Town Board Meeting
June 8, 1992
At a regular meeting of the Town Board of the Town of Ithaca,
Tompkins County, New York, held at the Town Hall , 126 East Seneca
Street, Ithaca, New York, there were :

Agenda Item #3 - Report of Town Officials
a. Supervisor ' s Report : The Supervisor appointed Candace E .
Cornell to the Codes and Ordinances Committee at the
recommendation of the Planning Board .
In reference to the Town Board Meeting of May 11 , 1992 the
Supervisor read a prepared statement in response to the Citizens
For Sensible Land Use and Property Rights version of the total
cumulative costs of the Comprehensive Plan, ( see attached) .

b. Town Engineer ' s Report: (Written report available upon
request. ) Mr. Walker reported Capital Projects on West Hill are
almost completed . There have been some complaints from the
residents concerning the vegetation. The Parks Department has
been trimming and replacing trees. They have had to wait to
replace some trees because of the wet ground . Additional trees
are being planted in a spirit of neighborliness . Town staff is
available to answer the residents concerns when needed .
Inlet Valley Phase I is a bigger project than anticipated. The
project is almost completed . The Town is holding a 2 1/2%
retainage until it is determined how the grass is growing. The
developer has moved off the site .
The Supervisor mentioned that residents from West Hill have been
going to Inlet Valley and making comparisons .
Inlet Valley Phase II, the final design will be completed soon .
Specifications have been prepared and will be reviewed for final
editing. Verbal verification has been received from the Corps of
Engineers for the stream crossing . We are also close to securing
an agreement with Conrail to cross the railroad tracks . We are
negotiating with the DEC for the crossing of the Inlet. We are
contracting with surveyors to provide the easement surveys .
There are two interns from Cornell in the Engineering Department
who are exceptional young men who are providing a great deal of
assistance .
c. Highway Superintendent' s Report: (Written report available
upon request. ) Fred Noteboom reported there were two major
projects in May the brush and leaf cleanup, and paving King Road.
d . Building Inspector/Zoning Officer Report: (Written report
available upon request. ) The Building Permits issued year to
date for 1992 are close to the dollar value of those issued in
1991 . The significant difference is the Ithaca College Science
Building which was a $16, 000, 000 project. Certificate of
occupancy levels are slightly down. Field visits are also down
slightly. There were nine new cases at the last two Zoning Board
meetings.
The Fireworks Committee from Ithaca College has been negotiating
with us for the July 2nd fireworks show. Some things have been
changed such as parking, to help with the traffic flow. It is
hoped this will eliminate some of the concerns from last_ year.

d. Building Inspector/ Zoning Officer Report - Cont ' d: Councilman
Niklas questioned Mr. Frost about number 4 of the Complaints
Investigated This Month, Danby and West King Road, fill material .
Mr. Frost responded they were not sure that fill was ever put
there without a permit. The material was leveled and seeded .
Supervisor Raffensperger stated if there is illegal dumping a
determination will have to be made as to whether the material
should be removed or whether some other abatement would be
appropriate .
e . Town Planner Report: Mr. Forman reported under the
Comprehensive Plan on May 28 a Public Information Meeting was
held on Chapter III at the NCR Cafeteria. Questions and comments
from the public concerning the Comprehensive Plan, and the Open
Space Report, Draft EPOD Legislation and map were discussed . At
the June 9th meeting the CPC members will be asked to review and
comment on a number of potential developments .
The Planning Board recently approved with conditions , a retail
project from John Novarr for a former NCR site . The Planning
Board has also received the GEIS from Cornell and is in the
process of determining the adequacy of the draft document.
Codes and Ordinances Committee is continuing to work with staff
on steep slopes and stream corridors .
Agenda Item 44 - Report of Town Committees
Councilman Whitcomb reported that the CAC continues to work on
the revised Open Space Report . We have a summer intern and a
college student volunteer assisting by verifying the inventory
and physical features . The CAC hopes to have a draft to look at
in June . The CAC approved a resolution at its last meeting
urging the Town Board to adopt legislation designating unique
natural areas as defined by Tompkins County as critical
environmental areas of the Town affording them a higher level of
review under SEQR. Councilman Whitcomb requested this be put on
the agenda for the July, Town Board meeting.
Councilman Niklas stated the COC had a very productive meeting .
Constructive alterations to the EPODS were made . The COC is
proposing the following schedule concerning EPODS : At the July
meeting the COC needs another opportunity to review the drafts
and to direct its attention on the map. A Public Information
Meeting will be held at the end of July to inform people what has
been done . The Planning Board might in August hold its own
Public Hearings since the EPODS are essentially rezoning. In
September the Town Board could discuss the recommendations of the

