REGULAR BOARD MEETING
March 11 , 1985
At a Regular Meeting of the Town Board of the Town of Ithaca ,
Tompkins County , New York , held at the Town Offices at 126 East
Seneca Street , Ithaca , New York , at 5 : 30 P . M . , on the 11th day of
March , 1985 , there were :

Supervisor ' s Report
Dog Contract
Supervisor Desch reported that the SPCA has offered a revised
contract which is 13 % lower in cost for basically the same service .
The primary impetus for the reduction is our consideration of
taking the services elsewhere . This means that the cost will be
very close to our budget and afford us the opportunity to evaluate
the service during the rest of this year and at the same time see
how the Town of Lansing is doing with the independent service . I
am circulating the revised contract which I would like your
authorization to execute . I already have authority to execute the
original one .
He went on to say that the Dog Enumeration is proceeding well .
1986 Water System Improvements
® Supervisor Desch noted that the Town staff has prepared a draft
report of priorities for water service extensions . The top
candidate is the West Shore properties on Taughannock Boulevard
because of the lake water quality problems . He went on to say that
he and Larry Would like to see if there is a way to also extend
sewer , service using relatively new approaches whereby solids would
be collected in septic tanks and the liquid collected and run to
the new treatment plant . This way the smaller sewers could be run
more with the lay of the land . Much more study on this will have
to be done .

Capital improvements
As an update of the Stearns & tlheler Townwide Water Improvements
Study , certain improvements remain priority projects when considering
any further service , elimination of potential health hazards , increased
overall dependability of area systems and interconnections , and full
cycle costs . When using these criteria , the potential projects , in
order .of ranking in importance and priority , are :
1 ) West Shore Cayuga Lake - Most residences within the Town of Ithaca
have marginal water sources . Most water is taken from the Lake
for household needs . However , this water can be directly
influenced by private sewage systems constrained by inadequate
soil type , slope , and area . Also , with the wave action and
variation of Lake level , this source is prone to freeze ups .
Domestic water for drinking and cleaning is well water , quite
often with high sulfur gas , or is transported from elsewhere .
Service could be provided either from an extension from Cass Park
or by pressure reduction from the Trumansburg Road grid . Demands
at the Hospital and north would favor Cass Park ,
2 ) DuBois Rd . - Indian Creek Rd . - Woolf Lane •- Grove Rd . -Trumansburg Rd .
This area is very typical of remote areas in the Town that have
neither public water nor sewer , are twenty or more years old , have
tight soil conditions , and limited space for replacement systems .
Fortunately , densities of development leave a potential home
served for every one hundred linear feet of extension , so , the
$ 3 , 000 capital cost is somewhat comparable today to replacement of
a well system . Service can be extended from the north end of the
Hospital grid or north from the Professional Building . A pump is
required to serve north of Indian Creek Fruit Farm . on Trumansburg
Road and in the Woolf Lane Subdivision . A modified low - cost
system featuring a low volume booster pump with pressure tank ( s )
and hydrant hookups for fire pumping will be investigated .
3 ) East Shore Drive - This area is one of the oldest mains in the
Town , experiences repeated breaks , has volatile soil conditions ,
and has poor services . It should be replaced . It should be
considered for reconnection to the City system or a stabilization
tank installed downstream of the Renwick Heights PRV ,
4 ) Ithaca College Connection - Ridgecrest Rd Zone to I C Zone -
This emergency connection should be installed to back up the

