HomeMy WebLinkAboutTB Minutes 1986-04-07 TOWN OF ITHACA REGULAR BOARD MEETING April 7 , 1986 At a Regular Meeting of the Town Board of the Town of Ithaca , Tompkins County , New York , held at the Town Offices at 126 East Seneca Street , Ithaca , New York , at 5 : 30 P .M . , on the 7th day of April , 1986 , there were . • PRESENT ; Noel Desch , Supervisor Henry McPeak , Councilman Shirley Raffensperger , Councilwoman Marc Cramer , Councilman Gloria Howell , Councilwoman Robert Bartholf , Councilman Patricia Leary , Councilwoman ALSO PRESENT : Lawrence P . Donna Mandell , W KO Ken Hughes , WHCU PLEDGE OF ALLEGIANCE The Supervisor led the assemblage in the Pledge of Allegiance . REPORT OF TOWN OFFICIALS Supervisor ' s Report Tax Reform Legislation Supervisor Desch reported that there is another wrinkle that would be caused by the House Rules version of the tax reform legislation . This has to do with reporting the amounts of real property taxes paid by individuals who claim deductions . The legislation would require the local municipality to report the amount of real estate taxes paid , to enable the IRS to verify the amount reported in the taxpayers return . This would place a very heavy burden on the Town that would be further complicated by taxpayers grouping together a number of properties . • The Supervisor went on to say that the IRS apparently has no basis for being concerned , so why should such a major step be needed? If there are no objections he stated that he would write to our Senators and Representatives and suggest that this provision be removed from the final form of the bill . Cayuga Heights Sewer Bills Supervisor Desch noted that the Village Board had accepted our idea that the Village sewer bills be collected by the Town in 1987 . However , there was some confusion over what their staff wanted to Town Board 2 April 7 , 1986 do logistically . We have , therefore , agreed to have the bills for 1986 rendered by the Village with a note on them informing the residents to pay the Town Clerk at the Town of Ithaca Office . The Town will then make a payment to the Village . This will provide a reasonably natural lead into the procedure in 1987 . Special Meeting The Supervisor stated that it would be necessary to schedule a Special Board Meeting next week to consider the permanent financing of the Town ' s share of the Ithaca Area Wastewater Treatment Plant Project and 1984 Water and Sewer Improvement Project . Flashing Lights on Warren Road • Supervisor Desch stated that the County Public Works committee will recommend to the County Board the construction of flashing lights at the Warren Road. school crossing if the Town will pay for the operation and maintenance . He went on to say that this was a reasonable request and one we should support in concept . Commissioner Mcbbs will build into the specifications a time clock which will operate the lights according to law , fran 6 : 00 A . M. to 7 : 00 P . M . Town Engineer ' s Report Town Engineer Lawrence Fabbroni reported that he is about ready to put the Hungerford Hill and Pine Tree Road tank painting out to bid , infact it will be advertised Wednesday . The timing seems to be pretty good . The bids will be opened prior to the May meeting . He went on to say that he has been investigating , more earnestly , new heating and air conditioning for Town Hall . He stated that he was quite positive about a roof unit as it will not take up more space in the building and would not require another chimney . Town Engineer Fabbroni stated that the Burns Road project was shaping up quite nicely and the landscape project will be accomplished in May . He went on to say that a formal appraisal was being done on the Hospital access . He did not know if the property owners would agree or if the Town would have to take the land . The Engineer went on to say that there has been a lot of activity on Forest Home Drive because of the good weather . As we expected , the material under the pavement produced no decent gravel . He went on to note that there was a drainage system which was put in when the old turnpike road was built , however , it had ceased to function a long time ago . Supervisor Desch questioned the Town Engineer ' s report regarding Cornell ' s involvement in the Forest Home Drive project . Town Engineer Fabbroni responded that Cornell would like to do their section this fall rather than have the road closed this year • for us and next year for Cornell . He went on to note that the biggest thing will be the annexation and legal action . He remarked that it was clear that the City will