Agenda Item #4 - Cont ' ds Planning Board and the COC, and give the
public a chance to make comments . In October the Town Board
would hold its first Public Hearing . There will be two levels of
Public Hearings . One at the Planning Board level , and one at the
Town Board level .
Councilman Niklas feels this schedule will afford the opportunity
to the public to make comments; and allow the COC, Planning
Board, and the Town Board to make changes as needed.
Councilman Liguori stated he still had a problem with the EPODS
coming up for adoption by the Town Board before the Comprehensive
Plan. The public has not had a chance to see the whole picture of
planning before the EPODS will be adopted. Councilman Liguori is
not opposed to the EPODS , he is objecting to the concept of
advancing Town Board approval on what will be major components to
comprehensive planning .
Councilman Niklas mentioned this was a recommendation which has a
long history even before the present administrations long term
planning. Councilman Niklas believes this a parallel process.
The Town Board has passed major changes in the zoning ordinance
already without seeing the Comprehensive Plan.
Councilman Liguori feels the public does not understand the whole
comprehensive picture . Pieces of it are coming to the Town
Board . He feels we should wait until the Comprehensive Plan is
completed so that we can see the whole picture before adopting
pieces.
The Supervisor told the Board that the consultant hired in 1989
recommended to the Town that we proceed with devising a
Comprehensive Plan and that there be parallel strategy of
planning improvements. This was reviewed and approved by the
Planning Board, as well as the Town Board.
Councilman Whitcomb stated the draft goals and objectives
presented in the plans at NCR the other night showed one of the
first recommendations of the draft is the development of EPODS .
He always feels that Councilman Niklas ' schedule is very
optimistic .
Councilman Niklas believes Councilman Liguori ' s attitude is
reasonable, but that if we give the public an opportunity to look
at the Comprehensive Plan in its entirety it would be too easy
for them to lose sight of the importance of the EPODS . Focusing
on the EPODS allows us to be open with what the consequences of
that rezoning would be .
Councilman Liguori reported the Public Works Committee discussed
the Town pesticide policy.

Agenda Item #4 - Cont' d
Councilwoman Valentino asked the status of the rabies pre-
exposure inoculations for the Highway Department employees. One
of our employees has been inoculated. The Supervisor addressed
the County Board of Representatives asking them to coordinate the
efforts of all the municipalities to deal with the rabies
problem. The County will be having a report and a
recommendation .
Councilman Whitcomb asked if we have a policy in the meantime
dealing with the removal of dead animals along the highways as we
have had to hire Wildlife Control Officers to deal with this
problem.
The Supervisor told the Board we do not yet have a procedure , and
we have had to hire the Wildlife Control Officers because the
animals have been located near routes walked by school children .
Councilwoman Leary feels the Town should make clear a statement
that we believe this is a County problem and we should not have
to pay for it. Supervisor Raffensperger suggested we wait to see
what the County Health Department recommends, and if we are not
satisfied we can make a stronger recommendation .
Agenda Item #5 - Report of County Board of Representatives
No report.
Agenda Item #6 - Persons To Be Heard
Noel Desch asked the date of the next COC meeting, and if he
could secure a copy of the revised law. Councilman Niklas
reported the next meeting would be July 1, 1992 . Mr. Desch was
told he can receive the revised copy after filling out a Freedom
Of Information Form.
Mr. Desch told the Board that Mr. Graham, DOC Officer has always
been willing to have any member of the public call concerning any
problems with dead or rabid animals . The Supervisor stated she
has been informed by Mr. Graham that since the problem has
escalated he can not do this anymore .
Agenda Item #7 - Forest Home Lower Bridge
James Kazda, Tompkins County Senior Civil Engineer reported to
the Board he had been asked to develop some numbers for the
options available for the downstream Forest Home Bridge . Mr.
Kazda represented the estimate that was given to the Public Works
Committee of the Board of Representatives, ( see attached) . The
resolution passed by the Committee included the recommendation

of a replacement one lane bridge, totally new construction. The
County Board of Representatives has not acted on this . A bid
alternate should also be done for the rehabilitation of the
truss. They are proceeding with developing requests for
engineering services with this design.
As a result of the Public Works Committee not acting
affirmatively on the recommendation of County Staff concerning
the bridge, they requested Mr. Kazda present an option for the
Town Board ' s serious consideration . That after the bridge is
completed both design and construction, the Town of Ithaca take
it over as a town bridge and have all responsibility. Mr. Kazda
stated the precedent has been set on many occasions. One
example, the Beach Road bridge in Newfield is a bridge that the
County Staff recommended for demolition. The Town of Newfield
felt the bridge was important for their own infrastructure as a
pedestrian bridge . The agreement was the County would
rehabilitate the bridge as a pedestrian bridge and then turn it
over to the Town .
Supervisor Raffensperger stated there was not a disagreement
between the County and thi:; Town Board as to what would be done
with the bridge .
Mr. Kazda, the difference is the recommendation of the County
staff versus the wants and desires of the community. The
community made a very strong argument for making this crossing a
one lane bridge . The County Committee was acting as a
representative of the community in saying that we agree you want
this as a one lane bridge , but you must consider it will come
back as a bridge of the Town of Ithaca as opposed to staying on
the County system.
Mr. Kazda is here to get the opinion of this Board about this
proposal , the County is proceeding as if the bridge will be
replaced with a one lane bridge . A formal notification from the
Public Works Committee will be forthcoming outlining the
alternatives. Councilman Niklas asked what if the Town of Ithaca
does not want to be responsible for the bridge after the
replacement?
Mr. Kazda was not sure , he was instructed to inform the Board of
this proposal . The Pickney Road Bridge was once owned by the
State and turned over to the County, that agreement will probably
be used as a guide for this situation . The other Towns passed
resolutions when they took over their bridges .
The County is also looking for a contribution from the Town of
Ithaca with respect to they construction agreement for

