Town Board Fleeting Minutes
September 8 , 1992
At a regular meeting of the Town Hoard of the Town of Ithaca ,
Tompkins County, New York, held at the Town Mall , 126 E . Seneca
Street, Ithaca, New York, thence were :

Call To Order: Meeting was called to order at 5 : 30 p . m ,
Agenda Item No . 3 - Report of Town Officials
a. Supervisor ' s Report: Preparation of the 1993 Town Budget is
underway. Department Pudget,s have been submitted, casts related to
water , sewer, fire , and other services are not available as yet.
The tentative budget will be available September 30, 1993 and will
be reviewed at the October 5 , 1992 Town Board Meeting . The Public
Hearing will be held November 5 , 1992 , The Supervisor has been
involved with the preparation of the Bolton Paint Budget .
The Supervisor attended a meeting August 31 for elected officials
concerning the newly established Water Quality Board . A meeting
for the general public is to be scheduled within the month .

Water Quality is an important problem which will require careful
definition . There were a lot of questions at the meeting about
duplication, questions about what problems were they addressing .
There were suggestions that they address quality, but no
determination was made as to how. There will at least be a
Southern Cayuga Lake Committee from this meeting as in otter
communities around the Finaerlakes .
b . Engineer ' s Report : fir . Walker reported on his written
presentation to the board , ( copy attached ) . Inlet Valley Phase
11 contract has been awarded, we are waiting on the final
permits and easements to begin working . The crossing of the Inlet
Creep[ with the water line has been delayed because of rain . The
creek can not be crossed after September because of the fisheries,
which may mean postponing this work until next year.
Supervisor Raffensperger asked what, postponement would mean to the
contract? Mr . walker talked to the Contractor and he does not have
a problem with that portion of the work being done next summer. If
that portion could not be completed under this contract, the
contract would be reduced by that amount.
C . High,��ay Superintendent ' s Report : Written report, ( copy
attached ) . The majority of the August work was completion of the
oil and stone program , and the paving program . The Forest Dome
Lower Bridge was closed for a day to complete minor repairs from
damage caused by old age and wear on the end cap . Work will be
started on the Mitchell Street walkway.
The Parks Department completed sealing blacktop walkways in the
Northeast and mowing . They also worked with the YCC on the South
Hill Trail . They will be helping the Highway Department with the
Mitchell Street walkway .
d . Town Building Inspector/ orning Officer ' s Report : Written
report , ( copy attached ) . The total of building permits issued is
slightly higher than last year.
e . Town Planner ' s Repox`t : The Planning Hoard on August 18, dealt
with the GEMS : it was not yet satisfactory in respect to its scope ,
content, and adequacy for this purposes of commencing public review.
September 1 , the Planning Board received a sketch plan from
Hospit:are , they are in the process of purchasing the Chase Pond
site on East King road .

Agenda Item No . 4 - Report of Town Committees
Councilman Whitcomb reported that the Open Space Report, Draft No .
2 will go to the printers tomorrow and will be ready next week.
The CAC has also released the Town of Ithaca Agricultural Report .
A Special Town Board meeting will be held in October as a Public
Informational Meeting to hear comments on the new draft. If it is
satisfactory it will be brought to the Town Board in November for
adoption.
A few weeks ago Councilman Whitcomb had a number of complaints from
residents along King Road about the truck traffic . The Town Board
passed a resolution at the special meeting in August asking the
County to find an alternate route for the heavy truck traffic . The
County responded, and rerouted the loaded vehicles on State
Highways . The empty vehicles are coming back through Michigan
Hollow and Rt. 96 , back to King Road. The residents were informed
of this and felt this was a reasonable compromise . Councilman
Whitcomb has written to Mr. Mobbs of the County to thank him for
his cooperation.
Councilman Niklas reported that the COC will have an informational
meeting September 16 at NCR at 7 : 30 p. m. It has been well
advertised. At the last meeting of COC Councilman Niklas
circulated his version of what the executive summary should be .
The Committee members will return their comments to him no later
than September 14 , when Councilman Niklas will make whatever
modifications he feels would improve the executive summary. Copies
of the final version of the Executive Summary and the most recent
draft ( no . 5 ) will be left at the Public Library, the County
Planning Office, and the Town Hall . Councilman Niklas encouraged
anyone interested, to attend the informational meeting.
Councilman Klein reported the CPC has finally reached a milestone
in having reviewed the last half of the plan, Chapter 4 , 5 , and 6 .
The CPC is meeting on September 9 , to approve the final versions of
Chapters 4 , 5 , and 6 ; so that a public information meeting can be
scheduled for September 29 . The meeting will be widely advertised.
Motion made by Supervisor Raffensperger authorizing two box
advertisements for the CPC public information meeting at a cost not
to exceed $220. 00 . Seconded by Councilman Niklas . Carried
unanimously.
Attorney Barney presented the opinion of the Supreme Court Case ,
South Carolina Coastal Council vs. David H . Lucas, Petitioner;
decided June 29 , 1992 to the Town Board . The owner of beachfront
property brought action alleging the application of South Carolina
Beachfront Management Act to his property constituted a taking
without just compensation .

