HomeMy WebLinkAbout2003-01-15 49 TOWN OF DANBY PLANNING BOARD MINUTES JANUARY 15, 2003 PRESENT : Chairperson Sarah Newman Planning Board Members : William Farrell , Laurene Gilbert, Robert Roe, Olivia Vent ABSENT : Linda Hansen (Excused) Others Present : Carol Sczepanski - Secretary Susan Beeners - Code Enforcement Officer Members of the Public : Esther Dotson , Boris Simkin, Megan Tetrick, Rhonda Roaring, Kandea Mosley Chairperson Sarah Newman called the meeting to order at 7 : 04 p . m . and asked the Planning Board to review the November and December Minutes for correction and approval . Approval of November 20, 2002 Minutes A motion was made by Robert Roe and seconded by Laurene Gilbert that the Planning Board approves the November 20, 2002 Planning Board Minutes as submitted . Carried Unanimously Approval of the Planning Board December 18, 2002 Public Hearing Minutes - Palmer A motion was made by Laurene Gilbert and seconded by Robert Roe that the Planning Board approves the December 18 , 2002 Public Hearing Minutes (Palmer) as submitted. Carried Unanimously Approval of the December 18, 2002 Planning Board Minutes A motion was made by William Farrell and seconded by Robert Roe that the Planning Board approves the December 18 , 2002 Planning Board Minutes as submitted . Carried Unanimously Sketch Plan Review of Proposed Construction and Dedication of Road Extension - Olde Towne Village Residential Community Susan Beeners said that the applicant Boris Simkin is a resident of the Village and a builder. The Planning Board reviewed a copy of the Old Town Village Subdivision Map . There are two (2) lots on the east end of Old Town Road that were approved by the town in a subdivision map in 1988 . At that time their access to those two lots (Tax parcels 2 . - 1 -22 . 43 and 2 . - 1 -22 .44) was not finalized. Two resident families share a driveway off of NYS Rte . 96B which was the old Old Town Road . The site plan shows that Mr. Simkin would construct an extension and a turnaround from the existing town road so that the two lots can be accessed . Building the road extension and the turnaround are the responsibility of the developer and the extension and turnaround may not be surface treated with oil and stone for a period of one year. Generally there is a period of one ( 1 ) year when the major maintenance of a new road is the responsibility of the developer. The Highway Superintendent has reviewed the plan and an engineer is in the process of doing a preliminary subdivision plat for this project . The subdivision plat will provide the preliminary engineering for road grades including the horizonal and vertical alignments and the plan is subject to Fire Department approval . Chairperson Newman said that drainage and erosion related to the position of the creek and the preservation of open space requirements were of concern . It would be appropriate for a subcommittee of Planning Board do a site visit before the public hearing. Susan Beeners said that there is a creek that goes through the properties and the house locations are fairly close to the creek. She has spoken to the engineer and there is room to move the location of the houses so that they would not be too close to the creek. Tompkins County Health Department approved the location of the septic systems on the original plat. 1 750 2 Planning Board Minutes January 15 , 2003 Motion to set Public Hearing Date for the Simkin Proposal A motion was made by Robert Roe and seconded by Olivia Vent that if the application is complete and ready to send to the Board by Friday, February 7 , 2003 , the Planning Board of the Town of Danby sets Wednesday, February 19, 2003 at 7 : 00 p.m . for a public hearing to Consider Preliminary Subdivision and Site Plan Approval for the proposed modification of a portion of "Final Plat for Old Town Village Residential Community North , approved by the Danby Planning Board on March 3 , 1988 and the Danby Town Board on April 18 , 1988 . The proposed modification involves lot line modification of Tax Parcels 2 . - 1 -22 .43 and 2 . - 1 -22 . 44, and construction and dedication by the developer to the Town of a road extension and turnaround. A vote on the motion resulted as follows : Carried Unanimously Comprehensive Plan Update Chairperson Newman distributed the most recent revision of the Comprehensive Plan Draft and a cover letter from her and Susan Beeners explaining the revisions. The revisions are from suggestions and concerns expressed by members of the Town Board and the Planning Board generated from the joint meetings of the Boards . Sarah said the summary is the front of the draft and corresponds to the organization of what is in the notebooks . She asked the Board to consider this new version of the summary and said the lengthy paragraphs that summarized Goals and Objectives have been replaced with the actual Goals, Objectives and Strategies for each one of the topics . Incorporated into the text are her efforts to address the questions, concerns and objections that were discussed at