HomeMy WebLinkAboutTB Minutes 1982-05-10 PO TOWN OF ITHACA REGULAR BOARD MEETING May 10 , 1982 At a Regular Meeting of the Town Board of the Town of Ithaca , Tompkins County , New York , held at the Town Offices at 126 East Seneca Street , Ithaca , New York , at 5 : 30 P . M . , on the 10th day of May , 1982 , there were PRESENT : Noel Desch , Supervisor George Kugler , Councilman Shirley Raffensperger , Councilwoman Marc Cramer , Councilman Henry 11cPeak , Councilman Dooley Kiefer , Councilwoman David Jennings , Councilman ALSO PRESENT : Robert Parkin , Highway Superintendent Lawrence Fabbroni , Town Engineer Susan Beeners , Work Study Student Gust Freeman , County Board of Representatives Representatives of the Media : Lisa Best , WHCU Carol Boyd , WTKO PLEDGE OF ALLEGIANCE Supervisor Desch led the assemblage in the Pledge of Allegiance . REPORT OF TOWN OFFICIALS SUPERVISOR ' S REPORT Supervisor Desch asked the Board Members to notice the new clock urchased for the Board Room at Rothschild ' s . A real bargin at p$ 25 . 00 . The Supervisor stated that he was happy to report that we have been successful in most of the speed limit requests in the Coddington Road area . The changes are : 30 MPH area speed on Pennsylvania Avenue / Kendall Avenue , 30 MPH on Northview , 30 MPH on Coddington Road from Juniper to the City line , 40 MPH Coddington Troy Road to Juniper and 45 MPH on East King Road to Troy Road . This is very close to the request . We are still awaiting a response on Elmira Road , Councilwoman Kiefer asked if the . new speed limit signs had been posted yet ? Supervisor Desch responded that a .. modification in the traffic law was needed first , then they will be posted . Supervisor Desch went on to report that American Community Cablevision provided the details of the cost for cable extension to Hayts Road in the Town of Ithaca at a meeting at the Town Hall on April 29 . Several residents plan to pole the neighborhood to find level of current interest and ATC agreed to look at a routing via Bundy and Hopkins . There are indications that we may be receiving a rate increase request . Under the line extension policy , the Hayts Road extension cost will be shared between ATC and the property owners . The property owners , if everyone subscribes , have , a one time cost of about $ 150 over two payments . r Town Board Minutes . 2 May 10 , 1982 Thanks to the aggressive pursuit of our Town Engineer , the final grading , seeding and mulching of the playfields at Dewitt Park was completed just ahead of Saturdays rain . The School District provided assistance on Thursday and Friday and all hands pitched in from the Town Engineering and Highway work force . There is a possibility that a thick stand of grass may be in existence to such an extent that Fall use of the fields would be possible . It . depends on the frequency of showers over the summer , Supervisor Desch reported that we may soon have the financing put together for the Town ' s share of the Outfall Project . At the June meeting , - it may be passible to set a hearing for authority to borrow $ 1 , 600 , 000 for the total Town share of the outfall . Our local costs will actually be . only $ 200 , 000 plus_ some short term carrying costs . There are two sections of State Law that provide for this debt to be excluded from our debt limits . : At the present time , all Town debt is excluded from our limit of about $ 12 , 000 , 000 . This is important for a continuation of our healthy AA bond rating . However , Section 124 runs - out on January 1 , 1983 , because the Legislature forgot to extend the . constitutional amendment and put it . on last years ballot . We may have to use Section 123 , which has to be renewed every year . It is utilized for revenue producing municipal . operations , . such as municipal power , parking garages , . etc . Only that portion of the debt recovered from revenue such as sewer rents is excludable and in the first year , only 75% of the total is eligible . With our combination of benefit formulas and water rates we have a 64 / 36% mix of debt recovery thru rates and benefit . respectively . This provides a sound balance between developed /undeveloped taxable and exempt property and may be applicable to the . sewer project . It would mean only a non - excludable debt of $ 576 , 000 for the outfall of which we would use only $ 72 , 000 on long term borrowing . . For the plant project , . $ 11 , 200 , 000 would be our total borrowing with $ 4 , 032 , 000 not excludable , of which we would use only $ 504 , 000 for long term borrowing , assuming that State and Federal grants were applicable for the 87 . 