Mr. Engman reported that Mr. Lane had sent a letter asking if the Town could send someone to
the County Legislature meetings to update them on Town business. Ms. Terwilliger will renew
the list on the cover of the correspondence list for members to sign up for a meeting,
Mr. Engman noted that there are two meetings in one week; the study session on September 28th
and the Budget Meeting on Thursday, October I". He asked if the board would like to combine
the two and if so, which day should the combined meeting be held. The board decided to
combine the meetings and hold it on Monday, September 28th at 4:30 p.m. held in the
Boardroom.

Be It Resolved that the Ithaca Town Board will hold a meeting beginning at 4:30 p.m. at the
Town Hall, 215 North Tioga Street, Ithaca, New York on the 28"' day of September, 2015 at
which time a public hearing will be held to allow for public comments on the following topics:
1. 2016 Assessment Rolls for Special Benefit Districts and Special Benefit Areas
2. Amending the Southern Cayuga Lake Intermunicipal Water Commission Agreement
Increasing Water Rate Charges Effective January 1, 2016

5. Discuss and consider a resolution opposing the repowering of the Cayuga Power Plant
with natural gas and supporting Auburn Transmission upgrades
TB Resolution 2015—093: Opposing the Repowering of Cayuga Power Plant with Natural
Gas (12-E-0577) and Supporting Auburn Transmission Upgrades (13-T-0235)
Whereas in January 2013 the Public Service Commission (PSC) began a proceeding (12-E-0577)
to analyze repowering the Cayuga Power Plant as an alternative to Auburn transmission system
upgrades; and
Whereas the PSC has announced a public comment period ending August 24,2015 regarding the
merits of Cayuga's February 61h revised repowering proposal versus New York State Electric and
Gas' (NYSEG's) February 6'h proposal for transmission line upgrades in Auburn; and
Whereas Cayuga proposes to convert the 60-year-old, 300 megawatt plant to use natural gas fuel
on both operating units, while retaining the ability to burn coal on one operating unit, and the
conversion will cost NYSEG customers$49.5 million for construction, plus$9.6 million per year
for ten years to subsidize the plant's operation (total $145 million)'; and
Whereas NYSEG's proposal for Auburn transmission upgrades, considered at PSC 13-T-0235
for a certificate of environmental compatibility and public need, will cost approximately$55
million and it is the sworn testimony of the Department of Public Service's Power Systems
Operations Specialist that Auburn transmission upgrades will be needed by 2020 regardless of
whether the Cayuga Plant is repowered3; and
Whereas if the Cayuga plant is repowered, 30 workers will lose their jobs, 30 will be retained
and the plant will continue to pay property taxes; and if the transmission upgrades are made and
the plant closes, 60 plant workers will lose their jobs4 and$1.8 million in property tax revenue
will be lost; and
Whereas if the State keeps fossil-fuel burning power plants open because closing them will
impact the economies of the communities in which the plants reside, the State's energy policy
cannot advance; and
Whereas it is the overwhelming consensus of the scientific community that climate change is a

result of fossil fuel combustion and other human activities, and that it poses a serious threat to
human and natural systems that calls for immediate actions to curtail greenhouse gas emissions;
and
Whereas continued fossil fuel burning at the Cayuga Power Plant is contrary to the State's
commitment to Reform the Energy Vision by promoting development of distributed power
generation, demand response, microgrids and energy efficiency, with stated goals including
reducing greenhouse gas emissions and the costs of electricity; and
Whereas the PSC notes that one of the major expenses of our current electric system is for
maintaining idle power plants that are utilized for only a few hundred hours of peak demand time
per year- as is proposed for the Cayuga plant -but now technological developments have made
alternative methods of managing and satisfying demand more feasible and less costly 5; and
Whereas NYSEG has nominated Tompkins County for demonstration projects that would enable
the area to be early adopters of such newer technologies6, and has proposed working with the
State to develop REV initiatives to ease the transition for the Lansing economy;7 and
Whereas in the final legislation of the 2015 legislative session a budget provision was made to
establish a fund to support the local tax base upon closing of a power plant and$19 million was
appropriated to that fund; now therefore be it
Resolved that the Ithaca Town Board opposes the repowering of Cayuga Power Plant to burn
fossil fuels (12-E-0577), and supports the proposal for all necessary and environmentally
compatible transmission upgrades (13-T-0235); and be it further
Resolved that the Ithaca Town Board calls on the Governor to provide support for job training
for the plant workers and financial support for Tompkins County, the Town of Lansing and the
Lansing School District to mitigate the tax impact losing the plant will have on the community;
and be it further
Resolved that the Ithaca Town Board asks the PSC to ensure that NYSEG timely details the
development of projects in Lansing that fit within the scope of REV and will support the local
economy; and be it further
Resolved that the Town Clerk will send a certified copy of this resolution to:

