REGULAR BOARD MEETING
February 8 , 1982
At a Regular Meeting of the Town Board of the Town of Ithaca ,
Tompkins County , New York , held at the Town Offices at 126 East
Seneca Street , Ithaca , New York , at 5 : 30 P . M . , on the 8th day
of February , 1982 , there were :

TOWN HISTORIAN ' S ANNUAL REPORT
Helen Blauvelt , Town Historian presented the following report :
Tlie major projects for 1981 are given below :
The use by the County of our slide show on the history of the
commercial heart of Ithaca , The Commons . Until 1888 this - was a
part of the Town . In 1981 , . twenty - five organizations . asked me
to give a program with a slide show . Thirty one other
organizations used the slide show in their programs without my
help . Individuals also checked out the show to use individually
or with family and friends . Old photographs are records , and
the Ithaca School District will use the show this coming year in
their new program of Teaching History with Historical Records:
I was President of the Municipal Historians of New York of
region VII , West ( Region VII , [west now includes six . counties :
Tompkins , Schuyler , Chemung , Tioga , Broome and Cortland ) . I
planned and ran two region - wide meetings , one in . . Montour . Falls
and one in Tioga County . ( Programs are attached to the official.
minutes ) .
We are making three facsimile copies of our First Book of Town
Records . One of these is finished . Copies two and three will
go to ; County Clerk ' s office and to the Dewitt Historical
Museum where there are research facilities we lack .
I attended two State meetings for Municipal Historians . The
Institute for Local Historians where the State Historians out -
line the program for the year and offer instruction for it . The
Conference on New York State History in which Municipal Historians
and Academic Historians both participate . This is invaluable
experience -for we nonacademic historians .
For two years the State Division of History has been preparing
Municipal Historians to assist the Public Schools in the
revolutionary new Local History Program , which our schools start
next September . The County , Town and City Historians and the

Education Specialist of the Dewitt Museum form part of a committee
organized by the Ithaca School District to facilitate this
program . I hope it will develop its interesting potentials and
be our big project for this year . In any event , the 1982 program
will include the location of historical records , their care and
preservation , and the sharing of our history with fellow citizens . .
INSURANCE COVERAGE
Robert Boothroyd of Boothroyd Agency , Inc : , stated that from time
to time he felt it important to review the coverage he was providing .
and discuss the aspects . of the coverage with the Board members .
Mr . Boothroyd distributed copies of the Schedule of Insurance .
( Copy attached to the official minutes ) .
Mr . Boothroyd stated that he felt the coverage was as broad as
he believed the Town required . The coverage provides direct
fiscal damage to buildings , valuable papers , employee ' s benefits ,
workman ' s compensation , public and premises liability , neglect of
Board , staff and employees for roads , parks , . playgrounds , etc .
Personal injury insurance , liability , vehicle coverage , bonds ,
and third party liability claim insurance .
Mr . Boothroyd went on to say that he felt that flood insurance
was not worth the premiums it would cost . It is highly unlikely
that the Town would ever suffer any serious dama e . He felt ,
however , that the Town should write a cover for 60 , 000 for
extra. expense insurance , in case of a loss to the Town Hall , or
maintenance garage . The coverage would cost about $ 100 , ' a
year . .
I-Ie noted that the Town could . purchase , for $ 4 , 200 a year , an
Errors and Omissions Policy . If someone make a decision and
a persons took exception to the decision and if the decision
were made in good faith , the policy would cover the Town . If
a decision were deliberately made in bad faith , then the Town
would not be covered . He went on to say he has mixes: feelings
on the need for this policy , as the Town has a good staff and
procedures :.
Councilman McPeak asked if the alternative was for each Board
to carry their own insurance ?
Mr . Boothroyd answered , you will have trouble buying insurance ,
as an individual .
Supervisor Desch thanked Mr . Boothroyd for his presentation .
Councilwoman Raffensperger asked if at a later date , would it be
possible for the Town Attorney to give the Board a presentation
on the_._Pub. lic Liability _ matter .
TOWN OFFICIALS REPORTS
SUPERVISOR ' S REPORT
The Supervisor reported that tax collections have proceeded well .
By month end , $ 1 , 271 , 580 . 44 had been collected . Unfortunately ,
we have lost one of our staff members for awhile . Nancy Fuller
was the victum of a skating accident and has suffered a rather
severe broken right wrist . We , therefore , will be distributing
various parts of her duties to others and some temporary help
'hay be needed , particularly for recording Zoning Board of Appeals
minutes .
Connie Allen , Bolton Point Business Manager is most will and able to

