SPECIAL BOARD MEETING
DECEMBER 30 , 1982
At a Special Meeting of the Town Board of the Town of Ithaca ,
Tompkins County , New York , held at the Town Offices at 126 East
Seneca Street , Ithaca , New York , at 10 : 30 A . M . , on the 30th day of
December , 1982 , there were :

PLEDGE OF ALLEGIANCE
The Supervisor led the assemblage in the Pledge of Allegiance .
INSURANCE PRESENTATION
Supervisor Desch called upon Mr . Boothroyd to make his insurance
presentation , saying that the coverage proposed is at least as good
as previously , and perhaps better .
Robert Boothroyd , Boothroyd Agency , Inc . , presented to the Board
his proposals for the 1983 Town of Ithaca Insurance Program . ( Copy
attached to the official minutes ) . Mr . Boothroyd stated that the
basic program had not changed , however , a few things had been added
on a blanket basis . He explained that Town coverage is on a
blanket basis , which means one considers all Town of Ithaca
properties , takes 900 of their combined total value , and then each
property is covered for their maximum ( $ 661 , 900 ) . He went on to
recommend that the Board consider the $ 1 , 000 deductible on the
Property Insurance as this would save the Town $ 700 a year . Mr .
Boothroyd stated that the rate will stay the same for three years ,
however , the premium may be different , it depends on variables such
as actual salaries paid , amount of roads paved , etc .
Councilwoman Kiefer asked if the premium also depends on the amount
of claims ?
Mr . Boothroyd answered no , however , every commercial policy is
experience - rated , and the Town is now receiving the benefit of
excellent claim experience .
-r -; Mr . Boothroyd went on to state that the insurance proposed is on a
replacement cost basis , and would pay for new items to replace
loss .
Councilman Cramer expressed concern that no insurance coverage was
shown for the computer .

Mr . Boothroyd explained that the computers were covered under a
special computer policy ; this is a separate package that is not
here yet but will be added . The premium will be $ 110 and covers
the cost of replacing the computer plus the cost to replace the
records lost .
Mr . Boothroyd stated that the Town was covered , under Comprehensive
General Liability Insurance , under the first level of $ 500 , 000 ,
then another policy takes over .
Councilwoman Raffensperger stated that sometime ago , the Town added
a rider to the policy to cover Bikeway , she asked if that was still
included in the policy ?
Mr . Boothroyd answered yes .
Mr . Boothroyd went on to say that the Valuable Papers policy SV was
similar to the computer policy , as it give the Town money to
replace records . Also , the policy pays to have somebody come in
and reproduce the record . Councilwoman Kiefer asked Supervisor
Desch if we had therefore put in a loss claim on the 1981 Minute
Books for labor to reproduce the record ? Mr . Desch answered no .
Mr . Boothroyd went on to explain that the Business Auto Policy
covers liablilty on all Town vehicles or vehicles not owned by the
Town but used by the Town for business or rental .
Councilman Jennings asked if collision insurance was carried on
vehicles over three years old ? Mr . Boothroyd responded that a
Board policy was instigated several years ago stating that all
vehicles five year old and under would be covered by collision
insurance . The policy is still in effect .
Councilman Jennings asked Mr . Boothroyd how he determined the cost
of collision insurance on heavy vehicles ? Mr . Boothroyd answered
that Cripsll Automotive was a good authority , also the insurance
companies have specialists in this area , and such an expert would
be called on . Supervisor Desch noted that in most cases , this type
of equipment does not depreciate very rapidly .
Mr . Boothroyd noted that the Unbrella Excess Liability policy was
very important as it afforded a second layer of protection : the
primary amount is $ 500 , 000 ; the excess amount is $ 5 , 000 , 000 . This
has a $ 10 , 000 deductible , which the Town must pay itself , and it
does not include legal fees . He went on to say that the Town has
potential for great loses , expecially if you are involved with
excavation for repairs .
Mr . Boothroyd said that it costs $ 2700 / year for the $ 5M ; for
$ 1200 / year more , coverage would be $ 10M ; he recommended the larger
figure for catastrophic occurances .
With respect to Public Employees Faithful Performance Bond , Mr .
Boothroyd said that for $ 50 , 000 coverage the premium is $ 340 . for
only $ 5 . 00 more , would get $ 100K coverage ; the Board preferred the
latter .
Mr . Boothroyd went on to say that the Town was required to carry
Worker ' s Compensation Insurance and that the premiums will vary
because they are based on wages . The wages paid would be up to
$ 225 / week minimum ( for life if necessary ) , the death benefit
depends on the worker ' s " economic worth " at time of death . He went
on to say that the Town ' s experience in the past few years had been
very good , therefore , he recommended that the Town accept Plan I
for Worker ' s Compensation coverage , which is experience - based .

