Review of Correspondence Organizational Meeting of the Ithaca Town Board Monday, January 10, 2011 at 5:30 p.m. 215 North Tioga Street, Ithaca, NY 14850 MINUTES CALL TO ORDER AND PLEDGE OF ALLEGIANCE Supervisor Engman opened the meeting at 5:31pm and led attendees in the Pledge. OATH OF OFFICE ADMINISTERED AND WELCOME TO NAHMIN HORWITZ AS TOWN BOARD MEMBER Mr. Engman introduced Mr. Nahmin Horwitz and the oath was administered. Mr. Nahmin is a retired physics professor from Syracuse University who lives at Kendal of Ithaca. ACKNOWLEDGE THE APPOINTMENT OF DEPUTY TOWN SUPERVISOR AND ADMINISTER THE OATH OF OFFICE Supervisor Engman announced that Bill Goodman had agreed to continue as Deputy Town Supervisor. The Board acknowledged the appointment and the Oath of Office was administered. PERSONS TO BE HEARD Paul Merrill from the Christopher Circle Neighborhood Watch Group submitted additional petition signatures for the existing petition. (Filed with Petition) SUPERVISOR’S REPORT OF 2010 AND OUTLOOK FOR 2011 (Attachment #1) Mr. Engman read from his report REPORT OF TOMPKINS COUNTY LEGISLATURE AND ITHACA COMMON COUNCIL Peter Stein, Councilman reported on the Chair and Vice-Chair elections and their concerns with the budget. They are analyzing what went wrong and right and they are very concerned with the property tax cap being proposed. Mandates of which the County ahs no control take almost 50% of the budget and therefore the income from property taxes which make up 50% of the budget. If faced with a cap on property taxes, it is hard to see how this will work in the coming years. Hanshaw Rd and Pine Tree Rd are also topics coming up for discussion. The County was sued by Hanshaw Rd residents and they are awaiting a decision from the Appellate Court and there is a united effort by Pine Tree Rd residents opposed to that construction. Added that there is a public hearing regarding a local law protecting public highways TB 1-10-2011 Page 2 of 22 5:45 P.M. PUBLIC HEARING REGARDING PROPOSED AMENDMENTS TO THE 1993 TOWN OF ITHACA COMPREHENSIVE PLAN RELATING TO HISTORIC RESOURCES AND THE POSSIBLE ADOPTION OF A NEW “LIMITED HISTORIC COMMERCIAL” FLOATING ZONE Mr. Engman opened the public hearing at 5:58 p.m. Laura Johnson-Kelly , the Town Historian, addressed the Board. She was concerned about archeological resources being protected because the way she read the proposed law, it only addresses physical buildings and structures above ground, nothing below ground. She also felt that people who did not want to be in a historical zone could just not maintain their property/building and let it fall into disrepair and then they would not be responsible for them and not have to remain in the historical zone. Mr. DePaolo spoke to the reversion clause which allows the property to revert back to its original zone if the property is no longer historic. He noted that there was some discussion about the Board being the authority to the reversion to handle that concern. He also asked about the archeological studies done in conjunction with development and whether those archeological searches are sufficient. Ms. Kelly responded that current laws only apply to building paid for with federal money, not homeowners. For example, if a resident wants to build a garage and they are not receiving federal money, you do not need to look for archeological assets. Discussion followed on what those thresholds are within the Town’s purview and how they are distinguished. Ms. Ritter responded that it seems to be most Type I actions that go before the Planning Board. Mr. Goodman noted that this is the first public hearing on the local law and the COC is garnering comments and will be looking at these types of questions that arose during the review of the draft by different boards, committees and residents. He asked Ms. Kelly to come to the next COC meeting with examples of her concerns. The overall intent of the law is to allow owners to make more use out of a historical building, to help preserve the building. Discussion followed. Ms. Kelly noted that she was reading the law from the perspective of someone wanting to get out of the historic zone while the intent of the law comes from the other direction. He was not sure how an owner could purposely let a historic building fall into disrepair to get out of the zone because it would revert back to residential which is more restrictive not less. Again, this is a first review of the draft and these types of concerns will be vetted at the COC meeting. Mr. DePaolo then asked Ms. Kelly what she does as the Town Historian and Ms. Kelly gave a brief over view of common activities and the county-wide group projects she is involved with. Basically she felt she was a facilitator and source of information for people. Mr. Engman added that the cataloging of the cemetery was handled by a volunteer and Ms. Kelly. Mr. Horwitz noted the wording of the state law quoted in the draft law and asked if the Town Board is empowered to determine the