HomeMy WebLinkAbout2002-10-14 1201 1 Town Board Minutes October 14, 2002 TOWN OF DANBY TOWN BOARD MINUTES OCTOBER 14, 2002 PRESENT : Councilpersons : Joel Gagnon, Norbert Nolte, Naomi Strichartz ABSENT : Supervisor Fredric Dietrick (excused) Councilperson Gladys Varona-Lacey (excused) Others Present Carol Sczepanski - Town Clerk Susan Beeners - Code Enforcement Officer William Hall - Highway Superintendent Sue Howe - Highway Secretary Members of the Public : Roy Casterline, Mary Oltz, Bob Roe, Ken Horst, Miranda Strichartz, Bill Evans, Eileen Wright, Willard T. Daetsch . Deputy Supervisor Naomi Strichartz called the meeting to order at 7 : 00 p . m. and led all present to the Pledge of Allegiance to the American flag . Additions to the Agenda : Transfer of funds for Highway Department was added to the agenda under new business . Councilperson Gagnon requested permission to add a resolution in support of creating in principal Intermunicipal Partnership No Board member objected. Privilege of the Floor Bill Evans - is a new resident stated that a vote of conscience by the Town Board against a war in Iraq was a nice gesture . Ted Jones - Bookkeeper reported that he is submitting the new formula as promised with numbers most recent of funds through September 30, 2002 . He is also including some information on the financial status . He also commended the Board on their resolution regarding a preemptive military strikes on other nations . Willard Daetsch - commended the Board on their resolution regarding a preemptive military strikes on other nations as it was extremely important Eileen Wright - agrees with Willard Daetsch in the importance of the Board Resolution . REPORTS : EMC Report - Robert Roe reported that the Hudson Bay PCB clean-up is moving ahead and is to take place in Niagara Falls . The DEC is undertaking a community environmental management program to involve local community members in permitting procedures . The report on Conserving Open Space in New York is now completed and he has requested a copy. The 202 Farm Security Bill has been reintroduced (the Wildlife Habitat Incentives Program) . Agra-Tourism Program has been expanded and funded for 2002 . There are three levels of grants available in terms of people visiting farms in the area: stop and look, stop and visit and stop and stay. The maximum grant that applicants (individual farms) for the Agra-Tourism Program can apply for is $ 50, 000 with $25 ,000 for the stop and visit, $ 50,000 for the stop and stay. Highway Report - Highway Superintendent William Hall reported that the department is 1202 2 Town Board Minutes October 14, 2002 completing their summer work load. Zoning Report Susan Beeners reported that she submitted the September Report. The Town has issued 30 permits for new homes and equals 1989 . There was an incident where a tree fell on a house that required enforcement of safety issues . There will be an application for changing the towers on Durfee Hill Telecommunication Towers site . The contract with Bill Sitzman needs to be finalized so that he can do the review. Planning Board Report : Robert Roe reported that the Comprehensive Plan joint sessions are moving forward. The Planning Board will be holding a public hearing regarding a Special Permit for the Spencer Van Etten Snowmobile Club. He said that the Town does not have any jurisdiction over the NYS Forest Lands . Recreation Partnership : Councilperson Strichartz reported that she did not attend the last meeting . Supervisor Dietrich attended the meeting and the discussion was related to sponsorship and ways to reduce costs . There is still controversy over the facility part of the contract. Danby Community Council Eileen Wright reported that the Danby Community Council will sponsor a concert on Sunday, October 16, 2002 at 3 : 00 p .m. Program Manager Jessica Miller will be leaving Cooperative Extension at the end of December. The Annual Halloween Party will be at the Danby Fire Station on October 31 , 2002 from 5 - 7 p . m. Community Council has received a $ 500 . 