HomeMy WebLinkAbout2006-09-11 1127 Town Board Minutes September 11 ,2006 TOWN OF DANBY TOWN BOARD MINUTES SEPTEMBER 11 , 2006 PRESENT : Supervisor Fredric Dietrich Councilpersons : Eugene Beavers, Norbert Nolte, Joseph Salino , Gladys Varon-Lacey Others Present : Carol Sczepanski - Town Clerk Susan Beeners - Code Enforcement Officer Roy Casterline - West Danby Water District Superintendent Andrew Thurnheer - Highway Superintendent Tracy White - Highway Secretary Members of the Public : George Blanchard, Jonathan Zisk, Naomi Strichartz, David Noteboon, Mary Casterline, Deirdre Silverman, Ames Brown, Leslie Connors, Kathy and Bill Halton, Beatrice Hogben, Olympia and Robert McFall, Sharon and John Gaden, Andrew Dunnick, Susan Baker, Kay Jenney, Ted Jones Supervisor Dietrich called the meeting to order at 6 : 30 p .m. and requested a moment of silence for the September 11 , 2006 tragedy. Following the moment of silence he led all present to the Pledge of Allegiance to the American flag. PRIVILEGE OF THE FLOOR Fire Department Report - Andrew Dunnick - Danby Fire Department Member addressed the Town Board and public with activities in the Fire Department . -Applied for a grant for the purchase of a new engine to replace a twenty year old engine ; -Plans for an expansion to the Danby Fire Station - four trucks now are housed in three bays ; -Difficulty in recruiting new members with old equipment and facilities ; - Road conditions are very poor and slows response time considerably particularly on gravel roads like Fisher Settlement and Station Road ; Andy described a difficult emergency on Fisher Settlement Road after a rain. John Gaden - Chief of the Danby Fire Department - reported on : 1 - the departments concern in the Town is house numbers and the difficulty finding residents houses . - mailboxes do now have large enough numbers and are often on only one side of the box . do something to let residents know that they need to have larger numbers and place them on both sides of their mailboxes . He asked the Town to help with notification to residents that it is necessary to better identify their location for emergency purposes. 2 - Road condition of Station Road slows fire departments response time and is like a washboard . Tracy White reported that the Town is going to try to get assistance from the State so that we can have that Station Road paved. Ames Brown - if we are going to have another resolution like the last one (Resolution 70) he will carry a petition to keep this stuff out of local government and another petition to support the troops . Ames referred to the "Eyes Wide Open" display that the Town Board endorsed and reported that he did not approve of the board using valuable time on items that do not directly apply to the Town. Jonathan Zisk - There was a letter in the Ithaca Journal about the Town and it was not a letter against the resolution. He said that he also is proud of the Town Board about their assertion and your attributing the decision to conscience . Naomi Strichartz - thanked the Board for their support of the resolution (#70) and for them voting their conscience. She thanked Bill Halton for presenting the resolution. She supported the "EyesWide Open" display and said that it was a very respectful tribute to each service person who was killed in combat. 1 1 yy 1 128 2 Town Board Minutes September 11 ,2006 Olympia McFall - Read a letter into the record regarding problems with dust on our gravel roads this summer and her requests on several occasions that our Highway Superintendent apply something of Fisher Settlement road and other gravel roads in the Town of Danby to cut down on excessive dust and loose gravel. Liquid gravel was applied after the August 14, 2006 Town Board Meeting and within 24 hours the "liquid" had totally disappeared and the road was once again dusty. She said that our roads are showing damage due to lack of proper maintenance . A copy of her letter is on file in the Clerk ' s office. Deirdre Silverman - said that she attended a meeting last week and said that the meeting was interesting and informative . Gladys Varona-Lacey submitted a memo that was e-mailed by Asher Hackett to the Clerk on Friday thanking the Town Board for hosting a public discussion on "Bring home the troops" Resolution. He asked that the Board act on the resolution which was passed and to forward it immediately to its intended recipients . There was a special message to Councilperson Beavers and Councilperson Salino stating that their opinions were important and valid and asking them to add their vote to the other three. A copy of the memo is on file in the Town Clerk ' s office. Kathy Halton reported that she had sent an editorial to the Ithaca Journal but it had not as yet been published. She thanked the Town Board for giving up their time on the Resolution #70 . REPORTS EMC - No report Highway- written report received Highway Superintendent Andrew Thurnheer responded to complaints received on road conditions and reported that he appreciates any comments that anybody brings to the Town and has not had the opportunity to speak to Olympia McFall. Response time when the highway department is contacted is within 24 to 48 hours . If you have a problem and you make a call we ' ll be there. He said that if the Fire Department has problems with Station Road, they just need to call and