character of a district in the town. If so, he asked if that would then mean the town board can determine that the area west of Sapsucker Woods is of “special character”? It sounded to him to be a wide-open TB 1-10-2011 Page 3 of 22 statement. Ms. Brock stated that this is an excerpt of the state law and she would have to look at the whole provision defining the term “special character” before commenting. Supervisor Engman closed the public hearing at 6:17p.m. DISCUSS THE NEED FOR A REQUEST FOR QUALIFICATIONS (RFQ) FOR AN AIR QUALITY AND HVAC EVALUATION OF TOWN HALL Mr. Engman gave the history of the issue. The Town has had numerous evaluations by different groups such as PERMA and the company who installed the HVAC for free but we need an independent evaluation. Discussion followed with the Board agreeing that an RFQ should be developed. The budgeting for an actual evaluation will have to be considered after a real estimate is on the table. CONSIDER ALLOCATION OF MONIES FOR INTERMUNICIPAL YOUTH PROGRAM Mr. Horwitz asked about the Board getting some quantified information on what is provided for these monies such as how many mentors and how many hours per student for each mentor and how many Town youths for those mentors. Mr. Engman responded that there is an ad-hoc committee that is going to do just that. Ms. Hunter was concerned about the brevity of the resolution. She would have liked to reference the fact that this is a one time payment. Mr. DePaolo offered an amendment to add such language which passed unanimously. The amended resolution was voted on. TB RESOLUTION NO. 2011 - 001 Resolution Allocating Funds for the Intermunicipal Youth Program from Fund Reserves RESOLVED that the Town Board hereby allocates an additional $15,000 from reserve funds to the Joint Youth Commission for the Intermunicipal Youth Program to offset, on a one-time-basis pending analysis of the Town’s funding of youth programs, a shortfall created by Tompkins County budget. Susan Brock had concerns regarding the wording of the formula, the percentage of service calls and over what period of time those percentages would be taken from. Discussion followed with an amendment being moved and seconded to add the following to the TCAC Contract Amendment: The Town’s prorated portion will be the average of the following three factors: 1. the ratio of the number of dogs in the Town to the total number of dogs in the consortiums municipalities, and 2. a similar ratio of the human population, and 3. a similar ratio of service calls over the previous 12 months and, the last paragraph regarding 2012 was deleted. The amendment was approved unanimously and the main resolution moved forward. Mr. Engman gave a brief update on the contract talks, enumerations and ratios and how the other municipalities are or will be affected. The Board discussed what services we actually receive for the monies spent and Mr. Engman noted that it is more of an insurance policy than a service contract because we are required to have the services even though we may not use that many of the services. HEALTH AND DENTAL INSURANCE –elected officials The Town/Commission offers the employees and elected officials group health and dental insurance. New employees are given an opportunity to enroll with coverage effective on the date of hire as long as they enroll within 30 days from date of hire. Employees will also have the opportunity to add, delete or change coverage during the open enrollment period st in November for January 1 coverage. The Town/Commission will not pay any benefits directly; only benefits paid by the insurance carrier are available to employees. The Town/Commission reserves the right to change the insurance carrier and, in conjunction with such change, to alter the level of benefits that may be provided. Domestic Partnership coverage is available; for more information contact the Human Resources office regarding these insurances. Health Insurance: Town Supervisor is eligible for health insurance at the full time employee equivalent (currently paid at 100%). Deputy Town Supervisor is eligible at the TB 1-10-2011 Page 18 of 22 part time level of 20% cost share, if working a part time shared schedule with the Supervisor, otherwise would be the same as all other elected official. All other elected officials are eligible at 50% cost share. If a retired Town/Commission employee becomes an elected official the health insurance cost share shall be 50% during the term of office, if it is less than the Retiree cost share. At the end of the term the cost share shall convert back to the Retiree cost share amount in effect prior to the term of office. Dental insurance: All elected officials opting for dental insurance shall pay 100% of the family or individual premiums. I don't know about America, but it certainly came to the Town of Ithaca in 2010. The arrival of new faces in the Town of Ithaca seemed to be the norm last year. We started with a new Town Clerk, Paulette Terwilliger, and