HomeMy WebLinkAbout2005-12-12 1 Town Board Minutes December 12 , 2005 TOWN OF DANBY TOWN BOARD MINUTES DECEMBER 12, 2005 PRESENT : Supervisor Fredric Dietrich Councilpersons : Joel Gagnon, Norbert Nolte, Naomi Strichartz, Gladys Varona-Lacey Others Present : Carol Sczepanski - Town Clerk Susan Beeners - Code Enforcement Officer Frank Proto - County Legislator Representative James Herson - Town Justice Members of the Public : Judy Van der Mark, Ann Klingensmith, Ames Brown, Bob Roe, Roy Casterline, Ronda Roaring, George Blanchard, Eugene Beavers Supervisor Dietrich called the meeting to order at 7 : 15 p .m. and led all present to the Pledge of Allegiance to the American flag . ADDITIONS/DELETIONS TO THE AGENDA Deletion - Proposed Bond Resolution - no final resolution received. Privilege of the Floor : Councilperson Varona-Lacey announced that Sue Howe asked her to report that on Saturday, December 17, 2005 from 10 a.m . to 2 p . m. at the Danby Federated Church there will be a community clothing give-away of clothing, blankets, toys, housewares, etc . This is open and free to anyone in the Town of Danby. Fire Commissioner Elections - Supervisor Dietrich reported that on Tuesday, December 13 , 2005 there will be a Fire Commissioner Election at the Danby Fire Station from 6 : 00 - 9 : 00 p . m . Tax Collection Draft - The Town Clerk communicated a draft article that the Tompkins County Town Clerk ' s Association is sending soon for publication in the Ithaca Journal regarding change in the dates Town Clerk ' s/ Receivers can collect Town and County Taxes . Members of the Public : Parking Lot Lighting - Bob said that he was representing his daughter reported that the new parking lot lighting system is becoming invasive to the point of disturbing their sleep . The lighting of the parking lot also lights up their home. He understands that there will be some mitigation of the lights soon. Sue Beeners reported that the lights on the building will be removed. Judge Herson said that the solution may be that the lighting system be put on a timer and that the lights on the building remain as they are on a sensor. Ann Klingensmith - presented a letter to the Board along with a petition regarding the proposed change in zoning in their neighborhood for the Bailey Homes Planned Development Zone . She said that the proposal is not suitable for their neighborhood . Judy Van der Mark - reported that she has a problem with getting information of Town news, i . e. Fire District Election for a Commissioner. Ames Brown - Supervisor has informed him that anti freeze could be detected with the proposed Aquifer Study. He believes that this chemical will not reach down into the aquifer. 2 Town Board Minutes December 12 , 2005 County Representative Report Representative Frank Proto reported on the following : 1 ) On December 20 the Legislature will be dealing with the final telecommunication towers DEIS . Lee Shurtliff will be willing to come to the Town to discuss the site on East Miller Road. Tompkins County will take charge of improvements on Curtis Road. 2) Cayuga Green Project and the tax abatement . 3 ) Re-assessment cycle - one year verses three year assessment - would tax payers be willing to take the risk of paying a larger increase in taxes should the market go up . There will be a public hearing in January to hear from residents . 4) Danby Highway Department has received a grant in the amount of $44 , 000 for the repair of a section of East Miller Road from Senator Seward. Councilperson Nolte said that it would have been nice if the Town Board had been informed that the Highway Department grant had been applied for. Aquifer Study Update Susan Beeners reported that she is working with Kate Hackett and thought she would have an agreement to be sent to the Town Board for their review and consideration. The Supervisor has the financing information . Supervisor Dietrich said that Senator Seward has generously offered to cover the financing from his office. A grant proposal will be submitted to help defray the cost of the study. We have money set aside to pay for the study through tax dollars . REPORTS : EMC Report - Robert Roe reported that the next meeting of the EMC will be for Year-end reports and election of the officers for 2006 . The SEQR Review Committee made recommendations to the County on various reports for the year. There were twenty(20) SEQR' s for major development changes . Highway Department Report : The Highway Department report for November 2005 has been received. Zoning Report Monthly Zoning and Code Enforcement Report for November 2005 has been received. Susan Beeners gave an update on the road in the CMC Development Project . The Town must take over the road after it has been completed for a period of one( 1 ) year. There may be a problem with storm water run off from the road. Community Council : Councilperson Strichartz reported that Community Council will hold their annual elections on January 12 , 2006 . Sunday there was a very successful concert. Planning Board Report : Robert Roe reported that the Planning Board in November received some technical information on the Proposed White Hawk Neighborhood Project . (Eco Village) There was a presentation on the conceptual plan presented that they are going to operate under and a conceptual plan presented by Bailey Homes for a proposed Planned Development Zone on Muzzy Road . The Planning Board recommended that they go back and reconsider some of the aspects of the proposal . There is a reconfigured plan for presentation at the December Planning Board Meeting. There is a subdivision application to create a mortgage lot . Recreation Partnership : Supervisor Dietrich said that he was going to be the Town of Danby Representative on the Recreation Partnership Board . A date and time of the next meeting has not been decided. Senior Citizen ' s Report Carol Sczepanski reported that the Senior Citizens Annual Christmas Luncheon was held on Thursday, December 1 , 2005 at Royal Court in Ithaca. It was a very light lunch with a limited menu but the best that could be arranged on short notice . 