REGULAR BOARD MEETING
May 13 , 1985
At a Regular Meeting of the Town Board of the Town of Ithaca ,
Tompkins County , New York , held at the Town Offices at 126 East
Seneca Street , Ithaca , New York , at * 6 : 30 P .M. , on the 13th day of
May , 1985 , there were :

The Supervisor led the assemblage in the Pledge of Allegiance .
REPORT OF TOWN OFFICIALS
Supervisor ' s Report
BAN Renewal - Ithaca Area Wastewater Treatment Plant
Supervisor Desch stated that on May 23rd , Dominic Cafferillo and he
would be going to New York City to open bids on the renewal of
$ 10 , 000 , 000 of the existing $ 131500 , 000 notes . The amount is
reduced as a result of the EPA reimbursements on work already
acccnnplished , as we saw at the plant site this evening . The
closing will also be in New York City on May 30th , at the Signature
Company . We are expecting excellent borrowing rates . He went on
to say that there was a good chance that we may get Federal
Reimbursement on the Lake Monitoring which will also reduce our
total local share by $ 130 , 000 .
® Personal Use of Town Vehicles
Supervisor Desch noted that there is a new IRS policy on use of
employer owned vehicles for commuting between home and job sites .
The policy indicates that such use constitutes additional
compensation and must be recorded as such . We are seeking more
information on this so that our policy can be established .
Route 96
Town Board 2 May 13 , 1985
The Supervisor stated that he was very pleased to report that one
of the major question marks and potential stumbling blocks on the
Route 96 project has been removed . We are very pleased that the
Tompkins Community Hospital Board has gone on record urging the
community to support the construction of the new road up West Hill
and assuring cooperation with Town , County and State to work out
the details of the highway through hospital property . The
Supervisor went on to say that we have some excellent video tape of
the aftermath of the Octopus accident . We also have some excellent
tapes of the congestion during the peak hour situation .

® We are getting a good response to our inquiry as to sewer and water
extensions . As might be expected , many of the property owners on
West Haven who do not have sewer would like it .
Town Engineer ' s Report
A written report from the Town Engineer is attached to the Minutes .
He went on to highlight his report by saying that the contractor
for the Phase II water contract started work a week after the last
Board meeting and that the properties on West Hill could now hook
up to water . The Phase I contractor is now on site and cleaning up
Phase I . He went on to say that there were a number of resolutions
to be considered this evening , in conjunction with his report . One
being an agreement to relocate Sand Bank Road along the new
playfields in conjunction with State Parks and County . The old
bridge would be abandoned . Town Engineer Fabbroni noted that the
Burns Road project was the most active project . Mr . Fabbroni noted
that there had been a lot of interaction with residents on West
Hill because of the dust related to the water project .
Supervisor Desch remarked that if the drought forecast was
accurate , people will be happy to get water .
Town Engineer Fabbroni responded , there are still ten or so who
remind us of dust , on a day to day basis .
Supervisor Desch remarked that he had promised Mary Robertson to
find her a rock so now we have the best opportunity to do it .
Highway Superintendent ' s Report
Highway Superintendent Robert Parkin stated that he had nothing to
add to his written report , which is a part of the Town Engineer ' s
report .
REPORT OF COUNTY REPRESENTATIVE
County Representative Mary Call reported that the County had
renewed their contract with Northeast Transit . She went on to say
that with money from Tioga County , that they had not used , the
Caravan would continue their run out that way . This will have an
effect on the Town residents who live in that direction . The
County has appropriated $25 , 000 for the Youth Program which will
enable the employment 166 youths . Mrs . Call went on to say that
the Jail was in the design stages . The Flood Control Project came
through the B & A Committee today and will go before the full Board
on May 21st . The Town of Ithaca will receive $ 10 , 000 . The Board
is trying to finish up projects that were started , therefore , she
expected the project would pass the Board without any problems .

