August 9 , 1982 At a Regular Meeting of the Town Board of the Town of Ithaca , Tompkins County , New York , held at the Town Offices at 126 East Seneca Street , Ithaca , New York , at 5 .& 30 P . M . , on the 9th day of August , 1982 , there were . PRESENT : Noel Desch , Supervisor George Kugler , Councilman Shirley Raffensperger , Councilwoman Marc Cramer , Councilman . Lawrence Jones , 211 Northview Road , West Robert Parkin , Highway Superintendent Representatives of the Mediaa Mary Earle ,' WTKO Will Astor , WHCU John Huenneke , Ithaca Journal PLEDGE OF ALLEGIANCE Supervisor Desch led the assemblage in the Pledge of Allegiance . REPORT OF TOWN OFFICIALS SUPERVISOR ° S REPORT The Supervisor reported that the sewer improvement application was substantially completed and would be forwarded to Audit and Control in the next day or so . The Supervisor reported that the Coddington Road water lane was being tested and is expected to be ready for individual house service connections this week . The Supervisor indicated that he expects Mayor Shaw will be setting up a meeting to discuss the City Site Plan Study for West Hill and South Hill Fire Stations . The Supervisor called to the Town Board ' s attention suggested uses for Federal Revenue Sharing Funds and a prioritized plan. for Town Water System Improvements . TOWN ENGINEER ' S REPORT The Town Engineer reported that the details , to allow the Corps of Engineers to perform work in Fall Creek , were being worked out with Cornell including the hold harmless clause . Mr . Fabbroni stated that the preliminary investigation survey of Burns Road to see if it is feasible to realign Burns Road has been started . The latest word is 1984 , when the County might upgrade the bridged Town Board Minutes - 2 - August 9 , 1982 PARK MAINTENANCE WORKER UPGRADE Town Engineer Fabbroni stated that Larry Stanton would be in a supervisory position with control of the Park Maintenance Crew and he felt- a small wage increase was desireable at this time . Mary. Call asked the Town Engineer if he would be making a final report on the Youth Workers so that the County could evaulate the possibility of offering the program again next year ? Supervisor Desch stated that he felt a final report on the Youth Program would be a very good idea . RESOLUTION NO . 101 Motion by Councilwoman Raffensperger ; seconded by - . . Councilman. _ . Jennings , - WHEREAS , Larry Stanton began in July of 1981 working for the Town of Ithaca continuously as a CETA Summer Youth Maintenance Worker Aide , CETA Work Training Aide , and part time Parks Maintenance Worker Aide , ' and WHEREAS , Mr . Stanton has been punctual and dependable , shown initiative , accuracy , skill and a positive attitude and assumed and coped with tasks of increasingly difficult levels of responsibility and leadership , NOW THEREFORE BE IT RESOLVED , that his part time position be extended through December 31 , 1982 at an hourly rate of $ 3 . 600 ( Desch , Kugler , Raffensperger , Cramer , McPeak , Kiefer and Jennings. voting Aye . Nays - none ) . rw HIGHWAY SUPERINTENDENT ' S REPORT The Highway Superintendent reported that the men have been hot . patching this past month in preparation of paving which should start around August 23rd . Surface treating started this month , _ The Highway Superintendent went on to say that he would like to attend the Highway Superintendent Seminar at Swan Lake , RESOLUTION NO . 102 Motion by Supervisor Desch ; seconded by Councilman Jennings , RESOLVED , that the Town Board of the Town of . Ithaca hereby authorizes Robert Parkin , Highway Superintendent , to attend the Highway Superintendent ' s Seminar at Swan Lake from September 28th to October 1st . ( Desch , Kugler , Raffensperger , Cramer , McPeak , Kiefer and Jennings voting Aye . Nays none ) , REPORT OF COUNTY REPRESENTATIVES Mary Call reported that the County Board of Representatives will hold a public hearing to deal with determining what to do with the land around the Biggs Complex not needed for public use . After the public hearing , negotiations will be held with a private buyer . µ HOSPITAL / BIGGS COMPLEX WATER AND SEWER SYSTEM JURISDICTION The Supervisor introduced the matter of the Biggs Complex utilities with a statement of Town policy . The written statement is on file . Town Board Minutes - 3 August 9 , 1982 A discussion was held on . the contents of a proposed letter to be sent to Harris Dates , Chairman of the County Board of Representatives and Ruth De Wire , President of the Tompkins Community Hospital Board of Directors . Copy of the letter sent to the above named persons is attached to the Official Minutes , RESOLUTION NO . 