At a Regular Meeting of the Town Board of the Town of Ithaca , Tompkins County , New York , held on the 7th day of April , 1980 , at 5 : 30 p . m . , at the Town of Ithaca Offices at 126 East Seneca Street , Ithaca , New York , there were : ® PRESENT : Noel Desch , Supervisor Victor Del Rosso , Councilman Marc Cramer , Councilman Catherine Valentino , Councilwoman Shirley Raffensperger , Councilwoman Henry McPeak , Councilman ABSENT : George Kugler , Councilman ALSO PRESENT : James V . Buyoucos , Town Attorney Lawrence Fabbroni , Town Engineer Robert Parkin , Highway Superintendent Lewis Cartee , Building Inspector Henry Aron , Planning Board Chairman Gust Freeman , County Board of Representatives George Gesslein , Citizens Savings Bank Nancy Fuller , Deputy Town Clerk Representatives of the Media : Donna Kessler , WTKO Matt Leone , Ithaca Journal Eva Raimon , WHCU PLEDGE OF ALLEGIANCE Supervisor Desch led the assemblage in the Pledge of Allegiance . REPORTS OF TOWN OFFICIALS TOWN SUPERVISOR Cornell / Town Mutual Interests I am working with Randy Shew , Cornell Director of Community Relations to develop an agenda for a joint work session with appropriate Cornell officials , and I need your input on topics that should be discussed . ® Of particular priority will be the following : ( 1 ) Forest Home by pass and other circulation needs . ( 2 ) East Ithaca bikeways . ® ( 3 ) Transportation - i . e . , East Ithaca . ( 4 ) Water and sewer . ( 5 ) Fire Protection Service and costs . Tompkins County Transportation Commission I would like to add an agenda item - appointment of Henry McPeak to the Tompkins County Transportation Commission . We need to continue our efforts to see that service is extended to East Ithaca and the broader effort of County wide service . District #2 Polling Place The new District # 2 polling place at the Highway Facility worked out very well for the Primary . We need a few minor changes such as lighting the entrance and providing signs so that new registrants can find 7 Mile Drive and the Highway building . ! 7J Town Board Minutes - 2 - April 7 , 1980 Critical Objectives In the coming months , the pace of major decisions will quicken as we enter the last stage on the revision of the Zoning Ordinance , develop the plan for funding youth services , reach the critical phase of dis - cussion with the City on joint operation and owning of the waste water facility and several other projects . These commitments will mean more frequent board meetings , more midnight oil on the part of the Town Staff and Town Committees , so be prepared to make a heavy time commit - ment . Joint City / Town Projects A reminder of the meeting on April 14th , the City will host the first session on the review of the Youth Services study , developed by the Human Services Coalition . At our request , Town Youth Committee and ® Board Members are encouraged to attend . These studies will have im - portant implications for the future . On April 22nd, the Public Hearing on the Environmental Impact Statement for the City of Ithaca Waste Water Treatment Facilities Plan will be held in Common Council . The Sewer System Planning Committee has ap - pointed two short lived subcommittees , one to propose a system of pay - ing for the handling and treatment of septage and a second to conduct appraisal of the real estate , which will be committed to the new operation by the City . COMMITTEE APPOINTMENT RESOLUTION NO . 57 Motion by Supervisor Desch ; seconded by Councilman Cramer , RESOLVED , that the Town Board of the Town of Ithaca hereby appoints Councilman Henry McPeak as the Town of Ithaca representative on the Tompkins County Transportation Committee . ( Desch , Del Rosso , Cramer , Valentino , Raffensperger and McPeak voting Aye . Nays - none ) . TOWN ENGINEER Town Engineer Lawrence Fabbroni reported on the progress of the sewer system evaluation . The sewage flow is now being measured in the Town , with West Hill , where the older sewers are , being done first then moving on to South Hill . It will be manhole to manhole coverage . The City sewers will be studied in the second phase . The CETA workers program has been delayed until May lst , because of paper work on the State level . Mr . Fabbroni further stated that the Donovan Plan has been submitted . It has been approved by the County Board of Representatives . CITIZENS SAVINGS BANK George Gesslein , Vice President of Citizens Savings Bank represented the Bank in their request for a variance to allow their sign at the East Hill Plaza to remain . He stated that he believed the sign was within the spirit and intent of the Sign Ordinance . All shops have signs on the walkway and if