REGULAR BOARD MEETING
November 5, 1987
At a Regular Meeting of the Town Board of the Town of Ithaca,
Tompkins County, New York, held at the Town Offices at 126 East
Seneca Street, Ithaca, New York, at 7:00 P.M. , on the 5th day of
November, 1987, there were:

PUBLIC HEARING TO CONSIDER THE 1988 TOWN OF ITHACA PRELIMINARY
BUDGET
Proof of posting and publication of a notice of a public hearing to
consider the 1988 Town of Ithaca Preliminary Budget having been
presented by the Town Clerk, the Supervisor opened the public
hearing.
Supervisor Desch called the Board's attention to a couple of
changes, the only one having an influence on the tax rate is in the
Fire Protection District on page 19. It involved the contract with
the Village of Cayuga Heights which in the Tentative Budget was
$43,000 and has been reduced to $38,796. The reason being we have
the actual figures from the Village rather than the estimated
figures. That figure also includes the second year payment on one
the fire engines that the Village has rebuilt, which amounts to
about $5,000 per year. He went on to say that the other changes
have to do with the water and sewer budget and the Phase I and
Phase II capital projects relating to the water and sewer
improvements. On page 15 there are same small adjustments under
Transmission and Distribution. It comes about by virtue of the
fact that we borrowed money for the initial phase of the project.
On the Thursday after Black Monday, we borrowed $900,000, with the
Bank of New York, the borrowing rate was 5.770. Unfortunately the
• investment rate was not as good we might have gotten had we been
even a week earlier. On the other hand it really doesn't matter
that much because of the new IRS ruling, the Tax Reform Act of 186,
prohibits you from making much in the way of interest, so the
spread is not as critical as it used to be. Our investment,
instead of locking it in for six months, we locked most of the
money in for 90 days in case the interest rates go up. Similar
adjustments were made in the sewer fund.

The Supervisor went on to say that if you look at page 25, you will
then see that the tax rate for fire service is slightly lower than
it was projected to be. If you take the earlier figure of 9% cut
it becomes a little less than 9.5% now.
Councilman Cramer asked, in review of the Fire Protection budget,
and the IRS ruling, will there be a capital fund line established
for the fire stations
Supervisor Desch replied no, since the City will be doing the
borrowing they will have the capital project. Two steps will take
place, one is that at some point this Board will have to decide
whether it is happy with the design and the project target cost.
• At that particular time if we agree on a number then the second
aspect is what we concur with the City as far as the term of the
borrowing, whether it is a 20 year borrowing and the amount of the
borrowing. Our particular debt service costs will be shown in the
Operating Budget once those decisions are made. At this point in
time as far as the project is concerned, the first architect
estimate came out, per station, at $1,200,000 instead of $600,000
which was what both parties had been talking about. The architect
has identified well over $300,000 in cuts without seriously cutting
the program. One of the things we are looking at is the
feasibility of building the upper portions of the stations as a two
story building rather than one story. That should result in a
significant savings.
As no one present wished to continent for or against the budget, the
Supervisor closed the public hearing.
RESOLUTION NO. 235
Motion by Councilman McPeak; seconded by Councilman Cramer,
RESOLVED, that the Town Board of the Town of Ithaca hereby adopts
the Preliminary Budget for 1988 as the final Budget for the fiscal
year beginning January 1, 1988. (Copy attached to minutes) .

1988 SOUTHERN CAYUGA LAKE INTERMUNICIPAL WATER COMMISSION
PRELIMINARY BUDGET
Proof of posting and publication of a notice of a public hearing to
consider the 1988 Southern Cayuga Lake Intermunicipal Water
Commission Budget having been presented by the Town Clerk, the
Supervisor opened the public hearing.
Supervisor Desch reported that there are no changes in the budget
from the Preliminary Budget, as presented. He went on to say that
as he indicated before, we will have to monitor it closely to see
if the revenues, in particular, are tracking in relation to the
forcasts that are here. If during the first few months of 188 they
don't measure up to what we are expecting, we may need to consider
• a rate increase in April. One of the major sources of revenue,
which is a change over the previous year, is called a water service
charge. You see roughly a $35,000 increase there. That primarily
is due to the connect of users to the new Town of Lansing water
mains. Those users, in accordance with the Intermunicipal
Agreement, are required to pay a $250 connection charge by virtue
of the rest of us having paid ten years on the debt retirement.
Councilman Cramer asked if there had been any discussion about the
Commission reinstating the meter reading policy? He noted that he