103 Motion by Supervisor Desch ; seconded by Councilman Cramer , RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes the Supervisor to forward a letter to the County Board of Representatives and the Hospital Board of Directors outlining the Town ' s policy and some historical background on the Town ' s water and sewer lines in regard to the conditions, of sale of the& old Biggs Hospital . ( Desch , . Kugler , Raffensperger , Cramer , McPeak , Kiefer and Jennings voting Aye . , Nays - none ) . REVENUE SHARING FUNDS RESOLUTION NO , 104 Motion by Supervisor Deschv seconded by Counc Uman Cramer , RESOLVED , that the Town Board of the Town of Ithaca will meet and conduct a public hearing at 6 : 30 p . m . , on September 13 , 1982 at the Town Hall , 126 East Seneca Street , Ithaca , New York to consider the allocation of $ 100 , 000 in Federal Revenue Sharing Funds for 1983E and to hear all interested persons in favor of or opposed to the . allocation , ( Desch , Kugler , Raffensperger , Cramer , McPeak , Kiefer and Jennings voting Aye . Law or a Resolution on theme defense of public officials . against liability for Town employees , officers and Board members . Town Attorney James Buyoucos suggested that the Board set a date for a public hearing . If the necessary information is not given to him in time , then the hearing can be adjourned . STATE TRAFFIC CONTROL INSTALLATION JUDD F ALLS / ROUTE 366 Town Engineer Fabbroni reported that the State DOT would like to install a traffic signal at the intersections of Judd Falls Road south , State Route 366 and the driveway into Wilson Lab , however , DOT is proposing to make Judd Falls Road north , toward Forest Home , one way south , with the center lane being . a turning lane . . After discussion , the Board adopted the following resolution . . RESOLUTION NOo 108 Motion by Supervisor Desch ; seconded by ' Councilman Jennings . WHEREAS , the New York State Department of Transportation has developed an in- house project to install a traffic control signal with controller at the SR 366 -Judd Falls South °Wilson Lab driveway intersection which would - require Judd Falls North to be one°way south between Kite Hill Road and SR 366 , . eliminating any northbound vehicles on Judd Falls North and requiring these vehicles to seek other alternatives , most likely , Tower Road to campus and Caldwell. Road to the northeast , and WHEREAS , the County , Cornell and Town staff recommended endorsement of the proposal as a short range improvement , all parties acknowledging the limiting factor of the geometry , approach grades , peak hour loading , approach queues , etc . , as these factors relate the daily chances of daily system breakdown , and WHEREAS , the County , Cornell , and Town staff request that NYSDOT consider adding an interconnected signal at Judd Falls Road North and SR 366 to alternate rights of way to the left turn lane ( to reach Judd Falls South ) and prohibiting left turn . from Judd Falls North to the east , NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of Ithaca that the NYSDOT short range improvement be implemented with modifications as appropriate to improve intersection efficiency and to provide special event flexibility , and BE IT RESOLVED , that such endorsement is subject to the : commitment by Cornell University to construct the road from Kite Hill Road extension to Town Road by December 1 , 1983 and , FURTHER BE IT RESOLVED , that should the improvement actually create substantially greater traffic problems in and around SR 366 , including Forest Home , as documented by ' before and after studies of the Town , the Town may petition the State to effect a return to � the existing dual flashing light and two -way traffic at Judd Falls Road north , as a fall back alternative . ( Desch , Kugler , Raffensperger , Cramer , McPeak , Kiefer and Jennings voting Aye . Nays - none ) . Town Board Minutes - 6 - August 9 , 1982 PERSONS TO BE HEARD Lawrence Jones , 211 Northview Road , West asked if the makeup of the Northview Road Park . had been changed because of: a _ survey of the neighborhood which showed the people wanted more increased use of the Park or if the decision was left to the Town Planner . He noted that the neighborhood was not informed of any change in plans . Mr . Jones went on to say that June 23 , 1979 he had written a letter to the Town Planner informing the Town that the area was a breeding . ground for Orioles , Chickadees and Woodpeckers , Also , the only sighting of a Lawrence ' s Warbler was adjacent to this area . He went on to say that he did not know what impact -the additional use of the Park would have on the bird population . Mr . Jones questioned how change in plans take place and is the Town obligated to notify neighbors ? : Supervisor Desch answered , the nature of the parks vary . Planning. process includes time and effort by the Park Committee working with the Engineering and Planning staff . Councilwoman Raffensperger stated that in 1979 a public hearing Was held . The Community was equally divided between play structures and passive . Families with young children compromised. to have play structures installed at a later date , with benches so that the mothers could watch their children . Charles Trautmann , 235 Forest Home Drive stated that the Town Engineer had written a letter on June 28 , 1982 , to the . residents and Cornell , regarding the Fall Creek dredging . Mr . Trautmann stated that he had responded to the Town Engineer , by letter , on July 8 , . 