a new Town Board member, Susan Riha. Chas Bruner later joined us a code enforcement officer. At the end of the year Mike Solvig arrived as Finance Officer and days later Dan Tasman as Assistant Planning Director. Sue Ritter moved up to Planning Director. We had four retirements in 2010: Engineer Dan Walker, Planning Director Jon Kanter, Budget Officer Al Can/ill and Recreation and Youth Coordinator Mamie Kirchgnessner. The engineer and recreation positions remain open pending further review. Intermunicipal Cooperation ^ The Town of Ithaca has a long tradition of extensive intermunicipal/community . cooperation which continued in 2010 and resulted in significant change: 1. Ithaca College - 24 acres of constructed wetland on the Ithaca College (IC) campus and 77 acres in Newfield will be permanently protected via a three- party agreement among IC, the Finger Lakes Land Trust and the Town of Ithaca. 2. Tompkins Countv Council of Governments fTCCOG) - several initiatives progressed: A. The Municipal Health Insurance Consortium was finally approved by the NYS Insurance Department and formally began operations January 1, 2011 B. A road construction law template was completed and provided to all municipalities in Tompkins County C. A cell lower group arranged for a study of cell tower placement options and for development of a model local law D. An agreement was reached among a subset of TCCOG municipalities to contract with Tompkins County Animal Control (a subsidiary of the Society for the Prevention of Cruelty to Animals - SRCA) for a three-year dog control contract «■ E. A subcommittee of TCCOG was established to help coordinate \ work on the various challenges of horizontal hydrofracking gas drilling. ^ \ 3. Ulysses Water - A great deal of clarification on the provision of water to the Town of Ulysses was gained through discussions with and actions of new Town Supervisor Roxanne Marino. 4. Ithaca Area Wastewater Treatment Facility - There was a huge amount of new activity regarding the sewage treatment plant: A. Upgrades to the plant - over $8,000,000 of improvements were agreed upon among the partners (over $3,000,000 of which will be paid by the Town of Ithaca) with resultant energy savings eventually paying for the improvements B. The Town of Ithaca applied for a grant from the American Reinvestment Act through NYSERDA and received $406,000 which reduced the cost of the plant improvements to be paid locally C. The Town voluntarily joined with the City of Ithaca to address a lawsuit brought against the City by First Energy over coal tar on the sewer plant property; the suit has been settled out of court resulting in a probable cost savings over a court decision D. Two spills by the Cornell animal digester resulted in a great deal of discussion among the members of the Special Joint Committee of the plant; a permit for receipt of the digester by-products by the plant has not yet been finalized. 5. The Southern Cavuca Lake Intermunicioal Water Commission (Bolton Point) - Reduced water usage and fixed costs plus an aging infrastructure necessitated a steep increase in water rates for 2011 both at Bolton Point and for the Town system. 6. Fire and Emergency Protection - Although payments will not be due until 2012, the addition of fire trucks to both the Village of Cayuga Heights and Ithaca City departments, with which we contract for services, caused a steep increase in the fire tax for 2011. 7. Sustainabilitv Planning - I coordinated a grant application with the Town of Dryden to the Park Foundation which resulted in a $105,000, two-year grant for a sustainability planner position now filled by Katie Stoner 8. Sewer Interceptors - Although we agreed to pay for the Town's portion of two sewage interceptor improvements, it became apparent that the procedures outlined in our agreement with the City of Ithaca are not being followed and follow up with the City is required 9. Black Diamond Trail - State Parks, the County, the City and the Town of Ulysses joined with the Town of Ithaca in deciding to try to make progress on the Black Diamond Trail despite the lack of state funding; Ulysses has already put in a new culvert for the trail and the Town of Ithaca has mowed a long section of trail to enable State Parks to evaluate many other culverts. ^ / i \ 10. Intermunicipal Youth Services - The county's cut In this program by 50% for 2011 caused great consternation throughout the County and resulted in a $15,000 increase in Town Costs. 11. Pedestrian Improvement Proiects - The Hanshaw Road and Pine Tree Road pedestrian improvements made progress, with construction anticipated within the next two years. Both benefit from Cornell and County funding. Unfunded State Mandates 1. Dog Control - Agriculture and Markets unilaterally decided to get out of the dog control business, leaving local municipalities to manage the entire program. The County Clerks coordinated a response and our Town Clerk's Office produced a local law and fee schedule which should provide a seamless transition to total Town control. 