Pledge of Allegiance : The Supervisor led the assemblage in the
Pledge of Allegiance .
Call to Order : The Supervisor called the meeting to order at 5 : 30
p . m .
Agenda Item No . 3 - Report of Town Officials
a . Town Supervisor - The Town Planner , Floyd Forman submitted his
resignation . Daniel Walker has been asked to coordinate the
activities of the Planning Department until the Town Board makes a
decision as to the Town Planner position .

Mr . Walker and the Planning Department staff have done an excellent
job in continuing the activities in Planning . The Supervisor has
received a call from Stuart Stein , asking if the Town would be
interested in some sort of an arrangement with Tompkins County
Planning for planning services , either on a temporary basis or more
permanently . Mr . Stein expressed the opinion that the County is
interested in the consolidation of services in a number of areas .
Barbara Blanchard , at Station ' s 6 ' s annual meeting expressed
interest in City / Town / County joint planning activities .
The Supervisor attended the annual banquet of the Volunteer Company
6 , from South Hill Fire Station on December 11 . The general morale
of the department , including the volunteers , seems to be high
although it is clear that reorganization of the volunteer program
and contract negotiations for fire services between the Town and
City next year will make 1994 challenging .
John Whitcomb , Supervisor - elect has been meeting with the
Supervisor and Department Heads for a smooth transition .
The Supervisor deleted Agenda Item No . 30 as she had not received
the necessary information from the City of Ithaca for the Town
Board to make a decision .
b . / e . Town Engineer ' s Report / Planning Report - Mr . Walker commented
on his written report , ( see attached ) . Mr . Walker has been
reviewing the South Hill Trail project with Planning . Mr . Frantz
has been doing an excellent job in auditing that by preparing cost
estimates to send to the State . The project is within the budgeted
amounts . The Planning Staff has been doing traffic counts on
Coddington Road due to voiced concerns . The planning staff has
been involved. in the search for the Indian remains at Inlet Valley .
A major project of concern is the Cornell GEIS for the Orchards
area . The comment period has ended with the comments forwarded to
Cornell . Cornell has offered to respond to those to allow the
Planning Board access to additional information . It is anticipated
that at the beginning of January the Planning Board will discuss
the comments and the time frame for developing the GEIS .
Councilwoman Valentino asked Mr . Walker about the MPO process . In
that process highways are included , but is public transportation
also included ?
Mr . Walker responded that is a very important segment of the ISTEA
legislation , it is an intermodal system encouraging more mass
transit , pedestrian , and bicycle considerations .
Councilwoman Valentino said the recreation task force is talking
about a new system of delivering recreational services . The recent
survey brought out the lack of transportation to recreation

facilities . Nancy Zahler , Director Tompkins County Youth Bureau
has talked to Tomtran to encourage more ridership on those
services . Maybe part of the MPO discussions could include
exploration of transportation services might fit into the plan .
Mr . Walker explained that has been addressed in the ISTEA
legislation . The plan for Tompkins County will address the transit
questions in great detail . Mr . Walker assured the Board he will
make sure the MPO includes this issue in their discussions .
Supervisor Raffensperger mentioned that the MPO is setting up a
system of public input into the master plan . Nancy Zahler should
be notified so that she can attend the meetings .
Councilman Klein commended Mr . Walker on involving the engineers
who have been hired to refurbish the Forest Home Bridge before the
work was started .
Mr . Walker said that the firm hired to complete the job is the MRB
group out of Rochester .
c . Highway Superintendent ' s Report - Mr . Noteboom reported on his
written report , ( see attached ) . It was difficult to do the leaf
and brush pick up because of a storm . Problems occurred with
picking up brush from the storm damage at the same time leaves were
picked up . The trails also had problems with trees leaning over
and falling down because of the storm .
d . Building Inspector / Zoning Officer ' s Report - Mr . Frost discussed
his written report with the Board , ( see attached ) .
f . Town Clerk ' s Report - Mrs . Noteboom reported that tax collection
may cause a few problems this year because Tompkins County passed
their budget so late . Bills will be printed later than was hoped .
The projection is that the bills will not be in the Town ' s
possession until after Christmas .
The bills have been created , however the County was not able to
purchase the machine to fold them and put them in the envelopes .
Each bill will have to be folded in three sections and stapled at
the top before mailing .
Previously , the County Tax Collectors had discussed sending the
bills directly to the homeowners instead of the escrow agents .
Unfortunately , opinions from the State Association of Tax
Collectors hive been received , along with a change in opinion from
Martin Luster that the bills should be sent to the escrow agencies .
The County Tax Collector ' s have agreed instead of sending them to

the homeowners they will be sent to the coded bank number that
Tompkins County provides . The State Association of Tax Collectors
says that at a house closing when the homeowner signs papers to
have the bill sent to the escrow agent that is the " contract ' with
the local receiver of taxes .
The Town will be using the codes from the County and will not send
out individual tax bills to other escrow agents who have notified
us that the property has changed hands during the year . The reason
that this will not be done is because it would be almost impossible
to pull out those bills from the 4 , 500 or more that we send out .
Real Property Tax Law allows the bills to be sent to the coded
agencies . This is will have to be reviewed in upcoming years with
the County so that this problem is not created .
Councilman Liguori asked how a property owner knows they have an
escrow agent , how much the bill is . and the amount ?
Mrs . Noteboom responded that at the time a homeowner closes on a
mortgage they sign an agreement at that time to have their tax bill
sent to the escrow agent .
Attorney Barney said there is a separate form prepared by the State
that directs the taxing entity to a escrow agency . It is paid by
the bank usually on the last day taxes can be paid . It is a little
disturbing , because the taxpayer has no way of knowing whether the .
tax bill is received by the escrow agency or if it has been paid .
Attorney Barney said he recommends to people at closings that they
contact the Tax Collector during February to find out if the bill
is paid . It is not a good system .
Mrs . Noteboom said there was a question at the November meeting
about the election district map . There was an error . The map
presented at the polling places in November showed the district
division one street farther down in District No . 6 and No . 7 . The
map has now been corrected .
Report of Town Committees
Councilwoman Valentino said that information has been received on
the survey for recreation . It seems that most of the people in the
Town of Ithaca favor a combination of part tax dollars and part
user fees for recreation . The also generally favor the task force
work on trying to find a joint program within the Ithaca school
district that would not provide children so much a problem with

going over boundaries to participate . Transportation was also
mentioned as a problem .
Councilman Liguori reported that at the Public Works Committee it
was discussed whether some additional control was needed in the
give away of wood chips . Rich Schoch , Parks Manager suggested the
possibility of selling . It was decided it was not appropriate to
sell them , but more controls were needed particularly to make sure
that contractors who get wood chips are going to use them within
the Town . Some sort of a manifest record will be developed for
this purpose .
Councilman Klein said that included should be that when people
bring in brush to be chipped they check in at the office to ensure
the Town is receiving brush from the Town of Ithaca .
Agenda Item No . 5 - PERSONS TO BE HEARD
Mr . Hieronim. Taraszkiewicz , 719 Hanshaw Road addressed the Board
concerning his previous grievance that the Town Engineer caused
damage concerning a lawsuit he was involved in . Mr . Taraszkiewicz
said he would not rest until this was settled . Mr . Taraszkiewicz
said that he was in court , and that the Court and the Town violated
his constitutional rights because of the Town Engineer . It was not
Town business to go on private property and advise neighbor against
neighbor , giving legal advice without a license . The court said
Mr . Taraszkiewicz was not responsible for this water coming down
the hill , but the court would not let him speak and instead it took
additional letters from the guys who have a conspiracy against him
to extort money . Mr . Taraszkiewicz gave a letter to his attorney
who cooperated with the Town Engineer and everyone else , even after
the trial with a letter to the judge .
This is not proper , even in Russia they do not do things like this .
Mr . Taraszkiewicz said that his attorney implied that maybe he was
liable for it . If he is liable , so maybe is the Town Engineer .
The Town Engineer had no right to be in court to testify against
him .
Attorney Barney told Mr . Taraszkiewicz that this matter has been
before the Town , and the Town Board is not going to do anything
about the matter . Mr . Barney explained to Mr . Taraszkiewicz has
legal recourse through the courts if he chooses . No great profit
will be gained by discussing it again at the Town Bo-ard meeting .
The Town Board made a decision . Attorney Barney apologized that he
had not sent the letter explaining this to Mr . Taraszkiewicz as
instructed .
Attorney Barney told Mr . Taraszkiewicz he would send him a letter

on December 14 , indicating that the Town looked into the matter and
the Town Board feels there is no Town responsibility . If Mr .
Taraszkiewicz differs in that opinion he has legal recourse .
Mr . Taraszkiewicz said the Town Supervisor is also responsible
because she approved of it .
Mr . Barney told Mr . Taraszkiewicz that he has already explained the
Town Board has heard the arguments and has come to the conclusion
there is no Town responsibility . It is a conclusion that seems to
be everyone else ' s opinion who has been involved in this . If Mr .
Taraszkiewicz disagrees he is free to take it up with the courts .
Mr . Taraszkiewicz said if he goes to court he will claim
$ 29000 , 0009009
Attorney Barney told Mr . Taraszkiewicz that anyone can claim
anything they want .
Mr . Taraszkiewicz submitted some documents for reference to the
Town Clerk , ( see attached ) .
Supervisor Raffensperger thanked Mr . Taraszkiewicz for coming .
Agenda Item No . 6 - Town Board Meeting Minutes , 11 / 4 / 93
Motion made 'by Councilman Niklas , seconded by Councilman Liguori
approving the Town Board Meeting minutes as written for 11 / 4 / 93 .
Carried unanimously .
Agenda Item No . 7 - Records Management Disposition Listing
The Town Clerk explained the listing included records from all
departments who are weeding out their files according to the
records disposition schedule .
Motion made by Councilwoman Valentino , seconded by Councilman
Niklas authorizing and directing the Records Management Officer to
dispose of the records as described on the listing according to the
procedure developed by SARA . Carried unanimously .
Agenda Item No . 8 - Water / Sewer Billing Refund
The Supervisor explained a request for a water and sewer billing
refund has been received for an account at 104 Birchwood Drive as
there was a credit because the property changed ownership .

