M . , on the 2nd day of October , 1986 , there were : • PRESENT : Noel Desch , Supervisor Henry McPeak , Councilman Shirley Raffensperger , Councilwoman Marc Cramer , Councilman Gloria Howell , Councilwoman Robert Bartholf , Councilman Patricia Leary , Councilwoman ALSO PRESENT : Lawrence P . Fabbroni , Town Engineer Robert Parkin , Highway Superintendent Andrew Frost , Building Inspector/ Z 0 John Barney , Town Attorney Alan Wood , 167- 7 Calkins Road Representatives of the Media : Fred Yahn , Ithaca Journ al PLEDGE OF ALLEGIANCE The Supervisor led the assemblage in the Pledge of Allegiance . PUBLIC HEARING TO CONSIDER THE ADOPTION OF A LOCAL LAW TO ESTABLISH THE BENEFIT ASSESSMENT FOR THE TOWN OF ITHACA ' S SHARE OF THE ITHACA AREA WASTEWATER TREATMENT FACILITY Proof of posting and publication of notice of a public hearing to consider the adoption of a local law to establish the benefit assessment for the Town of Ithaca ' s share of the Ithaca Area Wastewater Treatment facility having been presented by the Town Clerk , the Supervisor opened the public hearing . Supervisor Desch reviewed the appropriations of the 1987 ( first year) operating budget approved by the SJS , BPW and expected to be approved by Common Council . The Town ' s share is 28a , the City of Ithaca ' s share is 71 % and the Town of Dryden ' s share is 1 % . $1 , 060 , 000 x . 28 equals the Town ' s first year ' s share which is fixed . This will be monitored as the year proceeds to adjust the rate if necessary . The Supervisor went on to say that the plant • will not go on line until well into the year , so the budget should be safe . Referring to his July memo , ( copy attached ) the Supervisor noted the $ 12 increase in the benefit assessment and a substantial decrease in user charges . The Supervisor went on to say that the Village of Cayuga Heights has been billing Town of Ithaca customers in the Northeast directly . The Town did not get involved except to collect delinquent charges on the taxes . The Town will now generate the revenue and pay over to the Village the $ 75 . 00 figure . Village customers will be paying $ 78 . 84 instead of $ 75 . 00 . The Town of Town Board 2 October 2 , 1986 Ithaca revenue based on water consumption will come to the Town and in part stay with the Town . Each property owner will see a new line on their taxes , number of benefit units x $ 12 . 00 . Those properties not served by the sewer will be charged 2 " per thousand of assessed valuation . Dooley Kiefer , 629 Highland Road asked if the Village of Cayuga Heights would no longer be charging for sewer on water consumption? Supervisor Desch responded that the Village always charged on the basis of family units . Ms . Kiefer remarked that this sounded like a user fee . • Supervisor Desch explained that the Village of Cayuga Heights has always had an unusual method of charging for sewer use and debt retirement . They base their charge on the number of family units in a building , not on frontage or acreage . One unit used to be $ 72 . 00 , it has now increased to $ 75 . 00 . He went on to say that the Town is responsible for collection of the sewer rent delinquencies so it should do the other as well . This way the Village would not have to deal with late charges , etc . 30 % of the debt will be retired by the use of the benefit assessment , using front footage and/or consumption consistent with Town policy . Ms . Kiefer questioned , 30o base ? Supervisor Desch responded , based on the formula of benefit units . Ms . Kiefer remarked that she was trying to remember the formula . She then asked if she was right that one house with an added apartment would be charged two units ? Supervisor Desch responded , yes . Ms . Kiefer asked if the same formula was used in the Village ? Supervisor Desch responded that he did not know . Councilwoman Raffensperger remarked that she thought the benefit assessment and the sewer rate were for the debt retirement and O&M costs . Supervisor Desch responded that the determination of the split between the portion of debt recovered through benefit assessment and the rate was also related to the amount of undeveloped sewered property in the Town . The Cornell consumption in the revenue base , will be higher when the portion of the debt retirement is higher in the consumption base . Councilwoman Raffensperger remarked that with Bolton Point , she thought that the benefit assessment was to pay off the debt service and the water consumption was for O&M . Councilwoman Raffensperger asked how the percentage was determined? • Supervisor Desch responded , in total , there are two cost factors . Councilwoman Raffensperger asked how are the allocated? Supervisor Desch responded , based on the rate of the Town not connected to the sewer . If the existing contribution of Cornell University was small it would be necessary to put more on the benefit assessment because of the amount of undeveloped property owned by Cornell . Without the flow that Cornell contributes today , you ' d have to add 600 residential units to match Cornell ' s existing share , as far as the benefit assessment is concerned . Town Board 3 October 2 , 1986 Councilman McPeak questioned , if the people in the northeast would now be paying the $75 . 