Smith Supervisor Dietrich called the meeting to order at 6 : 30 p .m . and led all present to the Pledge of Allegiance to the American flag. Additions and Deletions to Agenda : 1 . Councilperson Beavers asked that interviews for the vacancy on the Planning Board be scheduled to take place the first half hour of the Agenda Meeting and the Town Board meetings in July. Privilege of the Floor Councilperson Beavers reported that he understands that there are problems with Round A of the proposed zoning changes . He asked if our Town Attorney could look at the proposed regulations and the response from Tompkins County Planning Department so that this can move along. Town Clerk asked the Board to consider scheduling the July Agenda meeting for Wednesday, July 5 , 2006 at following interviews of persons interested in filling the planning board vacancy. Highway Department - Tracy White reported that the Highway Department will be closed from June 30 to July 10 for summer vacation. Supervisor Dietrich said that he is going to request an executive session of the board tonight . The Town Clerk reported that the Danby Pirates Club may come and request the board to authorize the Fire Chief or the Town Supervisor to issue a permit to hold fireworks . Communications Received TCOMA Meeting Notice Letters of interest - Planning Board Vacancy County Facilities and Infrastructure Meeting Notice Recreation Partnership By-Laws Letter from Geraldine Fredricks - objecting to Bailey Homes Proposal (Read to the Board) Request for Special Meeting of the Town Board The Code Enforcement Officer made a request for a special meeting of the town board to be held on Monday, June 19 , 2006 at 6 : 30 . The purpose will be to review additional proposals for the Highway Garage Remediation Project . Special Meeting was scheduled by the board. 74 2 Town Board Minutes June 12 , 2006 Members of the Public Lisa Trent - is not in favor of the zoning change for Bailey Ronda Roaring - asked the Town Board to consider posting the names and a small bio of applicants interested in filling the vacancy on the Planning Board. REPORTS; County Representative Report : Representative Frank Proto reported on the following : Tompkins County Prescription cards are available at pharmacies and left a few with the Town Clerk. West Nile Virus - conditions may be prime this summer. Danby Youth Tom Schwartz was the recipient of the Tompkins County Distinctive Youth Award . Sampson Air Force/Navel Base may become a Vets cemetery. He encouraged the Town go consider applying for a Veterans Exempt for our veterans . Danby has received a Beautification Grant from Tompkins County E-11 Emergency Action Plan has been adopted by the County EMC - No Report Highway Report - Written report for May received . Councilperson Nolte asked that the Highway Department attach load tickets for gravel to their vouchers submitted for payment . Zoning - Written report for May received. Planning Board - Sue Beeners reported that at the last Planning Board meeting Danby Rural Cemetary Application and a small subdivision on Comfort Road were approved. They also had an update on the White Hawk Eco Village project . Beautification Committee - have planted a few trees but there was no report. Recreation Partnership - The Board has received copies of the By-laws . They will be doing a power point presentation at the Tompkins County Officials Municipal Association meeting on June 20, 2006 . Senior Citizens - held their monthly meeting on June 1 , 2006 at 6 : 00 p .m . and were entertained by the "Crane Hill Trio". The July meeting will be their annual picnic . Dog Control - SPCA report for May received. Fire District - No report . Task Force - are working on a Right to Farm Law . Supervisor Dietrich reported that plans have been made for the painting/staining of the gazebo to be done within the next two(2) weeks . Martin Kelly approached the Town Board with a request that the Board appoint either the Fire Chief or the Town Supervisor as a person who can issue a fireworks permit. He has researched the New York State Law and the regulations the Town Board designates the person to issue permits . Tompkins County Review of Round A - Subdivision Revisions Councilperson Beavers asked that the letter received from Tompkins County Planning and copies of the Round A - Subdivision Revisions be sent to the Town Attorney for review and advise . Councilperson Beavers requested the Board to set dates for interviews of applicants who are interested in appointment to fill the Planning Board vacancy. Three(3 ) at 6 : 30 the beginning of the Agenda Meeting on July 5 , and three(3 ) at the beginning of the Town Board Meeting on July 10 . 