need to step up their actions . Supervisor Desch stated that he was concerned , we have a commitment to have the restoration done in September but with us doing Judd Falls Road you won ' t be able to get on campus . Town Engineer Fabbroni responded that Judd Falls Road will not be closed until the washout is fixed . Town Board 3 April 7 , 1986 Councilwoman Raffensperger stated that she had had two inquiries from people who heard that Judd Falls Road/Forest Home Drive intersection was going to be regraded . Town Engineer Fabbroni responded that we have looked at the prospect of doing away with the swing around at the intersection . He went on to say that it was obvious that somebody would suffer if we regrade the road . Two driveways will be effected , along with utilities and a retaining wall will need to be built . Councilwoman Raffensperger stated that there were also rumors going around about the proposed sidewalks . You assured us you would discuss any changes and regradings with the residents . • Town Engineer Fabbroni assured Councilwoman Raffensperger that he intended to discuss the changes with the residents before any work was commenced . Councilwoman Raffensperger asked the Engineer if there would be any work on the Town section? Town Engineer Fabbroni responded , we will be repaving this summer . Town Engineer Fabbroni went on to say that there are major activities with proposed developments for the Planning Board to consider , including the Collegeview Trailer Park expansion and a motel for the East Hill Plaza , The Planning Board has not yet reviewed the proposals , hopefully they will be ready for Town Board action in May . Supervisor Desch questioned the proposed expansion size of Collegeview Trailer Park . Town Engineer Fabbroni responded , they are proposing between 60 and 80 units . Town Engineer Fabbroni went on to say that Segment II of the Wastewater Treatment Plant was zooming ahead of schedule . The contractor is working on the punch list for Segment I . The lake portion is virtually completed . All that remains to be done on the metering stations is the installation of the metering devices . Councilman McPeak congratulated the Town Engineer on the nice article in the Ithaca Journal about the Wastewater Treatment Plant . REPORT OF COUNTY BOARD OF REPRESENTATIVES County Board of Representative Mary Call reported that the County had passed no resolutions that dealt specifically with the Town since their last Board meeting . She then reminded the Town that the deadline for applying for Flood Control monies was Friday . She noted that there have been several requests . Supervisor Desch noted that the Town had been informed of an • increase in the 1986 Chips money . Mrs . Call remarked that the County would also be getting an increase . REPORT OF THE QTY/TOWN FIRE SERVICE MASTER PLANNING COMMITTEE Sean Killeen , Councilman from the City of Ithaca and Chairman of the Fire Service Master Planning Ccnmittee presented to the Board , the following report . Town Board 4 April 7 , 1986 FINAL REPORT WITH RECCb1MaMTIONS CITY/TOWN OF ITHACA FIRE SERVICE MASTER PLANNING C"UTTEE EXECUTIVE SLI24ARY In July 1984 , the City and Town of Ithaca , formed an intermunicipal f ire service master planning committee to draw up a series of recommendations which would provide the community with a modern , first-class , cost-effective fire service . The Committee recommends that following actions . • 1 . The City and Town should complete negotiations on a long-term agreement by August 1986 . 2 . The City and Town while conferring should together begin negotiations with Cornell University and Ithaca College regarding the claims upon and commitment to support of the fire service by these institutions . 3 . Relocation of fire stations to the south and west , and a training facility are essential items in the above negotiations . 4 . The environmental review process with City and Town jointly as lead agency should begin immediately . 59 The volunteer firefighter incentive program should be enhanced in 1987 City and Town budgets . 6 . The Fire Alarm Ordinance should be considered for adoption by City and Town Councils . 