participation . The approach work, the approach guiderail , the
approach sign work as well as the wearing surface on the deck are
considered the responsibility of the Town of Ithaca.
Councilman Niklas suggested the Board not vote of this proposal
until we have reviewed all aspects of this proposal, including if
we decide not to accept it.
Supervisor Raffensperger asked Mr. Kazda if the recommendation of
the County staff had been accepted by the County Public Works
Committee would there have been this proposal for the Town to
take over the bridge?
Mr. Kazda stated he brought to the Board what he was asked to .
Supervisor Raffensperger told the Board she expects Mr. Winch,
Chair of the Public Works Committee to forward written material
that will clarify the Towns options and what our obligations
would be under this type of agreement .
Karen Baum of the Forest Home Improvement Association addressed
the Board concerning the letter sent to the Board, ( see
attached) . They would like the Town Board ' s support of the
specifics in the letter. Most of them fit within the guidelines
of Mr. Kazda ' s replacement option in Column 1 . They are asking
that the 1904 parts be rebuilt or renovated, and the 1970 parts
when the bridge was last renovated be replaced .
Mrs . Baum had a different interpretation of what occurred at the
Public Works Committee meeting . It seemed there were two
separate issues . The Public Works Committee did vote unanimously
for a one lane structure , and that part of the outcome of that
would be to offer the Town the opportunity to take over this
bridge . She did not understand it to mean that since the staff
recommendation was not taken they are going to tell the Town to
take the bridge . Mrs . Baum told the Board they are asking the
Board to support a one lane replacement bridge which will
resemble the bridge that is there now.
Supervisor Raffensperger asked Mr. Kazda to what extent do the
present plans meet all the requests of the Forest Home
Improvement Association?
Mr. Kazda responded that the only issue that has not been
resolved prior to this date is the width of the bridge . They
have anticipated keeping the width within two inches.

The trusses would be part of a structure alternate within the
bidding process . The Committee would make the decision as to
whether to go ahead with rehabilitating the trusses when the
amounts came in . There would be a restoration of the bridge .
The plan is to hire a consultant from the RFP by the end of June ,
with it going out to bid in February next year .
The Supervisor surmised that the County plans to do eventually
all of the items that are requested by Forest Home except for the
two inch difference in the width .
Mr. Kazda stated the County will be bringing the plans as they
are developed to the Town Board and the community for
informational purposes .
Supervisor Raffensperger mentioned the Board would look forward
to receiving the communication from the Committee as to the
proposed responsibilities of the Town of Ithaca.
Mrs . Baum asked the Board if they would pass a resolution
endorsing the wishes of the Forest Home Association concerning
the bridge without any reference to who would be responsible for
the bridge after the construction.
Supervisor Raffensperger suggested the Board not send anything
further to the County concerning this matter until we have
determined where the Town stands on this issue . We must receive
more information about the meeting where the responsibility of
the bridge was discussed .
The Board agreed to take the recommendation of the Forest Home
Improvement Association to pass a resolution under advisement.
Pine Tree Road
The Board asked Mr. Kazda to update them on the Pine Tree Road .
The base bids came in, the County selected Alternates 1 , 3 and 4
which are additional turn lanes, and traffic signals, (Alternate
1 ) . The substitution of granite curbing for concrete , (Alternate
3) . Installation of traffic signs, (Alternate 4 ) .
On July 2, the County Board authorized the execution of an
agreement with J. G. Turner, Inc. for $641, 700 .
Alternate 2 was the sidewalk construction . J . G. Turner is also
the low bidder on Alternate 2 . The project as a whole is 20%
under the Engineer' s estimate, and 15% under the Capital Projects
estimate . The contractor will be starting within two weeks.

