Whitcomb , Supervisor ; Catherine Valentino , Councilwoman ; Karl Niklas , Councilman ; David Klein , Councilman , Carolyn Grigorov ; Councilwoman ; Ellen Z . ALSO PRESENT : John Barney , Attorney for the Town ; Joan Lent Noteboom , Town Clerk / Receiver of Taxes ; Daniel Walker , Town Engineer ; Fred Noteboom , Highway / Parks Superintendent ; Jonathan Kanter , Town Planner ; Andrew Frost , Building / Zoning Officer ; Sally Alario , Assistant Budget Officer ; Patricia Punger , Personnel Manager . Call to Order : The Supervisor called the meeting to order at 5 : 30 p . m . , and led the assemblage in the Pledge of Allegiance . Agenda Item No . 3 - EXECUTIVE SESSION__ Motion made by Councilman Niklas , seconded by Councilwoman Grigorov to move into Executive Session to discuss property acquisition , potential litigation , and personnel matters ; carried unanimously . The Board moved into Executive Session at 5 : 31 p . m . Motion made by Councilman Klein , seconded by Councilman Niklas to return to open session , carried unanimously . The Board returned to open session at 6 : 12 p . m . , no action was taken as a result of the Executive Session . Agenda Item No . 4 - Report of Town Officials : a . Town Supervisor - See attached report . b . Town Engineer - See attached report . The Coddington Road and Troy Road water extensions should be completed by the first of the year , some of the services may not be to the road . The West Haven Road sewer will be completed soon after the first of the year if the weather cooperates . c . Highway / Parks Superintendent - See attached report . Research determined there are 62 dead end roads in the Town that are maintained . The . Tompkins County Probation Department has placed several a offenders whose sentences are to perform community service at the Highway Department to do odd jobs . They have placed fire hydrant stakes and will be painting hydrants in the spring . They are supervised by people from the Probation Department . The County provides the liability insurance coverage for these persons . d . Town Planner - See attached report . The Ithacare public scoping section will be heard at the Planning Board meeting on December 20 . An outline has been developed and distributed for public review . Public comments will be heard at the meeting , then the Planning Board will finalize the scope . e . Building Inspector / Zoning Officer - See attached report . In September a maintenance problem involving an elderly lady on Trumansburg Road was discussed . Social services has become involved and will help resolve the situation . f . Town Clerk / Receiver of Taxes - See attached report . g . Assigtant, Budget Officer - See attached report . . Councilman Klein - Will the Town collect more sales tax this year ? Ms . Alario - The check we receive in February 1995 is for the last quarter of the 1994 fiscal year , therefore it is accrued . The rest of the sales tax for this year must be applied to Outside Village until all revenues are received , any surplus will then go the Townwide Fund . $ 115 , 000 is remaining to be received in Outside Village Fund . If the last check is the average it could put the Town over budget . Councilman Klein - The last payment could result in having sever hundred thousand left over . Supervisor Whitcomb - A payment has already been made to the building fund from the excess sales tax revenue of last year ' s fifth quarter . End of the year projections are presently being figured . h . Personnel Manager - See attached report . Supervisor Whitcomb - Ms . Punger has recently completed a training course in Human Resources at Cornell University and received an excellent grade . Agenda No . 8 - Persons To Be Heard : Margaret Rumsey , Buttermilk Falls Bed and Breakfast - " The property used to be Grandfather Rumsey ' s dairy farm . My husband and I moved there in 1948 and raised our children there . Five of my grandchildren now help run the bed and breakfast . The bed and breakfast was started in 1983 , four years after my husband ' s death . After my son graduated in 1983 from Cornell University and left Ithaca there was a nine room house empty . Taxes were increasing and more income was needed . " " I traveled to England and studied other like facilities for two weeks and realized I had exactly what was liked about those facilities . " This wonderful old house was built in 1920 before there was a Town of Ithaca . The house used to be in the portion of Buttermilk Falls Park where swimming now occurs . The Falls is a big attraction . The house has been a bed and breakfast for twelve years . People love to come to my bed and breakfast because of the old house , my hospitality , the wonderful gorge trails , swimming and Ithaca in general . Ithaca is a draw for tourism . Tourism is the second state wide income . The bed and breakfast is a family business with occasional outside help . I wish you would come to see the house to see what is being dealt with . It is a home that has been opened to the public so that I can continue to live there and pay the taxes . The Town Board commenced the lawsuit to require me to discontinue using the bed and breakfast for more than eight guests . I have offered that . The Judge is expected to make a decision one way or the other soon , but I would like to make it not a confrontational thing , but a cooperative effort where we can work together and hopefully resolve the issue without lawyers . It is a whole state wide issue . ( Mrs . Rumsey handed out materials for the Board , see attached ) . The Finger Lakes Bed and Breakfast Association at their December meeting corresponded with the Town , ( see attached ) . The local , regional , and state Bed and Breakfast Association ' s have been working with the building codes people , which has been slow and cumbersome , to revise a section of the building code directly applying to the bed and breakfast industry . The Town Board also has a letter from the Honorable Martin Luster , State Assembly ; and from the Honorable James Seward , State Senator pledging to work together to make these changes in the State Building Code . Work is being done with the Professional Association of Innkeepers International about what is going on in other states . It is hoped the new accommodations of the code can happen rapidly . We want the code to be safe , but we want it to be specific to bed and breakfasts . Wendy Wilber , President Bed and ' Breakfast Association , New York State - I have been involved in the Association since the first committee meeting in 1987 . I am here to represent the members of the New York State Bed and y Breakfast Association and to support Margaret Rumsey in her efforts . The Association wishes to ask the cooperation of the Town Board during this time when the State is looking at the bed and breakfast codes , both the building and fire . We are the first ones to say we want our homes to be safe for our customers , as well as ourselves . We would ask your support . I have worked with State officials for the last two years in the review process of these codes . I will continue to do that . We would like to ask the Town to possibly suspend this situation relative to Margaret Rumsey until those codes can be reviewed by the appropriate State officials . " Margaret Rumsey - " I would like Ray Borg , Vice President of the Finger Lakes Association to say a few words . " Ray Borg - " I am also on the New York State Hospitality and Tourism Association Board of Directors , as well as the State Board for the Bed and Breakfast Council . I have worked over the last year with the fire and building code representatives in Albany , and have submitted with their support , as much as they say they can support this , the recommended code changes . The codes were put forth in hearings in the earlier part of this year and a decision is being awaited from the Code Council to see if they will be implementing these codes . At the same time , to insure continuity we have suggested that the legislature in Albany become involved . It is believed they will be doing so by creating a new category for Bed and Breakfasts of a certain size . The category would be a B3 , which would include Bed and Breakfasts from three to five bedrooms . Supervisor Whitcomb - How many occupants or guests would that be ? Mr . Borg - If you assumed there are two people per room , that would allow up to nine people . There is a breaking point for both fire codes and health codes . The decision to stop at five was based on those codes so it would not go over that limit . Those . changes could be made avoiding making additional changes to the Health Department codes as well . Anything above that would be B2 . Homes with beds and breakfasts are generally going to be larger than six beds anyway . If not , the houses will be large enough to accommodate those type of changes . We are looking at the homes which are in between . Those homes which have three to five rooms . We are also concerned about safety . These are our houses also , and we want them to be as safe as anyone would be in their