7 . This Committee should expire with 1986 ; a more permanent Master Planning Conni.ttee should be conceived by the forthcoming intermunicipal agreement . He went on to say that the above report was presented to Common Council at their meeting last Wednesday . A resolution was passed asking the Mayor to establish a negotiating committee immediately , Mr . Killeen stated that he also wished to thank former Town Councilman David Jennings for all his support and effort in getting the project off the ground level , On behalf of the Town Board , Supervisor Desch thanked Sean Killeen for the many hours he has devoted to the project . He went on to say that it would be a formable task to get the negotiations formalized by August 1986 . AUDIT REPORT RESOLUTION NO , Motion by Councilman Cramer ; seconded by Councilman McPeak , RESOLVED , that the Town Board of the Town of Ithaca hereby accept the audit report as prepared by Ciaschi , Dieters-Hagen , Schaufler & Mickelson for the fiscal year ending December 31 , 1985 ° (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none ) . ADJOURNED MEETING Supervisor Desch stated that action on agenda items 6 and 7 , the permanent financing of the Town ' s share of the Ithaca Area Wastewater Treatment Plant and the 1984 Water and Sewer Improvement Project , would need to be adjourned until noon on April 170 COMMITTEE TO DEVELOP CATIONS ON ZONING ORDINANCE AMENDMENTS ON OCCUPANCY LIMITATIONS Supervisor Desch stated that he would like to create a committee , consisting of two Town Board member and two Planning Board members to work with the staff on occupancy limitations . He went on to say that the committee should be prepared to report back with their ® recommendations by August 15 , The Supervisor then appointed Councilman McPeak and Councilwoman Raffensperger as the two Town Board members on the committee along with two members of the Planning Board to be appointed by the Planning Board . (NOTE ° At the suggestion of the Chairman of the Zoning Board of Appeals , two members from that Board have been added) ENGINEERING REPORT ON 1987 WATER AND SEWER IMPROVEMENTS Town Board 6 April 7 , 1986 Supervisor Desch stated that it was necessary to begin the initial planning of water and sewer needs on West Hill which is also in response to the number of requests the Town has received . He noted that the areas are listed , on the resolution , in a priority order but that he hoped it would be possible to tie all together into one package . The extension to East Shore Drive was the result of the annexation of the Tin Can property to the City and the eleven City properties to the Town which were promised sewer . Extension of utilities to the DuBois Road , Trumansburg Road , Woolf Lane area to solve the problems in this area . The hospital sewer line which was not extended and a piece of the Mecklenburg Road in conjunction with the City who want to extend utilities to the City line . Supervisor Desch questioned why a budget figure had not been • included in the resolution . Town Engineer Fabbroni responded that $ 10 , 000 will take us almost through the field work . The $ 10 , 000 may not get us through the design stage and , therefore , the figure may need to be adjusted . RESOLUTION NO . Motion by Supervisor Desch ; seconded by Councilwoman Raffensperger , WHEREAS , the Town is considering extension of water and/or sewer lines to the following areas : Taughannock Boulevard - West lake shore East Shore Drive - East lake shore DuBois , Indian Creek , Trumansburg Roads , Woolf Lane and Grove Road Hospital Sewer line replacement Mecklenburg Road Tanks and pump facilities necessary to above extensions , and WHEREAS , the Town Board has set the following timetable for engineering services to be performed in-house : Engineering Outline with cost feasibility for alternative improvements June 1986 and financing Engineering report August 1986 for public hearing Engineering field work June August 1986 Engineering contract documents September-March 1986 /87 Intermunicipal Agreements June-March 1986 / 87 Capital project bid March-September 1987 Award of contract October 1987 Construction and inspection October 1987 November 1988 ; NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of Ithaca , that the Town staff be authorized to prepare the necessary Town Board 7 April 7 , 1986 engineering reports for such extensions to enable the Town Board to decide on specific project limits and funds to be expended , such professional work to be funded from budget items CF 8340 . 48 and CF 8120 . 