HomeMy WebLinkAbout2006-01-02 01 Town Board Minutes Organizational Meeting January 2 , 2006 TOWN OF DANBY TOWN BOARD MINUTES ORGANIZATIONAL MEETING FOR 2006 JANUARY 2, 2006 PRESENT : Supervisor Dietrich Councilpersons : Eugene Beavers, Norbert Nolte, Joseph Salino, Gladys Varona-Lacey Others Present : Carol Sczepanski - Town Clerk Susan Beeners - Code Enforcement Officer Roy Casterline - Water District Superintendent Bob Roe - EMC Representative Ted Jones - Bookkeeper George Blanchard - Member of the Public Supervisor Dietrich called the meeting to order at 7 : 05 p . m . and led all present to the Pledge of Allegiance to the American flag. The Supervisor was administered the Oath of Office by the Town Clerk. DELETIONS TO THE AGENDA Delete Proposed Resolution No . 19 from Agenda - (Is duplicated in the Proposed Organizational Resolutions . PRIVILEGE OF THE FLOOR Councilperson Varona-Lacey asked when a road becomes the responsibility of the Town? She would like the issue of roads discussed . She said that she thinks that when a development has been completed is the time to take over roads so that there would less of a burden on the Town itself Code Enforcement Officer, Susan Beeners said that item is something she has on her work in her working project list . George Blanchard - said we should look into changes in zoning regarding blacktop verses oil and stone for developments . Councilperson Beavers would like to bring up land issues . He would like to see the Board asking the repealing of the legislation that was passed in May and going back to the old regulations until we can come up with a more uniform fully finished easily enforceable and consistently enforceable new set of regulations . His point is what the Code Enforcement Officer doing now is labor and time intensive he would like to see us go back to the way it was . Councilperson Beavers also reported to the Board that in the Attorney General ' s regulations that any town owned building, no matter what the use would have to pass the building code and the old highway barns is not a safe building and is not up to code. He asked if we were in violation of the law given the current condition of that building. Supervisor Dietrich said that the old highway barns is not in violation and is okay with the insurance company but may be border line . He said that they had talked about adding repairs to the old town barn facility, putting a shed near the proposed salt shed to store some of the equipment that is stored there in a proposed bond proposal but it has now been cut out of the calculation for the bond. The Town Clerk reported that the unpaid water bills were incorporated in the West Danby Water District revenues in the 2006 budget. They were also relieved on the 2006 Town and County Tax Bills . When the warrant is collected the relieved tax will be put into the general fund . e . • 02 2 Town Board Minutes Organizational Meeting January 2 , 2006 The new dog licencing regulations will go into effect on January 15 , 2006 that will allow up to three (3 ) year registration . All registrations after January 15 will expire on the expiration date of the rabies vaccination. All health departments will be required to hold vaccination clinics every four (4) months . Ted Jones said that last board had a general sense of direction over time . He encourages open government. Bob Roe reported that the public hearing and the December meeting were cancelled due to inclement weather. A public hearing and meeting is scheduled for the next meeting on Thursday, January 19 , 2006 . The Planning Board has not had a change to discuss the vacancy on that board . He asked that the board not fill that vacancy until the Planning Board has had chance to make a recommendation. He also asked that a representative of the Planning Board to be involved in the interview process . Planning Board Vacancy Interviews Scheduled Supervisor Dietrich said that he would contact the applicants to schedule interviews at 6 : 00 p . m . on January 9 , 2006 and on February 6 . NEW BUSINESS The Board reviewed and discussed the proposed organizational resolutions 1 - 18 of 2006 of the Town of Danby. "Roberts Rules of Order" and how privilege of the floor should be handled at the board meetings . were discussed as a tool . SUPERVISOR' S STATEMENT TO THE BOARD Roberts Rules of Order will be followed at all Town Board Meetings except when special roll call vote is necessary. Roll call will be alphabetical with the Supervisor voting last . All meetings will begin at 6 : 30 p . m. and terminate