Budget Meeting of the Ithaca Town Board
Thursday, October 6, 2011 at 5:30 p.m.
MINUTES
Board Members Present:
Herb Engman, Bill Goodman, Pat Leary, Eric Levine, Tee-
Ann Hunter and Rich DePaolo Absent: Nahmin Horwitz

Supervisor Engman called the meeting to order at 5:34. Agenda items regarding the
IAWWTP were moved forward because Agenda Item #1 was a public hearing which
could not be opened until 5:45 p.m.
Discuss the Ithaca Area Waste Water Treatment (IAWWP) Plant Budget
Mr. Engman reported that the budget is a stable budget with no major changes from last
year. The Town’s portion is slightly lower based on our reduced consumption compared
to other partners. He also talked about the recent flooding and how Bolton Point has
been supplying water to the City of Ithaca because of the problems with the silt from the
flooding. This is a good example of the intermunicipal cooperation we give to the City
and would expect in return if something were to happen to Bolton Point.
TB RESOLUTION NO. 2011- 149: Approval of the 2012 Ithaca Area Waste Water
Treatment Plant Budget
WHEREASthe Ithaca Area Waste Water Treatment Plant’s 2012 Budget
has been submitted to the Town Board of the Town of Ithaca and discussed and
considered at its October 6, 2011 Budget meeting
NOW THEREFORE
BE IT RESOLVED that the Town Board of the Town of Ithaca does hereby approve the
2012 Ithaca Area Waste Water Treatment Plant Budget.

Discuss Southern Cayuga Lake Intermunicipal Water Commission (SCLIWC) Non-
Bargaining Employee Wages for 2012 and the IUOE Unit’s Wages for 2012
TB RESOLUTION NO. 2011-150: Approval of Southern Cayuga Lake
Intermunicipal Water Commission Non-Bargaining Employee Wages for 2012 and
the IUOE Unit’s Wages for 2012.
WHEREAS, the governing Town Board of the Town of Ithaca has reviewed the
proposed wage scale and wages for Southern Cayuga Lake Intermunicipal Water
Commission’s (Commission) non- bargaining employees for the year 2012 and the
International Union of Operating Engineers (IUOE) for the year 2012 (see attached);
and
WHEREAS, the said wages have been approved by the Commission at their September
8, 2011 meeting; and
WHEREAS, the United Auto Workers (UAW) unit is in the process of negotiating a first
contract, so those employees’ wages will be presented at a later time;
Now, therefore, be it
RESOLVED, the governing Town Board of the Town of Ithaca does hereby approve the
said wage scale and wages for the Commission’s non-bargaining employees for the
year 2012 and the wages for the IUOE unit for the year 2012 (see attached), and to be
filed in the Human Resources Office.

Discuss the Southern Cayuga Lake Intermunicipal Water Commission (SCLIWC)
Increase in Water Rate Charges
Discussion on why the increase was needed; tanks need to be replaced and/or repaired
and they have put off buying a van for 4 years and they have to get one this year.
TB RESOLUTION NO. 2011- 151: Setting a Public Hearing Regarding Amending
the Southern Cayuga Lake Intermunicipal Water Commission Agreement
Increasing the Water Rate Charges
RESOLVED, that the Town Board will hold a public hearing on October 17, 2011
at 5:50 p.m. regarding the proposed amendment to the agreement of intermunicipal
cooperation between the Town and several other municipalities pursuant to which the
Southern Cayuga Lake Intermunicipal Water Commission was formed, which

amendment would increase the water rate charged by the Commission from $2.87 per
1000 gallons to $3.15 per 1000 gallons, said changes to be effective January 1, 2012

5:45 p.m. Public Hearing re.: A Local Law to Override the Tax Levy Limit
Established in General Municipal Law §3-c
Supervisor Engman opened the public hearing at 5:50 p.m. There was no one wishing
to address the Board at this time and the public hearing was closed.
Motion was made by Pat Leary, Seconded by Rich DePaolo. Mr. Engman noted that

we are the 3 municipality to consider this override and the County is also considering
it.
TB RESOLUTION NO. 2011-152: ADOPTING A LOCAL LAW TO OVERRIDE THE
TAX LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW §3-C.
WHEREAS, municipalities of the State of New York are limited in the amount of
real property taxes that may be levied each year under the tax levy limit established in
General Municipal Law §3-c, and
WHEREAS, subdivision 5 of General Municipal Law §3-c expressly authorizes a
municipality to override the tax levy limit by the adoption of a local law approved by vote
of at least sixty percent (60%) of the governing body, and
WHEREAS, at its meeting on September 12, 2011, the Town Board of the Town
of Ithaca reviewed and discussed a proposed local law to override the tax levy limit and
adopted a resolution for a public hearing to be held by said Town on October 6, 2011 at
“A LOCAL