homes . We are also concerned about the changes being required in order to maintain the codes at the B2 level . They are very expensive and in a lot of cases they would inordinately change the entire character of the older historic homes . In addition , we have taken a look at the impact on the economy . There is an impact of $ 50 , 000 to $ 100 , 000 per bed and breakfast on an annual basis of income lost once the bed and breakfast goes away . This would include sales to restaurants and stores ; collection of Town , County , State sales tax and room occupancy taxes ; as well as the federal return of funding through other directions . I am supporting Margaret Rumsey ' s position and we would like to see a deferral of action until both the legislature and the State Code Enforcement can come to an accommodation on what the new changes should be . Attorney Barney - Mr . Borg , you are aware this problem with Mrs . Rumsey ' s bed and breakfast has been ongoing since about 1990 . The Town is going into its fifth year of trying to solve this . When do you anticipate the code accommodations will be forthcoming ? Mr . Borg - " I have been personally involved with making recommendations to the Code Council for the last two and one half years . The recommended changes to the code book were just put forth in April of 1994 . If I wait for the proper individuals to go through their process again , it will probably be another year before that can happen . What I am hoping is that when the legislature comes into session in January they will act on it . I have letters of assurance from Assemblyman Luster indicating they will be going forth with this . Once you establish the A3 category it forces the issue of change . I can not speak for the people in Albany as to how long it will take . Attorney Barney - " How long should the Town stand by and allow something that is currently a violation of current law to exist . It is going on five years now . The Town is curious as to what your position is . Suppose someone dies tomorrow because the Town let this go for five years , what would the Town ' s exposure be then ? Mr . Borg - " You could talk of the Town ' s exposure to this sort of thing better than I . We are going as fast as we can to push this . Attorney Barney - " The point is there is no guarantee anything will happen to these code changes in the next year or two , is that a fair statement ? Agenda Item No . 14 - Public Hearing , Ordinance Amending the Ordinance Regulating Traffic and Parking in the Town of Ithaca : The Supervisor opened the public hearing at 6 : 30 p . m . , the Town Clerk has proof of posting and publication „ discussion postponed until conclusion of Agenda Item No . 86 Agenda Item No . 8 - Persons To Be Heard , Cont ' d : Mr . Borg - " I can ' t answer the question , we are pushing this as 6 fast as possible to get these changes . " Attorney Barney - " It is not beyond the realm of possibility it could be another two , three , or five years before the changes are made , if it ever passes . " Mr . Borg - " I certainly would not dispute that , however it could be as fast and as early as June 1995 " . It could work both ways . Margaret Rumsey - " There are thirty nine bed and breakfasts in Tompkins County that are a part of the Visitors Bureau , The Board was sent brochures containing information on members of the local group , the members of the Finger Lakes group , and of the New York State Bed and Breakfast Association . Locally in Tompkins County in 1983 for these homes with ten rooms and under , and ( none are known ) , there was about $ 886 , 000 worth of taxable income brought in for the 3 % County room tax , 8 % State tax , . and additional 5 % tax for rooms over $ 1. 00 . 00 . Councilwoman Harrison - " If you had two rooms with four guests , would you currently be in compliance with the Building Code ? " Mr . Frost - The issues Mrs . Rumsey is in violation of now would not apply if she had only four guests . Councilwoman Harrison - An option for Mrs . Rumsey while she waits for the hoped changes in the code , which may not be a good economic option , is for Code is to reduce the number of guests ; especially if the code changes may be made by June . After that Mrs . Rumsey ' s compliance would be made to the new code . The Town Board is in the position that this is a State law . Whether the Board agrees with it or not is not the question . Whether the Board thinks the home is lovely and the necessary changes would not be desirable is not the question . The issue is legally there is violations and there is not a lot of leeway . It is not a matter of this Board ' s desire to amend the State code . The letters received address that issue . They are being used to good advantage in trying to push for the code changes that the bed and breakfast industry feels are imperative . Mrs . Rumsey - " Cooperstown has between sixty and eighty bed and breakfasts and the entire community has put off the strict interpretation of the building code until that is resolved . That has been done already in New York State . It is not as though I am asking for something that hasn ' t happened already . That was for the entire County . You are just the Town of Ithaca , we are just the Town of Ithaca . It is also a County issue . Others in the County have been told to close and then when they understood how deep the problem was the County backed off waiting for the code accommodations . In the adjoining County they have backed off . Perhaps this Board could help make it happen rather than shut down an industry . It is not just me . 17 Councilman Klein - How many bedrooms do you rent out now ? What is your maximum number of guests if filled ? Mrs . Rumsey - " I have four on the second floor , the house has five bedrooms . Normally , and after the tenth and eleventh year , I got up to 43 % occupancy . It is not often that you are totally filled to have 43 % occupancy . Most motels consider 60 % a minimum to be viable . A full house could be ten people . I have offered to take out one bedroom , and no one responded to that , so there would only be the four bedrooms . Supervisor Whitcomb - To whom did you make that offer ? Mrs . Rumsey - " To the Attorney for the Town " . Councilwoman Harrison - Would that answer the code violation question , to bring the occupancy to eight guests ? Mrs . Rumsey - The Town Board commenced a lawsuit to require me to discontinue using the bed and breakfast for more than eight guests . I have offered to do that . Attorney Barney - More than four was the breakpoint . Mrs . Rumsey - It has been different things at different times . This has been an on going thing . Councilman Klein - That is what Councilwoman Harrison was getting at , the threshold of four guests . Mrs . Rumsey - You could have four , any of you could do this , that is not really a business . I do not do real estate anymore , I started this bed and breakfast while doing primarily real estate and then it switched over to primarily bed and breakfast , it is totally bed and breakfast for my livelihood now . Councilman Conley - I wish to ask a question of the Attorney . I bring this up because it was happening back when I was in the Coherence of Mayors during my tenure with the City . In the Village of Liberty a large summer place burned . The Code Enforcement Officer had inspected it , had written it up submitted the necessary papers of all the violations and notified the owner of a date for compliance . The date went by and nothing was done to meet compliance . During the fire several people lost their lives and the damage was extensive . Their families did not sue the owners of the property , they sued the municipality Building Enforcement Officer personally and any officer of the Village who was aware of the violations and overlooked them and did not enforce their own laws . The problem is that each Town Board member was sworn to uphold the laws , including New York State laws . I would like to know what is the responsibility , and what would happen in the event there was a V fire at Mrs . Rumsey ' s . bed and breakfast . In the event someone was injured , in the event they brought a lawsuit against the Town . Could they also bring suit against the Building Enforcement officer individually , could they bring suit against the Town Board , any of us , or the Town ? Attorney Barney - There is a dual answer , anyone can bring a lawsuit against anyone . The question is if they are likely to recover if they bring a lawsuit . Mr . Frost has some exposure because he is aware of the circumstance of the violation of code and is not taking steps to see that brought into compliance particularly the life safety kind of issues . I do not know what the responsibility of the Town Board members individually might be without legal research . I am fairly comfortable with the present position . The cases researched do hold the municipalities liable for the acts of their officers when the officers are aware of a problem under code when the loss of life or danger occurs . Mr . Frost - Question to Mrs . Wilber , " I