Ithaca College zone and Danby Tank zone in times of major
maintenance , prolonged power failure , major fire needs , and other
emergencies . The difference in normal pressures on either side of
the emergency gate valve would be modest enough to be tolerable
during any anticipated period of use .
5 ) East Hill - 1 Million Gallon Storage Tank - This tank , connected
directly to the Intermunicipal main , would serve the domestic and
fire flow needs of major densities in and around Ellis Hollow
Road , Maple Avenue , and Judd Falls Road . This tank would back up
entire Town Water System in time of emergency north of Town
anywhere from water intake to Oakcrest pump station . This tank
could back up Cornell elevated tank and City East Hill tanks .
This supply would provide storage at south end of transmission
main to supply South Hill in normal peaks and the City and Cornell
systems in emergency . With this tank , North Campus can be served
directly from the transmission main and the need for an additional
tank in Pine Tree Road zone is obviated . Provision to increase
storage to 2 million gallons total should be planned . This tank
should be connected to Pine Tree Road Tank through altitude valve
and directly to suction side of Snyder Hill Pump Station . The
tank will serve a small domestic area on Snyder Hill Road from
Regency Lane to the foot of the hill now served by Hungerford Hill
Tank . It may be desirable to eliminate several PRVs in the lower
elevations of Eastern Heights to be then served off this new zone
through new connectins along Regency Lane ,
6 ) North Dorm Connection to Transmission Main - Connection through
control pit and master meter with fire flow override .
7 ) West Hill Tank - Old Hector Street Su pply Main - Once subdivision
makes it possible to connect West Hill 12 - inch main grid back to
City Line , a 500 , 000 gallon tank and the force main from the
Vinegar Hill Pump Station should be completed . One possibility
would be tank construction by the Town and supply main
construction by the City . Ideally , tank would be constructed at
south end of pressure zone to balance out fire flow capabilities .
8 ) Poole Road - Drew Subdivision - The next logical zone would serve
this area at the Town Line . The situation is like the DuBois Road
utility situation and density justification . Again , cost may
force compromises to necessitate a modified hydropneumatic zone
with special hookups for fire pumping .
9 ) Maple Avenue Apartments - Connection of Apartments to Ellis Hollow
Road transmission spur with loop completed for circulation by old
4 " main along Maple Avenue ,
10 ) Surge Tank - South Hill - As infill of development increases
development between Burns Road and Town Line along Coddington Road
with possible extension of watermain , consideration should be
given to a small surge tank at or near Town Line . ( it may , make
sense to be in Danby ) ,

11 ) Hydrant Connection - South Hill - Emergency hydrant hookup to
supply water from City South Hill 1 million gallon tank to Town
South Hill grid on Coddington Road crossover . Without " 5 ) " , a
12 - inch connection is needed from Pearsall Place to Hudson Street ,
12 ) Service Changes Slaterville Road - Services to be changed over
from old two - inch main to six - inch main by State DOT .
Consideration should be given to returning six - inch main to
Honness Lane back to City pressure zone to eliminate high pressure
and breakage at present .
Major Maintenance
1 ) Rehabilitation , Improvements , or Abandonment PRVs - Every PRV
should be reviewed for proper operation , need , access , safety ,
parts maintenance or replacement . In particular , back pressure
pilot valves for all Stone Quarry Road pits should be assessed for
need and function , the King Road PRV should be modified to add a
lower operating range , and the Eastern Heights pits should be
evaluated for need and improvements ( access , drainage , heat ,
light , sump , ventilation , etc . ) . Where feasible , PRVs might be
replaced with small equalization tanks .
2 ) Tank Repainting Program - This program began eight years ago and ,
with the useful life of epoxy systems six to seven years , a
continuing cycle of tank maintenance should be programmed .
Consideration will be given to polyurethane outside painting
system that , with minimal preparation , might be compatible with
existing epoxy system .
3 ) Cathodic Protection System - Upon installation of final three
systems , all tanks except Troy Road will be protected and require
annual maintenance and repair . A unified contract service for all
cathodic systems in the SCLIWC system might make the most sense to
enjoy economies of scale .
4 ) All temporary patches should be replaced with permanent repair
sleeves or new main in areas of chronic leakage or breaks .

1 ) Repair of hydrant valves .

3 ) Mowing and painting at pump stations .

Town Board 2 March 11 , 1985
On the overall program , the Board is urged to discuss priorities
with Larry . The next step will be to cost out the program .
He went on to say that we also have a relatively long standing
commitment to provide sewer service to the few properties on
Campbell Avenue . Although this is relatively costly per property ,
we can couple it with a larger package .
1986 Federal Budget
The Supervisor stated that he was circulating a copy of the brief
statement delivered to Congressman McHugh ' s office today to be
filed as part of the hearing information that will be presented
® today . (Copy attached to Minutes ) .
City of Ithaca Conference on Municipal/Educational Services
Problems
The conference will be held on May 3 and 4 . There will be
workshops on various service problems such as zoning , fire
protection , etc . He went on to say that he would encourage all
Board members and as many staff members as possible to sign up .
Jean Swartwood has the details and you should let her know within
the next three weeks of you wish to go .
Pine Tree Road Relocation
Supervisor Desch stated that he and Larry Fabbroni had attended the
County Planning and Public works Committee meeting on Friday . The
County seems to desire to look at their potential overall
commitment to improving circulation between Ellis Hollow Road and
Route 366 . He went on to say that the Town participants had
expressed concern that the whole matter move forward with all due
speed before more serious accidents occur .
Forest Home Reopenin
The City , Cornell , Town and County are scheduled to meet again on
Wednesday to further pursue an arrangement to reconstruct Forest
Home Drive . He stated that he expected to have the results of the
test borings so that the project cost estimate can be confirmed or
modified .
1985 Construction Season
Supervisor Desch remarked that as we approach the start of the
season he would encourage all the Board members to visit the site
of the new Sewage Treatment Plant to, see the progress being made .
As a matter of fact , there will be enough daylight in May at the
hour of our Town Board meeting so perhaps we can start the meeting
with a tour of the plant . Let ' s keep that in mind as May 13
approaches .
Town Engineer ' s Report
® Town Engineer Lawrence Fabbroni presented his report to the Board
( copy attached to Minutes) . The Town Engineer stated that he would
like to repeat the invitation again that he made in February for
the Board members to meet with him at their convenience for at
least one-half hour each month to discuss issues of interest to
them . He went on to note that he is in Town Hall , Monday through
Friday from 8 : 00 A . M . , to 11 : 00 A . M. and the remainder of the day
is spent at the Sewage Treatment Facility .