1982a He asked that these letter become part of the official minutes . Mr . Trautmann asked what the status of the project was ? Town Engineer Fabbroni responded that the intentions were to move ahead with the dredging of the bar . However , the Town does not choose to clean behind the dam because of problems with liability and equipment . He felt it was more fitting for Cornell to clearx - behind the dam , .-as they have the maintenance ability . WATER SYSTEM MASTER PLAN IMPROVEMENTS Supervisor Desch stated that the first action would be to look at design funds for the Water System Master Plan Improvements from the Revenue Sharing Funds which will be on the September Agenda . He stated that it may be impossible for the project to go to construction in 1983 . The Supervisor noted that the City of Ithaca is considering Bolton _ Point as a source of City water . APPROVAL OF MINUTES Councilwoman Raffensperger noted that the proposed changes in the minutes had not been discussed . Councilwoman Kiefer stated that the guidelines to minutes had not been discussed . Supervisor Desch stated that he felt the Board should avoid taking time at a Board meeting to discuss the minute of details of the minutes . THE CORNELL . Assistant Director RE : Fall Creek Dredging DATE : July 12 , 1982 Cornell Plantations asked Professor Art Bloom , Geology , to examine the gravel bars between the two one -lane bridges in Forest Home Drive , Generally , Professor Bloom agrees with your conclusion as expressed in your memorandum of June 28 , 1982 . With the deposition of gravel , after the October flood , the cross - section of the creek has been reduced and . therefore flooding is likely to occur with a relatively lower volume of water . Also Professor Bloom pointed out that if a log or ice jam occurs at the upstream end of the gravel bar , water is likely to be funnelled into the backyards of the homes . along Forest Home Drive and the channel of the stream may be diverted into that area . The Wildflower Garden of the Plantations is protected by the retaining wall upstream from it . However , we encourage the removal of the small gravel bar across from the Wildflower Garden and the gravel behind Gibson Dam . This would reduce the likelihood of the formation of an ice jam and , consequently , flooding and debris deposition in the backwater area of the Wildflower Garden . In conclusion , the interests of Cornell University and the surrounding properties are best served , we believe , by the removal of the gravel bars between the two one - lane bridges in Forest Home Drive . However , the presence of the large gravel bar does not directly affect our areas , but our consultant believes the residents on the north bank should be coin: cerned . We encourage and expect respectful treatment of the area by any machinery used to remove the gravel and we are willing to provide aC cess in a manner to be arranged . cc : C . Shipe , Westervelt , Lazar RE : Fall - Creek Dredging DATE : J" ly 8 , 1982 The * residents = of Forest Home listed above would . like to express their appreciation to the Town of Ithaca and - in particular to Mr . Fabbroni for their concern regarding stream damage resulting from the October 28.1 _ 1981 flood . After discussing . the matter with Mr . .Fabbronl and among ourselves we feel that we have pinpointed the mayor immediate hazards as well as potential low-probability problems caused by the events of last October . In this . memorandums we discuss our prefeerences for remedial stream. . work and several conditions we feel important. to preserve the character of the stream channel . Many people use Fall Creek in the area of consideraS; ion - for a variety of recreational purposes , including swi. rnming , . walking , bird watching , and fishing . We - request emphatically that any earthmoving activities be confined to. areas that can be completed in the time allotted . We feel this is important to prevent the creation of large stockpiles which may not be cleared for years . As an example , piles from stream work decades ago are s-till � readily visible behind the Palmer property , and tli:is we ' Waish to avoid in . . the future . Priority . Remedial Work 1 . After talking with all residents who received the .Tune - 2. 