MUNICIPAL LAW §3-C”
; and
WHEREAS, notice of said public hearing was duly advertised in the Ithaca
Journal; and
WHEREAS, said public hearing was duly held on said date and time at the Town
Hall of the Town of Ithaca and all parties in attendance were permitted an opportunity to
speak on behalf of or in opposition to said proposed local law, or any part thereof, and
WHEREAS, pursuant to the New York State Environmental Quality Review Act
(“SEQRA”) and its implementing regulations at 6 NYCRR Part 617, it has been
determined by the Town Board that adoption of the proposed local law is a Type II
action because it constitutes “routine or continuing agency administration and

management, not including new programs or major reordering of priorities that may
affect the environment,” and thus this action is not subject to review under SEQRA,
NOW, THEREFORE, be it
RESOLVED, that the Town Board of the Town of Ithaca hereby adopts said local
“A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN
law entitled
GENERAL MUNICIPAL LAW §3-C”
, a copy of which is attached hereto and made a part
of this resolution, and it is further

Discuss the Southern Cayuga Lake Intermunicipal Water Commission’s (SCLIWC)
2012 Tentative Budget
TB RESOLUTION NO. 2011- 153: Set a Public Hearing Regarding the 2012
Preliminary Southern Cayuga Lake Intermunicipal Water Commission Budget
WHEREAS the Town Board has discussed and considered the Southern Cayuga
Lake Intermunicipal Water Commission’s Tentative budget which includes the approved
non-bargaining and the IUOE Units Wage Schedules and the proposed increase to the
Water Rate Charges
Now therefore be it
RESOLVED that the Town Board accepts the 2012 Tentative Budget as the 2012
Preliminary Budget for the Southern Cayuga Lake Intermunicipal Water Commission
and
FURTHER RESOLVED that the Town Board will hold a public hearing on
October 17, 2011 at 5:52p.m. to hear comments regarding same.

Discuss the 2012 Town of Ithaca Tentative Budget
Mr. Engman discussed a change needed for the Youth Programs increasing A7320.465
by $5,944 from fund balance. Mr. DePaolo explained that the learning web took a big
hit and what they are asking for is a 4% increase which would allow them to rent a 12
person van and help our Youth Employment Coordinator at Cooperative Extension
receive a living wage. Mr. Engman moved the motion and Mr. Levine seconded.
Unanimous
Mike Solvig, Finance Officer, talked about the budget. He said it was a tough year
putting the numbers together but the budget as a whole is going down, mainly because
we do not have the East Shore Drive project in there anymore but the levy is going up
because we can’t use the Fund Balance like we have in the past. The total increase is
5.8%. Of that, 4.1% is to replenish the fire fund balance and the cost of the protection.
Mr. Engman added that the City is not going to fill a couple of vacant positions, but still,
the cost of fire protection is the driving force behind the increase. Discussion
followed.
Ms. Hunter asked about the Water and Sewer fund balances and noted we have 500
more units and asked where they came from. Mr. Solvig stated that he conducted and
audit and found that we hadn’t been charging for those units but we will be now.
Ms. Hunter asked if had budgeted for extraordinary legal services in case we get sued
regarding the gas drilling and Mr. Engman responded that we had not, but that was also
one of the reasons to restore the Fund Balance. Emergency expenditures. There was
some discussion regarding moving towards a staff attorney but the Board is very happy
with the services provided, and when you compare the cost of a full time employee and
contracted services, the bottom line is it is not a good idea.
Ms. Hunter asked about the line item for Town Hall Parking lot repairs and Mr. Weber
explained that now is a good time to do it because of the bonding rates and the low bids
we have been getting because the contractors need the work and it is very competitive
out there. Mr. Engman added that the Unified Court System has been penalizing us
because of the lighting of the parking lot and that will also be tied in to the repairs.
Ms. Hunter asked about the Public Works Facility annex building and Mr. Weber
described the building that they plan on using for storage of materials and equipment
which will help with maintenance and efficiency of staff.
Ms. Hunter asked whether we were reviewing our fees and Mr. Bates responded that he
was reviewing the Code Department’s but wanted to wait until the end of the year for
true numbers.

