A review of the above application was made on February 2B, 1991. The
applicant wishes to remove the existing house[two story] and replace
it with a 12?xS5I mobile home. Ouring'damolition of the house, the
applicant wishes to place the mobile home in a temporary position on
the side lawn of the lot in which to live. Electric power will be
relocated from the houee to the mobile-bome. Once the house, in removed,
the mobile home will be relocated running parallel with Bouts 200. Tie
trailer will utilize the existing septic tank and leech field installed
in 1SS3.
I have visited the eight and reviewed the application with the applicant.
Mr. Carwents children have left home and the house i■ too large,making it
too expensive to hest or maintain. The cellar wells are falling -in and the hou
structure in general disrepair. Although the board would prefer older
homes of this nature be restored, we feel it is perhaps best it be removed.
The board is agreeable to the application, but hes several recommendations
that it feels should be implemented before placement of a mobile home on
this lot. The Board recommend• the process be done in two phases:
PHASE *I- e] The lot be brought into compliance to Local Lew No.29
Section 3.10 by removing all inoperable vehiclep,ttleaeiilitser,rtEaoh,
etc.. [applicant plan■ to do) From the lot.
b) The discontinuance of the smell engine repair business in
an R-2 Zone. (applicant has indicated this is being done).
c) The shed that is attached to the front of the barn be
removed in order to make room for the mobile home. This is necessary to
Position the mobile home such that it will not interfere with the cemetery
and Stets DEC Fishing easements while in the temporary position. [applicant
intend■ to do]
d] Applicant apply for ■ zoning variance to place the mobile
home in the final position described by the applicant. This location is
approximately 20 Feet from the Right-of-way of Route 200 and 501 From the
centerline. Local Lew No.29 Section 3.6 requires 301 from a highway ROW
and 601 from the centerline. Note: The board feels this is acceptable
because the not-beckais deeper then the average „line -of -eight's of the
other houses on that aide of the road and will not have an 2idfrilfkW%IYJM
adverse effect on the house to the west. The boards howeverg feels that
the parch that is shown on the application be reconsidered in order to
preveotr.etfiurther encroachment on the Front yard set -beck.
PHASE #2: e] Upon completion of phase 819 the mobile home can be positioned
in the temporary location. The board recommends::Lk�stFceutionbe.nssd when
placing the mobile home to ensure no dammer is done to the leach Field
while the mobile home is in this temporary position. The positron of the
mobile home should be monitored by the Zoning Officer to insure safety.
b] The board recommends that demolition of the house be
completed no soon as possible. Lumber and debris from the demolition
must be removed From the lot and not allowed to accumulate. Care should
be taken to protect the environmental nature of Owego Creek.
c) Once the house is,removedg rapoaitioning of the mobile home
in the Final location should be completed according to Local low no.2.
The board recommends that this project be completed within 6 (six) months
From the issuance of the permit.

Meeting called to order- 7:02 P.M.

Minutes from Previous Meeting reviewed and accepted.
Old Business: Copies of laws, letters, etc. were distributed to members.
Additional copies are being made by the Town Clerk and will be distributed
at next meeting. [thank you- Betsy] It was discovered that the R.O.W
for State Highway Rt. 200 is 50 feet wide through the hamlet of Harford
Mille not the previously thought 65 feet that is standard for state high-
ways. After investigation it was found to have no impact on the set-
back venlencb mentioned for the Carmen property. This is due to the fact
that the mobile home,when,placed in the final position, will still
encroach into the set -back even with the narrower right -a -way.
New Business: Thompson Property, Harford Mills sight review. Application
was submitted late, but was able to be handled this meeting. After
discussion by members motion was made by Barb Stoner to approve, -second
by Joe Draghi and passed. (see submitted letter]

A letter and sketch was received by Clerk and forwarded to the board.
It appears to be a modification from a previous application. Because
it was incomplete the board could not act upon it. The paperwork is
being returned to the clerk for forwarding to Zoning Officer to complete.
There was a lengthy discussion about the processing of applications.
The board received copies of the Zoning Officier'e instructions for e
building permit, but that falls far short of what is required for a
completed sight plan epplicaticom The last two cases the board handled
were incomplete and had to be investigated by the board. This should be
completed by the Zoning Officer. Tom Canfield will contact the Cortland
County Planning Department to have someone come to a meeting to review
the planning procedures, time frames and agency responsibility. The
Board will invite the Zoning Officer, Town C1erk,Zoning Appeals chair-
person and any Town Board members that wish, to come. Date will be
made.