Agenda Item No. 10 - Setting Public Hearing To Amend Local Law No .
2 , 1976
A Public Hearing needs to be held to adopt a new water rate
schedule for payments of water in the Town . The Supervisor
presented a new schedule which has been approved by the SCLIWC .
The rates for the Town of Ithaca of $ . 10 per thousand of gallons
consumption would remain the increment for the Town and would not
be increased this year. Motion made to set Public Hearing by
Councilman Niklas , seconded by Councilman Whitcomb.
Carried unanimously. ( See attached . )
Bolton Point is trying to estimate what these rates would mean to
revenues . They are hoping it would bring in approximately 14% more
in revenues. Bolton Point has had some difficult years concerning
cash floor. The Supervisor explained the Commission had not raised
the rates for several years, so they were forced to make changes
for two consecutive years . They anticipate next year the
Commission will go to a flat rate . Everyone will pay the same
amount for a gallon of water, allowing each municipality to have a
more simple increment and surcharge system.
Agenda Item No. 11 - Set Public Hearing Amendments to SCLIWC
Agreement
In relation to Agenda Item No . 10 a public hearing needs to be held
to deliberate amendments to the SCLIWC Agreement relating to water
rates . Motion made by Councilman Niklas, seconded by Councilman
Liguori . Carried unanimously. ( See attached. )
Agenda Item No . 12 - Set Public Hearing to Amend Local Law No . 4 of
1992
Motion made by Councilman Niklas, seconded by Councilwoman Leary to
set a Public Hearing to consider amending Local Law No. 4 of 1992
for the purpose of revising ethics rules applicable to the Town of
Ithaca to clarify qualifications for membership on the Ethics
Board. Motion carried unanimously. (See attached. )

Agenda Item No . 13 - Fall Newsletter
Any items for the Newsletter must be submitted by September 15 .
The Newsletter may be sent first class mail because we have had so
much trouble with timely delivery in the past. The timing of the
newsletter is driven by the necessity to give residents information
about the leaf and brush pick-ups . Some budget information will be
included, along with a discussion for placement of mailboxes for
snow plowing. It is hoped to get the newsletter out by September
17 .
Agenda Item No . 14 - NYS Association of Environmental Management
Council Annual Meeting
Every year the NYS Association of Conservation Advisory Council and
Environmental Management Council have their annual meeting . This
year it is in November, at Oneonta, New York. Councilman Whitcomb
requested approval for two people to attend at a cost not to exceed
$225 . 00 each. Motion made by Councilman Whitcomb , seconded by
Councilman Niklas . Carried unanimously.
Agenda Item No . 15 - Town Justice Copier
The Town Justice ' s are in need of a new desktop copier at the Court
House . Motion made by Councilman Niklas authorizing the purchase of
a desktop copier for the Town Justice ' s, seconded by Councilman
Klein . Carried unanimously.
Agenda Item No . 16 - NYS Magistrates Annual Meeting and Conference
Town Justice , Merton Wallenbeck and Court Clerk, Luri Wallenbeck
have requested permission to attend the Magistrates Annual Meeting
to be held at Ellenville , New York on October 19 , 20 , and 21 .
Motion made by Councilman Niklas, seconded by Councilman Whitcomb
authorizing and approving their attendance . Carried unanimously.
Agenda Item No . 17 - Ratification Highway Department Laborer
Superintendent McConnell explained Alvin Howell was hired for S6 . 00
as a laborer after interviewing nine people . Mr. Howell was the
first choice . He was started as soon as possible because of the
vacancy from Art Westmiller ' s retirement and the paving schedule .
The Superintendent requested the ratification and approval of this
position. Motion made by Councilman Liguori , seconded by
Councilman Klein . Carried unanimously.
Agenda Item No. 18 - Costs of Documents Provided to the Public
The Supervisor read a memo explaining the inconsistency of the
availability and cost of documents made available to the public.