75 3 Town Board Minutes June 12 , 2006 Motion to Address the Tompkins County Planning Department Review of Review of Round 2-A Subdivision Revisions A motion was made by Supervisor Dietrich and seconded by Councilperson Beavers that the Town Board of the Town of Danby authorizes the Town Supervisor and the Code Enforcement Officer proceed with the Town Attorney and to submit a letter to Tompkins County Planning Department regarding their review of Round 2 -A of the proposed Subdivision Regulation revisions . A roll call vote on the motion resulted as follows : (Councilperson Varona-Lacey absent) Beavers Aye Nolte Aye Salino Aye Dietrich Aye Carried Motion to Schedule Interviews for Planning Board Applicants A motion was made by Supervisor Dietrich and seconded by Councilperson Beavers that the Town Board of the Town of Danby schedule three(3 ) interviews of Planning Board Applicants for 6 : 30 p .m. on July 5 , and three(3 ) at 6 : 30 on July 10 . The first half hour of each meeting will be for interviews . A roll call vote on the motion resulted as follows : (Councilperson Varona-Lacey absent) Beavers Aye Nolte Aye Salino Aye Dietrich Aye Carried Petition - Reclassification of a Portion of Curtis Road RESOLUTION NO. 59 OF 2006 - REGARDING A PETITION FOR RECLASSIFICATION OF A PORTION OF CURTIS ROAD By Supervisor Dietrich: Seconded by Councilperson Beavers WHEREAS, this action is to consider to the petition of Lee Shurtleff, Director, Tompkins County Department of Emergency Response, on behalf of Tompkins County, which letter of petition requests that a portion of Curtis Road of approximately 900 feet in length be reclassified from minimum maintenance (seasonal use) to year-round use, for the purpose of allowing access to the County Public Safety Communications System tower on Curtis road; with the cost of improvements to upgrade the subject road portion proposed to be funded by Tompkins County; and WHEREAS, this is an Unlisted Action for which the Town Board is acting as Lead Agency in environmental review ; with no other involved agencies having been identified; and WHEREAS, the Town Board on June 5 , 2006 , has held a public hearing to consider the petition; and WHEREAS, the Town Board has heard the report from the code Enforcement Officer that the property owners adjoining the subject road portion have reached agreement with the County on the location of the upgraded road bed; NOW, THEREFORE, IT IS RESOLVED, that the Town Board of the Town of Danby expresses its intent to proceed with reclassification of said seasonal use portion of Curtis Road, and to approve the upgrading of said road portion by Tompkins County, subject to subsequent requirements as required by law, and as subject to the following provisions . 1 . Submission of an Agreement satisfactory to the Town Supervisor, Town Highway Superintendent, and Town Attorney related to the terms and conditions under which the County will upgrade the subject road portion, at its own expense, including paying the costs to the Town of review of the project by the Town Attorney and the Town ' s Consulting Engineer. Said Agreement shall also contain provisions obligating the County to repair any damage done to existing roadways as a result of development of the tower site. 76 . 4 Town Board Minutes June 12 , 2006 2 . Enactment of a Local Law reclassifying said road portion from minimum maintenance (seasonal use) to year-round use. A roll call vote on the resolution resulted as follows : (Councilperson Varona-Lacey absent) Beavers Aye Nolte Aye Salino Aye Dietrich Aye Carried Bailey Homes Re-Zoning Proposal - 1850 Danby Road A public hearing was held on Monday June 5 , 2006 for the Bailey Homes Re-Zoning proposal for a . 38+/- acre parcel adjacent to the Lane ' s Automotive Property. The request is to re-zone that small parcel to Commercial Zone "C " to be annexed to the property at 1850 Danby Road Lane ' s Automotive) . Councilperson Nolte asked if the Board does not approve of the re-zoning what will happen to the project . Councilperson Beavers said that he could continue with the project on the existing land and do everything that was proposed. All he is doing is debating that section of land. Supervisor Dietrich said that all of the people who might be interested in the project did not get the information and that they may reside outside of the 500 foot perimeter requirement for notification . The Town Clerk presented the list of property owners who were notified for the Planning Board and the Town Board public hearings . Notices were sent for both hearings to the same property owners . All public hearings are noticed in the Ithaca Journal Legals and posted on the Clerk ' s bulletin board and in the meeting room. All proposals may be viewed at the Clerk ' s office during regular office hours. Susan Beeners asked if the Town Board was officially adjourning decision on the re-zoning of 1850 Danby Road pending the following : that Town send notice that the Town will send notice (Notice by Mail) to the neighboring property owners that the Town Board will listen to concerns from those not present at the public hearing for the Bailey Homes Proposal for the re-zoning of . 