Sewer - Discussions with NYSDOT whereby they will connect water services
on Route 79 at City Line to 6 " main at their expense
Investigation of alternatives for pilot study on Hospital Sewer
Main
- Review and refinement of Tank Specifications including request for
State and Federal Wage Rates for inclusion in document
- Scheduling of water service construction, 165 Ridgecrest Road
- Discussion with SCLIWC personnel to minimize surge problem on
Coddington Road
Parks - Meeting with WS Parks officials to explore feasibility of changes
at Buttermilk Park ; proposed alignment of bikeway along Inlet ,
Coy Glen, and Inlet Valley ; proposed construction schedule and
availability of funds
- Meeting with Plantations officials to discuss final cleanup Forest
Home and repair of Forest Home washout . $ 10 , 000 is available
to the Town for any permanent improvement which includes
provision for permanent repair to the Walkway . This repair
awaits resolution of the future status of Forest Horne Drive in
the City
- Discussion of plan of action for 1985 distributed for Town Board
review and action in April
Highways - Direction to Town Highway Department to proceed with Burns Road
work, weather permitting . Thaw has slowed progress .

It was a pleasure meeting with you on January 10 , 19850 I would like to thank
you for the time and courteous assistance provided me during my visit . As I
explained , the purpose of my call was to obtain information on the use and
storage of your construction equipment .
In an effort to aid you in your loss control activities , I am submitting the
following recommendation , as we discussed .
85 - 1 A heat and smoke detection alarm system should be installed in
the main garage building . This alarm should be equipped with
a central station monitoring system . The need for this alarm
is due to the high concentration of equipment in this building ,
along with its rural location .
If you should have any questions in regard to this recommendation , please feel
free to contact me .
I would appreciate it if you would please let me know of the status of this
recommendation within 30 days . Enclosed is a copy of this letter and a postage
paid envelope which can aid you in this area .