00 quarterly on their water bill ? Supervisor Desch responded , yes . Dooley Kiefer asked if she understood correctly that in the unconnected property there are a number of units to be developed and will these figures be given to Tan Neiderkorn for his study? Supervisor Desch responded that Mr . Neiderkorn will be given these figures plus a lot more . In fact , one meeting has already been held . • Councilman Cramer asked how much fluctuation will there be ? Supervisor Desch responded that the City ' s overall share will probably go up considerably because of infiltration . He went on to say that he did not know what it would do to the plant as far as operations , but that O&M shares would probably shift . Some of the interceptors in the City will need replacing . There will be a borrowing to replace the defective ones . The Supervisor stated that we will need to take action on the Benefit Assessement at the October 20th meeting . As no present wished to speak further on the subject of the Benefit Assessment , the Supervisor closed the public hearing and noted that continued discussion would be held on October 20th . INFORMATIONAL PUBLIC HEARING TO CONSIDER THE 1987 TENTATIVE BUDGET FOR THE TOWN OF ITHACA Proof of posting and publication of notice of an informational public hearing to consider the 1987 Tentative Budget for the Town of Ithaca having been presented by the Town Clerk , the Supervisor opened the informational public hearing . Supervisor Desch presented the following 1987 Budget Message : 1987 TOWN OF ITHACA BUDGET MESSAGE The development of the 1987 budget is the result of a considerable amount of thought and preparation on the part of the Town staff . The enclosed material includes the narratives prepared by staff so that you have the best perspective possible with regard to their sense of need and priorities . The worksheets are also available if you wish to review them . My sense of priorities is reflected in the overall budget as is my perception of services needed and constituents ' expectations . In general terms , the pressures on the 1987 budget come from three directions . First , the termination of Federal Revenue Sharing has a major impact on our flexibility to budget for major one-time purchases or improvements , i . e . , computers , drainage , vechicles , • etc . These now have to be rolled into the operating budget , if feasible , unless we choose to borrow funds . Second , there is pressure from the City of Ithaca to drastically increase our share of the cost of the City Fire Department . Third , the desire on the part of our constituents for improvements and services , i . e . , water 1 and sewer , better highway circulation , parks , etc . On the other hand , our sewer users throughout the Town will enjoy a significant savings in their annual costs for this service at the same time they became part owners of a new plant . Town Board 4 October 2 , 1986 The pressures of the Townwide budget are quite severe due to the upward climb of salaries (elected officials / staff) , the decrease in the reimbursement for the Town engineer ' s service to the joint sewer project and municipal insurance . There are several major requests that could not be included in the budget : ( 1 ) The request for $ 20 , 000 to replace the Xerox machine . I have included $ 5 , 000 for repairs or installment payments pending investigation of all the options . ( 2 ) A request for additional staff in the engineering department . While the Town Engineer makes a strong case in his budget message , the timing of many projects is such that most need not be accomplished all in one year . It is inappropriate to build an organization on the assumption that all engineering design is to be accomplished in-house . Clearly , our recent experience shows • that it is cost effective to perform engineering design of water and sewer projects in-house . However , we must continually ask ourselves what the hidden costs are when that design effort is not available for the important technical , administrative and ministerial functions referenced by the Town Engineer in his message . The time to ask for more staff is prior to the commitment to do the projects ( i . e . , Forest Home Road , Burns Road , water and sewer) not after . At the same time our staff needs to know what the priorities are in the