483 , estimated in-house cost for engineering field work and preparation of engineering report is $ 10 , 000 . Councilman Cramer asked if the DuBois - Trumansburg Road area extensions would be for water or sewer? Town Engineer Fabbroni responded , we are hoping to provide both water and sewer . (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none) . • PERSONS TO BE HEARD There was no one present who wished to address the Board . MINUTES As Board members have not had sufficient time to read the minutes , they will be considered at another Board meeting . ADVERTISING FOR TOWN PLANNER RESOLUTION N0 . Motion by Councilman Cramer ; seconded by Councilwoman Howell , WHEREAS , Town of Ithaca Planner Peter Lovi resigned from the position , effective March 21 , 1986 , and WHEREAS , there is a need to fill the position , NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of Ithaca hereby authorize the advertising of the position of Town Planner . (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none) . REFUND ON WATER ACCOUN'T'S RESOLUTION N0 . Motion by Councilwoman Raffensperger ; seconded by Councilman McPeak , WHEREAS , on March 13 , 1986 and again on March 21 , 1986 , Gerrard J . O ' Brien , 130 Snyder Hill Road paid his March 1 , 1986 sewer bill , NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of Ithaca hereby authorize a refund in the amount of $ 35 . 44 for sewer be paid to Gerrard J . RESOLUTION NO Town Board 8 April 7 , 1986 Motion by Councilman McPeak ; seconded by Councilman Bartholf , WHEREAS , R . John Muckey read his awn water meter for the December 11 1985 billing , and WHEREAS , on January 16 , 1986 , a Special Reading was done and at this time it was discovered that the customer had made a reading error on the December 1 , 1985 water bill , NOW FORE BE IT RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes a refund of $ 107 . 94 for water , $87 . 36 for sewer , $ 18 . 35 for water surcharge , $ 12 . 63 for water penalty and $8 . 74 for sewer penalty , total refund of $ 235 . 02 be made to R . REFUND ON BENEFIT UNITS RESOLUTION NO . Motion by Supervisor Desch ; seconded by Councilwoman Howell , WHEREAS , Roger and Priscilla McOmber , 1128 Trumansburg Road were charged 1 . 5 units of sewer on their 1986 Town and County Taxes , and WHEREAS , the existing sewer line will never allow this property to be connected to sewer , and WHEREAS , the taxes on this parcel were paid on January 24 , 1986 , NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of Ithaca hereby authorize a refund in the amount of $ 75 . 00 be paid to Roger and Priscilla McOmber , 1128 Trumansburg Road , Ithaca , New York , Tax Parcel Number 27-1-12 . WHAT ' S YOUR BEEF - WATER REFUND Councilwoman Raffensperger reported that when What ' s Your Beef received their water bill in December , the bill of $ 1 , 854 . 45 was double the usual amount , caused by a malfunction in a compressor . The computer kicks out bills that are unusually high and Bolton Point personnel inform the property owners or operators . Ray Thomas called What ' s Your Beef to inform them of their large water bill , however , the owners of What ' s Your Beef did not receive the message . Councilwoman Raffensperger suggested that Bolton Point personnel should keep of record of such calls , noting when they called and to whan they spoke to . Councilwoman Raffensperger noted that the bill had been paid in full and suggested that the owners • of What ' s Your Beef be refunded the surcharge of $ 155 . 50 . Supervisor Desch suggested that the surcharge beyond a normal water bill be refunded . Councilwoman Raffensperger stated that she recommends the entire surcharge of $ 155 . 50 be refunded . Councilman Cramer asked what their normal consumption was ? Town Board 9 April 7 , 1986 Councilwoman Raffensperger responded that a year ago , for the same period , their bill was $ 510 . 00 . The surcharge for that period was $86 . 70 . Councilman McPeak stated that he felt What ' s Your Beef should receive the full surcharge credit of $ 155 . 50 . RESOLUTION N0 . Motion by Councilman McPeak ; seconded by Councilwoman Raffensperger , RESOLVED , that the Town Board of the Town of Ithaca hereby authorize a refund , of the surcharge on the December 1985 bill , in • the amount of $ 155 . 50 be made to What ' s Your Beef , East Hill Plaza , Ithaca , New York, Account Number 169-0153319 . Councilman Cramer asked if there was any salvage value to the Building Inspector ' s present car? Town Engineer Fabbroni responded that the Building Inspector ' s car was not traded in , as the Town could only get three or four hundred for the car . He went on to say that $ 150 could be put into the car and used this summer , therefore , eliminating the need to rent another vehicle for the summer . RESOLUTION N0 . WHEREAS , bids for a new 1986 four door sedan were authorized to be taken by the Town Board under a budget of $ 8 , 000 , and WHEREAS , bids were opened April 4 , 1986 with the results showing four conplete proposals with a low bid of $ 7 , 474 submitted by Dave Ball