Sczepanski - Town Clerk Susan Beeners - Code Enforcement Officer Susan Howe - Highway Department Secretary Members of the Public : Bob Roe , Roy Casterline , Ames Brown, Ken Horst, Leslie Shakespeare, Guillermo Metz, Diane Olden, Dan Klein, Suzy Rose, Suzanne Green, Paula Zayac, Meghan Morris, Sarah W. Newman Supervisor Dietrich called the meeting to order at 7 : 00 p . m . and led all present to the Pledge of Allegiance to the American flag. ADDITIONS TO THE AGENDA: 1 ) A request from the reading room to attach a sign to the existing Town Hall sign . 2) A request asking Tcat to consider a portion of Danby as part of an empire zone . 3 ) Appeal to Planning Board Decision - Nine Poets Nature Golf 4) Installation Cost for Internet Service No Board Member objected . PRIVILEGE OF THE FLOOR Councilperson Gagnon asked that a report on trees be added under Old Business . Councilperson Strichartz reported that there will be a concert here on Sunday, September 15 , 2002 at 3 : 00 p . m . It will be outside if there is not rain. The group is "Flapjack" . Carol Sczepanski, Town Clerk reported that she has approached Community Service and it is possible to obtain a handyman through the County for a total of eighty (80) hours . Community Council has approved of funds in the amount of $445 for the Clerk to hire job trainees for records retention assistance for a total of eighty (80) hours . The funds will be reimbursed through Community Council and is part of the services provided to Community Council through Tompkins County Youth Bureau. Sue Howe reported that if the Town is interested in entering into the NYS Early Retirement Incentive Program a public hearing must be set tonight to meet the deadline of adoption of the Local Law. Dan Klein - 56 Durfee Hill Road - is here in support of a noise ordinance in Danby and is looking forward to hearing what the details of that ordinance might be . Guillermo Metz - 103 Durfee Hill Road - is here in support of a noise ordinance. Paula Zayac - 105 Marsh Road - is disturbed by noise and is interested a noise ordinance Suzanne Green - 48 Marsh Road - has recently been affected by loud noise from dirt bikes and supports the idea of a noise Ordinance . Leslie Shakespeare - 145 East Miller Road - is in support of a considering a noise ordinance . Suzy Rose - 56 Durfee Hill Road - suggested a committee such as a Community Dispute Resolution as an alternative to a local law. Supervisor Dietrich suggested that concerned residents may want to develop a committee to work together on a noise problem solution It seems like a reasonable solution for the future . Councilperson Strichartz said that she would welcome some of the residents present helping to form a noise ordinance . . Councilperson Gagnon said that when the Town considered a noise ordinance last time we had unresolved issues that need to be considered before we consider it again. We had conflicting opinions from responsible parties as to whether or not it would add anything that is in State Law. What we would gain if we had a noise ordinance that we do not already have . Councilperson Strichartz said that she thinks that a noise ordinance gives the community more teeth cannot it certainly is not going to hurt . The issue is important . Megan Morris - Summer Intern working with the Planning Board on the Comprehensive Plan . Megan distributed the completed draft plan to the Board for their review. She said that the Planning Board would like to set up a joint meeting with the Town Board to review the draft and to make comments and suggestions . Sarah Newman Chairperson of the Planning Board said that this is for a preliminary review of the plan. She asked the Board to read through the document and let the Planning Board whether they are off base in any particular area. There will be opportunity to make revisions according to the Board ' s concerns that will allow the Planning Board to hold public hearings on the plan . REPORTS : County Representative Frank Proto presented the Town with copies of the County Directory for 2003 and reported the following actions of the Board of Representatives . 1 . T-Cat is working on a five year long range plan ; 2 . Bus Station Site - Under the Green Street parking ramp is the preferred site . 3 ) Changing the Charter for election process for replacement of vacancies is on the next County Agenda, and making the EMC an organization that is specifically .mentioned in the Charter. 4) County Budget - looking at a possible 20% increase in property tax . 