Designed play structure for Hungerford Heights Park ( prefabrication by Parks Dept . in process ) . — �4ss�s �ed iVI �lav► � � � � r i�� 5 +� u ��e �re��rrc` ht Town Board 3 September 8 , 1986 REPORT OF TOWN OFFICIALS Supervisor ' s Report Town Fire Department Supervisor Desch stated that at the time of the presentation of the Tentative Budget he expected to distribute a detailed plan for the provision of fire service by a Town Volunteer Fire Department . This will allow us about one month before the public hearing to gather further Board input with a filing at the State to follow in November . Following the news article in the Journal , there has been a considerable interest and support for a move in this direction . • Water & Sewer Extensions Supervisor Desch noted that the proposals for West Hill are not quite ready but will be by the October 2nd meeting . It will be preferable to do it at that time because the October 20th meeting already looks like a heavy agenda . Town Engineer ' s Report Town Engineer Fabbroni noted that the Board had a copy of his engineering report which covers a two months period . (Copy attached to the minutes ) . He then highlighted his report . Water Tanks Town Engineer Fabbroni reported that work on the Pine Tree Road tank was completed except for the wiring to the cathodic protection . There were substantial but not irreversible problems under the Hungerford Hill tank . A tank expert was brought in to give us advise on how to correct the problem . There was a lack of compaction under the tank when installed . Sand was pumped under the floor and sections of the floor were replaced . We are now painting the tank and ready to fill in a week . Ithaca College The Town Engineer stated that Ithaca College has approved the easement for the water line . Work has been completed except for clean up , everything went smoothly . We now have the capability to feed Danby Road and Ithaca College . When a new hydrant is installed we will have the capability of pumping up hill . Water and Sewer Extensions Town Engineer Fabbroni went on , to say that the field surveys for the package extension of water and sewer to Trumansburg Road , DuBois Road , Woolf Lane , etc . , areas are complete except for King Road and Coddington Road , Parks The Town Engineer reported that he was satisfied with the Park Maintenance Crew . Also , people are making - good use of the parks . Highways Burns Road is virtually completed as for paving . The road is actively being used by the public . There is still a lot of work to be done on the shoulders plus signage . There is continued discussion with the Hospital to refine the access road . The Town Engineer went on to say that they were ready to pave on Forest Home Drive , however , they are waiting for Cornell to install the granite curbing . Paving , near the washout is nearing completion . We are reestablishing the Town portion of the path , also making drainage improvements . Park Lane 07 Town Board 4 September 8 , 1986 Town Engineer Fabbroni reported that a meeting had been held with NYSEG , however , the project was on hold . Judd Falls Road The Town Engineer went on to report that a meeting had been held with the Homeowners Association to address some of the difficulties addressed at the last Town Board meeting . Forest Home Drive will be opened before Judd Falls Road is made one-way plus there will be traffic counts before and after one-way traffic is instituted . Drainage The Town Engineer report that problems with drainage on the Compton Road project had ended . Sewage Treatment Plant Town Engineer Fabbroni reported that the second phase , piping , electricity , etc . , was being completed preliminary to the actual installation of the equipment . He reported that 80 % of the piping was completed . The biggest problem in the Phase I closeout was getting the contractor and the manufacturer to agree we have a problem with the pumps . We are reluctant to accept the pumps as they are . He went on to say that the digestor tanks were put on line and they still leak . A second coat of liner material will be put on the tanks to see if this helps . Town Engineer Fabbroni summarized his feelings by saying that in general , Burns Road typifies our time . The ten men in the Highway crew deserve a lot of credit . It was a very ambitious project for ten or eleven men to undertake along with the other projects on top of Burns Road . Any more of a work load we will need more bodies as the projects are overbearing now with the staff we have available . Supervisor Desch responded that the highway crew had done a nice job on the Burns Road project , it is a very beautiful road to travel on . Building Inspector/ Zoning Officer Building Inspector/ Zoning Officer Andrew Frost stated that he was still getting established and familiar with his duties . He noted that he was receiving an increase in telephone calls about the student population , also bed and breakfast questions . Mr . Frost went on to say that he is finding that both prospective owners and real estate agents are not familiar with the Town ' s zoning regulations . Therefore , he was sending all real estate agents a letter explaining the zoning regulations . He stated that he would also like to put an article in the Ithaca Journal about what Zoning Officers do and what the regulations are . REPORT OF COUNTY REPRESENTATIVES County Representative Deborah Dietrich reported that an agreement