Chevrolet Inc . , 1288 West Genessee Street , Syracuse , New York 13204 , NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of • Ithaca , that the Town Board award the bid to Dave Ball Cherrrolet Inc . , in the low amount of $ 7 , 474 . He stated that he felt the scheduling of a public hearing should be postponed until the Planning Board has made a recommendation . Councilman Cramer asked how much has been budgeted for a replacement car? Town Engineer Fabbroni responded , $8 , 000 but with a trade in we will be okay . • Councilman Cramer remarked that "disk" should not be added to .power brakes in the specifications . Councilman Bartholf remarked , why halogen headlights . RESOLUTION NO . Motion by Councilman McPeak ; seconded by Councilwoman Howell , WHEREAS , the Town Board has budgeted for replacement of the Town Highway Superintendent ' s vehicle in the 1986 adopted budget , and Town Board 11 April 7 , 1986 WHEREAS , the minimum specifications are the proposed specifications for such purchase , NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of Ithaca , that the Town Engineer is authorized to prepare bid documents to advertise for bids on a new 1986 sedan with bids to be opened May 9 , 1986 . (Desch , McPeak , Raffensperger , Cramer , Howell , Bartholf and Leary voting Aye . Nays - none ) . LETTER OF CREDIT FOR HIGHWAY EvRWVENIENTS FOR GRANDVIEW TERRACE SUBDIVISION ( IVAR JONSON) • Town Engineer Itemization - Grandview Subdivision Ivar Jonson -- Phase I Sewer at $30 . 00 per foot $ 30 , 000 Water at $30 . 00 per foot $ 45 , 000 Highway at $22 . 00 per foot $ 33 , 000 Drainage stone at $ 20 . 00 per foot $ 81000 Services and culverts at $ 22 . 00 per foot $ 22 , 000 Route 79 intersection $ 15 , 000 Total $ 153 , 000 Town Engineer Lawrence Fabbroni stated that we have been told that a Letter of Credit is no longer a guaranteed instrument . If a contractor deposits money in the bank , then the bank will be glad to give the Town a Letter of Credit . The Engineer went on to say that we are talking about all development costs of the first phase of about 15 houses and what is essential to the Town . This is were we arrived at the figure of $ 100 , 000 which will be decreased as the work is done . Phase I can be accomplished for $ 153 , 000 . We will hold $ 100 , 000 because that is the essential part of the $ 153 , 000 . Mr . Janson will get a release on the money he has already used (paid out for improvements ) as the work is completed to our satisfaction . Councilman Raffensperger remarked that the unusual part of this proposal is the giving back of money in phases during the construction of Phase I , instead of when Phase I is completed . Town Attorney Barney remarked , as I understand it , the $ 100 , 000 is against the $ 153 , 000 . $53 , 000 is not essential to the Town as the cost is. not essential to complete the road and utilities . Town Engineer Fabbroni stated that he had figured the water and sewer at a foot price , high enough for the Town to be able to finish the installation and still make a profit . Supervisor Desch stated that he felt the Town should not reduce a part of the credit when a part of the road has been completed , the • road must be completed in full before any money is released . Councilwoman Raffensperger asked if any kind of restrictions had been placed on the number of building permits that can be issued? Town Engineer Fabbroni responded , no . This phase of construction covers the lots that front on Terraceview Drive , If Mr . Jonson starts another section he will need another security . Town Attorney Barney asked if Mr . Jonson was likely to request all twelve or fifteen building permits ? Town Board 12 April 7 , 1986 Town Engineer Fabbroni responded , Mr . Jonson is likely to have six or seven houses under construction at one time . Town Attorney Barney remarked that the Town Board could put a ceiling on the number of building permits issued . Councilwoman Raffensperger stated that she was concerned that Mr . Jonson might want to roll over this money to another part of the project . Councilwoman Raffensperger went on to ask , if Terraceview Drive is all this is completed , does this agreement protect us , as this is Jonson ' s description of Phase I and not the Planning Board ' s description of Phase I . Town Engineer Fabbroni responded that this was difficult to answer . • Jonson could get to the entrances to the subdivision in Phase I and get the same number of building permits for less road than building the road from Honness Lane to Slaterville Road with houses on it and this would not leave