their sign was not permitted , pedestrians would find it difficult to locate their particular facility . He further stated that he believed the variance should be granted , as the sign was in good taste and serves a definate purpose . Supervisor Desch stated that the sign was rejected on the basis of cleaning up all non - conforming signs in that area . However , the Supervisor noted that no complaints have been received on the Citizens Town Board Minutes - 3 - April 7 , 1980 Savings Bank sign . Mr . Gesslein felt . the only immediate solution was to take down the sign and make it smaller . However , he noted that the top sign is smaller than permitted . By adding the measurements of the two signs together , the total was only about three square feet over the allowable measure - ment . Supervisor Desch said he saw no problem with the Citizens sign . Councilwoman Valentino asked if any other stores in the area were not in compliance ? Councilwoman Raffensperger asked if What ' s Your Beef was now in compliance ? Mr . Fabbroni stated that What ' s Your Beef was not in compliance , as they lost twenty feet of their forty feet frontage . He noted that Rite Aid had reduced the size of their sign . Councilwoman Raffensperger stated , she felt the variance was denied because of the memory of the P & C Store . Councilwoman Valentino stated that it took a lot of hard work to bring the signs at the East Hill Plaza into compliance , and if Citizens were allowed to remain , there will be problems with others in the area . Mr . Fabbroni responded by saying that the Building Inspector would be able to pick up violations before new tenants move into the stores . Henry Aron , Planning Board Chairman stated that when the new Sign Ordinance is passed , all signs which are not in compliance will have to be changed , at some point in time . Mr . Fabbroni stated that the limit is still the same in the new ordinance as was in the old ordinance . Changes in the ordinance have to do more with free standing signs . Councilwoman Raffensperger stated that she felt that the Citizens sign exceeded the limit by such a small amount , that the variance should be granted . RESOLUTION NO . 58 Motion by Councilwoman Raffensperger ; seconded by Councilman McPeak , RESOLVED , that the Town Board of the Town of Ithaca hereby grants the sign variance requested by the Citizens Savings Bank for their branch office at the East Hill Plaza . ( Desch , Del Rosso , Cramer , Raffensperger and McPeak voting Aye . Nays - Val:eiztino ) . Mr . Gesslein stated that the bank was willing to change the sign to compliance with the Sign Ordinance , when the present sign wore out and needed replacing . Councilwoman Raffensperger asked about the signs in the windows , will the new Zoning Ordinance take care of these ? Mr . Fabbroni answered yes . RESOLUTION NO . 59 Motion by Councilman Cramer ; seconded by Councilman Del Rosso , RESOLVED , that the Town Board of the Town of Ithaca hereby approves the sign applications of Evan N . Monkemeyer of 123 King Road , East ; / 73 Town Board Minutes - 4 - April 7 , 1980 Ithaca Seventh - day Adventist Church of 1219 Trumansburg Road and Benson Motors of 1103 Danby Road , these signs being recommended for approval by the Planning Board and no variances are involved . ( Desch , Del Rosso , Cramer , Raffensperger , McPeak and Valentino voting Aye . Nays - none ) . Supervisor Desch introduced Dr . Richard B . Fischer , who spoke on the Gypsy Moth . ® Dr . Fischer stated that the U . S . D . A . sprays gypsy moths because Congress authorized them to do so . U . S . D . A . has been spraying since 1906 and have spent millions of dollars on the project . After spend - ing all this money , they have been unable to bring the moth under control . Four places in this area are scheduled for spraying this year , namely Robert Treman State Park , Taughannock Falls State Park , Spruce Row Camp Grounds and Willow Wood Camp Grounds . The camping areas were chosen to be sprayed , so that the larva will not be carried to other areas . Buttermilk State Park will not be sprayed because the infes - tation is low in this area . The U . S . D . A . endorses all plans of spraying . Dr . Fischer further stated that spraying the gypsy moth was like thinning carrots in a garden , you yield hardier carrots from the survivors . The same thing happens to the gypsy moth . There are 224 species of insects that are now immune to spray . Pesticides cause the gypsy moth to become immune so that in heavy sprayed areas , more egg masses are found the next - year after spraying . Tent caterpillars are a good example . As several years ago there were large masses of them , now they are not as plentiful . Nature does a better job than man , in reducing an over population . Dr . Fischer noted that the area is in a period of gypsy moth decline and it was a fact of life , not spraying that controlled them . Sevin 80S spray is used in our area and this is most toxic to honey bees . Dr . Fischer asked , why use it if it kills honey bees ? If we have no bees , we will have no apple trees because the bees pollinate them . Bees also pollinate flowers , wild apple trees , which feed the deer , and other fruit and nut trees . Sevin is also toxic to small critters in streams and woods . It will kill the preditors who eat gypsy moth . Mice are most important in killing gypsy moth lavva . People come in contact with water which has spray in it , and Sevin 80S has been identified as a cause of birth defects in humans . ® Dr . Fischer stated that there are alternatives to spraying , and this is through management control . There are bacteria virus and preditors which take care of population . ® Dr . Fischer suggested that the Town draft a resolution asking the United States Department of Agriculture to defer spraying . Henry Aron stated that he had been on the west coast and had seen the damage inflicted to trees by the Gypsy Moth compared to fire damage . The damage inflicted by the Gypsy Moth was far greater than that done by fires , as trees effected by the Gypsy Moth are completely killed , however , the trees in a fire grew again . Big lumber companies are doing a great job to reduce the Gypsy Moth . They are spraying from the air . Also , lumber companies are hiring professional forestors , who are reducing the Gypsy Moth . Mr . Aron noted that the lumber companies in the south are also very much con - cerned with. the Gypsy Moth , Dr . Fischer stated that the south favors biological control , not spraying . 7 '� Town Board Minutes - 5 - April 7 , 1980 Councilman Del Rosso asked if the Gypsy Moth larva was artificially spread by cars and campers ? Dr . Fischer said yes . However , they also are spread in natural ways , such as cob webs and the wind . Councilman Del Rosso suggested that a representative from the U . S . Department of Agriculture be allowed to present their side . Supervisor Desch then asked Gus Freeman what the County Board of ® Representatives intended to do ? County Representative Freeman stated that the County has not reached a decision yet on whether spraying should be banned . However , the ® final decision will be the Counties . Supervisor Desch thanked Dr . Fischer for his presentation on the Gypsy Moth . PLANNING BOARD CHAIRMAN Henry Aron reported that the Town of Ithaca Planning Board met in regular session on Tuesday , March 18 , 1980 , with six members present . The minutes of that meeting have been distributed to you and so I will make my report brief . An adjourned public hearing was held on the matter of the WVBR request for installation of a radio broadcasting antenna transmitting tower at 245 Bundy Road . Several persons were in attendance and discussion was lengthy . The following resolution was adopted by the Board : RESOLVED , that this Public Hearing in the matter of consideration of the request of Cornell Radio Guild , Inc . d / b / a / k1VBR , for installation of radio broadcasting antenna transmitting tower , 245 Bundy Road , Town of Ithaca Tax Parcel No . 6 - 27 - 1 - 7 , as adjourned from February 29 , 1980 , be and hereby is further adjourned to April 1 , 1980 , at 7 : 30 p . m . , because said Planning Board is discussing with the Town Attorney whether such Board has any jurisdiction in this matter and on what basis it is . The Planning Board members were pleased to hear reports from Council - woman Shirley Raffensperger on the activities of the County Planning Board and the Sewer System Evaluation Planning Committee . The following applications for Sign Permits were reviewed and recommended to the Town Board for approval : 1 . 7th Day Adventist Church , Trumansburg Road . ® 2 . Benson Motors , 1103 Danby Road . 3 . What ' s Your Beef ? , East Hill Plaza . The Sign Ordinance Committee has met and the semi - final draft has been re - typed and final review will take place at the April 15th , meeting of the Planning Board , The April 1st , 1980 , meeting of the Planning Board was postponed to April 15th , 19800 BUILDING INSPECTOR The Building Inspector ' s report showed five building permits were issued in March 1980 , for a total construction cost of $ 1 , 008 , 000 . 00 . Total fee received by the Town was $ 285 . 