HomeMy WebLinkAboutTB Minutes 1985-11-07 TOM OF ITHACA SPECIAL BOARD MEETING November 7 , 1985 At a Special Meeting of the Town Board of the Town of Ithaca , Tompkins County , New York , held at the Town Offices at 126 East Seneca Street , Ithaca , New York , at 5 : 30 P .M . , on the 7th day of November , 1985 , there were : • PRESENT : Noel Desch , Supervisor George Kugler , Councilman Shirley Raffensperger, Councilwoman • Marc Cramer , Councilman Henry McPeak, Councilman Gloria Howell , Councilwoman Robert Bartholf , Councilman ALSO PRESENT : Lawrence Fabbroni , Town Engineer John Barney , Town Attorney Peter Lovi , Town Planner Beverly Livesay , Board of Representatives Ed Olmstead , Fire Chief , City of Ithaca ( during discussion of the Fire contract ) Representatives of the Media : Ken Hughes , WHCU Lisa Best , W'IICO PLEDGE OF ALLEGIANCE The Supervisor led the assemblage in the Pledge of Allegiance . REPORT OF TOWN OFFICIALS Supervisor ' s Report Election Results Supervisor Desch stated that he wished to congratulate Bob Bartholf , Pat Leary and either Henry McPeak or Larry O 'Neil for their election to the Town Board . Also , Warren Blye as Town Justice . The Supervisor went on to say that the time commitment • and the dedication to ones community are , in his judgement , opportunities that are available to everyone but so few take advantage of it . Supervisor Desch stated that he was saying this regardless of political philosophy . Our elections , he stated for • himself , are highly educational irrespective of whether one has opposition . There is always a great deal to learn . He went on to say that he wished to congratulate those such as George Kugler who lost in the election , not for losing but for the years of dedicated service . Cornell $ 100 Million Bond Issue Supervisor Desch noted that he was circulating , for Town Board information , the SEQR Negative Declaration on the financial aspects of the bond issue . Both Cornell and the Dormitory Authority have Town Board 2 November 7 , 1985 been very cooperative in providing the Town with sufficient information for us to concur that the Dormitory Authority would be the appropriate lead agency . The projects in the Town include part of the Town House Project on Jessup Road , chemical waste storage and life safety shop facilities in the orchard and a number of roadway and parking improvements . This cooperative spirit is a continuation of the now routine positive attitude exhibited by Cornell in processing all of their projects through the Town for Planning Board review , SEQR review and building permit issuance . For example , Cornell , as a condition to getting Town and Village approval of the Town House Project has formally confirmed their commitment to provide a walkway from Jessup Road to the Village line . • Municipal Liability Insurance Supervisor Desch went on to say that discussions with our insurance • carrier has confirmed that we will have liability coverage next year although the rate will be substantially higher . We are now shopping around to see what other insurors can offer . Our eventual costs may exceed the increase we have built into the 1986 budget but I would prefer not to change the figures until we have solid numbers for fear that the cost will come up to any number we might budget . Health Insurance The Supervisor stated that the Town now has the full packet of information on the new Empire Plan which replaces State Wide and GHI . It is an excellent plan and one which will involve careful study over the coming weeks . Town Board action , at the December 9 meeting , will be necessary . In the meantime , the Town Personnel Committee will be reviewing it at its meeting on November 12 . We expect the Town costs will be very comparable to the current budgeted amounts . Executive Session Supervisor Desch noted that the Board would need to meet in a brief executive session near the end of the meeting to discuss a personnel matter . Justice Court Computer The Supervisor went on to state that the software has been received for the Justice Court computer and the hardware is expected momentarily . This item cost about $2 , 000 and the funds are from several sources . The purpose for purchasing it early is to have the Justice Court records on line starting January 1 . Stone Quarry Road Speed Limit • Supervisor Desch stated that he wished to add an item to the agenda . Because of the prevalence accidents on Stone Quarry Road it is necessary to consider a reduction in the speed limit on this • road . The current speed limit is 50 MPH and some of the curves are posted at 30 MPH , which is too high for the road . He then asked the Board to think about and then discuss later in the meeting , a 35 MPH limit on the full length of the road and then reducing the 1. worse curves to less than 30 MPH . Town Engineer ' s Report Town Engineer Fabbroni noted that the Board members have the staff ' s report for the past month . (Copy attached to the minutes ) . He noted