2. Fireworks Permits - Similarly, the State decided that localities should issue all fireworks permits including those for both public and private displays. 3. Inlet Vallev Cemetery - When an incorporated cemetery ceases operation, the State requires that towns assume responsibility. The Inlet Valley A Cemetery became the first one for the Town of Ithaca. We have begun an inventory of the grave sites and would like to develop a master plan for the cemetery. Similar to the stormwater management mandate of a couple years ago (which staff has estimated costs the Town $70,000 per year), none of these mandates came with increased funding therefore putting increased pressure on the local property tax. Development While the Planning Board deals with development projects falling within current zoning requirements the Town Board gets involved when zoning changes are required. Here are some of the projects considered in 2010: 1. The Northeast - The building moratorium ended and no new activity has ensued as yet. 2. Vine Street Cottages - Now called Belle Sherman Cottages, this development has seen many positive changes as a result of Town Board and community input. 3. Ithaca Beer - The potential expansion of Ithaca Beer on a large parcel of land received a positive response from the Town Board. f 4. Conifer/Cornell - This project has struggled as changes in the original plan have occurred. 5. Limited Historical District - Progress was made toward the establishment of a limited historical district which will enable owners to make effective use of their property while respecting the heritage of the buildings. 6. EcoVillaqe Third Neighborhood - This example of more sustainable housing was well-received throughout the Town. Internal 1. The Hiahwav Excavation Law - The passage of this law will enable the Town to be better prepared for large-scale activities that require culverts and disturbance of the Town's roads. 2. Capital Proiects - An aging infrastructure and the opportunity for low- cost bonding enabled the Town to complete or plan for a number of ambitious projects: _ A. Studv Sessions - A second Town Board meeting was instituted in an attempt to improve communications, especially among committees. 4. Official Map - A new official map, the first update since 1968, was adopted by the Town Board. 5. Voucher Approval Schedule - Vouchers for approval at the Town Board meetings are now made available the Friday before the meeting to allow more time for inspection. 6. Staff/Board Lunches - In an attempt to improve communication among staff and Town Board members, several voluntary, informal lunches were held throughout the year. 7. Additional Parking Spaces - With the Post Office I negotiated two > additional parking spaces for the Town in addition to space for motorcycles and bicycles. 8. Dog Census - A highly successful dog census was conducted by the Town Clerk's Office resulting in a 30% increase in dogs found in the Town. 9. Employee Education Support - A $5,000 yearly fund was established to help employees pursue continuing education degrees. 10. Comprehensive Plan - Community meetings were concluded and considerable progress was made in the writing of the first draft of the plan. 11. Agricultural Plan - With the assistance of a $25,000 grant from the State and a sub-contract with Cornell Cooperation Extension of Tompkins County, the revised Agricultural Plan is almost complete and will be included in the overall comprehensive plan. 12. Miscellaneous - A new heating system and sound deadening improvements were made to the Town Clerk's space; mitigation fees and asset management potential were studied; a traffic/nodal development study was _ discussed; retirement incentives were offered; an improved property maintenance law progressed; potential critical environmental areas were studied; X an initial look at increased traffic control was begun; scenic resources and stream setback laws made progress; noise permits at Ithaca College continued to be time-consuming for everyone concerned; and there was considerable discussion of the roles of the Town Board and the Town Supervisor concerning the Town's administration. 2011 Outlook 1. The Comprehensive Plan - The plan must be completed in 2011 so that revisions to the Town's zoning (which I anticipate will be substantial) can be finished shortly thereafter. The areas of the Town where development should take place must be clearly defined so that the natural, historical and agricultural resources of the Town can be better protected. 2. Industrialization of the Rural Landscape - Road and critical environmental area protections must be enacted in 2011 to guard against potential industrial activity, including horizontal hydrofracking for natural gas. The Town Board must decide whether it wants to enact protective zoning or an outright ban on horizontal hydrofracking for gas exploration. ^ 3. Fire and Emergency Protection - The Town Board must investigate its ^ options regarding the unsustainable increases in costs for fire and emergency H response services. 