Pine Tree Road - Cont ' d
Alternate 2 was held out of the bid to await a resolution at the
Town level for paying for the sidewalk construction.
The Supervisor and the Board have discussed the establishment of
a sidewalk district. However, it has not been determined how
much it would cost. The condition of the sidewalk area after
construction must also be discussed . It would cost $46 , 950 for
the construction of the sidewalk. The Board needs to see the
plans with the revisions before they can act.
Agenda Item #10 - Public Hearing to Amend Local Law #12 - Fees
Collected by the Town Clerk
The Supervisor explained there are some revisions necessary in
Local Law #12 , Fees Collected by the Town Clerk. Motion made by
Councilman Niklas authorizing the Town Clerk to advertise for a
Public Hearing , July 13, at 7 : 00 p. m. to consider a Local Law to
Amend Local Law #12 , A Local Law to Establish and Change Fees
Collected by the Town Clerk. Seconded by Councilwoman Valentino.
Carried unanimously.
Agenda Item #11 - Consider Amending Local Law No. 1 of 1984 -
Sewer Use Laws
Motion made by Councilman Liguori authorizing the Town Clerk to
advertise for a Public Hearing , July 13, at 7 : 15 p . m. to consider
amending Local Law No . 1 of the Year 1984 "A Local Law Regulating
the Use of Public Sewers and Drains, Private Wastewater Disposal,
the Installation and Connection of Building Sewers, and the
Discharge of Platers and Wastes Into the Public Sewer Systems, the
Treatment and Pretreatment of Industrial Waste , and Providing for
the Inspection of Such Facilities and the Enforcement of this
Law" which amendments conform Local Law No. 1 of the Year 1984
with recent EPA and DEC regulatory changes. Seconded by
Councilman Niklas. Carried unanimously.
Agenda Item #12 - Consider Amending Local Law No . 1 of 1984 -
Pollutant Limitations
Motion made by Councilman Niklas authorizing the Town Clerk to
advertise for a Public Hearing, July 13 , at 7 : 30 p . m. to consider
amending Local Law No . 1 of the Year 1984 "A Local Law Regulating
the Use of Public Sewers and Drains, Private Wastewater Disposal ,
the Installation and Connection of Building Sewers, and the
Discharge of Maters and Wastes Into the Public Sewer Systems, the
Treatment and Pretreatment of Industrial Waste , and Providing for
the Inspection of Such Facilities and the Enforcement of this
Law" to establish revised pollutant limitations . Seconded by
Councilman Liguori .

The Supervisor explained that Agenda Item #11 and #12 were
related, however pollutant :limitations were created previously
within the text of previous sewer use Local Laws . The SJS has
suggested we do it separately now so that pollutant limitation
revisions may be made without having to revise the entire Local
Law. Carried unanimously.
Agenda Item #13 - Coddington Road Community Center Summer Program
Supervisor Raffensperger explained the summer program last year
was six weeks long and cost more than what is being asked for
this year. This year' s request for support is for $2043. 00.
The opportunity to attend has been offered first to children of
the Town of Ithaca.
Motion made by Supervisor Raffensperger that the Town of Ithaca
does hereby support the Coddington Road Community Center Summer
Program for a six week period in the summer of 1992 at a cost to
the Town of Ithaca of $204::. 00 . Seconded by Councilwoman
Valentino. Carried unanimously.
Agenda Item #14 - Summer Youth Employment Program
The Town Clerk explained that the Town would be having two youths
through the Summer Youth Employment Program four hours each day
during the summer to help with the Records Management Program.
There is no cost to the Tot-in of Ithaca.
Motion made by Councilwoman Valentino ratifying the Town of
Ithaca ' s participation in the Summer Youth Employment Program for
two participants to be supervised by the Town Clerk in support of
the Records Management Program. Seconded by Councilman John
Whitcomb. Carried unanimously.
Agenda Item #8 - Public Hearing "Local Law Revising the Town of
Ithaca Zoning Ordinance , Technical Amendments"
Public hearing opened at 7 : 00 p. m. by the Supervisor. Attorney
Barney addressed the Board and explained that approximately a
year ago the Board modified the zoning ordinance to provide
certain uses which required special approval, and required
certain ways special approval was obtained . Last year we
modified those into one section, when that was done it was not
discovered that five or six sections further showed a cross
reference back to one of these sections . The cross references
need to be changed back to the correct sub section . Vie also have
a slight inconsistency in our zoning law as opposed to what the
State law permits in term:; of time when the Planning Board must
act on site plan and subdivisions. Attorney Barney recommended we

make our zoning ordinance consistent with the State law.
Town Clerk has proof of posting and publication for Public
Hearing. Supervisor asked if any member of the public wished to
address the Board concerning this issue . There were no
petitioners.
The Town Board agreed to further consider this Local Law at a
special meeting on June 22 , 1992 at 12 : 00 p. m. so that they would
have time to review it. Motion made to close the Public Hearing
by Councilman Niklas, seconded by Councilman Liguori . Carried
unanimously. Public Hearing closed at 7 : 07 p . m.
Agenda Item #15 - Annual Fuel Contract
Fred Noteboom explained to the Board that the bid specifications
have been developed and they are asking for bids from companies
within a five mile radius who can accommodate all the equipment.
Motion made by Councilman Niklas, seconded by Councilman Liguori
authorizing the Town Clerk to advertise for fuel bids for the
Town Highway Department. Seconded by Councilman Liguori .
Councilman Klein asked why the specifications stated super plus
gasoline . Mr. Noteboom responded that many of our vehicles
require this type of fuel , especially the trucks.
Supervisor Raffensperger pointed out the differential was so
little we would lose the difference in money by having two
separate bids . Motion carried unanimously.
Agenda Item #16 - Recommendation of Appointment to City of Ithaca
Board of Fire Commissioners
James Mayer will be resigning from the City of Ithaca Board of
Fire Commissioners at the end of June . He has asked that the
Town Board fill this vacancy so he can orientate his successor .
Motion made by Councilman Niklas to appoint Stuart Grinnell to
fill the unexpired term of James Mayer on the City of Ithaca
Board of Fire Commissioners. Seconded by Councilman Liguori .
Carried unanimously.
Agenda Item #17 - Approval Town Board Minutes
Motion made by Supervisor Raffensperger approving the February
10, 1992 Town Board Meeting Minutes as written. Seconded by
Councilman Niklas. Carried unanimously. Motion made by
Councilman Whitcomb approving the May 11 , 1992 Town Board Meeting
Minutes as written.