recall you were at the Syracuse hearing when Mrs . Rumsey petitioned the Board of Review ? " Mrs . Wilber - " Yes , I was . " Mr . Frost - " That record will show that I supported some mitigating measures that were part of the application for relief from strict adherence of the code . My office and the Town supported that variance request which was made . Supervisor Whitcomb - " What happened to that variance request ? Mr . Frost - " It was denied . " Supervisor Whitcomb - Are there any further questions ? Mrs . Rumsey you may make a closing comment , the Town Board will consider this in consultation with the Attorney for the Town . Mrs . Rumsey - " I have made a number of mitigating measures that have made that house more safe . There is no smoking in the house . Every guest that comes there knows this . That in itself makes it much safer . The house is owner occupied , I sleep in the house and if I happen to be out of Town one of my family is there . Smoke detectors have been placed in every bedroom , fire extinguisher mounted on the wall by a Fire Fighter who knows where they should best be , and they are kept up to date . I have put portable ladders under the beds in the four bedrooms upstairs . Every one of the windows on the second floor are under fourteen feet which is the " magic " number in New York State to make that an escape route from the second floor . The Codes Council sent me again what they had sent out in 1993 that there was no need for enclosure of stairwells on a two story building . Which is what I have , which is how it was built in 1820 , a five bay center hall , federal style classic four course of brick , solid brick house . Carey McKinney gave me a letter saying they had insured that house since 1915 for the family and they have no problems . In 1993 they had go through the house to check to . see what more they would recommend I could do . The insurance people where satisfied with how the house is right now . This is my twelfth year , I have a good record and a wonderful business . People come from all over the world repeatedly . I have many letters from them and I am working to make that house as safe and correct as I can . I sincerely ask you to help with this instead of oppose it . I need the help and the Town of Ithaca surely needs the taxes from my three little parcels . The taxes , and trash which used to be a part of taxes , over $ 14 , 000 last year . The amount I have collected for sales tax and room tax last year was over $ 13 , 000 . I had a lot of rooms over $ 100 . 00 which made a 16 % sales tax . That is quite a contribution I am making to the Town of Ithaca . I continue to restore this wonderful old house and I invite you once again to at least see the house and know what I am doing instead of just go for the legal issue . The legal issue you have been doing . This is now the fifth year , please let ' s sit down and talk together , not just you huddled by yourselves . I know this is a public meeting so I will say no more now , but I would like to meet with you again . Thank you very much for your time . Agenda Item No . 14 , Public Hearing , Traffic Ordinance Cont ' d • The Supervisor resumed the public hearing at 6 : 50 p . m . and read the public notice . No persons came forward to be heard . Public Hearing closed at 6 : 51 p . m . Agenda Item No . 7 - Report of Tompkins County Board of Representatives : Tim Joseph - During a previous report the Town Board had asked about the County policy on whether they pave shoulders of roads routinely so as to provide bike lanes . The County does , however as the County ' s highway budget gets tighter one of the cost saving measures being considered is to stop doing so . Councilwoman Harrison - Recently , Ward Hungerford had reportedly told David Letter that in the long range it is cheaper to pave the shoulders because the road stays intact longer . That may be the type of thing where you save money one year but spend more later when the road deteriorates . I hope the County Board will take that into consideration . Is there anything this Board should do to try and insure the should paving continues ? Mr . Joseph - If this Board feels strongly about this a resolution to the County Board saying you would like shoulder paving to continue would be helpful . No decision has been made as yet not to pave the shoulders ; but Mr . Mobbs , Public Works Commissioner said that may be an option . An eight foot wide lane with a two foot shoulder is 25 % in materials added to the cost . Materials are the most expensive portion of the cost . • v Public Safety Committee statistics were recently received on crime from the County Sheriff . The list of the major crimes in 1994 . are down 14 % from the year before in every category except auto theft . This is an interesting thing since there is a general impression of a crime wave . Agenda Item No . 15 - SE R , ORDINANCE AMENDING THE ORDINANCE REGULATING TRAFFIC AND PARKING IN THE TOWN OF ITHACA : Motion made by Councilman Niklas , seconded by Councilwoman Valentino making a negative determination of environmental significance in accordance with the New York State Environmental Quality Review Act for the reference action as proposed and , therefore , neither a Full Environmental Assessment Form , nor an Environmental Impact Statement will be required . Carried unanimously . Agenda Item No . Enactment of Amendment to Traffic Ordinance : Motion made by Councilman Niklas , seconded by Councilman Klein adopting an " ORDINANCE AMENDING THE ORDINANCE REGULATING TRAFFIC AND PARKING IN THE TOWN OF ITHACA " . The Town Clerk is authorized and directed to publish said Ordinance as required by law . Roll call vote carried unanimously . Agenda Item No . 5 - Review of Correspondence : None Agenda Item No , - 6 - Report of Town Committees : Councilwoman Harrison - The GEIS Committee met with Jon Kanter and reviewed the issues raised . In the packet for this meeting was a summary of those , the request to all not on the Committee is to look at those issues and let the committee know if there are any other issues need addressing , or make comments on these issues . The Committee would like to bring back that input , The plan is for each committee member to do their " homework " , the committee will meet as a group , meet with Cornell University , and go from there . Councilman Niklas - There are a number of issues the Forest Home Neighborhood Association raised . What was the Committee ' s reaction to those numbers and projections . Councilwoman Harrison - Doug Brittain prepared the numbers about the growth of Cornell University and those type of rates . The Committee did not discuss or dispute those numbers . Councilman Niklas - Verification of those numbers should be made because how you respond to an issue is scope out by the magnitude of the issue . A statistical relationship or regression like the one shown and project into the future . There is no valid statistical way to do that . You can only predict within the scope of the data what the relationship is you cannot project because it � 1 would expect the current conditions to be maintained in the future and there is no expectation that is true or false . Councilman Klein - The Building Committee did a walk through of the possible site discussed in Executive Session for a new Town Hall . Then a meeting was held to go over the space program and make revisions for a " leaner " version . It has been determined that a 12 , 000 square foot building meets the program requirements . An in depth analysis of the requests has yet to be made . The Planning Department was the one there were the most questions about . Councilman Niklas - The Codes and Ordinances draft legislation for Sunset Provisions is being reviewed by the Planning Board with public hearings . The principle concern of Board members , contractors , and developers who have come before the Planning Committee is the amount of time that is in the legislation . It is hoped the staff and Planning Committee make the public aware that those numbers are not set , they were suggestions from COC . Recommendations from contractors and developers about what the dates , years should be are welcomed . Mr . Kanter - There probably will be another meeting held by the Planning Committee with contractors and developers to comment on those issues after the draft is reviewed . Councilman Niklas - Is the Planning Committee aware that they can make recommended changes rather than reject the entire draft ? Mr . Kanter - Yes . Councilwoman Valentino - The Recreation Partnership is going to go forward . Eight municipalities have signed on , it is remarkable that many municipalities have agreed to this inter - municipal cooperation . It is important the cooperation is in the form of recreation . The Board will be given a contract to be reviewed and . signed for the February 1995 meeting . The City of Ithaca will have four representatives , the Town will have three , the Village of Lansing will have two , the rest of the smaller municipalities will each have one . The Partnership is looking for the Town to appoint three people to work with the task force and make the transition as smooth as possible because the work will be heavy . The programs and budget need to be put in place . It will be a major transition for the City because they are giving up much of their responsibility . I feel especially proud that this will go forward . Agenda Item No . 