TOWN BOARD MEETING As a result of COVID-19, and the Executive Order of the Governor of the State of New York, the Regular Meeting of the Town Board of the Town of Cortlandville was held via Zoom, video and telephone conferencing, with Supervisor Williams presiding. Members present: Supervisor, Thomas A. Williams Councilman, Jay E. Cobb Councilman, Jeffrey D. Guido Councilman, Theodore V. Testa Councilman, Douglas E. Withey Town Clerk, Kristin E. Rocco-Petrella Others present were: Town Attorney, John A. DelVecchio; Deputy Town Clerk, Abigail Albro; Town Resident: Chris Mott; News Reporter, Colin Spencer from the Cortland Standard. Supervisor Williams called the meeting to order. A roll call was conducted with all members of the Board, Town Attorney and Town Clerk present. The additional attendees were announced as well. Councilman Withey made a motion, seconded by Councilman Cobb, to approve the Draft Town Board Minutes of June 17, 2020. All voting aye, the motion was carried. Councilman Cobb made a motion, seconded by Councilman Withey, to receive and file the Cortlandville Zoning Board of Appeals Minutes of March 3, 2020. All voting aye, the motion was carried. There was a brief discussion regarding approval of the purchase order to be paid to Beard Electric for the purchase of a 65” monitor to be temporarily installed on the wall in the Municipal Garage. Supervisor Williams noted that the Board has been discussing the purchase of a monitor since January 2020 and were in agreement to purchase the monitor to be installed in the meeting room/court room, however the purchase was stalled due to COVID-19. The monitor would be purchased and installed in the temporary meeting area in the Municipal Garage. Eventually, when the boards are able to conduct meetings back inside Town Hall, the monitor would be moved. Supervisor Williams added that the Town already purchased the speakers that would be eventually installed in the meeting room; the speakers were temporarily mounted in the Municipal Garage. The purchase of new microphones for the meeting room would be the only things left to purchase in the future to complete the project. RESOLUTION #152 AUTHORIZE SUPERVISOR TO SIGN PURCHASE ORDER #1286 TO BE PAID TO BEARD ELECTRIC LLC FOR THE PURCHASE AND INSTALLATION OF A 65” FLAT SCREEN MONITOR Motion by Councilman Guido Seconded by Councilman Cobb VOTES: AYE – Williams, Cobb, Guido, Testa, Withey NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby authorize and direct the Supervisor to sign Purchase Order #1286 submitted by Supervisor Williams to be paid to Beard Electric LLC, for the purchase and installation of a 65” flat screen monitor with a full motion mount to be used for board meeting presentations and trainings, for the total cost of $2,347.00. All voting aye, the motion was carried. Attorney DelVecchio reported: Executive Session: Attorney DelVecchio requested the Board convene to an executive session at end of meeting to discuss pending litigation. Town Board Reports: Councilman Guido apprised the Board he attended the virtual meeting/webinar hosted by EDF Renewables last week regarding the large solar farm application, which he found informative. Attorney DelVecchio added that the Board would be receiving and filing a document later in the meeting regarding the administrative ruling approving the Towns of Cortlandville, Homer and Solon for the available “Intervener Funds”. Attorney DelVecchio would be playing a peripheral role in the process, while Attorney Pat Snyder, who represents the Town of Homer, was selected as the Intervener attorney. Up to $31,500 was available for Phase 1 (design phase) of the project. If the project moves forward to the construction phase, up to $90,000 was available. Attorney DelVecchio explained that he has access to any documents that are filed regarding the solar project through a specific website. He would update the Board as necessary. Supervisor Williams reported: Gutchess Lumber Sports Complex – Accessible Playground: Supervisor Williams apprised the Board he met both Laura Cassalia from the Town’s engineering firm, CHA, and the representative from the playground equipment company to finalize the plans for the accessible playground at the Gutchess Lumber Sports Complex (GLSC). Plans and the price quotes were provided to the Town, which