Ms . Beeners went on to highlight her report by saying that they
would try to cut costs by using used material where ever possible .
Cornell will assist in paying for the Graphic Arts Trail plus
taking over the liability . In Eastern Heights Park they propose to
finish the parking area and driveway from Tudor Road plus restore
the five parking spaces along with completing the drainage ,
playfields , blacktopping the trail into the woods , landscaping
improvements , more seeding and install nature trail signs . The
Village of Cayuga Heights did not accept the original design of the
Pleasant Grove Road Recreation Way . The Village is now designing a
six foot detached path along the side of the road along with
partial road relocation .
Ms . Beeners continued , we propose to topdress certain areas of the
playfields and cut brush at the Cayuga Heights Ccmnunity Center ,
Forest Home Walkway , complete steps , paint and landscaping . The
Town would assume responsibility for the playfields at the
Coddington Road CCMmunity Center and then designate them as Town
playfields . The playfields will not to be topdressed , repairs made
to the fence , sand for the sandboxes and clean up the area where
the new well was dug . Additional work on restoring the vegetation
® for the Burns Road Phase I project , then the seeding of Phase II
when it is completed . We will be doing maintenance and making
repairs around the pump stations , a continuation of last year .
Also , the inspection of the water line project for plantings
restoration after the contractor has completed his work . We will
not be able to do any of the work , that was budgeted for the Inlet
Valley Park below the first ladder this year . Ms . Beeners went on
to say that a budget amendment may be needed to accomplish the work
on the driveway and parking area at the Eastern Heights Park . She
mentioned that she was hoping to obtain information on historic
buildings and plantings that could be historic landmarks .

Town Supervisor Desch asked Ms . Beeners if she was coming back for
approval of the Eastern Heights Park project or are you asking for
authority to move ahead ?
Town Engineer Fabbroni responded , we need to have the program
approved , then we will come back for budget amendments if
necessary . We are looking for your approval for the work program .
Supervisor Desch remarked that it would be necessary to come back
to the Board for approval of the Cayuga Heights Walkway .
RESOLUTION NO , 77
Motion by Supervisor Desch ; seconded by Councilman Cramer ,
RESOLVED , that the Town Board of the Town of Ithaca hereby approves
the 1985 Parks Work Plan as presented , and
FURTHER RESOLVED , that if the need arises for budget amendments ,
they will be presented to the Board at a later date , and
FUR'T'HER BE IT RESOLVED , that upon the completion of the design , by
the Village of Cayuga Heights , of the Pleasant Grove Road
Recreation Way this proposal will require Town Board approval .
Councilman Cramer questioned the $18 , 000 budgeted for the Inlet
Valley project .
Town Engineer Fabbroni responded that the problem is with the
City ' s purpose of the property . He went on to say that they would
be coming back to the Board , in the fall , to ask that the funds be
carried over for a more aggressive completion in the 1986 .
Susan Beeners stated that the City was talking about appointing a
committee to review the whole project and that she had been asked
to help with the review .

GRAPHIC ARTS BIKEWAY LICENSE
Susan Beeners gave a brief history of the Town ' s East Ithaca
Recreation Way section between Maple Avenue and Game Farm Road
which was completed last summer and has become a popular route for
Town residents and the Cornell Community . Major users of the trail
are commuters who walk or bike to campus , runners , and riders on
horse from the Cornell Polo facilities . A three foot cinder path
was constructed adjacent to the five foot oil and stone trail from
the former railroad bridge over Judd Falls Road to Game Farm Road ,
at the request of the manager of the Oxley Polo Arena , who has
agreed to assume maintenance of that path .
An extension of this trail from the railroad bridges to the
® intersection of Judd Falls Road and Route 366 is clearly needed , as
evidenced by the muddy foot and horse paths which leave the trail
and cross north on the lawns of the Graphic Arts Services Building ,
The Town proposes that an eight foot trail , conposed of a five foot
wide oil and stone path , adjoined by a three foot gravel and cinder
path , be constructed from the existing East Ithaca Recreation Way
at the west end of the former railroad trestles , over lands of the
Cornell Graphic Arts Services Building to Route 366 , with the
condition that Cornell University share in financing trail
construction , supply cinders , retain liability coverage and assume
maintenance of this trail spur .