17 - Public Hearing " LOCAL LAW ESTABLISHING AND / OR AMENDING TOWN CLERK BUILDINGe ZONING ENGINEERING PERMITS AND OTHER FEES AND REPEALING THE PROVISIONS OF THE ZONING ORDINANCE AND OTHER LOCAL LAWS RELATED THERETO " The Supervisor opened the public hearing at 7 : 04 p . m . The Town Clerk had proof of posting and publication . No persons wished to be heard regarding the local law . Public hearing closed at 7 : 05 p . m . Agenda Item No . 18 - SEOR , Local Law Fees : Motion made by Councilman Niklas , seconded by Councilwoman Valentino making a negative determination of environmental significance in accordance with the New York State Environmental Quality Review Act for the above referenced action as proposed , and therefore , neither a Full Environmental Assessment Form , nor an Environmental Impact Statement will be required . Carried unanimously . Agenda Item No . 19 - Public Hearing Date , " LOCAL LAW ESTABLISHING AND / OR AMENDING TOWN CLERK , BUILDING , ZONINGt ENGINEERING PERMITS , AND OTHER FEES AND REPEALING THE PROVISIONS OF THE ZONING ORDINANCE AND OTHER LOCAL LAWS RELATED THERETO " Motion made by Councilman Niklas , seconded by Councilwoman Valentino enacting a " LOCAL LAW ESTABLISHING AND / OR AMENDING TOWN CLERK , BUILDING , ZONING , ENGINEERING , PERMITS , AND OTHER FEES AND REPEALING THE PROVISIONS OF THE ZONING ORDINANCE AND OTHER LOCAL LAWS RELATED THERETO " . The Town Clerk is hereby authorized and directed to publish and file the said local law as required by law . Supervisor Whitcomb - These fees and provisions have been reviewed at length in previous meetings . Attorney Barney has drafted a local law reflecting the decisions at previous meetings . Mr . Frost - Page 3 , the sign ordinance is shown to sell for $ 1 . 50 and that should probably be $ 3 . 00 . The ordinance is currently 21 pages of law , in looking at charges for page copies $ 3 . 00 would be that amount . Supervisor Whitcomb - Does this change constitute a problem with enacting the local law ? Attorney Barney - No , since there is no opposition and it does riot denote a significant change . There is one typographical error regarding the area of public assembly , Page 6 should read " areas of public assembly " instead of " premises of public assembly " . Mr . Frost - At last month ' s meeting the Town Board charged myself and Attorney Barney to review the fees for multiple dwellings . That was left as is rather than going to an hourly rate for the apartments . Attorney Barney - In drafting the local law there were two ways in approaching it . One was to leave most of the zoning ordinance materials in the Zoning Ordinance and refurbish the schedule of fees and rewrite a large part of the Zoning Ordinance ; or put the language all under this local law which deals with fees . It made better sense to put the calculation mechanism into this local law . Supervisor Whitcomb - This local law is a step in the right direction to consolidate things in one local law instead having to search through the Zoning Ordinance for the fee of a specific action . Councilman Klein - There are building permit fees which are separate from inspection fees . Mr . Frost - There are fees for the building permits including the inspections . It does include them related to the building permit itself . Attorney Barney - Several inspections as a result of construction are included in the building permit fee . Councilman Klein - It was not clear since the local law starts talking about inspections on Pages 12 and 13 , inspection fees . Mr . Frost - Those are part of the site approval plan process done by Planning and Engineering rather than Building / Zoning . Councilman Klein - If the Building Officer made a dozen inspections for whatever reason , there would not be additional charges ? Attorney Barney - Correct , as long as those inspections are related to items which were not up to code and had to redone . Councilman Klein - A larger building will require many more inspections . Mr . Frost - That is the much higher fee in the local law . Ithaca College and Cornell University buildings have as much as 40 inspections involved , somewhat based on the value . Councilman Klein - On Page 5 , the last fee , the Town may never see single projects over $ 20 million . It seems there should be a dollar or per thousand value that is unlimited such as for Kendall of Ithaca . Mr . Frost - The Town charges per " building it is a building permit not a project permit . The Ithaca College Science Building did cost $ 18 million . Councilman Klein - If you have a $ 30 million building why review it and give the inspection for the same price as a $ 20 million building . Open end the fee , they average 03 % . Councilman Niklas - If that is done could this Local Law be passed after modification ? Attorney Barney - If these changes were made the local law should be readvertised for public hearing . There is another meeting in December at which the local law could be redone . Mrs . Noteboom - Mr . Frost had a question about the fee for the Zoning Ordinance and Map . He did not feel the $ 6 . 50 was enough if the map is sold separately for $ 3 . 00 because of the number of pages . Mr . Frost suggested that it be sold for $ 8 . 50 . Mr . Frost - The Zoning Ordinance booklet is costing over $ 5 . 00 to print without the map . Councilman Klein - There are several references on Page 10 , where the applicant ' s Engineer is asked to do something and a registered architect could do the same work . Architect should be added to those references . What is the inspection for on Page 14 , under the subdivision section ? Mr . Walker - That is the inspections of improvements on the subdivision or site plan for drainage , storm water management , erosion control , etcetera . This is an escrow amount . During the application it is estimated what the full cost of the project will be . The other inspection fees were related specifically to construction of improvements , not the building . In the past it was not clearly stated what fees could be charged . The Board directed the Attorney to redraft the local law with the amendments as described . Councilman Niklas withdrew his motion to enact the local law , Councilwoman Valentino withdrew her second . Motion made by Councilman Niklas , seconded by Councilwoman Valentino authorizing and directing the Town Clerk to advertise for a public hearing to be held on December 30 , 1994 , at 10 : 10 a . m . in order for the Town Board to consider a " LOCAL LAW ESTABLISHING AND / OR AMENDING THE TOWN CLERK , BUILDING , ZONING , ENGINEERING , PERMITS , AND OTHER FEES AND REPEALING THE PROVISIONS OF THE ZONING ORDINANCE AND OTHER LOCAL LAWS RELATED THERETO " . - Carried unanimously . Agenda Item No . 9 - Consent Agenda Items • Mrs . Punger - A correction of the account number needs to be made to 9 ( 1 ) , it should be A1670 . 100 . Councilwoman Valentino - Item 9 ( q ) needs to be discussed and pulled . Motion made by Councilman Klein , seconded by Councilwoman Valentino approving and / or adopting the resolutions for Consent Agenda Items 9 ( a ) - 9 ( j ) , 9 ( 1 ) - 9 ( p ) , 9 ( s ) as presented with amendments as stated . Item 9 ( c ) , vouchers and abstract were not present and therefore not approved , Item 9 ( k ) will be considered separately . Councilwoman Valentino - Item 9 ( q ) is the reappointment to the Neighborhood Advisory Committee for the Commercial Avenue Central Processing Facility . I have not been a . particularly good representative to the Town on this committee because their meeting times are often in conflict with other meetings that must be � 5 attended . The committee deals with maintenance of the building such as landscaping . They also deal with the neighborhoods where business has been lost and with residents who feel their property is devalued because of the facility . The County and the City have an agreement to determine a way to take care of those issues . There are a few Town properties near there which are residential . The majority of the Committee ' s discussions are ' things between the City and the County . Councilman Klein and Councilwoman Valentino amended the resolution to include pulling item 9 ( q ) , and to have it addressed at the January 1995 meeting . Agenda Item No . 10 - Benefit Assessment Refund : Motion made by Councilwoman Harrison , seconded by Councilwoman Grigorov authorizing a refund of water benefit charge in the amount of $ 80 . 