Supervisor Williams made available to the Board. After having several conversations with the salesperson, Supervisor Williams was confident that the total cost of the project would not exceed $150,000. At this time, the Town has $10,000 set aside from a private donation for the GLSC as well as $84,292.39 in CDBG program income funds already approved and committed (by the NYS Office of Community Renewal) for the accessible playground project. The Town lacked $55,707.61 to complete the playground project, however per Supervisor Williams there is JULY 1, 2020 TOWN BOARD MEETING PAGE 3 approximately $382,000 in General Fund A surplus funds from 2019 that could be used to fund the remainder of the project if authorized by the Board. Councilman Withey voiced his support for moving forward with the project and utilizing Town employees to assemble the playground, which would save the Town money in that respect. Supervisor Williams added that the playground equipment company would provide supervision for the assembly and that volunteers would also assist Town highway department employees with the assembly. Councilman Testa commented on the potential economic impact that the GLSC could have for the community and the need to have a solid plan for the park as the Town continues to build. He stated that professionals must layout the plan for the park project to make sure the project is done right. The Board agreed. Supervisor Williams explained that the playground would complete the first phase of the project. Highway Sup’t. Bassett was working on the next phase of the parking lot and then move on to Phase 2 of the project to build the other baseball fields and soccer fields. Supervisor Williams stated that although the CDBG funds were already approved for the accessible playground equipment, he was concerned that the State would take the money back if the Town does not spend the funds. Supervisor Williams asked the Board to approve the expenditure of up to $150,000 for the purchase of the accessible playground equipment, and to authorize the transfer of funds. RESOLUTION #154 AUTHORIZE EXPENDITURE OF UP TO $150,000 TO PURCHASE AND INSTALL THE ACCESSIBLE PLAYGROUND EQUIPMENT FOR THE GUTCHESS LUMBER SPORTS COMPLEX Motion by Councilman Guido Seconded by Councilman Withey VOTES: AYE – Williams, Cobb, Guido, Testa, Withey NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby authorize the expenditure of up to $150,000 to purchase the accessible playground equipment to be located and installed at the Gutchess Lumber Sports Complex, and it is further RESOLVED, the accessible playground equipment shall be purchased from Landscape Structures, Inc. through the Sourcewell Contract: 030117-LSI, NJPA Member #75926. RESOLUTION #155 AMEND THE 2020 BUDGET AND AUTHORIZE SUPERVISOR TO TRANSFER FUNDS Motion by Councilman Cobb Seconded by Councilman Testa VOTES: AYE – Williams, Cobb, Guido, Testa, Withey NAY – 0 ADOPTED BE IT RESOLVED, the Supervisor is hereby authorized and directed to transfer funds to adjust the accounts of the 2020 Budget for the Town of Cortlandville, in order to purchase the accessible playground equipment for the Gutchess Lumber Sports Complex appropriating General Fund A fund balance and Community Development Block Program Income funds already committed and approved by the New York State Office of Community Renewal in 2018, as follows: FROM TO AMOUNT A599 A9901.9 $55,707.61 CD4200 HG5031 $84,292.39 AND IT IS FURTHER RESOLVED, a prior year donation of $10,000 is already available in the Gutchess Lumber Sports Complex capital project fund (HG201) shall be expended to complete the accessible playground project. JULY 1, 2020 TOWN BOARD MEETING PAGE 4 Proposed Changes to Town Code, Chapter 171 – Water and Sewer: Supervisor Williams apprised the Board the Town received a request from a homeowner to install of a second water meter at her residence to measure water usage. At this time, there are three or four residential (single family) properties in the Town that have a second water meter installed to measure water consumption separately from sewer usage. Per the current Code, a second meter was allowed. Supervisor Williams explained that primarily a second meter was installed to measure water used for gardening or such things as pool fills. Supervisor Williams stated that Attorney