8 memorandum 'from Mr . Frabbroni , it became clear that the most . - pressing problem is the filled - in reservoir behind the Gibson Dam . The shallow depth causes reduced ice - carrying capacity and causes spring ice flows to back up onto - the Lazar property . As evidence of this effect , the Lazar property this past year sustained considerable ice damage , even though this year ' s ice flow was mild . In contrast , the pre - flood 1980 - 81 ice flow caused no damage , even though ii: was the heaviest ice flow an several decades . We encourage the Board to have the Corp of Engineers work on this aspect of the problem first , using a work plan, similar to that used by Cornell in its yearly dredging of the reservoir above Flat Rock . M s i PAGE 2 We further request that some of the - dredged material be used to fill a - stagnant inlet created by the flood between the wildflower garden and the Lazar property . This inlet , which formerly remained dry mast of the summer , is now a prolific breeder of mosquitos , - and its elimination would be greatly appreciated by the adjacent residents . 2 - . Several large rocks were deposited adjacent to the Shipe property during the flood , and , during high water , - these cause eddy currents that may lead to further loss of stream bank and yard . We would appreciate their removal . If this is impossible , they could be moved toward the center • of the stream where they can be partially buried in existing holes . . Removing the gravel. deposit just upstream from the upper bridge may help to prevent future streambank erosion by promoting flow in the center of the channel . 3 . . The October flood also caused considerable damage to the retaining wall at the Newbury property . We request that some gravel or larger stones be piled against the remainder of the wall to prevent further erosion . Remedial Work for Low Probability Events 1 . The Wolskis and Trautmanns , after examination of maps and . : s consultation with a specialist in hydraulics at Cornell , do not - consider the risk from future flooding or -ice flows to be major , even if no flood deposits - are removed . We therefore place removal of the gravel bar on the inside of the stream bend as a low priority , insofar as damage to property owners on the north side of the creek is concerned . If dredging of these deposits is to be pursued , however , we request that the work be confined to the section of gravel extending beyond the Cornell retaining wall and roughly 100 . yards downstream from the big . rock located behind the Wolski property . 2 . It is apparent that much of the buildup of sediments in the creek is due to the presence of Gibson Dam . Several residents signing this memo feel that long - term maintainence, - in the creek bed could be reduced or eliminated if the dam were removed or lowered. . We request that the Town consider this option as an alternative to future dredging . In closing , we wish to repeat our appreciation for the Town ' s concern . President Tompkins Community Hospital Board of Directors 148 Pine Tree Road Ithaca , New York 14850 Dear Harris and Ruth : The Town Board of the Town of Ithaca has reviewed the draft proposal ' — Conditions of Sale Old Biggs Hospital forwarded by Mr . Liguori on July 14 , 1982 . In responding to the per - tinent. aspects relating to- the Town of Ithaca ., we thought it perhaps worthwhile to state , for the record , the Town ' s policy and some historical background on these matters : ( 1 ) The Town does not participate in the cost of utility extensions to large tracts of undeveloped land . Such utility extensions- are the responsibility of ; the developers . The engineering details such as size , location of appurtences ( i . e . , hydrants) are subject to the approval of the Town : ' Once constructed , those elements of system mains , trunk sewers and collectors located in agreed upon municipal rights - of -way, including easements , are dedicated to the Town : ( 2 ) In the case of water improvements , the Town assumes no maintenance responsibility for internal systems beyond a master meter or in the case of residential properties , the portion beyond the curb box . ( 3 ) In the case of sanitary sewers , all laterals are the maintenance responsibility of the owners beyond the property • _ 2 _ line or easement limit , as the case may be . Historical Background , ( 1) The Town has in the past . two years invested in the following projects to improve the Trumansburg Road water delivery system • - ( a) Repair , painting of Trumansburg Road. Tank $ 26 , 000 (b ) Renovate Cliff Street Pump Station $ 52 , 000 . ( 2 ) The Town has completed a Master Plan: of Water System Improvement needs in the Town and one of the most urgent - needs is the reinforcement / replacement of the water main to the Trumansburg Road Tank at* an estimated cost of X250 , 000 . _ The existing 50 year old . main , constructed at the same time as the internal piping network around the Biggs Complex , is so heavily encrusted with rust build up that its capacity reduced to approximately 50% . ( 3 ) By agreement , Tompkins County dedicated the 6 " water main from the City line to the storage tank , the 5003000 gallon tank , property and right - of -way access to the Town in. 1966 . No other water lines beyond the master meter pit were transferred at that time, nor in the interum . . A11 these facilities had become - County property in 1965 .when the State turned over the complex to the County . : - (4) The Town of . Ithaca assumed responsibility for the trunk sewer from the South line of the . County/Hospital prop- erty to the City line in 1972 . Because of the poor condition of this sewer , identified by detailed investigations cony ducted as part of the SSES , the Town is committed to replace this line at an estimated cost of $ 100 , 000+ , in order to eliminate infiltration to minimize the Town share in overall treatment costs at the new jointly owned Wastewater Treatment Plant . ( 5 ) The Town of Ithaca had no opportunity to review and / or _ inspect any of the utility changes that were involved with the new hospital project , nor was the Town involved in the creation of the maintenance agreement between the County and: the Hospital . Town Position and Suggestion A . Sanitary Sewer System There is some substantial future potential benefit to the Town as a whole to have access to the existing trunk Line below the hospital and Biggs Complex . The existing alignment ( including an extension) could serve a major section of Indian - Creek and Dubois Road . The cost to replace the 7 , 200 .feet of existing "trunk line , from manhole 28 to the City line will be very high for the v following reasons : ( 1) The depth of the existing sewer , some under new Hospital spoil . ( 2 ) An auxiliary line will be necessary because of continuous hospital flow . ( 3 ) Extremely difficult terrain including rock involved with the alignment . ( 4) Construction constraints . under NYSDOTwright - of -way and pavement . _ The Town is willing to assume ownership of the trunk seiner from manhole 34 , a distance of 1 , 900+ feet to the south property line of the hospital property , manhole 28 , subject to the property owners granting a permanent 25 foot easement from the south to the north line of Parcel 24- 3 - 2 ( the edge of Indian Creek Road) on an alignment satisfactory to the Town Engineer , including an easement over any portions alw ready transferred by the County to another owner . The Town is not interested in the assumption of direct responsibility for the laterals and internal collector sewers _ connecting to the aforesaid trunk . The maintenance and operating arrangements that now exist clearly do have a number of inequities which are readily resolvable by the installation of individual water meters in each building . Such meters would enable the hospital to appropriately assess a water surcharge to the users of the system for administra- tive costs related to arrangements for repairs and allocation of costs for sewer usage . The hospital shall gay for the meter installation in their facility . In the event repairs are necessary to the Professional Build- ing / Hospital collector sewer , (manhole 30 to manhole 48C on attached drawing) such repairs would be arranged by the hospital and such costs allocated to the Town and Hospital on the basis of the percentage of the past year ' s metered water consumption by the Professional Building or other non-hospital metered users ultimately connected to the _ tota:l metered water consumption by facilities connected upstream of work to the collector system . Replacement of any portion or element of this collector sewer requires prior written. approval of the Town , in the event the Town is requested to participate in such costs . The engineer for the developers of all new connections to this main shall ascertain the availability of adequate ca- pacity , to the satisfaction of the Hospital and the Town , . . prior to approval of such connection . ( or successor owners of the collector) facilities on this collector to the total consumption in facilities connected upstream of work on the collector . Replacement of any portion or element of this collector requires prior written approval of the Town , in the event the Town is requested to participate in such costs . The Town will accept ownership ( if properly constructed) and maintain the new collector sewer constructed by the Medical Facility developers from manhole 38B to new manhole above County drive . The engineer for the developers of all new connections shall ascertain the availability of adequate capacity to the sat - isfaction of the . 