5 % . There will be more coming on this soon . The Supervisor went on to say that the City and Town , jointly ; will be asking the following bodies to nominate persons to serve on a Citizens Advisory Committee to help us evaluate our industrial pretreatment needs . The groups to be asked are . League of Women Voters , Senior Citizens Council , Tompkins County Economic Advisory Board , Chamber of Commerce , Machinist Local 1607 , Plumbers Local 109 , Ithaca Environmental Commission , Tompkins County Environmental Management Council , -News media , Municipal Boards , National Cash Register ; Morse -Borg Warner , Ithaca - Gun Company and Cornell Utilities . Preferably , persons appointed to this committee will live in the service area of the new plant . Supervisor Desch stated , the . Board , that in their packet of information , you have the breakdown of a proposed budget revision which does not show on the agenda because my final review was not . approved until Friday . What the proposal does is to breakdown the specific parts of the Highway Improvement Item so that the staff can properly plan work during the construction season . The total dollar figure does not change from the approved budget . More on this later in the meeting . The Supervisor noted that the County seems to be moving forward with some decisions on the use of the Biggs Complex . It seems clear that we will end up with a combination public / private occupancy . I do not propose that the Town Board take an official position , at . this time , on specific proposals . However , I believe we should encourage the County to consider a major block of space for high technology operations , subject to our normal zoning review . Such use could help our economy considerably including returning much of the complex to the tax rolls . We hope the County does not submit to the temptation of moving a large part Town Board Minutes I - 3 - May 10 , 1982 I of the County operations to the complex on a permanent basis but we do recognize the pressures to downtown .space . . Any moves of County offices should be accomplished without significant renovation cost . County Representative Gust Freeman stated that there would be a public hearing tonight and again on Thursday . night at the Public Library for public input on the proposed use of the old hospital . Councilman Jennings asked if there was a resolution to be passed now ? Mr . Freeman . answered no . The County received the Human Services Coalition Report a week ago , and this is the basis of the meeting . Councilwoman Raffensperger asked Mr . Freeman if there were any . files on people . . or businesses who inquired into . uses for the hospital property ? Mr . Freeman responded yes . there is a file , however , only two inquiries were received . Frank Liguori has the file .. Councilwoman . Raffensperger stated that someone had called her to ask if the file existed . The report she received was that a number of inquiries had been received , however , the County had never acknowledged receiving them . County Rep Freeman stated that all inquiries had been acknowledged . He went on to say that Downings proposal showed the most interest . However , it . was only a pipe dream , as he never presented any figures . COUNTY BOARD OF REPRESENTATIVE ' S REPORT County Representative Freeman reported that the County had passed a resolution to hire a consultant to prepare a sludge report for the proposed sewer project . Mr . Freeman asked the Highway Superintendent Robert Parkin how the Spring Clean - up was progressing ? The Highway Superintendent answered . that they were about finished . The amount of trash was about double from the previous clean-up . TOWN ENGINEER ' S REPORT Town Engineer Lawrence Fabbroni reported that regarding the Safer - Off Systems , he has had a pre - construction meeting on. : the installation of the culvert , pipes on Stone Quarry and Burns Roads . Materials will be ordered as soon as he has the go ahead . . He went on to say that the Contractor on the Coddington Road Water Project ( Lafayette Pipe line , Inc . ) has sent in their insurance papers . A pre - construction - meeting should be held in two weeks . The project should then be accomplished in a three to four week period . The Town . Engineer noted that he was expecting the license for the East Ithaca Bikeway in a very few days . Mr . Fabbroni stated that the Supervisor had submitted the necessary papers and addendum to the Soil Conservation Service for work on Fall Creek . An agreement was being worked out with the Corp of Engineers and Town and Cornell to remove large rocks and sand in the area of the Wildflower Gardens : The sand and rocks are restricting the water flow . He further noted that the Corp has a limited amount of time to spend on the project , usually they work weekends . The