Site Plan Review- placement of mobile home on lot
which had previously had mobile homes on it. Relocation
of mobile home from another lot to this.
The planning board has reviewed this application and recommends
approval. The applicant should contact the Cortland County Health
Department to ensure the septic tank is acceptable with them. Note:
the applicant has already called the Health Department and received
their ok.
There was concern at first that the location in which the mobile home
was to be placed on was not large enough to hold a 70 foot mobile
home. [It is to be place qg;r. the old Borden's Milk Plant foundation.]
After investigation it was discovered that the plateau is large
enough to hold the mobile home and allow for the necessary set -backs.
The property size is barge enough for the placement and the water is
supplied through the public system.
It is requested that action be taken as soon as possible an approval
because the applicant's mother is due to return by mid April and
the applicant needs to start preparing the lot.
The board recommends the zoning officer_r monitor placement, etc..

Riaz Shaquat reviewed GML requirements that =squire routing to County

Planning Board. Any sight plan review within 500' of a state or county
highway, 5009neer state owned property with a building, 500' within
a town or county boundary must be reviewed by the county. Determination
for routing or For no planning board action id the responsibility of
the Clerk and Zoning Officer. Timeframes were discussed. Submittals
to County ahould be made not more then 20 days prior to the board meet-
ing. A general discussion of town zoning laws raised a number of
questions on whet should go to the Town Board for approval and whetl
requires Zoning Board of Appeals action only. It appears in the laws
i
it is state one way in one law and another way in another law. Thea
county is a source for information and extends any assistance the town
would like to request. The Planning Board also rsvie Atate Environmental
Equality Review submittals with Riaz. There is a greet deal of
information to ebaorb,in one sitting. The Planning Board will cell on
the county for assistance when needed in the future.
Grant Gleason- Request for variance. Mobiler•homes on property in
violation of zoning. Four mobile homes on property- constitutes e
mobile home park. The mobile homes occupied by Mr. Gleason's children
[2] were placed there to aid them until they [the childrenl get can
back on their feet. The mobile homes will then be removed. Mr. Gleason
has stated that he wishes to bring the lot into compliance. =AFter much
discussion, it was determined that although this is a hardship situation',-
hardship is not a justification for appnam6l For a perminete rezoning.
The board however, feels that in order to correct the situation,a °
temporary variance should be issued with a one year renewable condition.
This would allow the children time to improve their situation and would
provide the town with control over the problem. The Planning Board
recommends that the existing mobile homes be brought into compliance,
the mobile homes in question be occupied by the children stated ion the
attached letter from Mr. Gleason and that said mobile homes be removed
when vacated by these children.

The intention of the Board is to prevent the property from becoming a
perminent mobile home perk, At the end of one year the owner must

Apgar property- Submitted by Dean Carpenter to permit use of existing

submitted day of meeting and found to be incomplete. The board and

Zoning Officer had several questions that could not be resolved. The

application was returned to
the board felt that perhaps a special permit might be more in orders.

to better serve the town. The Board supports the town obtaining a copier
for the clerk.
The Planning Board has also set a deadline for applications that can be
handled within that month. Any application received after the iOth of •
each month will go on the agenda for the next month. This will peevent
lest minute applications and allow for a proper review by the Code
Enforcement Officer and the Planning Board.

ANALYSIS
This application is seeking a special use permit to convert

CONSOLIDATED AGRICULTURAL DISTRICT #1 IN THE TOWNS OF
CORTLANDVILLE, VIRGIL, HARFORD, LAPEER AND MARATHON
PLEASE TAKE NOTICE, that Consolidated Agricultural District
#1 within the County of Cortland was established on December 28,
1988 pursuant to Article 25 -AA of the Agriculture and Markets
Law.
PLEASE TAKE FURTHER NOTICE, that under Section 303 (b) of
the Agriculture and Markets Law, the County is required to review
a district eight years after its creation and every eight years
thereafter.
PLEASE TAKE FURTHER NOTICE, that during the 30 -day period,
between September 5 and October 4, 1996, any municipality whose

Tracey Thompson reported that the elder Mrs. Carman is no Inuger
living in the trailer on her son's property. Zoning Board of
Appeals will be notified.
Proposed zoning change on Creamery Road for the senior housing
project was discussed.
The following is our report:
We consider this is a "spot" zoning problem and we feel. tho
developers should go to the Board of Appeals for a variance. If a
variance is approved we would expect to have a site plan and
environmental impact statement to review. According to our Land
Use Ordinance Section 10, R 2, page 17, 10.3c. Dwelling units of
two (2) or more requires Site Plan Review.
(reference: Hill View Diner, 1980, was not re -zoned but sent
to Board of Appeals for variance which was granted and approved
by Town of Harford Planning Board and Cortland County Planning
Board.)
According to our Ordinance, Section 19, page 45"In accordance
with the General Municipal Law of the State of New York, Section
239-L and 239-M, all proposed zoning regulations, or any amendment
thereof, whi,ch!Iwould change the district classification of or the
regulations apOlyling to real property lying within areas defined
by the aforemeritiioned sections, and any proposed special permits