3 Town Board Minutes December 12 , 2005 OTHER REPORTS Representative Frank Proto said to Councilpersons Joel Gagnon and Naomi Strichartz that as out- going legislators, it has been a pleasure working with them. He said he didn ' t know what the Town has in mind for them. Task Force Update : The Town Clerk asked the Board to acknowledge the motion from the Task Force. Minutes from the Task Force was transmitted to the Board at their Agenda Meeting. Motion to Authorize Code Enforcement Officer to Obtain a Summary Title Report - Deputron Hollow A motion was made by Councilperson Strichartz and seconded by Councilperson Gagnon that the Town Board of the Town of Danby authorizes the Code Enforcement Officer to obtain a summary title report from a title agency for approximately $250 . 00 related to the land owned by the Town on Deputron Hollow Road and that the source of that funding be from account number A1989 . 400 . A roll call vote on the motion resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously Request From the Task Force to the Board The Board has received a request from the Comprehensive Plan Task Force that they be allowed to continue what they are working on to complete Round 2 and directed to where they go from there . Supervisor Dietrich reported that there were some reservations from the Board specifically around the idea of setting a very specific agenda. This is not necessarily something that we have to do at this time. He recommended that this request be placed on the January agenda. Tompkins County Planning Agreement - Extension 4 Town Board Minutes December 12 , 2005 RESOLUTION NO, 85 OF 2005 AUTHORIZATION FOR TOWN SUPERVISOR TO EXECUTE EXTENDED CONTRACTS WITH TOMPKINS COUNTY PLANNING DEPARTMENT By Councilperson Gagnon: Seconded by Councilperson Varona-Lacey WHEREAS, the Town Board of the Town of Danby approved time extensions of the 2005 Mapping contract and the 2005 Code Revision Services Contract with Tompkins County Planning Department extending the contracts through December, 2005 , and WHEREAS , the Code Enforcement Officer has requested that further time extensions be made for these contracts, now therefore, it is RESOLVED, that the Town Board of the Town of Danby hereby authorizes the Town Supervisor to execute time extensions of the 2005 Mapping Contract and the 2005 Code Revision Services Contract with Tompkins County Planning Department, extending the contracts through January, 2006 . A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously Motion to Request The Planning Board to Extend The Neighbor Notification Perimeter From 500 Feet to 1500 feet for the Proposed Bailey Homes Planned Development A motion was made by Councilperson Strichartz and seconded by Councilperson Varona-Lacey that the Town Board recommends the Planning Board to extend the Neighbor Notification perimeter from 500 feet to 1500 feet for the request from Bailey Homes for a Planned Development District proposed to be located on a Muzzy Road. A roll call vote on the motion resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously ABOLISHING THE POSITION OF PART TIME SECRETARY IN THE HIGHWAY DEPARTMENT RESOLUTION NO. 86 OF 2005 By Supervisor Dietrich : Seconded by Councilperson Gagnon RESOLVED, that the Town Board of the Town of Danby abolishes a part-time typist position in the Danby Highway Department for reasons of economy and redundant services . Discussion: Supervisor Dietrich reported that redundant services means that it is being done more than once. He said that he has already talked with the incoming board members and other people about this and they have no problem. He has already talked with the Highway Department Part-time Typist. Councilperson Gagnon said that we would be back to where we were before Bill Hall was Highway Superintendent. Supervisor Dietrich said that the Highway Superintendent has offered to do some consulting the first of the year and he thinks that the Highway Part-time typist has tentatively agreed to do some consulting if time permits . He said that basically what you are doing is moving it from being a separate building and a separate facility and all that function he will want to move it to the Town Hall as he does not want the highway to be separate from the town offices . . . 5 Town Board Minutes December 12 , 2005 The bookkeeper said that under Town Law the Town Clerk is supposed to do the abstracts and vouchers . The Town Board can assign additional tasks to the Town Clerk. Councilperson Varona-Lacey has concerns about how deliveries will be made to the Highway Department if there is not a person there to sign for them . A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously The Town Clerk reported that in the Town Clerk ' s Manual that the duties of the Town Clerk related to the Clerk ' s duties in preparing the abstracts is that the Town Officials and Department heads must prepare vouchers and submit them to the Supervisor or Town Clerk to be placed on the abstract. She/he then places the account numbers to be charged on the vouchers and prepares the abstract for review and approval of the Town Board. Motion to Set Date for the Organizational Meeting of the Board A motion was made by Councilperson and seconded by Councilperson Varona-Lacey that the Town Board of the Town of Danby sets Tuesday, January 2 , 2005 at 7 : 00 p .m . for the 2006 Organizational Meeting of the Board with the Agenda Meeting to follow . Approval of the Town Clerk ' s November 2005 Report A motion was made by Councilperson Gagnon and seconded by Councilperson Nolte that the Town Board of the Town of Danby approves the Town Clerk ' s November 2005 Report as submitted. A roll call vote on the motion resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously APPROVAL OF WARRANTS Approval of the General Fund Warrant No. 12 of 2005 A motion was made by Councilperson Strichartz and seconded by Councilperson Varona-Lacey that the Town Board of the Town of Danby approves the General Fund Warrant No . 12 of 2005 in the amount of $ 17, 748 . 26 voucher numbers 530-571 .