00 , to be paid to Jane R . F . Mead , 222 Enfield Falls Road , Ithaca , New York . Mr . Walker - The Town incorrectly assessed water benefit to a property that cannot have water because it is above the pressure zone . There was confusion on the parcel because it is a land locked parcel behind a road frontage parcel . The assessment is charged for the road frontage parcel which is not wide enough to build a house on but is owned by the same person . The refund will be addressed next year because the error was not found in time to have it changed on the tax rolls . Motion carried unanimously . Agenda Item No . 11 - Insurance Proposal for 1995 • Supervisor Whitcomb - A committee was appointed several months ago to review the Town ' s fire and liability insurance on buildings and equipment , The Committee met with a consultant and recommendations for changes in the coverage were made . The request for proposals with those changes were sent to several insurance agencies . Mrs . Punger spent a great deal of time collating and comparing the bids . The result was the insurance proposal as recommended by Mrs . Punger . Included is a short summary of the new coverage compared to the existing coverage . This was an excellent process . The Committee learned a great deal and there is now much better coverage for less money . Mrs . Punger - There is one item the Board needs to decide . Most of the increased coverages are in the proposal . Reducing the property deductible from $ 5 , 000 to $ 2 , 500 so there would be no wait if there was a loss would cost another $ 2 , 500 . Motion made by Councilman Niklas , seconded by Councilwoman iv Valentino approving the insurance proposal submitted by the Sprague Insurance Agency , effective January 1 , 1995 , for a cost of $ 59 , 330 , charged to account A1910 . 400 . Supervisor Whitcomb - The purpose of insurance is to cover those kinds of major losses that can not normally be covered in the day to day operations . The Board agreed to stay with the $ 5 , 000 deductible . Supervisor Whitcomb - What exactly is building ordinance coverage which is included in this policy but was excluded under the present coverage ? Jeff Farmer - If you were to have a fire burn down an older building such as the Town Hall , but the Town ordinance requires it be reconstructed in a different form than what it was the insurance will pay the extra cost there might be to meet the requirements of the ordinance . Mrs . Punger - The options included in the original proposal were added to give the $ 58 , 830 . The public officials liability is included in this proposal . Mr . Farmer - The Public Officials liability is a separate item which needs to be continued . There is also an optional quote as the Town has an umbrella liability policy which may not pick up over and above the public officials . If you want the Town ' s umbrella policy to include over and above the public officials liability there is an extra cost . Mrs . Punger - This extra coverage and cost was included in the total proposal . Supervisor Whitcomb - Which public officials are covered ? Mr . Farmer - Basically all employees , elected , appointed and salaried . Mrs . Punger - The Town also has additional faithful performance bonds which cover the Town Supervisor , Town Clerk / Receiver of Taxes , and now the Assistant Budget Officer for $ 1 million a piece . Plus all other employees at $ 25 , 000 . The new coverage saves about $ 14 , 000 from the present coverage , with increased coverages . Motion carried unanimously . Councilwoman Valentino - Mrs . Punger is to be commended for her excellent work done on this insurance proposal . Very good job . Agenda Item No . 12 - Charter By - Laws Tompkins County Intermunicipal Cable Television Commission Councilwoman Valentino - Is the Town interested in becoming a member and participating in the Intermuncipal Cable Television Commission ? The charter and bylaws are very close to those of the original commission many years ago . The main change was in how payment is made . Supervisor Whitcomb - What kind of authority will this commission have ? Councilwoman Valentino - The authority will be intermunicipal cooperation . The goal is to try and negotiate the different franchises having the same expiration date jointly . During the transition period the commission will give people the opportunity to voice concerns about different areas receiving different services . The Commission is interested in working more cooperatively with the City on cable access . Because of what is happening with federal changes , the small municipalities cannot negotiate the complicated rates . The State Commission does the negotiating and has to follow the federal guidelines . The Town can not yet negotiate things like the channels received . The Commission will be able to address the issue of cable quality . The Town should join this Commission as it is unclear what will happen at the federal level . The Commission will not be able to negotiate rates . It is unclear what the Commission ' s budget will be . Attorney Barney - There are areas in the bylaws which are troublesome . The Town would give up some rights by joining . If the Town is going to change our franchise it would have to be first submitted to the Commission with a waiting period of at least 60 days for them to comment before the change could be made . Councilman Niklas - Would the Town be bound by the Commission ' s comments ? Attorney Barney - No , the Town would not be obligated by the comments , Attorney Barney - The bylaws also provide that any hearing they conduct on proposed changes in the franchise they submit constitutes a hearing for the Town ' s purposes . That is bothersome because there will be only one or two Town representatives on the Commission . It is not clear what powers the Town Board has to delegate that to another entity . Language might be inserted to say , " to the extent permitted by law " . The budget process talks about adopting the commission budget in the last quarter of the year . Since the Town is also going through the budget process it may be better to have the Commission adopt theirs before the Town so numbers will be known . There are other typographical errors which need to be addressed and noted to the Commission . 1 V This contract can be amended by a 3 / 4 ' s vote of the Commission . Since the Town of Ithaca is likely to be the second largest entity , does the Board want a contract to amended without their approval ? Councilwoman Valentino - A change in the language for the contract to be amended should be made from . " 3 / 4 ' s " to " all " . The Town of Covert is included since they are served by the same cable . Motion made by Councilwoman Valentino , seconded by Councilman Niklas authorizing the Town Supervisor to affix his signature to the Charter and Bylaws for the Tompkins County Intermunicipal Cable Television Commission ( TCICTC ) affirming the approval by this Town Board of the Charter and Bylaws of the TCICTC after the amendments as proposed by the Attorney for the Town have been included in the document . Carried unanimously . Agenda Item No . 13 - Appointment Interviewing Committee , Planninq Board Member : Supervisor Whitcomb - There may be more than one seat open on the Planning Board . The Planning Board has selected Steve Smith and Herbert Finch as members of this committee . Motion made by Councilwoman Valentino , seconded by Councilwoman Harrison appointing Councilwoman Carolyn Grigorov and Councilwoman Valentino to serve on the Planning Board Members Interviewing Committee . Carried unanimously . Agenda Item No . 20 - Conservation Board Budget : Councilwoman Harrison - What is the Town ' s share and what is the State ' s share ? Mr . Kanter - The Town ' s share is the $ 2 , 000 budgeted , and staff time contributed towards work on the Conservation Board . The average amount of reimbursement from the State has been approximately $ 1 , 000 per year . Supervisor Whitcomb - This does not ask for additional monies for the Conservation Board , this allocates the time and resources the Planning Department would spend on Conservation Board related activities for the purposes of a budget to submit to the State for reimbursement . It has been suggested this Conservation . Board budget be included during the normal Town budget process next year . Motion made by Councilman Niklas , seconded by Councilwoman Harrison approving the proposed State budget submission for the Conservation Board for the New York State fiscal year 1995 - 1996 in the amount of $ 17 , 747 . 48 in order to qualify for reimbursement under New. York State ' s Local Environmental Assistance Program . Carried unanimously . Aqenda Item No . 