The Supervisor wishes to make it clear as to what the policy is for
the staff and the public alike .
The Board discussed the memorandum. The Supervisor explained she
has been troubled by the fact that the Town is setting Public
Information Meetings to solicit comments from the public , and are
charging the public for the draft documents that we are soliciting
comments on .
The Board discussed at length the documents which are not ready to
be given out to the public , but which are discussed at committee
meetings . The Supervisor suggested that the Chairman of each
committee will need to make a determination about loaning the
document during the meeting .
Motion was made by Councilman Niklas adopting the memorandum as
Town policy with the amendment " in reasonable quantities" after "at
no cost" , and the size of "maps larger than 8 1/2" X 11" " be
changed to "8 1 /2 X 17 Seconded by Councilman Whitcomb. Carried
unanimously.
Agenda Item No . 7 - SPCA Contract
Pamela Stonebreaker, Director SPCA; and Stephanie Schaaf , President
of the Board SPCA addressed the Board concerning the Town of Ithaca
contract with the SPCA.
Ms . Stonebreaker explained the services provided to the Town of
Ithaca, and presented graphs which indicated the percentage of
services compared to other municipalities in the area. The graphs
also portrayed the percentage of services for Ithaca compared for
three years.
The SPCA provides two full-time and two part-time animal control
officers . The officers respond to calls concerning strayed,
injured, and viscous dogs . They issue appearance tickets for
violations of the Town ' s Dog Control Ordinance , as well as tickets
for failure to license dogs . The SPCA responds to all citizens
complaints regarding aggressive or destructive dogs.
Prompt impoundment of menacing and homeless dogs by the SPCA
reduces the risk of the spread of rabies . Diligent dog control
will increase the number of dogs vaccinated in the community. The
adult dogs impounded are vaccinated and licensed before they are
released . The SPCA accepts owner surrendered dogs, as well as
strays.

In 1991 the SPCA made 269 trips into the Town of Ithaca, and they
have made 123 trips through July of 1992 . They help the Town raise
revenues to offset the cost of dog control through impoundment
fees, dog licensing fees, and fines paid in response to appearance
tickets. In 1991 , $810 . 00 was raised in impoundment fees , and
approximately $2600. 00 in local license fees. Revenues from the
license fees should rise with the increase of rates adopted by the
Town .
The proposed contract with the Town of Ithaca for 1993 is $15, 370.
The increase in the contract amount is necessary to offset the
costs associated with providing the service . The past few years
have seen a dramatic increase in operating costs such as animal
care and feeding, refuse disposal , gasoline , heating oil,
insurance , and veterinary insurance .
The SPCA has taken many measures to keep expenses in check. In
1992 all personal salaries were frozen at the 1991 level . Which
left three individuals making minimum wage for over one year. They
have considered a layoff of one third of the staff ( 3 people )
Extensive measures have been taken to recycle . Monthly accounting
expenses have been delegated to current staff members or board
members . Strict cost control methods have been instituted on
animal care . The total cuts from the original 1992 budget are
$20,000 .
The SPCA does not wish to make money on dog control , only to have
it pay for itself so that it is not necessary to utilize donations
to cover the costs of services .
Ms. Stonebreaker told the Board the amount requested can be
negotiated and the SPCA is very willing to hold discussions with
the Board . The SPCA request is approximately 7% more than last
year.
The Supervisor asked the Ms . Stonebreaker if she had any
suggestions as to how the Town can have an enumeration completed.
It is not a pleasant job and it has been difficult for the Town to
keep someone as an enumerator .
1,1s. Stonebreaker stated that the smaller municipalities have hired
couples who can usually do an enumeration within six months. The
City of Ithaca has looked into a variety of community service
groups performing the service . The key would be to hire more
people to perform the enumeration in a shorter period of time .
The City has also thought about licensing dogs at the rabies
clinics .