Statement to be filed at the Public Hearing on the 1986 Federal
Budget sponsored by Honorable Matthew McHugh , Congressman
28th District
The Town of Ithaca , as you know , has been fortunate in avoiding
significant dependence on federal funds . We have taken advantage
of the Federal Revenue Sharing program these many years and have
avoided the temptation of using the funds for operating expenses ,
The current annual level of $ 85 , 000 would be missed and to a great
extent replaced by capital borrowing but the Town has used none of
its debt limit so this will be no problem . We do consider the FRS
program to be one of the most effective federal programs ever
created or now in existence . If it has to go , we would recommend
letting it lapse at the end of the current authorization but not at
the start of FY 860
We also recognize that our taxpayers will experience an increase in
their County tax rate if FRS is terminated but our County tax rate
is zero . We also recognize that our local government may have to
assume some subsidy cost to sustain the operation of the Tomtran
System . This could be a joint private/public sector investment in
our cam-,�unity .
We are perhaps being selfish in stating that the construction
grants program for EPA can be phased out but we have 11 years of
first hand experience as to why this is a poorly constructed
program and one which should be totally revamped or eliminated . It
has been frozen and as a minimum should continue to be frozen .
As a Town Board we have refrained from involving ourselves with
national issues , particularly those involved with foreign policy ,
so I will not deviate from that policy now . At the same time , we
urge the Congress to show far greater spending restraint than we
have seen in many years . L�b believe this is an optimal time for an
across the board freeze including defense spending .
Finally we hope that Federal . Highway Administration Funding already
set aside for the Route 96 improvements on West hill will not be
frozen . Critical local decisions are expected to be made this year
to move this project forward and the local region of NYSDOT has
contined to designate this as the highest priority project in the
region .
Town Board 3 March 11 , 1985
Councilman Bartholf remarked that a couple of Sundays ago he took a
tour of the treatment plant .
The Town Engineer went on to note that the Board members had a copy
of the draft Water System Improvements 1986-87 and Beyond and that
he would like Town Board members ideas and opinions at the April
meeting .
Town Engineer Fabbroni went on to say that the Board members also
had a copy of his report titled "Pine Tree Road Relocation " which
he had presented to the County last Friday . The report contains a
history of what has gone on since 1960 on the Pine Tree Road
relocation and the connection to Route 366 . There is a lot of
® history to this particular project from the Planning Board ' s
discussions in the 1960 ' s to the current traffic surveys , its all
pretty clear regarding the need to relocate Pine Tree Road . He
went on to say that there have been several suggestions , some you
heard again at last months Town Board meeting . It all comes back
to the point that aligning Pine Tree Road with Judd Falls Road
would create one big traffic problem.
Councilwoman Howell asked if the aligning of Pine Tree Road to
Summerhill Lane would alleviate traffic conjestion ?
Supervisor Desch responded that a lot of traffic goes on through
the area and does not stop at the East Hill Plaza , this will move
this through traffic .
Town Engineer Fabbroni remarked that at some point in time , based
on the 25 year projection , there might be a need to install a
traffic light . There are 6 , 000 cars a day going through this area ,
mostly to Pine Tree Road from Judd Falls Road , some to the Plaza
and a smaller amount to the City . Relocating Pine Tree Road to
Summerhill Lane will alleviate confusion with a right hand turn
only to East Hill Plaza . Cars can turn from East Hill Plaza and
Judd Falls Road without the confusion they encounter now . If the
volume of traffic generated by the East Hill Plaza , in the future ,
is so greatly increased then a third exit can be made from the
Plaza and force cars to come onto Summerhill Lane and then traffic
can be controlled by a four-way stop . An addition can be made to
the pedestrian walkway or a walk light can be installed . He went
on to say that if Pine Tree Road were aligned with Judd Falls Road
then you would need to widen Judd Falls Read to four lanes and then
what do you do with traffic once it reaches Route 366 . He went on
to note that Cornell University was researching the possibility of
more parking . The Town Engineer stated that you don ' t have to
build for Cornell but you must live with them .
PERSONS TO BE HEARD
Henry Aron then spoke to the Board . He noted that he was a member
of the Open Heart Club - which now has over 280 members with spouses .
We are now one year old , but during the time the club was formed we
asked Noel Desch for permission to use the Town of Ithaca Board
® Room . He also noted that Jean Swartwood had been very helpful in
acccmodating the club . Mr . Aron then presented to the Supervisor
and the Town Board a plaque from the American Heart Association , a
Certificate of Appreciation for all that has been done for them .
Supervisor Desch thanked Mr . Aron for the certificate .
Town Engineer ' s Report Continued
NORTHVIEW ROAD WEST
Town Board 4 March 11 , 1985
Town Engineer Fabbroni stated that the Town was left with Northview
Road when Willis Hilker went bankrupt . Citizens Saving Bank took
over and the road has now been constructed to Town specifications .

WHEREAS , Northview Road West extension to the cul-de-sac has been
completed to Town Highway Specifications , and

CODDINGTON ROAD COMMUNITY CENTER
Town Engineer Fabbroni stated that the Board members had copies of
the request from Shirley Brown in the amount of $ 1 , 795 . 15 for
proposed improvements . The item is not ready for action this
evening . He went on to say that it was up to the Town Board to
judge if the request should be approved .
Supervisor Desch noted that there has now been a great rebirth at
the Center . He went on to say that the Town does not own the site
and , therefore , he felt that a legal instrument was needed for the
Town to be on the site performing work . Also , the Board must
decide where , in the budget, the money will ocm from .
Town Attorney Barney questioned if the Town should legally be
involved at all .
Supervisor Desch remarked that the Town had some years ago assisted
in the purchase of the additional land .
Susan Beeners noted that the priority of the proposed improvements
was the safety aspect . Brush is a safety hazard and so is the
® fence . There is always a chance of kids running out through the
fence or lack of fence .
1985 PARK PROJECTS WORK PLAN
Town Engineer Fabbroni remarked that Susan Beeners has the work
planned for 1985 and this is just another item for Board
consideration .

