Wright, Mat Cicchetti , John Coulombe, John Vanderberg, Roy Casterline, George Arsenault, Mary Oltz, Ken Horst and others ADDITIONS/DELETIONS TO THE AGENDA 1 ) Supervisor Dietrich requested that discussion on Community Council be added as No . 8 under Old Business . This is in addition to the Community Council Report item under Reports . 2) Discussion on increase of Town contribution for NYS Retirement added as No . 3 under Old Business . 3 ) Prioritize work list for Town properties - discussion under New Business if time permits . 4) Official abandonment of Old Town Road - discussion and possible resolution of intent to abandon added to agenda No Board member objected to additions to the Agenda. PRIVILEGE OF THE FLOOR Members of the Public Eileen Wright addressed the Board and reported that the Health Planning Council has sent out information on how residents of Tompkins County can get lower cost prescriptions and health benefits . The booklet will be placed in the meeting room for residents to review. Willard Daetsch - The Office of the Aging and the Senior Citizen Council and several others are doing a survey to try to determine how many care givers are in our community. In order to do long range planning for what is needed it would be helpful if we know of persons providing services as care givers . Information can be forwarded to to Eileen Wright. He reported that he and Dorothy have sent a letter to the Town Board stating their concerns and interests in potential development of two (2) lots in the Block Development. Ames Brown - asked what happened to the proposal for the Gold Star Mothers . Supervisor Dietrich reported that the Gold Star Mothers exemption was not approved by Tompkins County. COMMUNICATIONS : 1 ) Acknowledgment of DECALS Resolution from Elliot Spitzer of the Office of the Attorney General 2) Request from Mrs . Gerald Dawson to consider Veterans Exempt for Town of Danby Veterans . _ 1 I 1 2 3 8 2 Town Board Minutes March 10, 2003 3 ) Memo to Planning Board and copied to the Town Board from Willard and Dorothy Daetsch concerning proposed development on two (2) lots in Old Town Village in the Block Development_that will require the extension of the road and a turn around for emergency vehicles . REPORTS : Highway Report - Monthly Report received - February Zoning Report - Monthly Report received - February Planning Board Report Susan Beeners reported that the Planning Board has received several applications . The Simkin project has been adjourned to April 16 if the requested information is complete . There is a small project on Steam Mill Road and AT&T has applied for a co-location on the Durfee Hill Towers . There is a work session scheduled for Wednesday, March 5 , 2003 to review the Draft Comprehensive Plan and a joint meeting of the Planning Board and Town Board for Wednesday, March 19 , 2003 . She distributed a handout from the Planning Board Chairperson to the Board to review before the joint meeting. Recreation Partnership - The Town of Danby is looking for a representative to serve on the County Recreation Partnership Committee . Danby Community Council - Councilperson Strichartz reported that Danby Community Council held their elections and have five (5 ) new members . Meetings will be held monthly on the fourth Monday. They will be receiving proposals for different programs they can do with finding from the Town . There is a proposal pending that involves the Library and possible field trips . They have received a $2 ,000 grant from CATS to continue the concert series . Senior Citizens - Carol Sczepanski met on Thursday, March 6, 2003 . They held their annual election of officers and approved the Agreement with the Town for 2003 . Dog Control - SPCA Report for February received. County Representative Report : Representative Frank Proto reported on the following : 1 ) The County is in the process on negotiating a new contract with the SPCA. They are no longer taking in any cats at the shelter from the Town of Danby. The cost of maintaining a no kill shelter has raised the costs of maintaining the SPCA shelter. 2 ) Assessment Department will have informal reviews of assessments with residents who want to contest their assessment before the Assessment Board of Review Grievance Day. What residents received in the mail is not the final assessment . 3 ) At the County Board meeting the new County Charter will be considered. It is a series of revisions to the existing Charter. 4) A meeting with the Fire Coordinator, Lee Shurtlef and highway representatives from the Town of Danby and the Town of Caroline has been scheduled for Thursday, March 13 , 2003 . Representatives from the Fire Department have also been invited to attend. 5 ) The Danby and Caroline Reading Rooms are now the Danby Community Library and the Caroline Community Library. The reading rooms will be receiving funds for promotion . 7) The Health Department is standing ready for smallpox vaccinations and is on a general alert for other emergencies related to possible terrorism. 