DelVecchio would discuss the matter further later in the meeting. Application to FEMA for Reimbursement of Expenses due to COVID-19: Supervisor Williams explained that the Town submitted a preliminary application to Homeland Security – FEMA to reimbursed for Town expenses as a result of the COVID-19 pandemic. A conference call was scheduled for the following week with representatives of FEMA to guide the Town through the application process and to explain potential reimbursable expenses. The Town has been keeping track of purchases/expenses since the pandemic started. Town Board Meetings: Supervisor Williams stated that the Town Board has been conducting their meetings via Zoom videoconference and would continue to do so throughout the month of July. While a decision had yet to be made, he suggested that the Board’s first meeting in August be held in person at the Municipal Garage. He explained that two of the upcoming agenda items would require public hearings to be conducted. Gutchess Lumber Sports Complex – Upcoming PBR Baseball Events: Supervisor Williams explained that the Town has allowed the NYS Prep Baseball Report (PBR) use of the Gutchess Lumber Sports Complex to host its baseball scouting events. The PBR is one nationally recognized and is highly scouted by the college and professional community. Top baseball programs and athletes play in the PBR event, which creates an atmosphere and platform for athletes looking to gain national exposure. Due to COVID-19, PBR spent in excess of $10,000 to videotape the events to provide scouting opportunities. Events would be held at the GLSC July 6-8, 2020 and again on July 17-18, 2020. The events typically bring baseball players from the northeast from New Hampshire to Canada and is competitive play. However, due to COVID-19 and travel restrictions by State rules, the Town is allowed to have players participate in the events from this region and contiguous counties. Supervisor Williams explained that he had a meeting with Machell Phelps from the Cortland Regional Sports Council to discuss the matter, and asked that the Town abide by the State requirements that allow for players to attend from this region or contiguous counties. Councilman Withey asked who would oversee the program and monitor the events to ensure social distancing and wearing of masks was adhered to. Supervisor Williams explained that a protocol was provided for the events, including players using their owns bats and balls, sanitizing procedures, temperature checks; waivers signed. The PBR would be responsible for the events, while the Town would provide Recreation Attendants to ensure bathrooms were clean and bleachers were properly marked. He added that only two spectators per player were allowed by state regulation. Part-time Town employee, John McNerney would be monitoring the event as well. The County provided hand sanitizer and masks that would be available at the event as well. Supervisor Williams added that the PBR hosted a similar event in Pennsylvania last weekend and heard no complaints. RESOLUTION #156 DECLARE THAT THE TOWN OF CORTLANDVILLE SHALL ABIDE BY NEW YORK STATE REQUIREMENTS THAT ALLOW FOR PLAYERS FROM THE REGION OR CONTIGUOUS COUNTIES TO ATTEND THE PBR EVENTS TO BE HELD AT THE GUTCHESS LUMBER SPORTS COMPLEX Motion by Councilman Withey Seconded by Councilman Guido VOTES: AYE – Williams, Cobb, Guido, Testa, Withey NAY – 0 ADOPTED JULY 1, 2020 TOWN BOARD MEETING PAGE 5 BE IT RESOLVED, the Town Board does hereby declare that the Town of Cortlandville shall abide by New York State requirements that allow for players from the region or contiguous counties to attend the New York State Prep Baseball Report (PBR) events to be held at the Gutchess Lumber Sports Complex and to proceed with the plan as outlined. Supervisor Williams added that in light of the current matters in the State, it would behoove the Board to speak with one voice. He stated that he spent the better part of the past two weeks speaking with many representatives and has a good handle on matters between the State and the Town, and mentioned that the County Legislative Chair speaks with the State daily and provides updates. According to Town Law, no one individual can speak for the Town without the authority of the Town Board. Supervisor Williams stated he believed in the Town Board