Highway Superintendent ' s Report
Highway Superintendent Robert Parkin stated that his Highway
Superintendent ' s report was attached to the Town Engineer ' s report .
REPORT OF COUNTY BOARD REPRESENTATIVE
County Representative Beverly Livesay stated that she had also
attended the meeting of the Planning Develognent and Public Works
Committee . She went on to say that as she had noted at the
February Town Board meeting , a request to pursue the realignment of
Pine Tree Road had not come from the County . She stated that
® considerable County staff time , in conjunction with Town and
Cornell had already been spent on the realignment . She went on to
say that the Comtittee had asked for certain information .
Supervisor Desch noted that he was confused about what information
the Comtittee wanted .
County Representative Livesay responded that she was uncertain
also . However , Stu Stein was concerned that the realignment was
dealing with part of the project , not all of the project . She went
on to say that she thought there needed to be a thorough
examination of the proposal and the cost .
Supervisor Desch asked who was going to take the lead to make sure
the Ccnrdttee had all they information they needed ?
Mrs . Livesay responded that she did not know .
Mrs . Livesay stated that she had a question for the Town Engineer .
She noted that the Engineer had stated that there was a problem
with the gas station now but that it would not be a problem after
the relocation of Pine Tree Road because of the required right hand
turn . Why not make it a right hand turn only now?
Town Engineer Fabbroni responded , where is the traffic going ? They
still have to come back to the Pine Tree Road - Ellis Hollow Road
Intersection . Presume the cars are now coming out the Bank exit ,
and going up Ellis Hollow Road , the other driveway to Judd Falls
Road is already backed up . Cars coming out of the other exit puts
them in conflict with existing traffic .
Supervisor Desch remarked that the Town of Ithaca was prepared to
work with the County to solve the existing problems .
Mrs . Livesay remarked , it ' s a mess . We need a long range solution .
Supervisor Desch asked Mrs . Livesay if she had anything else to
report .
Mrs . Livesay responded , only the hospital issue which is at square
one . Discussions are being held with the two County Committees and
the Hospital Board ,
AUTHORIZATION TO DEVELOP SPECIFICATIONS FOR USED GRADALL
Town Engineer Fabbroni stated that they had an expert cone in from
L . B . Smith , Inc . , who came up with a cost of $10 , 000 to
rehabilitate the existing grader , and this figure did not address
future problems like tires , front and rear ends of the Gradall ,
etc . He went on to say that they would like to be able to purchase
a Gradall with remote controls so that it could be operated by one
person . The present Gradall requires two people to operated it .

Supervisor Desch asked the Highway Superintendent what year Gradall
he expected to get ?
Mr . Parkin responded , something between eight and ten years old .
Councilman Kugler asked how many hours the Town had put on the
present Gradall since it was purchased ?
Superintendent Parkin responded that he did know the total but that
AVER between 300 and 600 hours were put on the Gradall each year .
Supervisor Desch stated that Councilman Bartholf should work with
the Town Engineer and the Highway Superintendent to develop the
specifications .
RESOLUTION NO , 26
Motion by Councilman Kugler , seconded by Councilwoman Howell ,
WHEREAS , the Ten Year Highway Equipment Replacement Plan scheduled
replacement of the 1964 Model Gradall in 1984 , and
WHEREAS , the Gradall was thoroughly evaluated recently to determine
the immediate repair needs to retore it to daily reliability to be
on the order of $10 , 000 , and
WHEREAS , the front and rear engines would still be in questionable
condition , and
WHEREAS , the Town could economize by considering purchase of a
none-man remote control Gradall rather than the present two-ran
requirement ,
NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of
Ithaca that the Town Engineer , Town Highway Superintendent and
Councilman Bartholf be authorized to develop specifications for a
used remote control gradall to be reasonably expected to cost
$ 35 , 000 to $ 40 , 000 with trade-in .

Town Engineer Fabbroni stated that Truck # 7 was listed on the
10 -Year Replacement Schedule . We have a long list of maintenance
that would be required if we planned to keep the truck .
Supervisor Desch asked what was the anticipated replacement cost ?
Highway Superintendent Parkin responded , $ 30 , 000 .
Town Engineer Fabbroni added that he expected to be able to
purchase the Gradall and the replacement truck within the amount
® already budgeted for equipment .
Councilman Cramer asked Mr . Parkin if he planned to replace the
truck with the same size vehicle ?
Highway Superintendent Parkin responded that the size was
comparable but that he hoped the replacement truck would have a
diesel engine .

evaluated the present condition as being severely in need of major
repair , or disposal ,
NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of
Ithaca that the Town Engineer and Town Highway Superintendent be
authorized to develop specifications for a new truck of comparable
size , weight , and functional capacility .