WHEREAS , the Town Board of the Town of Ithaca by resolution on
April 8 , 1985 , gave conceptual approval that the Town share with
Cornell University the construction costs to provide for the
construction of an all-weather trail from Route 366 to the East
Ithaca Recreation Way through the Cornell Graphic Arts property ,
and further resolved that the maintenance and liability for the
trail be assigned to Cornell University and legal access be given
to the Town of Ithaca ,

Ithaca , that the Town Supervisor be authorized to enter into and
execute an agreement with Cornell University , as approved by the
Town Attorney , that would provide legal access to the property and
Town construction of the trail from Route 366 to the East Ithaca
Recreation Way at a cost not to exceed $ 2 , 000 with all additional
cost , maintenance , and liability to be borne by Cornell University .

questioning Item # 7 of Local Law No . 4 , 1984 which reads "At least
one dwelling unit in each of the structures , after any conversion
as provided herein , or after a sale or other transfer of title by
Rocco Lucente or his executors or administrators , shall be
owner-occupied ; such owner , however , must qualify as a household
( or family ) as defined herein . If any such structure is sold or
title is otherwise transferred by Rocco Lucente , such new owner or
transferee of title must occupy at least one dwelling unit in any
such structure within 13 months of acquiring title , if , thereafter ,
a structure is not occupied by the owner then the structure may be
occupied only as permitted by the regulations of a Residential
District R- 15 for a two-family dwelling as if this amendment to the
Zoning Ordinance had not been adopted " . Mr . Tyler went on to say
that this paragraph does not address the question of rentals before
the sale of the property . He noted that how Mr . Lucente stands , is
not included in this paragraph . Mr . Tyler stated that Mr . Lucente
did not feel one year rental was sufficient time for him.
Mr . Tyler went on to noted that there was another issue that was
not addressed . This is a university town and facility take sabatic
leaves , maybe the rental issue should be two years out of ten
years . If the owner is forced to leave town , he would be forced to
leave the dwelling vacant while out of town . A three year period
would be optimal to get the units marketable .
Mr . Rocco Lucente stated that he was asking the Board to allow him
to do a good job converting the buildings . One or two years won ' t
® make a difference , the best job of conversion can be done in three
years . He stated that if allowed three years he could be more
fussy who he sold the property to and more fussy about finishing
the landscaping , etc .
Mr . Lucente ' s attorney Mr . Tyler noted that if Mr . Lucente were
given more time he could find buyers with larger down payments . He
went on to say that people who make larger down payments are better
persons .
Town Board 13 May 13 , 1985
Supervisor Desch noted that Mr . Lucente had three units under
construction and that there was a need for Mr . Lucente to address
the concerns of the Building Inpsector in his letter to Mr . Lucente
dated April 15 , 1985 . He asked Mr . Cartee to review the
violations .
Mr . Cartee listed the following violations :
120 Sapsucker Woods Road
( 1 ) Complete the conversion of the two-bedroom unit .
( 2 ) Provide self-closing mechanism cap fire doors from the garage
to furnace room and garage to main house .
( 3 ) Complete plantings as paer site plan .

( 5 ) Empty garage to provide parking for occupants in the
two-bedroam units .
( 6 ) The vacant two-bedroom unit shall remain vacant until such
time as the Town and your office resolve an interpretation of
Local Law # 4-1984 .

( 2 ) Complete plantings as per site plan .
( 3 ) Complete work on yard and driveway and designate parking space

