REGULAR MEETING The Regular Meeting of the Town of Cortlandville Planning Board was called to order at 6:30 p.m. by Chairman Chris Newell. APPROVAL OF MINUTES — 30 MARCH 2021 A motion was made by Member Ann Hotchkin to approve the Town Planning Board Minutes of 30 March 2021, as submitted. The motion was seconded by Member Nick Renzi, with the vote recorded as follows: Ayes: Chairman Newell Nays: None Member Renzi Member Parvizi Member Updyke Member Hotchkin Motion carried. This becomes Action #18 of 2021. OLD BUSINESS Builder's Best Home Improvement Center, Inc., Applicant/ Reputed Owner - 3798 Luker Road - TM #95.00-09-01.000 - Conditional Permit & Aquifer Protection District Special Permit - Proposed Warehouse Chairman Newell recognized Andrew Porter, representing the applicant who was seeking a Conditional Permit and Aquifer Protection District Special Permit to construct a 5,000 SF storage warehouse for this existing home improvement center's retail business. At the 30 March 2021 meeting of this Board, details of the proposed project were thoroughly explained in the documents accompanying the applications which were forwarded to the Cortland County Planning Board for their review. Mr. Porter said he had read the report from County Planning. He then explained that there will be no parking lot expansion. He displayed a rendering of the proposed warehouse to Board members; it will match the other building, be landscaped, pole barn construction, have minimal lighting on the building. He has submitted the airport information recommended in Item 2 of the County's report, and reached out to the FAA. With regard to review of the stormwater plan by County Soil & Water, PZO Weber advised that he had spoken with Kathleen McGrath who stated they had completed their Page 1 of 4 (T) Cortlandville Planning Board Regular Meeting Minutes 27 April 2021 review of the project and saw no problem with it. He also noted that green space was under the 50%, so no variance was needed. At the close of a brief discussion, a motion was made by Member Laird Updyke to approve the Conditional Permit for the proposed 5,000 SF cold storage warehouse, incorporating Items 1 thru 6 of the Cortland County Planning Board's Resolution No. 21-10 date 22 April 2021, with a recommendation made to the Cortlandville Town Board that they issue an Aquifer Protection District Special Permit and act as Lead Agency under SEQRA. The motion was seconded by Member Nasrin Parvizi, with the vote recorded as follows: Ayes: Chairman Newell Nays: None Member Renzi Member Parvizi Member Updyke Member Hotchkin Motion carried. This becomes Action # 19 of 2021. NEW BUSINESS Eastern Gas Transmission & Storage, Inc., Applicant/Raceway Holdings, Inc., Reputed Owner - 3747 US Route 11 - TM #97.02-01-06.000 - Conditional Permit - Temporary Contractor Yard Chairman Newell recognized Christopher Knight, representing the applicant who was seeking a Conditional Permit to establish a Temporary Contractor Yard at this vacant brush and dirt -covered 5.3± -acre location. His company has a maintenance project to replace approximately 1.2 miles of an existing 20 -inch gas pipeline and will be leasing this property for the duration of the project which will be completed by 1 November 2021. At that time, the property will be restored back to its original condition. The yard, he stated, would be used for employee parking, equipment staging, office trailers, minor storage of materials, and pipe welding between the hours of 7 a.m. to 5 p.m., Monday thru Saturday. Member Parvizi asked about noise generation onsite that would disturb neighbors. Mr. Knight stated that there was a quarry nearby and other businesses also. Chairman Newell asked who would oversee the restoration of the property once the yard is no longer needed, and PZO Weber responded that his office and the Code Office would take care of this. Member Nick Renzi asked if there would be any fencing, and Mr. Knight responded there are guard rails there that run along Route 11, but no fencing is planned. Site security will be provided. With regard to the NYSDOT, he advised that he has contacted them and is awaiting their permit. PZO Weber advised that Kathleen McGrath of County Soil & Water was reviewing any stormwater and erosion control measures. At the close of the discussion, a motion was made by Member Renzi to approve the Conditional Permit for the Temporary Contractor Yard, as requested. The motion was seconded by Member Updyke, with the vote recorded as follows: Ayes: Chairman Newell Nays: None Member Renzi Member Parvizi Motion carried. Page 2 of 4 (T) Cortlandville Planning Board Regular Meeting Minutes 27 April 2021 Wellhead Protection Area Moratorium Chairman Newell advised the Board they needed to discuss the proposed "Local Law Establishing a Moratorium Prohibiting the Approval or Expansion of Certain Uses and Development Within Any Existing Wellhead Protection Area in the Aquifer Protection District," a copy of which each member had previously received. A recommendation would then be made to the Town Board. Town Attorney John DelVecchio reviewed the document being considered and answered Board questions. The moratorium would be temporary and SEQRA would not be an issue. The ten activities listed on page 2 of the proposed local law being reviewed are prohibited on properties within the Aquifer Protection District in the current Code. What the Town "is trying to do here is to prohibit those exact activities on properties in the Wellhead Protection Areas as well," he said. At the close of the discussion, a motion was made by Member Ann Hotchkin that the Town of Cortlandville Planning Board recommends to the Cortlandville Town Board that they adopt the Local Law establishing a moratorium prohibiting the approval or expansion of certain uses and development within any existing Wellhead Protection Area in the Aquifer Protection District, as submitted. The motion was seconded by Member Parvizi, with the vote recorded as follows: Ayes: Chairman Newell Nays: None Member Renzi Member Parvizi Member Updyke Member Hotchkin Motion carried. This becomes Action #21 of 2021. EXECUTIVE SESSION At 7:07 p.m., a motion was made by Chairman Newell to go into Executive Session for attorney/client discussion. The motion was seconded by Member Updyke, with all Board members voting in favor. At 7:17 p.m., a motion was made by Chairman Newell to come out of Executive Session. The motion was seconded by Member Hotchkin, with all Board members voting in favor. No Actions Were Taken. 11 REGULAR MEETING — CONT'D OTHER DISCUSSION Member Updyke commented on the work being done along Route 11 between Cortland and Homer. PZO Weber advised the location was within the Village of Homer. • Chairman Newell confirmed that the next meeting of this Board will be 25 May 2021. I would like to extend my belated good wishes and special thank you to Joan Fitch for her untiring support of the Planning Board, not only during the meetings but in the production of the Minutes, Index of Actions and the countless times she makes sure that we dot the Is and cross the Ts. Your experience, competency and old world work ethic are refreshing characteristics in this new world. Joan, you are an important and integral part of the Planning Board and our success has its roots in the effort you put forth in making sure we are "doing it right." I have been on the Planning Board for about twenty-two years and have had the pleasure of working with and learning from Joan and, God willing, I hope to continue with you as my colleague.