Minutes of Town of Harford Planning Board Meeting.
Planning Board met on June 19, 1996 at 7:30 p.m., second floor, Town Hall.
Present were: Chairman David Horton, Barbara Stoner, Jacob Chwalek, Mary Ann Negus. Tracey
Thompson was absent due to illness in the family. Also present were: developers of Creamery frills Housing
(Chris Calabro and Dana Hoffman) and 2 town residents.
Planning Board reviewed the building permit application of Pioneer Development. Several concerns were
raised concerning the application.
1. Name on the application. We asked for clarification as to who Pioneer Development was. It was
suggested that Creamery Hills, Inc. should be the applicant.
2. Intended use was listed as multi -family. Planning board suggested that this should be listed as senior
housing. Applicants wanted both listed.
3. Application was not signed.
4. Application was not notarized.
5. Statement of Compliance: New York State Energy Conservation Construction Code was not signed
and filled out completely.
It was requested of the developers to furnish the Planning Board with the following:
1. A completed building application (Preferably an original).
2. To contact a Mr. Peter Rynklewicz at the Cortland County Health Department regarding the water and
sewage systems.
3. A "Study of the Hydrologic Conditions for Waste Water Effect on the Neighboring Wells". This study
is requested in order to protect the wells and aquifer in the hamlet of Harford. It was related to the developers
that there had been past experiences with contamination of wells in Harford Mills from salt brine due to a
underground propane storage terminal. Also the former creamery had to eventually truck out their wastewater to
prevent damage to wells and this added to the reasons for the closing of the milk receiving plant.
4. It was suggested that the NYS Dept. of Transportation be advised of the proposed housing so they
would be aware of the increased traffic entering and exiting Creamery Road. Developers agreed to contact NYS
Dept. of Transportation.
Discussion of the number of parking spaces was addressed. Developers did not feel that the regulation of
2 parking spaces for each dwelling unit would be necessary for this project. This being a Waal area, some
members of the planning board felt it may be necessary to have the required parking. No decision was made at
this time.
Chairman Horton reported that he contacted Duff Roberts concerning the Carmen residence. Mr. Roberts
has submitted a letter to the Carmens requesting the mobile home that the elder Mrs. Carmen had occupied (she
has moved out), be removed per an agreement with the Town of Harford Zoning Board of Appeals.

Planning Board met on July 1, 1996 at 7:00 p.m. at the Town Hall
Present were: Chairman David Horton, Barbara Stoner, Tracey Thompson, Jacob Chwalek, Mary Ann
Negus. Also present were: Developers of Creamery frills Senior Living Center (Chris Calabro and Dana
Hoffman) along with their attorney, Pat Snyder. Also present were: Town Board member Ed Drake and 6 town
residents.
1. Chairman Horton expressed condolences to Tracey Thompson on the recent death of his mother.
2. Chairman Horton apologized to Chris Calabro for short notice of SEQR review meeting.
Discussion began on the SEQR review process with defining our role in the SEQR process. Attorney for
the developers, Pat Snyder, informed the planning board that we were not the lead agency for the SEQR process.
He presented the board with a copy of a letter from Town Attorney John Ryan.
After reviewing the letter it was decided that the planning board would wait until the Town Board
meeting on July 8, 1996 to see if the Town Board had removed us as lead agency for SEQR.
Dana Hoffman requested that a Site Plan Review be done at this time. Planning Board denied this request
as this was a scheduled meeting for SEQR purposes only.

Tues, Feb 18 7:30 P.M. at Harford Town Hall.
1. Welcome Bob and Dave.
2. From Town Law, section 271:
"The town board of each town is hereby authorized ...to create a planning
board... and shall .....appoint the members of such board and designate the chairperson
thereof. "
3. It is interesting to note that in this instance the Town Board is responsible for choosing
the chairperson. At our last meeting we briefly discussed this and agreed that perhaps it
would be best to have input from the Planning Board before the Town Board made an
appointment, thus the joint meeting. Two points of view exist:
a. The chairperson should be chosen from the 3 members with longevity, because
they have had experience serving on the planning board which would be of value to a
chairperson. They are also familiar with the local ordinances applicable to the planning
board's task.
b. The chairpersoh should not be from the 3 members with longevity, because of
problems of confrontation which arose this past year between those members and the
Town Board. Anew person would be neutral and therefore be in abetter position to
work with both the Town Board and the Planning Board.
Of course there are pros and cons to both views. J hope we can come to some reasonable
solution through this joint meeting, one which we can all support.