Hs. Schaaf suggested that the Town could use the local television
station for a public service announcement urging people to license
their dogs .
Supervisor Raffenspe.rger asked what the SPCA' s role was concerning
the rabies epidemic? Hs . Stonebreaker responded that the SPCA has
a unique contract with the City of Ithaca where they respond to
raccoons who do not have actual contact with a human or other
animal . The SPCA currently has a contract with the Tompkins County
Health Department that if an animal has definitive contact with a
person, or a domestic pet they will pick it up and impound it for
rabies testing .
If the SPCA can say that an animal has been injured, as a humane
function they will respond to that. If it is a questionable animal
exhibiting signs of illness in every other municipality except the
City of Ithaca, they are referring the matter to a wildlife control
officer. Ms . Stonebraker stated she would like to see a County
wide contract with them for the handling of this problem.
Several members of the Board asked for explanations as to how the
graphs were developed and what they are actually showing.
As . Stonebreaker stated the graphs reflect that the number of calls
made by the SPCA on behalf of the Town of Ithaca will not be
significantly higher or lower than last year.
Councilman Niklas asked what percentage of increase in operating
expenses has the SPCA had? He pointed out that since they were
asking for a 7% increase in the contract it would be beneficial to
know that the operating costs have not increased beyond that
percentage .
The Board agreed that they would like to see a copy of the budget
for the last two years for comparison . Pis. Stonebreaker will
provide copies of these budgets before the end of September.
Councilwoman Leary stated she was concerned that there were no
salary increases for the staff within the proposed budget
especially since some of them only earn minimum wage . Councilwoman
Leary does not feel this is a positive aspect of the budget.
Ms . Schaaf agreed and stated they had considered many different
ways of cutting the deficit and found that it was either freezing
salaries or lay offs .
Councilwoman Leary stated increases in salaries should be
considered a normal operating expense . Raising salaries are
legitimate increases .

Councilman Niklas noted that the employees are committed to the
mission of the SPCA by continuing with no pay increase .
Councilwoman Leary rebutted that it shows a commitment to keeping
their jobs. She feels that not having an increase in salary in the
1993 budget is not positive or necessary.
Ms . Stonebreaker explained salaries were mentioned tonight because
the SPCA is not only going to municipalities and asking for
increases to offset operating costs, but also to show that the SPCA
has taken some internal measures to keep expenses in check.
Ms . Schaaf stated that freezing salaries was the option they had.
They started 1991 with a $40,000 deficit, and a $100,000 budget.
The only way to offset this was to take money out of the savings
account or to extensively fund raise . Not for profit organizations
have been hit hard by the economy through increased difficulty in
fund raising.
Agenda Item No . 19 - Records Management Disposition Listing
The Town Clerk presented the second Records Management Disposition
List to the Board each Department Head has reviewed the listing and
approved the disposition of listed records . The Clerk explained
that each file is being reviewed, rather than each drawer to ensure
that any vital record is not included in the listing .
I-lotion made by Councilman Niklas, seconded by the Supervisor
approving and authorizing the RMO to dispose of the referenced
records according to the SARA schedule . Carried unanimously.
Agenda Item No . 20 - DeWitt Middle School Crossing Guard
The Town Clerk informed the Board that the Crossing Guard had
resigned from the DeWitt School . The Personnel Manager has
advertised for the position and one person has applied . Since
school opens tomorrow and the applicant is qualified , the Personnel
Manager and the Town Clerk asked her to start tomorrow. The
applicant is retired, loves children, and has adequate
transportation.
Motion made by Councilman Whitcomb and seconded by Councilman
Liguori ratifying the advertisement for the position of DeWitt
Middle School Crossing Guard . Carried unanimously.
Motion made by Supervisor Raffensperger seconded by Councilman
Whitcomb authorizing the temporary appointment of Janice Smith by
the Town Supervisor as the DeWitt Middle School Crossing Guard
pending her completed application . Carried unanimously.

