HomeMy WebLinkAbout2004-08-09 . 1. 4 4 '7 1 Town Board Minutes August 9 , 2004 TOWN OF DANBY TOWN BOARD MINUTES AUGUST 9, 2004 PRESENT : Supervisor Fredric Dietrich Councilpersons : Joel Gagnon, Norbert Nolte, Naomi Strichartz ABSENT : Councilperson Varona-Lacey (Excused) Others Present : Carol Sczepanski - Town Clerk Susan Beeners - Code Enforcement Officer Members of the Public Joe Angels, Ames Brown, Michael Hovanec, Roy Casterline, Ronda Roaring, Bob roe, John and Antonia Rosenbaum, David Cook Supervisor Dietrich called the meeting to order at 7 : 05 p . m . and led all present in the Pledge of Allegiance to the American flag . ADDITIONS TO THE AGENDA Councilperson Strichartz asked that Community Council has asked that a resolution of support be placed on the Agenda. No Board Member objected . Privilege of the Floor : Councilperson Strichartz made an announcement that there will be a Blue Grass Concert here at the Town Hall on Sunday. The concert is sponsored by Danby Community Council and will be held outside if the weather is favorable. The Town Clerk reported that she had met with the County committee regarding the proposed changes in the election process . She also asked if someone could volunteer or be hired to take out the trash at 8 : 30 on Friday mornings . The bag is often to heavy for her take to the roadside . Michael Hovanec addressed the Board with a proposal that he plans to submit to the Planning Board. He said that the proposal is for the development zone on Muzzy Road. Ronda Roaring - reported that dogs are running loose near the parking area and the condition of South Danby Road is deteriorating. EMC Report - Robert Roe reported that the EMC will be reviewing the CMC Development proposal . The Town of Lansing is reviewing their subdivision regulations . Zoning Report : Susan Beeners reported that she has submitted a written report from the Code Enforcement Office for the month of July 2004 and reported on other activities her office is involved in. County Representative Report County Representative Proto reported that the County is looking at a 3 % increase in the tax levy and he would hope for a 5 % decrease in the budget . He also reported the public works department has a change in administration, Board of Health has received requests for smoking waivers, West Nile virus found in Ulysses . OLD BUSINESS PROPOSED LOCAL LAW NO. 2 OF 2004 RESOLUTION NO . 46 OF 2004 '. 448 2 Town Board Minutes August 9 , 2004 PUBLIC HEARING DATE SET - PROPOSED LOCAL LAW ENTITLED : "A LOCAL LAW PROVIDING FOR A MORATORIUM ON RURAL LAND DIVISION APPLICATIONS AND APPROVALS OF SUBDIVISIONS AND APPLICATIONS FOR REZONING". By Councilperson Gagnon : Seconded by Councilperson Strichartz RESOLVED, that the Town Board of the Town of Danby sets the date of Monday, September 13 , 2004 at 7 : 00 p .m . for a public hearing on the proposed local law entitled : "A LOCAL LAW PROVIDING FOR A MORATORIUM ON RURAL LAND DIVISION APPLICATIONS AND APPROVALS OF SUBDIVISIONS AND APPLICATIONS FOR REZONING" . Discussion : Councilperson Nolte recommended that the Board drop the whole moratorium thing. A roll call vote on the resolution resulted as follows : Councilperson Varona-Lacey absent Gagnon Aye Nolte Nay Strichartz Aye Dietrich Aye Carried NEW BUSINESS : RESOLUTION NO. 47 OF 2004 SEPTEMBER AGENDA MEETING DATE SET By Councilperson Strichartz : Seconded by Supervisor Dietrich RESOLVED, that the Town Board of the Town of Danby sets the date of Wednesday, September 1 , 2004 at 7 : 00 p . m. for the monthly Agenda Meeting . A roll call vote on the resolution resulted as follows : Councilperson Varona-Lacey absent Gagnon Aye . Nolte Aye Strichartz Aye Dietrich Aye Carried RESOLUTION NO. 48 OF 2004 TO TOMPKINS COUNTY LEGISLATURE- URGING FUNDING FOR RECREATION PARTNERSHIP PROGRAM By Councilperson Strichartz : Seconded by Councilperson Gagnon WHEREAS, the Recreation Partnership is an extremely popular and successful program, and WHEREAS, in 2003 , there were 206 Danby youth participating in Recreation Partnership programs, and 3 , 871 youth countywide, and WHEREAS, the current Tompkins County contribution to the Recreation Partnership program of $ 38 , 110 represents only three one-hundredths of one percent ( . 