HomeMy WebLinkAboutTB Minutes 1992-10-19 Town of Ithaca Special Town Board Meeting Minutes October 19, 1992 At a special meeting of the Town Board of the Town of Ithaca, Tompkins County, New York, held at the Women ' s Community Building, 100 West Seneca Street, Ithaca, New York, there were : PRESENT: Shirley A. Call to Order: Meeting was called to order at 7 : 40 p. m. Town Board Mtg. Minutes 2 10/19/92 Petitioner: Noel Desch Air. Desch requested that the Town Attorney, John Barney quote the section of the law which requires the ranking system to be included in the Open Space Index. Mr. Barney responded that 239X of the General Municipal Law spells out the requirements, including the establishment of a Conservation Advisory Council . The law states, "It shall keep an inventory and map as defined in Section 239Y" . 239Y defines this as conservation open areas an inventory of open areas within the municipality, with each such areas identified, described, and listed according to priority of acquisition or preservation. There was some discussion about not making the list at all , and the definition compelled the decision to attempt a listing defining the Conservation Open Areas Inventory. Mr. Desch responded that the Town Board has the task of identifying what the minimum is to create an acceptable index . Does this mean that Map No. 1 is the map that is required under 239Y? Councilman Whitcomb stated the intent with the series of maps was to meet the " spirit" of the law, and the maps in conjunction with the Open Space tally, ( folded sheets middle report) comprised the index as directed by the Town Board. Earlier this year the CAC went to the Town Board after a public hearing showed the designation of 32 top areas for preservation is not acceptable to the townspeople . They asked The Town Board what was acceptable as far as meeting the requirements of the law for an Open Space Index. Candace Cornell , CAC Member stated the first map is to show how the Town was divided into open areas, it has nothing to do with the tallies . Mr. Desch mentioned there is still confusion within the document because on the cover it talks about the Open Space Inventory, Map, and Proposed Open Space Index Tally. Before this document can be accepted and effectively used by the various Boards (Planning , CAC) they need to be informed of what the guidelines are . Is it a spread sheet, is it a map? Mr. Desch made specific comments in order for this to be the most objective , accurate , and effective tool to be used for Open Space , On page 22 , where subdivision regulations are mentioned that you limit the commentary to the 10% set aside as required under the sub-division regulations . For example , you can clearly site what has occurred in sub-divisions that have taken place over the past ten years , ( ex. Commonland, Deer Run ) . If a new member of the Town Board Mtg . Minutes 3 10/ 19/92 Planning Board or the CAC looks at this, then it should be clearly stated what has happened in the past. Supervisor Raffensperger asked Mr. Desch if he was suggesting that it should read " that it requires the set aside of 10% , but that in some cases developers set aside more , and some less" . Mr. Desch responded that developers should set aside more , as an example Grandview Park Subdivision explains the issue when you say that in general these pocket parts are too small to protect habitats in environmentally sensitive areas . One could argue that Grandview Park does not protect the environmentally sensitive area. Page 37 , Section 2 , ( Paragraph 2 , third line at the end) talks about the local legislative body, the third line down the last word should be has , instead of as . The top of Page 38 , the second word should be "on" instead of "of" . The last 4B, should be "preparation" . Mr. Desch mentioned a major credibility issue with the spread sheets . On the bottom of page 39 , an asterisk talks about "75% or more of a designated area has the indicated slope classification" . Having gone into that level of detail with respect to slopes, and you not doing it with respect to other levels of categories in the report destroys the usefulness of the report to someone who is looking at it as a tool to determine the more sensitive areas . The same thing is done with wooded areas over five acres . If you do it in those instances and only generalize other criteria, such as , aquatic and terrestrial features, etc . then proceed on by tallying up the number of criteria you identify in the parcel , it is impossible to say whether that parcel has a small area that is in total a sensitive area, or a large area. A member of the respective Board would need a lot of work to determine the intention . Until the atlas is done the report would be much more valuable to simply cut out the tally column at the end, anyone reading the report can add up the numbers . As soon as you have a column that looks like a total, you may be opening the Town up for a legal challenge which is unnecessary for what is trying to be accomplished. There are still a great number of property owners who still consider this a ranking system. Page 57, the top paragraph last sentence . There is a double reference , the assumption is that the words wanted are "altered by human activities" , the words "associated with" should be taken out. Page 58, under active agricultural lands the third sentence should have the word " inactive" taken out. Town Board Mtg . Minutes 4 10/19/92 Page 66 , the reference to infrastructure , the sentence in the middle of the paragraph which starts out " in the future" , on and in should be changed. Mr. Desch emphasized his concern with the tally column, there are so many things generalized that when trying to outline the sensitive items as a highlight it can not be done with the generalization. Staff should shade each area in relation to the tally to see what the relative average is of the number of points that one might expect to be considered as a sensitive parcel . Within the same shading group there are large parcels which have large acreage with eight points and large parcels with small acres which add to the same eight points. If the tally is left intact there will be a hard time defending it. Laura Marks stated the first Open Space Report was designed to follow the State mandates of protection areas . The decision in this report was to protect the features . Ms . Marks told Mr. Desch his shading was inaccurate because the report is not meant to save the parcels, it is meant to make sure that an area before the Planning Board can be tallied to make sure all the environmental sensitive features are accounted for. It is intended to move away from the features and not protect the parcel as a whole . Mr. Desch interjected that if that is the intent there should be a guideline given to the respective boards as a preamble Ms . Cornell stated the report does explain how it should be used, to protect the features and not the parcels . Ms . Cornell mentioned she is a member of the Planning Board, when the Planning board does have an atlas no decision would be made by her until she physically looked at the land , this atlas would strictly be a guide . Mr. Desch stated that is his point, when using the atlas and making an on site visit, you could look a lengthy period of time trying to find that one area, but with a spread sheet that emphasized a larger parcel it can be looked at more carefully. This is what becomes diluted when you put a tally on the end that understates or overstates the sensitivity of that particular parcel . Ms. Cornell mentioned that the maps do give a fairly precise location of the features . The original maps of the ones illustrated in the report . Town Board Mtg . Minutes 5 10/19/92 Mr. Desch suggested that the reader not use the maps within the report but use the original maps these were derived from. Ms . Cornell pointed out that intermittently throughout the report that if someone wishes to build a development they should steer away from the sensitive features. This is what the Planning Board would look at . Mr. Desch asked if the forming of the Conservation Advisory board as stated in the report would require a local law. He requested that a Public Hearing be held at the appropriate time if that is the case . Councilman Niklas asked about the point Mr. Desch made regarding Page 39 . Councilman Niklas asked if he was asking the CAC to distinguish between qualitative and quantitative features on the tally sheets, and was suggesting that all the qualitative listings be removed? Mr. Desch responded that if at this point to accomplish what you would like to provide , a tool for the CAC and the Planning Board to look at sensitive areas then you do more by taking the tally column out. The tally column when you have a number between one and eleven either understates or overstates the sensitivity of the parcels . It will be misconstrued as a ranking. Councilman Niklas stated that the tally is the sum of the bullets, in each case the bullets are a qualitative presence or absence feature . Mr. Desch feels it becomes troublesome when you add it up and make a total because it equates a feature like habitat to something that may be more sensitive such as a steep slope or an erodible soil, which may effect only two percent of the property but when added up it effects the same area as the largest qualitative criteria. Councilman Niklas stated he did not see anywhere within the report that some of the bullets are more important than others . Mr. Desch responded that they are made equally important by adding the tally.