Motion made by Councilman Niklas , seconded by Councilman Liguori
authorizing a refund in the amount of $ 46 . 18 to the owner of the
property at 104 Birchwood Drive . Carried unanimously .
Agenda Item No . 9 - October 1993 Financial Report
Assistant Budget Officer , Sally Alario said that on November 3 the
Town received the final County sales tax for the year of
$ 450 , 426 . 74 . That is up from last quarter by approximately
$ 81 , 000 .
On December 1 . $ 144 , 150 in mortgage tax money was received . This
will put the revenue in the budget for this over by $ 77 . 000 . The
Town received a great deal more than was expected .
Motion made by Councilman Niklas , seconded by Councilman Liguori
adopting the Financial Report for October 1993 as the official
report . Carried unanimously .
Agenda Item No . 10 - Town of Ithaca Warrants
Motion made by Councilman Niklas , seconded by Councilwoman
Valentino authorizing the payment of the vouchers as numbered and
listed on the abstracts . Carried unanimously .
Agenda Item No . 11 - Bolton Point Warrants
Motion made by Supervisor Raffensperger , seconded by Councilman
Niklas authorizing the payment of the vouchers as numbered and
listed on the Bolton Point abstract . Carried unanimously .
Agenda Item No . 21 - 1994 Health Insurance Payment in December
Patricia Punger explained that the renewal of the Town health and
dental policies must be paid in December . Each year the Town has
paid the increase for the employees and retirees in December . The
increase was substantial this year . 21 % for health insurance and
21 . 2 % for dental . To cover the payments is an amount not to exceed
$ 1042 . 00 .
Supervisor Raffensperger explained the Town is paying the increase
in December because salary increases do not take effect until
January . The Town has traditionally paid this increase for the
charges in December .
Motion made by Councilwoman , seconded by Councilman Niklas
authorizing the Town to pay the retirees ' and employees ' portion of
the increase in health and dental insurance premiums for the month

of December 1993 , not to exceed $ 1 , 042 . Carried unanimously .
Agenda Item No . 22 - Floating Holiday Town Employees
Ms . Punger explained two separate votes were taken by the Highway
Department and Town Hall employees . Both voted for Friday . July 1 ,
1994 .
Motion made by Councilman Niklas , seconded by Councilman Klein
approving Friday . July 1 , 1994 as the Floating Holiday for all Town
of Ithaca employees . Carried unanimously .
Agenda Item No . 23 - Job Description Part - time Clerk Typist
Ms . Punger told the Board that this job description is for a
position that was approved in the 1994 budget . It is a part time
position of 20 hours per week . A job description was necessary
with the major duties outlined .
Motion made by Councilwoman Valentino , seconded by Councilman
Niklas approving the job description outlining the duties of the
new part - time Clerk / Typist position . Carried unanimously .
Agenda Item No . 4 - Report Tompkins County Board of Representatives
Beverly Livesay asked if the Town Board may wish to considered
contracting of solid waste hauling for residents . Mr . Collins is
changing his charges and Ms . Livesay is receiving a great number of
calls about this issue .
Supervisor Raffensperger said that she has not received any calls .
Ms . Livesay explained that several of the municipalities provide
for hauling of solid waste . It is doubtful that the County would
be interested in providing this service as they would rather the
Towns consider it . The solid waste division of the County is
preparing research that the Towns could use to how best to approach
this issue .
Supervisor Raffensperger explained that the Town was promised this
material . It has been discussed , but it was not felt there was
enough information .
Mr . Livesay said that the material will be available soon .
Supervisor Raffensperger said that when the Board receives that
material a discussion could be scheduled .

Agenda Item No . 24 - Recruitment Part - time Clerk / Typist
Motion made by Councilman Klein , seconded by Councilman Niklas
authorizing the advertisement and recruitment of a part - time
Clerk / Typist for employment in 1994 . Carried unanimously .
Agenda Item No . 25 - Appointment Conservation Board Recording
Secretary
The Supervisor explained there has been a vacancy in this position
since last spring . A selection committee interviewed candidates .
Ms . Punger said that Karen Moore has been recommended by the
selection committee . Ms . Moore has also agreed to catch up on the
back minutes .
Motion made by Councilman Niklas , seconded by Councilman Liguori
approving the appointment of Karen Moore , as Recording Secretary to
the Conservation Board , effective December 14 , 1993 , on a part - time
basis . Starting salary is $ 9 . 00 hour with benefits limited to the
part - time status of this position . Carried unanimously .
Agenda Item No . 26 - Advertisement for Town Planner
Motion made by Councilman Niklas , seconded by Councilwoman
Valentino authorizing the advertisement and recruitment for a Town
Planner . Carried unanimously .
Supervisor Raffensperger asked for a discussion about a system of
sharing some of the activities and duties with the City or County .
Stuart Stein. and Barbara Blanchard are interested in some
consolidation, of services in the planning area . The Supervisor
suggested the Board may wish to have John Whitcomb contact these
individuals to meet to discuss this with them .
Councilman Niklas suggested that at this time informal meetings
take place because it is presently a vague proposition .
Supervisor Raffensperger told Mr . Stein she would try and get a
sense from the Board if they are interested on pursuing this issue .
Councilman Klein asked if Mr . Stein elaborated on the proposal ?
The Supervisor said that he seemed willing to either consider a
contractual arrangement as in the past which was short term . That
arrangement was additional planning services by the hour . The
Supervisor sensed from Mr . Stein and Ms . Blanchard that they are
looking at a much broader range . Mr . Stein understood that the

Town might be cautious in entering into discussions of real
consolidation of the planning departments . Each local municipality
wishes to retain to itself all of those duties . Mr . Stein said
that would be accommodated in any kind of an arrangement that
developed .
Councilman Niklas asked if there were any formal mechanism in the
past whereby the County , the City , or Town Planners met on a
regular basis to discuss needs .
Supervisor Raffensperger said they met periodically to discuss
mutual planning questions . Mr . Stuart is really looking for some
consolidation .
Councilman Liguori asked if there has been an assessment of how the
Planning Department will function for the next few months without
an appointment of a Town Planner ?
Supervisor Raffensperger said that the Planning Department has been
doing very well , Dan Walker has been coordinating it . That is
something that cannot continue for a long period of time because it
would give Mr . Walker an enormous workload . It takes a while to
get the advertisement out and to receive the applications and
arrange for interviews . It is at least a three to four month
process at best .
It does give the Board time to discuss the possibility of
consolidation .
Councilman Whitcomb recalled the last time a Town Planner position
was advertised the national publications for advertising have
certain deadlines .
Councilman Whitcomb said that informal discussions of the issue
w i t h the C i t y and County would f i t into his plans of discussing
other consolidation issues .
The Board agreed to the informal discussions , and that Councilman
Whitcomb should set them up .
Councilman Klein asked Councilman Liguori as the former County
Planner if he saw a need for consolidation .
Councilman Liguori said that he does see a need because of the
workload and the kind of activities at the Town level compared to
the smaller towns that get periodic service but are not in need for
continual service . Arrangement could be made , how well it worked
is not known .