6) Empire Zones - there is some concern regarding the abatements for the empire zones and the effect when abatements are given . Seventy-one percent of all the property in the City of Ithaca is tax exempt and forty-eight percent of Tompkins County . The County has many exemption categories . Cornell and Ithaca College have the bulk of tax exempt properties . OLD TOWN ROAD ABANDONMENT The Town received a memo from Willard and Dorothy Daetsch concerning a proposed development in the neighboring Old Town Village (Block Development) Susan Beeners said that it might be best to ratify the abandonment of Old Town Road that the Judges provided in their decision to abandon the road . She said that the Board might request from the Dateschs and the Wrights any assistance they can provide in clearing up the title for our Town Attorney to review. The current tax maps and the old tax maps do show a very little mystery parcel . a41 IIi, L - . ,_.. .. _. I 1239 3 Town Board Minutes March 10, 2003 RESOLUTION NO. 31 OF 2003 OLD TOWN ROAD DECLARATION OF INTENT NOT TO MAINTAIN AND TO MOVE TO ABANDON By Councilperson Gagnon : Seconded by Councilperson Strichartz WHEREAS, Old Town Road has not been maintained by the Town of Danby Highway Department for many years , and WHEREAS, the property owners on said road do not wish to have the Town maintain it in the f J future, and WHEREAS, Old Town Road serves only to access the two properties on it, now therefore be it RESOLVED, by the Town Board of the Town of Danby hereby declare our intention not to maintain Old Town Road and to move to abandon it. A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Dietrich Aye (Councilperson Varona-Lacey absent) Carried Unanimously OLD BUSINESS : The Town Highway Superintendent has submitted an Agreement to Spend Highway Funds for 2003 and asked the Town Board to sign the agreement . The Board signed the Agreement to spend Highway Funds for 2003 . Motion for Approval to Spend $6,500.00 for Water Tank A motion was made by Councilperson Gagnon and seconded by Councilperson Nolte that the Town Board of the Town of Danby authorizes the expenditure of $6, 500 . 00 from Account DA5130 .200 for a water tank to be installed on truck No . 38 . A roll call vote on the motion resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Dietrich Aye (Councilperson Varona-Lacey absent) Carried Unanimously Increase in NYS Retirement Contribution for Employees Councilperson Gagnon reported that the Town Board received a memo via e-mail from the Town Bookkeeper that the Town Contribution to the NYS Retirement may cost us approximately $ 34 , 000 more than we budgeted for in our 2003 budget. This represents an 11 % increase in contribution . A proposal was made by the supervisor that we consider cutting spending elsewhere in the budget. He suggested that department heads be reduce their spending to reduce their budgets so that payment will not have to be made out of our reserves . Supervisor Dietrich said that it is not a question of not being able to pay the increased amount. HIGHWAY DEPARTMENT REQUEST FOR RESERVE ACCOUNTS RESOLUTION NO. 32 OF 2002 RESOLUTION ESTABLISHING THE "REPAIR AND IMPROVEMENT OF FACILITIES RESERVE FUND OF THE HIGHWAY DEPARTMENT OF THE TOWN OF DANBY" UNDER SECTION 6-C OF THE GENERAL MUNICIPAL LAW By Councilperson Strichartz : Seconded by Councilperson Nolte The Town Board of the Town of Danby, duly convened in a regular session, does hereby resolve as follows : SECTION 1 . That there be and hereby is established a capital reserve fund for the future repairs to or improvement 1240 4 Town Board Minutes March 10, 2003 of the facilities of the Highway Department. SECTION 2 . Such fund is to be known as the "Repir and Improvement of Facilities Reserve fund of the Highway Department of the Town of Danby. SECTION 3 . That out of the surplus monies of said district now on hand for the year 2002 and not otherwise appropriated is hereby appropriated for the "Repair and Improvement Facilities Reserve Fund of the Town of Danby", and the Supervisor of the Town of Danby is hereby authorized, empowered and directed to transfer frond surplus funds of the said Highway Department. SECTION 4. Such additional sums a may hereafter be appropriated shall become part of the fund . SECTION 5. The monies in the fund shall be deposited in a separate bank account in Tompkins Community Trust. SECTION 6. The Supervisor, in his discretion, may invest the monies in the fund in the manner provided in Section 6-F of the General Municipal Law of the State of New York. Any interest earned or capital gains realized on the monies so deposited or invested shall accrue to and become a part of the fund. SECTION 7. No expenditure shall be made from the fund except by authorization of the Town Board of the Town of Danby pursuant to the provisions of Section 6-C of the General Municipal Law of the State of New York . SECTION 8. This resolution shall take effect immediately. A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Dietrich Aye (Councilperson Varona-Lacey absent) Carried RESOLUTION NO . 