Agenda Item No . 21 - Village of Lansing Community Center Ad Hoc
Advisory Board
The Supervisor received a proposed resolution from the Village of
Lansing concerning the Village of Lansing Community Center. The
Supervisor is not recommending that the Town pass the resolution as
written because the resolution makes commitments the Town of Ithaca
is not prepared to make at this time to subsidize and guarantee
operating funds for this recreational facility .
Supervisor Raffensperger feels the Town Board is willing to appoint
a Town Board member to serve as their representative on an advisory
board to continue the exploration of the possible involvement of
the Town in this recreational center .
Supervisor Raffensperger made a motion appointing Councilman David
Klein as the Town ' s representative . Seconded by Councilman Karl
Niklas . Carried unanimously.
Agenda Item No . 22 - Route 13 Street Lights
The Supervisor explained that the City of Ithaca had removed street
lights toward the City on Rt . 13 . Now there are lights in the Town
of Ithaca, a dark area, and then the beginning of lighting in the
City.
The NYS Department of Transportation does not feel it is safe to go
from a lighted to dark area, and then lighted again. They have
offered to remove the poles and bases without expense to the Town.
Motion made by Councilman Niklas authorizing the removal of the
street lights , seconded by Councilman Liguori .
Daniel Walker, Town Engineer stated we would still have some street
lighting located at the intersections where pedestrians will be
crossing .
The Supervisor received a phone call from a resident who asked why
we were taking down the street lights . The callers attitude was
that the City should have not removed their lights . The Supervisor
agreed that if the City had not removed them we would probably not
be removing lights in the Town now.
Motion was carried unanimously.
Agenda Item No . 8 - Public Hearing to Amend Zoning ordinance
Town Clerk has proof of posting and publication. Public Hearing

William Seldin, Attorney at Law representing Tom Bell spoke to the
Board. Mr . Seldin began by stating the amendment includes a
provision with regard to application for a site plan approval that
has been filed as of the date of adoption, and makes provision for
approval under the old law provided that it is in completed form
prior to the effective date of the Local Law.
Fir. Seldin was given the indication from Mr. Bell and members of
the Planning Department that this was a forum to obtain
clarification and direction on Mr. Bell ' s position in regards to
the amendment.
About six weeks ago, Mr. Bell, owner of Bells Convenience Foods and
warehouse, is seeking to devote one third of the warehouse to
retail use . The intent is that whoever occupies it for retail
purposes would also use the rest of the storage facility in a
compatible manner. Under the present law Fir. Bell does not need a
variance to accomplish this .
Fir. Bell started the process by visiting the appropriate people in
the Town of Ithaca. Last Thursday members of the Town informed him
there was some confusion as to what he would have to submit in
order to accomplish what was necessary under the now existing law,
part of the amendment. It was not until this morning that Mr. Bell
was notified a decision had to be made on the precise things that
were required of him. He submitted the site plan for the
warehouse, the indications were there were other things needed to
be done to it, such as where the parking would be , what the public
access to the building would be .
Attorney Seldin stated he wished to know, considering Fir. Bell ' s
conduct of good faith with the Town, what the Town Board ' s position
will be given Mr. Bell ' s situation so that he has some direction of
what to do in the future .
Town Attorney, John Barney responded to Attorney Seldin by saying
he had not seen Fir. Bell ' s application. The intent of this Section
2 was to provide a grandfathering provision for anyone who had an
application in process . The current law is unclear as to whether
or not it permits it, which is why the legislation is being
proposed for adoption . A number of years ago, an interpretation by
the Board of Zoning Appeals which they have partially refuted in a
few subsequent cases was made . The reason for this legislation is
to make clear what the Town Board wants in its Zoning Ordinance .
However, people on some occasions have acted in reliance on the
Board of Zoning Appeals interpretation , Mr. Bell in particular.
Mr. Bell ' s warehouse is not an explicitly permitted use in a light
industrial zone , but he was granted a permit on the theory that it

was alright under that interpretation. Section 2 was designed for
someone in Mr. Bell ' s situation if he has filed a substantially
complete application. Attorney Barney could not comment on the
extent of Mr. Bell ' s current application.
Mr. Forman stated he met with Mr. Bell and saw the application for
the first time today. The site plan Mr. Seldin has is not the site
plan the Planning Department received. The site plan submitted was
not to scale and was missing a number of items. Mr. Forman
explained to Mr. Bell some of the things that needed to be
completed before it would be a completed application, such as
signing the application and dating it . The site plan itself was
not a completed site plan, and would not be accepted from anyone at
this point.
Supervisor Raffensperger mentioned there is a check list to
determine completeness for site plan review.
Attorney Seldin responded this was not the first day that Mr. Bell
had made inquiries as to what was needed. He had come to the
office several times before to discuss this, there was some
confusion as to what was required of him.
Mr. Forman stated that approximately four to six weeks ago he and
Mr. Bell had a brief conversation concerning this . There was some
confusion at a future meeting with a Planning Department person
that the amendment had already been passed . Those are the only
meetings Mr. Forman was aware of .
Mr. Seldin, stated that last Thursday, Mr. Bell had a meeting with
Chad Eiken, and Mr. Eiken mentioned there was some confusion as to
what the appropriate vehicle will be, the Planning Board would let
him know. Mr. Bell was not called until today as to what to bring
to the Planning Department- .
This issue was in limbo as far as the Planning staff were concerned
and they couldn ' t say that the law was about to change which would
have made their viewpoint totally different.
Mr. Seldin argued that the proposed amendment gives the impression,
at least the intent, if the process is started as of the date of
the adoption of the amendment, you would be grandfathered in.
Attorney Barney stated it was not that simple . The Town has had
circumstances where applicants submit a clearly uncompleted
application , and people claim they are . That is the reason for the
wording, " substantially completed application" .