help with some of the financial and typing matters .
We have a definite schedule on the Fire Station Planning Sessions
for 10 : 00 a . m . , on February 20th at Central Fire Station . We have
been able to get Mr . George Proper , the State Fire Expert , to
insert us in his 18 month backlog of site visits , but it
necessitates the Saturday session . It turns out he was a high
school classmate of mine and , therefore , had some incentive to
help us out . Our Planning Board has discussed the matter , and
field test of response time will be conducted by the Fire Officials
on Friday . Our Public Safety Committee will be attending the
Saturday session which could be an all day affair .
In order to stay on schedule and get public water to the Coddington
Road area as planned , we will need to have a special meeting to
formally adopt the order . I am thinking about February 22 . It
can b .n a very short meeting or you may wish to have a work session
on other subjects , as has been suggested . Some of you will be just
back from the Association of Towns Meeting and full of good ideas .
George and I have a Water Commission meeting at 7 : 30 , so we could
go for 1L hours . More on this later .
We have been involved in discussions with the County on the matter
of the disposition of vacant land at the Biggs Complex , primarily
on the subject of utilities . Some aspects of on site water and
sewer need to be upgraded ., i . e . , meter pits , the sewers and any
development will involve extensions of services to those facilities .
Such extensions are the responsibility of the developer and / or the
property owner , as is the case with any private property . We are ,
however , open minded about consideration of taking over any parts
of the system that clearly will benefit users beyond the complex .
Keep open the date of March 1. 6 for a joint Planning / Zoning / Town
Board meeting general work session and give me a call or jot a
note on policy items you would like to discuss .
We came through the recent ice age in rather good shape . The
highway department was particularly busy with the steam probe ,
breaking . loose culverts that were frozen solid . Bob will no
doubt have more on this item .
Early planning is under way to have the Town assume responsibility
for the billing of Town customers tied to the City sewer system .
When we initiated the program of Zone Water billing in 1980 , we
set the quarterly schedule with the eventual sewer billing in mind .
so the transition will be minimal . The primary change will be in
the billing format . The new form will be very close to - the present
Qity sewer bill but it will have the water information as well .
Town customers would no longer see the blue Bolton Point . Water

We have had a number of requests from taxpayers to consolidate
tte two bills for convenience in eliminating one stop for them .
At the same time , the Town will be in a better position to respond
to complaints about service and the bill . In the past , the Town
would get the complaints but have no billing information .
Making this transition with the June 1982 billing , will give us
a solid base for information to establish the allocation of flow
contribution for the new base load plant , in accordance with the
Joint Sewer Agreement . Town properties connected to the Village
plant will still receive a separate annual bill for sewer use
from Cayuga Heights .
T014N ENGINEER ' S REPORT
Town Engineer Lawrence Fabbroni reported that the Comprehensive
Water_ Study being completed by Stearns & Wheler is progressing to
the draft stage . From the preliminary look I had earlier in the
Town Board Minutes - 4 - February 8 , 1982
month , I found that there are areas that need to be studied in
connection with the Bolton Point water transmission lines . This
being independent of tank storage capacity .
Supervisor Desch noted the task of identifying optimal locations
for additional storage tanks in the East Ithaca area . South Hill ,
with Ithaca College has a large impact . He went on to say that
there were basic deficiencies in some of our reservoir capabilities .
The Town Engineer stated that he would be presenting to the Board
a draft report in about three to four weeks . Maping has been
finished by the staff .
DESIGN FOR CODDINGTON ROAD WATER IMPROVEMENT
RESOLUTION N0 , 12
Motion by Supervisor Desch ; seconded by Councilman Cramer ,
RESOLVED , that the Town Board of the Town of Ithaca hereby
authorizes the firm of Stearns & Wheler to proceed with the
design , contract drawings and specifications for the Coddington
Road Water Improvement .