7. Discuss and consider a Declaration of Termination of a Pedestrian Trail and Play Area
easement associated with the Holly Creek Development.
Ms. Brock explained that this easement was a condition for approval for a development that
never happened and the wording in the condition makes it necessary for board approval to
rescind it.
TB Resolution No.2015 -094: Approval of Termination of Prior Declaration of Pedestrian
Trail and Play Area Easements and Covenants for Prior Holly Creek Subdivision and
Authorization for the Town Supervisor to Sign Termination Document
Whereas, a certain "Declaration of Pedestrian Trail and Play Area Easements and Covenants" was
previously filed in the Tompkins County Clerk's Office on August 2, 2004, as Instrument Number
458431-004(the"Declaration"); and
Whereas, the proposed trail, play area, pedestrian bridge access and pedestrian easement were
intended to be part of a subdivision approved by the Town of Ithaca(the "Town") Planning Board
as reflected on the approved Subdivision Map entitled "Holly Creek Subdivision Site Plan", dated
December 31, 2003, which map was filed in the Tompkins County Clerk's Office on August 2,
2004,as Instrument Number 458431-005 (the"Former Plat"); and
Whereas, the subdivision was never developed, a different approved subdivision has been
developed in this location, and the trail, play area, pedestrian bridge and pedestrian easement do
not actually or physically exist and are not required elements of the current approved subdivision;
and
Whereas, the Declaration states that its termination requires the approval of(a) the owners of at
least 75% of lots 1 through 8 as shown on the Former Plat, (b) the developer of the subdivision
shown on the Former Plat, if the developer owns any approved or contemplated lot in the
subdivision, and(c)the Town of Ithaca Town Board; and
Whereas, Holly Creek Townhomes, LLC and Ithaca Neighborhood Housing Services, Inc.
(collectively Owners) own the land that encompasses lots 1, 3, 4, 5, 6 and 7 on the Former Plat;
and
Whereas, Owners own 75% of lots 1-8 as shown on the Former Plat and execute this termination
for the purpose of verifying their respective consents to the termination of the Declaration; and
Whereas, David C. Auble was the developer of the subdivision shown on the Former Plat and will
execute this termination in that capacity, and Owners likewise will execute this termination in their
capacities as developer, to the extent that they can be considered a developer within the terms of

the Declaration; and
Whereas,the Ithaca Town Board's approval of this termination is not subject to permissive
referendum,because the Town does not own a property interest in the play area or trail shown on
the Former Plat for the following reasons: the easements and rights were granted to the owners
and residents of lots shown on the Former Plat, not to the Town; the Declaration does not grant
the public any rights; no land was ever developed into a park, trail or pedestrian bridge; the
subdivision shown on the Former Plat was never developed; a different approved subdivision has
been developed in this location and the trail,play area,pedestrian bridge and pedestrian easement
are not required elements of the current approved subdivision; the Town Board has not formally
accepted the play area or trail shown on the Former Plat; and pursuant to Town Law Section
279(4), any park shown on a filed or recorded plat shall be deemed to be private until such time
as it has been formally accepted by a Town Board resolution; and
Whereas, pursuant to the New York State Environmental Quality Review Act("SEQRA") and
its implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board
that its approval of the termination of said Declaration is a Type II action because it constitutes
"routine or continuing agency administration and management, not including new programs or
major reordering of priorities that may affect the environment," and thus said approval is not
subject to review under SEQRA; now therefore,be it
Resolved,that the Town Board does hereby approve, and authorizes the Town Supervisor to
sign, the attached Termination of Prior Declaration of Pedestrian Trail and Play Area Easements
and Covenants, subject to the approval of the Attorney for the Town.

