HomeMy WebLinkAbout2005-03-07 1 Town Board Public Hearing March 7 , 2005 - Whyte Appeal TOWN OF DANBY PUBLIC HEARING MINUTES MARCH 7, 2005 - WHYTE APPEAL PRESENT : Supervisor Fredric Dietrich Councilpersons : Joel Gagnon, Norbert Nolte, Naomi Strichartz ABSENT : Councilperson Varona-Lacey (excused) Others Present Carol Sczepanski - Town Clerk Susan Beeners - Code Enforcement Officer Applicants - Riney and Audrey Whyte Members of the Public Bill Farrell , Betsy Darlington, Mel Westmiller, Randy Inge11, Jim Reagan Public Hearing Declared Open Supervisor Dietrich declared the public hearing open at 7 : 02 p . m . and read the following Notice of Publication : PLEASE TAKE NOTICE , that the Town Board of the Town of Danby will hold a public hearing on Monday, march 7 , 2005 at 7 : 00 p .m. , 1830 Danby Road, Ithaca, New York to Consider the Appeal by Riney and Audrey Whyte, property owners , of the one hundred-eighty ( 180) day prohibition of subdivisions set forth in Town of Danby Local Law No . 2 of 2004, adopted by the Town Board on September 14, 2004 and effective on September 28 , 2004 requesting review, under current regulations, ordinance, and laws, of the proposed subdivision of Town of Danby Tax Parcel No . 18 . - 1 -4 . 2 , 8 . 48+/- acres total, on Station Road, into two lots of 1 . 5 +/- and 6 . 98+/- acres each. Under the current Subdivision Regulations of the Town of Danby, the proposed subdivision would be classified as a Minor Land Division and would be subject to a Minor Land Division Permit. Interested persons may view the application at the Town Clerk ' s Office during regular office hours . All interested persons will be given the opportunity to be heard either in person or in writing. A regular meeting of the Town Board will follow the public hearings . By Order of the Town Board Carol W. Sczepanski , Town Clerk Dated : February 24, 2005 Published : February 26 , 2005 Communications : Affidavit of Publication Affidavit of Notification by Mail Susan Beeners gave a short description of the Whyte ' s property and the subject area where they are requesting permission to subdivide in order to sell a portion of their property. Audrey Whyte reported that she has contacted some of her neighbors and they do not have a problem with the proposal . Comments from the Public Betsy Darlington of the Land Trust - stated she is here to answer questions regarding the Land Trust property should they come up . Mel Westmiller said that he didn ' t have a lot of time to do research and to review the application. The previous owner wanted to divide the property into four (4) lots and was turned down. He asked who owns the land. The neighbors thought that the church owned the land . It looks like that by creating this lot it will be creating two (2) new lots . 2 Town Board Public Hearing March 7 , 2005 - Whyte Appeal Susan Beeners said that she does not recall receiving anything on paper from Dick Bergren related to subdividing this property. Audrey Whyte said that the proposal to subdivide met the zoning requirements when they were submitted. Randy Brown - asked if there was a bigger plan for this parcel other than this plan that the Whyte ' s have submitted. He asked that this not be done piece meal . The Board discussed the Whyte ' s Appeal and will make a decision at their March 14, 2005 meeting.