Mr . Boothroyd stated that today it is a buyers market , as insurance
companies are scrambling for dollars . He recommends the Town ' s
coverage be carried by Maryland Casulty Insurance Company which has
an A+ rating and is a large , strong , good insurance company . Total
premium for the year would be $ 26 , 275 plus computer insurance and a
policy to cover errors and ommissions . Mr . Boothroyd noted that
the actual cost will be less than $ 26 , 275 as there will be a refund
on the current policy when it is closed out . He then thanked the
Board for the opportunity to serve the Town .
Supervisor Desch reviewed with the Board , the cost comparison
between the current policies and the proposals submitted by Ithaca
Agency and Boothroyd and the Board concurred that it was in the
best interest of the Town to accept the Boothroyd proposal with the
inclusion of the computer insurance and the other changes noted
above . The annual savings of approximately $ 16 , 000 over the 1982
costs reflects the buyers market , and the approach pursued by the
Supervisor are substantial benefits to the Town .
AUDIT AND APPROVE RECORDS
Building Inspector
Building Inspector Lewis Cartee presented his 1982 Year - End
Summary , covering Building Permits , Certificates of Compliances ,
Appeals , Sign Permits Issued , Complaints / Investigations and Area
Construction .
Councilman Cramer asked what the 1981 Building Permit totals were ?
Mr . Cartee responded , in 1980 , 90 permits were issued for a total
construction cost of $ 2 , 831 , 000 , including 13 new homes in 1981 ,
100 permits issued for a total cost of $ 4 , 661 , 000 , with 15 new
homes .
Supervisor Desch noted that it was very gratifying to see so few
complaint / investigation cases in the pending or adjourned category .

Motion by Supervisor Desch , seconded by Councilman Cramer ,
RESOLVED , that the Town Board of the Town of Ithaca , having
received the accounts and records of the Town Building Inspector
hereby approves the same , a copy of said account and records being
made a part of the Town records .

voting Aye . Nays - none ) .

RESOLVED , that the Town Board of the Town of Ithaca , having
received the accounts and records of the Town Clerk - Receiver of
Taxes , hereby approves the same , a copy of said accounts and
records being made a part of the Town records .

There are two plans available as follows .
PLAN I -
This is a retention plan with a maximum premium equal to the
discounted premium . The actual premium is based on a formula
as follows :
[ Discounted Premium X . 6041 + [ Losses X 1 . 101 = Earned Premium
The difference between earned premium and discounted premium
is returned to the Town as a dividend . If the losses for the
coming year are equal to the average of the losses for the years
' 79 , ' 80 and ' 81 , the dividend would be $ 2 , 993 . This results
in a net cost of $ 10 , 426 .
PLAN II
This plan involves a flat 10% dividend payable at audit . Loss
experience is not a consideration . This would result in a divi -
dend of $ 1 , 341 and a net cost of $ 12 , 078 .
RECOMMENDATION
In view of the excellent experience of the Town , we recommend
Plan I .

Supervisor Desch noted that Justice Wallenbeck ' s cases involving
dog control are down quite a bit from last year , while DWI cases
show quite a change , a reflection of the new legislation .

Area Sewer Bond Anticipation Note was 8 % and that he anticipated
Stone Quarry Road renewal would be around 8 % .

RESOLVED , that the Town Board of the Town of Ithaca hereby
authorizes the Supervisor to execute the renewal of Bond
Anticipation Note Number 4 for the Stone Quarry - Pittman Lane -
King Road West Water Improvement at the best interest rate that the
Supervisor can negotiate .

NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
Ithaca hereby approves the appointment of Montgomery May as
Chairman of the Town of Ithaca Planning Board for the year 1983 ,

FURTHER BE IT RESOLVED , that the Town Board of the Town of Ithaca
hereby approves the appointment of Carolyn Grigorov as Vice

