Councilman Withey made a motion, seconded by Councilman Cobb, to approve the Draft
Town Board Minutes of April 21, 2021. All voting aye, the motion was carried.
RESOLUTION #129 AUTHORIZE SUPERVISOR TO SIGN PURCHASE ORDER
#0176 TO DELL TECHNOLOGIES TO PURCHASE
COMPUTER EQUIPMENT (POWEREDGE T140 SERVER) FOR
THE WATER/SEWER DEPARTMENT

BE IT RESOLVED, the Town Board does hereby authorize and direct the Supervisor to sign

Superintendent to be paid to DELL Technologies to purchase one PowerEdge T140 Server needed
to run the water/sewer SCADA system, for the total cost of $1,942.08.

Supervisor Williams offered privilege of the floor to those in attendance. No requests were
made.
Supervisor Williams requested the Board convene to an Executive Session to discuss
personnel.
Councilman Withey made a motion, seconded by Councilman Testa, to recess the Regular
Meeting to an Executive Session to discuss personnel. All voting aye, the motion was carried.
The meeting was recessed at 5:06 p.m.
Councilman Withey made a motion, seconded by Councilman Guido, to adjourn the
Executive Session and reconvene the Regular Meeting. All voting aye the motion was carried.
The Executive Session was adjourned at 5:13 p.m.
Supervisor Williams called the Regular Meeting back to order.
Councilman Withey made a motion, seconded by Councilman Testa, to receive and file the
following monthly reports:
1) Code Enforcement Officer, Kevin McMahon – April 2021;
2) Town Clerk – April 2021;
3) Tax Collector – April 2021.
All voting aye, the motion was carried.
Councilman Guido made a motion, seconded by Councilman Cobb, to receive and file
correspondence from Charter Communications, dated April 30, 2021 and May 2, 2021, regarding
programming services. All voting aye, the motion was carried.
Under new business, Town Clerk Rocco-Petrella informed those in attendance that the
Board meeting was being videotaped and would be available online via the Town’s website at a
future date either through Laserfiche or a YouTube channel that would have to be created for the
Town of Cortlandville. At this time the meetings would not be live streamed, however with
additional software, training and support live-streaming could be accomplished if the Board chose
to do so. Town Clerk Rocco-Petrella explained that details were still being finalized.
Councilman Withey asked if the public would still be able to attend the meetings virtually
via Zoom. He was concerned with public access and requested the Town work towards live
streaming meetings. Town Clerk Rocco-Petrella explained that Zoom would not be utilized when
meetings are held in person. Supervisor Williams added that virtual meetings must be transcribed
which added another layer of work for the Clerk’s office.
Regarding tax collection, Town Clerk/Collector Rocco-Petrella announced that 92% of the
total tax warrant had been collected to date. The last day to pay 2021 Town/County tax bills, prior
to being turned over to the County Treasurer for collection, was May 31, 2021.
Lastly, Town Clerk Rocco-Petrella announced that it was National Professional Municipal
Clerks Week and expressed her thanks and appreciation to her staff for their hard work and
dedication to public service. Supervisor Williams voiced his appreciation for the Town Clerk’s
office and suggested the Board honor the clerks by resolution.

CLERKS IN HONOR OF PROFESSIONAL MUNICIPAL
CLERKS WEEK

WHEREAS, the Annual Professional Municipal Clerks Week (May 2, 2021-May 8, 2021) was
initiated in 1969 by the International Institute of Municipal Clerks and endorsed by all its members
throughout the United States, Canada and 15 other countries, to celebrate and reflect on t he
importance of the Clerk’s office and the vital services provided by municipal clerks for local
government and the community, therefore