Supervisor Raffensperger said the previous arrangements started
before to contract for definite services is something that would be
very useful . A total consolidation would have to be investigated
very thoroughly .
Beverly Livesay recalled that the County explored consolidated the
Planning Departments in the 1970 ' s in conjunction of the uses to be
made of Boardman House . At that time , none of the three entities
were really that serious about consolidations . Then it was
considered to combine it into one facility so that there would not
be the redundancy of maps , etcetera . It was not seen as something
where any cf the municipalities would give up any of their
authority to the County . Only sharing facilities and staff .
Councilman Niklas noted the Town Engineer brought this up in the
context of preparing and producing maps , it seems that a fruitful
avenue may be to look at cost sharing mapping services and for
things such as traffic flow studies where boundary lines are
arbitrary and unrealistic .
Councilman Liguori said that you need your own capabilities and it
has been done .
Mr . Walker said that presently the Town has more capability than
the County . One area where shared services are probably
appropriate is a Geographic Information Services , creation of
environmental atlases , and transportation planning . The
development review would have to stay in house . Mr . Walker is
nervous about the Town Planning Board depending on another agency
to provide them with the support needed .
Agenda Item No . 12 - Acceptance Certificate Forest Home Drive
Scenic Road Designation
The Supervisor stated that the Town of Ithaca received notification
from Thomas Jorling , Commissioner of the Departmental Conservation
that they had recommended a road segment of Forest Home Drive in
the Town of Ithaca to the Town of Dryden line as a scenic road .
Mr . Michael Urban , Division of Land and Forest and Mr . Creech ,
Resource Supervisor for Region 7 of the Department of Conservation
presented the certificate to Bruce Brittain for the Forest Home
Improvement Association , and the Town Highway Superintendent for
the Town of Ithaca .
Mr . Creech mentioned that Bruce Brittain did an outstanding job .
The booklet that was presented as a demonstration was wonderful .
Mr . Urban said that this is the first designation of a scenic road

outside of the corridor that runs up and down the Hudson Valley .
The reason this occurred was the hard work of the residents and
interested citizens in that area . This is the first designation in
the finger lakes and the western part of the State . It is
significant that the private Forest Home people , the Town of
Ithaca , the DEC , and Cornell University are involved . It is an
outstanding road .
Mr . Creech said that he was particularly pleased to be involved
because thirty years ago he actually lived on Forest Home Drive .
he hopes that all involved will look forward to help from the
Department of Conservation as time goes on . It is unusual that the
Department of Conservation promotes an incentive program rather
than a regulatory one . On behalf of the Commissioner and himself
Mr . Creech congratulated the Town and the Forest Home Association .
Supervisor Raffensperger thanked Mr . Creech and Mr . Urban for
coming . Supervisor Raffensperger also thanked the residents of
Forest Home for coming on this pleasant occasion . The Town Board
is very appreciative of the hard work the Forest Home Improvement
Association (lid in order to make this possible . The Board is very
proud to have the designation of the Forest Home Drive as a scenic
road .
Supervisor Raffensperger received a letter from Terry Nicholetti
Garrison honoring the designation of the scenic road , ( see
attached ) . The Supervisor asked the Town Clerk to file the letter .
Agenda Item No . 27 - Appointment Jeffrey Scott Dean , Highway
Laborer
Superintendent Noteboom said that eight applicants were interviewed
for this position by the selection committee . The committee has
recommended Jeffrey Scott Dean be the candidate asked to fill the
position . Mr . Dean has accepted the position if appointed .
Motion made by . Councilman Niklas , seconded by Councilwoman
Valentino approving the appointment of Jeffrey Scott Dean as full -
time Highway Laborer effective December 20 , 1993 at $ 6 . 00 per hour .
This appointment is subject to a six - month probationary period with
a salary review at that time . All benefits granted full - time
employment apply . Carried unanimously .
Agenda Item No . 28 - Permanent Employment Status , Planning
Secretary
Ms . Punger mentioned that StarrRae Hays has successfully completed
her six - month probationary period . She is working very hard . It
is recommended. she be given regular employment status with a salary

Agenda Item No . 29 - Authorization Attendance / Prepayment
Association of Towns Meeting
Mrs . Noteboom explained that the Town Officials and Department
Heads who wish to attend the Association of Towns Meeting in
February must pre - register . The fee per person is $ 60 . 00 and must
be paid to the Association of Towns . The Association will then
make the hotel reservations and send confirmation of registration .
The Town Clerk asked the Board to approve the payment of the
registration fees and expenses for those Town officials wishing to
attend .
Motion made by Councilwoman Valentino , seconded by Councilman
Niklas approving the payment for overnight lodging , registration
fees , meals , incidental expenses , and travel for those Town
officials wishing to attend the NYS Association of Towns meeting in
February 1994 .
Agenda Item. No . 31 - Purchase of Services Agreement Youth
Recreation
Supervisor Raffensperger explained this is identical to the ones
the Town has previously had except for the amount of consideration
which is $ 139 , 499 . 00 the amount that was approved in the 1994
budget .
Motion made by Councilwoman Valentino , seconded by Councilman
Niklas approving of the conditions and terms of the Town of
Ithaca / City of Ithaca Purchase of Services Cooperation Agreement
relating to Youth Recreation Services and authorizing the
Supervisor to execute the agreement . Carried unanimously .
Agenda Item No . 31 - Computer and Software Town Justice ' s
Supervisor Raffensperger stated that Justice Wallenbeck has asked
that his computer be updated . The new Town Justice has requested
a computer and software .
Ms . Alario said that Judge Wallenbeck wishes to purchase a new
computer because the one he has now cannot be upgraded .

authorizing and approving the purchase of ( 2 ) computers , a printer
and the related Court Management Software for the Town Justice ' s at

Councilman Whitcomb recommended that another IBM computer not be
purchased since it is not possible to upgrade it .
Agenda Item No . 33 - Snow and Ice Removal Contract Tompkins County
Supervisor Raffensperger recalled that one of the items missing
from the contract previously was an amount .
Attorney Barney explained that the Town has now received from the
County a mileage charge of $ 520 . 10 which has been now included in
paragraph 3 of the contract .
The Highway Superintendent has reviewed the agreement and approves
of the agreement , and that the amount of mileage money is in line
with what it costs the Town .
Motion made by Councilman Niklas , seconded by Councilwoman
Valentino authorizing the Town Supervisor to sign the Snow and Ice
Removal Agreement for the term January 1 , 1994 through December 31 ,
1996 with Tompkins County . Carried unanimously .
Agenda Item No . 13 - Public Hearing , Zoning Map
The Supervisor opened the adjourned Public Hearing at 6 : 45 p . m .
The Town Clerk had proof of posting and publication . The
Supervisor explained the purpose of the Public Hearing is to
consider the Town of Ithaca Zoning Map which incorporates changes
to the zoning; made since 1989 . This is not a change in zoning , it
only places the changes on the map .
The Supervisor asked if any member of the public which to be heard
concerning this issue ? No one came forward to be heard . The
Supervisor closed the Public Hearing at 6 : 47 p . m .
Mr . Walker told the Board there was one area of change on Danby
Road where the Board was concerned the multiple residence was
misaligned . Research was completed and the parcels that are zoned
Multiple Residence are now correct . The Engineering and Planning
Departments now feel the map correctly reflects the changes made to
the zoning since 1989 .
Councilman Niklas said that the correction rectifies the problem as
he had described in previous Public Hearings .
Motion made by Councilman Niklas , seconded by Councilman Liguori

determining the Zoning Map correctly incorporates changes made to
the zoning since 1989 , and that said map shall be used as the
official Zoning Map of the Town until superseded by further action

Agenda Item No . 34 - Memorandum of Understanding . NYSDEC
Mr . Walker explained this memorandum has to be done on a yearly
basis with NYSDEC in order to do stream maintenance , to clean up
gravel , and work on sandbars by the Highway Department .
Councilman Liguori asked if the Town has to get permission from the
DEC each time something is done ?
Mr . Walker said that in an emergency situation the Town can do the
work , however the Town does notify them when any major work is
done .
Motion made by Councilman Niklas . seconded by Councilman Liguori
authorizing the Town Supervisor to execute the Memorandum of
Understanding with the NYS Department of Environmental Conservation
for the period January 1 . 1994 to December 31 , 1994 . Carried
unanimously .,
Agenda Item No . 35 - No Parking Restrictions Maple Avenue &
Mitchell Street
Supervisor Raffensperger mentioned that the Town Board passed a
similar resolution authorizing Cornell Public Safety to enforce the
truck traffic ban in Forest Home . There is continuing difficulty
along Maple Avenue near the recreationway and on Mitchell Street in
front of the Cornell owned student apartments . The no parking
signs are posted but there is problems in getting the Sheriff to
enforce them due to their busy schedule .
Motion made by Councilman Niklas , seconded by Councilman Liguori
requesting that the authorized personnel of the Cornell University
Police Department enforce the " no parking " along Maple Avenue and
Mitchell Street . Carried unanimously .
Agenda Item No . 36 - Route 366 Water Agreement
Supervisor R. affensperger stated that some time ago the Town Board
signed an agreement with Cornell University having to- do with the
extension of water line on Route 3664 There is an agreement with
the Town of Dryden . The Town of Ithaca and the Town of Dryden
signed agreements with Cornell having to do with the water
extension . Cornell seems to have forgotten it is the same water