had brought this up before and that is was not a budget item but
one that concerns a lot of residents in the Village.
Supervisor Desch replied, if a vote were to be taken at the
Commission probably the vote would be in favor of reading every two
years. The problem is staff, however, the Commission may have to
add staff anyway. This is not a dead idea. The Supervisor stated
that he has expressed the Town of Ithaca's preference of every
year, He noted that the large user meters are being read by the
Commission.
RESOLUTION NO. 236
Motion by Councilwoman Raffensperger; seconded by Councilman
Cramer,
RESOLVED, that the Town Board of the Town of Ithaca hereby adopts
the Southern Cayuga Lake Intermunicipal Water Commission
Preliminary Budget for the year 1988 as the final budget for the
fiscal year beginning January 1, 1988. (Copy attached) .

PUBLIC HEARING TO CONSIDER THE 1988 ASSESSMENT ROLL FOR SPECIAL
BENEFIT DISTRICTS
Proof of posting and publication of a notice of a public hearing to
consider the 1988 Assessment Roll for Special Benefit Districts
having been presented by the Town Clerk, the Supervisor opened the
public hearing.
Supervisor Desch stated that the Water and Sewer Benefit Assessment
Roll which delinates for all of the benefited properties the amount
of the benefit in the number of units in relation to the Town's
formula, whether it be frontage, acreage or combinations, or
population in the case of the schools. This year with the level of
construction that is taking place, we went through all the Building
Permits, etc., and made the necessary changes. If approved
tonight, it will then go to the County to be put into the computer
and thus it will show up on the tax notices.
Councilwoman Raffensperger stated, we keep discovering extra units
do we check water consumption to pick up places that we think are
single family homes that have been changed to two families?
Supervisor Desch responded no, it's virtually impossible . to
distinguish between one and two family units as far as consumption
goes because there are a lot of one family units that use more
water than two family units. However, the Building Inspector,
through his travels pretty well knows those that are two units. We
did pick up quite a few two family units that were shown as one on
the preliminary roll. As far as the Building Permits are
concerned, instead of going back just a year ago October we went
back three years because we weren't sure that during the past two
Years, with the changes in personnel, that we had picked up all the
changes.

SALARY ADJUSTMENT FOR ACTING HIGHWAY SUPERINTENDENT
Supervisor Desch remarked, as you know our Highway Superintendent
has been ill for a long time, Bert Dean was made Acting Highway
Superintendent on September 1 with the expectation at that point
that he would not have to serve in that capacity for a very long

time but it appears now that not only has he been Acting
Superintendent for a month but it looks like it could very well be
for another month. The Supervisor went on to say that it was
normal practice to authorize the increase in salary during the
period that the person is serving in that capacity, half the
difference between his salary in his regular job and the
Superintendent's salary. Mr. Dean's annual salary is $22,672 and
the Highway Superintendent's salary is $25,228, a difference of
$2,556.
RESOLUTION NO. 243
Motion by Councilman Cramer; seconded by Councilwoman Howell,
• WHEREAS, Bert Dean, Highway Foreman, has performed the duties of
Highway Superintendent during the absence of the Superintendent due
to illness and,
WHEREAS, Mr. Dean has performed all duties required of him in a
cooperative and highly satisfactory manner,
NOW THEREFORE BE IT RESOLVED, that the Town Board of the Town of
Ithaca hereby authorize that a salary adjustment be made to Bert
Dean's salary equaling one-half of the difference between the
salaries of the Highway Superintendent and the Highway Foreman and
be paid retroactively to September 1, 1987. This salary adjustment
is a temporary adjustment to be discontinued once Mr. Dean is no
longer required to perform the added duties of Highway
Superintendent.