BE IT RESOLVED, in honor of Professional Municipal Clerks Week, the Town Board does
hereby acknowledge Town Clerk, Kristin Rocco-Petrella and Deputy Town Clerks, Abigail Albro,
Chavonne LaPlant and Amanda Rainbow for their work and service to the Town of Cortlandville
and the community.
Attorney DelVecchio reported:
Appreciation and Recognition for Town Employees/Officials:
Attorney DelVecchio stated it was great to see everyone again in person. He publicly
thanked all the employees of the Town for their work during the pandemic as follows:
“Just to continue the conversation for all the employees in the Town during the pandemic,
it’s been a strange and long road and I just want to say how well of a job everyone has done
meandering around these issues and things that we’ve had to deal with I think some people
deserve some public acknowledgement and I kind of made a list here. All the people in
Kristin’s office we’ve already named them. Bruce Weber has done a great job. There has
been a great deal of … rounding up the Planning Board meetings and ZBA meetings with
some people feeling uncomfortable about meeting in person and teaching people how to
use Zoom. And it’s just a very, very hard task. Everybody put in a lot of extra time to deal
with the issues. Bruce did a good job. Our Code Enforcement Office has done a fantastic
job. With the pandemic it’s been very hard to do inspections and encounter the public. I
remember calls from the public asking our code office to assist in enforcing mask wearing
and just very difficult things, but we’ve sort of meandered through those things. Megan
Johnson deserves a lot of credit. She worked a lot from home. Marcia Hicks as well. Our
Chairman’s of our … boards have put in a great deal of time. John Finn from the ZBA and
Chris Newell from the Planning Board. And also, I truly believe that Nick Alteri deserves
a lot of credit. He has been a major player around the Town in terms of managerial type
things, making sure that the public comes, and they are safe. And also, you’ll see his father,
Peter around with a spray gun sanitizing things. It has been a phenomenal thing to see
government at work during the pandemic. It really has. Last, but not least, I consider the
two captains of the ship around here to be Kristin , she has always put in the extra level of
time and she deserves more credit than you can imagine. And lastly, Tom Williams has
done a fantastic job. He really has put in the time and the care to make sure that things
around here have gone well and are on the straight and narrow path. It’s been interesting
to see because I run a law firm, I work in the private sector… sorry, I forgot Larry Drach…
he has done a fantastic job getting his crew together and dealing with those things. Sorry,
Larry … I run a law firm I’ve seen how the pandemic affects businesses. My law partner
got COVID, my secretary got COVID. I had to meander through some things myself. It’s
been interesting to see how government has had to deal with those things. It’s been nice
to see that Cortlandville strived through. We didn’t have to lay off people like a lot of other
businesses and a lot of other municipalities. It was a group effort. Hopefully, we are almost
through it … more than halfway in my opinion. I appreciate everyone’s cooperation. …
Also, Patty O’Mara needs to be recognized. She did a ton of work as well - work from
home. All sorts of stuff. The Court staff, the judges, as well have had to adapt to changes.
… sorry to do this but people deserve some recognition here. The water people … all the
people that work in this building…”
Supervisor Williams extended his gratitude and appreciation for Attorney DelVecchio
noting the amount of time he invests in the Town. He stated that it is amazing what Attorney
DelVecchio does and he should not go unnoticed. Councilman Testa added that Attorney
DelVecchio has done a great job for the Town and the community.
Lease Agreement with John Diescher:
There was discussion regarding the renewal of the lease agreement between the Town and
John Diescher d/b/a Diescher Farms for the lease of Town property for farming purposes. Attorney
DelVecchio explained that with the exception of the acreage and the total rent due, the lease
agreement was the same agreement as in 2020. The lease for 2021 would be for 40+/- acres for
the total amount of $2,800.00, while the lease in 2020 was 50+/- acres for $3,500.00.

BE IT RESOLVED, that the Town Board of the Town of Cortlandville does hereby authorize the
1-year lease of approximately ±40 acres of Town property located at 3111 Byrne Hollow Crossing
in the Town of Cortlandville, a portion of tax map #105.00-04-02.200, to John Diescher d/b/a
Diescher Farms for farming purposes, for the total rent of $2,800.00, and it is further
RESOLVED, the agreement shall commence June 1, 2021 and end May 30, 2022, and it is further
RESOLVED, this resolution is adopted Subject to Permissive Referendum as required by law.
Town Board reports:
Councilman Withey updated the Board regarding the possibility of running Wi-Fi to
Gutchess Lumber Sports Complex. He was in contact with a representative from Verizon and
hoped a meeting would be scheduled in the upcoming weeks involving the Town, Verizon, Beard
Electric and Plan First Technology.
In the absence of Cortland County Waterfest, typically held the first weekend in June each
year, Councilman Withey explained that the Cortland County Soil & Water Conservation District
would be posting a series of videos on its website to educate the public on the water system in
Cortland County. He urged the public to watch the videos.
Councilman Withey asked whether someone was responding to the email request received
from Peter Morse-Ackley. Supervisor Williams explained that the email correspondence was on
the agenda as item I-10.
Supervisor Williams reported:
Recreation Commission:
Supervisor Williams explained that in 2020 the Town Board created a Recreation
Commission for the Town of Cortlandville. Due to COVID, there was a delay in establishing the
rules of the Commission and appointing the slate of members. The five-member Committee would
commence with five terms (1-year, 2-year, 3-year, 4-year, 5-year) and would thereafter be a 5-year
term.
Supervisor Williams named the members of the Commission to be appointed by the Board
and provided their background information and qualifications. The first member to be appointed
for a 1-year term would be former Town Attorney, John Folmer. Mr. Folmer helped draft the
guidelines for the Commission and with his legal background and organizational skills he would
serve as the Chair of the Commission. Town resident, Matthew Coats will serve a 2-year term on
the Commission. Mr. Coats is the Associate Director of Athletics for Intercollegiate Operations
for Cornell University. The third member of the Commission to serve a 3-year term would be
Katy Wagner. Ms. Wagner is a Physical Education teacher in Cincinnatus School District with
20+ years of experience. Town resident, Abe Johnson would serve a 4-year term on the
Commission. Mr. Johnson is an educator in the Cortland School District and is involved in youth
sports. The final member to be appointed for a 5-year term would be Machel Phelps. Ms. Phelps
works for the Cortland Regional Sports Council and helps set up sporting events in the community.
She is very familiar with Testa Park and the Gutchess Lumber Sports Complex.