line so there are items relating to maintenance that are not
consistent in the two agreements . The Town of Dryden is not
pleased and they were to pay Cornell money for the construction and
are not willing to do it until the maintenance question is
clarified . This agreement does this and says that the Town of
Ithaca will own the line and the Town of Dryden will share the
maintenance costs for the next two years . It is a new line and it
is not anticipated there will any kind of substantial difficulty .
The Town of Dryden is not a happy participant in this situation at
the moment . The Town of Ithaca is trying to help solve the
problem .
Councilman Liguori asked what would happen if there were a major
break in the line ?
Supervisor Raffensperger said the Town of Ithaca and Dryden would
share the costs if it were in the next two years . If there were a
major break the Town would discuss it with Cornell because they
hired the contractors .
Mr . Walker said this also benefits the Town of Ithaca because we
can now provide water through the Town of Dryden into the Sapsucker
Woods . It also gives Ithaca additional capacity and reserve .
Discussions are being made as to the ramifications of the overall
system . Another term agreement will come from this within the next
two or three years .
Motion made by Councilman Niklas . seconded by Councilman Klein
authorizing the Town Supervisor to execute the agreement between
the Town of Ithaca and the Town of Dryden for the maintenance of
the water line along Route 366 on a temporary basis . . Carried
unanimously .
Agenda Item No . 37 - Sewer Access Easement 347 Coddington Road
Mr . Walker explained a couple of years ago a sewer line was
installed to service properties on Coddington Road built by Orlando
Iacovelli . At that time the Town asked for an access easement as
it was a back lot sewer along the edge of the property to gain
access for maintenance . Mr . Iacovelli has asked the Town to
abandon the easement . Mr . Iacovelli has provided another easement
to gain access to the sewer from Mrs . Rapponi , 341 Coddington Road
which eliminates the Town ' s need for the easement — through Mr .
Iacovelli ' s land .
Motion made by Councilman Niklas . seconded by Councilwoman
Valentino that the Town Board hereby abandons the easement across

347 CoddingCon Road to obtain access to the sewer , due to the fact
that the Town has obtained an easement across other property which
provides improved access to the sewer line . Carried unanimously .
Agenda Item No . 38 - Change Order # 4 - Inlet Valley Water & Sewer
Mr . Walker presented a summary of a change order for Inlet Valley .
The last several months some work directive changes were ordered to
facilitate the project related to restoration work . The change
orders listed incorporates seven changes for a total contract
change increase by $ 319972 . 50 . All of these changes were
substantial modifications to the original contract . The
compensation to the contractor is warranted .
Motion made by Councilman Liguori approving the Work Directive
Change No . 4 and authorizing the Town Engineer and the Town
Supervisor to execute the same for the Inlet Valley Water and Sewer
Improvements , Contract No . 4 of the 1989 Capital Improvement
Project . Seconded by Councilman Niklas .
Councilman Klein noted that this puts the change orders for this
project at better than 15 % , this is a high range for change orders .
Mr . Walker explained that the two big change orders that pushed the
cost up were the Glenside Road Water Main reconstruction which is
adjacent to the project site . This improved service to an area
already being served . There was also the completion of a link in
the service on Trumansburg Road .
Those were put into the project as there were available funds on
the bonding and were adjacent to the project .
Motion carried unanimously .
Agenda Item No . 14 - Informational Meeting , Capital Improvement
Projects
Supervisor Raffensperger said that the Town Board arranged this
informational meeting for the convenience of the residents on the
plan for capital improvements . The Town Board has information on
the revised plan for the capital projects , ( see attached ) . The
Town Board also received the projection of debt costs for water and
sewer over a number of years so that the Board has knowledge of the
resources available .
Mr . Walker informed the Board and the residents the priorities have
changed over the year because of the completion of Glenside Road
with the replacement of the water main , and the Trumansburg Road
there is a short section of water main that was not completed near

Dubois Road . The Schickel Road spring replacement also has been
completed on an emergency basis .
First Priorities - Rehabilitation Projects :
Danby Road 23ewer - This serves Ithaca College and has had numerous
blockages . Additional capacity is needed due to the growth at
Ithaca College and on the South Hill . The sewer line was put in
place in the 1940 ' s .
East Shore Drive Water Main Rehabilitation - This has been
averaging $ 5 , 000 to $ 10 , 000 per year in repairs for water main
breaks .
Trumansburg Road Water Main - Old cast iron six inch water main
built in the 1930 ' s , is the source of a $ 50 , 000 repair and water
loss billing . This is a critical link because it is the only
supply to the West Hill which has the hospital and Lakeside Nursing
Home . Rehabilitation would be with a 12 inch line .
The Danby Road Sewer and the Trumansburg Road Sewer have been
included in the 1994 budget figures .
Second Priorities - Minor extension and infill projects that have
been suggested by residents requests and petitions .
Coddington Road Sewer - Runs to Burns Road area , and is important
because of the potential contamination of septic systems into the
City reservoir .
Northwest Haven Road Sewer - Infill project .
Trumansburg Road Sewer - Infill project .
Westhill Trunk Sewer - Serves the hospital is a very old clay tile
sewer that has infiltration problems because of poor joints .
Easthill Water Tank and Transmission Main - Placement of tank to
alleviate some serious deficiencies in the Ellis Hollow / Pine Tree
Road / East Hill Plaza area . It is hoped to receive some
contributions from Cornell for this project .
Upgrade East Shore Transmission Main - This would run water from
Bolton Point so that the town can supply the lower areas of the
town by gravity .
South Danby Road Water Pressure Improvement - An extension and

change of the pressure regulating system on East King Road to
provide pressure on Danby Road .
Phase I West Hill Water Improvement - Inclusion of tank to
alleviate shortage in storage . Currently there is a days storage
at the tank on Hayts Road that serves the hospital . If the pump
station at the City line were down it would cause severe problems .
This project would include a new pump station at the City ' s Elm
Street tank to provide a second source of water to the West Hill .
Third Priorities :
Danby Road Sewer - South to complete sewerage all the way to the
town line .
Coddington Road Water Extension - Would bring water out Coddington
Road past Updike Road to the community center , and a water upgrade
on the South Hill distribution improvements . This is an area with
old water mains provide flow problems to fill the tank .
Troy Road Water - South of King Road to Troy Road .
West Hill Water High / Mid Zone - Mid Zone would bring water up to
a new tank that would pressurize a system that is currently
pressurized by a hydromatic pump that does not allow fire flow off
of hydrants on Trumansburg Road . The High Zone would serve
everything off Sheffield Road including the Drew Subdivision .
These were put in the lower priority because of the expense and the
number of people served at this point .
Mr . Walker mentioned that the order of the priorities within
categories is alphabetical and is not listed based upon any
priority .
Mr . Walker pointed out that the Town ' s current payments for
principal and interest on bonds between water and sewer are
approximately $ 1 . 2 million . That figure stays over the million
dollar mark for at least the year 2000 .
Supervisor Rcaffensperger stated that this report was prepared at
the request of the Town Board . The Public Works Committee has
reviewed it a. number of times , and the Town Board has reviewed it
and made some changes . It is understood by the Town Board that
this report is a general map of where the Town needs to go in the
future with water and sewer extensions , that matters of health and
safety in any particular area will mean that the Town Board at the

time will revise these priorities . But the Town Board has never in
the past had any kind of priority listing for water and sewer
projects . The Town Board felt this was necessary to do reasonable
financial planning for the future .
The Supervisor noted that many residents in the audience are
interested in this matter . Although , this is not a public hearing
the Town Board is willing to hear comments from those wishing to .
Salvatore Grippi , 423 East Seneca Street , property on Trumansburg
Road . Mr . Grippi stated his property is within the priority 2
listing and wondered how long is that project in the future ?
Mr . Walker responded that it is projected to be within a five year
time frame .
Mr . Grippi said he has a problem with that because he has been
asking for sewer connections since 1989 and he has always been told
that when development takes place his property would come under
that . The development sounds if someone prefers that new
development has priority rather than the older historic buildings
and the Kyong property . The Kyong property is a doctor ' s office ,
that should be hooked up to sewer . Mr . Grippi ' s property should be
hooked up to sewer because he has two buildings . It is a quarter
of a mile or less to the fire station and they have public
connection . The Town has been developing water and sewer well
beyond Hayts Road to the Ulysses line and you have bypassed this
pocket directly across from the professional building . Mr .
Grippi ' s property is only one half acre and it would be very hard
to replace a septic system if necessary .
Supervisor Raffensperger said it is her understanding that gap in
the sewer service is because at the time the Town anticipated there
would be some development , and the developer had agreed to pay for
the sewer . The development did not take place and the Town is left
with that gal) in the service and the Town is faced with determining
how to pay for it .
Mr . Grippi ' s. property is within the Trumansburg Road Sewer Infill
Project .
Councilman Liguori pointed out that there is an opportunity for the
property Mr . Grippi is discussing are on the downstream end , it is
possible to make an extension to a certain point if there is
agreement between the property owners involved at an e-arlier date .
Mr . Walker said that section would cost approximately $ 200 , 000 to
construct and could be built separate from the remainder .