voting Aye . Nays - none )
Town Engineer Fabbroni stated that he was very disappointed in
what the County is doing for the Town in regards to the recent
flood . 150 to 200 feet of retaining wall was damaged at Flat
Rock on Forest Home Drive . It may become necessary for the Town
to absorb the cost of replacing the wall , in the budget ,. on a
two to three year basis . There may still be an opportunity ,
through the Disaster Application , for the necessary money to
repair the wall , but he stated that he felt the Board should be
informed of possible problems . It may eventually be necessary
to borrow funds for the repairs .
The Town Engineer noted that an independent value engineer who will
critique what Stearns & Wheler are doing , have been hired and
they are in a week long process of evaluation to see if Stearns &
Wheler have left out any necessary steps on the sewer plant
project . They will give a summary of their critic at weeks end .
Councilwoman Kiefer stated that she was sorry the outfall pipe _
location is not being looked at again .
Supervisor Desch asked Councilwoman Kiefer if she was speaking of
the end or the route of the pipe ?
Councilwoman Kiefer answered , that she felt they were somehow
related .
Supervisor Desch stated that EPA has already approved the route
and the placement of the end of the pipe .
Town Engineer Fabbroni stated that there was a proposal to locate
a Town House near_ the Village Apartments . A concept plan was
presented by Otto Schoenfeld and Ivar Jonson to the Planning Board
in December . They will be back , possibly in April , with a proposal
which may indicate : consideration . of :rezoning of the area .

HIGHWAY SUPERINTENDENT ' S REPORT
Highway Superintendent Robert Parkins reported that the highway
employees have been busy for three weeks with constant cindering .
Very little plowing has been done . The highway department
borrowed the County steamer and has been thawing frozen culverts .
Also , hauling gravel for shoulder paving projects .
COUNTY BOARD OF REPRESENTATIVES
County Board Representative Mary Call reported that the County
committees have been formed for the coming year . Beverly , Gust
and she will rotate their attendance at the Town Board meetings . .
Councilwoman Kiefer asked if there was any news on the sale of
the old hospital ?
Mrs . Call answered no , but it should be resolved this month .
A Master . Plan is being drawn up .
PERSONS TO BE HEARD
Mary Robertson , 101 West Haven Road stated that when the sewer line
went up the hill , in 1978 , there were a number of rocks dug up in
the process . Big rocks sat at the end of the road for a considerable
time . She and the man across the street each : asked for a large rock
to be placed - on the corner . of Elm , West Haven and Coy Glen . The
rocks arrived in August . One Columbus Day she stated that she went
away . and upon her return found someone had stolen the rocks .
She went on to say that she immediately started telephoning to
find her rocks , and had received a royal run around . Mrs . Robertson
stated that all in the Town knew her as the rock lady . She said
that she had been patient for three years , now she would like some
action on her rock and would like it back , as would Sam Leonardo ,
the man across the road .
Supervisor Desch stated that the rocks had been removed because
they were partially in the Town ' s right - of - way and could cause
serious problems for the Town incase of an accident .
Mrs . Robertson stated that she was still waiting for her rock .
Supervisor Desch stated that he ' felt Mrs . Robertson might have to
waite for quite a while . However , if a large rock became available ,
by virtue of a Town construction project , they might consider
transporting it providing there was no cost , : to Town taxpayers . .
1982 LEGISLATIVE PROGRAM ASSOCIATION OF TOWNS
The position of the Board was that there was not enough ' information
on the resolutions titled Rehabilitation of Injured Employees ,
Circuit Breaker Tax Relief and Prohibiting Non - Returnable Beverage
Containers for them to make a decision . Therefore , the Official
Delegate , Shirley Raffensperger was directed to use her own
judgement after she received more information .
The remainder of the proposed resolutions were endorsed by the Board .