Mr . Cartee went on to say that the buildings had been ccmpleted and
occupied without his knowledge or inspection . He went on to say
that as he had stated in his letter to Mr . Lucente , no building
permits would be issued for the conversion of the remaining eleven
units until the Town and Mr . Lucente resolved the interpretation of
Local Law # 4 - 1984 .
Mr . Lucente responded that he had already done quite a bit to
eliminate the violations . The garage sheds are all made and he had
purchased the closers for the fire doors .
® Mr . Cartee noted that in his discussions with Mr . Lucente he had
noticed the realtors signs .
Mr . Lucente responded that all fourteen properties had been listed .
Mr . Tyler noted that there is a good buyers market right now .
Councilwoman Raffensperger stated that she did not understand what
Portion of Local Law #4 - 1984 needed to be changed .
Town Board 14 May 13 , 1985
Town Attorney John Barney responded that under Local Law # 4 - 1984 ,
the owner has thirteen months to move into the property as
purchased . Mr . Lucente is asking that the law be changed so that
once the conversion is done he be allowed three years to rent
before sale .
Supervisor Desch responded that the questions is , under the present
law , can Mr . Lucente rent the property and for what period of time .
He noted that he felt three years was too long of a period . The
Board must decide is they want to allow Mr . Lucente to rent the
property until it is sold and if they choose to allow the rental
then for what period of time . If the Board decides to consider
allowing rentals then a public hearing will need to be scheduled .
® Mr . Lucente stated that he would like regulations ccnparable to
Conmonlands where owner occupancy is required twelve out of
thirty-six months .
Councilwoman Raffensperger asked if the Board allows Mr . Lucente to
have thirteen months rental , then is the new owner also allowed
thirteen months rental ?
Town Attorney Barney responded , that is up to the Board . You could
specify thirteen months rental after the Certificate of Occupancy
is issued .
Councilman McPeak remarked , thirteen months doesn ' t seem like a
long time . There is another apartment complex soon coming on the
market .
Supervisor Desch then appointed a committee of Councilwoman Howell
and Councilman McPeak to go through the proposals , discuss them
with staff and the Town Attorney and then report back to the Board
at the June meeting .
BURNS ROAD PHASE II
Town Engineer Fabbroni stated that he had spoken to the landowner
in New Jersey and that he was asking for fair value . He went on to
say that the Town would be getting $125 , 000 from Safer-0ff Systems
to complete the work on Burns Road . The project money comes with
strings attached , however , the Town of Ithaca is one of four
ccmTunities still receiving money . This will allow us to tie the
timing of construction with the extension of Park Lane . With fill
from Park Lane , there will be less disturbance to the land . In
soneways this improves the favor of the project , as far as the
landowner is concerned . The Town Engineer went on to say that the
Town would be doing the grading work but the State will do the
paving as the State has a higher standard for blacktop for
intersections .
Supervisor Desch asked what the total cost would be ?
Town Engineer Fabbroni responded , we estimate the total cost to be
® $85 , 000 and we will be receiving $ 125 , 000 .
Councilman Kugler asked if this included the land purchase cost?
Town Engineer Fabbroni responded no , land purchase is not eligible
for Safer-Off Systems monies .
Supervisor Desch stated that the Board needs to know if the
budgeted funds are adequate ?
Town Board 15 May 13 , 1985
Town Engineer Fabbroni responded , there is no doubt that the funds
budgeted will be adequate , infact if all goes well we should have
approximately $20 , 000 unexpended .
NYSDOT GRANT FOR BURNS ROAD PROJECT
RESOLUTION NO , 79
Motion by Supervisor Desch , seconded by Councilwoman Howell ,
RESOLUTION of the Town Board of the Town of Ithaca approving a
Federal Aid Highway Project administered by the New York State
® Department of Transportation and authorizing the municipality to
perform the construction engineering and/or the construction for
such project and authorizing the Town Supervisor of the Town of
Ithaca to execute an agreement on behalf of the municipality with
the New York State Department of Transportation for the performance
of the work of such project and for the participation by the
municipality in the non-federal share of the costs of the project .
WHEREAS , a Project for the rebuilding of Burns Road funded under
the Federal-Aid Highway Program as provided by the appropriate
sections of Title 23 U . S . Code calls for state or local
participation , and
WHEREAS , the Town of Ithaca desires to advance the project which is
not or portions of which are not on the State Highway System by
authorizing the municipality to participate in the non- federal
share of the cost of construction engineering and /or construction
of such project ,
NOW THEREFORE , the Town Board duly convened does hereby
RESOLVE , that the Town Board hereby authorizes the Town of Ithaca
to participate in the cost of construction engineering and/or
construction with its own forces , and
IT IS FURTHER RESOLVED , that this Authorization shall commit the
Town of Ithaca to an amount not to exceed $ 125 , 000 for the
construction engineering and/or construction ,
AND IT IS FURTHER RESOLVED , that the Town Supervisor of the Town of
Ithaca be and is hereby authorized to excute all necessary
agreements on behalf of the Town of Ithaca with the New York State
Department of Transportation approving of the above subject project
and providing for the municipality ' s participation in the cost of
the local share of the subject report .
Councilwanan Raffensperger asked why the resolution was committing
the Tb m to $ 125 , 000 expenditure .