21 - SCLIWC Negotiated Work Plan Supervisor Whitcomb - The plan has been reviewed and revised by the Town Engineer and meets with his approval . Mr . Walker - The plan summarizes how the operation has been functioning . Technically , Bolton Point staff are Town of Ithaca employees . There are two parts to the water system that is why there are two sections to the plan , West Hill and non West Hill . In the West Hill area water is purchased from the City . Bolton Point does not generate revenue directly from the sale of that water . There are more charges on West Hill than within the system . The plan states what is already being done and how SCLIWC bills for different services . This falls within the Town Budget already approved . The prepared resolution was drafted by Bolton Point . It may not be necessary for the Town Board to approve the plan . It is an operational arrangement which fits within the original agreement . The agreement did not cover all these individual cases since the work has expanded since the agreement was made . Attorney Barney - Some of the language is questionable as to what it means . Councilman Niklas - The resolution can be amended by the Attorney for the Town so that the Town Board better understands what is being done . Motion made by Councilwoman Grigorov , seconded by Councilman Niklas acknowledging the Board has reviewed the Negotiated Work Plans and approves same at this time , sub3ect to the provisions set forth in the prepared amended resolution for the purposes for which it has been submitted or stated in the prepared amended resolution . Agenda Item No . 22 - Park Lane Speed Limit Request Motion made by Councilman Klein , seconded by Councilwoman Harrison that the Town Board hereby requests , through the County of Tompkins , that the State of New York Traffic Safety Division consider the extension of the area speed limit of 30 miles per hour for the boundaries - extending southerly on Park Lane to its intersection with the northerly right - of - way of Route 79 thence westerly along the northerly right - of - way line of Route 79 to the easterly right - of - way line of Pine Tree Road , thence northeasterly on a straight line to its intersection with the northerly right - of - way line of Regency Lane to its intersection with Snyder Hill Road . ' Carried unanimously . Councilwoman Valentino - The intersection of Park Lane and Route 79 needs a street light as it is very dark . v - Agenda Item No . 23 - Public Hearing Date , ECO Village SLUD • Motion made by Councilman Niklas , seconded by Councilwoman Valentino authorizing and directing the Town Clerk to advertise for a public hearing to be held on January 9 , 1994 , 7 : 00 p . m . to consider the Eco Village Co - Housing Cooperative Special Land Use District ( SLUR ) . Mr . Kanter - This public hearing will be contingent on the Planning Board having made their recommendations . This issue will not be addressed by them until January 3 , 1994 . Motion carried unanimously . Agenda Item No . 24 - Bid Specifications & Advertisement , Jet Rodder : Mr . Walker - A jet rodder is a high pressure hose used to clean sewers . Purchase of this machine was budgeted for in 1994 . Motion made by Councilman Niklas , seconded by Councilman Klein authorizing the Town Clerk to advertise and receive bids for the new trailer mounted sewer jet . Carried unanimously . Agenda Item No . 25 - Extension of Contract Holt Architects : Supervisor Whitcomb - After visiting the Orthopedic Associates building it may be worth doing a study to see what it would cost to bring it into compliance to meet our needs . Councilman Klein - Holt Architects prepared a memo outlining some of their observations about the building . There are 70 parking spaces , it is in good shape , two floors at 6 , 000 square feet on each floor seems to meet the theoretical program . In an existing building there may not be the economy of planning . A two story building would need a higher square footage for the stairs and elevator . There is a flush door on the upper level for handicap accessibility , and also at the lower level . There would have to be internal handicap accessibility . Mr . Frost - If the occupancy class of the building is not changed there may not need to be an elevator . Councilman Klein - It becomes more of a policy decision about providing an elevator . Supervisor Whitcomb - Before the specifics can be addressed the location must be considered . Councilman Klein - The building is worth looking into . Code issues could be addressed if the Board is interested in this building . The courts and meeting room would need a State variance of code because of the ceiling height . Holt Architects would identify any zoning or other issues needed to be dealt with and place a cost estimate on them . If the Board is interested in that location , the contract with Holt Architects needs to be extended to study these items . Supervisor Whitcomb - The disadvantages of this building are that it is not in the central business district adjacent to the post office , banking , and the Attorney for the Town . In late afternoon and early morning it would be a nightmare to come out of the driveway and turn left . Councilwoman Harrison , would you consider any location other than a downtown location ? Councilwoman Harrison - I feel strongly that the Town Hall should be easily accessible through other means than by automobile . Ms . Alario - The area is served by the bus route . Councilman Niklas - The traffic flow early morning and late afternoon would make this building a dreadful location . Supervisor Whitcomb - There are few prime downtown locations . Councilman Conley - The downtown location would be nice if it were easy to do , but other options can be investigated . It would be interesting to see what the employees thought of that location . What would the employees do for lunch ? Councilman Klein - Any location other than downtown will require the need for on site employee facilities . Supervisor Whitcomb - Other sites have been considered , such as next to the highway barns on Seven Mile Drive . Councilman Niklas - I am not against a non downtown location , just this particular one . Councilwoman Harrison - What would be the point of - spending significant monies on variances unless it was known they would be granted ? Councilman Klein - The Town would get a variance . Mr . Frost - If less than 100 occupants were probable the ceilings could be eight feet . Supervisor Whitcomb - What is the Board ' s pleasure , do you wish to pursue this building or a downtown central location ? Councilman Klein - Holt Architects would probably charge between $ 5 , 000 and $ 10 , 000 to review this building depending on what was asked . Mrs . Noteboom - A suggestion may be to continue the feasibility study with Holt Architects as contracted to finish the description sheets . Then the Board might authorize the Town Clerk to contact the real estate agents in the area asking for a listing of buildings for sale which have 12 , 000 square feet and are in the projected price range . That list could then be given to Holt Architects to review for serious possibilities . Supervisor Whitcomb - Would the Town get a better response if there were an agent working specifically for the Town , or if all real estate agents were asked ? Attorney Barney - Someone should go to at least one broker and ask what is on multiple listing for buildings of this size . Councilwoman Harrison - Notify a broker of the size requirements for buildings in the Town or City . Councilman Niklas - It is agreed the Town Board does not wish to pursue the Orthopedic Associates location at this time , but the Board does wish to ask a real estate agent to make a listing of what is available . Attorney Barney - There is a danger in that because there is one property the Town is aware of they wish to exclude . If an agent notified the Town of that property the Town would be in a position of possibly paying a brokerage fee . Supervisor Whitcomb - The County is also reviewing options for relocation of the Department of Social Services . Downtown is high / on their priority list . The decision will be made in January . The County feels there is some merit in exploring the idea of a municipal building shared with the County . There are concerns about losing the Town identity in that proposal . That could be addressed with a design issue . That should also be investigated . Agenda Item No . 26 - License Agreement Cannavino Sewer Easement Attorney Barney - Mr . and Mrs . Cannavino are in the process of selling their home and it was discovered by survey that the house is within the Town easement . The house was supposedly there at the time the easement was given . It is less clear as to how much of the deck encroaches on the easement . The Town could tell them to move the house . This encroachment creates a title defect for prospective purchases . The Cannavino ' s have asked the Town to relinquish its right to cause them to move the house . An agreement has been drafted allowing that with a resolution subject to Town Board approval . Councilman Niklas - If this is allowed would there be enough navigating room for any work the Town may do now or in the future ? Mr . Walker - The record drawings show the sewer lines running on the property line . The deck appears to abut the property line , a portion of the deck might have to be moved if work were done . Councilman Niklas - If the Town should ever have to do construction a - it will mean the temporary or permanent removal of the deck . Mr . Walker - The easement allows ten feet on the other side of the sewer main . The sewer main apparently does not run the middle of the easement as shown on the survey map . The house is more than ten feet away from the sewer line so the house would not be in jeopardy . The path was there when the sewer was built and provides access up the sewer line . The easement was drawn in 1961 and the house predates that by 20 or 30 years . Councilman Niklas - Does the draft agreement give the owners the right to maintain the house , and how would the deck be handled ? Attorney Barney - The house can stay , the Town would have the right to remove the deck or not excepting responsibility if the right to use the easement occurs . The agreement also states that if the house is destroyed it cannot be rebuilt over the easement . Motion made by Councilman Niklas , seconded by Councilman Klein authorizing the Town Supervisor to execute the License Agreement on behalf of the Town of Ithaca related to the sewer easement on the property owned by Patsy M . Cannavino , Jr . and Susan C . Cannavino . Carried unanimously . Agenda Item No . 