8. Discuss and consider resolution of Support for the New York Health Act,A.5062/S.3525
Mr. Engman moved the resolution stating that this basically endorses the single-payer approach
to health care. Mr. DePaolo commented that a lot of these resolutions of support that the board
considers are pretty easy to determine whether or not we are echoing the voice of our
constituents, but he was not so sure that the majority of the people in the town of Ithaca favor a
single-payer health care. He wondered to what extent we use this platform for our own
individual views versus trying to reflect the will of our constituents, many of whom probably do
support this but we don't really know. Mr. Engman responded that it is a legitimate point, but
his thought is that sometimes we provide a reflection of what our constituents want and
sometimes we provide a little bit of leadership hoping to raise the issue and find out what people
really do think if they are interested enough to make comments to us on the issue raised. It is
sometimes hard to tell.
TB Resolution 2015 -095: Support for the New York Health Act,A. 5062(Gottfried)
/S.3525 (Perkins)

Whereas the Town of Ithaca believes that controlling health-care costs and ensuring health care
for all residents are both of paramount importance and
Whereas the simplest approach to generating savings, reducing fraud and paying claims is to
move directly from the current multiple-payer approach with its high costs of administration to a
single-payer approach to health-care coverage where the government is the insurer and
Whereas the New York Health Act will replace the current multi-payer system with a single-
billing system will be publicly financed by progressively-graduated assessments collected by the
State and based on ability to pay and will pool all health revenue sources into a dedicated New
York Health Trust Fund and
Whereas the New York Health Act will establish a comprehensive universal health insurance
program for all New Yorkers with access to medical services and providers of their choice,
remove financial barriers to health care, expand provider network to ensure continuity of care
and
Whereas according to the April 2015 Economic Analysis of the New York Health Act report by
Gerald Friedman, Professor Chair of the Department of Economics at the University of
Massachusetts at Amherst, the New York Health Act would provide a net savings of over$45
billion in the first year alone after program improvements and expansions of$25 billion (e.g. for
increased utilization due to universal coverage, expanded and more comprehensive health
benefits, increased Medicaid and Medicare reimbursement) and, in addition, —98% of New
Yorkers will pay less than they do now for access to health care if a progressive financing
mechanism such as the one proposed in the recent economic analysis of the New York Health
Act is adopted and
Whereas the New York Health Act will eliminate the local share of Medicaid, a financial burden
that drives up local property taxes, now therefore be it
Resolved that the Town of Ithaca strongly supports adoption of the New York Health Act, A.
5062 (Gottfried)/S.3525 (Perkins) and be it further
RESOLVED that the Town of Ithaca urges the New York State legislature and the Governor to
pass this bill into law and take the opportunity to accomplish this major and long-needed reform
and be it further
Resolved that the Town Clerk send copies or this resolution to; Governor Andrew Cuomo,
Senators John Flanagan,Jeffrey Klein, Kemp Hannon, Andrea Stewart-Cousins,James Seward,
Michael Nozzolio, and Tom O'Mara, and Assemblyman Carl Heastie and Richard Gottfried, and
Assemblywoman Barbara Lifton.

9. Discuss and consider Proclamation of Climate Offset Week

Mr. Engman noted that this is a proclamation and he established it as a proclamation because 1)
this again is just to be supportive of a local attempt to be supportive of reducing climate impacts
but he didn't want it to be something that the town board was promising that the Town would
purchase carbon offsets and he didn't think anyone wanted to be personally liable for them either
so he proposed it as a supervisor's proclamation to define it a s a proclamation and be clear that
it is not holding the town of members to any commitment. Therefore, there is no action and he
was simply reporting this proclamation. The Board had no comments or concerns.
10. Presentation by Superintendent of Highway—Equipment and Machinery Report
Mr. Weber reviewed his spreadsheets and reports pursuant to New York State Law. Mr.
Goodman commented that he would like hybrid options to be considered whenever possible.
11.Acknowledge Receipt of the 2014 Town Justice Courts Audit
TB Resolution 2015 -096: Acknowledge Receipt of the Independent Audit Report of the
Town of Ithaca Justice Courts Funds.
Whereas, in accordance with the Uniform Justice Court Act, the Town Justice Courts provided
their court records and dockets for examination to the Town, and
Whereas, Sciarabba Walker and Company, LLP conducted an examination of Year Ending 2014
as prescribed and submitted their summary to the Town.
Therefore Be It
Resolved,that the Town Board acknowledges receipt of said report and will forward said report
to the Court Clerks for submission to the New York State Office of Court Administration as
required.