Sewer Construction Debt Exclusions The Constitutional Authority
to exclude from debt limits obligations incurred fox-- eonsiiru.ction' of '
sewer systems - expires on December 31st ,- 1982 . Extension of ` this'
exclusion. . is essential to allow towns to continue water pollution' ' '
control projects . A Constitutional amendment to ' exten'd4 this excli T 1 `'
sion to December 31st , 1993 should be adopted by the Legislature .
Liability and Casualty Insurance Alternatives : Insurance costs
continue : to mount and constitute a large item in local budgets : The
present =insurance reserve fund is too narrow and prohibits pooling`
arrangements . Legislation . is recommended to- : expand the Ii s'urance
reserve fund including _: :: :r; _: ? 44, ;:4
g pooling - authorization . - � - - ... - •
Consolidation of Vital Registration Districts : Currently towns
are performing an important state role in functioning as primary reg
istration: districts . While some districts maybe should be consolidated ,
the ,consolidation provided for under Chapter 342 of the Laws of . 1980 0
is unacceptable and should be repealed .
Sharing the Cost of Certiorari Proceedings 9 Local assessors pre-
pare assessment rolls with information and resources available . Market
complexities make this task difficult . These assessment rolls - are also
used - for : .the levy of . county and school district taxes, but the high
cost=. -of defending certiorari proceedings is basically borne by the towns
and . cities . Counties and school districts should be required to con
tribute . - to. the cost 'of defending certiorari proceedings :
- ..Interest on Delinquent Taxes : Present interest rates on deln
quent taxes are low while interest on deposits and investments is high ;
resulting in property owners delaying payment of their taxes . This
causes . -additional financial expense to local governments : it is recom-
mended ; that' interest rates be increased on delinquent taxes to encourage
more timely payment .
Circuit Breaker Tax Relief : The real property tax is the princi-
pal source of local revenue .. The local tax base is drastically affected
by state . imposed exemptions which carry out - state policies for patriotic ,
social welfare and historical preservation purposes . The current circuit
breaker concept should be expanded to compensate for these exemptions
Retirement and Pension Costs : Fringe benefits including retire
ment plans constitute an important consideration in public employment .' "
In recent years , pension costs have increased substantially . However ,
employee contributions under the CO-ESC plan have reduced employer
costs . . .The contribution concept should. be continued and deficiencies
of : CO-ESC remedied . : _
_� : : . Interest : on Tax `Collecting De osits : Town tax collecting officers
promptly. <after tax - collection are . required . to disburse the moneys ` to
the supervisor , the school districts , the county and other political .
subdivisions . Prior to disbursement , the moneys could be invested
temporarily , but the requirement to divide the ° earned interest propor�

tionately. to each entity discourages sur..h investment . The interest
should belong to the. town . The collecting officer should be authorized
by town. b.oards to make the deposits in interest bearing accounts as
proposed - in S . 2907-B , A . 3800-B .
Prohibiting Non-Returnable Beverage Containers : The use of non-
returnable . beverage containers has expanded in recent years and con-
tributes substantially to the littering of our streets and public places .
The removal and disposal of these containers is a costly local effort..
The adoption of statewide legislation prohibiting the use of non-return;
able beverage containers is . strongly recommended , .

WHEREAS , the Town of Ithaca Planning Board recommends that Barbara
Schultz be reappointed as a member of the Town of Ithaca Public
Works Committee ,
NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
Ithaca hereby appoints Barbara Schultz as a member of the Town
of Ithaca Public Works Committee for the year 19821

RESOLVED , that the Town Board of the Town of Ithaca will meet and
conduct a public hearing on April 12 , 1982 , at 7 : 00 p . m . , at the
Town Hall , 126 . East Seneca Street , to coriSider the , adoption of
a Town Park Use Ordinance .

TOMPKINS COUNTY TRANSPORTATION COMMISSION
RESOLUTION N0 , 15
Motion by Supervisor Desch ; seconded by Councilman McPeak ,
WHEREAS , a vz=7cancy as an alternate representative on the Ithaca -
Tompkins County Transportation Commission exists , and
WHEREAS , the Town of Ithaca Engineer , Lawrence Fabbroni has
expertise in this field and has expressed a willingness to. serve
as an alternate ,
NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
Ithaca hereby appoints Lawrence Fabbroni as the alternate
representative to the Ithaca - Tompkins County Transportation
Commission for a two year term .

TOMPKINS COUNTY ECONOMIC ADVISORY BOARD
Supervisor Desch noted that former Town Councilman Victor Del Rosso
was the Town ' s representative on the Tompkins County Economic
Advisory Board , however , because of business pressures he is un -
able to continue on the Board .

RESOLVED , WHEREAS a vacancy exists on the Tompkins County Economic
Advisory Board , and
WHEREAS , Robert Bartholf has expressed a desire in serving on
this committee ,
NOW THEREFORE BE IT RESOLVED , that the Town Board of the Town of
Ithaca hereby appoints Robert Bartholf of 1007 Taughannock Boulevard

WHEREAS , Mr . Shah has certified that even though he applied

completed , therefore , it is not occupied ,

Special Meeting at noon on February 22 , 1982 , at the Town Hall ,
126 East Seneca Street , to adopt the order on the Coddington Road
Water Improvement .