5 ) Libraries - The committee is going to set up a meeting for the public . Representative Proto said that he is going to set up public meetings for residents in both Caroline and Danby for comments on the County Budget . EMC - Report Bob Roe reported on the items before the EMC : 1 ) that the EMC did not endorse the dog park because it is State land and they are unwilling to compromise in the area of fencing ; 2) the water quality regarding the lake source cooling ; 3 ) the use of two cycle engines on Cayuga Lake ; Zoning Report: Susan Beeners said that her department has issued permits for 25 new housing starts this year and she expects one more soon. They have issued almost as many as in 1990 and 1991 . Both the Zoning Officer and Building Inspector have passed the exams for the new building codes and the Civil Service Tests on the old building codes . She has been in communication with the Spencer Van-Etten Snowmobile Club regarding the trail through the Danby State Forest . The snowmobile club and a subdivision on Short Road will be addressed by the Planning Board . She is also working on the Town Hall project and she will have an estimate for the oil and stone project for the driveways and parking area soon . 1488 3 Town Board Minutes August 12 , 2002 Planning Board Sarah Newman said the question they want to raise is the issue is the possibility of a joint meeting between the Town Board and the Planning Board to consider the Comprehensive Plan Draft . Recreation Partnership : Councilperson Strichartz reported that at the last Recreation Partnership meeting the County said that they would like to pay less than what it contracted for the services of the cooperation to the County, city and towns. There is a question as to whether or not they can reduce their payment after they have signed into a contract and could other towns and the city do the same . There is concern that programing may be cut. Community Council: Supervisor Dietrich said that the Community Council met with the Town Clerk and they have awarded her funds for a Youth Trainee to work on a records retention project in the vault. The Pond program is very well attended and a parents group is meeting at the same time . Danby Community Park Association : Supervisor Dietrich reported that he has circulated information to the Board regarding the grant award to the Danby Community Park Association. He met with the association and has reviewed the material and there is still some discrepancy as to who will receive the funds . Seasonal) with the following job description. DISTINGUISHING FEATURES OF THE CLASS : This is routine patrol work consisting primarily of patrol tasks performed under direct supervision . Conducts swimming instructions and water safety classes as assigned. Employees in this class must be constantly alert to assist swimmers when they are in difficulty and to enforce safety rules . An error in judgment might result in loss of life . Performs routine patrol work at a pool or bathing beach, looking after the safety and welfare of others . Work is performed under the general supervision of the Swimming Area Director. Does related work as required . 1492 7 Town Board Minutes August 12 , 2002 TYPICAL WORK ACTIVITIES : Stands watch at pools and/or patrols the park waterfront, keeping bathers within bounds and going to their aid when they are in difficulty ; Applies resuscitation techniques and otherwise renders first aid ; May conduct beginning and advanced swimming and diving classes ; Keeps locker rooms , pool side and beach areas free of glass and other debris ; Maintains order and enforces safety rules ; Performs other routine duties such as maintaining and repairing equipment. FULL PERFORMANCE KNOWLEDGE, SKILLS, ABILITIES AND PERSONAL CHARACTERISTICS : Good knowledge of first aide, lifesaving, and rescue work is applied to accidents in the water; good knowledge of current methods used in swimming and diving instruction; ability to swim well ; ability to deal effectively with the public and others and to secure their cooperation; ability to keep records and make simple reports ; good powers of observations; mental alertness ; integrity; excellent physical condition commensurate with the demands of the position MINIMUM QUALIFICATIONS : Completion of two years of high school . SPECIAL REQUIREMENTS FOR ACCEPTANCE OF APPLICATIONS : Eligibility for Red Cross certification as Advance Lifesaver . Possession at time of appointment. A roll call vote on the resolution resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously RESOLUTION NO. 65 OF 2002 RESOLUTION TO ENDORSE THE OUTING PROGRAM OVER TARGET REQUEST By : Councilperson