REPORT OF TOWN OFFICIALS Supervisor ' s Report Ithaca Area Wastewater Treatment Plan BAN Renewal Supervisor Desch stated that on May 30th , the $ 10 , 000 , 000 in BAN ' s for the plant were renewed . He went on to say that excellent bids were received with a part of each of the City and Town notes coming in at 5 . 32 % and the remaining at 5 . 33 % and 5 . 34% . We had a bid at Town Board 2 June 10 , 1985 5 . 28% that had to be rejected because the bidder filled the wrong number on the bid letter . The Supervisor went on to say , as you know borrowing rates are under 7% so the short term spread for investments will not be as good as the 3-4 % we have enjoyed so far . Nature Park - Lick Brook Supervisor Desch stated that he had received a letter inviting us to participate in the establishment of a Nature Museum in Lick Brook . Apparently fund raising has already begun . He went on to say that he presumed that at some point , the formal environmental review process would begin . Personnel Committee The Personnel CaTmittee has met and begun the process of reviewing a draft of the Personnel Manual which will reflect personnel policies in place . Proposals for changes will be forthcoming during the next several months so that any 1986 budget implications can be considered . Water/Sewer Extension Planning The Supervisor noted that we had received a significant response to our Newsletter item having to do with needs for water/ sewer extensions . For the most part the responses have come from West Hill . The people on West Haven who don ' t have sewer now would like it now that they have water . Several residents in the Woolf Lane area are interested , residents of Trumansburg Road above the hospital tank pressure zone are interested in water , so we will take these interests into account in our future planning . He went on to say that we have an item on the agenda involved with public water service along the West Shore and we will be looking at sewer along the East Shore now that access to a main is possible at the new Youth Facility , which is moving forward . As you may have noticed , the Tin Can is almost gone . The City Attorney is working on the annexation swap involving the Tin Can properties and the East Shore properties . Route 96 Project There are at least two State DOT presentations on the Route 96 alternatives next week . One will be Tuesday evening , July 18 at the County Court Room at 7 : 00 P . M. , and the second on June 20 in Common Council Chambers at 7 : 30 P . M. The Supervisor urged Town Board members and staff to attend at least one of these presentations . He went on to say that we must do everything in our power to convince our City colleagues that a new road up the hill is essential with or without an overpass over the railroad . Pine Tree Road Relocation ® Supervisor Desch stated that on Friday , . he , Shirley Raffensperger and Larry Fabbroni had met with representatives of the County and Cornell to discuss the various possibilities for improvement to the circulation in the East Hill Plaza and Route 366 areas . No conclusions were reached but there is agreement that major improvements will be necessary and there seems to be a desire to develop an overall plan to resolve the long term problems in the area . 1986 Town Bud et Town Board 3 June 10 , 1985 Within the next month the early stages of the budget process will begin . Any Town Board members having ideas or thoughts about new budgetary needs should contact me within the next month so that any necessary cost analyses can be accomplished in time for serious consideration . We will for example , be developing the first operating budget for the new Wastewater Treatment Plant even though construction is not expected to be completed until late 1986 . The training cycle for new plant personnel and the Chief Operator will be on board before the end of 1985 . He went on to say that he expects we will know the fate of Federal Revenue Sharing before the final Town Budget Hearing . If not , we may simply hold off allocating the 1986 Entitlement Period . FLOATING HOLIDAY Supervisor Desch stated that the Town employees have requested the designation of Friday , July 5 as the Floating Holiday , RESOLUTION NO . 103 Motion by Councilwoman Howell ; seconded by Councilman McPeak , RESOLVED , that the Town Board of the Town of Ithaca hereby approve the Town of Ithaca employees taking their Floating Holiday July 5th . (Desch , Kugler , Raffensperger , Cramer , McPeak , Howell and Bartholf voting Aye . Nays - none) . Town Engineer ' s Report Town Engineer Fabbroni noted that the Board members had a copy of his report in their folders . (Copy attached to minutes ) . He then went on to highlight his report . The installation of the main water line on South Hill and West Hill for Phase II has been completed . The contractor is now installing service lines into the properties . Phase I of the is vertially complete , with clean up on Bundy Road , Sugar Bush Lane and Danby Road by L ' Auberge . He noted that the contractor is anxious to receive his final payment . Councilman McPeak asked how much of the final payment Was being held by the Town . Town Engineer Fabbroni responded , $ 12 , 000 is still being held . The Engineer went on to report that there is a small break in the water line on the Forest Home Bridge . Every place where the pipe lays cn the bridge salt has worked its way into the pipe . He went on to note that the pipe is over 40 years old . Councilman McPeak asked which bridge is the second bridge? ® Town