'County ( or successor . owners ) and the Tom. , . prior to approval of such connection . The Medical Facility developers should reimburse the Hospital or County , for their water / seer consumption and surcharges by mutual arrangement . B . Water Distribution System The Town finds no basis for it to assume responsibility for 'Vi= the Hospital / Biggs Complex internal water distribution network beyond the existing master meter installation . The mere change of ownership of a part - of the property owned by the County is not justification. for the. Town to change its policy . As indicated above , the water line is in fair to poor condition to serve as part of the Town distribution network but is likely to be adequate for on site usage . * In the event public water serbice is needed in the Dubois Road/' Indian Creek Road area it , in all likelihood will be con- structed by the developers of the large parcels ( including .m " � the County or its successors ) with loop connection to Route 96 aria Dubois Road . In the -event repairs are necessary to the Hospital / County ( or successors ) water main from the meter pit , the shortest distance to the point of medical facility main connection , as shown on the attached map , the Town will share in such repair costs exclusive of the cost of lost water on the basis of the percentage of metered water . vsage by buildings of non-hospital / County (or successors ) usage in relations to the . total metered usage through the master .meter . ' Such repairs to be arranged by the Hospital . Replacement of. - any portion or element of . this water main shall require the . prior written approval of the Town of Ithaca . This commitment by the Town is contingent upon the building owners agreeing to install , at their cost , individual meters in each building to facilitate . the monitoring of leakage . The Town will not be involved with the reading of the lndi -- vidual meters , but the internal arrangements for distributing the cost of maintenance and leakage amongst - the parties owning and / or managing the properties can be made more straightfor. _ ward through the availability of these individual meter readings . The hospital could assess a surcharge for the handling of the internal repair cost and the administration thereof . These arrangements shall be delineated on a- utility map of the Hospital / Biggs Complex and subject to approval of. a . formal agreement to be prepared by Tompkins County , approved by Tompkins County , Hospital Board of Directors - and Develop ers of Medical- Facility . The Town of Ithaca may be a party to some of these- agreements , or separate agreements as may be appropriate . The Town of Ithaca endorses the proposal involving the County assumption of responsibility for the public use entrance drive commencing at present Trumansburg Road entrance , thru the complex continuing along the upper level only to Indian Creek Road , under an agreement to be negotiated with the Hospital. Corporation . The Towns commitment * to assume the responsibili- ties described above on certain water and sewer lines is subject to the acceptance by the County of the roadway as proposed . Fall Creek within Forest Home , huge deposits of rock 'and finer materials were deposited in Fall Creek particularly between the south bridge and the dam . During the height of the storm the eddy and reverse currents in the stream caused - considerable damage' to - the Shipe reA taining walls on the perimeter of - their property , some slight .washing - of the Newbury. retaining wall occurred as the crest of the creek waves generally came within a foot of the south - bridge deck and for a brief time splashing occurred over the4deck and around the north abutment . The Wolski and Palmer properties ' rear yard , ' were flooded with fines deposited there . Gravels and heavier . materials were deposited within the creek bed starting at - the Wolski property and ending at the dam structure . : While the darn and area adjacent to the Westervelt and Cornell properties had gradually been . filling in over the past teri years , after Cornell . - ceased annual dredging of the dam , the new deposit upstream and principally in the area of the Palmer property occurred instantly although some may recall such deposits in the same location years ago . As a part of the natural process of the creek seeking .a_ . near . course