process and in the democratic process. He asked the Board to let him know if there was anything they wanted communicated and he would do so, especially during this time when representatives have a huge amount of stress on them (due to COVID-19). Attorney DelVecchio concurred, especially during this time. There was a brief discussion regarding the renewal of the lease agreement between the Town and John Diescher d/b/a Diescher Farms for the lease of Town property for farming purposes. Attorney DelVecchio explained that the lease agreement was the same agreement from the prior year. For information, the amount of land to be leased changed from the 80 acres in 2018, to 50 acres in 2019, with slightly less land to be leased in 2020 at the same price of $3,500.00. RESOLUTION #157 AUTHORIZE THE 1-YEAR LEASE AGREEMENT BETWEEN THE TOWN OF CORTLANDVILLE AND JOHN DIESCHER FOR A PORTION OF TOWN PROPERTY LOCATED AT 3111 BYRNE HOLLOW CROSSING SUBJECT TO PERMISSIVE REFERENDUM Motion by Councilman Cobb Seconded by Councilman Testa VOTES: AYE – Williams, Cobb, Guido, Testa, Withey NAY – 0 ADOPTED BE IT RESOLVED, that the Town Board of the Town of Cortlandville does hereby authorize the 1-year lease of approximately 50 acres of Town property located at 3111 Byrne Hollow Crossing in the Town of Cortlandville, known as the site of the Gutchess Lumber Sports Complex, a portion of tax map #105.00-04-02.000, for the total rent of $3,500.00, to John Diescher for the purpose of crop farming, and it is further RESOLVED, this resolution is adopted Subject to Permissive Referendum as required by law. Councilman Guido made a motion, seconded by Councilman Withey, to receive and file correspondence from Young/Summer LLC, Attorneys at Law, dated June 16, 2020, regarding the application of EDF Renewables Development, Inc. for Certification of Environmental Compatibility and Public Needs for the construction of the Solar Energy Center in the Towns of Homer, Cortlandville & Solon. All voting aye, the motion was carried. Councilman Testa made a motion, seconded by Councilman Withey, to receive and file correspondence from New York State Board on Electric Generation Siting and the Environment, dated June 16, 2020, regarding the Solar Energy Center in the Towns of Homer, Cortlandville & Solon. All voting aye, the motion was carried. JULY 1, 2020 TOWN BOARD MEETING PAGE 6 RESOLUTION #158 REFER AQUIFER PROTECTION PERMIT APPLICATION SUBMITTED BY TOM KILE FOR THE CNY LIVING HISTORY CENTER FOR PROPERTY LOCATED AT 4386- 4392 US ROUTE 11 TO THE TOWN AND COUNTY PLANNING BOARDS FOR REVIEW AND RECOMMENDATIONS Motion by Councilman Cobb Seconded by Councilman Testa VOTES: AYE – Williams, Cobb, Guido, Testa, Withey NAY – 0 ADOPTED BE IT RESOLVED, the Aquifer Protection Permit application submitted by Tom Kile on behalf of the CNY Living History Center, for property owned by Homer Cortland Community Agency located at 4386-4392 US Route 11, tax map #76.15-01-30.000, shall be forwarded to the Town and County Planning Boards for review and recommendations, and it is further RESOLVED, the Aquifer Protection Permit application is hereby received and filed. There was discussion regarding a proposed Local Law of 2020 to make additions and modifications to Part II of General Legislation of the Town of Cortlandville Code, Part 1, Chapter 171 – Water and Sewer. Attorney DelVecchio explained that Water & Sewer Sup’t. Alteri and Water/Sewer Operator Brian Congdon prepared the draft changes to the Code over the past year, which he in turn drafted as an amendment to the local law. One significant part of the change in the Code was to not allow a second meter for residential properties. Attorney DelVecchio explained that the Board was being asked to accept the proposal and move it to a public hearing. Councilman Withey explained that it was common practice in the City of Cortland to allow more than one meter and stated he would be in favor of allowing a second meter to be installed; water and sewer could be metered separately. He stated that the Town no longer allowed relief for sewer charges due to pool fills, however people do not like to pay for something they are not receiving. Supervisor Williams indicated that he had many conversations with Sup’t. Alteri regarding the matter and noted concerns regarding metered water, payments to the