year ahead for major blocks of time . I will give you my assessment later in this document . I have made the assumption that the new computer is a high Priority . It can be purchased by a pooling of unused Federal Revenue Sharing and water and sewer capital project design moneys . These are the only possible sources without unreasonably inflating the tax levy . The long considered replacement of the heating systems in the highway facility and a portion of Town Hall , along with the Inlet Valley Park commitment , are in my judgement the highest priorities for our remaining available FRS dollars . This means that other needs must be postponed , i . e . , records restoration , new highway projects , fire station design , etc . There may , however , be other sources of funds for some of these worthy needs , i . e . , capital borrowing , grants , etc . Don ' t count all new Federal Revenue Sharing funds out yet ! In the Parttown budget the major request that has not been included is the Grandview Park project . We , in my judgement , cannot afford to build a parks organization (or contract for construction) to do more than one major parks project per year . While residential growth in the Grandview Park area is considerable , the justification that construction needs to take place in 1987 has not been made . The Town Board , as one of its objectives in 1987 , should review the parks construction priorities beyond the Inlet Valley park . The people on South Hill for example , have enjoyed little physical benefit from the Park Reserve Fund or Federal Revenue Sharing moneys for parks . Perhaps the South Hill bikeway (down toward Buttermilk and out toward Dryden ) ought to be the next Priority for consideration in 1988 . The full-year salary for a department secretary is included in the Parttown budget . The cost is split between Zoning and Planning although the service is to be department wide . The need for • additional staff in the Planning section is justified but can be met by work-study effort and significant assistance from the Parks planner , particularly with the level of effort shown in the Parks budget . In the Highway budget , department requests have been cut slightly but the appropriation level is still up 8 . 1 % above the 1986 budget . In the area of permanent improvements the commitment to the people on Kay , Roat and Judd Falls Road remain as the top priority . In the ten year paving plan the major projects are Coy Glen Road , West Haven Road and Caldwell Road . Caldwell Road , in my view, rates far Town Board 5 October 2 , 1986 above the other projects particularly with regard to the safety hazard and the likely success of the Judd Falls Road experiment . The Park Lane Extension project is unlikely to be accomplishable in one construction year even if new FRS funds are available and allocated . However , it is critical to get the gas line relocated and the rough grading done . This in my view is a higher priority than Coy Glen ( although scme initial work on this is possible ) and West Haven Road . Moneys are budgeted for the replacement of the 1972 F 400 dump truck and a 1978 pickup truck . Some balance should be available for carryover into 1988 . In the Water Fund budget the allocation for the start of the next tank painting cycle is tight but achievable if we hold the line on • other repairs . I expect , subject to Board approval , a capital borrowing for the water and sewer extension at several locations in the Town most notably on West Hill . The water extensions are particularly critical for fire protection irrespective of who provides the fire service . In the Sewer Fund budget the new line items reflect the first year operating budget and debt retirement costs . The amount of operating and maintenance sewer rents to be paid over to the City quarterly is fixed at $ 310 , 050 . Although the budget is shown to balance it is likely that there will be sufficient revenues left over from the project to pay a large part of the first year debt of the owners . We , therefore , expect a surplus at the end of 1987 which can be applied to future debt payments . The Fire Protection budget needs the benefit of a fortune teller . The tentative budget figure is representative of the higher end of a reasonable compromise figure with the City . As shown it is 26 % higher than the current year ! There is considerable interest on the part of several outlying areas in the feasibility of contracting with the Town of Ithaca . There is also considerable interest in establishing a fire district or a fire corporation . The pace of this activity is very high . More information will be available prior to the budget hearing . Public hearings on the specific matter may be necessary in late November or early December . Priorities of En