THE TOWN OF HARFORD PLANNING BOARD REVIEWED THE APPLICATION OF MR. LEE
KNUPPENBURG. IN ORDER FOR THE PLANNING BOARD TO RENDER A DECISION THE
FOLLOWING MUST BE DONE:
1) SECTION 239-M OF THE GENERAL MUNICIPAL LAW requires that any structure placed
within 500 feet of the right-of-way of any existing state parkway, thruway, expressway, road or highway
must be submitted to the county planning board for review. Since the diagram indicates that the mobile
home will be placed 460' from the centerline of State Route 38 the application must be presented to the
Cortland County Planning Board for review. The other option would be to move the mobile home from
460' to 550' from the centerline of route 38.
2) A complete Mobile Home Application is required by the planning board. The application we
received does not indicate placement of any of the utilities or driveway to the home.
This Mobile Home Application should be returned to Mr. Knuppenburg to be completed. Once completed
it should be returned to me and I will submit it to the Cortland County Planning Board for review. Once a
recommendation has been rendered by the Cortland County Planning Board the Town of Harford Planning
Board will review the application and render its decision to the Harford Town Board for review at their
next scheduled meeting.
It should also be noted that if this land is sold that a minimum lot size of 30,000 (150'x 200') square feet
is required according to section 8.4 of the Town of Harford Land Use Ordinance dated December 1973.

rejected for (1) Incomplete map diagram. Failure to show
location of utilities, septic and bordering property owners.
(2) Violation of Section 239-M of the General Municipal Law of
the State of New York due to property lying within a distance of
five hundred feet of existing state highway.

Thompson has placed a notice in the Cortland Standard and posted

A meeting was held at the Harford Town Hall on June 17, 1997
convening at 7:30 p.m. The minutes from the May 20, 1997 meeting
were presented and approved.
Copies of the Cortland County General Municipal Law Referral
Policy were distributed by Tracey. The Policv allows for certain
zoning referrals to be returned to the local municipality without
County Planning Board review if such matters are of local rather
than inter -community or county -wide concern.
An application submitted by Christopher and Becky Stone of 57 Rt.
200, Harford Mills, N. Y. for construction of an above ground
swimming pool was reviewed. Since Betsy was out of application
forms, the request was submitted with the intention of being
placed on an application when the new order was received by
Betsy. The Planning Board found the application to be acceptable
and recommends approval. The application has been forwarded to
the Town Board and/or the Town Zoning Board of Appeals for
approval as required by section 15.8 of the Town of Harford Land
Use Ordinance.
Calvin Jones resubmitted an application for Mark and Susan Dawson
to place a mobile home on a lot located on Owego Hill Road. The
application was revised to show the lot size and location of the
mobile home, well and septic. The Board felt that the utilities
needed to be more clearly marked on the drawing. The Board also
supports the Cortland County recommendation that the septic tank
and distribution box be uncovered and inspected to determine the
integrity of the sewage treatment system. The application was
approved pending clear marking of utilities on the drawing
included with the application.

services offered by Knapp were determined to be of no interest to
the Board. Tracey will keep the material on file in case there
is any individual interest in the future.

A meeting was held at the Harford Town Hall on December 16, 1997
convening at 7:30 p.m.
A Guide to Laws was distributed to the members by Tracey and
discussed. The Guide was part of the Cortland County Planning
Department's annual training program which Tracey and Barb
attended November 7&8, 1997. The Guide includes General
Municipal Laws, General City, Town and Village Law.
The Board then discussed topics which need to be addressed at
future meetings. The Board agreed that it needs to look at
concerns other communities are experiencing such as
Telecommunication Towers, Subdivisions and Nightclubs. Tracey

Stoner explained that it was brought to her attention that the unit
to be placed on the Adams Road -Daisy Hollow property was not a
"double -wide" in the normal sense. It was also noted that the
application had not been reviewed by the Town Board due to the Code
Enforcement Officer- not returning the application to the Town Clerk
in time for the meeting on February 2nd.
Discussion followed about the unit being built as temporary housing
only;in 1980 for the Olympics at Lake Placid. The unit, according to
the Town of Dryden Code Enforcement Officer, has no New York State
Seal which is required on mobile units after- 1976 (HUD requirement).
Dave Drogo suggested we have the Town Board check with our Town
Attorney and see what the State code is, as called for in our Mobile
Home Ordinance.