38+/- acres adjacent to the 1850 Danby Road (Lane ' s Automotive) property on July 10, 2006 at 7 : 00 p . m . After discussion the Board adjourned decision on the Bailey Homes proposal to the July Meeting of the Board on Monday July 10, 2006 at 7 : 00 . Notice of adjourned decision will be sent to the "Notice by Mail" listing. Motion to Move to Executive Session A motion was made by Supervisor Dietrich and seconded by Councilperson Beavers at 7 : 40 p . m . that the Town Board of the Town of Danby enter into an executive session of the Board to discuss a certain personnel issues within the highway department. A roll call vote on the motion resulted as follows : (Councilperson Varona-Lacey absent) Beavers Aye Nolte Aye Salino Aye Dietrich Aye Carried Town Board Meeting Reconvened The Board Meeting reconvened at 8 : 35 p .m . 77 5 Town Board Minutes June 12 , 2006 Motion to Extend Board Meeting A motion was made by Councilperson Salino and seconded by Councilperson Nolte that the Town Board of the Town of Danby extend the board meeting to 9 : 00 p . m . A roll call vote on the motion resulted as follows : (Councilperson Varona-Lacey absent) Beavers Aye Nolte Aye Salino Aye Dietrich Aye Carried RESOLUTION NO. 60 OF 2006 RESOLUTION FOR THE TOWN OF DANBY HIGHWAY SUPERINTENDENT TO ENTER INTO SHARED ARRANGEMENTS WITH OTHER MUNICIPALITIES TO BORROW OR LEND MACHINERY, EQUIPMENT, SUPPLIES AND SERVICES By Supervisor Dietrich : Seconded by Councilperson Nolte WHEREAS, all municipalities, including the Town of Danby, have the authority under New York Highway Law Sections 142 -d and New York General Municipal Law Article 5 -G to contract with other municipalities to exchange, borrow, lend or maintain machinery and equipment, with or without operators ; and WHEREAS , all municipalities, including the Town of Danby, have the authority under New York Municipal Law Article 5 -G to borrow materials and supplies from and lend materials and supplies to other municipalities ; and WHEREAS, the Town of Danby and other municipalities in Tompkins County have machinery and equipment that are not used during certain periods ; and WHEREAS, the Town of Danby and other municipalities in Tompkins County often have materials and supplies on hand that are not immediately needed; and WHEREAS, the Town of Danby and other municipalities may avoid the need to purchase or store certain needed highway machinery and equipment and a large inventory of certain extra materials and supplies, and thereby save the taxpayers money, if the municipalities can contract with each other to exchange, borrow, lend or maintain these items ; and WHEREAS , the Town Board determines that it is in the best interests of the Town of Danby to engage in such shared arrangements ; and WHEREAS , many of the municipalities in Tompkins County are developing a standard contract that will authorize the highway superintendents to engage in such shared arrangements with other municipalities ; and WHEREAS, pending the finalization of the standard contract, the Town Board ofthe Town ofDanby wishes to authorize the Town of Danby Highway Superintendent to engage in such shared arrangements ; THEREFORE BE IT RESOLVED, that the Town Board of the Town of Danby authorizes the Town of Danby Highway Superintendent to engage in such shared arrangements with other municipalities (including Tompkins County) , provided that ( 1 ) the machinery, equipment, supplies and services the Town of Danby provides another municipality are not immediately needed by the Town of Danby, and the Town received equivalent machinery, equipment, supplies and/or services from that municipality, (2) the Highway Superintendent shall maintain written records of the machinery, equipment, supplies and services that are exchanged, borrowed, lent or maintained and shall periodically update the Town Board on such matter, and (3 ) the Town shall maintain sufficient insurance coverage to protect the Town in such joint efforts ; and 788_ 6 Town Board Minutes