There are two trays that the Town Board could address this. They
could pass the amendment tonight probably under the definition of
substantially completed application, and then Mr. Bell ' s
application would not qualify. Or, the Town Board could choose to
delay the adoption until the October meeting with the language
complete, which would give Mr. Bell a month to get a substantially
complete application submitted, as well as anyone else who would
fall within this category. Or, under Section 4 of this law instead
of saying it takes effect immediately, amend it to say it takes
effect 10 days from the adoption . With the first suggestion you
would not need another Public Hearing, you would just adopt the law
at the next meeting .
Supervisor Raffensperger stated she would be concerned about
delaying the adoption because of the possibility of the number of
applications which may be received in the interim period .
Councilman Liguori asked if the amendment were not passed tonight,
or wasn ' t contemplated tonight, would Mr. Bell have a sufficient
application which could be approved?
Mr. Forman said it would be up to the Board, we could work with Mr.
Bell in terms of the site plan and bring it into compliance .
Whether or not he needed a variance would be up to Attorney Barney
or the Zoning Board of Appeals .
The Supervisor stated that is the question, there have been various
interpretations over many years as to whether or not a use that is
permitted in a less restrictive zone would be permitted in another
zone . The Zoning Board of Appeals did publish a document in 1974
and interrupted it one way, and in the meantime they themselves
have interrupted it somewhat differently. This amendment is
intended to clarify the intent.
Attorney Seldin said that under the prevailing status and the
history of the ZBA, what would be absent this amendment would be to
work with the Planning Department on gaining those approvals
without the necessity of going for a variance as called for by the
proposed amendment. There is a big difference with what you have
to show and what you have to prove . That is what Mr. Bell has
relied upon in the past.
Attorney Barney conceded that his advise to the Planning staff is,
that absent the existence of the law the issue be a site plan issue
only. It is not at all clear that the Planning Board would grant
a site plan of this proposed use in this location, that is a
different issue . It is quite a change from what the building was
intended to be .

Councilman Klein asked if the only district this applies to was the
light industrial on the Elmira Road? Attorney Barney responded it
applies to all industrial districts , but the only districts where
this has been contested is the light industrial district .

Section 4 to reading "this Local Law shall take effect ten days
after its adoption" . Seconded by Councilman Whitcomb. Roll call
vote of amendment, carried unanimously.
Motion made by Councilman Niklas adopting "A Local Law amending the
Town of Ithaca Zoning Ordinance to Clarify Uses in Zoning
Districts" , with the adopted amendment; and authorization of the
Supervisor to sign a Certificate of Necessity. Seconded by
Councilman Liguori . Roll call vote carried unanimously.
Public Hearing ended at 7 : 17 p. m.
Attorney Barney stated that Mr. Bell will have ten days to submit
a substantially completed application, and it would then proceed
under the site plan approval process . It is strictly an issue of
fairness to allow Mr. Bell to submit his application .
Supervisor Raffensperger painted out that this does not mean anyone
should imply that the action taken tonight is a site plan approval
by this Board.
Agenda Item No . 26 - Setting Public Hearing Rezoning Chase Pond
Properties
Town Planner, Floyd Forman explained that Hospicare contacted the
Town asking that the Chase Pond Parcel on East King Road which has
approximately 23 acres be rezoned. It is presently zoned for
multiple residence . The Hospicare is proposing to take the 23
acres and turn a portion of it into R-30 and another to R-15 . The
R-30 would actually have the hospice on it. Much of the area,
except for the Hospice would remain green. The R-15 parcel of
approximately 11 acres would be proposed to have twenty homes on
it.
Judy Malloy, President of the Board of Directors of Hospicare
addressed the Board . Ms. Malloy explained the Hospicare Board has
conducted various feasibility studies to determine if a Hospice was
needed in this County. The study indicated that an inpatient
facility was clearly needed.
Hospicare takes care of terminally ill patients in their home
through an inter-disciplinary service which consists of medical,
emotional , spiritual , family, and bereavement services .