Wastewater Treatment Plant, infiltration and such. Attorney DelVecchio added comments from his conversations with Water & Sewer Sup’t. Alteri. It was suggested that Water & Sewer Sup’t. Alteri attend the next Board meeting to address the Board and answer questions. At this time, the Board received and filed the proposed local law and scheduled a public hearing. RESOLUTION #159 ACKNOWLEDGE RECEIPT OF THE PROPOSED LOCAL LAW OF 2020 TO AMEND CHAPTER 171, WATER AND SEWER, OF THE CODE OF THE TOWN OF CORTLANDVILLE AND SCHEDULE A PUBLIC HEARING FOR AUGUST 5, 2020 Motion by Councilman Testa Seconded by Councilman Guido VOTES: AYE – Williams, Cobb, Guido, Testa, Withey NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby acknowledge receipt of a proposed Local Law of 2020 to amend Chapter 171, Water and Sewer, of the Code of the Town of Cortlandville by making additions and modifications to Part II of General Legislation of the T own of Cortlandville Code, Part 1, Chapter 171 – Water and Sewer, and be it further RESOLVED, a Public Hearing shall be scheduled for Wednesday, August 5, 2020 at 5:00 p.m. regarding the proposed Local Law. JULY 1, 2020 TOWN BOARD MEETING PAGE 7 There was discussion regarding a proposed local law to add Chapter 91 entitled “Firearms” to Part II of General Legislation of the Town of Cortlandville Code. Supervisor Williams explained that he asked Attorney DelVecchio to draft a proposed local law after realizing the Town did not have a law in place to prohibit firearms in the Town Hall or other municipal buildings. He stated that his request was not the result of any incident. He stated that federal building, schools and colleges do not allow firearms. Supervisor Williams stated that the proposed law was provided to the Board for their review. He suggested one change be made to the definition of “person” and suggested language be added for an exception to allow a person designated by the Supervisor to be allowed on site with a firearm for a specific period of time. He offered the example of a state representative conducting a meeting at the Town Hall who would perhaps have security detail present with a firearm, or perhaps a private investigator or detective on site looking into a matter. Attorney DelVecchio suggested the addition of language such as, “unless otherwise prescribed by law”. He explained that the draft local law was modeled after local laws from the towns of Dewitt and Jamesville. He would conduct further research regarding Supervisor Williams’ suggestion and would report back to the Board. Rather than receiving and filing the draft local law, the Board tabled the matter to allow for possible changes to be made to the draft prior to scheduling a public hearing. RESOLUTION #160 TABLE ACTION REGARDING A PROPOSED LOCAL LAW OF 2020 TO ADD CHAPTER 91 ENTITLED “FIREARMS” TO PART II OF GENERAL LEGISLATION OF THE CODE OF THE TOWN OF CORTLANDVILLE UNTIL JULY 15, 2020 Motion by Councilman Cobb Seconded by Councilman Guido VOTES: AYE – Williams, Cobb, Guido, Testa, Withey NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby table action regarding a proposed Local Law of 2020 to add Chapter 91, entitled “Firearms” to Part II of General Legislation of the Code of the Town of Cortlandville until July 15, 2020. There was a brief discussion regarding authorizing the Water & Sewer Sup’t. to accept the highest bid from Auctions International, online auction website, for a 1997 Cargo Trailer. Supervisor Williams noted that the trailer was purchased by the Town in the amount of $4,000. The current bid for the trailer, 23-years later, was over $3,300. Supervisor Williams and the Board commended the Water & Sewer Department employees for taking such great care of the equipment. Councilman Withey stated that the Town had “top-notch employees” who did a phenomenal job. Supervisor Williams asked for Board authorization to accept the highest bid at the close of the auction this evening. RESOLUTION #161 AUTHORIZE WATER & SEWER SUP’T. TO ACCEPT BID FOR THE 1997 CARGO TRAILER FROM THE HIGHEST RESPONSIVE BIDDER ON AUCTIONS INTERNATIONAL Motion by Councilman Cobb Seconded by Councilman Withey VOTES: AYE – Williams, Cobb, Guido, Testa, Withey NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby authorize and direct the Water & Sewer Sup’t. to accept the bid for the sale