Home My WebLink AboutTB Minutes 1986-11-17 TOWN OF ITHACA SPECIAL BOARD MEETING November 17 , 1986 At a Special Meeting of the Town Board of the Town of Ithaca , Tompkins County , New York , held at the Town Offices at 126 East Seneca Street , Ithaca , New York , at 7 : 00 P . M . , on the 17th day of November , 1986 , there were : • PRESENT : Noel Desch , Supervisor Henry McPeak , Councilman Shirley Raffensperger , Councilwoman Marc Cramer , Councilman Gloria Howell , Councilwoman Robert Bartholf , Councilman Patricia Leary , Councilwoman ALSO PRESENT : John Barney , Town Attorney PLEDGE OF ALLEGIANCE The Supervisor led the assemblage in the Pledge of Allegiance . DISSOLUTION OF EXISTING FIRE PROTECTION DISTRICTS Proof of posting and publication of notice of a public hearing to consider the dissolution of existing Fire Protection Districts consisting of the entire area of the Town of Ithaca outside of the corporated limits of the Village of Cayuga Heights having been presented by the Town Clerk , the Supervisor opened the public hearing . Supervisor Desch stated that the Town and City were still negotiating and , therefore , no action would be taken on dissolving the districts at this meeting . The Supervisor closed the public hearing and adjourned the matter indefinately . PERSONS TO BE HEARD Mr . Joseph Freedman , 230-232 Pennsylvania Avenue stated that he was charged for 2 units of water and 2 units of sewer on his property and he felt he was being overcharged one unit each . Town Attorney John Barney responded that Mr . Freedman was being assessed for two lots because he owns two separate plots . If they were consolidated then you would have a basis for a refund but you could build a building on each lot , as they now stand . LOCAL LAW TO ESTABLISH SEWER RENT RATES TO PAY TOWN ' S SHARE OF DEBT ITHACA AREA WASTEWATER TREATMENT FACILITY Proof of posting and publication of notice of public hearing to consider a local law to establish the sewer rent rates to be charged to consumers to pay the Town ' s share of the debt not included in the sewer rate for the Ithaca Area Wastewater Treatment Facility having been presented by the Town Clerk , the Supervisor opened the public hearing . Town Board Minutes 2 November 17 , 1986 Supervisor Desch stated that the local law was not ready for adoption tonight , therefore , it will be considered at the December meeting . RESOLUTION N0 . Motion by Supervisor Desch , seconded by Councilman Bartholf , RESOLVED , that the Town Board of the Town of Ithaca will meet and conduct a public hearing at 7 : 15 P . M . , on December 8 , 1986 to consider a local law to establish the sewer rent rates to be charged to consumers to pay the Town ' s share of the debt not included in the sewer rate for the Ithaca Area Wastwater Treatment • Facility . (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none ) . BUDGET AMENDMENT RESOLUTION N0 . Motion by Councilman Cramer ; seconded by Councilwoman Howell , BE IT RESOLVED , by the Town Board of the Town of Ithaca that authorization is hereby given for Burns Road Capital Project to borrow funds amounting to $ 16 , 000 from 1984 Sewer Improvement Capital Projects to be repaid upon receipt of Federal-State grant monies , borrowing to be effective as of October 31 , 19860 (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none ) . APPOINZP= OF SECRETARY FOR PLANNING/ ZONING/ENGINEERING DEPARTMENTS RESOLUTION N0 . Motion by Councilman Cramer ; seconded by Councilwoman Raffensperger , WHEREAS , approval was given by the Town Board to advertise for a Department Secretary to assist the Executive Secretary of the Engineering , Planning , Zoning , Parks and Highway Departments , and WHEREAS , advertisement has been made and candidates interviewed by a committee consisting of Henry Aron , Nancy Fuller , Susan Beeners , and Connie Allen , BE IT THEREFORE RESOLVED , that , at the recommendation of the above named committee , the position of Department Secretary be offered to Mary S . Bryant at a salary of $ 6950 /hour , appointment to be effective the first week of December 1986 , and • BE IT FURTHER RESOLVED , that the following budget amendment be approved to appropriate funds for this position for the balance of 1986 : Appropriate $ 1 , 300 from General Fund Outside Village Fund Balance and increase General Fund Outside Village appropriations B8010 . 100 Zoning Personal Services $ 650 and B8020 . 100 Planning Personal Services $ 650 . Nays - none ) . VOUCHER - ZONING BOARD OF APPEALS SECRETARY RESOLUTION N0 . Motion by Councilman Cramer ; seconded by Councilwoman Howell , RESOLVED , that the Town Board of the Town of Ithaca hereby • authorize payment of $ 50 . 00 for secretarial services performed by Beatrice Lincoln for the Board of Zoning Appeals . (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none ) . EXECUTIVE SESSION RESOLUTION NO . Motion by Supervisor Desch ; seconded by Councilwoman Raffensperger , RESOLVED , that the Town Board of the Town of Ithaca hereby adjourns into Executive Session to receive legal advice from Counsel regarding easements and possible litigation and to discuss a personnel matter . (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none ) . RESOLUTION N0 . Motion by Supervisor Desch ; seconded by Councilman Cramer , RESOLVED , that the Town Board of the Town of Ithaca hereby moves back into Open Session . (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none ) . FINANCIAL STATEMENT RESOLUTION NO . Motion by Supervisor Desch , seconded by Councilwoman Howell , RESOLVED , that the Town Board of the Town of Ithaca hereby approves the Financial Statement for the month of October . • (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none ) . AWARD BIDS FOR NEW TRUCK , DUMP BODY , HOIST AND SNOW PLOW RESOLUTION N0 . Motion by Supervisor Desch ; seconded by Councilman Cramer , Town Board Minutes 4 November 17 , 1986 WHEREAS , the Town Board of the Town of Ithaca authorized advertising for , and , on November 13 , 1986 , received bids for a new truck , a dump body and hoist , and snow plow equipment , and WHEREAS , two bids for each of the above three items were received , all within the expected cost range , NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of Ithaca hereby resolves that the awards of contract to supply the Town of Ithaca with the three items of abovementioned equipment be made to the low bidders as follows : Item No . 1 - 1987 Dump Truck to . • Chemung Ford , Inc . d/b/ a Clute Motor Co .