Strichartz : Seconded by Gladys Varona-Lacey WHEREAS, the town Board of the Town of Danby is interested in the well-being of youth of the community, and WHEREAS, the Ithaca Youth Bureau' s Outing Program provides young people throughout Tompkins County with an important adventure-based program in which youth are challenged to make group decisions, work cooperatively, develop new social and physical skills and gain appreciation for the outdoor environment, and WHEREAS, Tompkins County has funded this program for many years, and WHEREAS, county departments have been asked to submit 20% reduction budget proposals for 2003 and the 2003 and the County Youth Board has proposed elimination of funding for the Outing Program for 2003 , and WHEREAS , the Tompkins County Youth Board has endorsed an over target request which would provide full funding for the Outing Program in the amount of $ 132 , 586 . 00 : now therefore , be it RESOLVED , that the Town Board of the Town of Danby does hereby endorse the Outing Program over target request . Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously Borden Appeal - Planning Board Decision - Nine Poets Nature Golf A motion was made by Councilperson Gagnon and seconded by Councilperson Strichartz that the Town Board of the Town of Danby authorizes a refund to Michael Finn $ 100 . 00 of the application fee for Nine Poets Nature Golf if he withdraws his application in writing and that if the application is withdrawn that the fee paid by Ross Bordon for the Appeal to the Town Board of the Planning Board decision will be refunded in full . Discussion : Councilperson Strichartz reported that the Bordens were out of town and did not return until after the public hearing before the Planning Board . Councilperson Gagnon said that there was not a procedural error by the Town. A roll call vote on the motion resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously Trees Committee Report ICouncilperson Gagnon reported that the Road Committee met on July 18 , 2002 . The sense of the group was that they did not think it was desirable at this point to entertain a local law that would regulate the replacement and removal of roadside objects . The preference was for a policy that would essentially be recommendatory to property owners and would be binding on the Highway Superintendent but only to the extent that the Highway Superintendent sign on to it. It would set forth how we were going to deal with each other. A committee was established as a core group and they will extend an invitation to interested residents who may want to serve on the committee . Motion to Set September Agenda Meeting Date A motion was made by Councilperson Gagnon and Seconded by Councilperson Strichartz that the Town Board of the Town of Danby set the date for the September Agenda meeting for Wednesday, September 4, 2002 at 7 : 00 p . m . A roll call vote on the motion resulted as follows : Gagnon Aye Nolte Aye Strichartz Aye Varona-Lacey Aye Dietrich Aye Carried Unanimously RESOLUTION NO . 66 OF 2002 SUPPORTING AND CONCURRING WITH TOMPKINS COUNTY AREA DEVELOPMENT APPLICATION FOR DESIGNATION OF CERTAIN AREAS WITHIN TOMPKINS COUNTY AS AN EMPIRE ZONE By Councilperson Gagnon : Seconded by Councilperson Strichartz WHEREAS, Section 961 of Article 18 -B of NYS General Municipal Law authorizes application by Tompkins County Area Development for designation of Tompkins County as an Empire Zone within the meaning of said statute ; and WHEREAS, such designation could greatly benefit Tompkins County in that new businesses would be encouraged to locate in the zone area, and existing businesses would be encouraged to expand in the zone area and such new and expanded businesses would generate new employment opportunities for Tompkins County residents ; and WHEREAS, Tompkins County intends to authorize submission of an application for designation of areas within Tompkins County as an Empire Zone ; and IWHEREAS, Tompkins County Area Development, in consultation with the Town of Danby wishes to designate certain areas within the Town of Danby as part of the proposed Empire Zone ; and WHEREAS, the Town of Danby is desirous of working with Tompkins County Area Development through the Empire Zones Program to provide enhanced employment opportunities for its residents ; now therefore be it RESOLVED, by the Town Board of the Town of Danby that it fully supports and concurs in the Tompkins County Area Development actions to authorize and submit an application for an Empire Zone designation within the Town of Danby and other areas of Tompkins County .
