HomeMy WebLinkAbout2004-10-11 . 1 4 6 I 1 TOWN OF DANBY TOWN BOARD MINUTES OCTOBER 11 , 2004 PRESENT : Supervisor Fredric Dietrich Councilpersons : Joel Gagnon, Norbert Nolte, Naomi Strichartz, Gladys Varona-Lacey Others Present : Carol Sczepanski - Town Clerk Susan Beeners - Code Enforcement Officer Attorney Charles Guttman Members of the Public : Mauro Marinelli , George Blanchard, Roy Casterline, Barry Craddock, Larry Parlett, Craig McAllister, Ames Brown, David Cook, Ronda Roaring and others Supervisor Dietrich called the meeting to order at 7 : 08 p .m . and led all present to the Pledge of Allegiance to the American flag. Additions to Agenda : Councilperson Gagnon said that he would like the Board to schedule a special meeting following the Budget Workshop on October 14, 2004 . No Board member objected. Privilege of the Floor : George Blanchard - 437 East Miller Road - has an issue with his bank related to the moratorium on subdivision of properties . The bank requires a plan for subdivision should he default on his loan. He requested a letter from the Town stating that the seven(7) acres could be subdivided off to be a saleable property. Dave Cook - 1737 Danby Road - thinks that the Board should have thought about implications that the moratorium placed on residents . Ames Brown - 1840 Danby Road - understands that Mr. Blanchard started his project before the moratorium was being considered . Barry Craddock - said he would have to go through the same thing with his property. Any time you own property the bank will require a minimum (certain area) that can be sold should the owner default. Ronda Roaring - South Danby Road - asked if there was anything in the ordinance that requires the posting of building permits, has notified the DEC that the Down and Dirty relay must be held someplace else next year, and she was concerned with the amount of shooting in Danby. Tom McAllister - Fieldstone Circle - concerned that the road in Fieldstone Circle has not been paved. The residents do not want oil and stone and request that the road be black topped. REPORTS : Highway Report - has requested transfer of $ 15 , 000 from DA2300 (Snow Revenue) to the DA5142 .400 Snow Contractual account. Councilperson Nolte reported that the Highway Department Superintendent is concerned that his budget request was cut as his fuel costs have increased . Community Council - Patricia Cartland has expressed interest in serving on the Recreation Partnership and has resigned as treasurer. Funds were approved for the Town Clerk ' s Office Assistant. Senior Citizens - went on a trip in September to Old Forge for a luncheon cruise, a scenic train ride and dinner. The September meeting was attended by 43 seniors and the entertainment Alice Dietrick and Bob Turk. Highway Department Discussion Supervisor Dietrich said that the budget for the highway equipment maintenance will be adjusted in the 2005 budget to reflect their request. He said he has a meeting with the bank for the finalizing of the financing package for equipment, the salt shed and other major purchases . RESOLUTION NO. 52 OF 2004 TRANSFER OF HIGHWAY DEPARTMENT FUNDS By: Supervisor Dietrich Seconded by: Councilperson Strichartz RESOLVED, that the Town Board of the Town of Danby approves the transfer of funds in the amount of $ 15 ,000 from DA-2300 (snow revenue account) to DA5142 . 400 (snow contractual account) . A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously RESOLUTION NO. 53 OF 2004 APPROVAL OF CONTRACT WITH TOMPKINS COUNTY DEPARTMENT OF PLANNING FOR CODE REVISION SERVICES By: Councilperson Strichartz : Seconded by Councilperson Varona-Lacey RESOLVED, that the Town Board of the Town of Danby approves the attached Contract with Tompkins County Planning Department for Code Revision Services , and authorizes the Town Supervisor to execute said contract, for a total contract cost of (one thousand six hundred fifteen dollars) $ 1615 , and with such cost to be paid out of Town of Danby Account A8020 . 401 . A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously CMC Subdivision Proposal Report Susan Beeners submitted materials for the Board to consider further location of the proposed public facilities, being the road, stormwater management facilities and two areas that are going to be stormwater easements . Dave Herrik and the Tompkins County Health Department have reviewed the plans . She reviewed the plans with the Board. RESOLUTION NO. 54 OF 2004 CONSIDERATION OF FURTHER ACCEPTANCE OF PROPOSED ROADS AND OTHER PROPOSED PUBLIC IMPROVEMENTS IN THE CMC DEVELOPMENT SUBDIVISION By Councilperson Gagnon : Seconded by Supervisor Dietrich j i I i � n I � �� ; I iI i 63 4 Town Board Minutes October 11 , 2004 A motion was made by Councilperson Strichartz and seconded by Councilperson Gagnon that the Town Board of the Town of Danby sets the date of November 4, 2004 at 7 : 00 p .m. to hear the public for the Preliminary Budget for Fiscal Year 2005 . A roll call vote on the motion resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously Motion to Reschedule the Budget Workshop for October 18, 2004 A motion was made by Councilperson Gagnon and seconded by Councilperson Strichartz that the Town Board of the Town of Danby reschedules the budget workshop of October 18 , 2004 to October 14, 2004 with a special meeting of the Board to follow. A roll call vote on the motion resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously Approval of Town Supervisor' s Report - September 2004 A motion was made by Councilperson Gagnon and seconded by Councilperson Varona-Lacey that the Town Board of the Town of Danby approves the Supervisor ' s September 2004 report as submitted. A roll call vote on the motion resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously West Danby Water District Fund Warrant No. 10 of 2004 A motion was made by Councilperson Gagnon and seconded by Councilperson Nolte that the Town Board of the Town of Danby approves the West Danby Water District Fund Warrant No . 10 of 2004 in the amount of $ 1 , 318 . 93 voucher numbers 47- 53 .