ineering/Plannin / Zoning The following are listed in priority order in terms of task oriented work effort by the staff in these areas : 1 ) Water and sewer extensions 2 ) Comprehensive Plan update ( including drainage ) 3 ) Kay/Boat Street project 4 ) Inlet Valley Park 5 ) Caldwell Road 6 ) Park Lane Excavation phase If sufficient staff resources : 7 ) Burns Road design • 8 ) South Hill recreation trail 9 ) Sand Bank Road design 10 ) Grandview Park As always , these priorities are subject to change as opportunities arise and conditions such as site availability change . If necessary , parts of item 1 , 2 , and 3 can be sucontracted out and item 4 can be phased . Town Board 6 October 2 , 1986 It is not anticipated that in-house staff will have a major role in designing the new fire stations . Participation on a design committee is more likely . Salaries We need to decide on elected officials salaries at the meeting on October 2 in order to publish them as part of the public hearing notice for the November 6 meeting . With regard to staff , I have made sane adjustments to the requested salaries in order to try to meet the pool established by the Personnel Committee , i . e . , 5 . 80 . The actual percentage as shown is 6 . 33 % . If you wish to stay with 5 . 8 % the total salaries will have to be reduced by $ 11298 . A list of recommendations is attached . I recannend that the Personnel Committee review this list well in advance of the budget hearings so that any adjustments can be included in the budget . Any comments and recommendations should be submitted to me by October 17 so the budget can be distributed to the Town Board at least one week prior to November 6th , Supervisor Desch then presented to the Town Board , the proposed 1987 Tentative Budget and highlighted the radical changes he had made fran department recommendations . Under General Fund - Town Wide Expenditures , the Supervisor stated that he felt the request for an additional computer was more important than the request for a copying machine , therefore , he had reduced the $ 20 , 000 request to $5 , 000 which would allow for repairs to the present copying machine . Unallocated insurance has been reduced from $ 92 , 000 to $ 85 , 000 , which he felt safe in forcasting that the level of increase will not be as extreme as this year . The Supervisor noted that the appropriation for heating and ventilating for the Highway Facility had been changed fran $ 26 , 000 • to $ 25 , 000 because of insufficient Revenue Sharing monies . Councilwanan Raffensperger questioned the appropriated fund balances listed on page 23 . Supervisor Desch responded that the figures listed assume you are going to spend every dollar budgeted in 1986 . Page 23 is the extreme worse case . Town Engineer Fabbroni stated that he had used zero base accounting to arrive at the figues he requested . It takes ten full time Town Board 7 October 2 , 1986 people plus summer help plus overtime and that the Tentative Budget figures do not provide enough money . You will be short . Supervisor Desch responded that he had tried to increase those items in the budget that were the tightest - snow removal and machinery repairs . Supervisor Desch went on to say that under Water , debt retirement was the major change . Sewer , the big change is O&M for the sewer project and first year payment on the debt . The Supervisor remarked that as far as Fire Protection was concerned , it was the best guessing game in town . He went on to • say that he would be very surprised if the numbers didn ' t change but he didn ' t expect the total to change . We are hoping for another negotiating session with the City in a week . We may end up with a longer contract or we may end up with a phasing out , one year contract . There have been no breakthroughs at this moment . The City knows we are very serious in setting up a Town fire department . Councilwoman Raffensperger questioned contracts with other fire departments . Supervisor Desch responded that if the City doesn ' t want to compromise , Varna , Cayuga Heights , Trumansburg and Enfield fire departments have expressed an interest in providing fire protection , both on an interim and long term basis . Supervisor Desch stated that the budget if adopted as is , would result in a 9 . 