27 - Sidewalk Maintenance Route 13 Councilwoman Harrison - The State wants a resolution agreeing it is ✓ the Town ' s responsibility to maintain those sidewalks when they are built . Councilman Niklas - Why not say it is the State ' s responsibility ? Councilwoman Harrison - Since it seems to be the Towns responsibility under the law the Town should pass a resolution acknowledging that fact . The responsibility will be passed on to the abutting property owners . The Town should work on a townwide ordinance , but it has to wait so the issues can be considered . Attorney Barney - A resolution is not necessary because that option is given to the Town by New York State law . Maintenance should not be passed to the abutting owners unless it is done townwide . Mr . Noteboom - The Supervisor has been given a list of walkways presently maintained by the Town . Mr . Walker - This may be a planning issue for the COC before the legislation is written because it has to be decided if the Town wants to sponsor sidewalk construction if a rural atmosphere is desirable . Councilwoman Harrison - This issue is who is responsible for maintaining sidewalks when they are constructed . Aqenda Item No . 28 - Road Name Changes - Supervisor Whitcomb - The inception of the 911 emergency number shows there are a number of roads in the Town and County which have similar names . It has been requested the Town review those roads and consider changing the names . Mr . Frost - In the past the Town Board has been hesitant to change people ' s addresses . When there is a new road the Fire Coordinator is consulted to make sure there is not a conflict . There are some roads which exist with misleading names . Councilman Niklas - There are obvious problems where emergency vehicles could get lost . What is the proper procedure for dealing with these issues ? Attorney Barney - The action to change these could be done by simple resolution which does not require public input , or by local law which does require public input . The local law would probably be the best procedure . Supervisor Whitcomb - The Highway Superintendent will put together a list roads needing review and bring the list back to the Town Board , Councilwoman Valentino - There is also a problem with names of roads which are the same in several places throughout the County . Mr . Noteboom - There has been contact with the County about all aspects of the problem . How can these problems be prevented in the future ? Councilman Niklas - Cornell University had the same problem in naming buildings . They set up a committee to review them . The Town could have a standing committee charged with the naming of roads and streets . Attorney Barney - The subdivision checklist could be amended to add a line for confirmation of naming of roads and streets . SUPERVISED BY Town Engineer SPECIFIC MAJOR DUTIES Prepares water and sewer maintenance program including schedules , implementation measures and cost estimates . Prepares reports , keeps daily logs of projects and tracks program costs . Coordinates with Highway Superintendent in planning and scheduling highway dept . personnel for repair and maintenance of the Town water and sewer systems . Supervises work crews . All waters in the Town of Ithaca classified C with a standard of ( T ) and higher by the Department of Environmental Conservation , Works Covered By This Memorandum All Town of Ithaca , public works that will change , modify or disturb the course of , or necessitate the removal of sand , gravel or other material from any of the above waters . PERMITS 1 . No permit shall be required for the following works undertaken where the State does not own fishing rights or where the stream is not on other lands owned by the State : a . Stream crossings , provided the disturbance of the bed or banks is limited for fifty ( 50 ) feet above and below the crossing . - 2 - b . Channel clearing or realignment of streams that involves less than one hundred ( 100 ) lineal feet of stream in any mile of length . . Notification Notification shall be given to the local permit agent 24 hours before undertaking work covered by this Memorandum for which no permit is required . Standards of Performance All work shall meet the following standards : a . The project shall not obstruct the upstream or downstream movement of fish . ( Culverts and the floors of box culverts and bridges shall be , as nearly as possible , flush with the stream bed . ) b . Sufficient flow of water shall be maintained at all times to sustain aquatic life downstream . c . Any culvert , box culvert or bridge floor shall be designed to provide a V or dish - shaped channel , to concentrate flow during periods of low water and facilitate the movement of fish . d . Disturbance of the stream bed shall be kept at an absolute minimum , and the stream bed shall be returned as nearly as possible to its original condition , or better . ( Where possible , in modifying a stream bed , the center line shall be 8 to 12 inches lower than the toe of the channel bank , to concentrate the flow of water . ) e . Where work necessitates disturbing banks , they shall be returned to original condition or they shall be graded to a 1 vertical to 3 horizontal slope , and rip - rapped or planted with suitable grasses , trees and shrubs so as to prevent erosion . All tree and brush removal shall be kept to a minimum . f . Any dike or cofferdam required to facilitate construction shall be erected in such a manner that stream flow will not be sufficiently reduced to endanger fish life downstream and such dike or cofferdam shall be erected of materials that will not contribute substantially to the turbidity or siltation of the stream . g . During the project , care shall be taken to prevent or reduce to a minimum any damage to any stream from pollution by debris , sediment , or other material , or from the - 3 - manipulation of equipment and / or materials , in or near such streams . Water that has been used for washing or processing , or that contains oils or sediments that will reduce the quality of the water in the stream shall not be directly returned to a stream . Such waters . will be diverted through a settling basin or filter before going directly into the stream . h . If water is taken from a stream for construction purposes and an impounding structure is necessary , such structure shall be erected in a manner causing the least possible disturbance to the stream . i . In all cases involving work in a stream , every effort should be made to return the stream to the highest possible standard for aesthetic value , water quality and fish habitat . 2 . All other work falling within the jurisdiction of Conservation Law , Title 5 of Article 15 shall be carried out only after complying with Part 608 of Codes , Rules and Regulations of New York State and obtaining the necessary permits for the proposed work . NOTE : Emergency Work - See : Part 608 . 8 ( Codes , Rules and Regulations of the State of New York ) NOTE : Excavation or fill of navigable waters is not covered under this Memorandum , and a permit is required . It is further understood by both parties that the local permit agent , upon such notice from the Town of Ithaca , will complete his review and make known his recommendation , so as to facilitate the project . Rescission of Memorandum of Understanding If the required notification is not furnished or if in the opinion of the Department of Environmental Conservation , the Town of Ithaca fails to conform to one or more of the above standards or the recommendations of the permit agent , the DEPARTMENT may unilaterally rescind this Memorandum of Understanding . Such rescission shall be effective upon receipt of written notice by the Town of Ithaca . Seven Mile Drive Installation of the sanitary sewer has been completed and installation of the water is scheduled . Chase Pond Subdivision ( Saunders Road ) . East King Road All improvements required from the contractor have been completed . Sanctuary Woods Subdivision , Sapsucker Woods Road Construction of the sanitary sewer is completed and the water main improvements has been started . WATER & SEWER The Westhaven Road and Mecklenberg Road sewer extension construction has been started on the Mecklinburg road portion of the sewer . Work is proceeding with some delay due to weather . The Troy Road and Coddington Road water extension project contract has been under construction and the Troy Road main has been completed except for final testing and service installation . The Coddington Road water main is under construction and should be completed by December 15th . FACILITIES , The Town Engineer has continued to work with the Town Clerk . the Highway Superintendent and the Parks Manager on a facilities improvement plan , which includes the Town Hall facilities and the Highway and Parks department needs . REP HIGHWAY SUPERINTENDENT ' S BOARD REPORT FOR NOVEMBER 1994 TOWN OF I_THACA BOARD MEETING . DECEMBER 12 , 1994 As this fall has been rather mild , the Highway crews spent only 91 . 