Paulette Terwilliger, Town Clerk, Bruce Bates, Director of Code Enforcement, Susan Ritter, Director of Planning Mr. Engman opened the meeting at 6:17 p.m. Agenda Item #1 Discuss and Consider Authorization for the Town Supervisor to sign a Pedestrian Access Easement and Right-of-Way Agreement for the Holly Creek Residences along Holly Creek Lane There were no questions regarding the proposed resolution. TB Resolution No. 2013—019: Authorization for the Town Supervisor to sign a Pedestrian Access Easement and Right-of-Way Agreement for the Holly Creek Residences along Holly Creek Lane Moved: Tee-Ann Hunter Seconded: Rich DePaolo Whereas, Ithaca Neighborhood Housing Services, Inc. ("INHS") is the owner and developer of the Holly Creek subdivision on Holly Creek Lane, and Whereas, although a sidewalk for the approved subdivision was supposed to be built just inside the Holly Creek Lane right-of-way owned by the Town of Ithaca, it was instead built just outside the right-of-way on private property in the subdivision, thereby creating the need for an access easement from INHS to the Town of Ithaca to assure the public's right to use the sidewalk, and Whereas, a Pedestrian Access Easement and Right-of-Way associated with the Holly Creek Residences along Holly Creek Lane has been discussed by the Public Works Committee, the Applicant, the Town Engineer and the Attorney for the Town, and Whereas,pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that acceptance of said Easement and Right-of-Way is a Type II action because it constitutes "routine or continuing agency administration and management, not including new programs or major reordering of priorities that may affect the environment," and thus this action is not subject to review under SEQRA, Now therefore be it Adopted 2/11/2013 TB 1-28-2013 Page 2 of 3 Resolved that the Ithaca Town Board hereby accepts the attached Pedestrian Access Easement and Right-of-Way and authorizes the Ithaca Town Supervisor to sign said Easement and Right-of-Way on behalf of the Town of Ithaca. Vote: Ayes—Hunter, DePaolo, Goodman, Leary, Levine, Engman and Howe Passed unanimously Agenda Item#2 Added --Approval of Minutes Mr. DePaolo noted that there was an unfinished sentence in the December 28th minutes and Ms. Terwilliger stated that she would listen and finish the sentence. She thought that his comment was regarding the Fire Contract. Vote. Ms. Hunter asked that Ms. Terwilliger listen to the audio of the January 7th minutes regarding the Comprehensive Plan Committee section and the word"forwarding"versus "recommending". The Board felt that in the beginning half of the meeting the word being used was forwarding and then in the later half, the word needed for the process and the specific wording needed was "recommending." TB Resolution No. 2012 -021: Town of Ithaca Abstract Moved: Bill Goodman Seconded: Tee-Ann Hunter WHEREAS, the following numbered vouchers have been presented to the Ithaca Town Board for approval of payment; and WHEREAS, the said vouchers have been audited for payment by the said Town Board; now therefore be it RESOLVED, that the governing Town Board hereby authorizes the payment of the said vouchers in total for the amounts indicated.