Engineer Fabbroni responded , the bridge closest -to Flat Rock , The Engineer went on to say that he recommends that the main be replaced from valve pit to valve pit . A neoprene jacket of some type should be installed on the pipe or pipe already jacketed should be used . He stated that he would have a recommendation now but he wants to look into the two possibilities . The bridge support is metal to metal and has caused problems at every support . However , this road will not be a through street alternative to Pine Tree Road . Therefore , the traffic service area is confined to the Eastern Heights community . Noise associated with this road will be comparable to that presently associated with principal residential streets in this area . There is a potential for erosion and drainage problems , both during construction and afterwards . Deep cuts in the area of 10 - 20 feet are required at the base of the hill . Positive steps , such as the use of hay- bale barriers , shall be taken to control erosion during construction . The lower 300 feet will be storm sewered and retaining walls will be constructed as necessary to stabilize cut slopes . These mitigation measures , as well as extensive revegetation , should significantly mitigate this potential problem . APPENDIX B The prevailing community character of the area is one and two - family homes . The remaining open land on Snyder Hill will be developed comparably . This road extension is an safety improvement which provides an alternative to Snyder Hill Road as a means of access to and from the Eastern Heights development . The residential character of the area will not be adversely affected . APPENDIX C This road extension has been shown on the Official Highway Map from 19680 Construction would be in conformance with a comprehensive plan of develop - ment and is required as a condition of future subdivision approvals for the lands owned , by Frandsen and Pine Tree Associates , APPENDIX D There are two residential subdivisions which may not proceed with construction until this road has been constructed . The lands owned by William Frandsen are in the immediate vicinity of this road . At this time , there are approximately 55 lots which may be developed in the future and which will be served by this road . The lands owned by Pine Tree Associates are located to the northwest of this road extension . An additional 26 lots may be eventually developed on this property . APPENDIX E There are no secondary or cumulative effects which have been associated with this action . SUMMARY : This road extension is in conformance with the comprehensive development plan of the Town . The Highway Master Plan of 1968 identified the need for a second means of access and egress from Snyder Hill . This road may be characterized as a residential collec - tor street which will not substantially disturb the character of the Eastern Heights community . The aspect of the project most likely to create adverse environmental impacts is the need for sizable cuts in the hillside slopes . As indicated above , positive erosion control will be maintained throughout the construction zone and all disturbed areas will be completely revegetated . I recommend a determination of negative environmental significance for this project . Peter M . Lovi Town Planner June 6 , 1985 Town Board 4 June 10 , 1985 The Town Engineer noted that he was waiting for agreements with the City , Village of Cayuga Heights and Cornell on various parks . We are taking on moth ball projects , like hydrant maintenance , painting and lubricating valves . Town Supervisor suggested that the Town Engineer talk with Bolton Point personnel to see if it makes sense to number the hydrants . Town Engineer Fabbroni went on to say that another area of surprise were the gas heaters at the Highway Barn , which have developed a problem with corrosion . We expected a longer life , but they are pretty much shot . A ten mile per hour wind will start them oscilating . We have a number of estimates to replace the heaters . Councilman Kugler warned the Town Engineer to be careful you don ' t have the equipment exhaust going into the air space because of condensation and deposit of corrosive materials . Councilman Cramer asked how many unit heaters are there at the Highway Barn ? Town Engineer Fabbroni responded , seven unit heaters . The Town Engineer noted that they were working on the fire alarm system but were having trouble getting an estimate from the company . He went on to say that there was a lot of activity at the sewage treatment project , with some activities more visable than others . We have had a major pour , the crossing of Route 13 and Cascadilla Creek have begun . Also , the contractor has begun work on the lake outfall pipe . Town Planner ' s Report Town Planner Peter Lovi noted that he had included one additional item after a discussion with the Six Mile Creek Study Committee . The area in question is the south side of Slaterville Road from the City of Ithaca line to the property line of Cram-nonlands . The area is presently developed with thirteen houses fronting on Slaterville Road and one house situated on a rear lot . The area is zoned R-15 for a distance of 500 feet from the road , the remaining land to the City of Ithaca watershed boundary is zoned R-30 . This area is served by public water and sewer . There are approximately 45 acres of open , undeveloped land from the Cammonland property to the City of Ithaca line . The planning concern is that if additional frontage construction