Agenda Item #18 - Financial Report
Motion made by Councilman Niklas approving the Financial Report
for the date ending March 31 , 1992 . Seconded by Councilwoman
Valentino . Carried unanimously.
Agenda Item 419 - Automated Data Processing Committee
Daniel Walker reported the Committee was charged with
investigating the steps to go to a PC network, and breaking the
lease for the System 36 . The Committee has found it will be very
costly to legally discontinue the lease . The only way to do so
is to pay the remainder of the five year lease at a cost of
approximately $24 ,000. The Town has already paid about $20,000
for the hardware and software .
1814 is willing to discuss modifying the lease to include
different equipment.
Supervisor Raffensperger understood there was an escape clause
within the lease by not funding it. IBM is saying that
technically that can be done , but they would fight it and destroy
the Towns credit rating .
The only part of the System 36 that is being used is the word
processing software programs . Councilman Niklas pointed out that
in paying off the lease we are paying off a bad debt, because we
are not receiving anything for our money, the quicker we get rid
of this system and use a system that is beneficial to the Town
the better we will be . Councilman Niklas encourages the staff to
investigate with IBM all options for the exchange of equipment.
Mr. Walker pointed out that the problem with the System 36 is the
incompatibility with the PC hardware and software being used at
present.
The ADP Committee was instructed by the Board to discuss with IBM
what kind of arrangement could be made in modifying the equipment
in the lease, and then come back to the Town Board with their
recommendations .
The Supervisor explained there is an urgent need for the Town
Clerk to have a computer which is compatible with the Town
Attorney and the Deputy Town Clerk. The PC which she is
presently using does not do that. Since it could be a lengthy
period of time before the lease negotiations with IBM are
completed the Supervisor recommended the purchase of a PC

for the Town Clerk. Motion made by Councilman Niklas authorizing
the purchase of a computer for the Town Clerk for an amount not
to exceed $2500.00. Seconded by Councilman Liguori . Carried
unanimously.
The Supervisor reminded the Board that the Highway Department
also is in need of a new computer, as the one presently being
used does not have the capacity to run the programs necessary for
the Highway Department.
Agenda Item #20 - Intermunicipal Recreation Committee
The Supervisor explained to the Board they have informational
material about meetings being held among the municipalities to
set up an intermunicipal recreation committee . Councilwoman
Valentino has been the Town ' s liaison to our Intermunicipal Youth
Commission, the Supervisor made a motion that Catherine Valentino
be appointed to the Intermunicipal Recreation Committee as the
Town of Ithaca representative . Seconded by Councilman Niklas .

Agenda Item #21 - West Hill {Mater Supply
Daniel Walker told the Board a petition was received from the
residents of the Drew Park Subdivision off of Poole Road and
Shefield Road. The Board also has a petition from the residents
of Hayts Road .
Mr. Walker showed a drawing the Board and explained the options
that would be available to the residents of this area. Mr.
Walker explained he looked at the demands for water in these
areas on a current basis . Mr. Walker looked at alternative water
main routes, water storage requirements , and the feasibility of
developing a well supply to eliminate the need to run water mains
along areas such as farmlands to avoid additional assessment.
The water requirements for each day for the Drew Subdivision
would be 25 , 000 gallons , for Mecklenburg 16 ,000 gallons , 9,000
gallons for Bundy Road , and Hayts Road 22 , 500 gallons .
One alternative is well development which would limit the area of
service and may have a lower cost. It is unknown if there is an
adequate supply for water there . The treatment cost and need for
a licensed operator to maintain the system would be very costly.
We may be in violation of the Bolton Point water agreement which
states we can not develop another source while they still have
capacity.

