The following resolutions were adopted by the Board . RESOLUTION NO . 86 OF 2005 TRANSFER OF HIGHWAY FUNDS By Councilperson Gagnon : Seconded by Councilperson Varona-Lacey RESOLVED, that the Town of Danby Town Board transfer the following accounts for the Danby Highway Department : $6177 . 05 from DA5142 . 100 to DA5142 . 400 $ 13 . 56 from A3310 .400 to 5010 . 400 A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously RESOLUTION NO. 87 OF 2005 OF FUNDS ENCUMBRANCE OF 2005 FUNDS RESOLVED, that the Town Board of the Town of Danby encumbers the following 2005 funds : $5010 . 100 - Payroll A5010. 100 $ 1810. 20 - DA5142 . 400 (Cargill) $ 3636 . 32 - DA5142 .400 (University Sand & Gravel) DA5142 . 100 (to cover the last snow payroll Amount will not be less than $ 8 ,245 . 34 and will not exceed $ 12 , 000 . I 2 Town Board Minutes Year-end Meeting December 28 , 2005 Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously Supervisor Dietrich reported that information was received related to the bond proposal . The Town needs specific language in terms of proceeding with the bonds . Documentation that we spent $ 68 , 515 . 00 for the one and one half ton truck and that we always intended that to be covered in the bond proposal . The other is that the gradall was also expected to be part of the bond. He referred to the December 12 , 2005 Board Meeting where it is documented that purchase of the truck and gradall in such a way that it is understood that these items are all a part of the bond. RESOLUTION NO. 88 OF 2005 REIMBURSEMENT RESOLUTION OF THE TOWN OF DANBY, TOMPKINS COUNTY, NEW YORK, ADOPTED ON DECEMBER 28, 2005 PURSUANT TO THE PROVISIONS OF TREASURY REGULATION SECTION 1 . 150-2 (E) By Councilperson Gagnon : Seconded by Councilperson Varona-Lacey RESOLVED, that on December 28 , 2005 the Town Board of the Town of Danby, Tompkins County, New York, adopted as follows : 1 . The statements contained in this resolution with respect to the reimbursement of the expenditures described in this resolution are intended to be statements of official intent as required by, and in conformance with, the provisions of Treasury Regulation Section 1 . 150- 2(e) . 2 . The expenditures made from the Town' s general fund which are intended to be reimbursed pursuant to this Resolution have been incurred within 60 days prior to the date hereof (or earlier to the extent permitted under the applicable regulation) or will be incurred after the date hereof in connection with the acquisition of a one and one half ( 1 and '/2) ton truck (the "Project") . 3 . The size of the Project is $68 ,515 . 00 and the maximum principal amount of dept expected to be issued for the Project is approximately $ 68 , 515 . 00 . 4 . The Town reasonably expects to reimburse the expenditures set forth in this res9olution with the proceeds of tax-exempt debt to be incurred by the Town subsequent to the date hereof, but this resolution does not constitute a binding obligation to issue such debt. A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously RESOLUTION NO. 89 OF 2005 REIMBURSEMENT RESOLUTION OF THE TOWN OF DANBY, TOMPKINS COUNTY, NEW YORK, ADOPTED ON DECEMBER 28, 2005 PURSUANT TO THE PROVISIONS OF TREASURY REGULATION SECTION 1 . 150-2(E) By Supervisor Dietrich : Seconded by Councilperson Varona-Lacey RESOLVED, that on December 28 , 2005 the Town Board of the Town of Danby, Tompkins County, New York, adopted as follows : 1 . The Town reasonably expects to reimburse the expenditures set forth in this resolution with the proceeds of tax -exempt debt to be incurred by the Town subsequent to the date hereof, but this resolution does not constitute a binding obligation to issue such debt. Supervisor Dietrich said that the reference to the bond is in a resolution transmitted to the Town Bookkeeper by the Town Attorney on December 14, 2005 . He said that the resolution signifies that the Board agrees that the gradall was always thought to be part of the bonding Project. Supervisor Dietrich asked the Board to pass a resolution of intent for the bonding project . A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously RESOLUTION NO. 90 OF 2005 RESOLUTION AUTHORIZING VARIOUS PROJECTS IN AND FOR THE TOWN OF DANBY AT AN ESTIMATED MAXIMUM COST OF $582,500. 00 APPROPRIATING SAID AMOUNT THEREFOR, AND AUTHORIZING THE ISSUANCE OF UP TO $582,500.00 BOND ANTICIPATION NOTES AND SERIAL BONDS FOR THE TOWN TO PAY THE COST OF THE PROJECTS By Councilperson Gagnon : Seconded by Councilperson Strichartz RESOLVED, that the Town Board of the Town of Danby hereby states its intention to bond for the purchase of the following items : 1 ) One and one half ( 1 and %2 ) ton truck 2) One used gradall excavator 3 ) Construction alteration and remodeling of the Town ' s Highway Barns roof 4) The acquisition and construction of a salt barn and equipment and furnishings therefore 5) The acquisition and construction of the electric lines at the West Danby Water District Facility Councilperson Nolte asked if the auditors have looked at this information . Supervisor Dietrich responded that they had not. The audit was for the year of 2004 . A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously I� l 4 Town Board Minutes Year-end Meeting December 28 , 2005 APPROVAL OF WARRANTS Approval of West Danby Water District Warrant No. 13 of 2005 By Councilperson Gagnon: Seconded by Councilperson Nolte RESOLVED, that the Town Board of the Town of Danby approves the West Danby Water District Warrant No . 13 , of 2005 in the amount of $38 voucher number 63 . A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Ay Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously Approval of General Fund Warrant No. 13 of 2005 By Councilperson Strichartz : Seconded by Councilperson Nolte RESOLVED, that the Town Board of the Town of Danby approves the General Fund Warrant No . 13 , 2005 in the amount of $25 , 959 . 31 voucher numbers 572 - 606 . A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously Approval of Highway Department Fund Warrant No. 13 of 2005 By Councilperson Nolte : Seconded by Councilperson Strichartz RESOLVED, that the Town Board of the Town of Danby approves the Highway Department Fund Warrant No . 13 of 2005 in the amount of $ 12 ,987 . 90 voucher numbers 178 - 194 . A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously Other Business : Supervisor Dietrich reported that the Planning Board interviews need to be scheduled for a vacancy on that Board. He would like them to be scheduled at a time when there is a Board meeting and when councilpersons can be present. There are five applicants and each interview should be no more that twenty (20) minutes each. Recommendation to Tompkins County for Appointment to the Environmental Management Council (EMC) A motion was made by Supervisor Dietrich and seconded by Councilperson Nolte that the Town Board of the Town of Danby recommends the appointment of Robert Roe to be the representative for the Town of Danby on the Environmental Management Council .