the four(4) joint meetings with the Town Board and response she received from Planning Board members . A list of the things that were not included in the draft will be prepared and distributed to the Board . Chairperson Newman said that a preliminary review of the Draft Comprehensive Plan by the Tompkins County Planning would facilitate doing the final review . She requested that it be noted that the the Planning Board wants to look into the timing of an opportunity for the Planning Board to receive , digest and discuss Tompkins County ' s reaction to our plan before the public hearing . Kandea Mosley from the Ithaca Journal said that the Board had not mentioned any of the goals or objectives in the plan . She is trying to get a sense of what the Board is discussing. She would like the Board to familiarize those in attendance who don ' t know anything about this plan of what those goals and objectives are . Chairperson Newman said that they can get a copy of the Table of Contents so that they know the topics that are covered but the goals and objectives are under discussion and not finalized . She said that she would like to talk with the members of the Planning Board and Town Board before the information would be available or distributed to the public . Discussion followed on how and when the contents of the draft comprehensive plan would be released for public review . Susan Beeners said that the Planning Board needs to have time to get the plan into a form where they believe it is at a point where it can be made available . Candea was not satisfied that she could not obtain a copy of the draft at this time as she would like to do an article on the comprehensive plan . After lengthy discussion regarding release of information it was suggested by Susan Beeners that she could file a FOIL (Freedom of Information Request) or schedule a time to meet with Chairperson Newman . Copies of the draft can be made available to the public after it has been reviewed and discussed in detail . A request from Rhonda Roaring for Danby to have a WEB site and that the document put on the WEB for residents to keep them updated . Chairperson Newman said that an article will be placed in the Danby Area News to inform the Danby residents when the draft comprehensive plan is completed, ready for the public to view. The dates for public meetings and hearings will be well advertised . 751 3 Planning Board Minutes January 15 , 2003 February 19, 2003 Meeting At the next meeting on Wednesday, February 19 , 2003 - Public Hearing at 7 : 00 p . m . - Road extension and turnaround on Olde Towne Road if application is complete by February 7 , 2003 . Continued review of the draft Comprehensive Plan received on January 15 , 2003 . Miscellaneous Reports : Bob Roe reported that the EMC (Environmental Management Council ) held their organizational meeting on January 8 , 2003 . They reestablished their standing committees including how an energy committee and a cell tower committee . He asked the Board if there were any critical issues that they would like to be put before the EMC for inclusion in their agenda for this coming year. He has already made a very strong case (backed by Groton and Lansing) that the EMC get Tompkins County moving on the aquifer study . Ed Marks from Tompkins County Planning gave a presentation on the County Comprehensive Plan . He has a copy of the County Comprehensive Plan outline and will share it with members of the Planning Board . The plan is expected to be completed by the fall of 2004 . At the SEQR Review Committee A draft proposal from November 2002 to tighten up the regulations for the updating and revision of the 1987 SEQR Review Guidelines was reviewed . The Water Resource Council has made a proposal for regulation of personal watercraft (two-cycle water engines) . Planning Board Vacancy Chairperson Newman reported that the Town Board appointed Councilperson Gagnon as representative on the Municipal Officers Association Planning Coalition and have asked the Planning Board to appoint a member to the Coalition . Linda Hansen and Bob Roe have indicated that they would be interested but a 4 : 15 p . m. meeting was not possible . Susan Beeners will attend the January 29th meeting as a representative for the Planning Board . Danby Community Park - Update Esther Dotson reported that the Danby Community Park Association has been dealing with the complications related to the transfer the NYS Grant monies from the Town of Danby to the Not for profit organization . The Commissioner of Parks and Recreation will be asked to make that transfer from the Town to the Danby Community Park Association . Negotiations for the entry on the north side of the church are still pending and promising. The topographical survey has been completed and the calculations are in progress for drainage and grading. The association is consulting with Claudia Brenner it is hoped that there will be definite news on the entrance site for the park soon so that they can apply for a special permit from this Board .