FIRE PRO`IECTION CONTRACT
Proof of posting and publication of a notice of a public hearing to
consider the Fire Protection Contract having been presented by the
Town Clerk, the Supervisor opened the public hearing.
Supervisor Desch remarked, as you know in 1988 we will be in the
second year of the contract with the City and an on going contract
with the Village of Cayuga Heights. The fire budget is a separate
district, being a protection district, we should discuss this
separately. The main point being there were two issues that were
not included in the Tentative Budget that was presented to you that
were included in the request that the Mayor sent to us. That being
the salary of the additional Assistant Chief which is above and
beyond the roster covered by the fire contract and also the
part-tine position for account/clerk typist which also was not in
the roster, included in the contract. He stated that the wanted to
give the Board the opportunity to include these if they felt so
inclined, we would need to change the Fire Protection Budget. He
went on to say that the feeling was that since we spent a
considerable amount of tine discussing the entire roster of the
Fire Department during the contract negotiations that our position
had not changed, we did not feel the need was there for additional
personnel. Therefore, it was not included. He asked the Board if
they had changed their position.
CouncilWman Raffensperger remarked, that she heard today that
there is also a proposal before the City for the addition of a
number of fire fighters and she went on to say that she assumed the
Town had some ability and contingency to meet whatever we decide we
think we can support.
Town Board 7 November 5, 1987
Supervisor Desch replied, another way of putting this is that none
of these proposals, whether or not they are accepted by the City,
will have an influence on the Town's cost because our costs are
based on the 44 fire fighters and a fixed number of officers.
Councilwoman Raffensperger questioned, we get a chance to approve
additions?
Supervisor Desch replied, that is right. The City has to come
forward and say they have included in their 1988 budget an
additional chief or an addition fire fighter and then they will
send that to us for our consideration.

DELINQUENT WATER AND SEWER CHARGES ON 1988 TAX ROLL
RESOLUTION NO. 245
Motion by Councilman McPeak; seconded by Councilwoman Howell,
RESOLVED, by the Town Board of the Town of Ithaca that delinquent
Town of Ithaca water and sewer bills in the amount of $8,031.74 and
delinquent customer repair bills in the amount of $462.57 be added
to the tax roll for 1988, as a lien against the properties
involved, and to become due and collectible as part of the tax
bills for the Town of Ithaca which will be mailed to property
owners on December 31, 1987, and which will become due in January
of 1988.

COMPUTER FOR JUSTICE WALLENBECK
Supervisor Desch stated that he had a request from Justice
Wallenbeck to add a 20 Megabite hard disk drive to his micro

PART-TIME HELP FOR JUSTICE WALLENBECK
The part-time help that Justice Wallenbeck hired to input his

time period until the 90 hours are used up.

SOUTHERN CAYUGA LAKE INTERMUNICIPAL WATER COMMISSION - PLUMBING
REVIEW ADVISORY BOARD
Supervisor Desch noted a letter the Board members had from the
Supervisor as Treasurer of the Commission. Over the past couple of
months the Commission has had a number of discussions with, in
particular Plumbing Contractors, to try to overcome communications
problems in the very rapid pace of water and sewer inspections
that are occurring, not only in the Town of Ithaca but throught the
Commission system. The discussions in several cases were rather
adversarial and sometimes a little difficult to get people to stop
and listen to the problems and common solutions. So what evolved
out of that was that the Water Commission has established a
Plumbing Review Advisory Board to get the plumbing inspectors and
the plumbing contractors together so that the difficult job of
interpreting plumbing codes can be done in an open way rather than
adversarial way. In creating the makeup of that Board he stated
that he recommended to the Commission and they accepted it subject
to the various municipal approvals, to have the Town of Ithaca Town
Engineer a voting member of that body. The reason being that we
have a great deal at stake making sure that the standards that are
applied in the Town are what this Board wants. The reason for
coming back to the Board is that it is obviously a time commitment,
he did not think it would be significant, but all of these things
have a way of adding up. He asked the Board what their pleasure
was as to whether the Town Engineer becomes a voting member.

REJECTION OF COMPUTER BIDS
Eric Whitney, Assistant Engineer stated that only two bids were
received. Of the two bids, one was considerably lower than the
other. One bidder was from Elmira on the other one from
Tr mlansburg. We would like to reject both bids on the basis of not
enough bids and not enough qualified bidders. The lower bid would
be put together in a shop in Elmira, it had no service other than a

very, very small company, they have only been in business for three
years. In light of what happened to use with our last purchase,
with our PC Limited out of a place in Texas where we cannot get any
service in this area, which caused several months downtime, we
would like to reject both bids.