00 . In March of 1979 , no building permits were issued . HIGHWAY SUPERINTENDENT Highway Superintendent Robert Parkin reported that the highway crew J 7 J Town Board Minutes - 6 - April 7 , 1980 have been making repairs to the shoulders during the past month . They have also been cleaning ditches , flushing out culverts and brooming intersections to clean the sand left during the winter sandings . The men have started spring patching of roads , they also are working on the salt shed , laying the concrete rail . Mr . Parkin reported he has posted all necessary signs in the Forest Home area . The work on the ventilating system has been completed . The conversion of the heating units from fuel oil to natural gas is almost completed . Two units still need to be installed . ® He reported that the highway facility was broken into on March 27 , 1980 . One of the pick up trucks was taken , however , it was recovered un - damaged . ® Superintendent Parkin noted that paving costs will be very high this year . Oil that cost the Town sixty cents last year will start at ninety cents this year and there will be day to day price changes . SPRING CLEAN - UP DAY RESOLUTION NO . 60 Motion by Supervisor Desch ; seconded by Councilwoman Valentino , RESOLVED , that Spring Clean - up Day for the Town of Ithaca is hereby established as Monday , May 5 , 1980 . ( Desch , Del Rosso , Cramer , Valentino , Raffensperger , and McPeak voting Aye . Nays - none ) . SENIOR CITIZENS MONTH RESOLUTION NO . 61 Motion by Supervisor Desch ; seconded by Councilwoman Raffensperger , RESOLVED , that the Town Board of the Town of Ithaca hereby proclaims the month of May as Senior Citizens Month . ( Desch , Del Rosso , Cramer , Valentino , Raffensperger , and McPeak voting Aye . Nays - none ) . BOOKKEEPER TO THE SUPERVISOR Supervisor Desch reported that the State will not allow the Town of ® Ithaca to have three Deputy Town Clerks . Therefore , the Tompkins County Personnel Department has requested the Town personnel , in the Deputy positions , be reclassified into appropriate job titles . Cynthia Schoffner , a Deputy Town Clerk , has been filing the position of Bookkeeper for sometime and has not performed the duties of a Deputy Town Clerk . Supervisor Desch noted that Mrs . Schoffner has attended double entry bookkeeping school and , therefore , he would propose that Mrs . Schoffner be classified as the Supervisor ' s Bookkeeper , an exempt position . RESOLUTION NO . 62 Motion by Supervisor Desch ; seconded by Councilman McPeak , RESOLVED , that the Town Board of the Town of Ithaca hereby reclassifies the job title for Mrs . Cynthia Schoffner from Deputy Town Clerk to Supervisor ' s Bookkeeper . AM J 7V Town Board Minutes - 7 - April 7 , 1980 ( Desch , Del Rosso , Cramer , Valentino , Raffensperger , and McPeak voting Aye . Nays - none ) . NORTHEAST TRANSIT Lawrence Fabbroni discussed the proposed summer schedule for the North - east Transit which was discussed at a Transit meeting held on March 31 , 1980 . The summer schedule will be the same as the holiday schedule . A survey of the holiday schedule found the ridership to be 55 % permanent ® Ithaca residents . Therefore , some basic service should continue through the summer , so that riders will not have found other means of transpor - tation and , therefore , not use the transit system in the fall . Rider - ship was up even though we had a mild winter . He further stated that the Town Board was being asked tonight to con - sider the summer schedule which will have two runs in the morning and two runs in the afternoon . ( Schedule attached to minutes ) . The cost to the Town will be $ 1 , 000 . 00 for bus service from May 19 , 1980 to August 31 , 1980 . Councilwoman Valentino asked who are the permanent residents , are they people who work downtown or Cornell students ? Mr . Fabbroni noted that 55 % of the ridership were employed people and grad students . 45 % were undergraduates . Councilwoman Raffensperger noted that it was necessary to have a summer schedule to keep the winter people riding . Mr . Fabbroni noted that the current fair was 35 (,% for strip tickets , 40 (,% for cash fair . In August strip tickets will increase to 45 � and cash fair to 50 (� . RESOLUTION N0 , 63 Motion by Councilman McPeak ; seconded by Councilwoman Valentino , RESOLVED , that the Town Board of the Town of Ithaca hereby authorizes the expenditure of $ 1 , 000 to implement the summer bus run schedule from May 19 , 1980 to August 31 , 1980 . ( Desch , Del Rosso , Cramer , Valentino , Raffensperger and McPeak voting Aye . Nays - none ) . County Representative Gus Freeman noted the Hospital bus run had saved the Social Services $ 1 , 200 . ® TOWN HALL REPAINTING ® Bids for repainting the Town Hall were opened on April 3 , 1980 . The apparent low bidder