TOWN BOARD MEETING
October 2 , ' 1980
At a Special Meeting of the Town Board of the Town of Ithaca ,
Tompkins County , New York , held on the 2nd day of October , 1980 ,
at 7 : 00 P . M . , at the Town of . Ithaca Offices at 126 East Seneca
Street , Ithaca , New York , there were
PRESENT Noel Desch , Supervisor
George Kugler , Councilman
Shirley Raffensperger , Councilwoman
Catherine Valentino , Councilwoman
ABSENT Victor Del Rosso , Councilman
Henry McPeak , Councilman
Marc Cramer , Councilman
ALSO PRESENT Robert Parkin , Highway Superintendent
PLEDGE OF ALLEGIANCE
Supervisor Desch led the assemblage in the Pledge of Allegiance .
PUBLIC HEARING TO CONSIDER THE TENTATIVE
BUDGET FOR BOLTON POINT
Proof of posting and publication of notice of public hearing to
consider the Tentative Budget for Bolton Point having been
presented by the Town Clerk , the Supervisor opened the hearing .
Supervisor Desch stated that overall the expenses for 1981 were
slightly lower than 1980 . Revenue sharing was slightly higher .
He went on , :what are the concepts used to develop a budget . A
year ago , the commitment was made to build in several funds for
ware and tare . This year they have not been increased and further .
There is also a commitment toward bringing the salaries of the
employees up , as salaries are now lower , - in . comparison , than other
parts of the state . There will be no need for a rate increase as
sales are projected to increase .
Councilman Kugler asked if the City of Ithaca had depreciated the
value of the meters sold to Bolton Point ?
Supervisor Desch -answered , that is questionable . It was per their
record keeping . However , it was cheaper to buy from the City then
to buy new meters .
Councilwoman Valentino noted that the request for a riding lawn
mower was . in _ the .budget again . this year .
Supervisor Desch stated that it was a question of who buys it .
The Town has pump stations and parks to mow . .
PUBLIC ,HEARING TO CONSIDER TITHE
TENTATIVE BUDGET FOR THE TOWN OF ITHACA
Proof of posting and publication of notice of public hearing to
consider the Tentative Budget for the Town of Ithaca having been
presented by the Town Clerk , the Supervisor opened the hearing .
Supervisor Desch stated that the Board would find no salary increases
for elected officials . However , there is a 10% increase for the staff .
Town Board Minutes - 2 - October 2 , 1980
The Supervisor noted that the budget includes the 10 - Year Highway
Improvement Plan . He further noted that the fire contract was
higher this year . No contribution figures have been settled on by
Cornell University or Ithaca College for fire services . The Youth
Services also has a large increase this year .
He stated that it would be necessary to increase the Sewer ' Surcharge
from 2% to 7 % to pay for repairs that resulted from the Stearns &
Wheler Sewer System Evaluation . The payback will probably be spread
over a two year period . He also noted that there was not enough
money to hire a consultant to do the Water Improvement Survey , at
this time .
Supervisor Desch stated that last year the credit from the Sales
Tax eliminated the County Tax .
Councilwoman Raffensperger asked if it was the Town choice that
County taxes were paid by the Sales Tax ?
Supervisor Desch said that the County takes to Sales Tax first ,
any amount left over is credit to the Towns .
Supervisor Desch stated that new state law have been passed which
permits municipalities to pass local laws on defense of their
officers . He noted that the Board may want to discuss this later .

Motion by Supervisor Desch ; seconded by Councilwoman Valentino ,
RESOLVED , that the Tentative Bolton Point Budget , as presented ,
( copy attached to the minutes ) is hereby approved as the Preliminary
Budget for the Southern Cayuga Lake Intermunicipal Water Commission
( Bolton Point ) , and
FURTHER BE IT RESOLVED , that the Town Board of the Town of Ithaca
will meet and conduct a public hearing on November 6 , 1980 at
74 : 00 P . M . , at the Town Offices at 126 East Seneca Street , Ithaca ,
to consider the Preliminary Budget for the Southern Cayuga Lake
Intermunicipal Water Commission .

Budget for the Town of Ithaca , and
FURTHER BE IT RESOLVED , that the Town Board of the Town of Ithaca
will meet and conduct a public hearing on November 6 , 1980 at
7 : 30 P . M . , at the Town Offices at 126 East Seneca Street , Ithaca .
to consider the Preliminary Budget for the Town of Ithaca .