was being negotiated to name the new access road in honor of Harris B . Dates . Ms . Dietrich went on to say that the State of New York was being petitioned to pay for the cost of installing the proposed traffic light for the intersection of Route 96 and the hospital road . The County Representative stated that she was looking forward to the extension of water and sewer to the areas in West Hill that had petitioned the Board for these services earlier in the year . County Representative Dietrich questioned the condemnation proceedings on the Hall property for the proposed access road . She stated that she had talked to Gerald Hall and that he was very unhappy with the price the Town had offered for the property . Ms . Town Board 5 September 8 , 1986 Dietrich stated that the current price for land on West Hill was between $ 5 , 750 'and $ 8 , 500 per acre . She stated that she was pleading for Mrs . Hall , that the Town consider the fair market price for this property . BUDGET AMENDMENTS RESOLUTION NO . Motion by Councilman Cramer ; seconded by Councilman McPeak , WHEREAS , appropriation accounts B8010 . 400 Zoning Contractual and B8020 . 400 Planning Contractual are presently over budget due to the increased frequency of Planning and Zoning Board meetings during the past spring , and WHEREAS , summer months and the corresponding increased costs of recording secretary , legal notices , etc . , and , WHEREAS , due to the necessity to contract with a local engineering firm to do building inspections for the interim period prior to the hiring of a building inspector , NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of Ithaca hereby authorize $5 , 000 be transferred from B8010 . 100 Zoning Personal Services to Appropriation account B8010 . 400 Zoning Officer , and FURTHER BE IT RESOLVED , that $5 , 000 be transferred from B1990 . 400 Contingency to appropriation account B8020 . 400 Planning Contractual . (Desch , McPeak , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none ) . ENGINEERING REPORT ON WATER AND SEWER EXTENSIONS FOR WEST HILL Supervisor Desch stated that the engineering report on the water and sewer extensions would be deferred until the October 2nd meeting . RENOVATION OF TOWN HALL AND TOWN HIGHWAY HEATING SYSTEMS Town Engineer Lawrence Fabbroni presented the following report : Staff has studied the heating and cooling needs as appropriate for the two facilities involved . Presently specifications for bidding are being prepared for the following : Town Hall A roof top heating/cooling system is recommended to serve the rear • two sections of Town Hall for the following reasons : 1 ) Available space for plant and ducts . 2 ) Need to redo two rear sections of roof . 3 ) Elimination of noise problem . 4 ) Combination of heating/cooling aspects . 5 ) Coordination with insulation and window improvements and replacements . Town Highway Maintenance Facility Town Board 6 September 8 , 1986 A vaccum exhaust gas fired infrared heating system would replace existing individual burners for the following reasons . 1 ) More economical heating of space . 2 ) Elimination of roof penetration problem . 3 ) Elimination of vapor deterioration problem as present . Budgets along with specifications for approval will be presented in October for Town Board approval . Town Engineer Fabbroni remarked that the recommendations were only a quick summary and that he would still like Board input on other systems . He went on to say that hot water systems had been • considered , the age of the plant in the old part of the building also , the problem of the front of the building being isolated from the back of the building by the vault area . The plastic window in the Board room and upstairs need to be replaced . The layout makes it difficult to get the ventulating ducks through the building . He noted that the 9 " of insulation above his office helped but still there is a big heat loss . The best suggestion seemed to be a heating and cooling system on the roof . Most of the noise will be above the roof . An 8 " wall will be installed inside the current walls upstairs and in the Board room . The windows will be framed out to meet the new wall . The Engineer went on to say that the only other option is a high energy type system . Councilman Cramer asked what type of additional support will be needed on the roof? Town Engineer Fabbroni responded , not very much . The system is built to spread the weight load out . Councilman Cramer asked if a blower unit would be needed in the basement ? Town Engineer Fabbroni responded no . The blower will be on the roof , therefore , the noise will be on the roof . The Town Engineer went on to say that the system for the Highway Facility would be more expensive . We have a continual problem with 15 MPH winds which start a pendulum action in the chimney , no matter how much we brace them . Supervisor Desch asked the Town Engineer to bring back his proposal in October when he had a budget prepared . CONDEMNATION OF HALL PROPERTY Councilwoman Leary asked if the Board adopted the proposed resolution , could the appraisal be changed? Town Engineer Fabbroni responded that a new complete appraisal could be gotten . He remarked that in the beginning the Town had given the Hall ' s more , including the extension of water to their • property . RESOLUTION NO Motion by Councilman McPeak ; seconded by Councilwoman Howell , WHEREAS , it has been proposed to construct