no later than 8 : 30 p . m . Method of claims for payment of all bills will be by voucher. Vouchers and items for the agenda must be submitted no later than Thursday preceding the Board meeting. Vouchers maybe submitted to the Supervisor or the Town Clerk . The Town Board in accordance with Town Law AT103 will audit all bills . All personnel matters will be discussed in executive session. ORGANIZATIONAL RESOLUTIONS 1 - 18 OF 2006 By Councilperson Nolte : Seconded by Councilperson Beavers RESOLUTION NO. 1 OF 2006 APPROVAL TO. INVEST IDLE FUNDS RESOLVED , that the Town Board of the Town of Danby authorize the Supervisor to invest idle funds . RESOLUTION NO 2 OF 2006 YEAR 2006 SALARIES APPROVED RESOLVED , that the Town Board of the Town of Danby set the year 2006 Annual Salaries as follows : Annual salaries to be paid monthly: Supervisor $ 13 , 126 Town Justices (2) $20 ,960 ($ 10,480 each) Town Clerk $20,908 Court Clerk $ 5 ,240 Quarterly Salaries : Councilpersons $ 8 , 676 ($2 , 169 each) 03 t 3 Town Board Minutes Organizational Meeting January 2 , 2006 Water District Clerk $ 3 , 500 Asst. Water District Plant Operator $2 , 850 Bi-weekly Salaries : Code Enforcement Officer $34,248 Highway Superintendent $44,204 Water District Plant Operator $ 9 ,700 Bi-weekly salaries paid hourly as needed : Deputy Town Clerk $ 3 ,280 Code Office Assistant $ 13 , 755 Bookkeeper $ 15 , 956 Town Historian $ 300 per year honorarium - Paid in July and be it further RESOLVED, That the Town Board of the Town ofDanby authorize the Supervisor to pay the above salaries prior to the first meeting of each month with December payrolls adjusted to meet all budget requirements . RESOLUTION NO. 3 OF 2006 PAYMENT OF BILLS RESOLVED, That the Town Board of the Town of Danby approves a blanket resolution to authorize the Town Supervisor to pay utility bills, freight, postage, contracts and to conduct other normal proceedings such as payroll in advance of audit in order to keep affairs moving on a timely basis, and be it further RESOLVED, that a contract is not a bid award . RESOLUTION NO. 4 OF 2006 2005 FINANCIAL REPORT RESOLVED, That the Town of Danby Town Supervisor, in lieu of preparing a financial report under Town Law #29-( 10) shall submit to the Town Clerk by March 1 , 2006 a copy of the report submitted to the State Controller required by Section 30 of Municipal Law . RESOLUTION NO . 5 OF 2006 AUTHORIZATION FOR PURCHASE OF TOOLS, EQUIPMENT, ETC. RESOLVED, That the Town Board of the Town of Danby authorizes the of Danby Highway Superintendent to purchase tools, equipment (other than motorized equipment) , small implements, tires and tubes, etc . in the amount not to exceed $2 , 500 at any given time without prior approval of the Town Board . RESOLUTION NO. 6 OF 2006 TOWN OF DANBY OFFICIAL NEWSPAPER AND BANK DEPOSITORY RESOLVED, That the Town Board of the Town of Board names the Ithaca Journal as the Official Newspaper and the Tompkins Trust Company as bank for the depository of Town Funds . RESOLUTION NO. 7 OF 2006 TOWN OF DANBY ATTORNEY RESOLVED, That the Town Board of the Town ofDanby names the firm of Bixler and Stumbar 04 . 1 4 Town Board Minutes Organizational Meeting January 2 , 2006 be named as the law firm to represent the Town of Danby in all Zoning, Planning Board, and general Town of Danby business . The Town Board reserves the right to seek other legal aid if it deems necessary. RESOLUTION NO. 8 OF 2006 TOWN MILEAGE RESOLVED, That the Town Board of the Town of Danby authorizes the mileage for Town Business to be paid at forty-eight and one half cents ($ . 48 . 5) per mile . RESOLUTION NO. 9 OF 2006 HIGHWAY IMPROVEMENTS REIMBURSEMENT RESOLVED, That the Town Board of the Town of Danby be authorized to sign an agreement that monies collected for repairs and improvements of Town Highways in the amount of $ 95 , 857 . 00 (State Aid DA3501 ) be expended upon 71 . 98 miles of Town of Danby highways . RESOLUTION NO . 10 OF 2006 WATER COMMISSIONER APPOINTMENT RESOLVED, that the Town Board of the Town of Danby reappoints Nicholas McCabe as Water Commissioner for the West Danby Water District for a five year term as recommended by the Board of Danby Water Commissioners . Term of appointment begins January 1 , 2006 and expires December 31 , 2010 .. RESOLUTION NO. 11 , OF 2006 ACKNOWLEDGMENT OF DEPUTY TOWN CLERK RESOLVED, That the Town Board of the Town of Danby acknowledges the Town Clerk's appointment of Linda Howe as her Deputy Town Clerk. RESOLUTION NO . 