12.Acknowledge Receipt of SCLIWC's 2014 Independent Audit—Bolton Point
Mr. Engman reported that the Comptroller's Office stated that this is a Positive Audit, which
means they found nothing to complain about which is extremely rare. They were astonished that
five municipalities could work together the way we do without making mistakes. There were no
mistakes anywhere. The two inspectors with over 20 years between them could only remember
four others and the official report commends SCLIWC for their operation. He added that Bolton
Point will be sending out a press release because it is unfortunate that the Comptrollers' Office
doesn't advertise the positive results and this is something we should all be proud of.

TB Resolution 2015 - 097: Acknowledge Receipt of the Independent Financial Statements
of the Southern Cayuga Lake Intermunicipal Water Commission for the Year Ending 2014
Whereas Sciarabba Walker& Co., LLP has conducted an audit of the year ending 2014 financial
records of the Southern Cayuga Lake Intermunicipal Water Commission (SCLIWC) and
submitted their report of findings, now therefore be it
Resolved, that the Town Board hereby acknowledges receipt of the certified Financial
Statements from Sciarabba Walker, Co. LLP for SCLIWC.

13. Discuss allowing an antennae for Clarity Connect on the Sapsucker Woods Tank
Mr. Engman recapped stating that the old tank is coming down and the new tank going up and
Clarity Connect would like to move their antennae to the new tank with no charge. The antenna
currently serves about 8 people with the possibility of 8 or so more having the option to use
Clarity Connect if the new antennae goes up. They say they can't afford to pay anything for the
location. The question before the board is whether to allow the antennae for free in exchange for
the service to the residents since we are not allowed to give anything free to a private party and
whether providing access to internet service to our residents is enough of a public good to let this
be put up for nothing.
Mr. Howe would like a timeframe for the use of the location and reevaluate. Mr. Goodman
asked if they are or have paid anything for the current antennae and Ms. Brock responded that
they have not; a contract or agreement was supposed to be done but never was. Mr. Goodman
was skeptical about giving it to him for free and he was not in favor of it. Mr. Levine felt that we
weren't turning away a provider that was willing to pay in favor of Clarity Connect and so many
people have a problem getting service that it is something we should do and it is not using any
town resources. Mr. DePaolo said that he does not believe the antennae is a money maker for
Clarity Connect and he would be just as happy not to put it up but he did ask Mr. Weber what
would happen if the antennae caused an issue or damage to the tower and who would be
responsible. Mr. Weber responded that the new tanks will have attachment places to protect
against that and he assumes that would be in the agreement.
TB Resolution 2015 - 098: Approval of Transfer of Antenna System to the New Sapsucker
Woods Road Water Tank.
Whereas Clarity Connect, a telecommunications vendor, has approached the Town regarding
transferring an antenna system on the current Sapsucker Woods Road water tank to the newly
constructed water tank on the same site and
Whereas Clarity Connect provides service to a few, approximately 8, residences of the Town
where reception is poor in the West Hill area and

Whereas Clarity Connect has received a grant to expand service in the underserved rural areas of
Tomkins County and
Whereas, the co-location on the Sapsucker Woods Road water tank will meet some requirements
of the grant and
Whereas the Town Board supports moving forward with the process of negotiating a lease
agreement with a one-dollar per year fee in recognition of the service provided to a small number
of Town residents, now therefore be it
Resolved that the Town Board of the Town of Ithaca does hereby support the co-location of an