we ' ll take care of it during the week. The dirt roads are graded twice a year and if we have to we ' ll do them three. He would also like to see if the gravel in the pond at the highway department would be suitable to use. Zoning - Code Enforcement Office Report - Susan Beeners reported that the Town Board had her monthly report and attached to the back of it is housing unit numbers from the 2000 census which shows that we have since April 2000 we have increased about 10% in our population in our housing units . We generally get roughly 20 new houses per year. We have about twelve under construction or with permits about to be issued this year. She has issued a vacate order for a four(4) unit apartment building as it is not in any condition to be occupied. A camper trailer will be temporary housing for four(4) months for a family that experienced a fire on West Miller Road. A strategic plan grant application has been submitted requesting $24,000 . The Town Attorney has not responded on the letter from the Tompkins County Planning Department regarding the Subdivision Regulations . Beautification Committee -Naomi Strichartz reported that trees have been planted and have one flowering pear in front of the Danby Market. They are taking orders for trees and plants from residents on 96B . The committee thanked the Supervisor for painting the gazebo and the next thing will be the landscape around the gazebo . She hopes to get teenagers to help with the planting around the gazebo . Recreation Partnership - Supervisor Dietrich reported that they have been meeting with the towns for feedback and commitments to the program. The Town of Danby uses the partnership and has many children from danby participating in their programs. Community Council - Councilperson Varona-Lacey submitted the minutes from the June 9, 2006 Community Council meeting to be placed in their minutes book. They will be getting the same amount of funding from Tompkins Council Program Management and an increase of $200 for youth 129 3 Town Board Minutes September 11 ,2006 employment to cover the minimum wage increase. There will be a concert here at the Town Hall on October 8 , 2006 by Susan Waterberry. Danby Senior Citizens - Carol Sczepanski reported that the Senior Citizens met on September 7 , 2006 for their dish-to-pass luncheon . Thirty-six seniors were in attendance and were entertained by Zola Zola a father and son duo . Comprehensive Plan Task Force Update - The Planning Board has referred the proposed "Right to Farm Law" for consideration. The CPTF is looking at flag lot legislation. COMMUNICATIONS : Memo - McFall ' s of August 24, 2006 - road conditions Annual Down & Dirty Trail run schedule-October 8 , 2006 Supervisor Dietrich said that he hoped nobody changed the markers placed for the run this year Copy of Strategic Plan Grant Application Grant Application - Susan Beeners said that the grant application is for $24,000 for the State to look Strategic Planning for Hamlets . The cash outlay for the Town would be approximately $ 5 ,000 . The award notice if granted should be received in December. Planning Board - will hold three public hearings on Thursday, September 21 , 2006 . OLD BUSINESS RESOLUTION NO. 83 OF 2006- BOND RESOLUTION REAFFIRMED ON SEPTEMBER 11 , 2006 AS ADOPTED ON JULY 5, 2006 By Supervisor Dietrich: Seconded by Council-person Beavers BOND RESOLUTION OF THE TOWN OF DANBY, TOMPKINS COUNTY, NEW YORK, REAFFIRMED ON SEPTEMBER 11 , 2006 AS ADOPTED ON JULY 5, 2006, AUTHORIZING AN ENVIRONMENTAL REMEDIATION PROJECT AT THE TOWN ' S HIGHWAY GARAGE AT AN ESTIMATED MAXIMUM COST OF $385,000, APPROPRIATING SAID AMOUNT THEREFOR, AND AUTHORIZING THE ISSUANCE OF UP TO $385,000 BOND ANTICIPATION NOTES AND SERIAL BONDS OF THE TOWN TO PAY THE COST OF THE PROJECT WHEREAS, Section 220 of the Town Law of the State of New York empowers the Town Board of the Town of Danby, Tompkins County, New York (the "Town") to adopt a resolution subject to a permissive referendum to authorize the construction, alteration and remodeling of the Town ' s Highway Garage located at 93 Hornbrook Road in accordance with a Notice of Violation promulgated by the United States Environmental Protection Agency dated February 28 , 2006 (the "Project") ; and WHEREAS , the Town Board of the Town has determined that it is necessary for the Town to accomplish the Project; and WHEREAS , pursuant to Article 8 ofthe Environmental Conservation Law ofthe State of New York, as amended, and the regulations ofthe Department of Environmental Conservation ofthe State of New York promulgated thereunder (collectively referred to hereinafter as " SEQRA"), the Town is required to make a determination with respect to the environmental impact of any "action" (as defined by SEQRA) to be taken by the Town and the approval of this resolution constitutes such an action; and WHEREAS , the Town has reviewed the Project and has determined that the Project is a "Type II Action" (as defined by SEQRA) and therefore is not subject to review under SEQRA; and WHEREAS , the Town Board now desires to authorize the acquisition, construction and equipping of the Project and the financing of the costs thereof • 1I I i 3 t i I I 2, 30 4 Town Board Minutes September 11 ,2006 NOW, THEREFORE BE IT RESOLVED ON SEPTEMBER 11 , 2006 BY THE TOWN BOARD OF THE TOWN OF DANBY, TOMPKINS COUNTY, NEW YORK (by