Election Resolution: Clerk Goddard explained the need for this resolution. Resolution No. 113 of 2010—CALLING FOR A SPECIAL TOWN ELECTION TO BE HELD ON NOVEMBER 2, 2010, AND MAKING CERTAIN OTHER DETERMINATIONS IN CONNECTION THEREWITH WHEREAS,the Town Board on August 9, 2010 has held Public Hearing on this proposed local law,which Public Hearing was duly noticed in the Ithaca Journal; and WHEREAS, by Resolution No. 100 of 2010, dated August 9, 2010,the Town Board conditionally adopted Town of Danby Local Law Number 5 of 2010 Changing from an Elected Town Highway Superintendent to an Appointed Town Highway Superintendent; and WHEREAS,This Local Law is subject to mandatory referendum according to the provisions of Municipal Home Rule Law, §23; and WHEREAS,the Town Board on August 9,2010 and by the same Resolution No. 100 of 2010 scheduled a public referendum with respect to adoption of said local law for November 2, 2010. WHEREAS, under the Town Law, such referendum must be scheduled and held not less than 60 days, nor more than 75 days, from the date of passing said Local Law No. 5 of 2010; and WHEREAS, upon due deliberation upon the same, it is hereby RESOLVED as follows: Section 1.A Special Town Election of the Town of Danby will be held on November 2, 2010, between the hours of 6:00 AM and 9:00 PM, or as much longer as may be necessary to enable the voters then present to cast their votes, at which Special Town Election the Local Law contained in the notice hereinafter set forth shall be submitted to the electors of the Town of Danby.The polling places for said Special Town Election for Town of Danby voting districts 1 at the Danby Town Hall, 1830 Danby Road, Ithaca 14850, 2 at the West Danby Fire Hall, 47 Sylvan Lane, Spencer 14883, and 3 at the Danby Town Hall, 1830 Danby Road, Ithaca 14850. Section 2. The Town Clerk is hereby authorized and directed to publish at least once in the Ithaca Journal, a newspaper published in Ithaca, New York, in the County of Tompkins, hereby designated the official newspaper of the Town for such publication, and to post on the signboard of the Town maintained pursuant to subdivision 6 of section 30 of the Town Law, notice that the Town Board will submit the proposition upon the bond resolution for the approval or disapproval of the voters; said publication and posting to be at least ten (10)days before such Special Town Election. Said notice shall be in substantially the following form: TOWN OF DANBY, NEW YORK Page 1 of 3 NOTICE OF SPECIAL TOWN ELECTION TO BE HELD UPON NOVEMBER 2,2010 NOTICE IS HEREBY GIVEN that a Special Town Election will be held on November 2, 2010, and the polls shall remain open from 6:00 AM until 9:00 PM, or for such longer period of time as may be necessary to enable the voters then present to cast their votes at the following polling places: Election District Polling Places 1 Danby Town Hall, 1830 Danby Road, Ithaca 14850 2 West Danby Fire Hall,47 Sylvan Lane, Spencer 14883 3 Danby Town Hall, 1830 Danby Road, Ithaca 14850 At said Special Town Election the following proposition is to be voted upon: PROPOSITION 1: PROPOSITION NO. 1 -WHETHER THE TOWN OF DANBY HIGHWAY SUPERINTENDENT SHALL BE AN APPOINTED POSITION, submitting Local Law No. 5 of 2010 to the electors of the Town of Danby, County of Tompkins, State of New York, to be voted upon at a general election of the Town of Danby to be held upon November 2, 2010. Shall there be approved and adopted in the Town of Danby,a Local Law entitled"Local Law No. 5 of 2010"as approved by the Town Board of the Town of Danby, to change the Town Highway Superintendent from an elected position to a position appointed by the Town, effective January 1, 2012 ) Yes ) No An abstract of such resolution concisely stating the purpose and effect thereof, is as follows: ABSTRACT OF LOCAL LAW ABSTRACT OF LOCAL LAW ENTITLED: "Local Law No. 5 of 2010"as adopted by the Town Board of the Town of Danby upon August 9, 2010,to be submitted as PROPOSITION NO. 1 and voted upon in the Town of Danby at the general election to be held November 2, 2010. The purpose and effect of the Local Law is, pursuant to Municipal Home Role Law§10,to abolish the Elective Office of Town Highway Superintendent and create the Appointive Office of Town Highway Superintendent commencing upon January 1,2012. The foregoing Abstract,together with a proposition submitted herewith, is prepared by the Town Clerk of the Town of Danby, Tompkins County, New York,with and upon the advice of the Attorney for the Town of Danby, pursuant to Municipal Home Rule Law§25. By order of the Town Board of the Town of Danby, in the County of Tompkins, New York Dated: Sept. 22, 2010 Pamela Goddard,Town Clerk Section 3. Such special election will be held in conjunction with the general election and the Tompkins County Board of Elections shall provide such further notices, voting machines and/or ballots, election inspectors, and ballot clerks as designated for general election purposes pursuant to the Election Law Section 4.This resolution shall take effect immediately. In Favor: Connors, Halton, Klein, Race, Dietrich Page 2 of 3 CAC Interview Process: There was a short discussion about the process of interviewing candidates for the CAC.Three more candidates will be interviewed on Monday, October 4. Other candidates have yet to schedule interviews. Budget Workshop: Shawley laid the"ground rules"for this process and explained the process to new Board members. There was a general discussion of the budget, especially salaries for Town Hall staff/supervisor/town clerk. Klein suggested a budget line for the Conservation Advisory Council of$500. Further discussion about the Highway Department and Water District will continue at the October 4 Town Board meeting. Setting Agenda: There was a short discussion about setting the agenda for the TB meeting on Monday, October 4. Topics to be covered include three CAC interviews,budget info for the Highway and Water district,the Cell-Tower study resolution,reports on the Salt Barn construction,NYSERDA grant progress, issues on South Danby Road, and an update on attempts to set up a credit payment system for fees and licenses in the Town Clerk's office.