an access road to the Tompkins Community Hospital and adjacent lands , WHEREAS , the proposed route of said access road lies on the easterly sixty feet and the southerly thirty feet of the lands of 99 Town Board 7 September 8 , 1986 Gladys Hall , commonly known as 1307 Trumansburg Road , Ithaca , New York , WHEREAS , the Town -Board of the Town of Ithaca , by resolution passed on July 28 , 1986 , authorized the Town Attorneys to commence eminent domain proceedings on behalf of the Town for the said property of Gladys Hall , WHEREAS , as part of said eminent domain proceedings , after proper publication of notice , a public hearing to determine the need and location of said access road was held by the Town Board on August 18 , 1986 , NOW THEREFORE BE IT RESOLVED , that the following constitute the determinations and findings of the Town Board in regard to the said eminent domain proceedings : 1 . There is a need for an additional access road to the Tompkins Community Hospital and adjacent properties including those owned by the County of Tompkins , State of New York and various private landholders . 2 . The public use , benefit or purpose to be served by the proposed project includes easier and more efficient access to the affected properties by fire , police and emergency vehicles and others wishing to gain access to said properties . 3 . The approximate location of the proposed road enters the said Gladys Hall paroperty on the southwesterly corner of said property and runs thence easterly along the dividing line between the lands of the said Gladys Hall and those of Tompkins County , State of New York , for thirty feet on the Hall side of said dividing line , to the northeast corner of said property of Gladys Hall and running thence along the easterly sixty feet of the said Hall property . 4 . The site of the proposed project was chosen as being the feasible alternative with the least impact on private landowners . Locating the road immediately east of its proposed location would require the relocation of an electrical substation at a cost that would outweigh the benefits to the public from the relocation . Locating the road to the east of the hospital is not feasible due to the slope of the hill at that point . 5 . The proposed project would have no significant effect on the surrounding environment . 6 . The effect of the proposed project on the residents of the locality would be beneficial in that it would increase property values by providing roadway access to areas presently no served by a road . 7 . RESOLVED , that the above determinations and findings , or • a reasonable synopsis thereof , be published by the Town Clerk in the manner provided by law . TOWN BOARD MI=S RESOLUTION N0 . o R Town Board 8 September 8 , 1986 Motion by Councilman Bartholf , seconded by Councilman McPeak , RESOLVED , that the Town Board of the Town of Ithaca hereby approve the minutes of the July 28 , 1986 and August 11 , 1986 Town Board meetings , as presented by the Town Clerk . ONE-WAY TRAFFIC ON JUDD FALLS ROAD Peter Forlano , President of the Forest Home Improvement Association presented the following memo , addressed to Noel Desch , Supervisor , dated September 5 , 1986 : " I enclose a copy of a resolution passed unanimously at a meeting today of the Forest Home Improvement Association . This resolution expresses the strong sentiment of our Community concerning the proposed experiment with Judd Falls Road . We are most anxious that this experiment be conducted in as meaningful a way as is possible so that , at the conclusion of the experiment , we can ALL agree that the final decision is soundly based . " FOREST HOME IMPROVEMENT ASSOCIATION September 5 , 1986 RESOLVED , by the members of the Forest Home Improvement Association at its meeting on Friday , September 5 , 1986 , THAT no experiment in the direction of travel on Judd Falls Road , as proposed by the Town of Ithaca at its meeting on August 18 , 1986 , wherein it was proposed that traffic on Judd Falls Road be made one-way , southbound from its intersection at Forest Home Drive to its intersection with the so-called Jug Handle , north of Tower Road , be made until the full reopening of Forest Home Drive , including that section of the Drive lying within the City of Ithaca , and FURTHERMORE , that prior to and subsequent to said reopening of Forest Home Drive , traffic patterns and usage are measured on the streets in our ccmmmity including , but not limited to Warren Road , Forest Home Drive , Caldwell Road , Judd Falls Road , and Pleasant Grove Road , as well as the two bridges , • FURTHERMORE , that no permanent construction be undertaken until the Proposed experiment with one-way traffic on Judd Falls Road has been discussed with this Association as to the basis of the evaluation and that recommendations for Judd Falls Road have been thoroughly discussed with this Association . Town Engineer Lawrence Fabbroni then presented the following Judd Falls Road one-way experiment highlights : 1 ) Temporary one lane delimited by traffic barrels . 11G Town Board 9 September 8 , 1986 2 ) Relocation of mailboxes to 2-3 banks on existing west curb line . 3 ) 1 " overlay on steep grade with "hot mix" calcium additive to asphaltic concrete . 4 ) Barrels to be filled with sand but moveable by equipment for extraordinary winter maintenance during experiment . 