favorable vote of not less than two thirds of said Board), AS FOLLOWS : Section 1 . The construction, alteration and remodeling of the Town' s Highway Garage located at 93 Hornbrook Road in accordance with a Notice of Violation promulgated by the United States Environmental Protection Agency dated February 28 , 2006, together with appurtenant facilities, including site improvement, original furnishings, equipment, machinery apparatus and other improvements incidental thereto, all as required for the purpose for which such equipment, building and facilities are to be used, at a maximum estimated cost of Three Hundred Eighty-five Thousand and 00/ 100 Dollars ($385 ,000) , including all professional costs, equipment, machinery and other necessary appurtenances and all other necessary costs incidental to such work which is estimated to be the total cost thereof, is hereby approved. Section 2 . The plan for the financing of the aforesaid specific object or purpose is by the issuance of up to Three Hundred Eighty-five Thousand and 00/ 100 Dollars ($385 ,000), or such amount less than $ 385 , 000 as may be necessary, of serial bonds or any bond anticipation notes in anticipation of the issuance and sale of the bonds of said Town, hereby authorized to be issued pursuant to the Local Finance Law and the levy of a tax to pay interest on said obligations . Section 3 . The full faith and credit of the Town is hereby irrevocably pledged for the payment of the principal of and interest on the Bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such obligations becoming due and payable in such years and such debt service payments may be made in substantially level or declining amounts as may be authorized by law. Section 4. Pursuant to Sections 30 . 00, 50 . 00 and 56 . 00 to 60 . 00, inclusive, of the Local Finance Law, the power to authorize the issuance of and to sell the serial bonds and any bond anticipation notes in anticipation of the issuance and sale of the bonds herein authorized, including renewals of such notes, is hereby delegated to the Town Supervisor, the chief fiscal officer. Such bonds or notes shall be of such form and contents, and shall be sold in such manner, as may be prescribed by said Town Supervisor, consistent with the provisions of the Local Finance Law . Section 5. The Town Supervisor is hereby further authorized, at his sole discretion, to execute all agreements and instruments in order to effect the financing or refinancing of the specific object or purpose described in Section 1 hereof, or a portion thereof, by a bond, and/or note issue of said Town. Section 6. The intent of this resolution is to give the Town Supervisor sufficient authority to execute those applications, agreements, instruments or to do any similar acts necessary to effect the issuance of the aforesaid bonds and/or notes without resorting to further action of this Town Board. Section 7. The following additional matters are hereby determined and declared: (a) Pursuant to subdivision (a)(63) of Section 11 . 00 of the Local Finance Law, the period of probable usefulness of the Project is ten ( 10) years ; and (b) Current funds are not required by the Local Finance Law to be provided prior to the issuance of the bonds and any notes issued in anticipation thereof authorized by this resolution; and (c) The proposed maturity of the bonds authorized by this resolution will exceed five (5) years; and (d) The Town reasonably expects to reimburse itself for expenditures from the Town ' s General Fund made for the Project from the proceeds of the 131 5 Town Board Minutes September 11 ,2006 bonds or notes herein authorized; and (e) This resolution is a declaration of official intent to reimburse for purposes of Treasury Regulation Section 1 . 150-2 ; and (1) The bond anticipation notes authorized herein will not be issued in anticipation of bonds for assessable improvements . Section 8. Such bonds shall be in fully registered form and shall be signed in the name of the Town of Danby, Tompkins County, New York, by the manual or facsimile signature of the Town Supervisor and a facsimile of its corporate seal shall be imprinted or impressed thereon and maybe attested to by the manual or facsimile signature of the Town Clerk. Section 9 . The Town hereby covenants and agrees with the holders from time to time of the Bonds and any bond anticipation notes issued in anticipation of the sale of the Bonds, that the Town will faithfully observe and comply with all provisions of the Internal Revenue Code of 1986, as amended (the "Code"), and any proposed or final regulations issued pursuant thereto unless, in the opinion of bond counsel, such compliance is not required by the Code and regulations to maintain the exclusion from gross income of interest on said obligations for federal income tax purposes. Section 10. All other matters, except as provided herein relating to such bonds, including determining whether to issue such bonds with a schedule of substantially level or declining annual debt service and all matters related thereto, prescribing whether manual or facsimile signatures shall appear on said bonds, prescribing the method for the recording of ownership of said bonds, appointing the fiscal agent or agents for said bonds, providing for the printing and delivery of said bonds (and if said bonds are to be executed in the name of the Town by the facsimile signature of its Town Supervisor, providing for the manual countersignature of a fiscal agent or of a designated Official of the Town) , the date, denominations, maturities and interest payment dates, place or places of payment, and also including the consolidation with other issues, shall be determined by the Town Supervisor. It is hereby determined that it is to the financial advantage of the Town not to impose and collect from registered owners of such bonds any charges for mailings shipping and insuring bonds transferred or exchanged by the fiscal agent, and, accordingly, pursuant to paragraph c of Section 70. 