35 OF 2003 SUPPORTING THE TOMPKINS COUNTY MULTI-JURISDICTIONAL PRE-DISASTER MITIGATION GRANT APPLICATION By Councilperson Strichartz : Seconded by Councilperson Gagnon WHEREAS, the Federal Disaster Mitigation Act of 2000 encourages and rewards local governments that initiate pre-disaster planning to identify and mitigate , where practicable , natural , technological , and human-caused hazards within their communities , and to promote the development of more disaster resistant communities, and WHEREAS, residents of the Town of Danby are vulnerable to potential hazards, including: 1 ) natural hazards, such as flooding, severe weather (including summer storms , windstorms , tornadoes , snowstorms, and ice storms) , fire, drought, and other natural hazards , 2) technological hazards, such as transportation accidents and hazardous material spills, and 3 ) human-caused hazards , such as civil unrest, riots, and acts of terrorism, and WHEREAS, a hazard mitigation plan that addresses these potential disasters will help improve the ability the Town of Danby has to minimize the loss of life and property and disruption to the economic well-being of the community due to a disaster, and to lay the foundation for a speedier recovery should a disaster strike , and WHEREAS, by November 2004, participating in the development and adoption of an All -Hazard Mitigation Plan will be required to receive State and Federal funding for certain capital improvements and other hazard mitigation initiatives , and WHEREAS, the New York State Emergency Management Office is administering a competitive Pre-Disaster Mitigation grant program that reimburses successful applicants 75 % of the cost of preparing an All-Hazard Mitigation Plan, and WHEREAS, representatives of the Town of Danby have participated in discussions with interested municipalities regarding preparing a grant application and All -Hazard Mitigation Plan with multiple jurisdictions in Tompkins County, and WHEREAS, Tompkins County Planning Department has agreed to facilitate the completion of a Pre-Disaster Mitigation grant application and to oversee and administer the preparation of a Multi-Jurisdictional All-Hazard Mitigation Plan for Tompkins County, and WHEREAS, a cost allocation structure to pay for the 25 % local contribution required by grant recipients to prepare the All-Hazard Mitigation Plan has been discussed by the participating municipalities , now therefore be it RESOLVED, that the Town Board of the Town of Danby hereby supports the preparation of a grant application 6! A 12; 44 6 Town Board Minutes March 10, 2003 to develop a Multi-Jurisdictional All-Hazard Mitigation Plan and authorizes the Tompkins County Planning Department to coordinate the development of a Pre-Disaster Mitigation grant application for Tompkins County, and be it further RESOLVED, that in the event that the grant application is approved and funded, the Town Board of the Town of Danby agrees to actively participate in the development of a Multi-Jurisdictional All-Hazard Mitigation Plan, and be it further RESOLVED, that in the event that the grant application is approved and funded, the Town of Danby agrees to contribute matching funds or in-kind services in a formula and amount to be agreed upon by all parties prior to the initiation of the preparation of a Multi-Jurisdictional All-Hazard Mitigation Plan for Tompkins County. Motion to Seek Resolutions of Support for Town of Danby as Agent for Multi-Jurisdictional All-Hazard Mitigation Plan Grant Application A motion was made by Councilperson Gagnon and seconded by Councilperson Strichartz that the Town Board of the Town of Danby directs the Code Enforcement Officer to secure resolutions of support from the Fire District and the West Danby Water District naming the Town of Danby the Agent in pursuing the Multi -Jurisdictional All- Hazard Mitigation Plan for Tompkins County. Aye (Councilperson Varona-Lacey absent) Carried Danby Community Council - Discussion Councilperson Strichartz reported that there are some issues with Danby Community Council . One of the issues is the possible cuts in the budget. It has come to light that Community Council has a checkbook with We need to ask them about possibly using some of that money towards the budget we have approved since we are so short of money. Councilperson Strichartz said that the Community Council President is asking from the community is that everyone with a proposal for a youth development program present it at the next meeting scheduled for March 24 . People with different ideas of what programs that they would like to see would come and present it to the council . A a representative from the County was present at the Organizational Meeting and presented their proposals . Councilperson Gagnon said that the Town Board should be part of the discussion on programing. What they do would depend in part on what the Town is willing to support in terms of administration . Supervisor Dietrich said that he will make available to Community Council the Youth Bureau ' s request for funding, to the County, the County evaluations, and the daily reports of the persons served with outcome objectives . NEW BUSINESS Danby Senior Citizens 2003 Agreement Motion to Approve the Danby Senior Citizens Agreement for 2003 A motion was made by Councilperson Strichartz and seconded by Supervisor Dietrich that the Town Board of the Town of Danby approves the Senior Citizens Agreement for 2003 and authorizes the Town Supervisor to sign the Agreement. A roll call vote on the motion resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Dietrich Aye (Councilperson Varona-Lacey absent) Carried