of the 1997 Cargo Trailer, 2008 14’ equipment cargo trailer (Vin #4YMUL10118V172198), from the highest responsive bidder from Auctions International, an online silent auction site, in the amount of $3,550.00. Councilman Cobb made a motion, seconded by Councilman Testa, to receive and file correspondence from New York State Homes & Community Renewal, dated June 25, 2020, regarding the Town’s 2019 NYS Community Development Block Grant Town-wide Housing Rehabilitation Grant Program (CDBG #287HR323-19). All voting aye, the motion was carried. JULY 1, 2020 TOWN BOARD MEETING PAGE 8 Councilman Cobb made a motion, seconded by Councilman Testa, to receive and file correspondence and the “Certificate of Completion” from New York State Homes & Community Renewal, dated June 23, 2020, regarding the Town’s 2018 NYS Community Development Block Grant for Royal Nissan of Cortland, Inc. (CDBG #287SB902-18). All voting aye, the motion was carried. No further comments or discussion were heard. Councilman Withey made a motion, seconded by Councilman Testa, to recess the Regular Meeting to an Executive Session to discuss pending litigation. All voting aye, the motion was carried. The meeting was recessed at 6:23 p.m. Councilman Testa excused himself from the Executive Session at 6:30 p.m. Councilman Withey made a motion, seconded by Councilman Cobb, to adjourn the Executive Session and reconvene the Regular Meeting. All voting aye the motion was carried. The Executive Session was adjourned at 6:35 p.m. Councilman Testa returned to the meeting at this time. Supervisor Williams explained that two matters were discussed during the Executive Session. The first matter involved a wage increase for part-time employee Nicholas Alteri. RESOLUTION #162 AUTHORIZE WAGE INCREASE FOR PART-TIME BUILDING-RECEPTIONIST, NICHOLAS ALTERI EFFECTIVE JUNE 7, 2020 Motion by Councilman Withey Seconded by Councilman Cobb VOTES: AYE – Williams, Cobb, Guido, Testa, Withey NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby authorize a wage increase for part -time Building Receptionist, Nicholas Alteri, 1101 Church St., Cortland, NY 13045, from $15.00 per hour to $20.00 per hour, effective and retroactive to June 7, 2020 as a result of additional duties performed for the Town of Cortlandville. Supervisor Williams explained there was an ongoing electrical problem in the ground behind Rex’s Restaurant located off of Route 222 (Groton Avenue Plaza) due to damage by the Water & Sewer Department during an emergency repair. It was acknowledged that Councilman Testa was the owner of the property (leased to Rex’s Restaurant); however he was not involved in the repair or damage. Supervisor Williams asked for a motion to pay for the necessary repairs. Attorney DelVecchio clarified there was an original invoice to fix the electrical issue in the amount of $5,607 proffered by Beard Electric. Mr. Testa agreed to pay and paid $2,600 towards the invoice. Attorney DelVecchio asked for a motion that the Town will pay the rest of that invoice over and above the amount Mr. Testa has already paid, and also any money in addition to that to fix any other outstanding issues discovered by Beard Electric. Councilman Withey asked for a total cost of the repair at the next meeting. RESOLUTION #163 AUTHORIZE PAYMENT TO BEARD ELECTRIC TO RESOLVE AN ELECTRICAL ISSUE DUE TO DAMAGE BY THE TOWN WATER & SEWER DEPARTMENT DURING AN EMERGENCY REPAIR Motion by Councilman Withey Seconded by Councilman Cobb VOTES: AYE – Williams, Cobb, Guido, Withey NAY – 0 ABSTAIN - Testa ADOPTED JULY 1, 2020 TOWN BOARD MEETING PAGE 9 WHEREAS, the Town of Cortlandville Water & Sewer Department completed an emergency water repair at 1098 Route 222 (Rex’s Restaurant), tax map #86.13-01-55.211, owned by Theodore V. Testa, in which the Town damaged the electrical service, therefore BE IT RESOLVED, the Town Board does hereby authorize and direct that the Town of Cortlandville will pay the rest of the invoice to Beard Electric over and above the amount already paid by Mr. Testa ($2,600), and any money in addition to that original invoice to fix any other outstanding issues discovered by Beard Electric. No further comments or discussion were heard. Councilman Cobb made a motion, seconded by Councilman Withey, to adjourn the Regular Meeting. All voting aye, the motion was carried.