Jack Ellsworth , 100 Longview Drive addressed the Board . Mr .
Ellsworth said that he is mainly concerned about safety . It is
nice to have water , but that as he understands if there is ever a
fire there would be a problem . Since we have a new fire station
why isn ' t there a tanker there ? About ten years ago the neighbors
watched a house burn down because the City could not find a
hydrant . The Town of Enfield was there with two tankers and set up
the portable tanks , water could not be put on until they were given
a go sign .
Supervisor Raffensperger said that the City of Ithaca has assured
the Town that if they respond to a fire outside of the area served
by sufficient pressure that they will provide a tanker . It may be
that house fire was previous to this agreement .
Councilman Liguori asked if the Town could make an agreement with
the County Fire Coordinator for a larger tanker to be provided if
necessary ?
Supervisor Raffensperger said that the City calls for mutual aid
whenever they feel they need more water storage capacity , the
Town ' s contract with the City states they will call for mutual aid
whenever it is necessary .
Mr . Walker said that they do call , however there may be a short
time lag as the mutual aid is provided by volunteer fire
departments .
Matthew Whittemore , 289 Hayts Road asked the time frame of the West
Hill High Zone ?
Mr . Walker stated that they hope to work within a five year window ,
at this point it is a five to ten year window for its priority .
Mr . Whittemore said that he feels some of the priorities should be
set aside as they have petitioned for water . People have no water ,
salt water , water and sewer are a mile down the road . We pay high
taxes , up 9 . 4 % this year , something needs to be done . There is
nothing as basic as cable , it feels as that area is being left out
of everything .
Supervisor Raffensperger said that there is difficulty in providing
the type of service that is asked for in that area .
Mr . Walker said the area Mr . Whittemore is speaking about is a
relatively short distance but the elevation changes require storage
and pumping stations . To bring it to the high zone would require
two pump stations . Portions of Hayts Road would be within the mid
zone same priority . The problem is that it is not just running a

mile of water main there has to be a 112 million storage tank to
serve the needs . This would be a $ 2 , 000 , 000 .
Mr . Whittemore said that he understands that , but these projects
are being done everyday all over the country . Has anyone contacted
Eastern about putting the tank up there ? Something is needed in
that area .
Mr . Walker said there have been discussions with Eastern , they have
a need for water also . It has been suggested to them that some
form of contribution on their part would help .
Supervisor Raffensperger mentioned that if Eastern moved their
administration building they will have an increased need for water
and will hopefully be more inclined to negotiate with the Town of
Ithaca .
Mr . Whittemore asked the residents have to wait to see what Eastern
is going to do before they can get water ?
The Supervisor responded that the Town does not feel it has the
resources to do a $ 2 , 000 , 000 project to serve that area at this
time . This whole effort has been to be up front and honest about
the resources of the Town and an evaluation of the needs of the
Town and prioritized them . The Board understands that everyone
thinks their house is the first priority . I would too if I had
difficulty with water or sewer . The Board does have a
responsibility to say that the Town has a reasonable amount of
money to spend for water and sewer projects , and for these reasons
this is the priority that will initially accomplish with
flexibility . If there are health and safety problems the Town
Board will have to reevaluate where a project fits into the plan .
Councilman Liguori noticed after looking at the debt chart the Town
has an outstanding indebtedness with $ 1 . 2 million in annual
payments . A $ 2 , 000 , 000 would add significantly to that . The Town
has been very fortunate that those costs are spread out over the
entire Town . Consideration has to be given that the rest of the
residents are, going to be paying for any new projects .
Mr . Whittemore said that the people without water and sewer have
been paying for theirs for years .
Councilman Liguori said that is true but not in a proportional
basis . The residents without water and sewer are paying the
" pennies " .

Supervisor Raffensperger explained that the Town has a townwide
water district and a townwide sewer district . All residents to
whom water or sewer is available pay a benefit charge of $ 78 . 00 or
$ 80 . 00 a yea. r . For those residents who do not have water and sewer
directly available , they pay pennies per thousand of assessed
value . The philosophy of the Townwide District is that whether or
not you actually have water or sewer available , the health and
safety of the whole Town is benefitted by the townwide districts .
If a resident does not have water and sewer available they pay 1 or
2 cents per thousand depending on where the property is . That is
a very small charge .
Mr . Whittemore said he still pays for something he should not pay
for .
Supervisor Raffensperger said it is like the roads , you do not have
to use a road to benefit from it . With the townwide water and
sewer distracts , presumably every resident of the Town benefits
because the health and safety of the residents is protected by the
provision of water and sewer .
Councilman Whitcomb pointed out that a person with a $ 100 , 000 home
not being served by water and sewer would be paying about $ 4 . 00 a
year .
Are the bonds totally paid for by the benefit assessment charges or
are they paid for by general revenues ?
Supervisor Raffensperger said that nothing in water and sewer is
paid for by the general property taxes in the Town of Ithaca . Rate
payers , meter charges for water and sewer may , in some cases pay
for part of the debt . It is not all paid for by the assessment
some of it is paid for by the users of water and sewer . .
Councilman 'Whitcomb said that the Inlet Valley Project was
approximately $ 4 , 000 , 000 and at the time the water and sewer
benefit charge increase was about $ 16 . 00 .
Supervisor Raffensperger said there was a good size reserve in the
sewer budget before the Inlet Valley project and the debt
retirement for it came due to the Town . It is inevitable that the
sewer charges will have to go up in order to pay for the 1989
extension in Inlet Valley unless the Town is fortunate to sell some
of the excess capacity in the Joint Wastewater Treatment Plant .
The fund balance on the sewer monies is being drawn down very
quickly .
Mr . Whittemore asked if the Town still had the petition for the
residents that was presented . We do need water and sewer there .

Supervisor Raffensperger said , " yes " .
Gloria Beam , 286 Hayts Road stated she was in agreement with Mr .
Whittemore . She has two little girls , eight and six . The water
they have is salt water . If the Board had to drink her water they
would think twice about changing the priorities . It is great that
the Town wishes to upgrade some of these systems , but we need a
basic commodity .
Supervisor Raffensperger said that part of the difficulty if the
Town does not do some of the rehabilitation the whole hill may end
up with no water and no possibility of getting it . That is why the
Town thinks that some rehabilitation is such a priority . There is
a whole hill served by a very small , very old water main .
Mr . Walker said that the Comprehensive Plan brought out some issues
of taxing of agricultural land in the Town . That is one of the
questions on the West Hill .
Supervisor Raffensperger said that the Town is not permitted to
charge front: footage benefit charges to any property in an
agricultural district . This means that there would not be very
many units to help for the water and sewer . This is an additional
financial difficulty in some areas .
Councilwoman Leary asked if the Danby Road water priority was to
accommodate the Ithaca College expansion ?
Mr . Walker said that there has been problems on the lines . There
is a new transmission main that was built when the water plant was
built up to Pearsall Place , then the Town relies on . very old
undersized water mains to supply Danby Road . That provides most of
the water to Ithaca College and to the existing residents on the
lower portion of Danby Road .
Councilwoman Leary asked if the Town is asking Ithaca College for
a contribution to that water main ?
Mr . Walker said Ithaca College pays a significant benefit
assessment charge . The Town has flattened the water rates so that
the large water users are paying a proportionately higher share of
the cost . Part of the problem is that Ithaca College has a problem
with filling -the tank owned by them , that tank provides additional
storage for the Town . Ithaca College upgraded their pumping system
two years ago . Now the Town has trouble keeping up with the
College needs .

Supervisor Raffensperger mentioned that while the Town has
flattened the water rate fee for usage , the Town has not yet
flattened tl-te benefit levy . There is a built in advantage of that
to the big users , because the Town raised the rates for the big
users so much to the Bolton Point rate , the Town made a decision
that the Town would have to wait a little while in order to flatten
the benefit levy . That is something which could be considered in
the future to bring in more money .
It could not be done all at once , Ithaca College consumes about one
third of all water in the Town . Once when the water rate increased
substantially Ithaca College cut back their usage so much that the
Town almost didn ' t get any revenue increase . It is a difficult
balancing act . If the Town had to build a tank for Ithaca
College ' s benefit the Town would talk about a contribution from the
college .
Any year that you make a rate increase the Town has to be careful
that the usage does not drop . This past quarter Ithaca College ' s
usage for water was higher than it has been since 1989 .
David Wilson ;, 232 Troy Road about the South Hill extension of Troy
Road . Interest rates are very low at present that should be
another factor the Town should consider in deciding about when they
do projects is the rate to be paid on the borrowing . Since all the
residents would like to get the benefits , you should look at the
rates now compared to what they may be in five years .
These infrastructures are investments and not totally costs . There
will be development which is being encouraged in certain areas . If
the water and sewer is not put in those areas you want the
development }70u will get the development in other areas . It is
very important that all these factors be considered when making a
decision . The sooner things are done the more the residents will
benefit . If in the end it will cost the same because the money is
borrowed in the future at a higher rate years from now this is a
good time to borrow .
Councilman Klein pointed out that the schedule of interest rates
that tax free bonds are fairly stable in their rate . From the mid
1970 ' s until now everything is ranging within 6 % to 8 % range .
These bonds are not as sensitive to the prime rate .
Supervisor Raffensperger stated the last time she received
information on the sale of bonds it looked as if the Town would
save somewhat less than one half percent from when the bonds were
sold in 1990 .
Councilman Nik. las commented that he also does not have public water