permit to enter the creek is taken care of by the County application . Town Board Minutes - 4 - May 10 , 1982 The Town Engineer stated that he had submitted an application to CETA for eleven summer CETA people to work on the Park Program . The State seems to be approving approximately 2 / 3 to 1 / 2 of the amount requested . He felt he would be lucky . to get six people . County Representative Gust Freeman reported that Phil Shurtleff had proposed the County put up money to hire youths . He suggested the Town might be interested in looking into this proposal which might also speed up the time element involved in a State program . The Town Engineer stated that the Summer Youth Program was a little more stream lined . The State tends to be less bureaucratic because of the time limit of the program . Also , we have learned a lot from past programs . He went on to say that the Valley View sewer extension construction was underway . The 300 ' . section will sewer all houses on Valley View Road , The Northeast Transit has agreed to provide a summer service similar to the Christmas service , also to experiment with an additional service to provide bus service to Cass Park . ARC is funding part of the deficit . The summer service will provide two buses , nine hours a day plus the one . and one = half hour run to Cass Park . He went on to say that he was asking the Board to authorize $ 1 , 000 for the period of June through August and $ 3 , 500 to cover the period of September through December . He stated . that he hoped eventually the Town would be able to get a one year contract instead of two contracts each year . Supervisor Desch asked if the City was going to provide the bus service to Cass Park ? The Town Engineer answered no , Swartout and Ferris will provide the service . RESOLUTION N0 , 62 Motion by Supervisor Desch ; seconded by Councilman Cramer , RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes the expenditure of $ 1 , 000 to continue the Northeast Transit Bus route at the level of the Christmas holiday from June to. August , with the addition of . an experimental run added to Cass Park , funded by ARC , and FURTHER BE IT RESOLVED , that the Town Board authorize the expenditure of $ 3 , 500 for service from September through December , at the present level of service . ( Desch , Kugler , Raffensperger , Cramer , McPeak , Kiefer and Jennings voting Aye . Nay - none ) . Town Engineer Fabbroni went on to say that all the highway men had jumped in when they were needed last week to pick stones on the Dewitt Park project , inorder to complete the seeding before before a change in the weather . He noted that the School District seems to still be unhappy with what we promised and with the conditions of the field . Supervisor Desch stated that if the Town Board members received any complaints or . comments , they should refer them to either Councilwoman Raffensperger or himself as they were familiar with the agreement made with the School District , Councilwoman Raffensperger stated that she was very clear as to what the Town promised and she felt the Town had given more than was originally promised . Town Board Minutes - 5 - May 10 , 1982 Councilwoman Kiefer asked what was the problem ? Town Engineer . Fabbroni that the field was stripped , regraded , . and what top soil there was there was put back . The field was de -s:.tonbd , however , there are still little stones , Nothing that forty thousand dollars of top soil won ' t take . care of . Supervisor Desch noted , if :you remember , when Dewitt and Boynton were bid , they came in way over bid so several areas were cut: , including top soil for the fields . HIGHWAY SUPERINTENDENT ' S REPORT Superintendent Parkin reported that the Tompkins County Highway Department had received their bids for material . Surface treating oil was down 20 % , limestone was up 10% , as was salt and gravel . However , sand was down 10% . Steel pipe was up 5 to 10% . Supervisor Desch asked if this was a fixed price ? The Highway Superintendent responsed that blacktop and oil are not locked in , however , the remainder are . Mr . Parkin reported , that the new Highway employee started on. May 6th , just in time to pick stones . His name is Joseph McCoy and was hired at $ 5 . 