BOLTON POINT WARRANTS
RESOLUTION NO. 251
Motion by Supervisor Desch; seconded by Councilwoman Howell,
RESOLVED, that the Bolton Point Warrants dated November 5, 1987, in

$87,118.18 after review and upon the recommendation of the Southern
Cayuga Lake Intermunicipal Water Commission, they are in order for

• Supervisor Desch noted that the Board members had some information
to study between now and November 16th. One is the Traffic
Ordinance which reflects the change in parking restrictions on
Coddington Road and the addition of the Forest Hare stop signs
which will be the subject of a hearing on the 16th. Secondly, we
have a local law having to do with the creation of a Special Land
Use District on East Shore Drive relating to the Chamber of
Commerce as well as modified updated environmental review
information.
Town Board 10 November 5, 1987
Town Attorney Barney stated that he did not have much to add, but
he would appreciate any comments on the proposed local law. He
went on to say that the way the environmental process is, he
doubted that any action could be taken on the 16th.
Supervisor Desch remarked, we will probably be adjourning the
hearing on the 16th until the completion of the period.
Town Attorney Barney indicated that it was our understanding that
we could do the lead agency and conditional negative declaration
concurrently so that the time period would run concurrently. That
appears not to be the case so now we need to readopt the
conditional negative declaration and wait another period of 30 days
• from the date it is published in the environmental newsletter then
take your final action.
Supervisor Desch remarked, so if we chose on the 16th to confirm
the conditional negative declaration then that would trigger the
process. He encouraged the Board members to talk with the Town
Planner if they -had any questions so that the Board would have the
most complete information available on the 16th.
Councilwoman Raffensperger noted that Eastern Heights was not on
the list of streets where parking had been banned even though there
are signs up there which say no parking.
The Supervisor asked if this was a separate ordinance?
Town Attorney Barney replied that he and the Town Clerk had gone
through the Ordinance Book and we attemped to pull out and site
ever ordinance on parking that we could find. We could have missed
an ordinance, I suppose.
Councilwoman Raffensperger stated that she recalled the Board
Passing one a couple of years ago but she could not remember
exactly when but people came in asking for it and we did it partly
because of the difficulties snow plows were having up in the winter
time.
Supervisor Desch noted that the Board members also have a packet of
information having to do with changes that the Codes and Ordinances
Committee has recommended. He stated that he would like to discuss
these on the 16th, however, there will more coming shortly after so
setting a date for a hearing will probably take place after that.
We should work out way through them so that we are ready for the
hearing.
Town Attorney Barney asked, on the truck ordinanance, we have done
some looking and we are finding it very difficult to catagorize in
such a way that it will not either exclude any kind of a trucks
including pickup trucks or going by weight. We have looked into
the law and called the Motor Vehicle Department locally and Albany
the classification for trucks isn't weight oriented.
• Councilman Cramer replied that the concern was not so much with
Pickup trucks as with trucks over a certain weight requirement that
had a braking system that was infact injurious to the neighborhood.
The problem is that you eliminate school buses that would fall into
that category.
Town Attorney Barney replied, we can alway exclude for local pick
up and delivery so school buses would probably be the exception.
The problem with using weight is the problem because if we don't