June 12 , 2006 BE IT FURTHER RESOLVED, that once the standard contract is approved by the Town Board and the Town enters into written contracts with other municipalities for such shared arrangements, the Highway Superintendent ' s authority to enter into such shared arrangements shall be governed by the terms of the written contracts . A roll call vote on the resolution resulted as follows : (Councilperson Varona-Lacey absent) Beavers Aye Nolte Aye Salino Aye Dietrich Aye Carried RESOLUTION NO. 61 OF 2006 RESOLUTION FOR THE TOWN OF DANBY HIGHWAY SECRETARY TO WORK ADDITIONAL HOURS ON THE HIGHWAY GARAGE REMEDIATION PROJECT By Councilperson Nolte : Seconded by Supervisor Dietrich WHEREAS, the Town of Danby Highway Department Secretary be allowed to work additional hours above and beyond her normal Highway duties on the Highway Garage Remediation Project ; and WHEREAS, the Town of Danby Highway Secretary will separate her time accordingly on her timesheet ; and WHEREAS, the Town of Danby Highway Secretary will charge her time regarding the Highway Garage Remediation Project to A5010 . 111 , NOW, THEREFORE, IT IS RESOLVED, that the Town Board of the Town of Danby accepts said proposal as it is written. We need to get the Town of Danby package in order. He has been in contact with them to review all the Jennings Pond job descriptions and notification . There are new rules and regulations and the pond job descriptions need to be created . RESOLUTION NO 62 OF 2006 CREATION OF JOB DESCRIPTION (PT. SEASONAL) By Councilperson. Nolte : Seconded by Councilperson Salino TOWN OF DANBY JOB DESCRIPTION - RECREATION SUPERVISOR JENNINGS POND DISTINGUISHING FEATURES OF THE CLASS A Recreation Supervisor is responsible for planning, organizing and administering all aspects of a 79 7 Town Board Minutes June 12 , 2006 recreation program for a town or village . The supervisor may be required to spend some time in a leadership role for a particular program or activity. Supervision, either direct or general, may be exercised over the work of all subordinate personnel . The incumbent will perform all related duties as required . TYPICAL WORK ACTIVITIES : Administers the recreation program for specific municipality; Plans, organizes, promotes and directs recreation activities and events ; Supervises, trains and evaluates the work of all subordinate staff; Supervises and assists with the maintenance of facilities and equipment; Publicizes the activities of the recreation program ; Represents the recreation program at meetings with community organizations ; Prepares and presents special reports regarding the needs of the program and effectiveness of services provided; May conduct a program at a recreation center or physical facility; Makes arrangements for socials, dances , tournaments , special events , story-telling sessions, dramatics, parties, etc . ; May assist with the officiating at athletic events ; May assist with the chaperoning of trips and other group activities ; May assist in the instruction of children in games, sports , arts and crafts, dancing, singing, dramatics, etc . ; May supervise the conduct of children ' s games and maintains order; Keeps records of attendance, activities, equipment, etc . ; Makes up schedule for sports and special events ; May operate a videocassette player; May distribute and collect equipment ; Maintains and prepares courts, fields, facilities, etc . ; Maintains order and enforces rules and regulations ; Assigns courts and other facilities ; May perform routine custodial and maintenance tasks ; May operate power mowers and other ground equipment. FULL PERFORMANCE KNOWLEDGE, SKILLS , ABILITIES AND PERSONAL CHARACTERISTICS : Good knowledge of the principles and practices involved in administering a town or village recreation program ; Good knowledge of the recreation needs of the community; Good knowledge of the principles and practices of supervision; Ability to plan, organize and promote a variety of recreation activities ; Working knowledge of the principles and practices of budgeting ; Ability to assess program needs and accomplish goals within the confines of available resources ; Ability to communicate effectively, both orally and in writing, with groups and individuals ; Good problem solving skills, tact, courtesy and good judgment are required ; Physical condition commensurate with the demands of the position. SEASONAL) By Supervisor Dietrich : Seconded by Councilperson Nolte TOWN OF DANBY LIFEGUARD (PT. SEASONAL) DISTINGUISHING FEATURES OF THE CLASS : This is routine patrol work consisting primarily of patrol tasks performed under direct