is permitted along Slaterville Road without concern for the preservation of access to the remaining lands , a large amount of landlocked property will be created . The Town Planner went on to say that there were three open areas where a road intersection with Slaterville Read could be located . All three of these openings are in excess of the 60 foot minimum required for Town rights-of-way . Mr . Lovi asked the Board to think about the problem and determine ® if the problem is important enough to amend the Official Town Highway Map to show one or more of these corridors . He noted that an extension of Lois Lane was possible. but it already is a long cul-de-sac and therefore , he did not recommend this . The Planner noted that the Six Mile Creek Committee has discussed development of this area and there is already a healthy disagreement on development . Councilman Kugler asked if the area would need sewerage installed if developed? Town Board 5 June 10 , 1985 Town Planner Lovi responded yes , however , we would keep the developed areas away from the wooded areas . Councilwoman Raffensperger asked if the owners of the properties in question were aware of the Towns concerns ? Town Planner Lovi responded that questionnaires were being sent to the land owners to determine their feelings . REQUEST FROM CAYUGA VISTA TO MODIFY ODVENANTS Edward Mazza , one of the developers of Cayuga Vista stated that Cayuga Vista was a proposed project to be located on Route 96 past National Cash Register , on the right hand side of the road . The area in question contains about 8� acres of land . The Planning Board has already approved the 32 cluster ToHmhouses consisting of eight buildings which are not being built as apartments , they are being built as separate houses . At the last Town Board meeting restrictions were put on rentals . Our intentions , as developers , is to sell . However , in order to loan us the money the bank wants all avenues open to them . If we can ' t build for what we think we can , or if we can ' t sell for what we want to sell them for and the ® bank has to foreclose , they want all options open to than . Mr . Mazza stated that it was his opinion that the Town Board could not restrict rentals . He went on to say that the developers hoped to sell their proposal to the bank in order to get the necessary financing to develop the project . If the developers and the bank were allowed to rent for up to seven years this would help them to get financing . He went on to say that after seven years , restrictions on renting could take place . Supervisor Desch asked Mr . Mazza when he wanted to break ground? Town Board 6 June 10 , 1985 Mr . Mazza responded that they had hoped to have been started before this . Now we will be unable to construct the eight buildings that were proposed for the first year . Supervisor Desch assigned the Committee of Councilwoman Howell , Councilman McPeak , Town Attorney Barney and Town Planner Lovi to study the rental question and report back to the Town Board at the July meeting . MDDIFICATIONS TO LOCAL LAW #4 - 1984 (LUCENTE) Proposed Amendment to Local Law No . 4 of the Year 1984 - Be it enacted by the Town Board of the Town of Ithaca as follows : RESOLVED , that the Town Board of the Town of Ithaca enact and hereby does enact this Local Law to amend the zoning ordinance of the Town of Ithaca and to amend Local Law No . 4 adopted in the year 1984 so as to clarify certain rights of the owners of property located at 108 through 230 Sapsucker Woods Road , Town of Ithaca , Tax Parcels Nos . 6-70 -10 -3 . 12 through 6 -70 -10 -3 . 25 now or formerly owned by Rocco Lucente , more particularly described in Local Law No . 4 , such amendments to be as follows : 1 . Section 7 of Local Law No . 4 of the year 1984 as adopted by the Town Board of the Town of Ithaca is hereby amended to read as follows "At least one dwelling unit in each of the structures , after any conversion as provided herein , shall , within thirteen mcnths of the issuance of a Certificate of Occupancy issued in connection with such conversion be owner-occupied . Such owner , however , must qualify as a household ( or family ) as defined herein . If , thereafter , a structure is not occupied by the owner then the structure may be occupied only as Permitted by the regulations of a Residential District R-15 for a two-family dwelling as if this amendment to the Zoning Ordinance had not been adopted . Notwithstanding the foregoing , however , after the premises have been owner-occupied for at least four consecutive years , at the owner ' s option the premises may be leased and non-cxwnier occupied for a period of up to twelve months out of each consecutive periods of sixty months . Paragraph 11 of Local Law No . 4 of the year 1984 is amended by designating the first sentence in said paragraph to commence with " ( a ) " and adding a new subdivision " (b ) " to read as follows " (b) " The wards "owner-occupied " means occupancy by the deed owner of record of the premises . In any action to enforce any violations of these provisions , any relief obtained against the record owner of the premises , such as injunction , damages , or declarations , shall be binding upon all persons having any ® interest in the property , beneficial or otherwise , or any persons having a lien on the property derived through the record owner . 