PROPOSED LOCAL LAW #3 OF 2002
DECEMBER 30, 2002

Supervisor Dietrich led all present to the Pledge of Allegiance to the American flag.
Public Hearing Declared Open :
Supervisor Fredric Dietrich declared the public hearing open at 7 : 05 P .M . and read the following
Notice of Publication : "PLEASE TAKE NOTICE, that the Town Board of the Town of Danby
will hold a public hearing on Monday, December 30 , 2002 at 7 : 00 p . m. at 1830 Danby Road,
Ithaca, New York, County of Tompkins to consider a local law entitled "A LOCAL LAW
CLASSIFYING CERTAIN ROADS OR PORTIONS THEREOF AS MINIMUM
MAINTENANCE ROADS," which said local law is to designate certain low volume roads or
sections of roads hereinafter specified in Section 2 of said Local Law, pursuant to Local Law No .
2 of 2002 of the Town of Danby .
All interested persons will be given the opportunity to be heard either in person or in writing. A
Special Meeting of the Town Board will follow the public hearing.

Comments From the Public :
Steven Babcock of 137 Heisey Road - had questions related to the proposed local law .
What initiated this change in classification?
Will the road be improved?
He said he purchased his property for the seclusion and would like the seasonal sign to stay
where it is .
• Supervisor Dietrich responded that the proposed local law was an economic one.
Highway Superintendent William Hall said that there would be no change from what the
highway does now. The road would be graded and maintained with minimum maintenance .
Charles Banker of 1927 Carmichael Road, Owego, NY - owns property on Eastman Hill and has
no problem with this change and has seasonal usage . When you change designation to minimum
maintenance and should I want to put a permanent dwelling on that property I would have to
come to the Town to get it approved and the Board could refuse the request. The change does

affect the value of the property . He requested a copy of the resolutions if the local law is
approved to take to his assessor.

APPROVAL OF WARRANTS NO . 13 OF 2002
Motion to Approve General Fund Warrant No. 13 of 2002
A motion was made by Councilperson Varona-Lacey and seconded by Councilperson Nolte that the
Town Board of the Town of Danby approves General Fund Warrant No . 13 of 2002 voucher
numbers 655 - 703 in the amount of $ 7 , 376 . 44 .
A roll call vote on the motion resulted as follows :

Varona-Lacey Aye
Dietrich Aye Carried Unanimously
Motion to Approve Highway Department Fund Warrant No. 13 of 2002
A motion was made by Councilperson Gagnon and seconded by Councilperson Nolte that the Town
Board of the Town of Danby approves Highway Department Fund Warrant No . 13 of 2002 voucher
numbers 201 -216 in the amount of $20 , 933 . 32 .
A roll call vote on the motion resulted as follows :

Varona-Lacey Aye
Dietrich Aye Carried Unanimously
Motion to Approve West Danby Water District Fund Warrant No . 13 of 2002
A motion was made by Councilperson Nolte and seconded by Councilperson Gagnon that the Town
Board of the Town of Danby approve the West Danby Water District Fund Warrant No . 13 of 2002
voucher numbers 63 - 66 in the amount of $ 774 . 02 .
A roll call vote on the resolution resulted as follows :

Dietrich Aye Carried Unanimously