PETTY CASH FUND - HIGHWAY DEPARTMENT
Supervisor Desch stated that in 1983 the Town ' s books would be set
up on an modified accrual system . He went on to say that the
Deputy City Comptroller has agreed to give the Town assistance in
setting up the books . From the view point of New York State Audit
and Control this procedure should not be delayed . With the accrual
system , we will also be implementing a purchase order system .
However , one of the first steps is to establish a petty cash fund
for the Highway Department for small purchases .
Councilman Jennings questioned the possibility of a separate
checking account instead of petty cash . Also , he noted a concern
for security .
Supervisor Desch responded that Audit and Control encourage the
establishment of petty cash . Also , the Highway Facility has a
safe , so security should be no problem .
RESOLUTION N0 .
Motion by Supervisor Desch ; seconded by Councilman Cramer ,
WHEREAS , the creation of a Petty Cash Fund is allowed under Section
64 , 1 - a of Town Law , and
WHEREAS , the Highway Department , in conducting the affairs of that
department , are called upon from time to time , to purchase items ,
the cost of which are relatively small , and
WHEREAS , the Town of Ithaca plans to institute a Purchase Order
System , and
WHEREAS , under a Purchase Order System , for the purchase of items
costing under $ 20 . 00 , payment for same is encouraged by Audit and
Control to be made from a Petty Cash Fund ,
NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
Ithaca hereby authorizes the creation of a Petty Cash Fund in the
amount of $ 200 . 00 for the Highway Department .

EAST ITHACA CONNECTOR
Supervisor Desch asked the Board members to review the draft letter
to Harris Dates , Chairman of the County Board of Representatives
regarding the status of the Countys consideration of the proposals

described in the jointly sponsored and developed East Ithaca
Circulation Study .
Councilwoman Kiefer felt that a reference should be made to the
resolution passed by the Town Board on December 14 , 1981 and the
County should be requested to respond to same .
Councilwoman Raffensperger stated that we have Frank Liguori and
Bill Mobbs resolution . We can talk with the Planners forever ,
however , we need to know that the legislative intent is .
Supervisor Desch agreed , we need a response from the legislature .
Supervisor Desch will revise the draft letter to Harris Dates ,
DEFENSE OF PUBLIC OFFICIALS
Councilwoman Kiefer asked when information on our proposed Defense
of Public Officials will be ready . Attorney Grossman thought early
January likely .

CODES AND ORDINANCE COMMITTEE

The Codes and Ordinance Committee has served a very useful purpose
in the past year even though no formal set of charges was
established at the outset . The review mechanism has provided a
forum for Town staff and board members to address particular issues
in an informal , thorough way so that the final product reflects to
the best degree possible the wishes of the people of the Town .
This enables the staff and the boards to utilize their time much
more effectively .
In 1983 , the role of this committee will be extended to review with
Staff , the overall status of Town Codes and Ordinances so that
where necessary such documents can be brought up to date . For
example , the ordinance dealing with the demolition of structures in
the Town of Ithaca dates back to 1960 . There are new provisions of
law that permit the Town to contract for the removal of such
structures and charge the costs as a lien on the property .
Specific tasks , such as the unsafe building ordinance , will evolve
from the review with staff of the overall codes inventory . In
general , the review should be completed by May 1 , 1983 with
adoption of the most pressing update by August 1 , 19830
Concurrently , the Planning Board is expected to complete its work
on the subdivision regulations for review by Codes and Ordinances
before a recommendation is forthcoming from the Planning Board ( a
similar process that has been used on the Cluster Rules and
Regulations ) .
Codes and Ordinances review of the new Zoning Law was completed
last year . The Town Boards continuing review will resume over the

winter with focus on legal review and staff efforts on the P zones .
Expected adoption date is July 1 , 1983 .
PARKS AND RECREATION PLANNING COMMMITTEE

The thrust of the committee charge will be the implementation of
the major parks development program provided for in the 1983 budget
and the updating of the Open Space and Recreation Plan . Public
works planning , in most respects , have advanced to the stage where
it is a matter of scheduling the design and construction work and
arranging financing .
Work Plan for the 1983 construction season will be presented by the
committee to the Town Board over the winter in time to order
materials and dovetail with the highway work schedule in the
spring .

The primary thrust of this committee will be a two pronged fire
protection plan development . Intensive negotiations with the City
of Ithaca will parallel the in - house preparation of a Town Fire
Department Plan . The complexity of the matter may preclude
completion by the end of the current three year contract on January
11 1984 . If the joint fire protection district option is chosen ,
special state legislation will be necessary . The committee is
charged to establish a timetable of decision points to assist the
board in timely action on the matter .
Although no specific planning budget for this work has been
established , it is recognized that some travel and other support
costs may be necessary . The chairman of the committee will present
a plan for such needs at the appropriate time .
In the Youth Services arena , the Human Services Coalition will be
assisting the City of Ithaca in the evaluation of the Youth Bureau

Facilities . The Town , through its activity on the Youth Bureau
Boards and its relationship with the Human Services Coalition will
be directly involved in this process .