Town recognizes the cost of the project .

WHEREAS , the Town Board has authorized negotiations to proceed for
the acquisition of lands necessary to construct Burns Road Phase
II , and
WHEREAS , negotiations have proceeded to the point of the Town of
Ithaca making a bona fide offer based on a sound land appraisal ,
NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of
Ithaca , that the Town Engineer be authorized to order a land
appraisal for Burns Road Phase II , such appraisal to be capable of
being updated to a formal legal appraisal should such a formal
appraisal become necessary to a future Board action .
Councilman Cramer asked what the appraisal cost would be .
Town Engineer Fabbroni responded that the first step would be a
simple appraisal and would cost between $ 250 and $ 500 . A legal
appraisal could cost up to $ 1 , 000 .

RENTAL EQUIPMENT - BURNS ROAD PHASE II PROJECT

WHEREAS , the NYSDOT funds makes total construction during 1985 a
requirement , and
WHEREAS , the Town of Ithaca will principally be constructing the
improvement with its own manpower and equipment , and
WHEREAS , the bulk earthmeving and paving requires the use of
equipment , e . g . , scrapers , large HP bulldozers , 10-wheeler dump
trucks , and road paver , not a part of the Town equipment fleet ,
NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of
Ithaca , that the Town Engineer be authorized to rent heavy
equipment as needed for Burns Road Phase II up to $25 , 000 , such
funds to be expended out of Account CF5112 . 20 .

PUBLIC-PRIVATE PARTNERSHIP - PARK LANE EXTENSION
Town Engineer Fabbroni stated that he had drafted a summary of the
points , proposed by Pine Tree Associates , into a resolution from
® which the Town Attorney would draft an agreement , if the points are
approved by the Town Board . He went on to say that about a year
ago the Board passed a resolution to install a storm sewer and that
this would becom part of the agreement .
Supervisor Desch noted that the drainage project would also
dovetail with the state project .
Town Engineer Fabbroni went on to say that the agreement would need
some refinement after Board approval is received .