9 % tax increase . RESOLUTION N0 . Motion by Councilwoman Raffensperger ; seconded by Councilman Cramer , RESOLVED , that the Town Board of the Town of Ithaca hereby approve the following salaries for elected officials : Town Board Members - $ 3 , 960 each Supervisor - $ 12 , 000 Budget Officer - $ 3 , 000 Town Justice - $ 7 , 000 each (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none ) . Supervisor Desch then presented the 1987 Budget for the Southern Cayuga Lake Intermunicipal Water Commission noting that the Commission had adopted the budget at their September meeting . He went on to say that there was no proposed increase in the water rate . There has been a significant increase in water sales due to expansion in the Town of Lansing and Town of Ithaca . The • Supervisor noted that principal payment in the debt retirement goes up in 1987 . Also , he expected an increase in electric costs because of the increase in usage . Supervisor Desch remarked that in the future , Burdick Hill and Sheldon Road tanks would need painting . LOCAL LAW TO AMEND THE ZONING ORDINANCE WITH RESPECT TO THE PROPOSED REZONING OF THE LANDS OF PAUL A . JACOBS FROM RESIDENCE DISTRICT R30 TO RESIDENCE DISTRICT R5 (MOBILE HOME PARK DISTRICT') , Town Board 8 October 2 , 1986 LOCATED AT 136-146 SEVEN MILE DRIVE , TOWN OF ITHACA TAX PARCEL, NO . 6-33-2-2 AND A PORTION OF TOWN OF ITHACA TAX PARCEL, NO . 6-33-2-1 Proof of posting and publication of a notice of public hearing to consider the adoption of a local law to amend the Zoning Ordinance with respect to the proposed rezoning of the lands of Paul A . Jacobs from Residence District R30 to Residence District R5 (Mobile Home Park District) , located at 136- 146 Seven Mile Drive , Town of Ithaca Tax Parcel No . 6-33-2-2 and a portion of Town of Ithaca Tax Parcel No . 6-33- 2-1 having been presented by the Town Clerk , the Supervisor opened the public hearing . Supervisor Desch stated that pursuant to a resolution adopted by • the Town Board at a Town Board meeting held on September 22 , 1986 , said public hearing was adjourned until 8 : 00 P .M . , on October 20 , 1986 . The Supervisor then closed the public hearing . REPORT OF TOWN OFFICIALS Town 2gineer ' s Report Town Engineer Lawrence Fabbroni reported that corrective work had been completed on the Hun erford Hill 1 Water Tank . Seven to eight tons of sand was blown in under the tank . The repairs to the tank could go as high as 150 over budget , we will go back and renegotiate the contract with the contractor . The Town Engineer reported that Phase II of the water extensions is virtually complete . Also completed is the connection at Ithaca College which will allow a sufficient water flow from the Ridgecrest Tank for fire protection for Ithaca College , NCR and Morse Chain , Town Engineer Fabbroni stated that he was getting the dollar numbers together so that the Town could receive their reimbursement for the gabion wall project washout in Forest Hone and the Burns Road project . He noted that the Forest Hone project was under budget . Highway Superintendent ' s Report Highway Superintendent Robert Parkin stated that he had nothing to add to the Town Engineer ' s Report . Building Inspector/ Zoning Officer ' s Report Andrew Frost , Building Inspector/ Zoning Officer distributed to the Town Board copies of two new forms , pertaining to building permits that he proposed to use for one or two family dwellings . He went on to say that he had had a few occasions where Board members had cone to him with complaints . He asked that from now on , that Board members who wish to register complaints should put them in writing . • BOARD OF REPRESENTATIVE ' S REPORT Beverly Livesay reported that the Youth Job Program had been studied by the Youth Bureau and that the Youth Bureau recommends the continuance of the program . WATER AND SEWER EXTMSIONS Town Engineer Lawrence Fabbroni presented the following report for extending water and sewer on West Shore Drive , north of the "H " Town Board 9 October 2 , 1986 building at the Biggs Complex , Happy Lane , Indian Creek Road , DuBois Road , Woolf Lane , Grove Road and Trumansburg Road . He suggested that a 12 " water main now be placed along the Trumansburg Road and later on , install another tank which could be a full pump station . For now , a hydrophenumatic station will be built on Trumansburg Road . The sewer line , north of the hospital , will be put on the lower side of DuBois Road then extended to Woolf Lane and Grove Road . Sewer and water on the West shore of the lake will be put in the same trench . The people who live along the West shore should be able to bring both the water and sewer lines to their properties in the same ditch . Sewer lines will be extended to serve the houses south of Lieberman ' s Marina , these are the properties that will be annexed to the Town . • The Town Engineer went on to say that the hospital sewer main is the worst main in the Town . It is 55 years old . Two sewer lines will be needed on West hill , one to go out Route 89 , hit a crest then take off up the old railroad tracks , connect to the "H " Building by using the old steam line route . A sewer line on Bundy Road could then serve Route 96 , Town Engineer Fabbroni stated that in order to extend a connection of the Troy Road