14. Discuss and consider authorization for the Town Supervisor to sign a revised agreement
for the Pine Tree Road Bike and Pedestrian Trail Project
There is one place where the totals do not match and each signatory will need to initial the
correction. It is an obvious typographical error. Ms. Brock also noted the change in terminology
regarding Cornell's responsibilities for utilities; it used to read "Cornell owned utilities within
the ROW of the trail built by this project, including those carried by the bridge" and now reads
"built by Cornell" and Mr. Weber stated that it was his understanding that Cornell was asked to
do some of the work on their own account to reduce costs of the project and so the statement
makes sense.
TB Resolution 2015 -099: Authorization for the Town Supervisor to Sign a Revised
Agreement with Tompkins County and Cornell University for the Pine Tree Road Bike and
Pedestrian Trail Project
Whereas on June 10, 2013, the Town Board passed TB Resolution No. 2013-088, which detailed
the need for and history of the Pine Tree Road Bike and Pedestrian Trail Project, approved a
proposed agreement with Tompkins County and Cornell University for the Project, and
authorized the Town Supervisor to execute the agreement, and
Whereas on April 7, 2014, the Town Board passed TB Resolution No. 2014-057, which
authorized the Town Supervisor to sign a revised agreement pending changes to the dates and
schedule listed in the agreement for the project, and
Whereas on February 9, 2015, Town Supervisor, Herb Engman, informed the Town Board that
due to redesigns for the walkway and retaining wall a $400,000 shortfall was created and

Tompkins County had approached both Cornell and the Town of Ithaca about increasing their
contributions, and
Whereas the Town Board agreed to move forward with discussions about increasing the Town's
payment by$35,000, for a total Town payment of$70,000, and
Whereas, the revised agreement includes a total Town payment of$70,000, and increased
payments by Cornell and Tompkins County, with the increases by the three entities making up
the approximately$400,000 shortfall, now therefore be it
Resolved that the Town Board does hereby approve, and authorizes the Town Supervisor to sign,
the revised agreement on behalf of the Town for the Pine Tree Road Bike and Pedestrian Trail
Project,subject to the approval of the Attorney for the Town.

15. Consider award of contract for Front House Renovation project
Mr. Engman reported that the bids came back over budget and there was a procedural error in the
document specifications. The bid specifications will be redone with additional items broken out
for clarity of cost and the required State requirement under WICKS law.
Mr. DePaolo requested that future titles on agendas and public documents make it clearer what
the project is. Ms. Terwilliger will make sure that happens.
TB Resolution 2015 - 100: Authorization to reiect all bids for the Town Hall renovation of
the front offices and service areas and rebid with clarifications.
Whereas the Front of House Renovation Project bid results were higher than expected and it has
been determined that additional clarification of the project in the bid specifications may affect
the bid amounts, now therefore be it
Resolved that this board rejects all bids submitted on Friday, September 11, 2015 and authorizes
the rebidding process with additional clarifications to the bid documents.

17. Report of Town Officials
a. Discuss Post Office Lease—Mr. Fngman reported that Mr. Solvig noticed that the lease
expires in 2019 and although that sounds like a long time away, the Post Office hierarchy
moves very, very slowly and we should begin early to find out what their intent is and decide
what we want out of a lease and what they want. He suggested a small subcommittee; Mike
Solvig, Rod Howe and Bill Goodman agreed to be on the subcommittee.
b. Mr. Weber reported that all items sent to auction did sell for a little more than we expected
for a net gain of about $142K.
c. Ms. Drake reported that the Health Consortium is considering a reduced percentage of
increase.
d. Ms. Ritter reported that the stakeholder meetings regarding the Route 96B study have been
completed and were considered successful. The recommendations and report should be out
fairly soon.
18. Report of Town Committees
a. Codes and Ordinances— Draft Sign Law— Mr. Goodman reported that the draft law will
be sent to board members with a cover memo of the major changes and some of the issues

that have to be decided at the full board level and then moved on to the other boards and
committees for comments.
19. Review of Correspondence
a. Mr. Goodman asked about a petition asking for a sidewalk around Clover Lane and
Mitchell street. The board and Ms. Terwilliger were not aware of the petition and Ms. Ritter
will also look at it in case it is covered by the Belle Sherman project going on.