Town Attorney Barney suggest Item # 8 which states "The Town of
Ithaca will , as necessary , . . . . . . . . " be changed to read "The Town of
Ithaca nay , at its option , . . . . . . . . " .
RESOLUTION NO . 82
Motion by Councilman McPeak ; seconded by Councilman Bartholf ,
WHEREAS , a proposal has been forwarded to the Town Board by William
Frandsen and the Pine Tree Associates relating to improvements in
and along Park Lane , the sun-nary of which is as follows :
( 1 ) William Frandsen will , at his cost , construct the portion of
Park Lane from its existing eastern terminus to his east
property line to Town Highway Specifications .
( 2 ) William Frandsen and Pine Tree Associates will , at their cost ,
construct the portion of Park Lane from the Frandsen east
property line to Slaterville Road , according to a design and
layout of the Town of Ithaca , across lands to be made
available for this purpose by Mr . and Mrs . Bernard Quick .
( 3 ) Pine Tree Associates will , at their cost , construct the west
end of Park Lane from Joanne Drive to new subdivision road ( s)
within the old Marion property .
( 4 ) Park Lane , as finally constituted in 1 through 3 above , will
be shown on the amended Town Master Highway Plan Map , with all
other proposed highways removed simultaneously from said Map
within Snyder Hill Road , Slaterville Road , and Pine Tree Road
boundaries . This will not limit the Town Planning Board
review over future subdivisions , in that additional highways
may be added although not officially mapped .
( 5 ) The Town Board generally endorses the subdivision plans of
Pine Tree Associates that provide access from Regency Lane and
Park Lane , and the subdivision plans of William Frandsen that
provide access from Park Lane , although the final approval and
adjustment of details of subdivision approval will be within
the jurisdiction of the Planning Board in applying the
Subdivision Regulations to these two subdivisions .
( 6 ) The Town of Ithaca will , as previously resolved , storm sewer
the drainageway along the Park Lane extension from the old
railroad right-of-way to the State . Route 79 right-of- way over
lands now part of the aforementioned Quick property to be made
available to the highway extension .
( 7 ) The Town of Ithaca will provide a culvert at the west end of
Park Lane to cover over a drainageway constructed as part of
the 1976 flood improvements west of Joanne Drive .
( 8 ) The Town of Ithaca may , at its option , make available vehicles
for the transport of spoil material from the Park Lane
construction site to Town construction site . The private
® parties will coordinate their construction with the Town
construction projects requiring this fill material , and
WHEREAS , the Park Lane construction and associated Burns Road
relocation are important to the safety of travel , emergency
response , ease of circulation in East Ithaca ,
NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of
Ithaca , that the above terms be accepted in a form acceptable to
the Town Attorney to be signed by the Town Supervisor .

® RECITALS
1 . Chapter 707 of the Laws of 1981 , commonly referred to as the
New York State Uniform Fire Prevention and Building Code Act ,
( hereafter the "Act " ) , imposes cn all municipalities in the
State of New York certain minimum administration and
enforcement standards concerning the New York State Uniform
Fire Prevention and Building Code ( hereafter the "Code " ) .
2 . The State of New York Constitution , Article 5 -G of the General
Municipal Law , and Executive Law §381 grant local governments
the power to cooperate in the enforcement of the Code .
39 Ithaca employs a full time Building Inspector .
49 Ulysses has no Building Inspector , in large part because the
number of applications for building permits in Ulysses has not
been enough to necessitate such an employee in the past .
5 . With the Act and Code in effect , Ulysses requires the
services of an inspector and wishes to avail itself of the
services of the Ithaca Building Inspector , presently Lewis
Cartee and to appoint the Ithaca Inspector as the Ulysses
Inspector . Therefore , Ulysses has requested Ithaca to provide
the services of its Building Inspector in consideration of the
agreements and provisions set forth below:
TENS
1 . Ulysses hereby appoints the Ithaca Building Inspector
(presently Lew Cartee) as the Ulysses Building Inspector to