supervision. Conducts swimming instructions and water safety classes as assigned. Employees in this class must be constantly alert to assist swimmers when they are in difficulty and to enforce safety rules . An error in judgement might result in loss of life. Performs routine patrol work at a pool or bathing beach, looking after the safety and welfare of others . Work is performed under the general supervision of the Swimming Area Director. Does related work as required. TYPICAL WORK ACTIVITIES : Stands watch at pools and/or patrols the park waterfront, keeping bathers within bounds and going to their aid when they are in difficulty; Applies resuscitation techniques and otherwise renders first aid ; May conduct beginning and advanced swimming and diving classes ; Keeps locker rooms poolside and beach areas free of glass and other debris ; Maintains order and enforces safety rules ; Performs other routine duties such as maintaining and repairing equipment . FULL PERFORMANCE KNOWLEDGE, SKILLS, ABILITIES AND PERSONAL CHARACTERISTICS ; Good knowledge of first aide, lifesaving and rescue work as applied to accidents in the water; good knowledge of current methods used in swimming and diving instruction; ability to swim well ; ability to deal effectively with the public and others and to secure their cooperation; ability to keep records and make simple reports ; good powers of observation ; mental alertness ; integrity; excellent physical condition commensurate with the demands of the position . MINIMUM QUALIFICATIONS : Completion of two years of high school . SPECIAL REQUIREMENTS FOR ACCEPTANCE OF APPLICATIONS : Eligibility for Red Cross Lifeguard Training certification . Possession required at time of appointment . NOTE : To be eligible to conduct swimming and water safety classes a Lifeguard must possess a Red Cross certification as a safety instructor or as a instructor of beginning swimming. ROUTE 96B FOR PARADE ON JULY 15, 2006 By Supervisor Dietrich : Seconded by Councilperson Salino RESOLVED, that the Town Board of the Town of Danby, in compliance with Section 1604 , Paragraph 2, of the Vehicle and Traffic Law, which authorizes a Town to close a road for a Parade, is officially closing New York State Route 96-B on Saturday, July 15 , 2006 , from 10 : 30 a.m. until 11 : 55 a. m. , from the intersection of East Miller and West Miller Roads to the intersection f Bald Hill Road; and it is FURTHER RESOLVED, that the Town Board of the Town of Danby approves the extension of this time period from 10 : 15 to 12 : 15 p . m . , if the Danby fire Department deems such extension necessary to facilitate the safe movement of the Parade participants ; and it is FURTHER RESOLVED, that there will be a detour route from the West Miller Road intersection with Route 96-B to Comfort Road, to Lieb Road, to Bald Hill intersection with Route 96-B . A roll call vote on the resolution resulted as follows : (Councilperson Varona-Lacey absent) Beavers Aye Nolte Aye Salino Aye Dietrich Aye Carried Motion For Assistance From Highway Department for Parade A motion was made by Supervisor Dietrich and seconded by Councilperson Salino that the Town Board of the Town of Danby supports the parade in any possible with assistance to the parade committee with installing signs ("Road Closed for Parade") on temporary stands and dropping off arrow and detour signs and barricades and cones in designated locations and picking them up after the parade . A fireworks permit can only be issued by a Mayor (Supervisor) or Fire Department Official . Susan Beeners suggested that the Town Board designate Fire Chief Gaden or a designee appointed by him as the person to issue "Fireworks Permit". Motion to Designate Fire Chief John Gaden or Designee to Issue Fireworks Permits A motion was made by Supervisor Dietrich and seconded by Councilperson Beavers that the Town Board of the Town of Danby designates Fire Chief John Gaden or his designee to issue appropriate permit for fireworks in the Town of Danby. The purpose of the meeting will be to review the initial proposals for the Highway Garage Remediation Project. The Board approved of the Special Meeting but no vote was taken. Susan Beeners reported that there is an additional item to be added to the General Fund Warrant in the amount . There is an additional voucher from ERM in the amount of $ 15 ,253 . 06 and to be charged to A1442 . 400 . Approval of the Supervisor' s May 2006 Report A motion was made by Councilperson Salino and seconded by Councilperson Nolte that the Town Board of the Town of Danby approves the Town Supervisor' s Report for May 2006 as submitted.