Discuss Proposed Increases to the Town of Ithaca Water Rate and Sewer Rents
TB RESOLUTION NO. 2011- 155: Set a Public Hearing to Consider New Water Rate
and Sewer Rents Effective January 1, 2012
RESOLVED, that the Town Board of the Town of Ithaca hold a public hearing at

215 North Tioga Street, Ithaca, New York, on the 17 day of October 2011, at 6:00 p.m.
for the purpose of considering an increase in the water rates from to $4.99 and sewer
rents from $3.81 to $4.19 effective January 1, 2012; and it is further
RESOLVED, that at such time and place all persons interested in the proposed
increase may be heard concerning the same.

Consider Approval of 2012 Wage Scale for Non-Collective Bargaining Unit
Positions
TB RESOLUTION NO. 2011- 156: Approval of 2012 Wage Scale for Non-Collective
Bargaining Positions
WHEREAS, the Town Board established a Wage Scale, which set the Hiring
Minimum and Job Rate for each job classification, which may be increased each year
based on a Cost of Living Adjustment (COLA); and
WHEREAS, after evaluating the Consumer Price Index (CPI-W) as well as other
factors, the Town Supervisor and Human Resources Manager in preparation for the
2012 Tentative budget recommended to the Personnel Committee a 2.0% Cost of
Living Adjustment (COLA) for all classifications of the Wage Scale for Non-Collective
Bargaining positions; and
WHEREAS, the Personnel Committee reviewed and discussed the
recommendation and recommends a 2.0% COLA for the 2012 Wage Scale for Non-
Collective Bargaining positions; and
WHEREAS, the Budget and Finance Committee during its review of the 2012
Budget worksheets discussed the Personnel Committee’s recommendation and
reviewed alternatives, and also recommended the 2% COLA for the budget; and
WHEREAS, the Town Supervisor has used the recommended 2% COLA for the
Tentative Budget as filed with the Town Clerk;
Now, therefore be it

RESOLVED, the Town Board of the Town of Ithaca does hereby approve a 2.0%
Cost of Living Adjustment for all classifications of the 2012 Wage Scale for Non-
Collective Bargaining positions (see attached sheet).

Consider Recommendation and Approval of the 2012 Elected Officials’ Salaries
Mr. DePaolo asked for more clarity on what the functions of the Deputy Town
Supervisor would be; how they will be broken out, how much goes towards training etc
and also if Mr. Engman, if reelected, would be serving the full four year term. Mr.
Engman responded that he has not had a chance to sit down with Mr. Goodman and go
over specifics but they would be discussing them soon and would report to the Board.
He also stated that he would serve the full term is reelected.
There was some discussion on how the salaries should be listed and the Board decided
to break out the Deputy Town Supervisor’s salary which is above and beyond what he
makes as a board member.
TB RESOLUTION NO. 2011-157: 2012 Proposed Elected Officials Salaries.
WHEREAS, the governing Town Board of the Town of Ithaca has reviewed the
proposed salaries, indicated below, for the elected officials for the year 2012 at a 2%
cost of living adjustment increase; now, therefore, be it

the below proposed salaries for the elected officials for the year 2012 at a 2% cost of

SERVICES AGREEMENT WITH ASTRON SOLUTIONS FOR JOB CLASSIFICATION
SYSTEM PROJECT
WHEREAS, the Personnel Committee has been reviewing the Job Classification
System and had Astron Solutions conduct an Audit of the current system; and
WHEREAS, the Personnel Committee recommends utilizing Aston Solution to
develop a revised job evaluation plan, provide a market update on benchmark positions
and complete a procedure for utilizing the revised plan for a total amount of $6,000, see
attached agreement);
NOW, THEREFORE, BE IT
RESOLVED, the Town Board of the Town of Ithaca does hereby approve the
attached Consulting Service Agreement with Astron Solutions and authorizes the Town
Supervisor to execute it on behalf of the Town, subject to the approval of the Attorney
for the Town.
