Highway Garage Remediation Project - Cost Summary and Request for Funding dated June 19 , 2006
was presented to the board from Susan Beeners for their review and consideration .
Supervisor Dietrich called the meeting to order at 7 : 10 p . m . Purpose of the meeting was to review
additional proposals for the highway garage remediation project (Class V Injection Well
Remediation Project) .
Susan Beeners reviewed the Highway Remediation Project - Engineering and Compliance Services
Proposal she submitted to the Board on June 14 with the Town Board .
After discussion of the report it was suggested that Objective #2 be modified to reflect that the Town
Board is not interested in in-house capabilities .
Ted Jones reported on his conversation with the Association of Towns Attorney about using monies
from the Capitol Reserve Funds . Capitol Reserve funds should be limited to only Capitol projects
and improvements . It was not recommended that the Capitol Reserve funds should be used for the
septic and drainage remediation .
RESOLUTION NO. 65 OF 2006
MODIFYING 2006 BUDGET RELATED TO HIGHWAY GARAGE CLASS V INJECTION
WELL REMEDIATION PROJECT
By Councilperson Beavers : Seconded by Councilperson Salino
WHEREAS , the Town of Danby is continuing to move promptly to address the order received by
the U . S . Environmental Protection Agency related to remediation of a Class V Injection Well at the
Town Highway arage located at 93 Hornbrook Road ; and
WHEREAS , the Town Board on June 19 , 2006 has reviewed a Cost Summary dated June 19 , 2006 ,
which includes work recommended for funding and approval in the amount of $47 , 819 ; NOW,
THEREFORE, IT IS
RESOLVED, that the Town Board of the Town of Danby hereby further modifies the 2006 Budget
by transferring an additional amount of $47 , 819 . 00 from the General fund fund Balance to account
A1442 . 400 .

A resolution was presented to the Town Board for approval of further work related to the highway
garage remediation project. After reviewing the proposed resolution the following resolution as
amended by the board was approved.
Discussion :
Susan Beeners said that the amendments to the original resolution would insure that some further
work can occur and adjusted numbers will be available for a bonding information .
RESOLUTION NO. 66 OF 2006
APPROVAL OF FURTHER WORK RELATED TO HIGHWAY GARAGE REMEDIATION
PROJECT

WHEREAS, Environmental Resources Management (ERM) has submitted a proposal dated June 13 ,
2006 for Engineering and Compliance Services at the Danby Highway Garage, 93 Hombrook Road ;
and
WHEREAS, the Town Board on June 19, 2006 haws reviewed the recommendation of Town staff
related to approval of certain work items, and modification of other work items in said proposal :
NOW, THEREFORE, IT IS
RESOLVED, that the Town Board of the Town of Danby authorizes the Town Supervisor to execute
agreements related to the following :
1 . Approval of Objectives # 1 and #2 in said proposal, at a maximum estimated cost of
$ 35 , 819 . 00, with the provisions that option #2 be modified to request that the Town
Board wishes to defer research in house capabilities .
2 . Approval of a Revised Objective 4/5 , with ERM to prescribe best practices for on-site
storage and periodic disposal of waste oil and related materials ; and hazardous waste
mainly in the form of sweepings ; and with ERM also to advise on qualified firms to
pick up and dispose of hazardous wastes, at a maximum estimated cost of $ 6 , 000 .
3 . Provision of recent and ongoing engineering services by T. G. Miller, P . C . at an
estimated cost of $6 , 000 ; conditional with the condition that the town supervisor and
town bookkeeper concur that bonding for this project is feasible .

Susan Beeners reported to the Board that the reason that the expenses for best practices is included
is that we want the board to advise on the hazardous waste.
Supervisor Dietrich reported that the Highway Secretary has drafted a letter to Senator Jim Seward
requesting information on how to obtain past insurance information. He said that his meetings with
our insurance carrier has not produced any information on our policies and we have been unable to
locate copies . It is important that the board views and approves of the draft before it is sent to the
Senator.

Board of the Town of Danby authorizes the Town Supervisor to send a draft letter to Senator Seward
requesting him for help with any information on our missing insurance paper work.