Hospicare is currently unable to care for any patient who does not
have a care giver living with them 24 hours a day. The length of
stay is approximately 45 days . Hospicare is legally able to care
for a person for up to six months. The building would also benefit
the County as a respite center, and as a transition center for
patients .
Hospicare would be able to fill six beds on a continuing basis.
The financial study shows that donations would be available to have
six beds . A ten year, and twenty year projection shows a probable
need for 12 beds.
Supervisor Raffensperger told the Board the Town has received a
letter from Donald and Maxine Keene, 1 McGrain Court, Chase Farms
who wish to give their enthusiastic approval to this rezoning.
I•is. Malloy explained that Hospicare differs from a nursing home in
that it can not give any form of curative care, all care must be
symptom control or pain control . Hospicare Patients must be
certified by a Physician to have six months or less to live .
The Chase Farm property meets the criteria the Hospicare needs.
The neighbors have been most welcoming .
Councilman Whitcomb stated that the Hospicare people and the
Malloy' s have been very cooperative with the Neighborhood
Associations in the area, and they have addressed most of the
concerns raised by them.
Councilman Klein felt it was a wonderful program but questioned the
problems that may occur if it is necessary to have emergency
vehicles go there .
Ms . Malloy responded that an ambulance would take a Hospicare
patient only when someone panicked at the last minute, they usually
prepare everyone for a calm, dignified, peaceful death . A typical
ambulance call would be planned in the daytime for a transfer to a
hospital .
Most of the clientele are elderly patients, they will accept
patients of any age who meet the criteria as outlined by the State
and Federal governments .
Motion made by Councilman Niklas authorizing the Town Clerk to
advertise for a Public Hearing on October 5 at 7 : 45 p. m. , to
consider a Local Law rezoning the referenced property, and to
further refer the application to the Planning Board for

Agenda Item No . 23 - 1993 Salary Ranges
The Personnel Committee met and reviewed present salaries and
ranges and have made recommendations for some changes . The list
was presented to the Town for review. The previous range remains
unless there are noted changes. Some changes were made to ensure
comparable positions had comparable ranges .
Councilman Klein asked what the criteria was for some ranges being
changed more dramatically than others.
The Supervisor explained it. was a reflection of the present salary,
and evaluation of the Personnel Committee that it was a realistic
hiring range for the position.
Motion made by Councilman Niklas, seconded by Councilman Liguori
adopting the 1993 salary ranges as recommended by the Personnel
Committee . Carried unanimously.
Agenda Item No. 28 - Reimbursement for Damage Due to Sewer Blockage
Engineer Daniel Walker explained there was a sewer blockage on
Kendall Avenue . One of the residents of a basement apartment
sustained sewer damage to personal property because normal flow
away from the building did not occur. The sewer manhole overflowed
and surcharged the sewer causing it to back up into the apartment.
There was approximately 4 to 8 inches of sewage in various areas of
the apartment. H any items were on the floor as the resident was in
the process of moving in . The resident has submitted a list of the
items that were damaged including the replacement costs . Most
items were submerged by the sewage .
The Engineer recommended that the Town Board approve reimbursement
for the items, and felt the value placed by the resident on the
items were reasonable .
The claim for damages was submitted to the Town ' s insurance company
and it is not covered under the terms of the insurance contract .
The Town will review the Town ' s insurance policy to determine why
the Town was not insured for this loss.
Mr. Walker explained a check valve will be installed to avoid a
recurrence of this problem.
Motion made by Councilman Niklas authorizing reimbursement for
damages caused to the personal property of Stuart Krause in the
amount of $1 , 315 caused by a sanitary sewer blockage . Seconded by
Councilman Liguori . Carried unanimously.

Supervisor Raffensperger explained that this position was held by
Linda Nobles as Personnel Manager who has now left the Town of

Manager to meet the requirements of grant funding .