FIRE STATION SITES
Supervisor Desch stated that the Planning Board , at. their.
February 2 , 1982 meeting discussed the possible sites for fire
stations in the West and South Hill areas . ( Copy attached to the
official minutes ) . Possible sites suggested were the end of
Mecklenburg Road , by the City line , and near the hospital on
West mill . Sites for South Hill were NCR and on the Coddington
Road . The Supervisor felt that it may inak;e ' :aense .to ; do.
a two or three site study and at some point , establish a building
plan .
Councilman Kugler. asked if the City would dictate the building
plans ?
Peter Lovi responded that he did not know .
Councilman Kugler added that if the buildings could be built into
a hill , there would be less heat loss .

$ 204 , 370 . 00 ; Second South Hill Water , Note # 2 in the amount of
$ 158 , 630 . 00 ; and Coddington Road Water in the amount of
$ 19 , 000 . 00 , all renewable on March 3 , 1982 , and
FURTHER BE IT RESOLVED , that the Supervisor be authorized to
renew the above note at the lowest interest rate available at the
time , and to execute and deliver such documents as the holder of

RESOLVED , that the Town Board of the Town of Ithaca hereby
authorizes the Town Engineer , Lawrence Fabbroni and the Town
Planner / Analysis , Peter Lovi to attend a seminar on " The Land
Use Mechanism : Reducing Friction , Improving Efficiency " in
Syracuse , New York on March 12 , 1982 .
Councilman Jennings stated that he thought it was inappropriate
to send part - time employees to seminars .
Councilman Cramer stated that he felt the seminar was related
to planning and development and might shed new light for the•
Codes & Ordinance Committee .

NINE MILE NUCLEAR POWER PLANT
Councilwoman Kiefer noted that recently . the City of Ithaca Common
Council had passed a resolution dealing with the continuing
construction at Nine Mile Point . She went on to say that with
the cost of energy , she felt it was appropriate for the Town of
Ithaca to become involved and take .ansactivepart .
Councilwoman Kiefer then read and moved the adoption of a proposed
resolution requesting the Public Service Commission to abandon
further construction on Nine Mile Point Nuclear Power Plant , No . 2 ,
in Oswego , New York . '
Supervisor Desch stated that he had several thoughts . concerning
Councilwoman Kiefers proposed resolution . He went on to say
that since we have a Public Service Commission to deal with this
sort of thing , that we should look to them to take action on this
subject .
The Supervisor went on to say that since the nuclear plant was
not located in Tompkins County or the Town of Ithaca , he felt
this was not a matter the Town Board should be considering .
Supervisor Desch noted that the residents of the Town of Ithaca
had elected the Board members to govern the affairs of the Town
of Ithaca .
The Supervisor stated that most people do not have enough facts

to support the resolution , as it - takes a lot of time to study a
problem of this complexity , and such a time commitment would
detract from items of higher priority and of direct urgency to
the Town . If the issue were to be considered locally , then he
felt the County would possibly be an appropriate body , after the
Economic Advisory Board . had dealth extensively into , the subject ,
He further noted that we have people who are elected to State
government to represent us in matters such as these .
Councilman. Jennings stated that there , zyiere many aspect of the
resolution that he liked . He went on to state that in reading
through past minutes , he noted where the Board had passed a
resolution on the Deregulation of Natural Gas , which approach
seemed to contradict the Supervisors comments ,
Councilman Jennings stated that he felt matters , not pertaining
directly to the Town , were not the business of the . Town Board ,
He went on to say that may be we are doing something wrong ,
Some of the people will think we have powers to control things
that we cannot control ,
Supervisor Desch stated that he agreed with Councilman Jennings '
statements ,
Councilwoman Kiefer questioned the Board passage of the Beverage
Control Resolution ,
Supervisor Desch noted that the resolution was sponsored by the
Association of Towns ,

Supervisor Desch asked for a vote . on the proposed resolution .
Councilman Jennings then stated that he wished to withdraw his
second to the proposed resolution ,