AUTHORIZATION TO DEVELOP SPECIFICATIONS FOR FIRE ALARM SYSTEM
Town Engineer Fabbroni stated that a letter received from Gary R.
Gleason , Senior Loss Control Representative for C & F Underwriters
Group regarding a loss control survey done on January 10 , 1985 is
quite specific . It almost says that if we do not have a Fire Alarm
System we will have no coverage ( copy attached to the Minutes ) .
The proposed resolution recognizes the problem and calls for the
drawing of plans and specifications and the development of a
budget .
Councilman Kugler remarked that Simplex has terrible equipment and
the service is worse . He went on to say that he would not be
opposed to purchasing a system from local suppliers .
Town Engineer Fabbroni noted that at the present time , there are no
local suppliers able to supply this equipment .
RESOLUTION NO , 28
Motion by Supervisor Desch ; seconded by Councilman Kugler ,
WHEREAS , the Town insurer has conducted a loss control survey of
the Town of Ithaca Highway Maintenance Facility , and
WHEREAS , the report resulting from the survey recommends the
installation of a heat and smoke detection alarm system equipped
with central fire monitoring system because of the facility ' s
remote location , and
WHEREAS , this is an unbudgeted item that preliminary investigation
puts a realistic estimate in the range of $ 7 , 000 to $ 10 , 000 , and
WHEREAS , there are several companies , e . g . , Rochester Time and
Sirrplex Time , and several private individuals who are locally
familiar in design of such systems ,
NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
Ithaca authorizes the Town Engineer and Town Highway Superintendent
to design and develop a construction budget for the required
system, and
FURTHER RESOLVED , that they seek the advise , design expertise , and
specifications guidance as necessary to prepare specifications for
bid from one or a combination of the aforementioned sources at a
cost not to exceed $ 1 , 000 to be paid from A5132 . 4 ( 412 ) .

Town Engineer Fabbroni noted that this was his annual blanket
resolution to seek out help where available and then to come back
to the Board , later with specifics . He noted that the Supreme
Court had just ruled that municipalities could not hire people for
less than the minimum wage . Nancy Zahler is looking into the
ruling .

Motion by Councilwoman Howell ; seconded by Councilman Cramer ,
® WHEREAS , the Town Board of the Town of Ithaca has , over the years ,
supported a reasonable level of temporary summer assistance to
support the planning , design , construction and maintenance needs of
the Town , and
WHEREAS , the preliminary wurk plan for 1985 Sumner Program includes
the need for three technical aids for highway , water and sewer ,
surveying support needs , two technical aides for park construction
and maintenance ; one technical aide for planning and computer
support , two - four person full time equivalent park planning and
maintenance crews , one - four person full time equivalent survey
crew , one - four person full time equivalent highway brush cutting ,
shoveling , and raking crew , and three full time equivalent
secretarial aides , all between May 20 , 1985 and September 1985 ,
NOW THEREFORE BE IT RESOLVED , that the Town Board authorizes the
Town Engineer and Town Planner to pursue filling these needs within
1985 budgeted amounts from the pool of temporary employment skills
available through Cornell Tradition , Cornell Work Study , Tompkins
County Summer Youth Employment Program , and Tompkins County Job
Training Program , and
FURTHER BE IT RESOLVED , that specific positions , for specific
duration from specific funds , for specific individuals , at specific
pay rates will be approved by resolution as the total 1985 program
takes form with the evolving programs ' ability to service the Town
needs .

NORTHVIEW ROAD 'TANK SITE ACCESS
Supervisor Desch stated that no action would be taken on this
agenda item tonight as more internal discussions and more staff
work was needed .
CONSIDERATION . OF EX'T'ENSION OF TIME ON DEMOLITIC N OF SLAU=ERHOUSE
Town Engineer Fabbroni reported that the Attorney for Mr . Stuhr had
requested the Town to extend the Notice of Violation subject to
sealing off the area , posting and prohibition of access . Mr . Stuhr
is in Mexico and the time is needed because of the communication
distance and the impending sale of the property .
Councilman Cramer asked what was the condition of the building now?
Town Board 10 March 11 , 1985
Supervisor Desch responded , the building is in very bad condition .
Councilman Cramer asked if the liability , for the property , was
still with the property owner ?
Supervisor Desch responded , definately .
Town Attorney Barney suggested that the building should be
demolished and the owner billed for the demolition .
Town Engineer Fabbroni responded that some of the building was
reusable as it stands . The concrete walls are still there . The
biggest problem is the basement in the building . The Fire
® Department is worried about another fire in the building . The
debris from the last fire covers any holes in the floor and the
Fire Department is worried about a fireman falling through one of
these undetectable holes .
Town Attorney Barney asked if the extended time could be shortened?
He stated that he was concerned about someone going into the
building , for reasons known to them, and breaking a leg , the Town
could be involved in a liability claim because of the extension of
time .
Supervisor Desch suggested the date of May 1st for the extension .
Town Attorney Barney remarked that the problem is the longer time
you give them the more they delay in getting the building torn
down .
RESOLUTION NO . 30
Motion by Councilman Cramer ; seconded by Councilman Kugler ,
WHEREAS , a Notice of Violation of the Town of Ithaca Ordinance
Regulating Unsafe Buildings and Collapsed Structures has been
served upon Bernard C . Stuhr , owner of Town of Ithaca Tax Parcel
No . 6-31 -2 -5 , because the former Knight ' s Slaughterhouse located
thereon is dangerous and unsafe to the public , and
WHEREAS , an extension of time for removal of the building has been
requested by the owner ' s attorney and by a prospective buyer of the
site ,
NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
Ithaca extends the deadline for removal of the building to May 1 ,
1985 , if measures are taken to seal off , post , and prohibit access
to the structure to the satisfaction of the Town of Ithaca Building
Inspector within two weeks .