Councilman Niklas mentioned the Drew Subdivision does not have a
problem with water capacity, but with the quality of
water. A treatment system for the poor quality of water mentioned
would cost more than a $250, 000 .
Another alternative is to bring the water from our existing water
mains pump it into a storage tank above the subdivision . There
could be a very high pressure problem with this . The system
needed to make this work would cost approximately $2,000,000.
The last alternative would be to install a pump station and pump
the water to the storage tank, requiring 19, 000 feet of water
main, one pump station, one storage tank. This would cost
approximately $1, 800, 000 . The benefit of this system would be
more people would be served .
Mr. Walker summarized by saying a well system would cost
approximately $1 ,000,000 and the other alternatives about
$2,000 ,000 to complete .
Supervisor Raffensperger a-sked Mr. Walker to determine the cost
of a water system to only the Hayts Road and Artificial Breeders.
Mr. Walker responded it would take almost $1 ,000,000 off the cost
of the $2 ,000,000 alternative .
Supervisor Raffensperger mentioned we will need to determine the
costs more closely and determine the percentage of hook-ups if
the system were built to be able to estimate a cost per household
each year if the project were bonded .
The Board instructed Mr. Walker to develop a scenario for each
alternative of cost and construction. Then it can be presented
to the Planning Board for their input.
Agenda Item #9 - Public Hearing "Local Law to Amend the Zoning
Ordinance to Change Variance Standards Resulting From New York
State Amendments to Section 267 of the Town Law Dealing With
Board of Zoning Appeals
Public Hearing opened at 7 :00 p. m. , Supervisor adjourned Public
Hearing until completion of discussion of Agenda Item #21 . Public
Hearing reopened at 7 : 40 p. m. Town Clerk had proof of posting
and publication. No comments received from the public . Public
Hearing closed at 7 : 41 p. m.
Attorney Barney told the Board last year the Commission of Rural
Resources recommended adoption of changes to municipal laws
dealing with Zoning Boards of Appeals . The amendments were to
update the statutes which had not been changed in many years .

One of the amendments addressed was the basis for granting area
variances by the Zoning Board of Appeals. Hr . Barney explained
the differences in an area variance and a use variance . Mr.
Barney suggested to the Board that we adopt a local law
incorporating by reference substantially all of the provisions of
the new State law but specifically modifying the criteria to be
used to obtain a use variance to allow the Board to grant
variances when an applicant demonstrates that he cannot obtain a
reasonable return from the uses of the property permitted under
the ordinance rather than having to demonstrate that he is
deprived of. all economic use or benefit from the property.
We would be adopting this Local Law under Municipal Home Rule
Law.
Motion made by Councilman Niklas approving the adoption of a
Local Law to Amend the Zoning Ordinance to Change Variance
Standards Resulting From the New York State Amendments to Section
267 of the Town Law Dealing with Board of Zoning Appeals .
Seconded by Councilman Klein.
Supervisor Raffensperger made a motion to accept the Short
Environmental Assessment Form for this Local Law showing a
negative impact. Seconded by Councilman Klein . Carried
unanimously.
Roll call vote taken on the adoption of the Local Law. All Board
members voted aye .
Agenda Item #22 - Bids Inlet Valley Water and Sewer Phase II
Mr. Walker told the Board the plans and specifications are almost
ready to go out to bid. There is a very good bidding climate at
the present time . The easements are in line to be signed. The
Permits are ready, except the stream crossing permit with DEC .
Mr. Walker stated he wished to have authorization to solicit bids
for Inlet Valley Water and Sewer Phase II of the 1989 sewer
improvements contingent upon approval of the bid package by the
Town Attorney .
Motion made by Councilman Niklas authorizing the solicitation of
bids as outlined above . Seconded by Councilman Liguori .
Councilman Whitcomb stated he attended a meeting with the
Planning Department suggesting postponement of Phase II of Inlet
Valley upon the completion of the Comprehensive Plan. It was
decided there were some legal issues which needed to be
addressed.

Supervisor Raffensperger told the Board there were two issues
addressed at the meeting Councilman Whitcomb is referring to.
One had to do with the need for services in that area and that
the Town had assured people the Town would be providing water and
sewer in that area. Also, there was a substantial problem by the
fact we had already bonded that project. It would very difficult
not to continue in that theme . Attorney Barney agreed there could
be financial consequences for not using the money borrowed as it
was intended .
Councilman Whitcomb stated this may not go along with the
Comprehensive Plan by developing areas of the Town we aren ' t
ready for, even though it does meet the need for water.
Councilman Klein asked where the additional monies from the
bonding would go if the bids came in lower than the amount
borrowed? Sally Alario told the Board it would pay some of the
bonds .

Agenda Item #23 - West Hill Water and Sewer Change Order
Mr. Walker explained there were two items on this change order.
During installation of a meter reader on Taughannock Boulevard
there was a change in the site conditions which did not allow
drainage . A sump pump had to be installed . Metering equipment
outside of a manhole would be much safer than inside the manhole .
Mr. Walker asked if these changes would be approved by the Board .
The changes result in an increase of $1538. 88.
Motion made by Councilman Klein authorizing the change orders for
the West Hill Water and Sewer project as outlined by the Town
Engineer. Seconded by Councilman Niklas . Carried unanimously.
Agenda Item #24 - Inlet Valley Water and Sewer Phase I , Change
Order
Mr. Walker explained there was one changed condition on the site .
It was determined after delivery that the motors were the wrong
type due to the incorrect voltage at the site . This increased
the contract cost by $2841 . 60 . There is an increase of the
number of water services from the original contract of $37, 447 . 64
which includes a twelve inch water main which would normally be
in Phase II , but is less expensive to install now.