and sewer and he lives in the Drew Subdivision . If you wish to
come to his basement there is a chemistry set to deal with sulfur
and sediment . There is not a division line between the people on
the Board and other residents . Mr . Walker has used a number of
criteria to rank these projects . You have to invest in old
infrastructure if you have lines that are fifty years old . It has
to be moved up in the priorities because if that fails , the cost to
the Town would be much greater when it does fail . The other issue
is cost per person . I live in a low density development which
happens to be far away from the heart of the water . If you look at
how much it costs the Town as a whole per person , it is
exceptionally high compared to other areas .
The Town Board is not insensitive to the needs , but the Board has
to have responsibility to the Town to what is best for the Town as
a whole . Even if it hurts people on the Town Board .
Dave Reynolds , 102 Longview Drive said that he does not think
people are aware of the magnitude of the problem he has with the
silt , and glacial dust in the water . Some people can not use their
water . Mr . Reynolds asked how much did the Inlet Valley Project
cost compared to what the upper end of the West Hill would be ?
Mr . Walker said the water and sewer were approximately $ 2 , 000 , 000
each . The reasoning for the Inlet Valley Project is the number of
commercial properties that were identified by the Health Department
as potentiat health hazards . There is a light industrial
development that has been approved this will serve . The Town
picked up approximately 400 residents units initially , and there
are other proposed developments in that area . It was free of the
necessity of storage tanks through additional connections due to
contributions from the City to improve their distribution . That
project was approved in 1989 . Mr . Walker said he was not involved
with the planning of that project , he inherited the implementation .
The Town Board at that time felt the cost and benefit was suitable .
There are a number of governmental facilities that are also being
served .
Mr . Reynolds asked if the upper end of West Hill would have had
more use of that water and sewer .
Supervisor Raffensperger said that part of the reason the project
was done was because in the past when a water and sewer request was
made it was done in isolation . People are always glad to get water
and sewer , s: o the Board was always getting petitions . The
difficulty is that the Town Board was not making difficult choices .
This whole process is an effort to make the difficult choices that

should be made . The Town is trying to prioritized now .
Councilman Niklas stated that very few people who are on the Board
now were on the Board at the time the decision was made . He said
he was sitting in the audience then opposed to it These things
involve history , when the Town Board now was put in place the issue
was master planning knowing what was needed to be done in the
future . Inlet Valley is a complicated situation . At least the
residents now know where they stand . Now the residents at least
have some knowledge of the priorities so that when there are new
Board members that will not necessarily get immediate funding
before these listed items are .
Supervisor Raffensperger interrupted the informational meeting to
open the Public Hearing at 7 : 45 p . m . on the Amendment to the SCLIWC
Agreement relating to the Back - Flow Prevention Program . The
Supervisor postponed the Public Hearing until the conclusion of the
informational meeting .
George Frantz stated that a study was completed on the number of
the dwelling units on the West Hill rural areas beyond the water
and sewer service area extending from the Town of Newfield north to
the Town of Ulysses . In that area there were between 400 and 500
dwelling units .
Councilman Klein said that the Town Engineer was asked to look into
the possibility of creating a separate water system for the Drew
Subdivision . This is not an easy thing to do because the Town ' s
contract with Bolton Point is that when the Town creates water
districts it must get the water from Bolton Point . The cost of
providing the road to Drew Subdivision with its own water system
has many legal implications . No decision has been made and the
figures are extremely tentative . It may be conceivable that if the
health hazardous worsens to the point it is serious , and the Town
gets to the point that it can ' t run the water service up the hill
because of the low amount of units that may be a possibility . The
down side is that the residents within that pocket area served by
a separate system would have to bear the entire cost .
Mr . Whittemore asked if that was fair when the West Hill residents
have been putting money into the system for years with the pennies
assessments on their taxes ?
Councilman Klein responded that it was pointed out that tax rate is
about $ 4 . 00 per year for that .
Mr . Whittemore said that is not the only tax money used , there were
monies for salaries and materials for the staff for years , does
that come out of that ?

Supervisor Raffensperger said that water and sewer planning does
come out of the water and sewer accounts because the Town is
required to do that . The Town in the past has hired engineers to
do water and sewer plans that comes out of the appropriate budget .
That does not mean that the Town Engineer doesn ' t work on water and
sewer , he does . It is true that some of your tax dollars do
support general functions of the Town .
Mr . Fishburne on Compton Road said that the water is three tenths
of a mile from his house , Schickel Road is where it was stopped .
Since 1971 he has put in three petitions for water and they still
have not gotten it . All around the Town and City they have water .
Mr . Walker said that in the priority two listing there is the South
Hill Road pressure improvement project . The problem further out
from where the water ends on Danby Road is that it is right on the
edge of the pressure limit . The Town cannot provide anymore water
to the hill until the pressure is improved . It is possible that
some proposed projects may provide opportunity for developers to
contribute to an extension in that area .
Mr . Fishburne said that his taxes tripled , his assessment went up
three times .
Supervisor Raffensperger said not his Town taxes , your assessment
may have but not the tax rate .
Mr . Fishburne said it seems funny that you see the water at
Schickel Road and they cannot get it .
Supervisor Raffensperger responded that the Town Engineer has
explained it is because of the pressure and the topography .
Mr . Fishburne said that he supposed that Ithaca College , and all
the businesses get it before the residents .
Supervisor Raffensperger said that whether something is a business
or not is not the reason someone gets water or not . I believe the
technical explanation the Town Engineer has given , there are
pressure zones and in order to go beyond those the Town has to
provide additional storage and pumping facilities .
Jane Brewer , 119 Compton Road asked if and when they will ever get
water ?
Supervisor Raffensperger said according to the priority listing
that would be within a five year planning period . This is not a
guarantee , the financial situation of the Town can change , the
needs of the ]' own can change . It is not a guarantee that the Town

Board in five years will be able to do these , but at least the
Board has attempted to prioritized the water and sewer districts .
Mr . Walker clarified that the priority listing is based on Town
funding the full cost of these developments . If a developer were
to come into an area and need to improve the infrastructure to
serve his project the Town may be able to serve other areas between
more economically and within a different time frame .
Mr . Walker said that a gravity system may work on the mid zone
priority to feed the Hayts Road and Trumansburg Road area . The
problem with the West Hill is that things are spread out quite far ,
which create long runs and high costs to get the infrastructure to
areas that need water . We are very aware of the concerns and needs
of the residents .
The Supervisor thanked all the residents for their input and for
coming to express their concerns .
Councilman Klein said that the next step would be to have the Town
Engineer outline the costs and plans for the projects by
priorities .
Attorney Barney stated the Town Board would authorize the Town
Engineer to expend the money to prepare the reports .
Mr . Walker said the portion of the Trumansburg Road and the Danby
Road Sewer are in the 1994 budget . The Danby Road sewer plans are
being prepared now because of the major health concerns there .
Supervisor Raffensperger pointed out that some of the money for
these comes from leftovers from the 1989 project . They could not
be used directly but they can be put into the budget and pay the
interest costs with it . This frees up other budgeted monies from
the interest costs . So when there are leftovers in a capital
project you can use that money for a capital project .
Mr . Walker said the next step for the 1994 work plan is to look at
a more detailed public works plan .
Councilman Liguori mentioned that under the concept of a public
works priority plan the Town Engineer should submit each year to
the Town Board what he recommends for year one of that five years ,
and the projects can be moved up as each is completed .
Motion made by Councilman Liguori , seconded by Councilman Klein
approving in concept the attached Capital Improvement Projects
Planning worksheet for the Town of Ithaca and directing the Town
Engineer the Town Engineer at the beginning of each year to present

as designed „ Councilman Niklas abstained from the vote . Motion

Councilman Whitcomb said he felt that the Town Engineer has done a
good job of prioritized the projects . They all cannot be done next
year . Unfortunately , some of them will have to wait . Mr . Walker
has done they best job he can within the financial resources the
Town has .
Councilwoman Valentino said that for the first time the Town Board
can finally get a handle on the projects that need to be done . She
thanked Mr . Walker saying this has been very helpful .
Agenda Item No . 16 - Public Hearing : Cross Connection Control Law
The Supervisor opened the Public Hearing at 8 : 00 p . m . The Town
Clerk had proof of posting and publication . The Supervisor
postponed the public hearing until the conclusion of the discussion
at hand and the hearing on Agenda Item No . 15 .
Agenda Item No 15 & 19 - Public Hearing , Back - Flow Prevention
Program
The Supervisor reopened the Public Hearing at 8 : 05 p . m . The Town
Clerk had proof of posting and publication . The Supervisor asked
if any persons wished to be heard concerning this issue . No member
of the audience wished to be heard .
The Supervisor closed the Public Hearing at 8 : 06 p . m .
Motion made by Councilman Niklas , seconded by Councilman Liguori
approving the Southern Cayuga Lake Intermunicipal Water Commission
Agreement relating to the Development , Implementation ,
Administration , and Enforcement of a Back - Flow Prevention Program ,
and authorizing the signing of said agreement by the Town Board .
The Supervisor recalled that last year a Public Hearing was held on
this matter , it was postponed because the other members of the
Commission were not able to come to a consensus .
Attorney Barney said that the Town of Lansing had some questions
about the agreement .
Mr . Walker said the agreement gives Bolton Point the authority to

