Wright, Brian Colgan , Kandea Mosley, Ric Dietrich , John Vandenberg, Russ and Kim Nitchman Chairperson Newman opened the regular meeting of the Planning Board at 7 : 50 p . m . following public hearing of the Proposed Simkin Project. Preliminary Site Plan Review - Simpkin Proposal Laurene Gilbert said she does not have a problem with the project. She is concerned that they are here for Preliminary Site Plan Approval with none of the backup material that the Planning Board needs to make that determination . There is no shown vegetation , no grading or drainage plan , no proposed buffer and no details showing drainage of a detention pond or retention pond. There are no calculations for the drainage . The material submitted does not have all the information the Planning Board needs to make a preliminary approval . Linda Hansen said considering all the drainage and run off issues that residents addressed as concerns , does not think waivers should be allowed . Susan Beeners said that she has a concern about the retention pond in the small triangle west of the turn around . The Highway Superintendent is concerned that the Town not incur any huge maintenance burdens such as the maintenance of a retention pond . She would like to see a way of having some other techniques used such as the drainage gallery idea explored that could be incorporated into the private lots . Bill Alpern said that a home owner generally does not want a retention pond on their property so it would be on Town property . Chairperson Newman said that this is a preliminary hearing and a good time for all the issues and concerns to be raised. The whole project will come back to the Town Board. We have the option of adjourning this to the next meeting at which time we might propose that the details we are asking for would be available . Laurene Gilbert said she is not willing to grant preliminary site plan approval until more information has been submitted . When the additional information is submitted we can do both the preliminary review and final approval at the same meeting. Susan Beeners said that no plat would become final until the Town Board has accepted the improvements . Public Hearing Date Set - Preliminary and Final Plat - Simkin A motion was made by Laurene Gilbert and seconded by Robert Roe that the Planning Board of the Town of Danby sets the date of Wednesday, April 16, 2003 at 7 : 00 p . m. for the Simpkin Project public hearing to consider preliminary and final approval of the project. 54 2 Planning Board Minutes February 19, 2002 A roll call vote on the motion resulted as follows : - Farrell Aye ( 'r Gilbert Aye IX) cc r Hansen Aye Roe Aye n- 0 O 3 Vent Aye C7 Newman Aye Carried Unanimously Approval of the Planning Board Minutes - January 15, 2003 A motion was made by Robert Roe and seconded by Linda Hansen that the Planning Board approve the January 15 , 2003 Planning Board Minutes with suggested corrections presented by Chairperson Newman.. A vote on the motion resulted as follows : Carried Unanimously Nitchman Request for Special Permit - Detached Second Dwelling Sketch Plan Review Susan Beeners reported that Russ and Kim Nitchman have submitted a request to have a detached second dwelling on a property located on Steam Mill Road for sketch plan review. It is necessary to have a special permit and a public hearing for a second detached dwelling on a property. Russ Nitchman said that he would like to have approval to erect a detached second dwelling on his property. The proposed dwelling was described as a bunk house . He reviewed the property location and the wetlands area with the Board . Motion to Schedule a Public Hearings - Nichman A motion was made by Robert Roe and seconded by Olivia Vent that the Planning Board schedule a public hearing for Wednesday, April 16 , 2003 at 6 : 45 p . m. for the Nichman request for Special Permit. A roll call vote on the motion resulted as follows : Farrell Aye Gilbert Aye Hansen Aye Roe Aye Vent Aye Newman Aye Carried Unanimously AT&T Request for Special Use Permit Sketch Plan Review AT&T Wireless has submitted a request for a Special Use Permit to collocate wireless communication panel antennae and related equipment on Durfee Hill tower. Susan Beeners said that there has been reinforcement on the guide lines on the Durfee Hill telecommunication towers . The request is for a six panel antennae and similar to the last addition on the tower. Our consultant Bill Sitzman is reviewing the project plan and she expects to have his report later this week. The Board reviewed the AT&T proposal for collocation and suggested that the hearing be scheduled after the Town has received the consultants report. After review of the information from AT&T Wireless it was decided by the Planning Board will set a public hearing date at the March meeting. Comprehensive Plan Update Chairperson Newman reviewed with the Board a letter she sent to the Board in the mail . The Town Board has agreed to have a joint meeting with the Planning Board on March 19 , 2003 following a brief meeting of the Planning Board . She would like to have a brief meeting with the Planning Board to discuss their concerns with the revisions and to prepare for the joint meeting. l55 3 Planning Board Minutes February 19, 2002 Special Meeting of the Planning Board Scheduled Chairperson Newman scheduled a Special Meeting of the Planning Board for March 5 , 2003 at 7 : 00 to discuss the January revision of the Comprehensive Plan . Before the meeting the Board will receive an article she has drafted to be published in the Danby Area News . Susan Beeners reported that she has the maps from Tompkins County Planning. Wright, Brian Colgan, Kandea Mosley , Ric Dietrich, John Vandenberg, Russ and Kim Witchman Communications Affidavit of Service by Mail Affidavit of Publication of Hearing Tompkins County Planning Department Review Public Hearing Declared Open Chairperson Sarah Newman declared the public hearing open at 7 : 03 p . m . and read the following Notice of Publication : "PLEASE TAKE NOTICE that a public hearing will be held by the Planning Board of the Town of Danby on Wednesday, February 19, 2003 at 7 : 00 p .m. at 1830 Danby Road, Ithaca, New York to Consider Preliminary Subdivision and Site Plan Approval for the proposed modification of a portion of "Final Plat for Old Town Village Residential Community North , approved by the Danby Planning Board on March 3 , 1988 and the Danby Town Board on April 18 , 1988 . The proposed modification involves lot line modification of Tax Parcels 2 . - 1 -22 . 