HomeMy WebLinkAboutTB Minutes 1984-08-01 TOWN OF ITHACA SPECIAL BOARD MEETING August 1 , 1984 At a Special Meeting of the Town Board of the Town of Ithaca , Tompkins County , New York , held at the Town Offices at 126 East Seneca Street , Ithaca , New York , at 12 : 00 noon , on the 1st day of August , 1984 , there were : ® PRESENT : Noel Desch , Supervisor George Kugler , Councilman Henry McPeak, Councilman Robert Bartholf , Councilman ABSENT � Councilwoman Raffensperger Councilwoman Howell Councilman Cramer ALSO PRESENT : James V . Buyoucos , Town Attorney PLEDGE OF ALLEGIANCE The Supervisor led the assemblage in the Pledge of Allegiance . Supervisor Desch noted that the Town Board had set a public hearing for August 13th to amend the Building Permit Fee Schedule . He stated that in talking with the Building Inspector , Mr . Cartee had requested that Section 77 of the Zoning Ordinance governing the fees for an appeal before the Zoning Board of Appeals be increased from $5 . 00 to $ 7 . 50 . Also , Section 76 pertaining to the issuance of a Certificate of Occupancy . Presently no fee is being charged for the Certificate of Occupancy and Mr . Cartee requests a fee of $ 15 . 00 be established . Everytime a Certificate of Occupancy needs to be issued , Mr . Cartee must go out and inspect the premises . Town Attorney Buyoucos stated that he felt $ 7 . 50 was not enough for the appeal to the Zoning Board of Appeals , should be increased to cover the cost of the advertising . He went on to say that if someone comes in with a big project , the fee should be large enough to cover the legal notice in the paper . Mr . Buyoucos stated that he felt the Planning Board should also charge a fee for the legal notice , when a public hearing is involved . Councilman Kugler stated that he felt the Board should set a fee for a one-family dwelling with a graduated scale for income type properties . Dont ' hit the little person . RESOLUTION N0 . 126 ® Motion by Supervisor Desch ; seconded by Councilman McPeak , RESOLVED , that the Town Board of the Town of Ithaca hereby amends the resolution setting the date of August 13 , 1984 as a public hearing to consider increasing the fees charged for Building Permits under Article 75 of the Zoning Ordinance to also include allowing a fee of $ 15 . 00 to be charged for the issuance of Certificates of Occupancy under Article 76 of the Zoning Ordinance and an increase from $5 . 00 to $ 10 . 00 for an appeal to the Zoning Board of Appeals under Article 77 of the Zoning Ordinance . syvz Town Board 2 August 1 , 1984 (Desch , Kugler , McPeak and Bartholf voting Aye . Nays - none ) . Supervisor Desch stated that he had received a letter from Timothy and Ann Benedict of Winthrop Drive requesting an extension of the No Parking on Winthrop Drive . People using the play area at the Northeast School are parking along the road causing difficulty for cars to get through . There is also the danger that a fire truck could not get through . He went on to say that he had written the Benedict Is that the Town Board would hold a public hearing on August 13th . Councilman Kugler asked if this would restrict the people who live ® there from parking infront of their houses ? Supervisor Desch responded that is right the no parking should include both sides of the street . RESOLUTION NO , 127 Motion by Supervisor Desch ; seconded by Councilman Kugler , RESOLVED , that the Town Board of the Town of Ithaca will meet and conduct a public hearing on August 13 , 1984 , at 8 : 45 P . M . , to consider amending the No Parking Ordinance to include No Parking on both sides of Winthrop Drive from the entrance to the Northeast School parking lot , westerly to the intersection with Brandywine Drive . (Desch , Kugler , McPeak and Bartholf voting Aye . Nays - none ) . SCHEDULED PUBLIC HEARINGS Supervisor Desch stated that the remaining three items on the Agenda , Walter J . and Joyce Wiggins bed and breakfast project which requires the consideration of a local law to amend the Zoning Ordinance , a local law to revise Article II , Section 1 of the Zoning law and Rocco Luoente ' s project which also requires the adoption a local law to amend the Zoning Ordinance to permit conversion of 14 buildings , are public hearings . He suggests that the hearings be adjourned until a later date as we need to have all Board members present and on record . RESOLUTION N0 , 128 Motion by Supervisor Desch ; seconded by Councilman McPeak , RESOLVED , that the Town Board of the Town of Ithaca hereby reschedules the ublic P hearing to further consider the adoption of a local law to revise Article II , Section 1 of the Town Zoning Ordinance by adding to the list of permissible districts itemized in said Section , a district designated as a Special Land Use Distruct (Limited Mixed Use ) to August 13 , 1984 at 8 : 00 P .M . ® ( Desch , Kugler , McPeak and Bartholf voting Aye . Nays - none ) . RESOLUTION NO , 129 Motion by Supervisor Desch ; seconded by Councilman McPeak , RESOLVED, that the Town Board of the Town of Ithaca hereby reschedules the public hearing to further consider the enactment of a local law amending the Zoning Ordinance to establish a Special OqZ Town Board 3 August 1 , 1984 Land Use District # 1 to permit erection and operation of an 80 unit motel ( to be used as a Bed and Breakfast Inn ) on the property of Walter J . and Jouce Wiggins ( Parcel No . 6-36 -1-4 . 2 ) consisting of about 20 acres on the west side of the Ithaca-Danby Highway to August 13 , 1984 at 8 : 15 P . M. (Desch , Kugler , McPeak and Bartholf voting Aye . Nays - none ) . RESOLUTION NO , 130 Motion by Supervisor Desch ; seconded by Councilman McPeak , ® RESOLVED , that the Town Board of the Town of Ithaca hereby reschedules the public hearing to consider further the adoption of a local law which will amend the Town Zoning Ordinance to permit the conversion of 14 buildings on the Rocco Lucente , Sapsucker Woods Road Subdivision ( Parcel No . 6-70 -10-3 . 12 through 6 -70-10 -3 . 25 ) to August 13 , 1984 at 8 : 30 P . M . ( Desch , Kugler , McPeak and Bartholf voting Aye . Nays - none ) . PERSONS TO BE HEARD Mrs . Carl Mann , 103 Happy Lane asked if the Special Land Use District was only for the hospital or would it apply to all sections of the Town ? Supervisor Desch responded that the local law will allow specific consideration and creation of Special Land Use Districts . The public hearing notice mentioned "La Tourelle " , Rocco Luoente and the old hospital . A developer would come in for Limited Mixed Use designation for a specific property . Lake Shore West , Limited Mixed Use designation is for a specific proposal to allow shops , a bank , barber shop and gift shop . We are not talking about a Jamesway . From a land use standpoint , it makes sense to have Limited Mixed Use in some areas instead of changing the zoning . Mrs . Mann responded , if you want it changed , you would get a variance . Supervisor Desch responded not a variance , a rezoning . Town Attorney James Buyoucos added , the law says in an Residence R15 zone a person can have a business in their home . The Town isn ' t breaking any new ground . Mr . Carl Mann noted that the old hospital land had been surveyed and they were just wondering what was going on .