The Harford Planning Board met for a regular meeting on January 20, 1998 at the
Harford Town Hall, Harford, NY at 7:30 p.m.

Reviewed the application of Hatfield, Neff, Hathaway, et al, for the replacement of
property to be control burned. The Board reviewed the application. The lot was shown to
be 125 X 200. We determined the lot had to be 150 X 200 (30,000) sq. ft. to conform to
the ordinance. The property was purchased with an existing house. Because the new
owner decided to have the house burned did not meet the "replacement' definition.
Dave Drogo made a motion to grant conditional approval pending increasing lot size to
150 X 200. Barb Stoner seconded. All in favor.

Minutes of the March 1998 meeting were read and approved.
Tracey presented a letter which he received from Burr Phelps
(Code Enforcement Officer) for the Board members' information
regarding the Hatfield application submitted at the January 1998
Planning Board meeting. The Code enforcement Officer has cited
seven items in violation of codes.
The Board reviewed an application for Michael Shipman for
placement of a 14x60 mobile home on Daisy Hollow Road. The
application was found to be in order and approved.
The Board discussed revising the application form to include
filing requirements. This would make the filing process more
efficient and provide the applicant with directions for properly
completing the application.
The topic of Subdivision Ordinance was discussed. Jake reported
that the Town of Richford is currently considering a Subdivision
Ordinance and is reviewing the Town of Owego's Ordinance as a
model.
The Board discussed its authority over Subdivision Ordinances.
The Town of Dryden Planning Board has authority over
subdivisions, whereas the Town of Harford Planning Board does
not. The Board agreed that it required clearer direction from
the Town Board regarding its duties and authority over
subdivisions before it could do further work on ordinances for
subdivisions. Tracey agreed to attend the July 6th Board meeting
to discuss (1) The Planning Board's purpose for review of
subdivisions (2) The Planning Board's authority regarding
subdivisions.

Minutes of the June 1998 meeting were read and approved.
Tracey reported that the Town Board has decided that there is no
need for subdivision regulations for the town of Harford at this
time. The Planning Board will remove subdivision regulations
from its agenda. It will proceed with adult entertainment and
ordinance for age of mobile homes at future meetings.
Tracey suggested that future minutes of the Board meetings should
be labeled a draft subject to approval before submitting to the
Town Board. The reason for this being that the Planning Board
members do not approve the minutes until after the Town Bcard has
included them on the agenda for their meeting. Board members
agreed that future minutes shall be so labeled.
Tracey advised that he has developed a mobile home application
form that will be greatly improved from the existing application.
It should help the applicant in following requirements for
approval and assist the•Board in receiving properly completed
applications. Tracey is currently looking at the use of multiple
form paper. The new form will be discussed at the next Planning
Board meeting.
An application from James Farnham was submitted for a mobile home
to be placed on property located at Route 200 and 38. A review
of the application showed that the lot does not meet the minimum
lot'size required by the Land Use Ordinance. The application was
rejected due to non-compliance and violation of the Town's Land
Use Ordinance.

The Board reviewed an application for Howard Hilsinger, Jr. to
place a 1971 mobile home at 1026 Daisy Hollow Road. The
application was in order and was approved pending the code
inspector's approval. Since the mobile home is not HUD approved,
it does not meet code requirements and may require modifications.
The Board discussed the growing concern over mobile homes older
than ten years and not meeting HUD requirements being permitted
for use in the Town of Harford. Most neighboring communities
have zoning ordinances in place to address this issue. The Board
believes this issue poses significant risk exposures and safety
issues for the Town of Harford. The Board requests that the
Town Board immediately place a moratorium on all permits
submitted for mobile homes older than ten years until appropriate
regulations can be instituted by the Town Board.

demolished. Recommendation that the plan be made in two

3.10 of Local Law No. 2. The discontinuance of a
small engine repair business in an R-2 zone. The
removal of the shed on the front of the barn in
order to allow positioning of the mobile home.so as
to not interfere with the cemetery easement and the
DEC fishing easement. Apply for a zoning variance
for front yard Get -back. Board ok's placement, but
suggests reconsideration of porch on front of
trailer, because of further encroachment.
Phase #2: Completion of phase 91. Caution be used
over leach field. Zoning Officer to monitor'place-
ment. Lumber and debris from house demolition will
be removed and not accumulate. Reposition of Mobile
Home completed according to Law No.2. Board re-
commends project be completed within six months of