Agenda Item #25 - Downtown Ithaca Post Office
The City of Ithaca has requested the Town of Ithaca join them in
passing a resolution opposing the closing of the downtown Ithaca
Post Office . Supervisor Raffensperger made a recommendation that
the Town of Ithaca adopt a resolution urging the Post Office to
continue to provide full public service , including bulk mail
service at the downtown Tioga Street Post Office , and that the
Postal Service make every effort to provide handicap
accessibility at this site . Seconded by Councilwoman Leary.

Agenda Item #27 - Inlet Valley Cemetery Association Benefit
Assessment Reimbursement
Mr. Walker explained that in May a resolution was passed
authorizing the reimbursement to the Inlet Valley Cemetery
Association for the benefit water assessment because they do not
use any water. They did not pay the taxes on time, therefore
interest and penalties were assessed .
Motion made by Councilman Niklas authorizing a refund to the
Inlet Valley Cemetery Association for the interest and penalties
assessed on their property in the amount of $6 . 68 . Seconded by
Councilwoman Valentino . Carried unanimously.
Agenda Item #28 - SCLIW Vouchers
The Supervisor explained this is done yearly to allow the SCLIW
treasurer to sign checks for vendors between the audit meetings ,
allowing the opportunity to take advantage of discounts and avoid
service charges .
Motion made by Supervisor Raffensperger authorizing the SCLIWC
Treasurer to sign checks for vendors as described in the attached
resolution . Seconded by Councilman Whitcomb . Carried
unanimously.
Agenda Item #29 - Prescription Safety Glasses for Highway
Department
The Personnel Committee has recommended that prescription safety
glasses be purchased for those members of the Highway Department

employees who do not wear prescription glasses, and in the past
has provided goggles or masks for those who do . The Highway
Superintendent feels these goggles are unsafe and uncomfortable .
They cloud up and can restrict peripheral vision. The individual
employee would pay for the eye examination .
Motion made by Councilman Niklas approving purchase of
prescription safety glasses for the Highway Department employees
who need them as outlined in the attached resolution . Seconded
by Councilwoman Valentino. Carried unanimously.
Agenda Item #30 - Set Public Hearing to Amend Zoning Map,
Clarification
Attorney Barney informed the Board when Chase Farm came to the
Planning Board they were advised and understood there entire area
was in a R-15 residential zone . The subdivision of this land
were determined by a R-15 as opposed to R-30 . Recently it was
discovered that part of the Chase Farm subdivision was not in a
R-15 zone but in an R-30 zone .
There have been a number or houses built within this area which
are not within the proper zone . Historically the reason behind
the difference of zones was the lack of a water supply. The new
subdivision could now easily handle the increase need for water.
The area requested to be rezoned is approximately six acres .
Mr. Barney presented a copy of a Description of Lands to Be Zoned
R-15 , as well as a proposed Local Law.
Supervisor made a motion to hold a Public Hearing June 22, 1992
at 12 : 15 to consider a Local Law Amending the Town of Ithaca
Ordinance Rezoning a Portion of Land Along King Road From
Residence District R-30 to Residence District R-15 . Seconded by
Councilman Whitcomb. Supervisor Raffensperger asked if any
member of the Board wished to make an amendment deleting tax
parcel number 44-2-8 . 2 and 44-2-8. 1 . Motion made amending the
resolution by deleting parcels as outlined by Councilwoman
Valentino, seconded by Councilman Niklas. Motion to amend
resolution carried unanimously. Motion to hold Public Hearing to
consider this Local Law carried unanimously.
Agenda Item #31 - Sewer Easement, 230 Renwick Drive
The Supervisor explained this request was heard before the Zoning
Board of Appeals . The Zoning Board of Appeals approved the
infringement with the condition of the approval of the Town
Board .

The petitioner is requesting infringement on the sewer easement
to turn his garage into another room . The Zoning Board of Appeals
has no problem with the approval to infringe . Attorney Barney
feels that we could work around any problem if we had to dig the
sewer. The residents ' attorney has provided an agreement whereby
the Town would not be responsible if the Town in acting to take
care of the sanitary sewer damaged the property, and they would
indemnify the Town and hold the Town harmless from any claims the
Town might have by reason of their working near the sewer.
Motion made by Councilman Niklas authorizing the Town Supervisor
to sign an agreement consenting to Mr . Eberts encroaching onto
the sewer easement as shown on the map as presented by the Town
Attorney subject to approval of the agreement by the Town
Supervisor and the Town Attorney. Seconded by Councilman Liguori .