PARKS & RECREATION COMMISSION

Machell Phelps – 5-year term
Solar Ad Hoc Committee:
Supervisor Williams asked the Board to appoint the Committee Members for the Town’s
Solar Ad Hoc Committee. The Board recently enacted a Local Law for a “Moratorium of
Installations of Ground-Mounted Large Scale Energy Solar Systems”. The Committee would
review the Town’s Solar Energy Law and provide recommendations to the Board for amending
the Town’s solar ordinance. Supervisor Williams named the members of the Committee as
follows: Town Attorney, John DelVecchio would serve as the Chair of the committee; Nasrin
Parvizi, Planning Board member and member of the original Solar Committee that wrote the
Town’s Solar Law; Carlos Karam, ZBA Member; Robert Martin, Town resident and Director of
Facilities for Cortland Jr./Sr. High School; Michael Barylski, Town resident and retired Permitting
Agent for NYSDEC Region 7.
RESOLUTION #134 APPOINT MEMBERS TO THE TOWN OF CORTLANDVILLE
SOLAR AD HOC COMMITTEE

Town Sign Ordinance – Political Signs:
Supervisor Williams informed the Board that the Code Enforcement Officers were working
with Attorney DelVecchio to draft proposed changes to the Town’s Sign Ordinance. The changes
would address concerns regarding signs [political] as discussed in the past. He expected the
proposed revisions would be presented to the Board in June for consideration.
Gutchess Lumber Sports Complex - Playground:
Supervisor Williams announced that the playground at the Gutchess Lumber Sports
Complex is complete and is “gorgeous”. He complimented Highway Sup’t. Drach and the
Highway Department for their work on the playground including the new concrete work.
Supervisor Williams planned to have a ribbon cutting ceremony and would invite the public and
children in the community to come play. In addition, he mentioned that Highway Sup’t. Drach
was designing regulation horseshoe pits, which were previously located at Citizens Park.

Cortlandville and NYS Homes and Community Renewal, on behalf of Seven Valley Specialty
Cables, LLC (NYS CDBG #287ED967-21). All voting aye, the motion was carried.
Councilman Testa made a motion, seconded by Councilman Guido, to receive and file the
Cortland County Planning Department Review and Recommendations, dated April 16, 2021, and
Cortland County Planning Board Resolution #21-10, dated April 22, 2021, regarding the Aquifer
Protection Permit application submitted by Builder’s Best Home Improvement Center, Inc. to
construct a 5,000 sq. ft. storage warehouse on property located at 3798 Luker Road, tax map
#95.00-09-01.000. All voting aye, the motion was carried.

construct a 5,000 sq. ft. storage warehouse for an existing home improvement center retail
business, for property located at 3798 Luker Road Town of Cortlandville, tax map #95.00-09-
01.000.

email correspondence from Town resident, Peter Morse-Ackley, dated May 4, 2021, concerning
various topics of interest in the Town of Cortlandville. All voting aye, the motion was carried.

No further comments or discussion was heard. Supervisor Williams requested the Board
convene to an Executive Session to discuss a contract and potential litigation.
Councilman Testa made a motion, seconded by Councilman Guido, to recess the Regular
Meeting to an Executive Session to discuss a contract and potential litigation. All voting aye, the
motion was carried.
The meeting was recessed at 5:48 p.m.
Councilman Cobb made a motion, seconded by Councilman Testa, to adjourn the
Executive Session and reconvene the Regular Meeting. All voting aye the motion was carried.
The Executive Session was adjourned at 6:55 p.m.

Complex, in which the following statements would govern Park Outdoor Advertising’s
commitments:
• The following items are prohibited from being advertised on the digital signs: Candidacy
for Public office; advocacy regarding subjects which are highly controversial, obnoxious,
personally derogatory or political; and in particular, abortion, immigration, sexual
orientation, religion, sexual lewdness, racial discrimination.
• Park Outdoor Advertising will allow up to 400 commercials for the Town of for Public
Service per day on each digital face at the Sports Complex.
o Copy for any advertisement must be received at least five (5) business days prior
to being advertised on the digital signs.

Councilman Guido made a motion, seconded by Councilman Cobb, to adjourn the Regular
Meeting. All voting aye, the motion was carried.