Town Engineer, Daniel Walker explained that there is some patching
which cannot be done when the water table is high. There will be
a credit of $750 . 00 on the contract, this amount will be adequate
for repairs with Town employees . The second is a credit of
$1138 . 00 to the Town for trees and shrubs that are being replaced
by the Town Parks Department. This is a mutual agreement between
the Town and the Contractor to satisfy more fully the residents
complaints and desires .

with the Town Zoning Ordinance and Building Codes, and if he shall
fail to do so within the time limit set by the Town Attorney, the
Town Attorney is authorized and directed to institute a corporate

A LOCAL LAW AMENDING THE TOWN OF ITHACA ZONING ORDINANCE TO
CLARIFY PERMITTED USES IN ZONING DISTRICTS .
Be it enacted by the Town Board of the Town of Ithaca as
follows :
Section 1 . The Zoning Ordinance of the Town of Ithaca as
readopted, amended, and revised, effective February 26, 1968 , and
subsequently amended, be further amended as follows :
1 . ARTICLE II is amended by adding a new section 3. 5 at the
end thereof reading as follows:
°SECTION 3. 5. Prohibition of Uses . All uses not
specifically set forth as permitted uses in a zoning district are
expressly prohibited as uses in that zoning district. A use
specifically permitted in one zoning district is not permitted in
any other zoning district, less restrictive or otherwise, unless
specifically enumerated as a permitted use in such other zoning
district. "
2 . ARTICLE XII, section 55, is amended by adding at the end
thereof the following:
"The enumeration of the classification of restrictiveness in
this section shall not be interpreted to mean that a conforming
use validly permitted in one district is automatically permitted
in a less restrictive district ( e . g . , a dry cleaner permitted in
a Business District C is not a permitted use in a Light
Industrial District. ) "
Section 2 . The amendments provided by this law shall not
affect any application for site plan approval which was filed in
substantially complete form prior to the effective date of this
local law and which was pending at the date of enactment of this
local law. Any subsequent alterations of the site plan, however,
shall be governed by the provisions of these sections as amended.
Section 3 . If any provision of this law is found invalid by
any court of competent jurisdiction, such invalidity shall not
affect any other provisions of this local law which shall remain
in full force and effect.
Section 4 . This law shall take effect ten days after its
adoption.

Discontinuance Street Lighting Route 13

WHEREAS , the Town of Ithaca has been paying energy and
maintenance costs for Street Lighting on State Route 13 at a cost
of approximately $4, 900 per year; and
WHEREAS , the New York State Department of Transportation has
suggested that Street Lighting of this area be discontinued and the
Department of Transportation has offered to remove the lights and
all components at no cost to the Town of Ithaca if completed during
the current renovation project; now therefore be it
RESOLVED, that the Town Board of the Town of Ithaca authorizes
the discontinuance of street lighting along Route 13 from the City
of Ithaca line to the Village of Lansing line, with the exception
of the intersection lights required for Route 13 and Route 34
interchange .

Reimbursement Property Damage Caused by Sewer
Resolution No. 234
WHEREAS, on August 5, 1992 the Kendall Avenue sanitary sewer
became blocked and caused the basement apartment at 181 Kendall
Avenue to become flooded with sanitary sewage; and
WHEREAS, Stuart Krause , the resident of the apartment had
several personal items that were covered with sewage, damaging them
beyond repair; and
WHEREAS, Mr. Krause has submitted a list of items with
replacement costs and has requested reimbursement from the Town;
and
WHEREAS, a claim has been submitted to the Town ' s insurance
carrier and the claim was rejected because this type of
reimbursement is not covered by the Town' s insurance policy; now
therefore be it
RESOLVED, that the Town Board of the Town of Ithaca authorizes
the reimbursement for damages to Stuart Krause for an amount of
$1 , 315 . 00 for replacement of damaged personal items.

Stoppage in the Town of Ithaca System
Dear Mr. Becker :
On August S , 1992 sewerage backed up into the basement apartment
at 181 Kendall Avenue in the Town of Ithaca. The overflow into the
apartment through the waste drains was caused by a blockage in our
sanitary sewermain. The backup and overflow occurred about noon and
the City Sewer Department ' s crew finished clearing the blockage about
4 : 15 p.m.

conversation on Friday, August 7th, with Susan of your office , that we
are covered for this type of incident.

well as bills for cleaning of some individual items, in addition to
the list of items for which the resident wants total replacement .