5 ) One-way signs , do not enter signs , directional and warning signs as appropriate at jughandle , McIntyre , Judd Falls and Forest Horne Drive , • 6 ) Traffic counting across the entire Forest Hone screenline before and after one-way experiment . 7 ) Implementation of one-way experiment only after reopening of Forest Hate Drive to traffic . 8 ) Estimate of permanent funds lost to experiment $ 1 , 500 labor and machinery , barrels are reusable for safety demarcation of multiple Town projects annually - initial cost $ 1 , 500 . 9 ) Use and constraints of jughandle to be particularly monitored during one-way experiment , buses expected to be rerouted via campus or Caldwell Road , 10 ) Improved pedestrian way from Judd Falls to first bridge along Forest Hone Drive to be studied for possible implementation if permanent improvement is implemented in 1987 . The Town Engineer went on to explain that the road would be 15 ' wide instead of 14 " , as originally planned , to make it easier for snow plowing . He noted that the people who live locally will have the greatest problem coming and going . The Engineer went on to say that he would work with Cornell and the School District to reroute bus runs through Cornell . Supervisor eDesch asked if the experimental one-way would start on November lst and run through the end of the spring term? Town Engineer Fabbroni responded that November 1st looks like the date . However , the actual date will depend on the opening of Forest Hone Drive , we will just have to wait and see . A man in attendance stated that he lived in the northeast . He went on to say that you are creating a one-way valve to campus and letting us find our own way home . This is going to increase my automobile insurance because the added loop will increase the miles I will be driving . Town Engineer Fabbroni asked the man why he could not use Caldwell Road if it is improved? The man responded , are you going to improve the "S " curve ? You are • talking about tripling the traffic on Caldwell Road . Right now , if you get two late model cars on that "S " curve , the two cars can ' t get thru . Shirley Egan , Cornell University Counsel questioned if a month of traffic counts on Forest Home Drive was sufficient time ? A month won ' t even be enough time to let people know that Forest Hone Drive is open again . Town Engineer Fabbroni responded that traffic useage will be seen in the screenline . Also , based on the former traffic counts you Town Board 10 September 8 , 1986 can get a projection . He stated that not doing the experiment over the winter leaves holes in the experiment . Muth Mahr , 103 Judd Falls Road asked if the experimental walkway would be on the east or west side of the -road ? Town Engineer Fabbroni responded , west . On the west side where the granite curb is then on the east by the jughandle . Ruth Mahr remarked , making the street narrower on the west side ? Town Engineer Fabbroni responded , right . Mrs . Mater then questioned , in moving the mailboxes , will you confer with the residents ? Town Engineer Fabbroni responded , yes . A man in attendance remarked that there was a fairly major traffic Problem in this area . The real solution to the traffic problem is a by-pass , if you piecemeal now you will never end with a by-pass , only a piecemeal solution . Town Engineer Fabbroni noted that Judd Falls Road was in need of repaving , curbs needed replacing , plus the residents asked for walkways ( sidewalks ) . Peoples front yard in Forest Home are so small already that we did not want to talk about making them any smaller . Look at the number of cars in terms of Forest Home Drive which was a vital link to downtown eventhough it only carried 2 , 000 cars . They cars went someplace when the road was closed . we estimate that 2 , 000 to 21500 cars will use Forest Home Drive after it reopens . Dale Grossman , 111 Judd Falls Road stated that she had lived there for eight years and has noticed an increase in traffic during this time . She stated that she would like to see the one-way traffic implemented on a permanent basis . Shirley Egan , Cornell University Counsel remarked that Cornell University would like to go on record on a couple of points . Basically we have an open campus where we see traffic going thru but we now see the possibility of impossing traffic on roads , such as the jughandle and Plantations Road , that were not ment for this kind of traffic . Cornell may ask for a hold harmless agreement . Also , we would like to reserve our right to shut off roads we feel are becoming overly dangerous or Cornell University deems there is too much density of traffic . As far as Forest Hone Drive is concerned , she again stated that it takes more than a month to change peoples habits and , therefore , she did not think that traffic counts would show true readings . Town Engineer Fabbroni remarked , that if Cornell built another Parking lot , they would not be able to say what impact it would have on traffic . • A man in attendance stated that he was concerned with the evaluation of the project . Commuters may enjoy it and Forest Home residents may not . He stated that he would like to see more input from the residents . Supervisor Desch remarked that even if the one-way experiment is satisfactory , we still need a by-pass . RESOLUTION N0 . KAY STREET DRAINAGE Town Engineer Lawrence Fabbroni remarked that the people who attended the Town Board meeting last month during the discussion of the Kay Street drainage stated they wanted open