43 and 2 . - 1 - 22 .44 , and construction and dedication by the developer to the Town of a road extension and turnaround. The subject 2 . 65 +/- acre property is located at the east end of Olde Towne Road, in Planned Development Zone 8 . Angela Block, Owner, Boris Simkin, Applicant. Sczepanski , Town Clerk Dated : February 11 , 2003 Published : February 13 , 2003 " Description of the Simkin Proposal Bill Albeit gave a description of the subdivision that was approved in 1988 and presented to the public the original approved drawing that was filed with Tompkins county . Bill Albern is the engineer working on this project and Boris Simkin the developer. He explained that the developer is proposing a turn around for Town of Danby Tax Parcels 2 . - 1 -22 . 23 and 2 . - 1 -22 . 24 for town vehicles , garbage trucks, recycling trucks, UPS , emergency vehicles , etc . Code Enforcement Office Susan Beeners said that the plat as shown is an excerpt of the final plat as filed. The present action is a request for modification of the final plat. The modifications involve a couple of minor lot line changes and a proposed turn around . At the time the plat was approved there was litigation regarding the road . In approving the plat the developer showed the contingency where there could be a road extension but no detail for a turn around. The Town of Danby Subdivision Regulations now has new requirements related to subdivision review that were not in place when the Block Subdivision was approved . Susan said that she has done a short form SEQR for the proposed project. She pointed out the major items that she looked at for the SEQR. One of 758 2 Planning Board Minutes Public Hearing - Simkin February 19, 2003 the requirements in the subdivision regulations is principles of design are not to increase storm water run off anymore than pre-development condition . Septic system placement and well placements were previously approved by the Tompkins County Health Department. There are private restrictive covenants that regulate some of the aesthetic impacts in the subdivision that call for minimizing tree clearing . Susan said that she would recommend that there are no significant impacts with the modifications to the pre-approved plan . The zoning map of 1991 ratified this area as a Planned Development Zone. The Town Board approved the plan . The applicant has stated on the plat that he is going to abide by all the restrictions as placed by the Architectural Review Board . The zoning in this area is low density, two acres with 200 ft. of road frontage minimum. Susan said that she would recommend that one could find that there would be no significant environmental impacts if we were assured that the drainage, erosion and storm water management issues were addressed properly, that the grading of the road was done properly . The applicant would like some assurance that they could proceed with the topo and engineering design needed to provide for that information . A waiver has been requested for the preliminary engineering summary showing estimated storm water run off and a waver of a vertical profile . Public Comment : John Vandenberg of 102 Old Town Road - his concern is that this project would be done right . It is a drainage issue and he is down hill from the proposed road extension . Eileen Wright - 1342 Danby Road - on the initial approval the two lots were one ( 1 ) acre each . If part of the lots are to be used for the road frontage, she wonders where the extra acreage comes from . The lot nearest her property ended up a creek bank because the creek runs down through . Has there been any lot line modifications to this lot? Willard Daetsch - Danby Road - Mr. Simkin came and talked to them about the proposal . They intend to keep their property as it exists . Matthew Cicchetti - his house is at the end of Old Town Road and his concern is the drainage issue as his property is down hill from the project. If things are done according to plan and the regulations . There are some large trees that border his property as well and he would not like to see the area clear cut . Provisions need to be made so that he continues to get the end of his driveway gets plowed . Alex Wright - 1342 Danby Road - not approved in 1988 . The Court decision took away that road right of way . Matthew Cicchetti - asked for clarification of what it means about the maintenance for a year. Bill Albern - explained the details of the area and drainage for the properties . Naomi Strichartz - concerned that there should be some protection for children around the retention pond . The purpose of the meeting was for appointments to the Planning Board and Board of Zoning Appeals and to amend Resolution No . 31 of 2002 entitled : Approval of Consulting Services Related to Review of Special Use permit Applications for Wireless Telecommunications Facilities . RESOLUTION NO. 28 OF 2003 APPOINTMENT TO THE PLANNING BOARD By : Councilperson Strichartz : Seconded by Councilperson Varona-Lacey RESOLVED, that the Town Board of the Town of Danby appoints Lee Washesky to the Danby Planning Board to fill a vacancy with the term of appointment to begin immediately and expires on December 31 , 2008 . The Code Enforcement Officer, Susan Beeners reported to the Town Board that the rates approved in Resolution No . 31 of 2002 need to be modified. Consultant, William J. Sitzman, President of Independent Broadcast Consultants has raised his fees for service . By Councilperson Strichartz : Seconded by Councilperson Varona-Lacey RESOLVED, that the Town Board of the Town of Danby hereby amends Resolution No . 31 of 2002 , adopted by the Town Board on March 11 , 2002 , by approving modified rates for the engagement of Independent Broadcast Consultants in the review of Special Use Permit applications for Wireless Telecommunications Facilities , where consulting fees are paid from review fees deposited by the applicants for such Special Use Permit applications, as follows : William J. Stizman, $ 57 . 00 per hour Staff engineers, $42 . 00 per hour Travel , $ 13 . 00 per hour plus $0 . 50 per mile A roll call vote on the resolution resulted as follows : (Councilpersons Gagnon and Nolte excused) Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously Multi Jurisdictional Pre Disaster Mitigation Plan Susan Beeners reported that the Town is apparently interested in submitting a grant application to be included in the Tompkins County Multi Jurisdictional Pre-disaster Mitigation Plan. The County needs to have a response early in March. She said she would assemble date on past disasters for the grant application .