00 of the Local Finance Law, no such charges shall be so collected by the fiscal agent. Such bonds shall contain substantially the recital of validity clause provided for in Section 52 . 00 of the Local Finance Law and shall otherwise be in such form and contain such recitals in addition to those required by Section 52 . 00 of the Local Finance Law, as the Town Treasurer shall determine. Section 11 . The law firm of Trespasz & Marquardt, LLP is hereby appointed bond counsel to the Town in relation to the issuance of the Bonds . Section 12 . The validity of such bonds and bond anticipation notes maybe contested only if: 1 . Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money, or 2 . The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of publication, or 3 . Such obligations are authorized in violation of the provisions of the Constitution. Section 13 . This resolution shall be subject to permissive referendum and a summary hereof shall be published by the Town Clerk as provided by Town Law Section 90 . This Resolution shall become effective 30 days after its adoption pursuant to Section 91 of the Town Law. Following such effective date, in the event that no petition for a referendum was timely submitted and filed, the Town Clerk shall cause the publishing and posting of a notice in substantially the form provided in i1 i I ! NEW BUSINESS : RESOLUTION NO. 85 OF 2006 ADOPTION OF THE NATIONAL INCIDENT MANAGEMENT SYSTEM By Supervisor: Seconded by Councilperson Beavers WHEREAS, Emergency Response to critical incidents, whether natural or manmade, requires integrated professional management, and WHEREAS, Unified Command of such incidents is recognized as the management model to maximize the public safety response, and WHEREAS, The National Incident Management System, herein referred to as NIMS has been identified by the Federal Government as being the requisite emergency management system, and 1 t ii I t 134 8 Town Board Minutes September 11 ,2006 WHEREAS, Failure to adopt NIMS as he requisite emergency management system may preclude reimbursement for costs expended during and after a declared emergency or disaster and for training and preparation for such disasters or emergencies, therefore it is RESOLVED, that it shall be the policy of the Town Board of the Town of Danby to adopt the NIMS concept of emergency planning and unified command, and it shall be further RESOLVED, that it will be the policy of the Town of Danby to train public officials responsible for emergency management. A roll call vote on the resolution resulted as follows : Beavers Aye Nolte Aye Salino Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously RESOLUTION NO. 86 OF 2006 PERMISSION FOR THE CAYUGA LAKE WATERSHED NETWORK TO USE THE TOWN HALL FOR WORKSHOPS By Councilperson Varona-Lacey: Seconded by Councilperson Salino RESOLVED, that the Town Board of the Town of Danby grants permission to the Cayuga Lake Watershed network to use the Town of Danby Town Hall on Wednesday, October 18`h and November 15 `h from 7 : 00 - 9 : 00 p .m. to hold the Septic System and Well Water workshops, in conjunction with the Tompkins County Health Department. A roll call vote on the resolution resulted as follows : Beavers Aye Nolte Aye Salino Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously RESOLUTION NO. 87 OF 2006 PERMISSION FOR TOWN CLERK TO USE A TOWN OWNED TRANSCRIBER AT HER HOME By Supervisor Dietrich: Seconded by Councilperson Beavers RESOLVED, that the Town Board of the Town of Danby grants permission to the Town clerk to use a Town of Danby owned transcriber at her home for Town business . A roll call vote on the resolution resulted as follows : Beavers Aye Nolte Aye Salino Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously PROPOSED RIGHT TO FARM LAW Councilperson Beavers reported that the original intent of the proposed local law was notification to residents who subdivide a lot or apply for a building permit that they may be in an area where agricultural activities occur. It has turned into restrictions for agriculture. Under the Section 1 (e) it restricts farm CAFOs . Most of these are described and regulated by the State and Federal Government. He read a section of the Planning Board report relating to the "Proposed Right to Farm Law". He suggested that Section 1 (e) be removed. 