on the outside of the curve , the creek once past the high Cornell retaining wall burst into the wildflower garden area carry-- ing finer silts and driftwood . This spillover - continued on the west side toward the Lazar home flooding below , g ground areas of _ the house and coming within 10 feet ( horizontally ) of the front stoop . As a part of the flooding the dam was . completely filled up with fill and debris , the west dam wingwall -was severely washed under , and the associated . washout remains today . After the storm the Town attempted to obtain disaster - funds as a means to repair . damage done in the above described areas as well as other areas upstream and • townwide . A general public federal disaster declaration was never approved by Governor Carey ' s office . However , alternative means of help and funding were aggressively . pursued through SBA for private homeowners , Soil Memorandum Fall Creek Dredging - 2 - June 28 , 1. 982 Conservation Service for erosion control and bank stabilization , and Army Reserve training for general but limited assistance . SCS will repair the damaged retaining wall along Forest dome Drive at Flat Rock . Various options for clearing debris and making permanent repairs have been discussed by the Town and Cornell . In Forest Home , the Town saw an opportunity to act on behalf of the public interest of its landowners adjacent to the creek . It seemed to us with the creek bed almost halved in width , near the Palmer property the potential of ice jams , snagged debris , etc . creating a higher repeat chance of flooding for the Trautmann , Wolski , Palmer , Shipe , and Cornell Treatment proper- ties in the to be expected annual runoff occurrences is very real . . Also , with debris left as . is , the probability of annual flooding and debris deposition on the Cornell plantation and Lazar lands and accelerated deterioration of the Lazar retaining wall is very likely . When the dam was annually cleaned and deposits removed the inside ( east ) side stream channel actually .. had a chance to gradually wear away and self - cleanse . Now the immediate prospects , given the quantity and unit weight of the . new material and the fill behind the dam , seem to be more deposi - tion and lessening of the non - flood channel capacity . The large deposit will also act as a dam during high .. water and place the south bridge and the properties immediately to the east in jeopar- dy of severe washing . The Town pursued a cooperative venture with the Army Corps of Engineers Reserve training unit whereby such heavy equipment training might be fulfilled by removing a small amount of the fill during one weekend , the unit ' s time limit on any one site . This would leave much more material to be removed by the Town and Cornell University over the next . few years as - in.-kind forces and time allowed . Such a project was approved by the Town Board at its June meeting whereby fill would be removed from Fall Creek between the two bridges by . the Army gaining access totally over Cornell lands west of the creek and with the Town sponsoring the operation which . would seem to benefit the public interest at little cost and no direct impact as the entire operation would be on Cornell land . In the past week I have been made aware of some opposition to the Town ' s proposed action on the basis of anything from the hypothesis that the stream has stabilized and will reach. a new equilibrium by washing away the new fill over time to the notion that the fill has created a new recreation area on Cornell land for the use of the community . As I have stated , I believe , if left as is , the stream will fill in farther to the upstream and downstream sides of the newest deposition and in time a continu- ous land mass will occupy the eastern half of the stream , the dam. will remain filled , and the potential for flooding will increase dramatically for adjacent property not protected by ten foot retai - ning walls . Some evidence of my feelings can be verified by the height the freeboard over the dam now reaches during routine runoffs i Memorandum Fall Creek Dredging - 3- June 28 , 1982 The Town has no obligation to sponsor a stream maintenance project although we have the legal authority with appropriate ease - ments . Without some indication of your support of this program in writing it is possible that the Town Board will consider with- drawing its - involvement in the project when the Board meets on July 12 . I trust you understand- that the withdrawal by the Town from this stream maintenance project will leave you , the property Owners , with the burden of the total cost for future stream main - . . tenance work as well as repairs to all flood damage to private property .