Supervisor Desch stated that he had a conflict of interest with

46 -1-15 . 2 , as he was part owner of this property . He stated that
he would like to refer this item to the Deputy Supervisor , George
Kugler for his study and that he would step aside at the April
meeting and that the Deputy Supervisor would conduct the meeting
® during the discussion of the refund .
REFUND ON BENEFIT UNITS FOR THE JOHN MARION ESTATE
® Supervisor Desch noted that Agenda item 11 ( d ) was a little
complicated because Pine Tree Associates had purchased the property
and then without the Towns or the Tompkins County Assessments
knowledge , Pine Tree Associates had deeded the abutting property to
the current property owners . The deeds were not recorded in time
for the Assessment Department to do an apportionment .
Town Attorney Barney stated that he felt Dr . Baldwin should
reimburse the Marion Estate directly .

Town Engineer Fabbroni stated that he had sent a letter to Dr .
Baldwin showing the reapportionment .
Town Attorney Barney again stated that he felt it was more
appropriate for Pine Tree Associates to pay the benefit assessment

tabled .
NYSEG EASEMENT FOR BURDICK HILL TANK SITE
Town Engineer Fabbroni noted that according to a Survey Map dated
May 16 , 1984 , the Town of Ithaca is shown as the owner of the
property on which the Burdick Hill tank is located and the Town of
Lansing as the owner of the property on which the pipes are
® located . He stated that NYSEG needs a right-of-way ten feet wide
to set a pole .
Councilwoman Howell stated that she had a conflict of interest in
this resolution , as Mr . Circa is her brother .
Town Attorney John Barney requested that the record show that the
firm of Buyoucos , Barney , Grossman and Roth represents Mr . Alex
Cima .

Town Planner Peter Lovi stated that the Planning Board is reviewing
the Dell Grove Cluster Subdivision at 1018 -1020 Danby Road , Tax

is similar to Commonlands . The Town Board must review the
Covenants and the Home Owner ' s Agreement ,
Town Supervisor Desch asked if there would be much of a difference

Susan Beeners , Parks Planner distributed to the Board copies of
® Parks and Recreation Ways - Spring Presentation . She stated that
she would like to have the Parks and Recreation Plans for the
Spring placed on the April Agenda . She went on to say that most of
the items were things taylored for youth workers at a minimal
expense for material .
Supervisor Desch asked if action on the Parks and Recreations Plans
could be held until Councilwoman Raffensperger returned?
Town Engineer Fabbroni responded that if the Staff has the Town
Boards feed back now , there will be no problem. There would be a
problem if the Board waited until the last minute to voice their
concerns ,
ENVIROlZ'OUAL ASSESSMENT FORM ON CITY YOUTH BUREAU FACILITY
John Meigs , City of Ithaca Planner presented a map showing the
proposed relocation of Cayuga Street Extension and the relocation
of the Youth Bureau Facility . He went on to say that it was felt
that the Youth Bureau was park oriented and , therefore , proposals
for Stewart Park were tied into the Youth Bureau Facilities (Tin
Can ) . The present facility is separated from the Park by a heavily
traveled road plus the railroad with two trains per day . The City
of Ithaca would like to combine two parcels they own . Therefore ,
they are proposing replacement of the Youth Bureau Facility on
approximately the same site as the present facility is located but
with a safer and better looking facility with no negative impact on
the environment .
Supervisor Desch noted that the proposal would save some of the
large trees . He asked how many would be removed?
Mr . Meigs responded of the mature trees , perhaps one-half would
® have to be removed .
Supervisor Desch questioned half of what number ?
® Mr . Meigs responded , four to six trees would be removed . Mr . Meigs
went on to say that there would be a negative environmental impact ,
in disturbance , during construction .
Councilman Cramer asked where the Park Maintenance Facility was
located now?
John Meigs stated , in the bathhouse in the park .
Supervisor Desch asked City Engineer Peter Novelli if the road
would be able to carry more traffic?
Town Board 16 March 11 , 1985
Peter Novelli responded yes , the road should carry all the traffic .
There is to be a 30 ' pavement total .
Town Planner Peter Lovi stated that the Zoning Board had given
their approval , the Planning Board has reviewed the project , with
no special problems . He went on to say that once the City has
submitted its final draft and drawings for the project he felt the
Planning Board would give their approval .
Town Supervisor Desch asked City Engineer Novelli if the City would
maintain the new Cayuga Street if the property remained in the
Town?
Peter Novelli , responded yes . The City would be assuming
maintenance responsibility for the new Cayuga Street .
Councilman Cramer asked the City Engineer if there was a problem
with drainage in the area ?
Mr . Novelli responded yes . There is a 24 " drainage pipe then a
ditch and a 48 " drainage pipe . We are going to ask the State for
their permission to extend the 48 " culvert .