RESOLUTION NO. 36 OF 2003 APPROVAL OF FINDINGS RELATED TO THE PROPOSED CLASSIFICATION OF SMILEY HILL ROAD, AND THE SEASONAL MAINTENANCE PORTIONS OF DURFEE HILL ROAD, HOWARD ROAD, MARSH ROAD, AND DEPUTRON HOLLOW ROAD AS MINIMUM MAINTENANCE ROADS By Councilperson Strichartz : Seconded by Councilperson Gagnon WHEREAS, the Town Board of the Town of Danby has reviewed the recommendation of the Town of Danby Highway Superintendent that the roads or portions thereof that are presently designated as Seasonal Maintenance or Seasonal Use Roads be classified as Minimum Maintenance Roads, with such roads or portions thereof being the following : 1 . All of Smiley Hill Road, from its intersection with Hill Road to its intersection with Michigan Hollow Road : ; 1 2 4 6 8 Town Board Minutes March 10, 2003 2 . The seasonal -maintenance portion of Durfee Hill Road, commencing at a point 1900+/- feet from the intersection of Durfee Hill Road with NYS Route 96-B , and thence running northerly 5280+/- feet to the eastern end of a year-round portion of Durfee Hill Road; 3 . The seasonal-maintenance portion of Howard Road, commencing at a point 600+/- feet easterly of the intersection of Howard Road with Durfee Hill Road, and thence running east 1500+/- to a turnaround; 4 . The seasonal-maintenance portion of Marsh Road, commencing at a point 1100+/- feet south of the intersection of Marsh Road with Hornbrook Road, and thence running south 965 +/- feet to its intersection with Deputron Hollow Road ; 5 . The seasonal -maintenance portion of Deputron Hollow Road, commencing at the intersection of Deputron Hollow Road with Marsh Road, and thence running in a easterly direction 6072+/- feet to the northwestern end of the year-round portion of Deputron Hollow Road; NOW, THEREFORE, IT IS RESOLVED, that the Town Board of the Town of Danby makes the following findings and determinations with respect to the said roads or portions thereof that are presently designated as Seasonal Maintenance or Seasonal Use Roads : 1 . The volume of motor vehicle traffic on such roads or portions thereof is less than 50 vehicles per day, with the vehicular use of these portions primarily being for recreational purposes ; 2 . none of said roads or portions thereof provide principal motor vehicle access to a farm center of operation or year-round residence; 3 . property owners of land abutting said roads or portions thereof shall continue to have reasonable access to their property ; and 4 . the users of said roads or portions thereof traveling at a reasonable and prudent speed, under the circumstances, shall not be placed in a hazardous situation ; and it is g along FURTHER RESOLVED, that the findings determinations herein alon with the recommendation of the Town Highway Superintendent shall be on file and made available for public inspection in the office of the Danby Town Clerk and shall also be transmitted to the Board of Education of the involved school district for its recommendation . A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Dietrich Aye (Councilperson Varona-Lacey absent) Carried RESOLUTION NO. 37 OF 2003 ESTABLISHING LEAD AGENCY AND SETTING PUBLIC HEARING DATE FOR A PROPOSED LOCAL LAW AMENDING LOCAL LAW NO. 3 OF 2002 BY DESIGNATING SMILEY HILL ROAD, AND THE SEASONAL-MAINTENANCE PORTIONS OF DURFEE HILL ROAD, HOWARD ROAD, MARSH ROAD, AND DEPUTRON HOLLOW ROAD AS MINIMUM MAINTENANCE ROADS By Councilperson Gagnon : Seconded by Councilperson Strichartz RESOLVED, that the Town Board of the Town of Danby is acting as Lead Agency in the environmental review of a proposed Local Law Amending Local Law No . 3 of 2002 by Designating Smiley Hill Road, and the Seasonal- maintenance Portions of Durfee Hill Road, Howard Road, Marsh Road, and Deputron Hollow Road as Minimum 1 Maintenance Roads, which is an Unlisted Action, with the Tompkins County Department of Planning and the Ithaca City School District Board of Education being involved or interested agencies which are being notified of this action ; AND IT IS FURTHER RESOLVED, that the Town Board of the Town of Danby schedules a public hearing to consider enactment of said proposed Local Law for Monday, May 12 , 2003 at 7 : 00 p . m. I 1247 9 Town Board Minutes March 10 , 2003 Strichartz Aye Dietrich Aye (Councilperson Varona-Lacey absent) Carried Revitalization Grant Application RESOLUTION NO. 38 OF 2003 APPROVAL OF REVITALIZATION GRANT APPLICATION By Councilperson Gagnon : Seconded by Councilperson Nolte RESOLVED, that the Town Board of the Town of Danby authorizes the Town Supervisor to submit a Revitalization Grant application for town hall parking lot lighting in the event that grant monies are made available and an invitation to submit applications is proffered by Tompkins County . Discussion : Councilperson Gagnon said that the total cost may be approximately $ 3 ,000 . 00 Councilperson Strichartz said that given the fact that the Board is asking all departments to cut back on spending, is this a good time to commit to matching funds . Councilperson Gagnon said yes . This is if the money is available we will ask for it. Discussion : Councilperson Gagnon questioned a decrease of $7 , 000 . 00 in the West Danby Water District Cash Savings item in the January Report .