was V . Giordano Construction & Supply of Ithaca at $ 13 , 500 . Town Engineer Fabbroni recommended that the Town Board accept the low bid of V . Giordano Construction & Supply . Councilman Del Rosso asked what # 2 , # 3 and # 5 on the bid summary sheet were ? ( Bid Summary Sheet attached to the minutes ) . Mr . Fabbroni stated # 2 was a sealer that is injected to seal the mortar and bricks . # 3 is a paint sealer and # 5 is like a paint coat or an overcoat after plastering . Councilwoman Raffensperger asked what the date of completion was ? Mr . Fabbroni stated October 1 , 1980 , was the scheduled date of completion . Town Board Minutes - 8 - April 7 , 1980 RESOLUTION N0 , 64 Motion by Councilman Del Rosso ; seconded by Councilman Cramer , RESOLVED , WHEREAS , on April 3 , 1980 , bids were received for the painting of the Town Hall exterior , for the Town of Ithaca , New York , and WHEREAS , the Town Board has carefully considered the Engineer ' s Report on these bids and has adopted a budget of $ 15 , 500 for said ® project , ® NOW THEREFORE , BE IT RESOLVED , that the award be made of contracts for painting to the following : ® V . Giordano Construction & Supply Corp . P . O . Box 668 602 Hancock Street Ithaca , New York for the contract sum of $ 13 , 500 as submitted in the bids and contract documents . This resolution is subject to compliance by the Contractor in furnishing all documents and items required by the bid and contract documents to the reasonable satisfaction of the Town representatives and subject to proper execution of all required documents by the Contractor and by the Town Supervisor and subject to compliance with all applicable law . REPAINTING OF TRUMANSBURG ROAD , NORTHVIEW ROAD ND TROY ROAD WATER TANKS The apparent low bidder on the repainting of these water tanks was Broome Industrial Painting , Inc . , of Binghamton , New York . Therefore , it was recommended by the Town Engineer , that Broome Industrial Painting , Inc . , be awarded the bid . RESOLUTION NO . 65 Motion by Councilman Del Rosso ; seconded by Councilman McPeak , RESOLVED , WHEREAS , on March 28 , 1980 , bids were received for repainting of the Trumansburg Road , Northview Road and Troy Road Water Storage Tanks , for the Town of Ithaca , New York , and ® WHEREAS , the Town Board has carefully considered the Engineer ' s Report on these bids and has adopted a budget for said project , ® NOW THEREFORE , BE IT RESOLVED , that the award be made of contract for repainting to the following : Broome Industrial Painting Company , Inc . for the contract sum of $ 33 , 733 . 00 as submitted in the bids and contract documents . This resolution is subject to compliance by the Contractors in furnishing all documents and items required by the bid and contract documents to the reasonable satisfaction of the Town representatives and subject to proper execution of all required documents by the Contractor and by the Town Supervisor , and subject to compliance with all applicable law . Town Board Minutes - 9 - April 7 , 1980 CATHODIC PROTECTION TRUMANSBURG ROAD AND NORTHVIEW ROAD TANKS Town Engineer Fabbroni reported that he had received a proposal from Wallace & Tiernan for cathodic protection for the Trumansburg Road and Northview Road tanks . He recommended the acceptance of the proposals of $ 4 , 975 . 00 for the Northview Road tank and $ 4 , 990 . 00 for the Trumansburg Road tank . The money to install the protection was budgeted and the proposals are within the budget figure . ® RESOLUTION N0 , 66 Motion by Supervisor Desch ; seconded by Councilwoman Valentino , RESOLVED , that the Town Board of the Town of Ithaca hereby accepts the proposal of Wallace & Tiernan for the installation of cathodic protec - tion for the Trumansburg Road tank at $ 4 , 990 . 00 and the Northview Road tank at . $ 4 , 975 . 00 . ( Desch , Del Rosso , Cramer , Valentino , Raffensperger , and McPeak voting Aye . Nays - none ) . AWARD BID - PICK UP TRUCK Bids for a new pick up truck for the Highway Department were reviewed . The apparent low bidder was William T . Pritchard , Inc . , of Ithaca for a 1980 Dodge D 150 2 ton pick up at $ 6 , 021 . 33 . RESOLUTION N0 , 67 Motion by Councilman Del Rosso ; seconded by Councilman McPeak , RESOLVED , that the Town Board of the Town of Ithaca hereby accepts the apparent low bid of William T . Pritchard , Inc . , of $ 6 , 021 . 33 for a 1980 Dodge D 150 2 ton truck . ( Desch , Del Rosso , Cramer , Raffensperger , Valentino , and McPeak voting Aye . Nays - none ) . AWARD BID - ONE - WAY SNOW PLOW The one bid received for a new one - way snow plow was reviewed by the Board . Motion by Supervisor Desch ; seconded by Councilman Cramer , RESOLVED , that the Town Board of the Town of Ithaca hereby accepts the bid of Charles J . Blackwell , Inc . , of Horseheads , New York for a new one - way Frink snow plow , Model No . 