39 This law shall take effect immediately . Town Supervisor Desch asked if the Committee wished to defer setting a Public Hearing on the above . proposed amendment until after they considered the question of rentals for Cayuga Vista ? Town Board 7 June 10 , 1985 Town Attorney Barney responded that the Committee will have met to discuss rentals at Cayuga Vista before the Public Hearing to amend the local law pertaining to Rocco Lucente ' s property . Councilman Cramer stated that he was having a problem with the sentence "Notwithstanding the foregoing , however , after the premises have been owner-occupied for at least four consecutive years , at the owner ' s option the premises may by leased and non-owner occupied for a period of up to twelve months out of each consecutive periods of sixty months " . Town Attorney Barney responded that the sentence means the property can be leased for one year out of every five years . RESOLUTION NO . 105 Motion by Supervisor Desch , seconded by Councilman Cramer , RESOLVED , that the Town Board of the Town of Ithaca will meet and conduct a public hearing at 7 : 00 P . M. , on July 8 , 1985 at the Town Hall to consider an amendment to Local Law No . 4 of the Year 1984 . (Desch , Kugler , Raffensperger , Cramer , McPeak , Howell and Bartholf voting Aye . Nays - none) . Councilwoman Raffensperger asked if the neighbors would be notified of the public hearing to amend the local law? Supervisor Desch responded , yes . INLET VALLEY PARK RESOLUTION Susan Beeners prepared the following status report : Assemblyman MacNeil ' s office has drafted and introduced a bill to the New York State Legislature (Assembly Bill A 6772 and Senate Bill S 6362 ) that would give the City of Ithaca authorization to implement the proposal that would lead to City purchase and Town developmnt of a park in the Inlet Valley area . A resolution in support of the bill has been. passed by City Common Council . A similar resolution is proposed for consideration by the Town Board on June 10 . Passage of the bill is expected before the close of the legislative session at the end of June . The City has had difficulty in negotiating for the proposed Inlet Valley Park land . The owner of the largest parcel , which was the former Knight ' s treat market site , has not responded to the City ' s offer to purchase the site at fair market value based on appraisal . Nor has this property owner responded to a Notice of Violation of the Ordinance Regulating Unsafe Buildings and Collapsed Structures from the Town Building Inspector or from his own attorney in regard to the hazardous state of the former meat market . As authorized by the Town Board , an architect has been appointed by the Building Inspector to survey the condition of the building , and it is likely ® that a court order for demolition will be sought . The owner of a smaller parcel which has been proposed for inclusion in the Inlet Valley Park land has expressed an unwillingness to sell his acreage to the City . Planning staff at the City has suggested the possible acquiring of the proposed park land by the Town through emminent domain , with funding of the fair market acquisition costs by the City . While City and Town staff will continue efforts to negotiate with the involved property owners , it is possible that the process of emminent domain will be brought to the Town Board for 0 Town Board 8 June 10 , 1985 consideration , as well as the reservation of funds which were budgeted for 1985 Inlet Valley Park Development . Councilwoman Raffensperger questioned the fact that support of the resolution would not necessarily conmit the Town to the way of obtaining the land . Supervisor Desch responded that his understanding and reading of the bill does not commit the Town to any particular action on acquisition or development . RESOLUTION NO . 106 ® Motion by Councilwoman Raffensperger ; seconded by Councilman Cramer , WHEREAS , the Town of Ithaca desires to develop certain lands in the Inlet Valley area for recreation , pursuant to the Town of Ithaca Comprehensive Open Space and Recreation Plan , and WHEREAS , such development will be facilitated by and subject to acquisition of said lands in the Town by the City of Ithaca in fulfillment of City park land alienation requirements , and WHEREAS , New York State Assembly Bill A . 6772 and Senate Bill S 6362 will authorize the City to implement the proposed alienation plan , NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of Ithaca expresses its support for Bills A 6772 and S 6362 , and requests passage of said Bills by the New York State Legislation . ACCEPTANCE OF SEWER MAINS TO SERVE LOT # 14 - HERTEL SUBDIVISION Town Engineer Larry Fabbroni stated that Lot #14 is shown as a lot currently subdivided as a buildable lot . In 1978 , Hertel ' s build a house and extended water up the road to their lot and lot # 14 . Hertel ' s asked the Town to extend the sewer , they were told the Town policy was for the developer to extend the sewer . Now that the sewer will be serving at least lot # 14 , they are asking the Town to accept the sewer line as a public sewer line . Councilman Kugler asked if the pipe and manhole were of legal size for public sewer? Town Engineer Fabbroni responded , yes . Town Supervisor Desch remarked that there was nothing unusual about this request , from a policy standpoint . RESOLUTION NO . 