have the enforcement mechanism, the ordinance now says five ton
limit, but the enforcement officers have no scales. The weight
that is shown on your license is a gross weight that you are
permitted but it may not necessarily be the weight that the vehicle
presently has on it as you are going through. So you really need
to run them up on scales to see if they exceed five tons even
though they may be allowed to carry 6 or 7 tons. Unless we were to
design an ordinance that says vehicles with permissible maximum
gross weight over a certain amount are excluded in which event the
enforcement would then be just looking at the license. We will
take your guidance.
Supervisor Desch asked, what would happen if you did it according
• to the size of tires?
Mr. Zaharis, in attendance, replied there are many vehicles with
larger size tires on the markets. 99% of the trucks on the road
today use air brakes, and 85% of those use a Jacob clutch brake,
which if you don't have a good muffler you could shatter windows.
The other problem is the State maximum limit for any kind of a
motor carrier is 68,000 lbs. being registered under an "R" Permit
basis.
Town Attorney Barney suggested that perhaps the Town might want to
consider purchasing the scales and lending them to the Sheriff's
office to use in the purpose of enforcing the ordinance and say
with the five ton limitation.
Councilman Cramer remarked that he believed that Cornell Safety
last year purchased a set of scales for use in weighing coal trucks
as they went through the Honness Lane and Pine Tree Road areas.
Town Attorney Barney remarked that there was a certification
problem also, the scales have to be accurate.
Supervisor Desch asked the Town Attorney to pursue the problem and
bring it to a conclusion as far as definition is concerned and that
the Engineering staff check on the scales. He asked the Town
Attorney if he felt he had run into a dead end?
Town Attorney Barney replied yes, he felt like he was bouncing his
head against a wall.
PRELIMINARY PARKS WORK PROGRAM
Rich Schock' Parks Manager stated that basically his highest
priority was to develop the Grandview Park site adjacent to
Slaterville Road next to the new Grandview Heights subdivision.
The grading of a ballfield, reseeding, access for parking, site
furnishings, etc. Number two is getting the initial site work done
at the Deer Run Park site behind the Troy Road Pump Station
adjacent to the Deer Run subdivision. We hope to do a small lawn
area there as well as a playstructure in a couple of years. In
addition, site work at the Westwood Hill Park site off of Woolf
Lane and Grove Road is on the agenda. We would have a small lawn
• area there, playstructure eventually and nature trails, that sort
of thing. Another major project that we anticipate sometime in the
Spring of '88 is the landscaping, seeding and regrading of Dates
Drive. This would be the first year of a five year commitment
toward landscaping and plantings, etc. The next item would be the
completion of the half-court basketball in the Hungerford Heights
Park off of Snyder Hill Road. The base was laid this year, we
built a playstructure and did additional plantings, etc., in the
park but did not get a chance to complete the basketball court. He
went on to say that he hoped, early in the year, to do further work

on getting a grant proposal together for the South Hill Trail
project. One last major item would be the completion of new routed
signs for all of our recreation way entrances and exits, such as we
have done for the parks and installed this year. They turned out
really well. Don Ten Kate will be spending a major part of his
indoor time this winter making these signs.
Councilwoman Raffensperger asked Mr. Schock if he planned on having
some kind of a public informational meeting at a Planning Board
meeting about these proposals for the parks? She stated that she
recalled, only too well, what happens if you don't have a public
meeting.
Town Planner Susan Beeners responded that normally we have a
meeting in March or April.
Councilman Cramer remarked that it would be nice to have a map
showing all of the Town of Ithaca parks and an indication of the
overall cost of maintaining these parks.
Rich Schock replied that they have updated the Park and Open Space
Map recently and that he would be glad to put the cost figures
together.
YOUTH SERVICES
Supervisor Desch advised the Board that Can Council had adopted
a resolution recommended by the City Youth Bureau with some slight
modification in it. He went on to say that he would watch to see
how things develop in the next several weeks. There have been some
discussions with the County but he the felt the chances of a
contract for next year were about 300. The Supervisor went on to
say that he had received quite a number of letters from
constituents in response to the Newsletter indicating their
thoughts on what to do as far as financial commitments. He stated
that he would leave his folder with the Town Clerk so that Board
members could read them.
WATER AND SEWER CONTRACT
Town Engineer Flumerfelt remarked that he would like to update the
Board on the water and sewer contract. We expect that on Monday
the ground will be broke on both the water and sewer project and
the Hospital Access Road.
Supervisor Desch noted that the traffic light at the entrance to
the Hospital is under construction.
Eric Whitney, Assistant Engineer reported that one -of the Cornell
Work Study Tradition students, Paul Look, on his own time this
week, and after being flustrated entering data points took our
basic program and wrote a program that does in ten minutes what it
used to take us ten hours to do, to reduce survey points into the
Cad system for drawings.
Councilman Cramer noted that the Town Highway Committee has
redesigned the snow plowing routes at the request of the
constituents in Eastern Heights and Forest Home. Instead of the
traditional four snow plow routes that existed in the Town of
Ithaca at a cost of $1,800 to the Town we have picked up a fifth
snow plowing route, thus cutting the plowing time down in Eastern
Heights and the Forest Home area.