The Supervisor reopened the Public Hearing at 8 : 09 p . m . The
Supervisor then closed the Public Hearing as the Town of Ithaca has
already passed this Local Law ,
Agenda Item No . 39 - Use of South Hill Park , Hunting Season
George Frantz explained that in 1989 when the Town designed the
recreationway one of the conditions was that the trail would be
closed during the deer hunting season . It was closed because of
the residents who had safety for users of the recreationway . This
is the second year the trail has been closed for the hunting
season , but is the first year in the minds of the public that it
was officially opened as 95 % of the construction is completed .
Mr . Frantz said that his interest is to have the western half of
the trail from Juniper Drive back to Hudson Street and Coddington
Road entrances remain open during the hunting season with
conversations with regular trail users who have expressed
disappointment that the entire recreationway is closed .
Mr . Frantz said that he has reviewed Conservation Law regarding the
firing of firearms and showed on a map those areas around the trail
where hunting is allowed .
Councilman Liguori asked if it would be posted so that people will
know where hunting will be occurring ?
Mr . Frantz responded yes , the perimeter has been posted since
hunting is prohibited on the recreationway .
Supervisor Raffensperger said that no one is allowed on the
recreation trail during hunting season as a matter of safety on the
whole trail . Because the Town is concerned with people shooting
over the trail .
Supervisor Raffensperger said the Town Clerk received a phone call
from Wayne Moriello , a hunter who is very upset that the South Hill
Trail enforcement of closure is not done . Mr . Moriello feels that
people other than hunters should not be on the trail during hunting
season as hunters are on adjacent properties , and is in favor of
the trail being closed to all the hunters as long as the no
trespassing laws are enforced .

Councilwoman Valentino said that even hunters are not supposed to
be on the trail .
Mrs . Noteboom explained that Mr . Moriello knows that he is not
supposed to be on the trail , and that he does not hunt on the
trail . His point was that he is afraid when he hunts on adjacent
properties that a stray bullet of hunters may hit someone . He was
very upset that even though the trail is posted he has seen three
people on the trail while he was hunting on adjacent properties .
He told the people he saw the trail was closed and they told him
they were going to use it . Mr . Moriello feels that this puts all
hunters and the Town in a dangerous liability position . Mr .
Moriello said that he will not hunt near the trail in the future
because he is afraid that he may accidentally shoot someone on the
trail .
Supervisor Raffensperger said the Sheriff will enforce it if he is
called .
Councilman Niklas asked Mr . Frantz how many people have requested
a portion of the trail remain open ?
Mr . Frantz responded that approximately a half dozen people .
Councilman Niklas said the issue is to balance how many people want
that small portion of the trail open during hunting season versus
the global liability to the Town if someone is glanced by a stray
bullet , who is responsible . Councilman Niklas said he opposes
opening any portion of the trail because of the risk factor .
Councilwoman Leary asked why we could not ban hunting along the
trail ?
Supervisor Raffensperger said that we do not own the properties
where hunting is allowed adjacent to the trail .
Councilman Whitcomb asked what portions of the trail have been
closed this year ?
Mr . Frantz responded that the whole trail has been closed . Signs
were posted at the City line , as part of the trail is part of the
City ' s wildflower trail . Last year it was decided we could not
post on the City ' s portion .
Supervisor Raffensperger said that when this has been discussed
before she had. told Mr . Frantz that she was very opposed to opening
any part of the trail because any chance of injury is too much , but

because Mr . Frantz had received calls encouraging the use of the
trail I told him it could go to the Town Board for a decision
concerning the risks and new developments .
Mr . Frantz pointed out there is a distinction of the trails from
the woodlands areas . The primary concerns are for people who
would be injured further down the trail . In many areas the trail
is below the level of the surrounding land . One concern of the
hunters is that shooting from a distance with the weight and arch
they have no opportunity to see the trail user . Other areas have
brush , but the trail is visible .
Supervisor Raffensperger opened the public hearing on the Rules and
Regulations of the SCLIWC at 8 : 15 p . m . and postponed the discussion
until the conclusion of the discussion on Agenda Item No . 39 .
Councilwoman Valentino pointed out that the landowner or hunters
with the landowners permission can hunt on adjacent properties , and
they do not always pay attention to posted signs .
Councilman Niklas asked if any member of the Board wished to move
the prepared. resolution opening the trail on the section as
explained by Mr . Frantz ?
Councilman Whitcomb asked if the trail were closed during archery
season or just during hunting season ?
Mr . Frantz said just during regular hunting season .
Supervisor Raffensperger thanked Mr . Frantz for his presentation .
Agenda Item No 20 - Amendments to the Rules and Regulations of the
Southern Cayuga Lake Intermunicipal Water Commission
The Supervisor resumed the Public Hearing at 8 : 20 p . m . The Town
Clerk had proof of posting and publication . The Supervisor asked
for comments from the public , no comments were received . Public
Hearing closed at 8 : 22 p . m .
Attorney Barney explained that the amendments to the Rules and
Regulations goes back to the Cross Connection Control Law that says
under certain circumstances you have to protect the public water
supply from the possibility of being contaminated by another water
supply . The Town adopted the local law and the Town needs to amend
our agreement with SCLIWC to allow them to enforce the Local Law
and then they need to amend their Rules and Regulations to impose
the requirements of the local law . This is the third step in that
process .

Councilwoman Valentino said that on Page 39 where it states the due
date of twenty days does put a burden on lower and income and
family people that are paid bi - weekly or on fixed incomes . Even if
it were 25 (lays it would give people two pay periods to raise the
money . It would be better if it were 40 days . On page 40 , if a
bill is not paid on or before said due date that the service can be
connected within ten days be extended to 20 days .
Attorney Barney said that what is being adopted tonight is not a
change , If the Town says they will not approve it this way and that
we want to revise the rules for these items that have not been
touched with the amendments , it would extend the time periods . It
can be done , but it may be better to adopt the amendments as
presented this evening and then get in touch with SCLIWC so that
they can make the changes Councilwoman Valentino has requested .
Councilwoman Leary mentioned that while the amendments were before
SCLIWC it would make the Councilwoman Valentino ' s points stronger
if the Town did not approve them . If we approve them they may not
go back and look at the requests made .
Attorney Barney said the problem is these are the rules right now
and not approving them would interfere in their ability to enforce
the Back - Flow Prevention Program .
Motion made by Councilman Klein , seconded by Councilman Whitcomb
adopting the Rules and Regulations of the SCLIWC . Carried
unanimously .
Motion made by Councilwoman Valentino , seconded by Councilman
Niklas that the Town Board of the Town of Ithaca hereby requests
that the SCLIWC revise the Billing Period , Page 39 of their Rules
and Regulations , to extend the time under Section VII , No . 2 - a from
twenty days to thirty days , and on Page 40 , No . 4 - b ( second to the
last paragraph ) that " after ten ( 10 ) days written notice to the
customer " , be changed to " after twenty ( 20 ) days written notice to
the customer " . Carried unanimously .
Agenda Item No . 40 - Naming of South Hill Park
Supervisor Raffensperger recalled Mr . Orlando Iacovelli donated to
the Town of Ithaca 3 . 5 acres of land adjacent to the South Hill
Recreationway . At the time he asked the Town to consider naming
the park , which was far in excess of what he was required to give
to the Town , after his father , that is Vincenzo Iacovelli Park .
Motion made by Supervisor Raffensperger , seconded by Councilman
Liguori hereby naming the future park to be developed on the

aforesaid 3 . 5 acres of land Vincenzo Iacovelli Park .
Councilwoman Valentino said that she has a problem with this . It
is her recollection that there is only one thing in the Town of
Ithaca that is named after something . Seeing that the Town has not
designated names on its parks anything that we decide to put a name
on , the Town should take more time in deliberation . There are
people in the community who have put in a lot of time and effort
for the things that have happened which may be more deserving ,
maybe not . Just to have a resolution without more consideration
and an outline of how things should be named should be thought
about .
Councilman Niklas said that both Ithaca College and Cornell
University have standing committees that nominate names for their
buildings . parks , and halls . These are based upon public service .
Supervisor Raffensperger also pointed out that Cornell University
and Ithaca College have named buildings and pieces of land for
donors of the land , and this is precisely what this resolution is .
Councilman Liguori said this is a delicate topic that you do not
discuss at a Town Board meeting until an agreement has been
reached . Has there been an agreement reached ?
Supervisor Raffensperger said the Board discussed it previously
when Mr . Iacovelli was here and when the arrangements were
discussed for the donation of the park and process of the zoning
she did not hear any opposition or she would have discussed it
further . There was public discussion before and there was no
dissent . It is fine that the Board feels it something they wish to
discuss , the point has been made and in the future perhaps a
committee should be delegated to review these issues .
The Board has discussed it previously . the Town has received a deed
to the land . Supervisor Raffensperger encouraged the Board to
support the resolution .
Councilwoman Leary said that this is something the City Council of
New York does all the time . It is harmless enough , but it is a
good idea to :l`iave a general policy for naming things .—