SHADY CORNERS SAFETY IMPROVEMENTS
Supervisor Desch stated that on September 29 , 1980 , the Tompkins
County Board of Representatives passed a resolution requesting
safety improvements be made at the Shady Corners - Routes 13 - 96 - 34
intersection . He noted that County Representative , Gust Freeman
was encouraging the Town to also adopt this resolution .
RESOLUTION NO . 173
Motion by Councilwoman Raffensperger ; seconded by Councilwoman
Valentino ,
RESOLVED , WHEREAS , the intersection at the foot of Newfield Hill ,
commonly called Shady Corners , where Route 13 intersects with Routes
34 and 96 south of Ithaca has proven to be a hazardous intersection
resulting in numerous accidents , particularly related to runaway
trucks , and
WHEREAS , there are feasible ways of redesigning the intersection to
improve safety ,
NOW THEREFORE BE IT RESOLVED , on recommendation of the Planning and
Public Works Committe , that the New York State Department of Trans -
portation initiate a program to improve the intersection to increase
safety while at the same time maintaining good traffic flow charac -
teristics .

� � ultwrt 234 - REAFFIRMATION OF ROUTE 96 RECOMMENDATION
Introduced by Mr . Freeman , seconded by Mr . Mason .
WHEREAS , in August of 1978 the Tompkins County Board of Representatives
received the recommendations of the Ithaca -Tompkins County Transportation
Commission regarding the redesign of Route 96 , and
WHEREAS , the Board also received the recommendation of the County Planning
Board which if implemented , would result in improved traffic safety and flow ,
opportunities to overpass the railroad on the north -bound leg and provide for
a new alignment to the hospital area , and -
WHEREAS , the Ithaca - Tompkins County Transportation Commission also
recommended that consideration be given only to those designs that incorporated ,
at least . on the outbound lane , an elevated crossing over the Lehigh Valley
Railroad , and
WHEREAS , the Board also received the recommendation of the Tompkins County
Planning Board that in order to resolve existing traffic problems and provide
for future traffic needs , consideration should be given only to those designs
that include a four - lane highway from the City of . Ithaca to a point near the
Tompkins County Hospital , and
WHEREAS , the Common Council of the City of Ithaca did forward several
proposals for the rebuilding of Route 96 to the New York State Department of
Transportation , and
WHEREAS , four of these proposals incorporated an elevated grade crossing
and a four - lane highway , and
i WHEREAS , the New York State Department of Transportation has now indicated
that its proposed plans for the redesign of Route 96 will not now , and may not
in the future , include provision for an elevated crossing over the railroad ,
rnow therefore be it
RESOLVED , That the Tompkins County Board of Representatives hereby
reaffirms its position as stated in Resolution No . 238 of 1978 and does again
request that the New York State Department of Transportation take in-mediate
action to pursue and implement a design for the reconstruction of Route 96 that
Incorporates an elevated crossing over the railroad and a safe limited - access
highway . to the hospital area ,

Town Board Minutes - 4 - October 2 , 1980
ROUTE 96 PROJECT
Supervisor Desch stated that in the past the Town had taken a stand
on the Route 96 projects . He stated that the Board was being asked
to support a resolution passed by the County Board of Representatives
on September 29 , 1980 ( copy attached to the minutes ) .
Supervisor Desch questioned as to just how strongly the Board wanted
to push the elevated highway project .
Councilwoman Raffensperger stated that there was a lot of confusion ,
always before the Town ' s resolution addressed only the Town ' s portion
of the project .
Supervisor Desch had stuck pretty religiously to supporting a
resolution which effected only the Town ' s portion of the Route 96
project .
The Board decided to take no further position on this matter .
INTERMUNICIPAL BIKEWAY
Councilwoman Raffensperger that the intermunicipal bikeway package
had been prepared . 90% of the project will be federal funding .
The project now need the concurrence of the Town Board so that
funds may be applied for , as soon as possible .
She went on to say the project was estimated to cost $ 200 , 000 .
Town of Ithaca ' s share would be about $ 20 , 000 .
Councilman Kugler asked how many miles will the bikeway cover ?
Councilwoman Raffensperger stated that she did not have a total .

RESOLVED , that the Town Board of the Town of Ithaca supports the
Tompkins County application for funds for the Intermunicipal
Bikeway proposal under the Auto Use Management Program of the

FURTHER RESOLVED , that the Town Board of the Town of Ithaca
authorizes the Tompkins County Department of Planning , acting
for the County of Tompkins , to act as lead agency in seeking
federal funds for bikeway construction .

auditing the warrants for the Town of Ithaca and the Southern

Supervisor Desch noted that there had been a problem with trucks
in Forest Home area and that the Town Engineer would write to