00 Beautification Grant. She asked permission from the Board to plant a 25 foot by 50 foot space on the Town Hall property to plant bulbs and perennials to sell at the Farmers Market. West Danby also received a small grant for a Beautification Project. Senior Citizens Carol Sczepanski reported that at the last meeting on October 3 , 2002 the seniors voted to have their Christmas dinner at the Owego Treadway Inn. The Thanksgiving luncheon will be on November 7 , 2002 at noon and the turkey will be provided. OLD BUSINESS Fieldstone Circle Covenants Members of the Fieldstone Circle Review Board are concerned about the size of a new dwelling now under construction in the development. New covenants that are now being drafted and the group and have asked that the Town endorse the new language . Susan Beeners reported that the subject house now conforms to the proper size as required for building in the development. Information regarding the Fieldstone Covenants has been sent to the Town Attorney for review. NEW BUSINESS : RESOLUTION NO. 77 OF 2002 PUBLIC HEARING DATE SET FOR FISCAL YEAR 2003 BUDGET By Councilperson Gagnon : Seconded by Councilperson Nolte RESOLVED, that the Town Board of the Town of Danby will hold a public hearing at 7 : 00 p .m . on Monday, November 4 , 2002 for the Town of Danby Fiscal Year 2003 Budget . A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Carried Unanimously Supervisor Dietrich and Councilperson Varona-Lacey absent 1203 3 Town Board Minutes October 14, 2002 Budget Workshop Scheduled A motion was made by Councilperson Gagnon and seconded by Councilperson Nolte that the Town Board of the Town of Danby schedule a Budget Workshop with the Highway Department for Wednesday, October 23 , 2002 at 5 : 30 p .m. A roll call vote on the motion resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Carried Unanimously Supervisor Dietrich and Councilperson Varona-Lacey absent Councilperson Gagnon reported that other Budget Workshops are scheduled for Monday, October 21 at 7 : 00 p . m. with Community Council and October 28 , 2002 at 7 : 00 p . m. for the remaining departments . Other workshops may be scheduled if needed. Copies of the Supervisor ' s Tentative Budget are available at the Clerk ' s Office during regular office hours . RESOLUTION NO. 78 OF 2002 APPROVAL OF FINDINGS RELATED TO THE PROPOSED CLASSIFICATION OF THE SEASONAL-MAINTENANCE PORTIONS OF EASTMAN HILL ROAD AND HEISEY ROAD AS MINIMUM MAINTENANCE ROADS By Councilperson Nolte : Seconded by Councilperson Gagnon WHEREAS, the Town Board of the Town of Danby has reviewed the recommendation of the Town of Danby Highway Superintendent that the portions of Eastman Hill Road and Heisey Road that are presently designated as Seasonal Maintenance of Seasonal Use Roads be classified as Minimum Maintenance Roads ; NOW, THEREFORE, IT IS RESOLVED, that the Town Board of the Town of Danby makes the following findings and determinations ; the volume of motor vehicle traffic on such road portions is less than 50 vehicles per day, with the vehicular use of these portions primarily being for recreational purposes ; neither road portion provides principal motor vehicle access to a farm center of operation or year- round residence ; property owners of land abutting the road portions shall continue to have reasonable access to their property; and the users of the road portions traveling at a reasonable and prudent speed, under the circumstances, shall not be placed in a hazardous situation ; and it is further RESOLVED, that the findings and determinations herein along with the recommendation of the Town Highway Superintendent shall be on file and made available for public inspection in the office of the Danby Town Clerk; and shall also be transmitted to the Board of Education of the involved school district for its recommendation. A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Carried Unanimously Supervisor Dietrich absent Councilperson Varona-Lacey absent RESOLUTION NO. 79 OF 2002 ESTABLISHMENT OF LEAD AGENCY AND SETTING PUBLIC HEARING DATE FOR A PROPOSED LOCAL LAW CLASSIFYING CERTAIN ROADS OR PORTIONS THEREOF AS MINIMUM MAINTENANCE ROADS By Councilperson Gagnon : Seconded by Councilperson Nolte RESOLVED, that the Town Board of the Town of Danby is acting as Lead Agency in the 1204 4 Town Board Minutes October 14, 2002 environmental review of a proposed Local Law Classifying Certain Roads or Portions Thereof as Minimum Maintenance Roads, which is an Unlisted Action, with the Tompkins County Department of Planning and the Ithaca City School District Board of Education being involved or interested agencies which are being notified of this action; AND IT IS FURTHER RESOLVED, that the Town Board of the Town of Danby schedules a public hearing to consider enactment of a Local Law Classifying Certain Roads or Portions Thereof as Minimum Maintenance Roads for Monday, December 30 , 2002 at 7 : 00 p .m. A7330 .400 from Youth and Recreation to Town Youth and Recreation . DA5120 .400 to Highway Fund No . DA5110 .400 .