ditches . This week the Town received a letter which stated the residents wanted weeper drains . The Engineer went on to say this his advise was to take time and sort out these conflicts of opinion with the project . He then advised the Board that if they say put in open ditches at this time , he would need to hire six extra men . The Town Engineer asked the Board for direction . Supervisor Desch responded that he agreed with the Town Engineer , the Board needs more input from the residents before they can make a decision . He went on to say that using the information we have now we may end up spending more money then is necessary and not get • something that is good for the area . He then suggested that a letter be written to the residents to let then know what the Town plans on doing and to start the project early in the Spring . Councilman Cramer stated that he would support this proposal if the drainage project was made a top priority for Spring , after more discussions were held with the neighborhood . Supervisor Desch responded , we will have fire stations more centrally located in each section of the Town . A man in attendance asked if negotiations with the City had been completely cut off? Supervisor Desch responded , not completely . However , the Town is now paying $ 350 , 000 for fire protection and the City wants this figure increased to $ 750 , 000 . The City is not moving . The City feels the Town ' s assessed valuation is 30 % of the City ' s assessed valuation and , therefore , should be the basis for future contracts . The Towns position is that not all of the Town is within a three minute response , hence part of the assessed value needs to be discounted . The City also feels that the Town ' s assessed valuation has grown faster than the City ' s , but it has not . The man then asked if the Town would be receiving any increased services or are they just asking for more money? Supervisor Desch responded that the only extra services the Town would be receiving would be the two fire stations located in the Town which would be manned by City fire personnel . Isabella Spencer , 108 Glenside asked how the Town would be rated in regard to insurance ? Supervisor Desch responded that nothing will change until the two new fire stations are built in the Town . Ms . Spencer then added , she wondered what kind of stuff the Town was putting on their road in the winter as it makes a lot of dust and every time she wants to drive her car she must wash her windows . JACOBS FROM RESIDENCE DISTRICT R30 TO RESIDENCE DISTRICT R5 (MOBILE HOME PARK DISTRICT) , LOCATED AT 136- 146 SEVEN MILE DRIVE , TOWN OF ITHACA TAX PARCEL N0 . 6-33-2-2 AND A PORTION OF TOWN OF ITHACA TAX PARCEL NO . 6-33-2-1 Proof of posting and publication of notice of a public hearing to consider the adoption of a local law to amend the Zoning Ordinance with repsect to the proposed rezoning of the lands of Paul A . Jacobs from Residence District R30 to Residence District R5 (Mobile Hone Park District) , located at 136-146 Seven Mile Drive , Town of Ithaca Tax Parcel No . 6-33-2-2 and a portion of Town of Ithaca Tax 1J Town Board 18 September 8 , 1986 Parcel No . 6-33-2- 1 , having been presented by the Town Clerk , the Supervisor opened the public hearing . Jonathan Albanese , attorney for Paul Jacobs remarked that in the Spring , the Town had passed an ordinance allowing mobile homes in the Town of Ithaca . He went on to say that this was a first , as there was no previous provisions for mobile homes in the Town of Ithaca eventhough there was a need for this type of housing . The Comprehensive Plan , adopted several years ago , showed a need for this type of housing . Mr . Albanese went on to say that two public hearing had been held previously and that only Mr . Jacobs had shown up for these hearings . It seemed to him that there was a feeling , by the people in the Town of Ithaca , that it was okay to have a mobile home park as long as it was not in their own backyard . Mr . Jacobs has already completed a lot of changes and improvements to the present mobile home park plus he has a list of proposed changes . Mr . Albanese noted that the Town Board had received a petition signed by persons who opposed the rezoning . He then presented to the Board the following : "The undersigned hereby affix their signatures to indicate their support for the expansion of the College View Mobile Hone Park located in the Town of Ithaca from a 24 unit mobile home park located on a 2 . 9 acre parcel on Seven Mile Drive to a 54 to 56 unit mobile hcme park , which would include mobile homes placed on a 15 acre parcel adjacent to the existing park , and further support the rezoning of said approximately 18 acre area from a Residence District R-30 to a Residence District R-5 (mobile home park) . The undersigned further certify that they are familiar with College View Mobile Home Park as it currently exists , and are familiar with the way in which said existing mobile home park has been managed by Paul A . Jacobs , and feel that the park has been properly run , in all aspects , during the course of Mr . Jacobs ' ownership thereof . The undersigned also recognize a severe need in the Town of Ithaca for low cost housing and understand that this void could help be alleviated by the expansion of the existing mobile home park and the rezoning of the district in that area . The Town of Ithaca , by adopting the proposed rezoning , would