act on certain matters in the manner set forth below .
2 . Applications for building permits in Ulysses will be on the
attached form , " Town of Ulysses Applicaticn for Building
Permit" , and willbe submitted to the Ulysses Town Clerk with
the fee as indicated cn the schedule in the application .
3 . (A) Ithaca ' s duly appointed Inspector will provide , as
limited below , the inspection services required by
Ulysses ( and agrees to accept appointment as
Ulysses ' s Building Inspector ) . His duties will be
limited solely to the issuance of Building Permits , to
review applications and plans therefore , make field
inspections , authorize issuance of Certificates of
Compliance with the Code and keeping of records , provided
that these services will be limited to permits and
certificates for new construction for which applications
for permits are made to Ulysses . It is specifically
agreed that the Inspector ' s duties do not otherwise
include inspection of existing construction , buildings
and premises .
Town Board 19 May 13 , 1985
( B) The Inspector will hold office hours at the Ulysses
offices and make field inspections as necessary between
1 : 00 P . M. and 5 : 00 P . M . , on Tuesdays and Thursdays . If
he cannot attend on either of those days because of
Ithaca duties , illness , absence frcan the vicinity , etc . ,
he will be available on another day of the week .
49 (A) The normal work week of the Inspector for the Town of
Ithaca is 35 hours . Ithaca will continue to pay such
Inspector ' s salary , fringe benefits , workmen ' s
compensation premiums , etc . To reimburse Ithaca for that
portion of the 35 hours devoted by the Inspector to the
services performed for Ulysses as particularly specified
® above , including the normal use of the Town of Ithaca
automobile by the Inspector , Ulysses will pay to Ithaca
fees for the issuance of Building Permits and
Certificates of Ccupliance in accordance with the
enclosed fee schedule . Such fee shall be paid to Ithaca
by the 15th of each month for all permits and
certificates issued the preceding month .
(B) In the event the volume of work for Ulysses requires time
in excess of two half days per week , if the Inspector can
accomplish the excess work a times other than during the
hours he is employed by Ithaca , Ulysses will reimburse
the Inspector directly for services rendered by him in
excess of the time specified in paragraph 3 above and
reasonable expenses incurred , on such terms and
conditions as Ulysses and the Inspector shall agree .
5 . (A) Ulysses represents that it has enacted , and will adopt
and keep in effect , resolutions and local laws to
idemnify its officers and employees pursuant to the
provisions of Public Offioer ' s . Law Section 18 , and that
such enactments and procedures will cover and apply to
the Inspector in the course of the performance of his
work for Ulysses . Ulysses will take whatever steps may
be necessary to assure that adoption of Public Officer ' s
Law Sections 18 procedures are kept validly in effect .
( B) Ulysses will , at its expense , defend the Inspector and
Ithaca , and its officers and employees against all claims
for damages and other liability for any act , negligence
or omission to act occurring in the course of work
performed for and on behalf of Ulysses by the Inspector
and will indemnify and save harmless the Inspector , his
representatives and heirs , Ithaca and its officers
against all such claims , damages , liability and expenses ,
including reasonable attorney ' s fees .
6 . In performing services of Ulysses Building Inspector , and
without limiting the foregoing , the Ithaca Inspector will have
and possess the same powers , duties , immunities and privileges
that he would ordinarily possess if he were employed directly
by Ulysses .
® 7 . This agreement will be effective as of November 1 , 1984 , and
shall continue until it is terminated by either party on 30
days ' prior written notice . In the event there is a vacancy
in the office of Ithaca Building Inspector , this agreement
shall be suspended until the vacancy is filled , at which time
the new Ithaca Inspector may be appointed by Ulysses unless
Ulysses declines to do . so , in which event this agreement shall
terminate . Not withstanding any termination or suspension ,
Ulysses shall pay Ithaca for any fees for permits or
certificates issued prior to such termination or suspension .

