HomeMy WebLinkAboutTB Minutes 1986-09-22 TOWN OF ITHACA SPECIAL BOARD MEETING September 22 , 1986 At a Special Meeting of the Town Board of the Town of Ithaca , Tompkins County , New York , held at the Town Offices , 126 East Seneca Street , Ithaca , New York , at 12 : 15 P . M . , on the 22nd of September , 1986 , there were : • PRESENT : Noel Desch , Supervisor Henry McPeak , Councilman Shirley Raffensperger , Councilwoman • Marc Cramer , Councilman Gloria Howell , Councilwoman Robert Bartholf , Councilman Patricia Leary , Councilwoman ALSO PRESENT : Lawrence P . Fabbroni , Town Engineer John C . Barney , Town Attorney PLEDGE OF ALLEGIANCE The Supervisor led the assemblage in the Pledge of Allegiance . ADJOURNMENT OF THE PUBLIC HEARING TO CONSIDER THE ADOPTION OF A LOCAL LAW TO AMEND THE ZONING ORDINANCE WITH RESPECT TO THE PROPOSED REZONING OF THE LANDS OF PAUL A . JACOBS FROM RESIDENCE DISTRICT R30 TO RESIDENCE DISTRICT R5 (MOBILE HOME PARK DISTRICT) , LOCATED AT 136- 146 SEVEN MILE DRIVE , TOWN OF ITHACA TAX PARCEL N0 . 6-33-2-2 AND A PORTION OF TOWN OF ITHACA TAX PARCEL NO . 6-33-2-1 Supervisor Desch stated that he received the following letter dated September 10 , 1986 , from Jonathan 0 . Albanese , attorney for Paul Jacobs : "On behalf of Mr . Jacobs and myself , I am sending this letter to request an adjournment of the adjourned meeting scheduled for October 2 , 1986 , at 8 P .M . That meeting , of course , was the continued public hearing in the matter of the zoning amendment application of Mr . Jacobs for the College View Mobile Home Park . It turns out that I will be unable to attend that meeting as the result of my being out of town until October 3 . I would appreciate it if this meeting could be rescheduled for sometime later on in • October , so that I will be able to attend along with Mr . Jacobs . If there exists a problem with this requested adjournment , feel free to contact me . " • RESOLUTION N0 . Motion by Councilman McPeak ; seconded by Councilwoman Howell , WHEREAS , on September 8 , 1986 , a public hearing was held on the matter of rezoning premises on Seven Mile Drive to R5 , and WHEREAS , said public hearing was adjourned to October 2 , 1986 , at 8 : 00 P .M . , and Town Board 2 September 22 , 1986 WHEREAS , it appears that the attorney for the owner of the premises will be out of town on that date and as a result the owner of the premises and his attorney have requested that the public hearing be further adjourned , and WHEREAS , the Town Board wishes to accommodate the owner of the premises as well as the members of the public that are interested in this proceeding and believes that such accommodation is best obtained by having the owner and his attorney present at any public hearing on the matter , and WHEREAS , the Town Board wishes to give as much advance notice of any proposed adjournment as is possible so that the inconvenience • of the owner and the public is minimized , NOW THEREFORE BE IT RESOLVED , that this Board proposes to adjourn the adjourned public hearing on the above matter from October 2 , • 1986 at 8 : 00 P .M . , to October 20 , 1986 at 8 : 00 P . M . , AND IT IS FURTHER RESOLVED , that the Town Clerk notify the owner , the owner ' s attorney , and the attorneys for the persons objecting to the rezoning of the intention of the Town Board to adjourn said public hearing , AND IT IS FURTHER RESOLVED , that notice of the holding of the adjourned public hearing on October 20 , 1986 be duly published in the Ithaca Journal and posted on the Town bulletin board , AND FURTHER BE IT RESOLVED , that at 8 : 00 P . M . , on October 1 , 1986 , the Town Board advise the public that the public hearing adjourned to that date has been further adjourned to October 20 , 1986 at the time set forth above . Town Clerk Jean Swartwood questioned Town Attorney John Barney about the publication of the legal notice . Town Attorney Barney responded that the Town Clerk should insert , at the end of the legal notice the following statement : "Pursuant to a resolution adopted by the Town Board at a Town Board meeting held on September 22 , 1986 , said public hearing was adjourned until 8 : 00 P . M . , on October 20 , 19869 " (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none ) . SCHOOL CROSSING GUARD Supervisor Desch noted that he , Michael Ouckama , Principal of the Northeast School ; Gary Lindenbaum , Business Manager for the Ithaca City School District and Town Clerk Jean Swartwood had met to • discuss the need for a crossing guard on Warren Road , The Supervisor stated that because of the installation of flashing yellow school crossing lights and the fact that the school district was bussing all children who live within 4 / 10 of a mile of the • school , a school crossing guard was not hired this year . Mr . Ouckama and Mr . Lindenbaum expressed the Districts concern for the safety of the children crossing a busy road like Warren Road . It was agreed that the School District would advertise for the position , jointly the School District and the Town would interview the candidates . The person hired would report directly to the Northeast School , this way they would know sooner if a problem arose . In the past , by the time the Town was informed that the crossing guard did not report for work , the children have already crossed the road . Supervisor Desch stated that the Town would continue to provide the salary at the current budget level . Town Board 3 September 22 , 1986 Supervisor Desch asked Town Attorney John Barney and Town Clerk Jean Swartwood to check the law and draw up a contract with the School District to allow the School District to administer the position of school crossing guard and the Town to provide the financial assistance . Also , to check on the question of insurance coverage . FIRE PROTECTION Supervisor Desch stated that a lot was happening in the fire arena . We are considering two options , one being a standard Town district governed by a Commission which would be appointed by the Town then • the following year they would be elected , staggering the terms from one to five years . The district would do the borrowing to build the buildings and buy the equipment . The second option would be a not-for-profit corporation which contracts with the Town of Ithaca . • The Town Board would retain control over the service . The firemen would be members of a fire company . The corporation would borrow the money for the buildings and equipment . The Supervisor went on to say that he was receiving good feedback from Town residents for establishing our own fire department . There has been no movement on the part of the City to reduce their $ 750 , 000 request . It is obvious there will be at least another negotiating session , as we need to set up a one year phasing out contract . Councilwoman Raffensperger remarked that she keeps hearing that some people in the City are willing to compromise to some extent . Supervisor Desch responded yes . The problem is we keep hearing conflicting approaches as to what would be a compromise . He went on to say that the players are somewhat varied . Councilwoman Raffensperger asked if anything had been resolved with Cornell University and Ithaca College to help with the financial gap? Supervisor Desch responded that he had met with Tom Salm , Vice President for Business at Ithaca College last Friday and that no financial help would be forthcoming from Ithaca College . He went on to say that as far as Cornell University is concerned , if it comes to a choice of a major increase in the contract , Cornell may establish their own fire department . He also noted that the Varna Fire Department had expressed an interest in serving a part of the Town . Councilwoman Raffensperger stated that people are talking informally about the proposed fire protection . She stated that she did not know the City ' s feelings regarding the negotiations . • Supervisor Desch responded that none of the Commissioners nor the Fire Chief was at the last negotiations . • Councilwoman Howell added , the people , from the City , who attended the meeting were not interested in negotiating . They had their minds made up before they ever attended the meeting . Councilwoman Raffensperger stated that there were feelings that the City thinks that Cornell University and Ithaca College will step in to save relations after the City of Ithaca and the Town of Ithaca fail . Town Board 4 September 22 , 1986 Supervisor Desch remarked that there were a sufficient number of people on Comm Council who are interested in having the negotiations continue .