be doing a great service to all of Ithaca ' s residents by providing a means for the development of this form of affordable housing . Having been made familiar with the proposed expansion of College View Mobile Home Park , the undersigned believe that said expansion would in no way adversely affect the character of the neighborhood . Furthermore , this location of a mobile home park is ideal given the existence of wooded areas and hills surrounding the proposed site , which not only would help to provide a buffer between the area of expansion and the existing neighborhood , but would also add to the aesthetic quality of the development . • The undersigned fully support the expansion of College View Mobile Home Park and support Mr . Jacobs in his effort to help the Town of Ithaca by alleviating the need of this desperately needed form of affordable family housing . " The petition was signed by sixty persons in favor of the rezoning , who Attorney Albanese stated represented neighbors , existing residents and proposed residents . Attorney Albanese also presented the following letters : A letter from Florence Van Orman Hawks - 7S . Town Board 19 September 8 , 1986 "As an owner of 49 acres with 750 foot frontage at 160 Seven Mile Drive , I see no reason for objecting to Mr . Jacobs plans to increase his mobile home park . " Also , a letter dated August 28 , 1986 from Pete Curry , Transportation Manager for the Ithaca City School District - "After reviewing the plans for the proposed addition to the trailer park on Seven Mile Drive owned by Paul Jacobs , I see no problems regarding . school bus availability to the park . We would not normally travel into the park itself for regular school students , however , for a handicapped child it would be no problem with the grade of the driveway , the height , or the width of the driveway . " Attorney Albanese stated that the Planning Board after review, determined the proposed expansion would have a negative environmental impact . It took a total of five appearances before the Planning Board and most of these people here tonight had the opportunity to speak at at least one of these public hearings . All issues were addressed by the Planning Board . The Planning Board recam ended the Town Board approve the project . He noted that through the adoption of the local law establishing mobile home parks in the Town of Ithaca , the Town Board had voted six to zero to accept the need for this kind of affordable housing . Paul Tavelli , attorney for the people opposed to the mobile how park responded that the people opposed feel a full environmental statement should be done . Number one , they feel there is a problem with the traffic , and number two the portion on water and sewer says the Town Board will defer to the Health Department . We feel there is a need to set up sow guidelines . A mobile hone park should be located in a place that has public water and sewer . The Town Board will have nothing to say if it turns enforcement over to the Health Department . He stated that he did not think the Town Board could accept a "won ' t be significant " statement without further study . He went on to say that as far as not being able to see the trailer park from the road because of a buffer , if you plant evergreen trees it will be 20 years before they will be big enough to buffer the trailer park . He again stated that water and sewer problems should be solved now, not after the park is established . William Seldin , attorney for the people opposed to the mobile home park referred to Part II of the Environmental Assessment Form . In particular , Item #4 "Will proposed action affect any non-protected existing or new body of water ? " - there is a stream that runs adjacent to the park . The stream impacts to the Inlet , he questioned if there had been any study on the stream . Mr . Seldin went on to say that a lot of stuff was being dumped into the stream . The Health Department says the Town Board is lead agency on this , citizens say what if you rezone and then its too late to do anything about the dumping into the stream . Mr . Seldin referring to Item # 5 "Will proposed action affect surface or groundwater quality? " asked how did you arrive at a "no " answer? What studies were done ? Continuing he questioned the "yes " answer to Item # 6 "Will proposed action alter drainage flow , patterns or surface water water runoff" . Mr . Seldin went on to say that the proposed action is likely to cause a substantial erosion and that he had argued this point before the Planning Board . Item # 14 "Will there be an effect to existing transportation systems ? " , there is no major highway leading to Route 13 . Town Board 20 September 8 , 1986 Item # 17 "Will proposed action affect public health and safety? " , Mr . Seldin noted this question was answered "no " . He stated that there was forty years of complaints in the files from the Health Department . . Item # 19 " Is there public controversy related to potential adverse environmental impacts ? " , Mr . Seldin remarked that he agreed with this "yes " answer . Mr . Seldin continued , say that a trailer park on a hill looking down on Route 13 - to say you are going to hide it by planting evergreens is ludicrous . Doesn ' t even meet the standards of your own Cc oprehensive Plan . • Item #5 - "Will proposed action affect surface or ground water quality? " "no " conclusionary statement , what study was done ? Item # 11 - " Impact on aesthetic resources or commmity character " "yes " sounds like a politician running for office . Item # 14 - "Will there be an effect to existing transportation system" "yes " , I would like to see the study where the number of vehicles was projected and how the traffic would be dispersed . Item # 18 - " Impact on growth and character of community or neighborhood " "no " , this is a political answer . Supervisor Desch asked Mr . Seldin what a political statement was ? Mr . Seldin responded , the State put pressure on the Towns to find affordable homes . The people in the neighborhood are concerned about affordable housing . It ' s politics because the State of New York and this Board ' s decision to allow affordable homes in this Town . You talk about traffic , water and sewer and growing evergreen trees , we don ' t buy it . There are no studies to show what could happen against what will happen . Also , the Town Board is leaving the enforcement of water and sewer problems up to the Health Department . Then the Health Department will say the Town Board is lead agent , so we will leave it up to them . Mr . Seldin went on to say that there were numerous pictures of dumping , Pictures of the recreation area with a big pile of dirt in the middle of it and pictures of trailers without skirting . The people Opposed are concerned with reality not proposed . David Dubin , 178 Seven Mile Drive stated that he was not here when the law was passed . He went on to say that he had called the Health Department to ask them if they were responsible for the environmental impact and they said no . They would do the best they could to enforce any rules or regulations . He went on to say that he wrote a letter about the water but never received an answer . Cornell University experts say there are a lot of problems with water in this area , especially with trailer parks . He went on to say that traffic in the area was already a real problem , especially with buses . Mr . Dubin noted that Mr . Fabbroni , at a Planning Board meeting stated that if you wanted to get out on to Route 13 you had • better be patient . Attorney Seldin stated that full environmental impact statement that will address the concerns are real and justifible and is the only way to address these concerns . Town Engineer Lawrence Fabbroni responded that more information was Provided and answers to design questions were addressed at earlier meetings of the Planning Board . The water and sewer questions were refined during the normal review by the Health Department . If the Health Department approves the water and sewer portion of the 9 Town Board 21 September 8 , 1986 project , are you saying that the Town Board is not responding to these questions ? Supervisor Desch questioned if Mr . Seldin was concerned about the relationship between the Town and the Health Department not having a good record ? Mr . Seldin replied , no . The Town Supervisor raised a question about the density of the project , asked how many units per acre will there be when the development is completed? • The Town Engineer responded , 2+ units per acre . Supervisor Desch noted that if a developer came in with a proposal for an R-30 District he would be allowed 1 . 75 units per acre . Such a developer would also be required to set aside open land , just as was required of Mr . Jacobs . The Supervisor went on to say that most mobile home parks have significantly higher density than that proposed here . He then asked Mr . Jacobs whether or not the proposed addition of 32 units would be the total expansion proposed? Both Mr . and Mrs . Jacobs responded that they would not come back in the future with a request for approval of any units beyond this request . George Sheldrake , 124 Seven Mile Drive remarked that the existing trailer park had 25 trailers in 2 . 9 acres . He remarked that the proposed expanded area was 500 of all the open area figured in . He went on to say that Seven Mile Drive wouldn ' t get that kind of commitment for conventional housing until public water was installed . Supervisor Desch questioned if Mr . Sheldrake was implying that if the area had not been developed by now, people won ' t be rushing in to build conventional houses ? A lady in attendance responded , if nice houses were being built people wouldn ' t be so concerned . George Sheldrake remarked , 200 ' frontage , plus an acre for a water well and sewer system . While we are abiding with the zoning ordinance , Mr . Jacobs isn ' t required to . Mr . Dubin stated that the Health Department says they are not concerned with the environmental impact statement . Town Engineer Fabbroni responded , that is so clearly wrong . The Health Department is concerned with environmental impact statement , they just don ' t want to be lead agent . A man in attendance remarked that he agreed with George Sheldrake . If normal houses were being built on this acreage we would all be a • lot happier . Dorothy Negley , Lot 17 , 136 Seven Mile Drive stated that she enjoys living at the College View Trailer Park . She went on to say that she has had a new beginning since she moved there and that she was contented living in the College View Trailer Park . There are a lot of people , like myself , who can ' t afford to live anywhere else . A man in attendance remarked that as far as traffic was concerned , vehicles have two alternatives , Route 13 or Bostwick Road . Town Board 22 