Motion made by Councilman Niklas approving and authorizing the

Additional Agenda Item - Shalebrook
Attorney Barney stated we have an agreement with the Shalebrook
people that they will complete some work, if they don' t we can
place a lien on their property for the cost of completing the
work. The lien is automatically lifted when there is a sale to a
bonafide purchaser of a separate lot with a building on it.
Shalebrook intends to sell the lots without houses on them. A
title attorney has discovered this and they have asked us to
allow the lien to be lifted if there is a bonafide sale of a lot
to a third party. Motion made by Councilman Whitcomb authorizing
the Supervisor to add an addendum to the agreement allowing the
lien to be lifted if there is a bonafide sale of a lot to a third
party. Seconded by Councilman Niklas . Carried unanimously.

Functions
As a result of the Executive Session a motion was made by
Councilman Niklas authorizing the separation of the management of
the Fiance and Personnel functions of the Town by appointing
Sally Alario as Assistant Budget Officer at a salary of $30,080,
and Pat Punger as Personnel. Manager at a salary of $25, 650. Both
appointments are effective immediately, with review of salary
levels and responsibilities at the end of the 6 month
probationary period. Seconded by Councilwoman Valentino .
Carried unanimously.

to make the changes as outlined above to the Inlet Valley Plater and
Sewer Phase I Project for the indicated costs .

WHEREAS , by resolution March 9 , 1992 the Town Board of the
Town of Ithaca authorized a refund to be paid to the Inlet Valley
Cemetery Association for the benefit assessment of water and sewer
on their 1992 Town and County Taxes, and
WHEREAS , interest and penalties in the amount of $6 . 68 were
added to the 1992 tax bill because of a misunderstanding that
payment of said bill was necessary before reimbursement could be
made, and
WHEREAS , the Inlet Valley Cemetery Association has paid said
tax bill in full including the interest and penalties, now
therefore be it
RESOLVED , the Town Board of the Town of Ithaca does hereby
authorize a reimbursement of $6 . 68 to the Inlet Valley Cemetery
Association for the interest and penalties incurred on the 1992 Tax
Bill for the property located at Elmira Road, Parcel No. 35-1-20 .

the SCLIWC Treasurer be authorized to sign checks for the following
vendors between Audit Meetings; now therefore be it
RESOLVED, that the Town Board of the Town of Ithaca hereby
authorizes the SCLIWC Treasurer to sign checks for the following
vendors between audit meetings based upon the recommendation of the
Bolton Point Commission ; and be it further
RESOLVED, that payment to Direct Page is authorized if payment

WHEREAS , OSHA requires the Town to provide protective eyewear
for employees performing certain jobs, and
WHEREAS, this requirement has been met for non-prescription
lens wearers by providing two pairs of safety glasses, 1 clear and
1 tinted, and
WHEREAS , in order to provide similar protection for
prescription lens wearers the Town has been using goggles or full
face shield, which are hot, restrictive, and do not allow full
vision range for these employees, now therefore be it
RESOLVED, the Town Board of the Town of Ithaca does hereby
authorize the provision of one pair of photo-gray safety glasses
( single vision or bifocal, whichever is required ) through Ithaca-
Cayuga Optical at a cost not to exceed $55 . 00 for bifocals and
537 . 00 for single vision lenses, including repair or replacement
for work-related damage or change in prescription .

the Town Attorney subject to the appoval of the agreement by said
Attorney, and be it further
RESOLVED, said agreement shall state the Town of Ithaca would
not be responsible if the Town in acting to take care of the
sanitary sewer damaged the property, and that Mr. Ebert' s would
indemnify the Town and hold the Town harmless from any claims the
Town might have by reason of his working near the sewer .

Personnel functions has steadily increased over the recent past,

WHEREAS , the Town has in its current employ staff capable of
assuming the management of each of these areas if clerical/data
entry support was provided, now therefore be it
RESOLVED, that the Town Board of the Town of Ithaca does
hereby authorize the separation of the management of the Finance
and Personnel functions of the Town; does hereby appoint Sally
Alario as Assistant Budget Officer at a salary of $30 ,080; does
hereby appoint Pat Punger as Personnel Manager at a salary of
$25, 650. Both appointments are effective as of this meeting, with
review of salary levels and responsibilities at the end of the 6
month probationary period, and be it further
RESOLVED, the Town Board of the Town of Ithaca does hereby
authorize the creation and filling of an Account/Data Entry Clerk
position to assist in the day-to-day functions of both areas .

WHEREAS , the Town of Ithaca has entered into an agreement with
Shalebrook Development Corporation that unless they complete all
work a lien can be place on their property for the cost of
completing the work, and
WHEREAS, the agreement further states the lien is
automatically lifted when there is a sale to a bonafide purchaser
of a separate lot with a building on it, and
WHEREAS, Shalebrook Development Corporation wishes to sell
lots without buildings on them and are therefore requesting the
Town of Ithaca amend the agreement allowing the lien to be lifted
if there is a bonafide sale of a lot to a third party, now
therefore be it
RESOLVED , the Town Board hereby authorizes and directs the
Supervisor to sign an addendum to the agreement with Shalebrook
Development Corporation allowing the lien to be lifted if there is
a bonafide sale of a lot to a third party contingent upon the
review of the agreement and addendum by the Town Attorney.