that the Town was getting chastised once a week by the State . The Town Engineer stated that a developer is subdividing the old Blatchley farm and that the developers have asked the State to open cut the road to bring the water service the the subdivision . Town Engineer Fabbroni went on to say that Town Attorney John Barney has been working hard on getting all the park agreements completed and back to the Town . He noted that the Town Attorney ' s comments on the Sand Bank/Buttermilk park agreement have been incorporated in the agreement , the Supervisor has signed and we are • now waiting for the City and County to sign . The Coddington Road Community Center is scheduled for spring plantings . The Town Engineer stated that he was still searching out a heating • system for the back part of the building . Something that won ' t drown out people talking . He went on to say that Burns Road was virtually completed except for the last 200 ' at Slaterville Road . The State removed the fill themselves at the Park Lane intersection , then occupied the space where the Town was planning to work . Town Engineer Fabbroni reported that the concrete base has been laid in Fall Creek and the first course of gabions are in place , thanks to Peter Lovi and Bob Flumerfelt , Town Engineer Fabbroni noted that meeting upon meeting have been held lately on the Sewage Treatment Facility , The Segment I contractors are working 24 hours a day , with night time activities being very quiet activities , in anticipation of a tie in of the old system to the new system . Construction is on schedule or ahead of schedule and most of the concrete work will be completed before winter . WATER ACCOUNT REFUND RESOLUTION N0 , 216 Motion by Councilman McPeak ; seconded by Councilwoman Howell , WHEREAS , on September 15 , 1985 , Eastern Heights Association , paid their September 1 , 1985 water bill , and WHEREAS , on October 16 , 1985 , Eastern Heights Association again paid their September water bill along with a special reading , NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of Ithaca hereby authorize a refund in the amount of $ 50 . 71 for water , $ 8 . 62 for water surcharge , $30 . 54 for sewer and $ 8 . 98 for penalty , total refund of $98 . 85 be refunded to Eastern Heights Association , • P . Nays - none ) . • WATER 00NNECTION REFUND RESOLUTION NO , 217 Motion by Supervisor Desch ; seconded by Councilwoman Raffensperger , WHEREAS , when Michael Koplinka-Loehr , 124 Crest Lane , Ithaca , New York , applied for a water tap permit for a new house he was constructing , Mr . Koplinka-Loehr was advised by the Bolton Point Town Board 4 November 7 , 1985 staff to purchase an extra meter , at a total cost of $ 200 , for an eventual basement apartment , and WHEREAS , when the water meter was installed , the Bolton Point staff installing said meter felt the cost of the second meter was not warranted and instead recommended the installation of one main meter and the private installation of a flow meter later , if necessary , and WHEREAS , upon the recommendation of the Bolton Point installation staff , only one meter was installed , NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes a refund of $ 50 . 00 to be made to Michael Kcplinka-Loehr , 124 Crest Lane , for the cost of the second meter , which was never installed . • (Desch , Kugler , Raffensperger , Cramer , McPeak , Howell and Bartholf voting Aye . CODDINGTON ROAD camMUNITY CENTER SPEED ZONE Supervisor Desch stated that he has had a number of telephone calls from the operators of the Center plus parents requesting that the speed limit in the area of the Center be reduced . He stated that Jeff Paddock , Senior Civil Engineer for Tompkins County feels the State will not approve a 15 MPH speed limit but will probably approve a 25 MPH speed limit as there is not a lot of pedestrian traffic in the area . Councilman Bartholf remarked that he had received a couple of phone calls about the speed limit following several accidents . RESOLUTION NO . 218 Motion by Councilman Bartholf ; seconded by Supervisor Desch , WHEREAS , a day care center has been established at the Coddington Road Community Center at 676 Coddington Road in the Town of Ithaca , and WHEREAS , the day care center operates daily 5 days per week and provides facilities for 25 preschool and elementary school children and three staff members , and WHEREAS , the vertical and horizontal alignment of the highway creates serious hazards for pedestrians and vehicles entering the highway from the off street parking facilities , NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of • Ithaca hereby requests the New York State Department of Transportation to post a 15 MPH School Zone in the area of the Coddington Road Camiunity Center , and • FURTHER BE IT RESOLVED , that the Town Board hereby requests urgent action , by Tompkins County and NYSDOT , on this matter because of the seriousness of the hazards . Nays - none . ) DEWITT/BOLES SCHOOL SPEED ZONE Town Board 5 November 7 , 1985 Supervisor Desch stated that there has been a decrease in the number of students who are now walking to the school as the school bus will pick up all students living in the Winston Court Apartments and perhaps at some point in time we will no longer need a crossing guard on Warren Road . However , the hazard still exists unless the speed limit is further reduced . RESOLUTION NO . 