25 per hour . He has a Class I license and one year of mechanics schooling . Spring Clean - up is progressing , the . men worked three days last week , all day today and it will take all day tomorrow and possibly half a day Wednesday . Mr . Parkin noted that most of the Town of Ithaca signs have now been installed by the County . The Highway Superintendent stated that work was progressing on cleaning ditches , shoulder repairs , brooming of roads and the catch basin on Concord Place . Councilwoman Kiefer questioned the work with the Army Corp of Engineers , who will take . care of the procedures necessary for SEQR and will it hold up the work ? Town Engineer Fabbroni stated that he could not answer , however , if SEQR is required , the Town will handle all the necessary details . County Representative Freeman stated that he felt the Bulk Stream Entrance Permit would meet all requirements . GROUP HOMES Councilwoman Raffensperger stated that she was presenting to the Board a resolution requesting that the Town o. f . Ithaca Planning Board set a list of criteria as guidance for the Town Board so that we will not find ourselves in a position of having to judge each case individually . Supervisor Desch noted that the Town Attorney had reservations regarding the Planning Board getting too specific . He felt the Planning Board had always conducted themselves in a business like and proper manner . RESOLUTION N0 , 63 Motion by Councilwoman Raffensperger ; seconded by Councilman Cramer , Town Board Minutes - 6 - May 10 , 1982 RESOLVED , that the Town Board of the Town of Ithaca concurs with that section of the Town of Ithaca Planning Board resolution. (April 13 , 1982 ) , which affirms the general suitability of locating a group home for the developmentally disabled in the Town of Ithaca , and FURTHER BE IT BE IT RESOLVED , it is hereby requested that the Planning Board of the Town of . Ithaca develop a list of criteria to be employed by the Planning Board and for the guidance of the Town Board in considering any . further request for approval of such a . use . ( Desch , Kugler. , Raffensperger , Cramer , McPeak , Kiefer and Jennings voting Aye . Nays - none ) . Councilwoman Kiefer stated that she was glad to see the Board doing something before another request is received . HIGHWAY FUND TRANSFER AND BUDGET AMENDMENT f, Supervisor Desch stated that over the years , the Town .Board has followed the practice of transferring. siirplus money from Item! . III to the Reserve Fund to buy the necessary expensive equipment : RESOLUTION N0 , 64 Motion by Supervisor Desch ; seconded by Councilman - Kugler , RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes the transfer of . $ 25 , 275 . 05 from the 1981 Year End . Budgetary Account Surplus from Highway Fund , Item III . , Account Code No . DM5130 . 2 Machinery Fund to Capital Reserve for Machinery . ( Desch , Kugler , Raffensperger , Cramer , McPeak , Kiefer and Jennings voting Aye . Nays - none ) . RESOLUTION NO , 65 Motion by Supervisor Desch ; seconded by Councilman Kugler , RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes the Budget Amendment to Highway Fund , Item I , Permanent Road Improvements , Account Code No . Nays - none ) . -APPROVAL OF TOWN BOARD MINUTES Supervisor Desch stated that he had a more detailed review of the list of 1981 Objectives in the January minutes . Under Town Board Minutes - 7 - May 10 , 1982 " Capital Projects " , Cliff Street Pump Station Renovation was done ; Town Hall Rehabilation and Dewitt Park project are almost done , the scope of the Northeast bikeway may need to be changed because of the lack of outside funding . Discussions . with Cornell on the license for the East Ithaca Bikeway continue . Under " Local Legislation " there is a revised benefit formula , anew Town fire protection code , the new Zoning Law is in the legal review stage with further work required on P - 1 and P - 2 zones ; revision of the subdivision regulations is proceeding . Under " Intermunicipal Agreements " , there is agreement with the City on the Wastewater Treatment Plant ownership and operation , and there are bus service agreements on the Hospital / Ithaca College , East Ithaca and . Northeast Transit services , but the City turned down use of the Tin Can site for the YMCA . We have a new three year contract with the City of Ithaca for Fire Protection in the Town , but no in - lieu of contribution from Ithaca College was forthcoming . Planning Studies - Water System Improvement planning is well underway with the work being. done by Stearns & Wheler engineers , no work was done by the Town on a noise control ordinance . The snow removal arrangement with the County was reviewed and snow plowing routes . have been adjusted . The County has a consultant to study a multiphased approach to the solid waste disposal needs of the County . Under Administrative Studies - water and sewer bonds were not sold because of high interest rates , the in - house computer study was completed and the election districts were revised as planned . A copy of Councilwoman Kiefer ' s corrections are attached to the official minutes . Councilwoman Raffensperger stated that she found only one correction , Northeast Transit was listed when it should have read East . Ithaca Transit . Approval of the minutes was postponed to give the Board Members time to review Councilwoman Kiefer ' s corrections . BOLTON POINT WARRANTS RESOLUTION N0 , 67 Motion by Supervisor Desch ; seconded by Councilman Kugler , RESOLVED , that the Bolton Point Warrants dated May 10 , 1982 , in the Operating Account are hereby approved , in the amount of Town of Ithaca - $ - May 10 , 1981 $ 69 -, 471 . 