5 hours of time removing snow from the roads and salting them this month . As the one storm we received began on a weekend , 45 . 5 hours of the 91 . 5 hours were overtime hours , leaving 46 regular hours . The total amount of salt used was 43 tons . Because of the mild weather the Highway crews have been able to get several road repair jobs done . The crews have put down shoulders on several Town roads , including Hopkins Road , Culver Road , Chase Lane , Burns Road , etc . This , along with other miscellaneous jobs , took 297 . 5 hours of Permanent Improvement ' s time . So far , we have used 500 tons of material to lay shoulders . During November , the Town conducted its semi - annual leaf collection . The Highway crews spent 392 . 5 hours working on leaf collection . Again , this year ' s collection went rather smooth , with very few mechanical breakdowns . The Highway crews spent 431 hours of time on General Repairs . Such projects included : patching roads , working on handicap ramp at Town Hall , distributing and collecting voting machines , and other tasks around the Highway barn . Repairs and servicing on machinery took 142 hours this month . December Proiects 19 Snow removal , when required . 2 . Continue laying road shoulders . 3 . Cleaning ditches . 4 . Final mowing in some of the parks was completed , totaling 14 hours . The mowing equipment was then serviced and stored for the winter . 2 . Fall cleanups at all park and trail sites were done , requiring 24 hours . 3 . Park ' s four staff members contributed 170 hours to the town ' s leaf collection effort . 4 . Don and Tim spent 222 hours constructing the Town Hall ' s handicap access ramp during November . 5 . We received our new 47 " , two - stage snowblower attachment for Park ' s John Deere 935 Tractor , complete with cab for operator comfort and protection . This gives us two pieces of snow removal equipment for better sidewalk and bikeway maintenance . 6 . Year - end purchases . ghk Agenda Item #4d Town Planner' s Report for December 12 1994 Town Board Meeting DEVELOPMENT REVIEW Planning staff has been working on the following projects under Planning Board review jurisdiction: First Residents Group at EcoVillage, Mecklenburg Road Discussion of the proposed SLUD and conceptual plan for 30 dwelling units ( 15 duplexes) and a community center clustered on a 30 acre parcel at the EcoVillage site continued at the November 15, 1994 Planning Board meeting. Town Attorney, Town Planner, and Town Engineer met with the applicant to further revise the SLUD . The matter is next scheduled to be on the 1 / 3 / 95 Planning Board agenda, where a recommendation to the Town Board is anticipated . South Hill Industrial / Retail Complex (DigiComp), Danby Road This is a modification of a previously approved site plan (Novarr), now consisting of 32,500 sq. ft. of retail / office / industrial use in three new buildings and 5,000 sq. ft. of office /industrial use in an existing building Which is currently being renovated. Primary access would be added off of the NCR site entrance. A public hearing on preliminary site plan approval was held at the December 6th meeting, and preliminary approval was granted . Cornell University - East Hill Plaza, Ellis Hollow Road Site plan amendment (change of interior use : former Southeast Asia Program space to be used by Purchasing Dept. ) received approval at 11 / 15 / 94 Planning Board meeting. Buttermilk Valley Estates, Danby Road 70 lot cluster subdivision proposed on 74 + /- acres adjacent to La Tourelle . Was considered for preliminary approval at 12 / 6 / 94 Planning Board meeting. Board issued a Positive Declaration of Environmental Significance, and required the preparation of an Environmental Impact Statement. Scoping for the EIS will be the next step. Paleontological Research Institution (PRI), Trumansburg Road Discussion was held at 11 / 15 / 94 Planning Board meeting on the concept of setting up a temporary outdoor display by Dinamation of dinasaur replicas during the summer of 1995, including modifications in site access, parking, circulation and a temporary structure for the sale of souvenirs / gifts . Subsequent word from PRI is that they are not going to pursue this project. Ithacare Senior Living Community, Danby R6ad The 11 / 15 and 12 / 6 / 94 meetings of the Planning Board included discussion of a draft resolution regarding Positive Declaration of Environmental Significance and a draft Scoping Outline for an EIS, both pursuant to the judge' s recent ruling. Significant staff time was spent on preparation and revision of Scoping Outline. A meeting was held with the applicant to further revise the Scoping Outline . At the 12 / 6 Planning Board meeting, the Board issued a Positive Declaration, suggested further revisions to the Scoping Outline and set a date for a Public Scoping Hearing (Tuesday, Dec. 20, 1994) . Notice of the Pos . Dec. and Hearing, along with the revised Scoping Outline, will be distributed to NYS Dept. of Environmental Conservation (DEC), Interested and Involved Agencies and appropriate individuals . CURRENT PLANNING DEPARTMENT PROJECTS Planning Department staff is working on the following projects : Environmental Atlas : In process of trying to get an intern from Cornall Natural Resources Dept. to work on project. Conservation District: Planning Committee met with City of Ithaca officials on proposed Six Mile Creek Conservation District, including a field trip to observe some of the key issues and areas . City also discussed their efforts to acquire additional lands around the watershed . A revised draft of a proposed Conservation District has been prepared and was discussed at the Dec. 5th meeting. Planning Committee is considering another field visit to study issues of density, boundaries, etc. A parcel analysis will be prepared to study the size, uses and owners of properties in the Six Mile Creek area . Fees in Lieu of Parkland : Town Attorney has prepared draft for Codes and Ordinances Committee' s consideration. The draft has been circulated to other boards and committees for comment. Staff will conduct additional research on land values in MR and R-5 Districts (these were not included in the original research) to provide a basis for setting fee amounts . Sunset Provisions for Subdivision Approvals: A proposal to extinguish abandoned subdivisions was forwarded to the Planning Board for their consideration as an amendment to the Subdivision Regulations. This was discussed, and a public hearing was held at the Nov. 15th Planning Board meeting. Concerns were raised by the public and board members on the proposal, and in particular, about the short length of time in which a subdivision approval would be extinguished if no sale of lots or commencement of construction of required improvements occurs (within 3 years of final approval) or substantial completion of construction of improvements (within 5 years) . Ithaca-Tompkins County Transportation Council (ITCTC ): Staff attended the regular meeting of the Planning Committee on Nov. 22nd, and will be attending the joint meeting of the Planning and Policy Committees on Dec 13th. At that meeting, the 2015 Long Range Plan should be officially adopted. Other upcoming initiatives will include a county-wide trail / corridor study. The Sprague Insurance Agency , currently serving 33 other municipalities , was determined to have the best all around proposal and has been submitted to the Town Board for approval . YEAR END PREPARATION Verification and balancing has begun of salaries , taxes , benefits , and voluntary and garnished deductions of the 189 people paid through the Town ' s payroll system during 1994 . Payments requiring special tax treatment have been identified and the appropriate forms ordered . This process must be complete before year - end for federal reporting in January . In addition to 1994 figures , the process of calculating and inputting changes for 1995 plus the notification of affected persons , including retirees and COBRA participants , has begun . An upgraded computer has been installed in anticipation of the expanded payroll program and personnel data base scheduled to be loaded later this month .