219 Motion by Councilman Cramer ; seconded by Councilwoman Raffensperger , WHEREAS , a 30 MPH school zone has been established on Warren Road , • in the area of the DeWitt/BOCES schools , and WHEREAS , 6th graders now attend school at DeWitt , and • WHEREAS , the Warren Road school crossing is also heavily used by students who attend the Northeast Elementary School with enrollment at capacity , and WHEREAS , said 30 MPH zone has not decreased the hazard to the school children crossing Warren Road because of speeding vehiches , NCW THEREFORE BE IT RESOLVED , that the Town Board of the Town of Ithaca hereby petitions the State of New York and the County of Tompkins to reduce the speed limit in the school crossing zone at the DeWitt/BOCES schools from 30 MPH to 15 MPH . ( Desch , Raffensperger , Cramer , McPeak , Howell and Bartholf voting Aye . Nays - none) . STONE QUARRY ROAD SPEED LIMIT Supervisor Desch asked Town Engineer Larry Fabbroni what he thought was a reasonable speed limit to request in response to the frequency of serious accidents on this road . Town Engineer Fabbroni responded , 55 MPH at the top , then a transition zone , then 30 MPH below house number " 241 " where the retaining wall is located . The last time we applied to the State they said 55 MPH down to the railroad tracks . He went on to say that he felt the State would approve a transition zone of 40 to 45 MPH . The Town Engineer went on to say that as far as the curve signs he felt that the Town could change them on the basis of the accident rate . Councilman Bartholf remarked that since the new topping was put on the road it is now much more slippery . Councilman Kugler added that he would like to make a strong • recommendation that something be done with the area of the railroad tracks . • Town Engineer Fabbroni responded that the railroad tracks were tied into the drainage . We were supposed to straighten the road but with the pending drainage proj ect we did not want to tear up the road again . The drainage way is in limbo because the City of Ithaca has changed their mind so it may make sense to go ahead and do what ever is necessary now to correct the road . Supervisor Desch commented , we may have to go ahead and fix the road and not wait for the bikeway project . RESOLUTION NO . 220 Town Board 6 November 7 , 1985 Motion by Councilman Bartholf ; seconded by Councilwoman Howell , WHEREAS , the recent incidence of accidents on the steep portion of Stone Quarry Road and increased traffic has indicated the need for reduced speed limits on this highway , NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of Ithaca hereby petitions the New York State Department of Transportation and Tompkins County to create a transition zone starting from the intersection with West King Road to the top of the steep grade portion of the hill , at which speed would be further reduced to 30 MPH . • (Desch , Kugler , Raffensperger , Cramer , McPeak , Howell and Bartholf voting Aye . Nays - none ) . • NORTHVIEW ROAD TANK SITE Town Attorney John Barney requested that the Board take no action on the agenda item as he had received a telephone call from the attorney for the land owners requesting no action be taken by the Board for one month . SET DATE FOR PUBLIC HEARIW7 TO AMEND THE TRAFFIC ORDINATE TO ALLOW NO PARKING ON JUDD FALLS ROAD Town Engineer Lawrence Fabbroni stated that Cornell University had requested the Town amend the Traffic Ordinance to prohibit parking on both sides of Judd Falls Road as cars have started parking on the lawn and on both sides of Judd Falls Road . RESOLUTION NO , 221 Motion by Councilwoman Howell ; seconded by Councilman Mcpeak , RESOLVED , that the Town Board of the Town of Ithaca will meet and conduct a public hearing at 7 : 00 P .M . , on December 9 , 1985 at the Town Hall , 126 East Seneca Street , Ithaca , New York to consider amending the Traffic Ordinance of the Town of Ithaca as last amended November 7 , 1985 by adding to Section 1 . Parking Vehicles as follows : " ( i ) On the east and west sides of Judd Falls Road from its intersection with Tower Road to its intersection with State Road 366 . " (Desch , Kugler , Raffensperger , Cramer , McPeak , Howell and Bartholf voting Aye . Nays - none ) . • SET DATE FOR PUBLIC HEARING To AMEND THE SEWER USE LAW Supervisor Desch stated that when the Sewer Use Law was put • together , it was a struggle to get everything DEC wanted into the law. Therefore , it was put together in patch work form. Anyone who wanted to use the law had a lot of homework to do . Now the law has been