107 Motion by Councilman Kugler ; seconded by Councilman McPeak , WHEREAS , John and Martha Hertel , 130 Crest Lane , extended the eight inch ( 811 ) sewer to their property to an end four-foot (4 ' ) manhole in 1978 to serve their new home being constructed at the time , and WAS , the materials , sizes , and construction methods utilized were identical to those of public sewer mains and Town of Ithaca specifications , and Town Board 9 June 10 , 1985 WHEREAS , the Hertels now desire to sell a portion of their lands to others for residential development to include sewer use of the same end manhole for extension to building site ( s ) , NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of Ithaca that the sewer main and manhole is accepted as a Town public sewer main provided the following conditions are met : ( 1 ) A permanent easement , sufficient in width , condition of title and form to the Town Engineer and Town Attorney , shall be offered to the Town for improvements being accepted and subsequently recorded at the expense of the Hertels . ® ( 2 ) That tests for exfiltration and infiltration of the manhole and sewer reach shall be performed by the Hertels with leakage not exceeding 100 gallons per diameter inch mile per day for acceptance by the Town . Rocco Lucente stated that Mr . Lucente had requested a 36 month rental period after conversion of the buildings to allow Mr . Lucente time to sell the property . He went on to say that he had written Supervisor Desch a letter saying Mr . Lucente would meet the Board half way , therefore , he was proposing a 24 or 25 month rental period . The long term result will not be good for the neighborhood if Mr . Lucente is only allowed 13 months rental . Mr . Lucente wanted time to find good solid purchasers . Mr . Tyler , referring to the proposed amendment to Local Law # 4 - ® 1984 , stated that he felt the amendment was not realistic and that it would be damaging to the Town and to Mr . Lucente . He went on to say that he was asking the Board to reconsider the proposed amendment and allow Mr . Lucente 25 months rental of the property . Mr . Tyler noted that he was not asking for the moon or something unreasonable . Mr . Lucente is not going to find a buyer everyday with this amount of money . He stated that his other concern was the section referring to people going on sabbatical leave . The way the section is written , you would be required to own the property for four years before going on sebbatic . Town Attorney Barney responded , the premises must be owner occupied for four years , however , this could moan two or three different owners . Mr . Tyler questioned the possibility of a person buying the property then going on sebbatic the next year . Town Attorney Barney remarked that you have to draw the line some place . Sometimes it is harsh . Mr . Tyler responded that he did not feel Mr . Barney was concerned about the people who go on sabbatic . Town Attorney Barned responded that he did not want to get into a lot of exceptions , as soon as you starting granting exceptions then you defeat the purpose . Mr . Tyler stated that he was respectfully asking the Board to consider 24 to 25 months rental instead of the Committee ' s reccmrendation of 13 months . Supervisor Desch asked the Board if they wished to reconsider the Proposed amendment to Local Law #4 - 1984 ? Councilman Cramer stated that the Board awes the public the right to comment at the public hearing . We can consider a change after we hear the public ' s comments at the hearing , if we so desire . PUBLIC INFORMATION HEARING - DESIGNATION OF PLAYFIELD AT THE CODDINGTON ROAD COMMUNITY CENTER AS A TOWN PARK Proof of posting and publication notice of a Public Information Hearing to consider designating the playfield at the Coddington Road C n1munity Center , 920 Coddington Road , Ithaca , New York , Tax Town Board 14 June 10 , 1985 Parcel No . 47-1-11 . 3 as a Town Park , having been presented by the Town Clerk , the Supervisor opened the public hearing . Susan Beeners , Landscape Consultant stated that the proposed resolution was pretty self-explanatory . Proposed improvements for 1985 is the upgrading of the play fields ( ruts ) , resurfacing of the parking area and the installation of a sign noting the play fields as being a Town Park . The rules and regulations governing Town Parks will be posted on the sign . The rules and regulations on alcoholic beverages and groups over 20 will be modified so that they are referred to the Center instead of the Town , this will allow users of the play fields the use of the bathroom facilities by arrangement with the Center . Repair of fence , repair of lawn and repair of asphalt curb around the basketball court to hold ® water in the winter for a skating rink are part of the planned repairs for 1985 . outside of the play field , prepare ground for a garden club . Ms . Beeners went on to say that the size of the parking area is sufficient . The Town will resurface the parking area with crusher run . However , the parking area is not stable enough for the Town plow , therefore , snow plowing will be the responsibility of the Center . Supervisor Desch asked how big the proposed sign would be ? Ms . Beeners replied , 3 ' x 51 . The Supervisor asked if the sign would be in addition to the sign already there ? Ms . Beeners replied , yes . Supervisor Desch asked who would issue the permits for the play fields , the Town or the Center ? Ms . Beeners responded that her recommendation would be that the Center issue the permit . Ballplayers , etc . , will need bathroom facilities , therefore , the Center would issue the permit . Supervisor Desch asked if the Center would be required to administer the remainder of the Park Rules ? Ms . Beeners suggested that the Town Board needs to discuss this as a matter of policy . Supervisor Desch remarked that if the