640 SK , for $ 2 , 840 . ( Desch , Del Rosso , Cramer , Raffensperger , Valentino , and McPeak voting Aye . Nays - none ) . AWARD BID - REPAIRS ON GALION GRADER Superintendent Parkin noted that one year ago , State Equipment bid $ 5 , 993 . 00 for grader repairs . This year State Equipment of Syracuse , New York was the lone bidder . Bidding $ 8 , 463 . 04 for repairs to be made at the Town Highway Facility and $ 8 , 107 . 04 for repairs made at their shop via Town delivery of grader . Mr . Parkin noted that Tompkins County would charge the Town $ 250 . 00 for delivery , therefore , he recommended the acceptance of the bid of $ 8 , 463 . 04 for repairs to the grader . These repairs to be made at the Highway Facility . 17 ' Town Board Minutes - 10 - April 7 , 1980 Councilman Del Rosso asked what the value of the grader would be after the repairs were made ? Superintendent Parkin stated the grader would be valued at $ 20 , 000 plus . He noted a new grader would cost between $ 60 , 000 and $ 70 , 000 . He further stated that the machine itself was not hurt . Councilman Cramer asked about rebidding , as State Equipment was the only bidder ? ® Superintendent Parkin did not think this was a good idea because only State Equipment handle parts for the Galion Grader . STONE QUARRY ROAD Town Engineer Lawrence Fabbroni noted Board approval was needed for a change order in the amount of $ 1 , 497 . 12 . The change order was necessary because they were unable to get a 600 foot easement and the contractor had to by pass a section of land . COUNTY REPRESENTATIVE REPORT ® Beverly Livesay stated that she would like input from the Board members on the resolution passed regarding the Donavan Plan . What are the plans for the problem areas ? It was recommended that the bond money be spent on repaving costs . If the County has extra money , it , could be spent on Town roads . She asked how the County should use its money ? Mrs . Livesay felt repaving should be done on a priority basis . She felt a top priority was to decide what the money should be spent for . An overview was needed on all of the problems in the County and Town . Mrs . Livesay wondered if the Town would like a meeting to discuss the uses of the old hospital . Supervisor Desch noted that Harris Dates was writing him a letter asking for ideas on a use for the old hospital . J 7 Town Board Minutes - 11 - April 7 , 1980 Mrs . TOWN ATTORNEY REPORT Town Attorney James Buyoucos stated that he , Barbara Restaino and Lawrence Fabbroni were going over the proposed SEQR Law . He asked if the Town Board members had read the proposed SEQR Law , and if they understood it ? ® Mr . Buyoucos stated there were several items to be clarified . One in particular being , who will be lead agency . ® EAST HILL PLAZA TRAFFIC The East Hill Plaza traffic problem was discussed . Councilwoman Raffensperger stated that the entrance proposed to the Planning Board originally , was only an entrance , however , when the proposal was presented to the Town Board it became an entrance and an exit . Henry Aron stated that Councilwoman Raffensperger was right , the original plans were for one - way in and one - way out . Councilman McPeak of the Traffic Committee and Town Engineer Fabbroni will study the problem . Supervisor Desch suggested he talk to Mr . Stewart Knowlton . It was felt that the Texaco Gas Station would not permit this change in the entrance and exit . ) 79 Town Board Minutes - 12 - April 7 , 1980 FIRE - LIFE SAFETY CODE Building Inspector Cartee noted the fire at the Holiday Inn in Greece , New York , a year ago . He noted the many hotels and motels in this area . Also , the fact that Cornell had purchased the old IOOF building to be used as Statler , West . The Town does not have a fire safety code . The County Health Department ' s enforcement is strictly in the food and water areas . Lately , he has received a few fire and life safety questions . ® It was felt that the County Health Board should bring the problem to the attention of the County Representatives . It was also felt that more information on a fire safety code was needed before a recommendation could be made . Town Attorney Buyoucos noted that he was following a liability of officials actions case that was winding its way through the courts . The Town can protect its employees and officials , however , a local law or ordinance would be needed to provide such protection . He suggested the Town Board think about taking such action . Mr .