consolidated , making it easier to implement and much more readible . The law , itself was unchanged . RESOLUTION N0 , 222 Motion by Supervisor Desch ; seconded by Councilwoman Raffensperger , Town Board 7 November 7 , 1985 RESOLVED , that the Town Board of the Town of Ithaca will meet and conduct a public hearing at 7 : 15 P .M . , on December 9 , 1985 , at the Town Hall , 126 East Seneca Street , Ithaca , New York , to consider amending Local Law # 1 - 1984 . (Desch , Kugler , Raffensperger , Cramer , McPeak , Howell and Bartholf voting Aye . Nays - none) . HOSPITAL ROAD CIRCULATION PLANS Town Engineer Fabbroni showed the Board members a map of how the three alternatives for Route 96 would affect the hospital circulation road . He went on to say that the Planning Board never • liked the proposed entrance into the Professional Building and had requested a second entrance be built if the Professional Building were to be expanded . The Professional Building owners were asked • to put $ 25 , 000 into an escrow account to help build the road . The hospital was also asked to deposit $25 , 000 into an escrow account to provide a tie in access road further up . The proposed road would go through a field and would be a Town road with an extension out to Indian Creek Road or DuBois Road which would help land locked land . He went on to say that the County said , regardless of what happens they would like to have this road built . The County was asked if they would also provide $ 25 , 000 and Frank Liguori ' s answer was yes . The biggest stumbling block is a 60 ' and a 30 ' right-of--way . The owners of the private property at this point , are not willing to sell or give a right-of�way to the Town . He asked the Supervisor to talk to the property owners again , but he cautioned the Board not to be surprised if condemnation proceedings were necessary . Councilman Cramer asked if the adjacent land was awned by the hospital ? Town Engineer Fabbroni responded , yes . Councilman Cramer then asked why the new road could not be built on hospital land or Dr . Mitchell ' s land? Town Engineer Fabbroni responded that an electric substation and a grove of pine trees will make it too costly to build the road on hospital land or Dr . Mitchell ' s land . He noted that the people who own the property are not interested in the potential increased value of their land that would result from the road . REPORT OF BOARD OF REPRESENTATIVES County Board Representative Beverly Livesay reported that the rental of the old hospital was coming to a head with a public • hearing scheduled for Wednesday . Supervisor Desch questioned the progress of the incubator space . • Mrs . Livesay responded that the County had applied for the incubator funds . She went on to comment that solid waste was an issue and that the communities need to take more of an interest in how to deal with this problem . She noted that space in the old hospital for the Department of Social Services (DSS ) was not a good idea and that a meeting would be held next week so that the camadttee could go over all the information they have on the alternative sites . Town Board 8 November 7 , 1985 Mrs . Livesay went on to state that she felt the municipalities should work together on the state of the economy in Tompkins County . The number of people on welfare is really alarming . Councilwoman Raffensperger asked County Representative Livesay how long would the hospital be rented and can the property be sold while it is rented ? Mrs . Livesay responded that Oddessy wanted a two or three year rental . If a lease is given to them then it would go with the building . Other proposals are on an interim basis . Incubator space could go with the sale of the building . • Councilman Cramer asked what will happen if the Landstrom Landfill site is rejected by DEC ? County Representative Livesay responded that bailing stations were • being considered . She went on to say that the County was working to help insure that the Landstrom site gets DEC approval . ACCEPTANCE OF DOVE DRIVE Town Planner Peter Lovi remarked that the Board had the two resolutions , which speak for themselves . Councilwoman Raffensperger stated that she had received a telephone call asking why the Board was accepting Dove Drive while there is still a problem with numbering . The Town should not accept the road until the houses are properly numbered . Town Planner Lovi remarked that the Town Engineer does all the numbering of houses in the Town of Ithaca . Town Engineer Fabbroni responded that for some reason or another the first two houses were given numbers , then the two lots that were set aside for a Town park were changed to another location and the two lots will have houses built on them . Therefore , it is now impossible to give the houses numbers without having a conflict . It is easier to ask the people to renumber - which they are not sympathetic in doing . He went on to say that he had asked two people to change their numbers and they had refused . It may be necessary to add letters to the numbers . PUBLIC HEARING TO CONSIDER THE 1986 TOWN OF ITHACA PRELIMINARY BUDGET • Proof of posting and publication notice of a Public Hearing to consider the adoption of the proposed 1986 Town of Ithaca Preliminary Budget having been presented by the Town Clerk , the Supervisor opened the public hearing . • Supervisor Desch noted the following changes in the 1986 Budget since the last meeting . Expenditures - Coddington Road Community Center was increased from $ 2 , 000 . 