135 9 Town Board Minutes September 11 ,2006 Susan Beeners reported that she would need at least thirty(30) days for processing. She suggested that the Town Board direct her to transmit the local law draft to the involved agencies for their response, then schedule a hearing. A public hearing may be scheduled for November or December. Motion to Set Dates for Budget Workshops A motion was made by Councilperson Salino and seconded by Councilperson Beavers that Budget Workshops will be scheduled for Monday, September 25 at 7 : 00 p .m. , October 2 at 6 : 00 p .m. , Monday, October 9 at 6 : 00 p .m. and the public hearing for the preliminary budget scheduled for Thursday, November 9 , 2006 . A roll call vote on the resolution resulted as follows : Beavers Aye Nolte Aye Salino Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously MOTION TO RECIND RESOLUTION 70 OF 2006 By Councilperson Beavers : Seconded by Councilperson Salino DISCUSSION ON RESOLUTION NO. 70 OF 2006 Councilperson Beavers read into the record the following : No Board Member objected. "Members of the Board, I ask you again to rescind resolution 70 . I have heard and understood the passionate arguments for supporting Resolution 70. I ask that you put your passion away to listen and consider this . The government is set up to work at different levels of representation, Federal to State to County to Town. We are a town board elected to take care of town matters not National and International . The argument that the money needed to support the war comes from and steals from the local community, I find a mute point. All government programs are funded by taxes and come from the local community. The issue here is of ethics and procedure. I don' t believe that there is one person in the community when they voted were voting for more than representation at the town level . I ran for town board on the issues of roads, land use and ethics . Not one person asked me of my views on International policy, capital punishment, etc . The war resolution is one everyone likes (I like it) . If asked privately to sign the petition I would have but to support it as a board member I cannot. You have to be careful of the president you set in doing so . Nobody likes the war and it is an easy feel good resolution that everybody likes . If passed the president opens the doors for other venders out of town business like the issue of abortion that kills more people in a year than this war since it started. This is my point. Other issues could not be so easy for everyone to support but just as passionate . Don' t violate th procedures of government to do something that makes you feel emotionally better. Use your rights to vote to make change . I ' ve heard arguments from people in the community calling this grass roots and comparing it to the founding fathers in their efforts to make change. How is it they can even try to compare it to the integrity and vision of these people and to the situation to which they were under. They were under the impression of a king with no rights . The last I knew the rights given to us by the founding fathers still exist. The right to free speech, press, assembly and mos of all the right to vote. I have heard argument from former board member Naomi Strichartz saying she believes that the board should be and is proud that they are venturing into this issue. I believe that Mrs . Strichartz thought that th board should be doing a lot of things . I would like to point out to her she is no longer on the board. Maybe she should think of why. I would also like to point out that this issue has taken more time in debate than the failed $ 600,000 salt barn bond and even as much as the 60/40 land issue. What have we gained for the community? Division and dissension. I ask that we give the voters what they voted on, a town board dedicated to doing town business in the best interest of the people. ( i I 136 10 Town Board Minutes September 11 ,2006 Councilperson Varona-Lacey submitted a memo from Asher Hackett and read by Councilperson Nolte thanking the town board for hosting a public discussion on "Bring home the troops" resolution (No . 70 of 2006). "Thanks for hosting the public discussion on the "Bring home the troops" Resolution. It is my deep desire that we never lose the ability to talk to our neighbors without rancor on subjects about which we disagree We must all be ready and willing to change our minds when the facts tell us we are wrong. No mistake is irreversible and only a fool digs in and refuses to admit them . And if respect and civility prevail there is still hope for us and our American way. On the heels of tonight ' s meeting I ask that the Town Board act on the resolution which it passed legally and in the light of day nearly two months ago, and forward it immediately to its intended recipients . If there is a motion next week to vote to rescind the resolution please vote against it. And a special message to Mr. Beavers and Mr. Salino : Thank you for your public service. Your opinions are important and valid, and I respect them and you for having them. But look at the evidence . The numbers quoted to you tonight by various folks are accurate . This miserable war is costing us all more than we can ever possibly afford, and not only in terms of money - the entire American dream and the system in which you are willingly participating is at peril . Since the outset of the war one mistake has led to another, and no one at the top takes any responsibility for them. There was talk tonight about the expertise or, more specifically, the lack thereof, of board members in foreign policy. That talk applies in spades to our federal administration. They have none and have demonstrated no ability to gain any whatsoever.