September 8 , 1986 Wendy Norman , Seven Mile Drive stated that she hated the noise . She went on to say that if she had had any idea of the noise she would not have moved to Seven Mile Drive . There is a lot of noise from motorcycles , not just those that live in the park , plus pickup trucks , dump trucks , tractor trailers . She went on to say that her child could not take a nap because of the noise . Millard Brink , 706 Elmira Road stated that he owned 80 acres of land across from the trailer park . In fact , my land provides a playground for the occupants of the trailer park . He stated that he now has his farm up for sale . Mr . Brink that he has retained his land , that is why there are no more housing developments on Seven Mile Drive . • Town Engineer Fabbroni addressing Attorney Seldin and Attorney Tavelli remarked that they had each seen the initial design which was inadequate . Mr . Jacobs had many meetings with the Health • Department . The end result was a thorough review with the Health Deparment irregardless of whether it was a public or private supply of water . The Health Department will continue to police the water supply and sewage system . Mr . Fabbroni added , based on what Mr . Tavelli says , this is not adequate . Attorney Tavelli responded that policing the water supply after the project is built will not help the problem . We want independent studies done before it is built . We don ' t think the Health Department is in a position to say build or do not build . David Dubin remarked , the Health Department is not in a position to say what will happen down the road . Town Engineer Fabbroni questioning the concerns on traffic asked on what basis do you want us to check traffic . The road could handle 3 , 000 cars a day , the increase of 192 cars shown in the impact statement will not have an effect on the road . He went on to say , we know the capacity of the intersection and the amount of increased traffic is incidential to what the road can currently handle , therefore , that is not a problem . In fact , it is so far from being a problem that it is not even considered to be an issue . If a person came in with a proposal that included travel by an additional 500 cars on a road with a capacity of 9 , 000 and an actual road count of 8 , 000 , this would be considered as a potential problem . Supervisor Desch questioned Mr . Seldin ' s traffic concern , asking what it was relative to? Mr . Seldin responded , in terms of the road bed , there will be sufficient additional traffic to warrent a full environmental impact statement . • Supervisor Desch responded , if the current traffic count were significantly higher and the projected addition was higher , then a full environmental assessment might be necessary . No one seems to be questioning the accuracy of the projection of 192 cars • additional traffic . David Dubin stated that he had called the Fire Chief ( Ithaca) and have gave him the figures on amount of water per minute available and the number of proposed trailers . The Fire Chief said this was not adequate . Town Engineer Fabbroni questioned if the Fire Chief was aware of the 12 , 000 storage tank ? Mr . Dubin responded that the Chief said he was aware of the area . Town Board 23 September 8 , 1986 Mrs . Norman spoke again stating that she was only concerned with the traffic and that she did not oppose trailer parks or the people who live in trailer parks or these particular people who are here from the trailer park tonight . Attorney Tavelli then filed with the Board the following petition addressed to the Town Board of the Town of Ithaca , from William S . Seldin , Esq . , regarding the proposed rezoning/Paul Jacobs , dated July 14 , 1986 : "Pursuant to Section 265 of the Town Law of the State of New York , we the undersigned , being the owners of twenty ( 200 ) per cent or more , either of the area of land included in such proposed change • or that immediately adjacent extending 100 feet therefrom , hereby protest said proposed and purported zoning change scheduled for a public hearing on September 8 , 1986 . " • The petition was signed by Jeff Coleman , Ronald and Sandra Knewstub , Millard Brink , Glen Snyder and Donald and Nansen Josselyn , The Town Supervisor suggested that it seemed that everyone had been heard but that the public hearing should be adjourned in case there were persons interested in the development who could not make tonights meeting . RESOLUTION NO . Motion by Supervisor Desch ; seconded by Councilman McPeak , RESOLVED , that the Town Board of the Town of Ithaca hereby adjourns the public hearing until 8 : 00 P .M . , on October 2 , 1986 , to consider the adoption of a local law to amend the Zoning Ordinance with respect to the proposed rezoning of the lands of Paul A Jacobs from Residence District R30 to Residence District R5 (Mobile Home Park District) located at 136-146 Seven Mile Drive , Town of Ithaca Tax Parcel no . 6-33--2-2 and a portion of Town of Ithaca Tax Parcel No . 6-33-2-1 . Councilwoman Leary stated that she would like to ask the people who are at this meeting and live in the College View Trailer Park how many cars they own . She went on to say that she found it hard to believe that anyone who can only afford a $20 , 000 home would own two cars . The people who live in the College View Trailer Park agreed wholeheartedly with Councilwoman Leary . (Desch , McPeak , Cramer , Howell , Bartholf and Leary voting Aye .