00 to $ 4 , 000 . 00 . Youth and Old Age Projects was decreased from $80 , 000 . 00 to $78 , 000 . 00 , this being a transfer between the two items . Revenues - Metered Water Sales was increased from $ 640 , 000 . 00 to $ 661 , 000 . 00 because of the water charges on West Hill . He noted that he had written to Mayor Gutenberger about the increase . Expenditures - Village of Cayuga Heights Fire Protection decreased from $ 40 , 000 . 00 to $38 , 000 . 00 because we now have a firm figure . The Supervisor again mentioned Town Board 13 November 7 , 1985 the decrease from $10 , 000 . 00 to $8 , 500 . 00 in Federal Revenue Sharing because of the purchase , this year , of the computer for the Justices . The Supervisor went on to say that the Town ' s share of the Ithaca Area Wastewater Treatment Plant BANS was sham in the budget this year . Supervisor Desch asked County Representative Livesay if there would be any sales tax credit to the Tam after the County approves their budget , and if she had any idea what the balance would be? Mrs . Livesay responded that the amount would not be known until the 19th , however , there will be a credit or excess . Councilman Cramer questioned the possibility of reducing the amount • for postage ( Shared Services ) . This is not possible because of the number of public hearing mailing notifications . • Supervisor Desch remarked that the zoning fees to be collected was probably under estimated . Councilman Cramer questioned whether the funds were carried over f or the paving of Roat Street and part of Blackstone and was the Town ' s share of the Forest Home project included in the $ 160 , 000 appropriation ? Supervisor Desch responded yes , a portion of Forest Home Drive and Judd Falls Road and Roat Street is in the carry over . Tam Engineer Fabbroni responded that the Town was going to pave Blackstone , Judd Falls and Orchard but they will be carried over to 1986 . Normally , we do two more miles but was unable because of Forest Home Drive . He went on to say that he would probably be back to the Board in the Spring for some additional paving money . Supervisor Desch added that a lot of the Forest Home Drive expense I s labor . Councilwoman Raffensperger asked why the Highway Reserves were not in a Capital Reserve Fund? Supervisor Desch responded , Highway machinery and , as the Town Engineer just talked about , paving cannot be put into a reserve fund until there is a year end balance . Councilman Cramer questioned tank repainting . Town Engineer Fabbroni stated that the Hungerford Hill and Pine Tree load tanks will be done next year , the money was redistributed . He went on to say that the optimal schedule is to open bids in the winter when the contractors are not busy and you get a better price . We found that we had problems with the • Hungerford Hill Tank that needed to be taken care of before it was painted . When We got ready to go to bid this year the prices were very high so now we will wait until Spring for a better price . • Councilman Cramer questioned Capital Improvements and Extensions . Tam Engineer Fabbroni responded that this was for little nagging extensions that were never completed in the late 160 ' s . These property owners have been charged full benefit all along and now they want the water lines put across the road . Supervisor Desch added , Sewer Capital Improvements are the same as water , small loose end type improvements . PUBLIC HEARING TO CONSIDER THE 1986 SOUTHERN CAYLUA LAZE INTEM NICIPAL MMR COMMISSION PRELIMINARY BUDGET Proof of posting and publication notice of a Public Hearing to consider the Southern Cayuga Lake Intermunicipal Water Commission Preliminary Budget for the year 1986 having been presented by the Town Clerk , the Supervisor opened the public hearing . • Supervisor Desch stated that the Commission had made no changes in the Budget since the presentation of the Tentative Budget . He reminded the Board that the Commission will be assuming the electric costs for the Christopher Circle Pump Station starting in 1986 . He went on to say that perhaps someday the Commission may • take over the electric costs for the Pine Tree Road Pump Station also . Supervisor Desch went on to say that while the divers were at the Wastewater Treatment Plant they checked the Bolton Point intake line . There was no corrosion on the line , however there was some corrosion on the bolts . They also checked the intake screens and found very little deposits .