50 after review and upon the recommendation of the Southern Cayuga Lake Intermunicipal Water Commission they are in order for payment . PUBLIC HEARING TO CONSIDER THE ADOPTION OF A TOWN PARK USE ORDINANCE Proof of posting and publication notice of a Public Hearing to consider the proposed adoption of a Town Park Use Ordinance having been presented by the Town Clerk , the Supervisor opened the public . hearing . Supervisor Desch stated that the public hearing would be adjourned until the June meeting , at which time the ordinance would be adopted . Councilwoman Raffensperger stated that she felt a good job had been done incorporating all the changes into the document , Section I . , General Regulations , , No . 4 . , Minors under six ( 6 )- year of age shall at all times be under the supervision and control of' a parent , guardian , or responsible custodian ,. Custodian should be changed to adult . Councilwoman Kiefer asked if the . Committee discussed adding a sentence requiring owners of dogs to clean up after their dogs . . Councilwoman Raffensperger stated that she felt the problem was taken care of in Section II , Noe l . , under Prohibited Activities . Councilman McPeak questioned . Section II ; No . 5 . , as to why rifles , guns , and revolvers were listed , why not just firearms ? Councilman . Cramer responsed that the Town Attorney had requested each item be listed , as was done . Also under the same item , the word " instrumentality " was questioned ? It was felt that the word needed. clarification . Councilwoman Kiefer asked about fraternities holding chicken barbecues, for fund raising ? Supervisor Desch stated that this would be covered under pe-LMItS . Councilman McPeak noted that he saw no section in the ordinance which covered the prohibition of the removal of plants or shrubs , Councilwoman Raffensperger stated that a section on the removal of plants and shrubs was in the other versions of the ordinance , it apparently was just left out o .fithis one . It was noted that the schedule of penalties will be worked out with the Town Attorney before final adoption . Supervisor Desch stated that specific recommendations as to who will enforce the ordinance referred to in Section VIII must be decided . He noted that Lou Cartee 'was . ino the field more than the Town Clerk . Perhaps it could b;e in conco.rt with the Town Clerk and the Building Inspector , Town Engineer Fabbroni suggested that perhaps the Town Clerk could issue the permit and the Building Inspector could be the eyes . RESOLUTION N0 . 68 : Town Board Minutes - g - May 10 , 1982 . Motion by Supervisor Desch ; seconded by Councilwoman Raffensperger , RESOLVED , that the Town Board of the Town of Ithaca hereby adjournes the public hearing on the adoption of a Town Park Use Ordinance until 7 : 00 P . M . , on June 7 , 19829 ( Desch , Kugler , Raffensperger , Cramer , McPeak , Jennings and Kiefer voting Aye . Nays - none ) . 1982 PARK WORK PROGRAM Councilwoman Raffensperger stated that the Public Works Committee had complied a list of work needed for the 1982 Parks Program . She noted that this was a follow up to General Budgeting . A meeting was held with the neighborhood regarding Lisa Lane . . The Committee knows what they want done . .. Dewitt is being completed per the contract . Tareyton , Salem and Tudor are scheduled for small play areas . East Ithaca Bikeway is a major project . Eastern Heights is the result. of updating studies . It is the second stage of the development . General Maintenance is . scheduled on a six months. basis for all parks . . Supervisor Desch questioned the playstructures for Salem Drive and Northview . He stated that he expected the committee to come back with either plans or photographs of the structure . Town Engineer Fabbroni remarked that if the Board authorizes the recommendations of the Public Works Committee then the Board would be authorizing all phases . Coming back to the full Town Board would put constraints on the work . Supervisor Desch stated that he would like to see the structural plans for the pavilion at Eastern Heights , Councilwoman Raffensperger stated that the $ 2 , 000 was for material. . Students will be building the pavilion . The request is only to reserve the funds so that they will be there