12, OF 2006 TOWN BOARD MEETINGS RESOLVED, That the Town Board of the Town of Danby regular monthly board meetings be scheduled at 6 : 30 P .M . on the second Monday of each month for the year 2006 . RESOLUTION NO. 13 , OF 2006 ACKNOWLEDGMENT OF COURT CLERK RESOLVED, That the Town Board of the Town of Danby acknowledges the Town Justices appointment of Theresa Klinger as Danby Court Clerk. RESOLUTION NO. 14, OF 2006 REAFFIRMATION OF TOWN OF DANBY PROCUREMENT POLICIES AND PROCEDURES AS APPROVED IN RESOLUTION NO. 24 OF 1993 RESOLVED, that the Town Board of the Town of Danby reaffirm the Town of Danby Procurement Policies and Procedures as established in Resolution No . 24 of 1993 . RESOLUTION NO. 15, OF 2006 APPOINTMENT OF DEPUTY TOWN SUPERVISOR RESOLVED, The Town Board of the Town of Danby approves the appointment of Norbert Nolte as Deputy Town Supervisor for 2006 . 05 I 5 Town Board Minutes Organizational Meeting January 2 , 2006 RESOLUTION NO. 16 OF 2006 APPOINTMENT OF PLANNING BOARD CHAIRPERSON RESOLVED, that the Town Board of the Town of Danby appoints Robert Roe as Chairperson of the Town of Danby Planning Board for the year 2006 . RESOLUTION NO. 17 OF 2006 APPOINTMENT OF CHAIRPERSON OF THE BOARD OF ZONING APPEALS RESOLVED, that the Town Board of the Town of Danby appoints Ted Jones as chairperson to the Town of Danby Board of Zoning Appeals for the year 2006 . RESOLUTION NO. 18 OF 2006 APPOINTMENT TO THE BOARD OF ZONING APPEALS RESOLVED, that the Town Board of the Town of Danby reappoints Russell Klinger the Town of Danby Board of Zoning Appeals for a five (5 ) year term to begin on January 1 , 2006 and will expire on December 31 , 1010 . A roll call vote on blanket resolutions 1 - 18 of 2006 resulted as follows : Beavers Aye Nolte Aye Salino Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously Susan Beeners submitted two resolutions and suggested that the Board make a recommendation for what their goal would be for their meeting on January 11 . The second resolution is requesting investigations from both the Task Force and the Planning Board with respect to the May 2005 revisions . Before any amendments to the regulations can be made the Town Board must refer it to the Planning Board for their recommendation. RESOLUTION No. 19 of 2006 -REQUEST TO COMPREHENSIVE PLAN IMPLEMENTATION TASK FORCE FOR RECOMMENDATION : By Councilperson Nolte : Seconded by Councilperson Varona-Lacey RESOLVED, that the Town Board of the Town of Danby hereby requests that the Comprehensive Plan Implementation Task Force assist the Town Board in revising Town Board Resolution No . 31 of 2004, "Creating a Comprehensive Plan Implementation Task Force", by providing recommendation related to the following. 1 . The charge to the Task force 2 . Membership , voting and Subcommittees 3 . Staff support and other paid assistance 4 . Chairperson, and Vice-Chairperson 5 . General Work Plan Discussion : Robert Roe said that at a joint meeting last year the Board agreed that the recommendations from the Task Force were to come to the Planning Board and then be forwarded to the Town Board. Supervisor Dietrich said to him the question is still open about whether the Task Force recommendations should come straight to the Town Board or whether it should go to the Planning Board. We were moving toward getting the clarification with the Town Board and the Task Force and the Planning Board making some recommendations . There was discussion by the Board on the structure of the Task Force Committee and the sixty/forty subdivision regulation. L ; • 06 6 Town Board Minutes Organizational Meeting January 2 , 2006 Councilperson Beavers said it would be simpler to go back to the previous regulations until the revisions to the May 11 , 2005 regulations can be rewritten . A roll call vote on the resolution resulted as follows : Beavers Aye Nolte Aye Salino Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously RESOLUTION NO. 20 OF 2006 REQUEST TO TASK FORCE AND PLANNING BOARD FOR RECOMMENDATION WITH RESPECT TO RESCINDING MAY 11 , 2005 REVISIONS TO THE ZONING ORDINANCE AND THE SUBDIVISION REGULATIONS By Councilperson Beavers : Seconded by Councilperson Salino RESOLVED, that the Town Board of the Town of Danby requests that the Comprehensive Plan Task Force and the Planning Board make recommendations of interim improvements to the Town of Danby Zoning Ordinance and the Town of Danby Subdivision Regulations specifically related to the removal of the sixty/forty conservation area requirement and the addition of the permit process for the reinstatement of the permit process for minor subdivisions .