00003 %) of the total County budget, and WHEREAS, this contribution represents only 37 cents per resident of Tompkins County per year, now therefore, be it RESOLVED, that the Town Board of the Town of Danby urges the Tompkins County Legislature to maintain finding its share of the Recreation Partnership Program. A roll call vote on the resolution resulted as follows : Councilperson Varona-Lacey absent . 1449 3 Town Board Minutes August 9 , 2004 Gagnon Aye Nolte Aye Strichartz Aye Dietrich Aye Carried Budget Process for 2005 Supervisor Dietrich handed out information for scheduling of workshops and proposed public hearing date for the Fiscal Year 2005 budget . The public hearing must be held no later than the Thursday following the election. A schedule was presented to the Board . The Town Clerk is to send out budget forms to departments and committees next week . Forms and requests should be returned to the Supervisor and Clerk as soon as possible . Approval of Supervisor ' s July 2004 Report A motion was made by Councilperson Nolte and seconded by Councilperson Strichartz that the Town Board of the Town of Danby approves the Town Supervisor ' s July 2004 Report as submitted. A roll call vote on the motion resulted as follows : Councilperson Varona-Lacey absent Gagnon Aye Nolte Aye Strichartz Aye Carried Approval of Town Clerk' s July 2004 Report A motion was made by Councilperson Gagnon and seconded by Councilperson Strichartz that the Town Board of the Town of Danby approves the Town Clerk ' s July 2004 report as submitted . A roll call vote on the motion resulted as follows : Councilperson Varona-Lacey absent Gagnon Aye Nolte Aye Strichartz Aye Dietrich Aye Carried Discussion on Task Force Materials and Minutes Councilperson Gagnon said that we need to privide funds for the purpose APPROVAL OF WARRANTS Approval of General Fund Warrant No. 8 of 2004 A motion was made by Councilperson Strichartz and seconded by Councilperson Nolte that the Town Board of the Town of Danby approves the General Fund Warrant No . 8 of 2004 in the amount of $ 14, 772 . 33 , voucher numbers 340-376 . A roll call vote on the motion resulted as follows : Councilperson Varona-Lacey absent Gagnon Aye Nolte Aye Strichartz Aye Dietrich Aye Carried Approval of the Highway Department Fund Warrant No. 8 of 2004 A motion was made by Councilperson Nolte and seconded by Councilperson Gagnon that the Town Board of the Town of Danby approves the Highway Department Fund Warrant No . 8 in the amount of $24, 996 . 45 voucher numbers 91 - 112 . A roll call vote on the motion resulted as follows : Councilperson Varona-Lacey absent Gagnon Aye Nolte Aye 1459 4 Town Board Minutes August 9, 2004 Strichartz Aye Dietrich Aye Carried Approval of the West Danby Water District Fund Warrant No. 8 of 2004 A motion was made by Councilperson Gagnon and seconded by Councilperson Strichartz that the Town Board of the Town of Danby approves the West Danby Water District Fund Warrant in the amount of $277 . 65 voucher numbers 32-35 . A roll call vote on the motion resulted as follows : Councilperson Varona-Lacey absent Gagnon Aye Nolte Aye Strichartz Aye Dietrich Aye Carried Approval of CD Account Payment A motion was made by Councilperson Gagnon and seconded by Councilperson Strichartz that the Town Board of the Town of Danby approves the expenditures not to exceed $ 593 . 05 from the CD Special Grant Fund.