Agenda Item No . 41 - Agreement Quick / Park Lane
Supervisor Raffensperger reminded the Board that this has been
discussed many times . There was an authorization for an agreement
at a previous Town Board meeting , there have been some minor
changes .
Attorney Barney stated the changes were in addition to the roadway
being conveyed there are two easements one of which is already
being utilized for the sewer line and the other easement is the
potential sewer line to come down to the Frandsen property . The
Town agrees to provide a curb cut to Mrs . Quick off the road up
through the area that shows a drainage way on the subdivision map .
Supervisor Raffensperger said the amount to be paid to the Quick ' s
is still in the amount of $ 45 , 000 .
Motion made by Councilman Niklas , seconded by Councilwoman
Valentino authorizing and directing the Town Supervisor to execute
the agreement between the Town of Ithaca and Barbara P . Quick of
1564 Slaterv :ille Road . Carried unanimously .
Attorney Barney mentioned he has already received the title
abstract from Mrs . Quick ' s attorney . We are moving rapidly to
receive title° to the road . Mr . Barney has yet to receive the
. abstract from Mr . Frandsen .
Supervisor Raffensperger said that she is very pleased to solve
this problem with the Quick ' s with such an agreeable solution .
Councilwoman Valentino said she thinks the Town is fortunate that
the Quick ' s have been so patient .
Mr . Earl Thomas said that he was very pleased with the agreement .
The Town is to be congratulated for accomplishing the agreement at
the level of $ 45 , 000 .
Agenda Item No . 42 - Location of Park Lane , Frandsen , Quick
Properties
Supervisor Raffensperger said that she had some reserv-ations about
this coming to the Board in this form . The location of Park Lane
was approved some years ago and she was opposed to it . She is not
happy to see it come before the Board again . She has been advised
by the Town staff , and Attorney it is a necessary step .

Attorney Barney explained that in the subdivision law the Town
Board is the Board authorized to receive public dedications . They
are the Board that determines whether the proposed land is an
appropriate location . It has not been accepted in exactly this
location . This is the same location of the road with an addition
of a stub off of Brian Lane .
Councilman Whitcomb asked if the rest of Brian Drive has been
approved in any form at all ?
Attorney Barney responded , no .
Mr . Walker said this is the acceptance of the location not the
acceptance of the road .
Supervisor Raffensperger withdrew her objections .
Motion made by Councilman Klein , seconded by Councilman Liguori
accepting the location of the proposed roads as shown on the Final
Subdivision Plats for a portion of Park Lane and Brian Drive .
Councilman Whitcomb stated that at the last discussion of this
issue there were people who objected to opening this road , his
understanding; is if the Town doesn ' t open the section of the road
it destroys the agreement reached with the Quick ' s . None of the
Board is happy about opening this road , and if we had been on the
Board ten years ago the road would not exist today . The Town Board
has made the best of a bad situation .
Motion carried unanimously .
Attorney Barney said a segment of the road can be opened , but there
is still the necessity of title with Mr . Frandsen to deal with .
Supervisor Raffensperger said the Town has been doing some
additional drainage work on it .
Mr . Walker said that Brian Drive has preliminary subdivision
approval by the Planning Board .
Mr . Earl Thomas said that he is concerned with the turn around at
the end of Brian Drive .
Mr . Walker said that the one shows the turn around just inside the
general purpose lands with no additional lots within the Town
general purpose lands . It is a hammer head turn around . not a
circle .
Mr . Thomas asked if it is considered to be essentially approved as

of now .
Mr . Walker said there was a preliminary Planning Board approval of
the plat that generally implies a substantive acceptance by the
Planning Board .
Supervisor R. affensperger did not believe that at the time it was
done the Town had the system of the Town Board approving the
locations . The Planning Board did .
Mr . Thomas is concerned again , that part of the park is being given
away , could there be some sort of compromise such as to have half
on the park land and half on Mr . Frandsen ' s land , or go back to the
circular drawing he may prefer with half in the park and half in
his .
Mr . Walker said that possibility exists , Mr . Frandsen has not
returned to the Board with a request for final subdivision approval
which permits opportunity to modify it with his concurrence .
Mr . Thomas said the farther Brian Drive encroaches on the park the
more damage it does to the wilderness nature of the park .
Councilwoman Valentino said that when the Board talked with the
Eastern Heights people one of the things that was brought up was
taking the pu. blic purpose land and designating it as a park . What
would be the procedure for doing that ?
Supervisor Raffensperger said there would have to be a resolution
to do that .
Attorney Barney said there is some reluctance on his part to
recommend that until this entire Park Lane matter is concluded
successfully .
Agenda Item No . Additional 1 . - Waiver Water Supply Schickel Water
District
Attorney Barney explained this is the water district which provoked
concern when the water supply was cited by the Health Department .
This resulted in the extension of the water line to the area .
When this lot was originally conveyed to the Town of Ithaca it was
conveyed for the right to use it for supply purposes . It contained
in the deed a reverter that at such time as the Town ceased using
it as such it would revert to the owner of the property . Since the
Town has now extended public water , the reverter would be self
actuated . However , the Attorney for the bank that is financing the
construction of a building on the lot would like to have the record

cleared that the Town would not be making any claim .
The staff is willing to ask the Town Board to take that action . it
is also viewed as the opportunity to extract from the owner of the
lot the ability to maintain the water and sewer line , and an
agreement that the Town would not have to supply water to the lot
because there is a pressure problem . If the Town were obliged to
provide water it could be a significant expense . This resolution
authorizes the Town Supervisor to execute a quit claim deed
surrendering the Towns rights to the water lot . but including a
disclaimer that the owner will not make a claim for water service .
Motion made by Councilman Liguori seconded by Councilman Niklas
authorizing the Town Supervisor to execute a quitclaim deed
quitclaiming any rights the Town may have in and to the title to
said lot provided that such deed is executed by the grantee and
contains the grantee ' s agreement relating to waiving any right the
grantee may have to having the Town supply water to said lot

Agenda Item No . Additional 2 Request for Reduction of Speed Limit ,
96B
Supervisor Ra. ffensperger said that we have received a letter from
the NYSDOT that the State had denied the request from Ithaca
College for the 40 mph speed limit on Route 96B . It was left on
the agenda because it was originally thought the Town Board should
send a resolution saying they should reconsider . That is usually
not very effective with DOT .
Would it be wiser to wait until preliminary subdivision approval
has been given to the Ithacare complex which will add a
considerable number of people to area and would be a good excuse to
ask for the reduction ?
The Board agreed to that plan . The Supervisor will inform Ithaca
College of the Board ' s intentions .
Agenda Item No . Additional 3 - Planimetric Digital File Agreement
Attorney Barney said that he feels the Town of Ithaca should have
the right to modify the software and recommended an amendment to
that effect .
Mr . Walker explained the purpose in his report for this agreement

Niklas authorizing the Town Supervisor to enter into an agreement
with the County . City . Cornell , and NYSEG for the control use and

Resolution No . 357
WHEREAS , the due and payable date specified in the Southern
Cayuga Lake Intermunicipal Water Commission Rules and Regulations
on Page 39 and the Partial Billing Periods on Page 40 , make it
difficult for some residents to pay their water and sewer bill in
a timely manner to avoid interest and penalty charges on their
water and :sewer bill ; and
WHEREAS , the Town of Ithaca Town Board wishes to have the
billing periods for water and sewer bills " user friendly " to
residents of the Town ; now therefore be it
RESOLVED , that the Town Board of the Town of Ithaca hereby
requests that the Southern Cayuga Lake Intermunicipal Water
Commission revise the Billing Period , Page 39 of their Rules and
Regulations , to extend the time under Section VII , No . 2 - a from
twenty days to thirty days , and on Page 40 , No . 4 - b ( second to the
last paragraph ) that " after ten ( 10 ) days written notice to the
customer " , be changed to " after twenty ( 20 ) days written notice to
the customer " .