boundary on State Route 34B , would be abandoned as a Town Highway ,

the matter through annexation of the area in question to the City ,

REVIEWER ' S RECOMMENDATIONS :
Type of Action : This is a Type I action , as it involves the abandonment
of a Town Highway . The abandonment of the existing highway , its
relocation , and the construction of the new Youth Bureau and maintenance
facility have been reviewed by the Planning Board and Zoning Board of
Appeals . I recommend that a negative declaration of environmental
significance be made . I believe that the information presented in the
EAF and the preliminary site plans are sufficient for this determination .
recommend that the final site plan to be approved by the Planning
Board contain a full description of the landscaping and revegetation
plan requested in # 37 ,

TOWN HIGHWAY ALTERNATIVES - BUT'TERMILK FALLS PARK
Town Engineer Fabbroni presented a map showing the present entrance
to Buttermilk Falls Road . He noted that the existing Town road
goes across the bridge and up Sand Bank Road . The Town Engineer
went on to say that a meeting had been held with the State of New
York on a proposed future road . The Town could end up with a
cul-de-sac at the beginning of the present East Buttermilk Road ,
The Town would then assume , as a Town road , the gravel road by the
old Rumsey Sand & Gravel Office . The proposal is to remove the
office building . The Town may be asked to surface treat the road
once the realignment is completed . The realignment would solve a
maintenance problem to property owners for maintenance .
® John Meigs , City Planner , responded that hopefully the State will
be able to design the road and keep the building . Perhaps a longer
radius would permit traffic to swing around the building as that
® building is the most logical location for a comfort station and
there is no guarantee that the building would be replaced .
Town Engineer Fabbroni noted that if the proposed realigned road
needs to be surface treated , the Town would hope to be able to
enter the old gravel bank and obtain the necessary material for
surface treatment and then they would be able to reclaim the land
better than it is now .
The Town Board agreed to move in this direction .
ELECTION DISTRICTS
RESOLUTION NO , 43
Motion by Supervisor Desch ; seconded by Councilman Kugler ,
WFE;REAS , Section 4 - 100 ( 3 -a) of the State of New York 1984 Election
Law states that an Election District shall contain not more than
eight hundred registrants where one voting machine is used and not
more than nine hundred fifty registrants where two voting machines
are used , and
WHEREAS , with the large voter registration received for the 1984
Presidential Election the total registration was compiled at the
following Districts :
District # 1 - 728
District # 2 - 1095
District # 3 - 942
District # 4 - 1223
District # 5 - 783
District # 6 - 982
District # 7 _ 762
District # 8 776
District # 9 - 657
and ,
WHEREAS , with the new Tompkins County Reapportionment and the large
total registration numbers , it was necessary to realign the Town of
Ithaca Election Districts and to create a new Election District to
be known as Election District # 10 ,
NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
Ithaca hereby approves the realignment of the Town of Ithaca
Election Districts as shown on the Town of Ithaca Election District
Map .

Ithaca . hereby approves the location of District # 10 at the Ellis
Hollow Elderly Housing and approves the moving of District #5 from
the Cayuga Heights Fire Department to the Cornell University

RESOLUTION NO . 44
® Motion by Supervisor Desch , seconded by Councilman Cramer ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
® authorizes the Supervisor to execute the contract with the SPCA for
the period of January 1 , 1985 through December 31 , 1985 at a cost
of $ 8 , 916 .