us with a cul-de-sac or a horseshoe . Town Attorney Barney remarked that as long as Ivar Jonson had filed the map for the whole subdivision , he should secure the whole project . Town Supervisor Desch stated that , as there is a continuation of the project , a new agreement must be executed . Town Attorney Barney asked , if this project turns out to be another Beacon Hills , is there enough money to finish the project? Town Engineer Fabbroni responded , there would be enough money to finish Phase I . Councilwoman Raffensperger asked if the Town Board was aware the Planning Board has approved the whole subdivision . She went on to say that she would be more comfortable if the Planning Board had approved the phasing instead of Jonson . Torun Engineer Fabbroni responded that Mr . Jonson had filed the whole map which he was not required to do . Usually the map is filed in phases . He is phasing the project himself . Councilwoman Raffensperger questioned , no one else feels the Planning Board should review the project in phases ? She stated that she felt the Planning Board should look at the next phase . RESOLUTION NO . Motion by Supervisor Desch ; seconded by Councilman Bartholf , WHEREAS , the Grandview Subdivision received Final Subdivision Approval from the Planning Board on March 4 , 1986 , and WHEREAS , the developer , Ivar Jonson , must post a form and amount of security acceptable to the Town Board against completion of development of Terraceview Drive if more than one building permit • is issued , and WHEREAS , one building permit has already been issued for the property as a whole fronting on Slaterville Road , and WHEREAS , the developer , Ivar Jonson , has provided the Town with a breakout of development costs as attached , and WHEREAS , the developer would like to secure improvements for a f irst phase on Terraceview Drive to obtain building permits on an incomplete Town highway , and Town Board 13 April 7 , 1986 WHEREAS , the Town Engineer has prepared a breakdown to secure the portion of Phase I of the developer that is essential to the development and public use of properties on Terraceview Drive , NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of Ithaca , that the Town Supervisor and Town Attorney be authorized on behalf of the Town to enter into an agreement with developer , Ivar Jonson , to secure $ 100 , 000 in an instrument such as letter of credit , bond , cash , acceptable to both and completely satisfactory to the Highway Superintendent to satisfy the requirement of Town Law that such protection be given to completing Terraceview Drive as a fully developed Town highway with utilities as approved , completely satisfactory to the Town Engineer , and • FURTHER RESOLVED , that such agreement provide for a reduction of security in such a way that remaining work will be secured at least up to the unit costs as outlined by the Town Engineer while recognizing that the essential $ 100 , 000 will not be reduced until the balance of Phase I work (although not all essential to Terraceview Drive) falls below $ 100 , 000 , AND FURTHER RESOLVED , that upon submission of the required documents , the Building Permits may be issued for lots on Terraceview Drive but not elsewhere in the project and providing all other Building Permit requirements are met . WHEREAS , Jerold Weisburd has requested release of security for phases of Commonland Community completed to date , and WHEREAS , the Town Engineer , Town Planner and Town Building Inspector reviewed completed phases of Cormonland with the following items among unfinished details : 1 ) Finished grading and seeding of playfield . 2 ) Bank grading and landscaping north of playfield . 3 ) Drainage swale capacity and culvert size to drain playfield . 4 ) . Drainageway ( stoned) south of driveway , south of pond . 5 ) Regrading and landscaping of pond south bank . 6 ) Completion of Community Building for residents ' use . 7 ) Restabilization of bank above entrance road . 8 ) Restabilization and seeding of banks below Marion property . 9 ) Replacement of dead evergreens , spruces , and miscellaneous landscaping . 10 ) Priming and final painting of structural grade beams . 11 ) Completion of roof drainage and footer drain systems to • protect structural woodwork and maintain stable drainage system for column support system. 12 ) Waterproofing of exposed structural masonry walls . 13 ) Completion of drainage details along City reservoir property line to eliminate erosion around buildings , completely seed bared areas , and temporarily retain area to arrest velocity and rate of runoff .