permits were issued by the Center , the Town would loose control . Merry Jo Bauer , 921 Coddington Road stated that she saw no problem with the Town spending $ 2 , 100 to mow and remove the ruts from the play field . However , she was concerned with any expanded use of the play fields . She went on to say that there is a shortage of fields for the leagues and she would hate to see local leagues from downtown using the play fields at the Center . Mrs . Bauer went on to say that she would prefer to have the Town issue the permits . Center Board members might be more lenient in giving permits to neighbors than the Town would be . Also ,, if you have to go downtown to get a permit , you might think twice about using the area . Louise Mudrak , 693 Coddington Road stated that she was on the Board of Directors for the Center . She stated that play fields for children and youth in the area was needed . Soccer areas are needed for the older children . She went on to say that the Center was hoping to provide an on going child . care facility . Her main concern was coordination . If the younger children have activities scheduled and a barbeque is also scheduled and someone else schedules a ballgame , she went on to say that this worries her Town Board 15 June 10 , 1985 because of the traffic and alcoholic beverages . We need someone to coordinate functions . Anne Morrissette , 1058 Coddington Road stated that she was Secretary of the Center . She went on to say that the parents of the day care children had all become members of the Center , eventhough membership is not a requirement . Supervisor Desch asked Mrs . Morrissette how many children were enrolled in the day care program? Mrs . Morrissette responded that they had a 60 % enrollment . She added that the day care does not use the play fields . She went on to say that as a Board member she could not see the Community Center , without a ballfield being very successful . Since letting people know through one newsletter that the Center was open again , we have had 62 people join , plus we have received quite a few donations . However , she stated that she did not fell that they could manage the play fields by themselves as there was too much mowing and maintenance to be done . Robert Cotts , 115 Northview Road stated that he was in favor of the project . He stated that his kids , when they were young , always went . to the Community Center . He went on to say that there is very little level ground without trees in the area . He is glad to see the Town getting involved in recreation and parks . A ballfield should definately be part of the project . Sarah Grigorov , 611 Coddington Road stated that she wanted to go on record as supporting the plan . As no one else present wished to speak , the Supervisor closed the public information hearing . Supervisor Desch stated that the permit process needs to be formalized . We will move ahead with the projects contingent upon the Town getting the necessary easements and the addressing of the problem of permits . Councilwoman Raffensperger questioned the wording of the resolution , specifically " annual funds " . "Annual " was removed . RESOLUTION N0 , 117 Motion by Councilman Cramer ; seconded by Councilman Kugler , WHEREAS , the Town Board of the Town of Ithaca recognizes the need for a Town park on South Hill to serve Town residents , and WHEREAS , the Coddington Road Community Center has requested assistance from the Town in the cleanup , repair , and upgrading of outdoor play areas and in the maintenance of a play field , NOW THEREFORE BE IT RESOLVED , by the Town Board that appropriate permanent easements be obtained from the Coddington Road Community ® Center for the Town ' s use of the playing field at the Center , and FURTHER RESOLVED , that a temporary work easement be obtained to perform maintenance work on the playing field and related outdoor play areas , and FURTHER RESOLVED , that funds be appropriated for the work and materials to maintain the playing field as reasonably estimated by the Town Landscape Consultant for 1985 not to exceed $ 2 , 100 . 00 , said amount to be appropriated from the General Townwide Fund Balance and to be paid out of expenditure line item A7140 ( 401 ) , Town Board 16 June 10 , 1985 Playgrounds and Recreation - Coddington Road Community Center Play field , and FURTHER RESOLVED that allocation of budgeted funds will not be made until the Coddington Road Community Center Corporation Charter and/or By-Laws is modified as follows . 10 Membership in the Center and use of the play field will be available to all Town of Ithaca residents . 2 . PUBLIC HEARING TO CONSIDER THE REZONING OF PARCEL NO , 50-1 -4 . 2 AT 122 TROY ROAD OWNED BY RUTH LACY Proof of posting and publication notice of a public hearing to consider the rezoning of Parcel No . 50 -1 -4 . 2 , 16 . 