when needed . . Councilman Jennings questioned the proposed fencing at Dewitt . Persons will be climbing on the fence and could get hurt . He felt that planting bushes to make a fencing hedge . would be better . Councilwoman Raffensperger stated that a commitment was made to fence in the pond . Town Engineer Fabbroni stated that he was unclear as to what details the board was looking for . If you are talking about public hearings then the projects would be delayed for three months . Supervisor Desch stated that the Board was looking for something specific . Will the playstructures resemble Eastern Heights only scaled down . The specifications of the pavilion for Eastern Heights . Susan Beeners showed pictures of various playstructures available . Supervisor Desch asked if the East Ithaca Bikeway proposal includes decking on the bridge ? Engineer Fabbroni answered yes . However , no repairs to the concrete abutment . Councilman Jennings asked about insurance for the parks . '. . i . .rig._ . Town Board Minutes - 10 - May 10 , 1982 Supervisor Desch stated that the coverage would be added to the general policy once the structure was inplace . Susan Beeners showed the Board Members pictures of play structures designed for parks . Supervisor Desch asked Councilwoman Raffensperger if she was satisfied that the cost of insurance for each play structure is the same ? He went on to say that he was concerned about a play structure that goes around . Councilwoman Raffensperger stated that the cost of insurance was per play structure . She went on to say that generally the Park Committee was planning on a stationary structure with a swing arount for Eastern. Heights or Tarryton . Councilman McPeak questioned the life of the play structure ? Councilwoman Raffensperger stated Bell Sherman School installed a play structure eight years ago , an it was holding up . well . This particular one was made mostly of wood . Town Engineer Fabbroni stated that the Committee is planning on. a life expectancy of twenty years . Supervisor Desch and Councilman Cramer both expressed their opposition to spinners being used for play equipment . RESOLUTION N0 , 69 Motion by Councilman Raffensperger ; seconded by Councilman McPeak , RESOLVED , that the Town Board of the Town of Ithaca hereby approves the 1982 Work Program for Parks , as presented by the Parks Work Commmttee ( copy of proposal attached to the official minutes ) . ( Desch , Kugler , Raffensperger , Cramer , McPeak , Kiefer and Jennings voting Aye . Nays - none ) . PUBLIC HEARING TO CONSIDER THE ADOPTION OF A WETLAND MAP Proof of posting and publication notice of a Public Hearing to consider the adoption of a Wetland Map having been presented by the Town Clerk , the Supervisor opened the public hearing . Town Engineer Fabbroni presented the maps to the Board , saying he had received a few more answers about . the ,maps . . The single most important new information is that existing homes in wetlands will be able to be sewered if the sewer goes through the area . He went on to say that the area included along the lake is bounded by the 386 ' contour . The line needs to be determined . T . G . Miller took existing maps and put an overlay on the corresponding tax map . Mr . Fabbroni went on to say that he was not sure the wetlands on the Sheffield Road were accurately designed . EMC recommendations for the designated wetlands should be used . However , the maps can be revised at a later date . On the Five .Mile Drive area , the map has crept to Floral Avenue where an eight unit building was built on filled area . He felt the line should be cut back 400 ' on Floral Avenue to where it was in the 1964 Aerial Map , The Town Engineer stated that the maps would stick mostly with property boundaries . RESOLUTION NO . 70 Motion by Councilman McPeak ; seconded by Councilman Cramer , WHEREAS , in the interest of Floodplain Management and Protection of Wetlands , USEPA has required all Wetlands and Floodplain Areas to be mapped , NOW THEREFORE BE IT RESOLVED , by the Town Board of the Town of Ithaca that the maps prepared for the Town by T . G . Miller be accepted as the maps most correctly delineating Wetlands and Floodplains in the Town or such amendments to said maps as may be developed by mutual agreements of the U . S . Government , State of New York , and Town from time to time , and FURTHER BE IT RESOLVED , that in accepting these maps or subsequent amendments the Town of Ithaca agrees to comply with the Example Grant Conditions as outlined in Attachment . I . ( Desch , Kugler , Raffensperger , Cramer , McPeak , Kiefer and Jennings voting Aye . Nays - none ) . Councilman Jennings questioned revision to the map and the Towns control over the revisions.