4. Traffic Control - The Town Board must determine if it can offer increased traffic control for its residents through sub-contracts or other agreements with local police forces. 5. Recreation and Youth Sen/ices - The town Board must determine what the Town residents need in the areas of recreation and youth services and the best way to provide those services. 6. Budget - The Town must continue to be cautious in its expenditures, including pay and benefits for employees, given the continued troubled economic times and the potential for massive increases in costs for retirements and health care, especially given the possibility of a State cap on property taxes. Conclusion The Town of Ithaca remains in a good position to weather economic and social challenges. With the cooperation of staff, appointed boards, elected officials and residents, the Town of Ithaca will continue to thrive even in the challenging circumstances of the coming year. They continued the discussion on the wage system by reviewing a 3 grid system. They approved revisions to the Health and Dental Insurance Policy and approved of a College Course Reimbursement request. Employee Relations committee received an update on Class A and Tank Endorsement requirements for CDL drivers and that the air quality for Town Hall would be discussed at Operations Committee again. New suggestion cards discussed included topics such as bereavement leave for friends and copier room as a kitchenette. The committee reviewed the Board/Staff luncheons and recommended that they continue in 2011. Bolton Point's Personnel and Operations committee had updates from each manager on training, performance reviews and department needs. The committee reviewed the status of the union negotiations, which have moved to mediation. Personnel - Civil Service: Resolutions and other paperwork were prepared for Dan Tasman's position and the promotion of Susan Ritter, both for the Planning Department. The Finance Officer Interview Committee after second interviews recommended the appointment of Mike Solvig to the position. Mike started on December 28^ so he would have a few days here before Al retired. A great deal of time was spent preparing for the retirements of Al, Dan and Jon. Exit interviews including reviewing final pays and retiree benefits were held with all three. Changes to several job descriptions were recommended and approved by the Town Board due to the need to have CDL drivers with a tank endorsement and some with a Class A. Town will be paying the costs for employees to get these new requirements. Commercial Insurance (Ithaca Aoencv- NYMIR Insurance Companv): The vehicle damage claim reported last month that included tire damage from a pothole was denied. The claimant has filed a small claims suit against the Town, which was passed onto NYMIR to defend. A claim due to water damage from the rain storm on December 1®*, was processed. Workers' Compensation (Public Emplovers Risk Management Assoc - PERMA): There are no new claims to report. Health and/or Dental Insurance: ^ ^ Attended trainings held by Excellus and Medco regarding the change over to the Consortium. Drake, PHR, Human Resources Manager Planning Department Report for the Month of December 2010 Submitted to the Ithaca Town Board for the January 10,2011 meeting Planning Board - Development Reviews Cavuga Medical Center (CMC) Lab Addition - Final Site Plan Approval was granted for the constmction of a 15,985 +/- square foot laboratory (one-story) and associated mechanical room (two-story) addition on the east side (rear) of the hospital. A portion of the project will be constmcted below grade and include a green roof. TTie project will also include the relocation of the existing helipad and cooling towers, construction a new service entry, extension of a walkway and additional landscaping treatments. Trowbridge & Wolf, Landscape Architects LLP and HOLT Architects were consultants for the project. Hollv Greek Townhouses Modifications. HoUy Greek Lane - Preliminary Site Plan and Subdivision Approval was granted for modifications to the Holly Creek Townhouse development (Danby Road and W. King Road area, behind the). The proposal involves modifying the approved plan to change the design and siting of the buildings and increasing the number of units from 20 to 22 units in six buildings. The units would be sold to moderate income buyers as part of the Ithaca Neighborhood Housing Services Community Housing Trast program. Holly Creek Townhomes, LLC, Ithaca Neighborhood Housing Services and HOLT Architects were applicants/consultants for the project. Holochuck Homes Subdivision - Continued discussion and consideration of Acceptance of the Final Environmental Impact Statement (FEIS) for the proposed Holochuck Homes Subdivision. The discussion will continue into the January 4^ Planning Board meeting. The proposal