The Personnel Committee has already been charged by the Town Board
to conduct a thorough review of Town staff and Town Board salary
levels and job descriptions during the year . In the context of the
job descriptions , the work of the committee may suggest the need
for additional staff .
Such recommendations are expected to be forthcoming to the Town
Board by August 1 , 1983 .
General
There are a number of objectives not directly related to specific
committee assignments that will require significant effort by staff
in the year ahead , including documentation of various procedures ,
statistical systems upgrading , etc .
Councilwoman Kiefer , referring to Codes and Ordinance Committee ,
suggested that we ask the Town Attorney to regularly alert us to
changes in New York State Legislation which affect what Town Board
can / must do , so that this committee could consider appropriate
changes in Town ordinances .
Both Councilwoman Raffensperger and Councilwoman Kiefer requested
summaries of the legislative changes sent out periodically by the
_. Secretary of State .
Councilman Cramer asked , if in response to Stewart Knowlton ' s
request for a local law to ban traffic from parking in fire lanes ,
will the local law be drafted in - house or by the attorney ?
Supervisor Desch responded that we have a copy of the Village of
Lansing ' s Ordinance which probably can be used as a model .
Councilwoman Kiefer questioned why there was not a committee called
Planning and why was Forest Home Circulation included under the
assignments of the Park and Recreation Committee ?
Supervisor Desch responded that the Town has never had a committee
called planning and that he did not think it was necessary since we
have an effective Planning Board .
Councilwoman Raffensperger stated that recreation is involved in
ways to plan for drainage and things like traffic circulation .
With respect to Public Safety , Councilman Jennings stated that
there was a need for some effort to be put forth to decide on an
administrative group for the joint City and Town fire department .
He also suggested the possible need for changes in the make up of
the Fire Commissioners ,
Supervisor Desch agreed that our effort in this area would need to
focus on these matters .

LAMPRICIDE CONTROL
Councilwoman Kiefer stated that the State Department of
Environmental Conservation , in order to deal with the presence of
sea lampreys in Cayuga Lake proposed , to add chemical poisons to
Cayuga Lake to kill the larvae next spring . She went on to say
that a public information meeting had been held by DEC and no one
from Bolton Point had attended since they were meeting at the same
time . She stated that she had serious questions about DEC ' s plans
to implement the program at this time . Mrs . Kiefer stated that DEC
planned on using two chemicals , namely TFM which is a liquid that
is applied in the streams which then moves down stream into the
lake in a block form . The other chemical is Bayer 73 which is
applied directly into the lake in granular form , which sinks into
the bottom of the lake . DEC is planning on dispensing this latter
chemical from aircraft , this time . She went on to say that
extensive testing has not been completed on Bayer 73 , EPA has used
it on an experimental basis .
Councilwoman Kiefer noted that treatment of Seneca Lake had begun
this year . It will take until next spring for the necessary
analysis to be completed , however , DEC plans to make a decision
this winter on whether or not Cayuga Lake will receive the
treatment . She recommends that no decision be make on applying the
chemicals to Cayuga Lake until the test results are received from
Seneca Lake . Mrs . Kiefer stated that she had received a phone
call from a Town resident who gets their water from Bolton Point .
The caller asked what measures would be taken to safeguard the
water . Apparently charcoal filtering is effective , but according
to a technician at Bolton Point , no one there has been contacted by
DEC about this matter .

Councilwoman Kiefer stated that she would like the Town Board to at
least write questions regarding Bolton Point and safeguards for the
water supply to DEC .
Supervisor Desch stated that the Water Commission has discussed
this issue and that the Staff was researching the problem . The
question is if the level of filtering is sufficient . He felt that
probably the filters were more of a safeguard than we think . The
Supervisor went on to say that he felt it was inappropriate for the
Town Board to take any action at this time . He stated that he
would bring the subject up to the Commission at their next meeting .
Councilwoman Kiefer responded that she did not think the Town Board
should oppose the action , only ask that DEC wait to implement their
program until results are received from Seneca Lake .
Supervisor Desch stated that he had received no negative comments
from the Bolton Point staff and there is no place in the state with
more qualified employees . The staff did review the EIS and it was
their judgement that they had sufficient information and it was not
necessary for them to attend the meeting .
Councilwoman Kiefer pointed out that conerns were brought out at
the meeting that did not appear in the EIS .
Councilwoman Raffensperger stated that the Board should ask our two
representatives to Bolton Point to discuss the public safety and
issue any announcements to the public .