It shall be subject to annual review by the parties , not later
than November of each year .
8 . This agreement is signed by the Town of Ulysses pursuant to a
resolution adopted by the Town Board at a meeting held on
November 20 , 1984 in which it resolved to appoint Lewis
Cartee , the Town of Ithaca Building Inspector , as the Building
Inspector for the Town of Ulysses .

Supervisor Desch stated that the difficult part of the contract had
to do with public liability and fee schedules , so %e applied a
factor to our fee schedule so that the Town of Ithaca is not
subsidizing the Town of Ulysses or the Village of Trumansburg . He
also stated that in the future an amendment to Lew Cartee ' s salary
should be considered .
Town Engineer Fabbroni responded that an increase for the Building
Inspectors salary should be considered in the very near future .

RESOLVED , that the Town Supervisor be authorized to enter into a
building code contract with the Town of Ulysses pursuant to which
the Town of Ithaca ' s Building Inspector acts as Building Inspector

the form of agreement submitted to this meeting and with such
changes therein as the Town Supervisor and the Town Attorney may
approve , and
IT IS FURTHER RESOLVED , that the Town Building Inspector be
authorized to perform the services for the Town of Ulysses as set
for in said Agreement .

week upon prior request from the Village Clerk .
4 . (A) The normal work week of the Inspector for the Town of
Ithaca is 35 hours . Ithaca will continue to pay such

compensation premiums , etc . To reimburse Ithaca for that
portion of the 35 hours devoted by the Inspector to the
services performed for Trumansburg as particularly

and reasonable expenses incurred , on such terms and
conditions as Trumansburg and the Inspector shall agree .
5 . (A) Trumansburg represents that it has enacted , and will
adopt and keep in effect , resolutions and local laws to
indemnify its officers and employees pursuant to the
provisions of Public Officer ' s - Law Section 18 , and that
such enactments and procedures will cover and apply to
the Inspector in the course of - the performance of his
work for Trumansburg . Trumansburg will take whatever
steps may be necessary to assure that adoption of Public
Officer ' s Law Section 18 procedures are kept validly in
effect .
(B) Trumansburg will , at its expense , defend the Inspector
and Ithaca , and its officers and employees against all
claims of damages and other liability for any act ,
negligence or omission to act occurring in the course of
work performed for and on behalf of Trumansburg by the
Inspector and will indemnify and save harmless the
Inspector , his representatives and heirs , Ithaca and its
officers against all such claims , damages , liability and
expenses , including reasonable attorney ' s fees .
6 . In performing services of Trumansburg Building Inspector , and
without limiting the foregoing , the Ithaca Inspector will have
and possess the same powers , duties , immunities and privileges
that he would ordinarily possess if he were employed directly
by Trumansburg .
7 . This agreement will be effective as of November 1 , 1984 , and
shall continue until it is terminated by either party on 30
days ' prior written notice . In the event there is a vacancy
in the office of Ithaca Building Inspector , this agreement
shall be suspended until the vacancy is filled , at which time
the new Ithaca inspector may be appointed by Trumansburg
unless Trumansburg declines to do so , in which event this
® agreement shall terminate . Notwithstanding any termination or
suspension , Trumansburg shall pay Ithaca for any fees for
permits or certificates issued prior to such termination or
suspension . It shall be subject to annual review by the
parties , not later than November of each year .
8 . This agreement is signed by the Village of Trumansburg
pursuant to a resolution adopted by the Village Board at a
meeting held on in which it resolved to appoint
Lewis Cartee , the Town of Ithaca Building Inspector , as the
Building Inspector for the Village of Trumansburg .

CODDINGTON ROAD COMMUNITY IMPROVEMENTS
Susan Beeners , Landscape Consultant reported that she had a
resolution for Board consideration , establishing a Town Park at the
Coddington Road Community Center . The resolution will also give
permanent easements to the Town for the play field and temporary
easement to perform the necessary work on the play field and
outdoor play areas at a cost not to exceed $ 2 , 100 . She went on to
note that groups over twenty would be required to make arrangements
with the Center as well as groups serving alcholic beverages .
® Supervisor Desch stated that the only question that comes to mind
is should the.. Town Board hold an Informational Public Hearing so
that residents of the area can voice their opinions . He went on to
say that some people may be concerned with the area becoming more
public with more traffic . He then asked if the Planning Board had
considered this proposal as they had considered the Eastern Heights
Park proposal .
Councilwoman Raffensperger responded that the Park Committee had
held the Informational Public Hearing on the Eastern Heights Park .

used for bathrooms ?

old Rumsey building will be eliminated . If the building does go ,
there are other buildings to the north that can be converted to
bathrooms .
Town Attorney Barney asked if there would be a need to abandon the
road ?
Town Engineer Fabbroni responded , need to abandon a road which is
Partially abandoned now because of the bridge .

houses . If we go further we will need to install a pressure
reducing vault . If Glenside were to be connected by a loop line , a
second PVR would be needed . He went on to say that he believed
this was as far as the Town Board would ever want to extend water

number of years . Now the number of such requests have increased as
residential construction has increased and he wished to remind the
Town Board that the cost can be significant .

to extend water or sewer services to a given property boundary line

a need to extend three water services across Snyder Hill Road , one
water service across Slaterville Road , and two sewer services
across Kendall Avenue , and

insurance and questioned if there was someway to protect the Town
from having to pay the unemployment insurance .

II from FHA and NYSDOT that require 80 % of the work to be

to Force Account participation of labor and equipment to a maximtm