involves the construction of 106+/- town home type units in a clustered neighborhood development with two entrances proposed from NYS Route 96 (Trumansburg Road). Owners are Holochuck Homes LLC. Consultants include David M. Parks, Esq. (Legal), Tim Miller Associates (Environmental Planner), Inc. and Keystone Associates, LLC (Engineers). Consideration of a Recommendation to the Town Board on the **Limited Historic Cnmmercial" Floating Zone, related changes to Chapter 270, Article Xin "Commercial Zones Generally" of the Town of Ithaca Code, and Proposed Amendments to the 1993 Town of Ithaca Comprehensive Plan regarding historic resources and a new '^Limited Historic Commercial" Floating Zone. The Planning Board expressed general support for the proposal, however, there were several specific comments on the language of the law which will require further consideration by the Codes and Ordinances Committee Codes and Ordinances Committee (COC) At the December 15* meeting, the committee began reviewing the revised draft amendments to Conservation Zone language regarding forest management plan requirements. The committee will be continuing to review of the revised draft at the January meeting. Other future agenda items will be consideration of modifications to the zoning regulations regarding garages and consideration of recent comments received concerning the draft Stream Setback Law. Planning Conunittee At the December 9^ meeting, the Committee discussed plans for holding a small meeting with I ) City officials to discuss various topics related to West Hill. The committee discussed the ^ Cornell/Conifer West Hill proposal and recommended not moving the PDZ language further at this time. Members discussed and recommended consideration of a limited development moratorium on West Hill. Comprehensive Plan Committee At the December 18^ meeting, Sustainability Planner, Katie Stoner, presented to the Committee, a status report on her work related to sustainability planning for the Town. The Committee also reviewed the Energy/Climate Change goals/objectives draft Plan section. Conservation Board At the December 2"^ meeting, the Board was provided with a presentation by Katie Stoner regarding sustainability planning for the Town of Ithaca. The Board also discussed an email complaint, members received, pertaining to the new lights being installed as part of the Forest Home traffic calming project, and their potential impacts on wildlife. The Board also briefly discussed the forest management language amendments to the Conservation Zones, as well as status of the Richard Fischer Award nominations, and other regular reports. Agriculture Plan Committee Planmng staff continues to work with committee members on preparation of final sections of a draft Agriculture and Farmland Protection Plan for the Town of Ithaca. Other Activities of Staff Pine Tree Road Bike and Pedestrian Paths Meeting - December 20^. Staff attended this public meeting concerning the proposed bike and pedestrian trail additions along Pine Tree Road with connections and modifications to the East Ithaca Recreation Way. The project will also include replacement of the old train trestle with a new ped/bike bridge and widening of Pine Tree Road in the vicinity of the old train trestle. Pedestrian Oriented Development in the Town of Ithaca presentation for staff and Board members - December 8^. Staff, along with numerous Board members attended the presentation "Pedestrian Oriented Development in the Town of Ithaca" by Rob Morache on December S'''. The presentation included development scenarios for the Town's West Hill area. Stream Setback Presentation to the Tompkins County Environmental Management Council - December 8^, At the invitation of the EMC, staff provided an update/presentation on the Stream Setback Law. Our mission is to protect historic, architectural, and cultural resources and to encourage sound, sustainable reuse and economic development that respects our shared heritage. We support the creation of a "Limited Historic Commercial" floating zone in the Town of Ithaca. Historic buildings such as Hayts Chapel and Schoolhouse attain a level of significance that makes them resources belonging to the entire community. Such buildings are deserving of creative solutions to ensure their continued use and survival. Adaptive use has long been a vital tool for historic preservation, especiaUy for buildings threatened by development pressure or perceived obsolescence. And, the recognition that comes ' ^ with a unique and historic address can contribute to the success of a business. One must look no further than the DeWitt Mall, the Chemung Canal Trust Company branch at the old Lehigh Valley train station, or Sunny Gables to see this principle in effect. Allowing limited commercial uses on historic properties currently zoned for residential use will increase their chances for survival as attractive landmarks contributing to the economy and sense of place of the Town of Ithaca.