75 acres at 122 Troy Road , Ithaca , New York , owned by Ruth Lacy , from R-30 District to R-15 District , having been presented by the Town Clerk , the Supervisor opened the public hearing . Mrs . Ruth Lacy stated that she wished to have the property rezoned as she would like to sell some of the lots . Town Engineer Fabbroni noted that the property has both water and sewer available , and the Board ' s policy has always been to rezone any area with water and sewer to R-15 from R-30 . Mr . Phiroze Mehta , 102 Troy Road asked , what is an R-15 District? Town Engineer Fabbroni responded , in an R- 15 District the lot sizes are 100 ' x 1501 . In an R-30 District the lot size requirements are 150 ' x 2001 . Supervisor Desch added , the primary reason for the R-30 District was to have room for water and sewer onsite (well and septic tank) . ® Mr . Mehta asked , are we talking about rezoning for size or use? Town Engineer Fabbroni responded that the size of lots are less flexible in an R-15 District , Mr . Mehta responded that he was concerned , you are talking about 16 acres of land . fie went on to say that he could envision a lot of lots and a lot of houses . Town Board 17 June 10 , 1985 Town Engineer Fabbroni responded , the land can be subdivided but it ' s not always sold . Beacon Hills is a good example . The Northview area is very comparable , you are almst surrounded by an R-15 District and you don ' t even realize it . Mrs . lacy remarked we are only considering a 7 acre portion of the land . A 6 acre lot , toward Ithaca College , will be subdivided into 5 lots , all will be an acre plus . As no one else present wished to speak , the Supervisor closed the public hearing . RESOLUTION NO . 118 ® Motion by Councilwoman Raffensperger , seoonded by Councilman McPeak , RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes the rezoning of Parcel No . 50 - 1 -4 . 2 , 16 . 75 acres at 122 Troy Road , Ithaca , New York , owned by Ruth Lacy , frcm R-30 District to R- 15 District . (Desch , Kugler , Raffensperger , Cramer , McPeak , Howell and Bartholf voting Aye . Nays - none) . PARK LANE EXTENSION PROPERTY RIGHTS Town Engineer Fabbroni stated that this project involves 1200 ' of road , one-half of which is on the property of Barbara Quick . This is also part of a three-party agreement authorized by the Board at the May 13th meeting . There will be no expense for the Town , as the owner is willing to give a fee simple deed for the road frcm Frandsen property to its intersection with the Slaterville Road , approximately 3 / 4 of a mile to the east of Pine Tree Road . The project will also include storm sewerage for the lower 300 feet of the roadway , when the agreement is finalized . ENVIRONMENTAL ASSESSMENT RESOLUTION N0 , 119 Motion by Councilman McPeak ; seconded by Councilwoman Howell , RESOLVED , that the Town Board of the Town of Ithaca after review of the Short Environmental Assessment Form for the Park Lane Extension project , declares the the proposed action will not have a significant environmental impact , i . e . , is a negative declaration . ( Copy attached to minutes) . Councilwoman Raffensperger stated that she had received a telephone call pertaining to the project , which she reported to the Supervisor . She asked if the people in Eastern Heights were notified that the Board would be taking action tonight ? Supervisor Desch responded no , neither were the people on the Slaterville Road notified . Basically , the proposed road has been shown on the original approved East Heights Subdivision Map and the adopted 1968 Official Highway Map , Councilwoman Raffensperger stated that the Board has contacted People in the Eastern Heights Civic Association in the past and these people should have been informed of our upcoming discussion Of the Environmental Assessment Form. Town Board 18 June 10 , 1985 Supervisor Desch responded that the Planning Board had held at least two meetings where Park Lane was discussed , plus the Town Board ' s discussions . (Desch , Kugler , Cramer , McPeak , Howell and Bartholf voting Aye . Nays - Raffensperger ) . Councilwoman Raffensperger stated that she was voting no because she felt notice should have been given to the area residents . RESOLUTION NO . 120 Motion by Supervisor Desch ; seconded by Councilman Cramer , ® WHEREAS , the Town Engineer has reached an informal understanding with Barbara P . Quick for a transfer of lands to the Town (a portion of 6 -56-3-26 . 2 ) required for the Park Lane extension to Slaterville Road , NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of Ithaca to formally approve a land transfer together with any abstract updates and surveys which will be provided by the Town including costs of closing , contingent upon execution of the related three-party agreement authorized by the Town Board on May 13 , 1985 , and FURTHER BE IT RESOLVED , that the Town Engineer and Town Attorney proceed to develop the formal terms and conditions of offer , access to property , considerations if any , property search , and closing for the Town Supervisor ' s signature . (Desch , Kugler , Cramer , McPeak , Howell and Bartholf voting Aye . Nays - Raffensperger ) . Councilwoman Raffensperger again stated that she voted no because the representatives of the Eastern Heights Civic Association were not notified that the Board would be taking action on this proposal . HOSPITAL ENTRANCE ROAD Town Engineer Fabbroni shaved the Board a map of the new proposed alternatives for a proposed access road into the hospital . He went on to say that the new Hospital Board was not as interested in the buildings as was the other board . There is quite a difference of opinion on the two alternatives , however , as the Paleontological Research Institution has mounted a world wide campaign against one of the alternates . He went on to say that the hospital would not stand in the way of the new alternatives . In 1983 , the Planning Board approved an extension to the Professional Building Complex and a $ 25 , 000 escrow account was established for a second access road . Lake Shore West was also to ® make access into their property a part of their proposal and the Planning Board asked Lake Shore West to put up a like amount . Of course , the Lake Shore West project did not materalize . Now the Community Hospital has come along with a proposal to remove "C" wing and add more tiered parking , all of which are to be served off the new access road . The resolution . calls for the Tompkins Comrnanity Hospital to put $ 25 , 000 in. escrow the same as the Professional Building developers were required to do . He went on to say that the Town would assume responsibility and ownership of the prime road . Town Board 19 June 10 , 1985 Supervisor Desch remarked that the first phase of the road ( the small section ) could be constructed in 1985 . Town Engineer Fabbroni responded that is correct . If one or more of the private parties would take the initiative it would be easier for the Town . Supervisor Desch remarked that the Town was taking the initiative by coordinating the road plan . RESOLUTION N0 . 121 Motion by Councilman Kugler ; seconded by Councilman McPeak , ® WHEREAS , Site Plan review by the Planning Board on April 16 , 1985 , and Special Approval by the Zoning Board of Appeals on April 17 , 1985 , both require the Tompkins Camtunity Hospital to prepare a $ 25 , 000 . 00 escrow account in a form and manner satisfactory to the Town Engineer and Town Attorney for the construction of an alternate access road west of the existing upper tier of parking to serve the Hospital expansion with a connecting drive , NOW TM�EFORE BE IT RESOLVED , by the Town Board of the Town of Ithaca that the Town Engineer and Town Attorney proceed to prepare or review an agreement that controls a $ 25 , 000 . 00 escrow account in such a manner that : ( 1 ) The Town has immediate access to the funds for the propose intended . ( 2 ) The amount is fully secured in an account from which only the Town may release unused funds . ( 3 ) The funds are available for the intended purpose whether or not the improvement is effected by a public or private project . ( 4 ) The scheduling of the improvement is timely to the Town and the Tompkins Community Hospital . ( 5 ) The Town Attorney with approval of the Town Supervisor has the opportunity to protect the Town interests by any other reasonable conditions that may be in order . ( Councilman Cramer left the meeting before the vote ) RESOLUTION NO , 122 Motion by Councilwoman Raffensperger ;. seconded by Councilman Bartholf , . .WHEREAS , the Site Plan approved by the Planning Board for an addition - to the Tompkins County Professional Building , Inc . , buildings May 17 , 1983 , and , the Site Plan approved by the Planning Board April 16 , 1985 , and the Special Approval approved by the Zoning Board of Appeals April 17 , 1985 , for an addition to the Tompkins Community Hospital building , each envisioned an alternate access to be constructed somewhere west of the existing upper Hospital service drive and upper parking tier , and Town Board 20 June 10 , 1985 WHEREAS , the Town Board has reviewed the concept with general favor that , if the Town could coordinate improvements to effect a new access road , the portions of the new access improvement that are common and not part of private drives serving the individual users might be accepted as a Town Highway , and WHEREAS , Tompkins County might be interested in adding to the $ 50 , 000 . 00 escrow amount already secured for construction of an alternate access if the access road were extended farther north to improve the parking circulation for the remaining Biggs Building , NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of Ithaca that the Town Engineer be directed to prepare a preliminary engineering concept of location , acquisition , cost , and feasibility ® for future consideration of Town engineering and construction coordinating roles in effecting an alternate access road . WEST SHORE WATERMAIN FEASIBILITY STUDY Town Engineer Lawrence Fabbroni stated that the most direct way to service the West Shore area with water was to hook on at Cass Park and then run the lines out the West Shore . He went on to say that an alignment along the mid-shelf may be the most feasible approach , however , there are two alternatives and more study is needed . Town Supervisor Desch asked how far do we have to go into the City to hook up to the Cass Park line ? Town Engineer Fabbroni responded , about one-half mile , the line is somewhere in the area of the Hanger Theater . The other question we need to resolve is what size line . Councilman Kugler asked , what pressure will you achieve ? Town Engineer Fabbroni responded very satisfactory pressure , at least 40 pounds and 80 pounds down by the lake . Town Supervisor questioned the possibility of extending sewer at the same time . Town Engineer Fabbroni responded that he would need to talk with John Andersson of the Tompkins County Health Department . He went on to say that more research needs to be done on ' extending the sewer . This will not be an easy project but a worthwhile project . We have houses with 50 ' lots and no place to go with replacement septic systems . The Town Engineer stated that he was prepared to goahead with the next phase of the feasibility study if the Board wanted him to do so . i Supervisor Desch asked the Board if they were comfortable with the ® Town Engineer going ahead with the feasibility study : Councilman McPeak stated that he felt there was a need to extend the sewer line also , if possible . The County Board of Representatives has provided $25 , 437 of matching funds for the Municipality ' s work under the County ' s Program Plan to Reduce the Impact of Flooding .