water line to East King Road and the Coddington Road area , a pressure valve will be needed . He noted that the density of this area was one-half of that of other areas where the Town proposed to extend the water lines . We will need to run a line one-half mile along an undeveloped area of East King Road in order to serve five houses with water . The Engineer pointed this fact out in his report , as the cost per residence to extend water to East King Road and Coddington Road would be $ 9 , 421 opposed to $ 5 , 015 North of the hospital . (Copy attached to minutes ) . Supervisor Desch stated that if the Town were to go with their own fire department , there was a need to include as much of the Parameters of the Town as possible . The Town Engineer went on to say that if a 12 " water main was installed along West Shore Drive it would provide sufficient water to service the Town of Ulysses . This could prove to be in the mutual interest of the Town of Ithaca and the Town of Ulysses . Councilwoman Raffensperger asked if the Engineer ' s report was a proposal ? Supervisor Desch responded that we now have the numbers and are not far from producing the drawings . Councilwoman Raffensperger asked if the people on Coddington Road and East King Road had water supply problems ? Supervisor Desch responded that the area has problems with sulfer . However , it was more important to extend the water for fire protection . Councilwoman Raffensperger asked if people would be required to • hook up ? Town Engineer Fabbroni responded , the people will have to hook up to sewer within a year , that ' s a policy the Board made . TOWN HALL/HIGHWAY FACILITY HEATING FACILITIES Town Engineer Fabbroni stated that staff have been looking at three types of infrared heating systems for the Highway Facility and were asking for authority to proceed with the specifications . Town Board 10 October 2 , 1986 RESOLUTION NO Motion by Councilman Cramer , seconded by Councilman McPeak , WHEREAS , Town Engineering has investigated three viable infrared heating systems for the Town Highway Maintenance Facility , copy attached , NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of Ithaca that full bid specifications for such a system be prepared by the Town Engineer . (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary • voting Aye . Nays - none ) . HIGHWAY EQUIPMENT BIDS Supervisor Desch stated that the Highway Committee had checked over the specifications . A new truck will add to the fleet of four snow plows . By not turning in Truck # 2 , this will give us a backup truck . RESOLUTION N0 . Motion by Councilman Cramer , seconded by Councilman Bartholf , WHEREAS , the Town Board has budgeted to add one full-size ( 35 , 000 GWV) dump truck to be equipped with snow plow to the highway fleet in 1986 , and WHEREAS , the attached specifications have been reviewed by the Highway Committee , NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of Ithaca that the attached specifications be approved for bidding of the truck body and for separately bidding of the truck box and plow accessories , such bids to be opened November 3 , 1986 , at 11 : 00 A . M . , EST , with a budget total of $ 55 , 000 established for these purchases from Account 5130 . 200 . (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none ) . WATER ACCOUNT REFUNDS RESOLUTION NO . Motion by Councilman Bartholf ; seconded by Councilman McPeak , WHEREAS , a defective remote meter caused the customer at 26- 1026 Ellis Hollow Road to overpay their water bill , NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of • Ithaca hereby authorize a refund of $ 13 . 76 for water , $ 11 . 12 for sewer , $2 . 34 for water surcharge , $ 1 . 61 for water penalty and $ 1 . 11 for sewer penalty , total refund of $ 29 . 94 be made to R . Kane , 137 Fayette Street , Ithaca , New York , Account Number 169-0154254 . (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none ) . If a leak is found , it must be tended to immediately . RESOLUTION N0 . Town Board 12 October 2 , 1986 Motion by Councilman Cramer , seconded by Councilman McPeak , WHEREAS , the State has mandated testing for leaks of all underground storage tanks more than ten ( 10 ) years old before December 1986 , and WHEREAS , such services are provided by consultants , such as Calcerinos & Spina , O ' Brien & Gere , or Stearns & Wheler , NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of Ithaca that testing of the three underground tanks at the Highway Maintenance Facility be pursued with one of the above firms by the Town Engineer , with the approval of the Town Supervisor , for a cost • not to exceed $ 5 , 000 , and FURTHER RESOLVED , that any corrective action , not an emergency , be the subject of a subsequent approval and review of the Town Board .
